En medio de este debate, todavía es posible tematizar con Shakespeare y Kant un concepto de trascendencia inmanente que (...) pueda capturar bien aquello que se juega en la subjetividad proteica del mundo moderno, esto es, la posibilidad abierta por ensayar diferentes respuestas de sentido que orientan nuestra actividad práctica. The essays in this volume blend historical and philosophical reflection with concern for contemporary political problems. They show that the causes and motivations of civil religion are a permanent fixture of the human condition, though some of its manifestations and proximate causes have shifted in an age of multiculturalism, religious toleration, and secularization.

In «Naturalized Epistemology and the Law of Evidence Revisited», the original target article for the various refutations that I comment on here, I revisited through a slightly different lens the subject of the article that I coauthored with Brian Leiter close to twenty years ago. That article has prompted four responses from Professors Pardo, Spellman, Muffato, and Enoch. Professors Pardo and Spellman basically accept the implications of the original article and offer useful but friendly amendments. Prof. Muffato apparently does not (...) want to dispute over my ground and so changes the subject, and in doing so offers a number of interesting points. Only the fourth, Prof. Enoch, has the same doubts about the utility of my original article as I do of the genre that gave rise to it. I can thus be quite brief in discussing professors Pardo, Spellman, and Muffato, but it will take bit more effort to lay out the limits of Prof. Enoch’s analysis. (shrink)

This brief essay explores how understanding the treatment of expert evidence requires engaging with its legal and political contexts, and not just focusing on its epistemological aspects. Although the law of evidence and thus its treatment of experts is significantly informed by epistemological considerations, it is also informed by concerns over the organization of trials, larger issues of intelligent governance, social concerns, and enforcement issues. These five aspects to the law of evidence give rise to principles to guide the explicit (...) structuring of the law of evidence that are identified here as well. This complexity helps to explain why the central issue of expert testimony is not the epistemological one of knowledge and belief but instead the conflict between educational and deferential modes of trial. The probabilistic account of juridical proof meets insurmountable problems. A better explanation of juridical proof is that it is a form of inference to the best explanation that involves the comparative plausibility of the parties’ stories. In addition, discrete evidentiary matters such as relevance and probative value are also best understood as involving inference to the best explanation rather than being probabilistic.

As consumer lifestyles have changed over recent decades, people have increasingly turned to meals prepared away from home. A major consequence of this shift in eating patterns has been a concomitant rise in obesity rates worldwide. Research has consistently documented that consumers tend to make less healthy choices when purchasing prepared meals away from home. In part, this can be attributed to inadequate information at the time of purchase; both nutrition experts and lay consumers tend, for example, to underestimate calories (...) in food purchased away from home and thus portion sizes tend to be larger. Thus, by requiring restaurants and other purveyors of prepared foods to provide the calorie content and other nutrition information at the point of purchase, consumers should be able to make more informed decisions and public health should be improved. The often maligned Affordable Care Act (i.e., “Obamacare”) addressed this issue in a mandate calling for compulsory nutrition labeling of prepared foods at the point of sale. In response to this effort, conservatives in Congress introduced the “Common Sense Nutrition Disclosure Act” (CSNDA) which, if enacted, would have effectively eviscerated the menu labeling provisions mandated by the Affordable Care Act. The stated rationale behind this legislation: to protect small business and prevent job loss resulting from overly‐burdensome federal regulations. This article provides a historical look at the evolution of federally mandated menu labeling in the United States with particular emphasis on opposition to its passage. The position is taken such that this legislation is beneficial, warranted, and long overdue, and its opposition, as reflected in the CSNDA, points to the need for new metrics when evaluating public policy. The problem of providing mandated medical care has become commonplace as correctional systems in the United States struggle to manage unprecedented increases in its aging prison population. This study explores older incarcerated women’s perceptions of prison health care policies and their day-to-day survival experiences. Aggregate data obtained from a sample of 327 older women residing in prison facilities in five Southern states were used to identify a baseline of health conditions and needs for this vulnerable group. With an average of (...) 4.2 chronic health conditions, frequently histories of victimization, and high rates of mental health issues, the women’s experiences of negotiating health care was particularly challenging. By incorporating the voices of older women, we expose the contradictions, dilemmas, and obstacles they experience in their attempts to obtain health care. It is clear from the personal accounts shared that, despite court mandates, penal harm practices such as delaying or denying medical treatment as well as occasional staff indifferences are common in women’s prisons. With older women having the greatest need for health care, an age- and gender-sensitive approach is recommended. (shrink)

The crime passionnel belongs to that tradition: in law it is a kind of “brief-insanity defence.” We still say that “passion blinds us;” and in common parlance to be philosophical about life's trials is to be decently unemotional about them. Indeed many philosophers have espoused this view, demanding that Reason conquer Passion. Others — from (...) Hume to the Emotivists — have appeared to reverse this hierarchy.” But those philosophers who refuse to join in the general denigration of emotion as irrational usually share the presupposition that the role of rationality is limited to the calculation of means. In so far as emotions are concerned with the determination of ends, they remain, on this view, beyond the pale of rationality. Modern decision theorists have worked out schemes to assess the rationality of desires, as well as actions, against the background of beliefs and other desires.1 But these schemes leave no room at all for emotions, except, by implication, as disrupters of the rational process. In October of 2009, Trevor Keezer was terminated by Home Depot for refusing to remove a pin from his uniform declaring “One Nation under God, Indivisible.” Mr. Keezer, a cashier with Home Depot, contended that the button he had worn for over one year before any action was taken by his employer expressed his support for American troops and his Christian faith. Were the actions taken by his employer warranted or was Mr. Keezer the victim of arbitrary religious discrimination unrelated (...) to job performance? Religion is becoming an increasingly polarizing issue in the workplace, forcing retail managers to balance the respective interests of employees, coworkers, and patrons of retail establishments. And from all indications, if legislation pending in Congress is enacted, maintaining the balance will become more problematic. (shrink)

Following a series of national protests in support of an increase in the federal minimum wage, many fast food workers faced retaliation by their employers when they returned to work; schedules were changed, wages and hours were reduced, and some employees were terminated. These retaliatory actions resulted in a number of complaints being filed with the National Labor Relations Board alleging violations of the National Labor Relations Act. Several of the complaints were found to have merit and, additionally, in several (...) instances both the immediate employer, the franchisee, and the corporate organization of which it was a part, the franchisor, were named as co‐defendants. This ruling—that franchisors like McDonald’s USA—could be held jointly responsible for the labor violations of independent franchisees reversed a long‐standing precedent, whereby franchisees were regarded as independent contractors solely responsible for day‐to‐day labor practices, including compliance with federal and state labor statutes. Critics of the ruling argue that it will open the door to unionization and may well spell the end of the service‐sponsor franchising format. Supporters of the NLRB argue that the ruling is just and reflects new “industrial realities” in retail labor markets. Further, a case can be made that the NLRB’s position represents a step in the direction of the restoration of more equitable balance of power between labor and management. (shrink)

In this paper, we sketch the development of two important themes of modern set theory, both of which can be regarded as growing out of work of Kurt Gödel. We begin with a review of some basic concepts and conventions of set theory.§0. The ordinal numbers were Georg Cantor's deepest contribution to mathematics. After the natural numbers 0, 1, …, n, … comes the first infinite ordinal number ω, followed by ω + 1, ω + 2, …, ω + ω, (...) … and so forth. ω is the first limit ordinal as it is neither 0 nor a successor ordinal. Hart's "Ascription of Responsibility and Rights" is where we find perhaps the first clear pronouncement of defeasibility and the technical introduction of the term. The paper has been criticised, disavowed, and never quite fully redeemed. Its lurid history is now being used as an excuse for dismissing the importance of defeasibility.

In this paper we examine the effects of different competitive conditions on the determination and evaluation of strategies of corporatesocial responsibility (CSR). Although the mainstream of current thinking in business ethics recognizes that a firm should invest in social responsibility, the normative theory on how specific competitive conditions affect a firm’s social responsibility remains underdeveloped. Intensity of competition, risks to reputation and the regulatory environment determine the competitive conditions of a firm. Our central thesis is that differential strength of competition (...) produces differential moral legitimacy of firm behavior. When competition is fierce or weak, different acts or strategies become morally acceptable, as well as economically rational. A firm has to develop its own strategy of social responsibility, in light of its competitive position, as well as ethical considerations. (shrink)

This paper critically evaluates the celebrated paper of Hanks and McDermott on temporal projection, non-monotonic reasoning, and the frame problem. First I argue against their intuitions, and a fortiori, against their proposed solution. Next, I suggest how the solution they desire could be obtained, were they willing to represent the problem a bit differently.

We show that either of the following hypotheses imply that there is an inner model with a proper class of strong cardinals and a proper class of Woodin cardinals. 1) There is a countably closed cardinal k ≥ N₃ such that □k and □(k) fail. 2) There is a cardinal k such that k is weakly compact in the generic extension by Col(k, k⁺). Of special interest is 1) with k = N₃ since it follows from PFA by theorems of (...) Todorcevic and Velickovic. Our main new technical result, which is due to the first author, is a weak covering theorem for the model obtained by stacking mice over $K^c ||k.$. (shrink)

The article aims to document the types of cyberviolence faced by 120 students of an urban high school in the cd. Toluca. Understood as an aggressive and intentional act online is about “sending and posting harmful or cruel texts or images over the Internet or other digital media”. Based on a mixed research design, the “online violence” self-report was applied, which allowed to identify trends and subsequently, from a narrative generating question, the experience stories with online violence were recovered.

Résumé L’une des théories les plus répandues concernant le rapport de l’art à l’éthique s’appelle parfois la Vicarious Experience Theory. Cette approche basée sur la notion d’une expérience par procuration va toutefois avoir du mal à expliquer la valeur (morale ou autre) de tout art « abstrait », non figuratif et/ou non narratif. Il faudrait alors démontrer que l’art (abstrait ou pas) provoque également une expérience directe – et non pas uniquement une expérience par procuration – et que cette expérience (...) directe est toujours déjà « métaéthique ». Cet effet méta-éthique serait inscrit au sein d’une définition (pragmatiste, pluraliste et institutionnelle) de l’art dans son ensemble, alors que la théorie de l’expérience par procuration s’appliquerait uniquement à quelques arts. Je compte défendre cette thèse par un examen des écrits et des pratiques d’Olafur Eliasson. (shrink)

Le concept d’authenticité sert de base à la valorisation de la thématique de « l’identité » qui domine aujourd’hui. Anish Kapoor présente toutes les garanties de cette « hybridité » actuellement très à la mode. Toutefois, il résiste explicitement à toute tentative de « mise en boîte » qui le cantonnerait à l’expression d’une quelconque « indianité ». Kapoor est connu pour l’aspect sensoriel et aléatoire de son travail. Shooting into the Corner est un excellent exemple d’une œuvre qui évacue (...) l’identification culturelle ; elle trouble par ailleurs les catégories goodmaniennes habituelles d’autographique et d’allographique. Son slogan – « Je n’ai rien à dire » – semble confirmer ce rejet de l’authenticité. Je compte démontrer que même l’aléatoire et l’auto-engendré sont reliés au critère d’authenticité, si cette notion repose sur l’intentionnalité et « l’intensionnalité » de l’œuvre d’art. Redéfini ainsi, le concept d’authenticité deviendrait une « règle constitutive » de notre institution. (shrink)

In a market place crowded with practical rhetoric books what educational value could a challenging work such as Kenneth Burke’s A Rhetoric of Motives possibly have? Burke knows but doesn’t use the terminology of the classical art and rather than analysing the persuasive rhetoric of well-known speeches to equip us with strategies, he weaves his way around literary texts, teasing out meanings that their authors something intended, sometimes did not. Yet, despite such difficulties, A Rhetoric of Motives is a practical (...) rhetoric book. It is just that its process of explication teaches us to think well. This essay tries to explain Burke’s rethinking of the purpose and contents of a traditional teaching tool—the rhetorical handbook—and defends the value of literary-rhetorical reading that aims to ‘equip’ citizens to think openly. This essay notes a resurgence of interest in rhetorical studies on the appeal of form, grounded in the work of rhetorical theorist Kenneth Burke. The essay argues that form is not only a way to structure discourses, it is a way to structure experience. Form is foundational in creating perceptions and thus experiences. Form is also highly rhetorical, in that how we structure our world carries social and ideological implications. The essay thus argues that an understanding of form as foundational (...) and rhetorical should be central to the educational curriculum. This way of understanding form is then a way of making rhetoric central to education in ways surpassing even the efforts of the ancient Greeks and Romans. A rhetorically centered curriculum based on teaching students how to understand form in their lives is empowering and liberating for students at the same time that it instills in them a strong awareness of ethics. This essay takes a rhetorical pragmatist perspective on current questions concerning educational goals and pedagogical practices. It begins by considering some challenges to rhetorical approaches to education, placing those challenges in the theoretical context of their posing. The essay then describes one current rhetorical approach—based on Kenneth Burke’s dramatism and logology—and uses it to understand and redescribe another rhetorical approach—Jesuit teaching of eloquentia perfecta. Proceeding in this way, the essay presents both a general theoretical framework for discussing educational aims and (...) a specific practical example of how such aims might be achieved. (shrink)

Despite both positive and negative perceptions of the current state of higher education, the contemporary debate over what it is to be a university is limited. Most of all, it is limited imaginatively. The range of imagined options is narrow. The imagination has not been given anything even approaching a wide scope. As a result, our sense as to what a university could be and could become in the modern age is itself impoverished. If we are seriously to develop a (...) wide range of ideas of the university that is adequate to the challenges of the modern world, the imagination itself needs to be freed. Imagining the University seeks to address each of these sets of issues and will do so by first, identifying a very wide range of ideas of the university as it is now unfolding and could become; secondly, by evaluating those conceptions of the university with a classification of ideas of the university; and thirdly, by reflecting on the imagination itself, its current impoverishment and its possibilities. Whether studying, researching or deciding policy, this book is vital reading to all those involved in the planning and delivery of higher education. (shrink)

By developing the concept of “global borderlands”—semi-autonomous, foreign-controlled geographic locations geared toward international exchange—this article shifts the focus of globalization literature from elite global cities and cities on national borders to within-country sites owned or operated by foreigners and defined by significant social, cultural, and economic exchange. I analyze three shared features of these sites: semi-autonomy, symbolic and geographic boundaries, and unequal relations. The multi-method analyses reveal how the concept of global borderlands can help us better understand the interactions that (...) occur among people of different nationalities, classes, and races/ethnicities and the complex dynamics that occur within foreign-controlled spaces. I first situate global borderlands within the literatures of global cities and geopolitical borderlands. Next, I use the case study of Subic Bay Freeport Zone (SBFZ), Philippines to show (1) how the semi-autonomy of global borderlands produces different regulations depending on nationality, (2) how its geographic and symbolic borders differentiate this space from the surrounding community, and (3) how the semi-autonomy of these locations and their geographic and symbolic borders reproduce unequal relations. As home of the former US Subic Bay Naval Base and current site of a Freeport Zone, the SBFZ serves as a particularly strategic research location to examine the different forms of interactions that occur between groups within spaces of unequal power.
