Die analytischen Schriften Ottmar Ballwegs entwerfen eine Rhetorik des Rechts und der menschlichen Angelegenheiten. Ballwegs Denken zeigt, wie als Antwort auf die Erfahrung bestimmter Situationen und dadurch geprägter Meinungen scheinbare Wahrheiten - Wahrscheinlichkeiten - formuliert werden. So sind auch die Sätze des Rechts (dogmatisierte) Meinungen, und eben keine Wahrheiten, allenfalls Ausdruck von Klugheit (Jurisprudentia), aber nicht von Wissenschaft; sie erwachsen aus der Erfahrung einer immer nur zeitbezogenen Stellungnahme zu situativen Problemen.

Cicero, als der unbestrittene Meister der römischen Beredsamkeit in Theorie und Praxis, hat sich in mehreren Werken mit der Theorie der Rhetorik befasst. In seinen 'Partitiones oratoriae' stellt er die Rhetorik als System dar. Der literarischen Form nach handelt es sich um einen Dialog oder einen Katechismus in Frage und Antwort: Sohn Marcus darf seinen Vater im Urlaub anhand einer griechischen Vorlage examinieren. Über die Datierung des Werks besteht keine Übereinstimmung: Einiges spricht für seine Entstehung im Jahre 56 (...) v. Chr., vieles dafür, dass es erst zehn Jahre später niedergeschrieben wurde. Das straff gegliederte Werk gibt einen ausgezeichneten Einblick in die vielfältigen Anforderungen, denen ein Redner gerecht werden musste und auch heute noch genügen muss. (shrink)

Die beiden Werke Rhetorik und Poetik wurden in der Tradition immer wieder als verwandte Projekte eingestuft und bisweilen auch gemeinsam überliefert. Der spätantike Aristoteles-Kommentator Ammonios nahm an, dass die beiden Werke gemeinsam den asyllogistischen Teil des aristotelischen Organons ausmachen. Der Codex Parisinus 1741 aus dem 10. Jh. überliefert Rhetorik und Poetik gemeinsam und stellt die älteste erhaltene handschriftliche Quelle für beide Werke dar.

Das Verhältnis von Philosophie und Rhetorik wird in der Forschungsliteratur meist als eines der Entgegensetzung und des wechselseitigen Ausschlusses beschrieben. Dabei wird dem überzeitlichen Wahrheitsanspruch der Philosophie die kontextabhängige Wirkungsabsicht der Rhetorik gegenübergestellt. Während Philosophie auf sicheres Wissen und Erkenntnis ziele, gehe es der Rhetorik nicht um Wahrheit, sondern um die bloße Wahrscheinlichkeit und Meinung. Das kann allerdings nicht darüber hinwegtäuschen, dass Philosophie und Rhetorik auf grundsätzliche Weise aufeinander verwiesen bleiben. Denn allein in der Notwendigkeit, ihren (...) Wahrheitsanspruch öffentlich durchsetzen zu müssen und in der Frage nach der adäquaten Wahl der Ausdrucksmittel, muss sich Philosophie notwendig rhetorischer Verfahren bedienen. Entsprechend hinterfragt eine rhetorische informierte Philosophie das intellektualistische Ideal einer transparenten und selbstexplikativen philosophischen Sprache. Sie unterstreicht demgegenüber die Materialität, Literarizität, Performativität und Historizität philosophischen Sprechens. ZusammenfassungDer Aufsatz überprüft die These, daß die Moderne kein Zeitalter der Rhetorik, sondern ein Zeitalter der Rhetorizität sei, an drei einschlägigen Texten von Jacques Derrida, Paul de Man und Roland Barthes. Dabei erweist sich die genannte These als einseitig, da sie zwar auf die restringierten elocutio-Rhetoriken Derridas und de Mans zutreffen mag, nicht jedoch auf Barthes. Seine Rückkehr in die Rhetorik zielt auf die Rekonstruktion eines umfassenden Rederegimes, die zu einer seinerzeit noch ausstehenden Diskurslinguistik, die Benvenistes späte Schriften (...) nahegelegt hatten, führen sollte.The essay checks the thesis that modernity is not an age of rhetoric but an age of rhetoricality with three relevant texts by Jacques Derrida, Paul de Man and Roland Barthes. The thesis mentioned proves to be one-sided, since it may apply to the restricted elocutio-rhetorics of Derrida and de Man, but not to Barthes. His return to rhetoric aims at the reconstruction of a comprehensive speech regime that should lead to a discourse linguistics still outstanding at the time, which Benveniste’s later writings suggested. Die Studie beschreibt die Validierung der Rhetorik durch die Philosophie des deutschen Idealismus am Beispiel dreier ihrer größten Vertreter und fördert drei deutlich unterschiedene Positionen zutage. Den Leitfaden der Untersuchung bilden die von Platon formulierten und von Kant, Fichte und Hegel jeweils unterschiedlich ausgedeuteten zentralen Gesichtspunkte philosophischer Rhetorikreflexion: die logisch-methodologische, die ästhetische und die politisch-moralische Kritik sowie die Kritik des Rhetorischen als Korruption der Philosophie selbst.

Der Beitrag versucht zu zeigen, dass die lebensphilosophische Neuorganisation des Geschichtsfeldes, die Nietzsches Historienschrift in die Wege leitet, sich ihrem Kern nach im Rückgriff auf die Rhetorik der antiken Mnemotechnik formiert.The article tries to demonstrate that in its essence the philosophical reorganization of the historical scope in Nietzsche's On the Use and Abuse of History for Life is drawing on the rhetoric of classical mnemonics.

This essay analyses the specific rhetoric of degeneration which was observable in the antisemitic polemic discourse of the last decades of 19th century. It provides an overview of the representation of Jewish art und artists as it took shape in the antisemitic literature of the Wilhelminian epoch. The growing emphasis placed by psychiatrists and racial theorists on the pathologies of the,,Jewish race“, such as hysteria or degeneration, resulted in the tendency to pathologize Jewish art and artists, which were deemed responsible (...) for the alleged decline of German culture. Mere aesthetic categories underwent a process of reduction and ideologization and were finally used for defamatory purposes, as shown in the case of the antisemitic denigration of Heinrich Heine. In order to demonstrate this, the analysis outlines the strict dichotomic logic of these argumentations, as the definition and consolidation of an ideal German essence was usually based on the construction of a degenerated Jewish identity. The idea that Heidegger's thinking is essentially anti-sociological is very widespread and seems to be commonly accepted. Nevertheless, a closer examination of Heidegger's reading of Aristotle, particularly in his early Freiburg and Marburg lectures, provides a quite different picture. In his attempt to overcome the shortcomings of Husserl's phenomenology, by studying Aristotle Heidegger makes an important discovery. Being sociological is an existential feature of human being. Here, the lecture of the summer term 1924, Grundbegriffe der aristotelischen Philosophie (Fundamental concepts of (...) Aristotelian Philosophy), which mainly deals with Aristotle's Rhetoric, is of special importance. In analyzing the phenomenon of speaking within the polis as some kind of apophantic language, Heidegger hits upon the fact that the political is grounded in social communication. The idea of human being as existing within a context of communication developed in this lecture is an important starting point of Heidegger's later philosophy of language. (shrink)

The dramatic characters in the tragedies of Aeschylus tend to assert that their actions are in accordance with the law and prompted by necessity. Because these statements are often given to legitimise problematic actions, this paper argues that the rhetorical devices can convey the intentions and dispositions of the tragic heroes. Therefore, the „Septem“, the „Suppliants“ and the „Oresteia“ are analysed to show how Aeschylus makes use of rhetorical devices in order to enable the recipient to reach a fuller understanding (...) of the tragic heroes and the tragedies. If we regard discursive practice as constitutive for the way we relate to the world, ourselves and others, then it is vitally important to ask how this practice can be formed or cultivated. For this reason, rhetoric has always been closely connected to ethics. This article attempts to explicate this relationship. It revolves around ancient conceptions of rhetoric that do not aim at establishing a system or a theory of speech, but at cultivating speech as a practice of good life. (...) This “rhetorical ethics” of antiquity remains instructive for contemporary thinking, since it points to a way of reflecting discourse that accounts not only for the content of speech but also for how it shapes human life. In particular, it is instructive for modern ethics, since it reveals that moral discourse can be regarded as a rhetorical practice too: it is not ethically neutral but has to be reflected upon as a practice of life. In Plato’s 'Gorgias', Socrates makes pronounced use of ‘rhetorical’ means. While this has often been pointed out, it has rarely been asked which constitutive features are shared by Socrates’ and Gorgias’ discursive practices. This article tackles this question based on the notion of logos that emerges in Gorgias’ Encomium of Helen. It is claimed that Gorgias was not concerned with a rhetorical technique but in fact with a practice of ethical formation. In this practice, or culture of speech, speakers bring (...) virtue to bear by displaying virtuous ways of speaking. Socratic dialectic, as presented in the Gorgias, can be interpreted as bringing this discursive practice to perfection. (shrink)

It has often been remarked that the Platonic Socrates seems to be using a particular rhetoric. The aim of this specific rhetoric has been described as irritating or "destabilizing". However, little attention has been given to the techniques and elements of his rhetoric. The work focuses on the early dialogues of Plato, since they provide rich material for Socrates' irritating rhetoric and depict him using an ample range of different strategies.
