One of the most interesting jurists of the post-World War II era, Ross [1899-1979] was a legal and moral philosopher, scholar of international law and the leading representative of Scandinavian Legal Realism. This book and On Law and Justice (...) (1958) are his principal works. In Directives and Norms Ross asks whether imperatives (or, to use his term, 'directives') are subject to logic in the same way as indicatives. He shows the difference between indicative and directive discourse and explains the concepts 'directive' and 'norm' as they function in the social sciences, especially in the study of law. A contemporary essay in the Modern Law Review (32:544), though critical of this work, was still impressed by its "clear and convincing account" of these processes. (shrink)

I investigate the extent to which there might be, now or in the future, non-human animals that partake in the kind of fully human-style consciousness that has been taken by many philosophers to be the basis of normative personhood. I first sketch a conceptual framework for considering the question, based on a range of philosophical literature on relationships between consciousness, language and personhood. I then review the standard basis for largely a priori skepticism about the possibility that any non-human animal (...) could experience FHSC and be a person to any extent, and indicate empirically motivated grounds for rejecting such skepticism, at least with respect to a select group of hypersocial candidate species with communication systems we do not currently know are not languages: corvids, parrots, elephants, and toothed whales. Relevant facts about elephants are reviewed in some detail, as a mini case study. While it is suggested that elephants might partake in the sort of consciousness characteristic of personhood to some extent, grounds are given for expecting that this extent is sharply limited by comparison with normal humans. As these grounds are mainly aspects of elephants’ external niche, however, rather than known limitations in their inboard cognitive or representational capacities, the surprising conclusion emerges that elephants might acquire FHSC, and thereby become persons, if they can be brought into conversation with humans, a possibility opened by considerations canvassed in the paper. There are those who believe that on January 1, 1999, when the euro becomes the common currency of the European Union, France will become a province of Germany. Effectively (...) real sovereignty will pass from Paris to Frankfurt.Already there are those at Cornell, for example, who think that we, in the French section, should seek to merge with the German department. I support the move (which isn’t going to happen), if only as a permanent reminder to avoid the fetishism of French. In today’s world, French is a question more than an answer to any question. French studies should be open even to the possibility that, these days, to speak French, it is becoming more and more necessary to speak German. The opposite has been true for a long time, as the French smugly know all too well—having for centuries lent their language of refinement and savoir-vivre to the Huns. The imminence of the conjuncture should remind us, too, that French studies is itself situated within the history of French—is transformed in its possibilities and embodiments by that history and by what is happening now, as we say, historically. Finally, the point here is to recall that the question of French studies has a history, that it is not merely being invented at this moment, but also reactivated as an object of discussion and debate.In fact, the current debate has been going on for some time. In 1993–94 the issue was addressed at two national conferences: a two-part symposium was organized by the Committee for the Future of French Studies at the University of Pennsylvania and the University of Wisconsin; another was held at New York University organized by the Association for French Cultural Studies and the Institute of French Studies. This careful commentary analyzes the Grundlegung, the metaphysical discussion of morality written during Kant's critical period, between publication of the Critique of Pure Reason and the Critique of Practical Reason.

Carey's book on conceptual change and the accompanying argument that children's biology initially is organized in terms of naïve psychology has sparked a great detail of research and debate. This body of research on children's biology has, however, been almost exclusively been based on urban, majority culture children in the US or in other industrialized nations. The development of folkbiological knowledge may depend on cultural and experiential background. If this is the case, then urban majority culture children may prove to (...) be the exception rather than the rule, because plants and animals do not play a significant role in their everyday life. Urban majority culture children, rural majority culture children, and rural Native American children were given a property projection task based on Carey's original paradigm. Each group produced a unique profile of development. Only urban children showed evidence for early anthropocentrism, suggesting that the co-mingling of psychology and biology may be a product of an impoverished experience with nature. In comparison to urban majority culture children even the youngest rural children generalized in terms of biological affinity. In addition, all ages of Native American children and the older rural majority culture children gave clear evidence of ecological reasoning. These results show that both culture and expertise play a role in the development of folkbiological thought. (shrink)

We consider the potential contribution of economics to an interdisciplinary research partnership between sociology and neuroscience. We correct a misunderstanding in previous literature over the understanding of humans as ‘social animals’, which has in turn led to misidentification of the potential relevance of game theory and the economics of networks to the social neuroscience project. Specifically, it has been suggested that these can be used to model mindreading. We argue that mindreading is at best a derivative and special basis for (...) social coordination, whereas the general and pervasive phenomenon on which it depends is mindshaping. We then outline the foundations of Conditional Game Theory as a mathematical model of mindshaping, which extends game theory without displacing its classic solution concepts, and which exploits economists’ experience in modeling networks.
