The relationship between law and morality is a topic which receives special importance and attention, especially in "liberal democracies" in which the law is supposed to regulate highly pluralized and fragmented societies. Under conditions of plurality of values, many social forces and legal theories require a certain kind of neutrality from the legal system, a means of compatibility of the many "world views" and "moral systems" that are present within the same social space. Such a conciliating commitment (...) sounds particularly relevant in times of the doctrinal ubiquity of ideas such as "peace based on human rights". This was the title of the 28th World Congress of the IVR in Lisbon, with the special workshop "Law and Morals" on which this book is based. Today, the earth is an interconnected globe humming with electronic transmissions-a chattering planet nestled in the provident silence of space. The ethical question is whether this is contributing to authentic human development and helping individuals and peoples to be true to their transcendent destiny. The new media are powerful tools for education, cultural enrichment, commercial activity, political participation, intercultural dialogue and understanding. They also can serve the cause of religion. Yet the new information technology needs to be informed and guided (...) by solidarity in the service of the common good bridging the digital divide within and among nations. The value-laden message of Western secular culture to people and traditional societies in many cases ill-prepared to evaluate it leads to widespread crisis, for example, in regard to marriage and family life. This technology can be a means for solving human problems, promoting the integral development of persons, creating a world governed by justice, peace, and love. It also can help men and women in their age-old search for self-understanding. Like today's world itself, the world of media, including the Internet, has been brought by Christ, inchoately yet truly, within the boundaries of the kingdom of God and placed in service to the word of salvation. It is not uncommon to hear that poor school performance, welfare dependancy, youth unemployment, and criminal activity result more from shortcomings in the personal makeup of individuals than from societal forces beyond their control. Are American values declining as so many suggest? And are those values at the root of many social problems today?Shaped by experience and public policies, people's values and social norms do change. What role can or should a democratic government play in (...) shaping values? The volume comprises a selection of papers delivered at the 24th IVR World Congress. All papers address the challenge of the construction of a Global Ethics in the context of fragmented and pluralist societies, in which the idea of an Ethical Space seems to be an unachievable project, but also an indispensable device for cooperation between individuals, communities and states.The idea of a Global Ethics is to be constructed from within different traditions and environments with a mutual understanding and exchange (...) of opinions. In this volume, we combine the ideas of Harmony (typical of the traditional Chinese legal philosophy) and of the Rule of Law (as it is understood in Western societies) to new ideals. By acknowledging the potential that these ideals have on a global scale, the papers of the first section, Ethical Dimensions of the Rule of Law address some of the key ethical problems in today's world. In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed (...) research proposals when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. “Career value” is the name of a kind of value I used (or perhaps I coined) in my classification of value according to good things in life based on the law of nonreplaceability. I classify value into seven classes: (1) health value, (2) sentimental value, (3) economic value1, (4) belief value, (5) environmental value, (6) social value, and (7) career value. Career value refers to the extra value of the most important work, which one wants to do and actually (...) does in one’s life time, for oneself. In Section 2, I explain the nature of career value, which is different from the natures of all other values. In Section 3, I discuss various career values themselves. Career value has several different forms, depending on the nature and size of career. Finally, I conclude that, except for economic value3, which isunsuitable and unreasonable to be a career value, the pursuit of any kind of a nonmaterial career value is a good thing and conforms to the maximization of social utility in utilitarianism. On the winter morning of 16 June 1976, fifteen thousand black children marched on Orlando Stadium in Soweto, carrying slogans dashed on the backs of exercise books. The children were stopped by armed police who opened fire, and thirteen-year-old Hector Peterson became the first of hundreds of schoolchildren to be shot down by police in the months that followed. If, a decade later, the meaning of Soweto’s “year of fire” is still contested,1 it began in this way with a symbolic (...) display of contempt for the unpalatable values of Bantu education, a public rejection of the “culture of malnutrition” with which blacks had been fed.2 The local provocation for the Orlando march was a ruling that black children be taught arithmetic and social studies in Afrikaans—the language of the white cabinet minister, soldier, and pass official, prison guard, and policeman. But the Soweto march sprang from deeper grievances than instruction in Afrikaans, and the calamitous year that passed not only gave rise to a rekindling of black political resistance but visibly illuminated the cultural aspects of coercion and revolt.The children’s defacement of exercise books and the breaking of school ranks presaged a nationwide rebellion of uncommon proportion. The revolt spread across the country from community to community, in strikes, boycotts, and street barricades. It represented in part the climax of a long struggle between the British and Afrikaans interlopers for control over an unwilling black populace and was at the same time a flagrant sign of the contestation of culture, an open declaration by blacks that cultural value, far from shimmering out of reach in the transcendent beyond, would now be fought for with barricades of tires, empty classrooms, and precocious organization. 1. The following article is a reflection on the value of peace, a term often attributes to the absence of war or the lack of violence, conflict, suppression or, in short, phenomena considerer opposite to peace. But, is this really how peace should be defined? It is a fact that peace, be it personal inner peace or peace within a society, is constantly threatened, attacked, violated, and destroyed by a variation of causes: the failure to keep a promise, the breach of (...) a contract, obtained by illegitimate means, economical ambitions, diverse geo-political strategies, anarchy, social pressure, the lack of understanding on an interpersonal level, a family crisis, immaturity, unemployment, acts of injustice, poverty, the failure to adapt, discrimination, migration, terrorism, arms trafficking, civil wars, the threat of a world war and the usage of weapons of mass destruction, etc.; factors that take away peace, among men and women, societies, and entire countries. But…what is peace? Why do we struggle so much to obtain it? Why is it so appreciated by the majority mankind? Why have humanists, philosophers, politicians, civil right organizations, and men of good will in general dealt with this topic in such an extended manner? Why it has written so much about peace? Why peace is so fragile? These are some of the questions that I will try to answer in this contribution, using some of the texts of St. Augustine, Hobbes, Rousseau, Kant, and Hegel as reference. The ‘death of evidence’ issue in Canada raises the spectre of politicized science, and thus the question of what role social values may have in science and how this meshes with objectivity and evidence. I first criticize philosophical accounts that have to separate different steps of research to restrict the influence of social and other non-epistemic values. A prominent account that social values may play a role even in the context of theory acceptance is (...) the argument from inductive risk. It maintains that the more severe the social consequences of erroneously accepting a theory would be, the more evidence is needed before the theory may be accepted. However, an implication of this position is that increasing evidence makes the impact of social values converge to zero; and I argue for a stronger role for social values. In the following, I will discuss the current social reaction to the ecological crisis and the ways in which society reacts to technological risks, which can be understood primarily as a reaction to scientific and moral or ethical uncertainty. In the first section, I will clarify what is meant by scientific and moral or ethical uncertainty. In the second section, I will contrast Max Weber's differentiation of science, law [Recht) and morality in the modern world with the process of (...) de-differentiation of these value spheres, a trend which can be observed in the present-day context of the ecological crisis and technological risks. We shall see that social contradictions emerge in the functional relationships between these value spheres, and that such contradictions go hand in hand with these value spheres or contexts of discourse either losing their original function or becoming transformed. Science forfeits its role as a functional authority and becomes a strategic resource for politics. Law becomes a basic constituent of an amoral form of negotiation, which can no longer be properly grasped in terms of legal categories. Morality is transformed into fear, and economics yields unprofitable practices. In the third section, I will in attempt to open up the moral and ethical dimension of how to deal with uncertainty with the help of discourse theory (Apel, 1988; Habermas, 1996), as well as outline a possible solution. PURPOSE: The purpose of this paper is to consider some of the philosophical and bioethical issues raised by the creation of the draft social values framework developed to facilitate data collection and country-specific presentations at the inaugural workshop on "Social values and health priority setting" held in February 2011. -/- DESIGN/METHODOLOGY/APPROACH: Conceptual analysis is used to analyse the term "social values", as employed in the framework, and its relationship to related ideas such as moral (...) values. The structure of the framework (process and content values) is considered in light of current debate in philosophy and bioethics about the political and moral aims served by these kinds of values, and the extent to which they are either suited to, or sufficient for, the policy context. -/- FINDINGS: There is much to be gained by engaging with the arguments presented in the philosophical literature in order to further refine the framework. The framework should remain neutral in respect of the importance of procedural values in different contexts and should be as inclusive as possible in respect of the principles it includes. Further development would be best served by taking a multidisciplinary approach. The framework could provide a valuable space in which future debates about procedural/substantive values can be considered. -/- ORIGINALITY/VALUE: The paper brings philosophical and bioethics perspectives to bear on a new framework proposed for the analysis of social values in health priority setting. It identifies how such a practical, policy-focused framework might be informed by engagement with deeper, and often unresolved, questions or principle around resource allocation in health. (shrink)

Despite the growing importance of ‘social value’ as a central feature of research ethics, the term remains both conceptually vague and to a certain extent operationally rigid. And yet, perhaps because the rhetorical appeal of social value appears immediate and self-evident, the concept has not been put to rigorous investigation in terms of its definition, strength, function, and scope. In this article, we discuss how the anthropological concept of liminality can illuminate social value and differentiate and reconfigure (...) its variegated approaches. Employing liminality as a heuristic encourages a reassessment of how we understand the mobilization of ‘social value’ in bioethics. We argue that social value as seen through the lens of liminality can provide greater clarity of its function and scope for health research. Building on calls to understand social value as a dynamic, rather than a static, concept, we emphasize the need to appraise social value iteratively throughout the entire research as something that transforms over multiple times and across multiple spaces occupied by a range of actors. Proponents of care ethics tend to reject the ideals of historical republicanism and the enlightenment because they do not take into account the centrality of the roles played by carers or caregivers in society. Furthermore this is irremediable because of enlightenment’s prizing of reason over and above emotions and of independence over relationships. In this paper I argue that such a wholesale rejection is misguided because it is based on a fundamental misunderstanding of the ideals of enlightenment and republicanism which (...) did value both the emotions and relationships. I focus on the example of one feminist republican writer of the eighteenth century, Sophie de Grouchy, and argue that her response to Adam Smith’s Theory of Moral Sentiments, the Letters on Sympathy provide a model for a feminist republican social reform. I discuss de Grouchy’s arguments on the relationship between sympathy and morality, and on the kind of social and political reforms which are needed in order to ensure that sympathy can operate freely as a regulator of human interactions. I also show how her claim that sympathy originates in the first human relationships, namely between a child and the woman who feeds them means that in this republican account, mothering is identified as central to the well-functioning of human society. Ethics of privacy is not a new but rather well developed topic especially in such areas as medical ethics and genome research. However it is safe to say that this problem is far less explored in moral philosophy. Namely there is a lack of consensus on Meta ethical status of privacy as moral value. This essay suggests some clarifications on the notion of privacy in the ethics of ICT and considers possible approaches to research on privacy issues in ethics. Moral (...) relativism suggests that privacy is a conventional value and it is possible to accept that it may become obsolete if confronted with changing social and cultural environment. Such approach also contributes to the view that privacy is an individual value and it may come in contradiction with societal values. Naturalistic approach on the other hand suggests that privacy is a value intrinsic to human nature, as it is deeply interrelated with phenomena of self-identity. Thus privacy is a crucial value not only to individual but to society as well. (shrink)

The report is devoted to elaboratation creative philosophical models for optimization multi-cultural dialogue into “post modern” global society. The main idea of the article is to describe the basic philosophical models (rooting in ancient philosophy, as the most seriously and fundamental theoretical positions for solution the problem of many-pole's world), connecting them with the main points of modern philosophers (F. Fucuyama, A. Toffler, S. Hantington, S. Averintsev, A. Panarin, Y. Lotman, S. Filatov, A. Malashenco, E. Volkhova etc). The dialogue of (...) cultures is the “other side” of the process of globalization. The question about possible strategies of intercultural interaction, its opportunities and limits, as well as potential grounds for mutual understanding is ultimately vital todayfor contemporary philosophy of culture. Its solution determines perspective of consolidation of sodium as well as selection of definite position in the dialogue itself – whether it will be an isolationism leading to the “end of history” as to the returning to cyclic model of life of human community; or there will be retained an orientation for mutual displacement of value priorities (war of ideologies) as competitive adaptive programs. In any case the globalizing world in the order of self-organization in the next decades will stop at the selection of any definite strategy. (shrink)

It is widely assumed that it is ethical to conduct research with human subjects only if the research has social value. There are two standard arguments for this view. The allocation argument claims that public funds should not be devoted to research that lacks social value. The exploitation avoidance argument claims that subjects are exploited if research has no social value. The primary purpose of this article is to argue that these arguments do not succeed. The allocation (...) argument has little relevance to commercial research. Social value is not necessary to avoid exploitation if subjects benefit from participation. Although the standard arguments for a social value requirement do not succeed, that view might be justified in a different way. It might be justified by appeal to the importance of social trust or the integrity of physician investigators. It is possible but doubtful that these arguments succeed. (shrink)

Pragmatic trials aim to directly inform health care decision-making through the collection of so-called ‘real world data’ from observations of comparative treatment effects in clinical practice. In order to ensure the applicability and feasibility of a pragmatic trial, design features may be necessary that deviate from standard research ethics requirements. Examples are traditional requirements to seek written informed consent and to perform extensive data and safety monitoring. Proposals for deviations from standard research ethics practice have resulted in controversy about their (...) ethical acceptability. One of the justifications for altered procedures is the allegedly high social value of pragmatic trials. In order to properly operationalize the concept in the ethical assessment of pragmatic trial designs, specification is warranted. We identified three determinants from common claims about a pragmatic trial's social value: the extent to which the research question has real world relevance, the trial design's ability to generate a real world answer and the probability of direct uptake of the results by decision-makers in practice. Subsequently, we discuss how these determinants should be applied to the practice of pragmatic trials, and to what extent they might be applicable to explanatory trials. (shrink)

Ethicists have long recognized that two necessary features of ethical research are scientific validity and social value. Yet despite a significant literature surrounding the validity component of this dictate, until recently there has been little attention paid to unpacking what the social value component might require. This article introduces a framework for assessing the social value of research, and in particular, for determining whether a given research program is likely to have significant social value of the (...) kind necessary to fulfill the social value requirement. The article goes on to illustrate how this framework can provide a clearer account of the responsiveness requirement, an ethical dictum that is oft-repeated but whose content and value as a guideline in international research remains contested. Although I introduce this conception of social value in the context of the responsiveness requirement, the account offered can, and is intended to, stand alone as a tool for the assessment of the social value of research. As such it can be usefully applied to discussions about the value of comparative effectiveness trials, the assessment of the continued proliferation of me-too drugs and the research done to develop them, the demand for public access to study-generated data, and persistent deficits in the publication of negative results. Economic environmental valuation remains a much debated and contested issue. Concerns have been voiced that it is unable to capture the manifold immaterial values of ecosystems due to conceptual and methodological issues. Thus, additional value categories (social values) as well as novel valuation approaches like deliberative (monetary) valuation are areas of growing interest, yet the theoretical foundations are rather weak. Against this background, this article aims to develop a consistent conceptual framework for making sense of social (...) values in economic environmental valuation. Based on a holistic view of society and individuals, the role of institutions, the social environment, culture and transcendental values is emphasised. To synthesise diverging concepts of value into an economic concept and to account for the multidimensionality of social values, the framework consists of three spheres: social, natural and contextual. The novel framework demonstrates that social values may be integrated into a preference-based utility framework when denoting a holistic understanding of social preferences and human embeddedness in nature and society. The literature on Base of the Pyramid strategies emphasizes that creating social value requires collaborative, multi-stakeholder business approaches. However, there is limited understanding of how businesses can successfully coordinate such value creation processes in the developing economies that face significant institutional voids. This study adopts a business model perspective for analyzing social value creation processes that span organizational boundaries. We introduce a novel, theoretically grounded business model framework that helps conceptualize social value by locating the various loci (...) of value creation, and the stakeholders that partake in creating and capturing this value. We subsequently analyze the mechanisms of social value creation in M-Pesa, a renowned boundary-spanning mobile money system that has advanced financial inclusion among tens of millions of users in Kenya. The results show that information and communications technology can help advance social value creation by reducing the cost of coordinating boundary-spanning business models that integrate diverse societal stakeholders. The results further point to uneven distributional outcomes in self-governing social value creation strategies where the focal firm plays a coordinating role. (shrink)

The prime concern of education is to evolve the good, the true and the divine in man so as to establish a moral life in the world. It should essentially make a man pious, perfect and truthful. The welfare of humanity lies neither in scientific or technological advancements nor in acquisition of material comforts. The main function of education is to enrich the character. What we need today more than anything else is moral leadership founded on courage, intellectual integrity and (...) a sense of values. Since education is a powerful instrument of social change and human progress, it is also a powerful tool to cultivate values in an individual. Therefore all the educational institutes have greater responsibility to impart learning and cultivation of values through education. For inculcating values many educationists have suggested different ideas such as : provision of value based curriculum, designing special orientation program for teachers, value based foundation courses, publication of literature based on values, necessity to develop code of conduct for teachers and students, inculcation of philosophical viewtowards life among teachers and students. Further to cultivate values among the new generations we are to design a curriculum from out of our accumulated cultural heritage. (shrink)

People often make less risky decisions for themselves than others. We examined how people allocated risks (i.e., determining the ratio of uncertain outcomes to certain outcomes) between themselves and others. We also investigated gain (vs. loss) domain and social value orientation as predictors of risk allocations. The results of three experiments demonstrated that participants were more likely to share their risks equally between themselves and others than distribute risk unequally. In the gain (vs. loss) domain, participants allocated fewer risks (...) to themselves and more risks to the other person for unequal risk allocations. Compared to proselfs, prosocials were more likely to allocate risks equally. We also found stronger domain effects on unequal risk allocations for proselfs than for prosocials. Therefore, our findings clarify the effects of risk distribution, domain, and social value orientation on interpersonal allocation decisions and highlight equal risk distribution between oneself and others. Introducción: Los docentes universitarios requieren nuevos saberes para enfrentar los diversos retos que plantea la educación superior; dichos desafíos se relacionan con el dominio de saberes disciplinarios, profesionales, laborales, pedagógicos y didácticos e incluso axiológicos. Lo que aquí se presenta son los resultados de una investigación llevada a cabo en la Universidad Autónoma del Estado de México en el periodo de enero de 2014 a abril de 2015. El objetivo: fue determinar los saberes específicos, métodos de enseñanza y valores sociales (...) que deben poseer los profesores universitarios desde la perspectiva de los estudiantes para la identificación de aquellos principios que deben orientar la formación y actualización docente. Método: consideró el cualitativo y la técnica de la encuesta; fueron aplicados 119 cuestionarios diseñados en Escala de Likert, a igual número de estudiantes; el instrumento de 48 reactivos fue construido con base en tres grandes "baterías" o ejes: "Saberes de un buen docente", "Métodos o estrategias de enseñanza", y "Actitudes y valores". Resultados: se resaltan los saberes pedagógicos y didácticos como aquéllos que los estudiantes visualizan que les hacen falta a sus docentes; de éstos, son los métodos de enseñanza eminentemente prácticos, y aquellos vivenciales o más cercanos a la realidad los que se consideran como importantes. En términos de las actitudes y valores sociales que deben tener y demostrar los profesores, se encuentran la actitud profesional, la actitud de servicio, así como la responsabilidad y la ética. Conclusiones: se discute aquello que se considera deben saber, y lo que necesitan mejorar los docentes universitarios. Introduction: Professors require new knowledge to face the different challenges that higher education has. Those challenges are related with the mastery of disciplinary, professional, pedagogic, work-related, didactic and even axiological knowledge. The results of a research that was carried out at the Universidad Autónoma del Estado de México from January, 2014 to April, 2015; are presented in this article. Objective: To determine specific knowledge, teaching methods and social values that professors must have from the perspective of the students for identifying the principles which should lead teaching formation and updating. Method: The qualitative method and the survey as a procedure were considered. One hundred nineteen questionnaires that were designed in Likert scale were also applied to the same number of students; the instrument of 48 reagents was based on 3 axes: 'Knowledge of a good professor', 'Teaching methods or strategies' and 'Attitudes and values'. Results: Pedagogic and didactic knowledge is emphasized, for instance the one students consider their professors should have. However, the professors consider those teaching methods essentially practical, based on past experiences or closer to the reality as the most important ones. There are some attitudes and social values that professors must have and demonstrate, as well as the professional attitude, the service attitude, responsibility and ethics. Conclusions: the ideas that must be known and improved by the professors are discussed here. (shrink)

Research shows that the physician’s personal attributes and social characteristics have a strong association with their end-of-life decision making. Despite efforts to increase patient, family and surrogate input into EOL decision making, research shows the physician’s input to be dominant. Our research finds that physician’s social values, independent of religiosity, have a significant association with physician’s tendency to withhold or withdraw life sustaining, EOL treatments. It is suggested that physicians employ personal social values in their (...) EOL medical coping, because they have to cope with existential dilemmas posed by the mystery of death, and left unresolved by medical decision making mechanisms such as advanced directives and hospital ethics committees. Values are essentially interpretive: they can, even must be interpreted and can and should be understood as (somehow socially or personally standardized) interpretive constructs of a specific kind and according to different types to be distinguished and classified within an hierarchical typology. There is a special connection between values and actions as well as their characteristic of being related to their ascription to persons, goods, events etc. This connection is indeed covered, borne or carried out by interpretation. In (...) fact, any ascription of a value concept or predicate whatsoever is dependent on a structure and hierarchy of normative and in part descriptive schemes of at times conventional and dispositional scheme-interpretations. Generally speaking, the thesis is that the methodological model of interpretive constructs (scheme-interpretationism) can be thoroughly applied to the concept and usage of values. Social values are then in this sense socially originated, institutionally sanctioned or standardized interpretational constructs of a social character, notably for social comparisons in using and establishing preferences for a kind of (limited) uniformity and expectability and predictability of social behavior and actions.
