Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Most accounts of Weber’s notion of charisma follow his own explicit comments and seek its origins in the writings of Rudolf Sohm. While I acknowledge the validity of this, I follow Weber’s suggestions and locate the charismatic forces in the political and ethical conduct and beliefs of certain Old Testament prophets, specifically Amos, Jeremiah and Isaiah. Their emphasis on political justice and ethical fairness, coupled with their unwavering belief in the power of prophecy, infuse Weber’s conception (...) of charisma and in crucial ways contribute to the formation of his notion of the modern political leader. For over fifty years, Rudolf J. Siebert (b.1927) has developed his Critical Theory of Religion and Society out of the Critical Theory of the Institute for Social Research, commonly known as the "Frankfurt School." Born from the World War II ruins of his hometown in Frankfurt, Germany, Siebert's Hegelian thought has developed in conversation with Christian theology, German Idealism, comparative religion, political-economy, sociology, psychology, and history. Also known as Dialectical Religiology, Siebert's literary corpus is saturated with the dialectics of (...) Georg Wilhelm Friedrich Hegel (1770-1831), especially Hegel's philosophy of right, history, religion, as well as Hegel's theodicy, which lays at the core of the enlightener's work. The recent literature on causality has seen the introduction of several distinctions within causality, which are thought to be important for understanding the widespread scientific practice of focusing causal explanations on a subset of the factors that are causally relevant for a phenomenon. Concepts used to draw such distinctions include, among others, stability, specificity, proportionality, or actual-difference making. In this contribution, I propose a new distinction that picks out an explanatorily salient class of causes in biological systems. Some select causes (...) in complex biological systems, I argue, have the property of enabling coherent causal control of these systems. Examples of such control variables include hormones and other signaling molecules, e.g., TOR (target of rapamycin), morphogens or the products of homeotic selector genes in embryonic pattern formation. I propose an analysis of this notion based on concepts borrowed from causal graph theory. (shrink)

Relying on Husserl as well as on the reflections by Merleau-Ponty on Cézanne, Henry on Kandinsky and Deleuze on Bacon, this essay sketches some basic problems that arise in a phenomenological account of non-figurative painting. An investigation of the distinction between phenomenological and pictorial perception, of the transposition of the painter’s mode of perception into a painted image, and of the expressive force of paintings inevitably confronts one with the enigma of the appearing of something invisible. The essay proceeds in (...) three steps. The first step describes pictorial perception in terms of a ‘seeing according to’. Such a mode of perception pays attention to visual ambiguities, to the ‘gaze of things’ and to the conditions of visibility that are ordinarily overlooked. The second step moves on to the issue of the transposition of a pictorial perception in a painted image. Deleuze’s account of “manipulated chance” proves to be very helpful here. In the final step, Henry’s and Deleuze’s emphasis on the painting’s expression of totally invisible ‘forces’ is discussed. (shrink)

APA PsycNET abstract: This is the first volume of a two-volume work on Probability and Induction. Because the writer holds that probability logic is identical with inductive logic, this work is devoted to philosophical problems concerning the nature of probability and inductive reasoning. The author rejects a statistical frequency basis for probability in favor of a logical relation between two statements or propositions. Probability "is the degree of confirmation of a hypothesis (or conclusion) on the basis of some given evidence (...) (or premises)." Furthermore, all principles and theorems of inductive logic are analytic, and the entire system is to be constructed by means of symbolic logic and semantic methods. This means that the author confines himself to the formalistic procedures of word and symbol systems. The resulting sentence or language structures are presumed to separate off logic from all subjectivist or psychological elements. Despite the abstractionism, the claim is made that if an inductive probability system of logic can be constructed it will have its practical application in mathematical statistics, and in various sciences. 16-page bibliography. Max Weber (1864-1920), generally known as a founder of modern social science, was concerned with political affairs throughout his life. The texts in this edition span his career and include his early inaugural lecture The Nation State and Economic Policy, Suffrage and Democracy in Germany, Parliament and Government in Germany under a New Political Order, Socialism, The Profession and Vocation of Politics, and an excerpt from his essay The Situation of Constitutional Democracy in Russia, as well as other shorter (...) writings. Together they illustrate the development of his thinking on the fate of Germany and the nature of politics in the modern western state in an age of cultural 'disenchantment'. Rudolf von Ihering was the leading German philosopher of law of the nineteenth century. He was also a major source of Weber’s more famous sociological definitions of action. Characteristically, Weber transformed material he found: in this case Ihering attempt to reconcile the causaland teleological aspects of action. In Ihering’s hands these become, respectively, the external and internal moments of action, or intentional thought and the factual consequences of action. For Weber they are made into epistemic aspects (...) of action, the causal and the meaningful, each of which is essential to an account of action, but which are logically and epistemically distinct. Ihering thought purposes were the products of underlying interests, but included ‘ideal’ interests in this category. Weber radicalized this by expanding the category and making it historically central. This radicalization bears on rational choice theory: if ideal interests have a large historical role independent of material interests, and are not fully explicable on such grounds as ‘sour grapes’, the methods appropriate to the study of the transformation of ideas, meaning genealogies in the Nietzschean sense, are central to the explanation of action. Several authors have used the notion of causal specificity in order to defend non-parity about genetic causes (Waters 2007, Woodward 2010, Weber 2017, forthcoming). Non-parity in this context is the idea that DNA and some other biomolecules that are often described as information-bearers by biologists play a unique role in life processes, an idea that has been challenged by Developmental Systems Theory (e.g., Oyama 2000). Indeed, it has proven to be quite difficult to state clearly what the alleged special (...) role of genetic causes consists in. In this paper, I show that the set of biomolecules that are normally considered to be information-bearers (DNA, mRNA) can be shown to be the most specific causes of protein primary structure, provided that causal specificity is measured over a relevant space of biological possibilities, disregarding physical as well as logically possible states of the causal variables. I examine different arguments that could be used to establish indeterminism of neurological processes. Even though scenarios where single events at the molecular level make the difference in the outcome of such processes are realistic, this falls short of establishing indeterminism, because it is not clear that these molecular events are subject to quantum mechanical uncertainty. Furthermore, attempts to argue for indeterminism autonomously (i.e., independently of quantum mechanics) fail, because both deterministic and indeterministic models can account for the empirically observed (...) behavior of ion channels. There are several theses in political science that are usually explicitly called ‘laws’. Other theses are generally thought of as laws, but often without being explicitly labelled as such. Still other claims are well-supported and arguably interesting, while no one would be tempted to call them laws. This situation raises philosophical questions: which theses deserve to be called laws and which not? And how should we decide about this? In this paper we develop and motivate a strategy for thinking about (...) laws in political science which integrates two core concepts: spatio-temporal stability and social mechanisms. The proposed strategy is a set of guidelines that political scientists can use to reflect on and argue about specific cases within their discipline, not a clear-cut demarcation criterion. We defend and motivate this strategy and apply it to two cases (one with respect to state repression, one about parliamentary elections). After we have developed and motivated our strategy for political science, we show that our proposal is relevant for other disciplines in the social sciences. We explain how our views fit into critical realism and embed them in the debate on laws in general philosophy of science and in the philosophy of the social sciences. (shrink)

Two chief problems of the theory of knowledge are the question of meaning and the question of verification. The first question asks under what conditions a sentence has meaning, in the sense of cognitive, factual meaning. The second one asks how we get to know something, how we can find out whether a given sentence is true or false. The second question presupposes the first one. Obviously we must understand a sentence, i.e. we must know its meaning, before we can (...) try to find out whether it is true or not. But, from the point of view of empiricism, there is a still closer connection between the two problems. In a certain sense, there is only one answer to the two questions. If we knew what it would be for a given sentence to be found true then we would know what its meaning is. And if for two sentences the conditions under which we would have to take them as true are the same, then they have the same meaning. Thus the meaning of a sentence is in a certain sense identical with the way we determine its truth or falsehood; and a sentence has meaning only if such a determination is possible. (shrink)

Die Traume und Visionen aus der antiken Literatur, die die romischen Kaiser und ihr Umfeld betreffen, wurden bislang noch nicht auf ihre Bedeutung hin untersucht. Die vorliegende Arbeit schliesst diese Lucke, indem sie das Material von Caesar bis Maurikios analysiert. Dabei ergeben sich spezifische Motive, die besonders mit Traumen und Visionen verbunden sind: Geburt und Kindheit, Verheissung der Herrschaft, Erringung eines Sieges und gottliches Eingreifen, Ausubung der Herrschaft, besondere Befahigung und gottliche Begunstigung, nahendes Ende. Durch den breiten zeitlichen Ansatz gelingt (...) es, fur die Motive unterschiedliche Schwerpunkte auszumachen: Sie stehen alle in der Spannung zwischen einer gezielten Verbreitung zur Schaffung von Akzeptanz und der Literarisierung durch die antiken Autoren.
