O presente artigo analisa as possibilidades e limites da discricionariedade administrativa no Estado Social e Democrático de Direito, propondo a releitura dos princípios da legalidade, da supremacia do interesse público e da igualdade perante a administração. Apresenta critérios distintivos entre ato administrativo vinculado e discricionário, além de discorrer sobre os parâmetros constitucionais e legais que devem nortear a decisão discricionária. Inspirando nas luzes pós-positivistas, a pesquisa conta com a revisão bibliográfica sobre o tema e, adotando o método dedutivo, busca aproximar (...) os preceitos constitucionais da atuação discricionária do administrador público. Given two (positive) equivalence relations ∼ 1 , ∼ 2 on the set ω of natural numbers, we say that ∼ 1 is m-reducible to ∼ 2 if there exists a total recursive function h such that for every x, y ∈ ω, we have $x \sim_1 y \operatorname{iff} hx \sim_2 hy$ . We prove that the equivalence relation induced in ω by a positive precomplete numeration is complete with respect to this reducibility (and, moreover, a "uniformity property" holds). This (...) result allows us to state a classification theorem for positive equivalence relations (Theorem 2). We show that there exist nonisomorphic positive equivalence relations which are complete with respect to the above reducibility; in particular, we discuss the provable equivalence of a strong enough theory: this relation is complete with respect to reducibility but it does not correspond to a precomplete numeration. From this fact we deduce that an equivalence relation on ω can be strongly represented by a formula (see Definition 8) iff it is positive. At last, we interpret the situation from a topological point of view. Among other things, we generalize a result of Visser by showing that the topological space corresponding to a partition in e.i. sets is irreducible and we prove that the set of equivalence classes of true sentences is dense in the Lindenbaum algebra of the theory. It is well known that, in Peano arithmetic, there exists a formula Theor (x) which numerates the set of theorems. By Gödel's and Löb's results, we have that Theor (˹p˺) ≡ p implies p is a theorem ∼Theor (˹p˺) ≡ p implies p is provably equivalent to Theor (˹0 = 1˺). Therefore, the considered "equations" admit, up to provable equivalence, only one solution. In this paper we prove (Corollary 1) that, in general, if P (x) is an arbitrary formula built (...) from Theor (x), then the fixed-point of P (x) (which exists by the diagonalization lemma) is unique up to provable equivalence. The paper explores the adoption and operationalization of the circular economy strategy within the ambit of cooperatives, anchoring this exploration in the embeddedness theory. In more detail, our study aims to discern whether territorial and network embeddedness act as catalysts for the adoption of a circular economy strategy and subsequently influence the operationalization of circular initiatives. Given that cooperatives intrinsically emphasize community bonds and mutualistic relationships, understanding the nuances of their embeddedness can elucidate the pathways in adopting and operationalizing circular (...) economy strategies. The study draws from a survey encompassing 1116 Italian cooperatives to fathom how these organizations integrate and operationalize the circular economy in their routine operations. Data were scrutinized using a structural equation model. Outcomes reveal that both territorial and network embeddedness emerge as strong influencers of circular economy strategies, which subsequently sway the operationalization of circular initiatives. Our investigation, assessing also the mediating role of circular economy strategy adoption in relation to both territorial and network embeddedness on the assimilation of circular endeavors, offers enriched theoretical and managerial perspectives on the embeddedness theory and its practical implications. What is the role of attention in the dialectics of memory and communication? How far is attention functioning as a medium? Which role does attention play in the information management practices? Attention is not only fundamental to human existence but also to the process of understanding. If understanding is mediated by memory and communication then attention can be identified with the medium. So whenever you search to explain the role and mechanisms of memory in the information society, the question of (...) attention is asked immediately. Furthermore, attention can be analyzed under the following topics: as cognitive process, as subjective, intersubjective and cultural phenomenon, and as resource and medium within an 'Attention Economy'. Whereas the first aspect has to be seen in the context of empirical studies in psychology and cognitive sciences, the phenomenological, cultural, and economic aspects seem to have common points and similar implications in their theoretical approaches. In the last twenty years, the notion of attention has been the central core of several discourses in German phenomenology, economy and cultural studies. Similar to Georg Franck's theory of mental capitalism, the idea of an attention economy also was followed up in the American discourse. The purpose of this study is to analyse the structure of written argumentative texts produced by pupils in grades 3, 5, 7 and 11 in relation to three different tasks: Group A — subjects are assigned a topic question consisting of a single statement ; Group B — subjects are given a topic question consisting of both a statement and its opposite ; Group C — subjects are given an initial and a final sentence of a text, which they have (...) to complete, and which refers to opposite opinions . Six different types of text organization were evidenced on the basis of the argumentative moves presented in the texts, the linguistic indexes used to express the relationships between the moves, the presence or absence of counter-arguments and the type of argumentation or reasoning used. The organization of the texts range from a simple affirmation of a position to a use of data or reasons to support a position, to others still in which two positions are presented in the body of a unitary structure, developed ‘in parallel’ and interconnected regularly. Our analysis found a well-defined tendency corresponding to the age levels in the types of texts produced by the subjects. The texts produced by the younger group, the pupils in elementary school, contained a fairly simple structural organization, characterized by very few argumentations or a lack of explicitness of the essential moves and a juxtaposing of arguments. The older subjects, in particular those attending secondary school, were able to produce texts which were more complex with regard to the presence and the organization of the argumentative moves, and more coherent and cohesive with respect to their articulation of opinions and use of adequate linguistic indices to analyze t topic. As regards the different types of tasks, when the subjects were presented explicitly with two opposite opinions , they developed both positions in their responses, contrary to the situation in which they produced one position when only one of two opinions was presented. By an unfounded chain for a function f:X→X we mean a sequence nω of elements of X s.t. fxn+1=xn for every n. Unfounded chains can be regarded as a generalization of fixed points, but on the other hand are linked with concepts concerning non-well-founded situations, as ungrounded sentences and the hypergame. In this paper, among other things, we prove a lemma in general topology, we exhibit an extensional recursive function from the set of sentences of PA into itself without an (...) unfounded chain, and we prove that every term in a Magari algebra has an unfounded chain. The author places Grmek's editorial within the flux of the historiographical debate which, since the middle of the 1970s, has concentrated on two major crises due to the end of social science-oriented 'scientific history' and to the 'linguistic turn'. He also argues that Grmek's historiographical work of the 1980s and 1990s was to some extent an alternative to certain observed changes in historical fashion and has achieved greater intelligibility because of its commitment to a rational vision of science and historiography.

Para Freud, a disciplina que criou fazia indiscutivelmente parte das ciências da Natureza, e de modo algum daquelas 'do espírito', como então se chamavam na Alemanha as atuais ciências humanas. Para nós, contemporâneos, tal asserção parece muito estranha: que objeto poderia ser mais humano do que o espírito humano, tema da Psicanálise? Este artigo retoma esse problema pelo ângulo da partição entre os dois tipos de ciência que vigoravam no tempo e no ambiente cultural de Freud, no interior da qual (...) faz sentido a sua enfática afirmação. Mostra que já não dividimos o campo do saber da mesma maneira que então, o que torna possível alojar a Psicanálise ao lado de disciplinas como a História, a Etnologia e outras do mesmo gênero, portanto, no campo das ciências humanas. A parte final do texto explora alguns intrigantes paralelismos epistemológicos entre as noções de 'seleção natural' e 'inconsciente', e as estratégias retóricas de que Darwin e Freud - este, aparentemente sem se dar conta de que estava imitando seu grande predecessor - se utilizam para criar no leitor a convicção de que são indispensáveis para estruturar o campo das respectivas disciplinas.Freud had never any doubts that his invention belonged in the field of natural science, and not in the area of the 'sciences of the Spirit', as human/social sciences were then called in Germany. For us, this sounds strange: what could be more human than human mind, the subject of Psychoanalysis? This paper argues that the way of separating both fields in which Freud's claim makes sense has changed considerably since his day, so that we are justified in ranking Psychoanalysis on the same side as History, Anthropology and similar disciplines, as we usually do nowadays. It also explores some intriguing parallels between the notions of 'natural selection' and 'unconscious', as well as some rhetorical strategies employed by both Darwin and Freud - in this case, probably unaware that he was copying his great predecessor - when they set to the task of persuading their readers that those ideas cannot be dispensed with in their respective fields. O propósito deste artigo é o de evidenciar de que forma a afirmação de ser ser-para-a-morte de Heidegger pode ser entendido como condição de possibilidade para a responsabilização do desejo conforme formulado pela psicanálise lacaniana. Primeiro, descreve-se a estrutura do Dasein heideggeriano, bem como seus existenciais. Em seguida, analisa-se o uso e o sentido da noção de desejo em Lacan. Tanto numa existência autêntica, quanto num final de análise, onde o sujeito sabe lidar com suas perdas, diante da angústia, ele (...) assume um papel de protagonista de sua existência e consegue se responsabilizar pelo seu desejo. A análise, nesse sentido, serve como uma ferramenta que possibilita o sujeito lidar com este sofrimento decorrente da falta, deste nada que falou Heidegger. Evidentemente que a análise não objetiva eliminar esta falta ontológica, mas tão somente desconstruir os fantasmas que o sujeito construiu para afastar o que lhe é mais próprio, constitutivo de sua estrutura ontológica, qual seja, sua finitude. Portanto, tanto para Heidegger, por meio da afirmação da angústia frente à morte, quanto para Lacan, onde o sujeito assumiu a tragédia de sua existência – no final de análise –, é a afirmação da finitude que possibilita a responsabilização do desejo, de ser autêntico ou, se preferir, sujeito. There is a debate in philosophy and cognitive science over whether concepts – the building blocks of thought—are couched in a perceptual modality or are amodally represented. The empirical evidence so far collected seems not to have adjudicated this question yet, as reinterpretation of the same set of evidence by both supporters of modalism and amodalism have been provided. I offer a critique of such reinterpretations, arguing that they ultimately derive from theoretical problems in the definition of a modal representation. (...) In particular, I will review three criteria which have been offered to distinguish amodal concepts from modal ones: the isomorphism criterion, the neural location criterion, and the input specificity criterion. I will explain how these criteria often lack theoretical clarity, making it possible in most cases to propose a parsimonious explanation of the same set of data from both an amodalist and a modalist perspective. As a result, it becomes impossible to empirically discriminate between the two interpretations. My conclusion is that the main problem with the discussed criteria is that they frame the question on the format of concept as an either/or debate, by overlooking more interesting empirical questions. This article explores the critical realist conceptualization of authenticity through its development in tourism, especially in relation to indigenous Sámi culture. Authenticity is discussed through the often relativistic perspectives surrounding it. This paper proposes a middle ground between objective and existential views; it considers authenticity to be a compromise, and it focuses on both universal components (present in all Sámi people in the tourism context) as well as mediated components (such as characteristics differently influenced by geo-history). The role of cultural (...) tourism labels is also discussed. The overlying objective is to conceptualize authenticity so that it produces a positive effect on the tourism operations of Sámi people. Specifically, it argues that the use of certain labels or certifications, based on the concrete universal aspects of Sámi, can be beneficial. If the Sámi themselves are involved in the creation of such labels, they need not betray the objective of respecting Sámi culture. (shrink)

Dos desdobramentos freudianos acerca da civilização, questionaremos como, diante da eminencia de um futuro trágico, a indagação de formas alternativas de gozo pode originar uma sociedade menos hostil. Partindo de noções como pulsão de morte, agressividade e Super-Eu, veremos que a racionalização dos afetos não reclama nossa destrutividade. Da antinomia entre Eros e Thanatos, Freud conclama a independência das pulsões agressivas, alegando que a civilização é vivenciada como mal-estar. Assinalando como os desejos do outro estão implicados nos nossos, acentuaremos que (...) a agressividade instaura o Super-Eu, cuja função é impor sobre o Eu a mesma hostilidade que este satisfaria nos outros. Exercendo autoridade interna, o Super-Eu atravessa a subjetividade, indicando que não há nada que não garanta nossa própria catástrofe. Mas se a civilização está edificada sobre o resto da liberdade individual, então talvez a responsabilização pelo desejo permita pensar novas formas de subjetivação e, quiçá, numa sociedade menos hostil. Resumo: Percepção sensorial: até hoje um grande mistério filosófico. O presente trabalho divide-se em duas partes. A primeira sintetiza a crítica ao modelo representacionista intracerebral predominante, e enuncia um argumento que prepara o terreno para a segunda parte do trabalho. Nesta, a teoria pragmatista da percepção é equiparada à de Aristóteles, em De Anima. Eis, grosso modo, o argumento: percepção resulta de fatores causais da natureza inerentes à transação organismo ambiente; tais fatores não podem ser encontrados entre os elementos ontológicos (...) revelados na própria percepção; logo a estrutura ontológica revelada na percepção não reflete a total complexidade da transação real organismo ambiente. Esta conclusão é crucial para entender a teoria pragmatista-aristotélica da percepção; passagem da fase sujeito-no-mundo para a fase mundo-no-sujeito, via recepção imaterial de formas - estabelecimento de campo anteceptivo consciente de potencialidades de ação subentendidas em tais formas. Pragmatismo como naturalismo esclarecido: a percepção é a versão histórico-natural mais evoluída do mesmo mecanismo chave-e-fechadura próprio da detecção de formas inerente a interações ontológicas elementares - biológicas e mesmo físico-químicas. Mas em vez de detecção-na-ação nomológica/biológico automática: detecção consciente, em aberto, de possibilidades de ação livre inscritas no ambiente do precipiente.: Even today, sensorial perception is a great philosophic mystery. This work is divided in two parts: The first synthesizes and criticizes the prevailing cerebral representationism model and enunciates an argument that prepares the field to second one. In this second part the pragmatism perceptions theory is compared to Aristotle's De Anima. Here is, in a general way, the argument: perception is the result of nature's cause factors intrinsic to organism environment transaction; these factors cannot be encountered among revealed ontological elements of this same perception; therefore the ontological structure reveled by perception doesn't reflect the totality of the organism-environment's transaction complexity. This conclusion is vital to understand the Aristotelian-pragmatic perception theory: the subject-on-world's transposition to world-on-subject phase, via "immaterial reception of forms"- establishment of the anteceptive field conscious of the action potentialities in such way. Pragmatism naturalism cleared up: the perception is a natural-historic evolved version of this same key-and-locker mechanism proper to form detection intrinsic of elementary ontological, biologic and even physical-chemical interaction. But instead of detection in the automatic nomological/biological action: conscious detection, opened, of free actions possibilities inserted in the percipient environment. (shrink)

This paper criticizes the predominant, representational-neurophysicalist conception of sensory perception. It introduces the notion of "experience-field" to give a tentative ontological account of the phenomenological data of experience. The general idea is that visual experience, for instance, would be ontologically something like an experience-field extending over and between the central nervous sistem of the subject of the experience and the distal object of vision. I call this position phenomenological macrorealism, in contrast to scientific microrealism. Phenomenal qualities are not subjectively inside (...) the brain, but objectively inside perceptual extraencephalic experience-fields, or, as we say, out there in the world. Some specific consequences of phenomenological macrorealism are presented.Este artigo critica a concepção predominante, representacionista-neurofisicalista sobre a percepção sensorial. Introduz a noção de "campo-experiência" na tentativa de tratamento ontológico dos dados fenomenológicos da experiência. A idéia geral é que a experiência visual, por exemplo, seria ontologicamente algo assim como um campo-experiência de intencionalidade visual, que se estende por sobre e entre o sistema nervoso central do sujeito da experiência e o objeto distai da visão. Chamo esta posição de macrorrealismo fenomenológico, em contraste com o microrrealismo científico. Qualidades da fenomenalidade não estão subjetivamente dentro do cérebro, mas objetivamente dentro de campos-experiência perceptuais extra-encefálicos, ou, como dizemos, lá fora no mundo. Algumas conseqüências específicas do macrorrealismo fenomenológico são apresentadas. (shrink)

In this study the influence of irrational beliefs and perfectionism on the emergence of competitive anxiety was investigated. While previous studies indicate that higher irrational beliefs predict greater competitive anxiety, in the present study it is hypothesized that this relationship is mediated by perfectionism. A serial atemporal multiple mediation analysis revealed that both adaptive and maladaptive perfectionism were significant partial mediators between irrational beliefs and competitive anxiety. The total score and all four subscale scores on irrational beliefs had both direct (...) and indirect effects on cognitive competitive anxiety, the latter effects mediated by both forms of perfectionism. Depreciation beliefs had a direct effect, and demandingness and awfulizing had indirect effects, on somatic competitive anxiety when both forms of perfectionism were entered as mediators. These findings suggest that both irrational beliefs and perfectionism influence the emergence of competitive anxiety, therefore rational emotive behavioral therapy with a focus upon perfectionism may be an effective means of reducing competitive anxiety in athletes. The study includes the responses of 1537 students from 12 countries including Australia, Canada, China, Colombia, Ecuador, Hong Kong, Ireland, Japan, Nepal, South Africa, Spain, and the United States. The results of the analysis indicate that, on average, social desirability response bias decreases (increases) as a country’s Individualism (Uncertainty Avoidance) increases. The analysis also indicates that women scored significantly higher on Paulhus’ Image Management Subscale on an (...) overall basis and for seven of the 12 country comparisons. This research serves as a caution when considering the research findings of prior international survey-based ethics research that do not include a direct measure of social desirability response bias. For example, the finding that women score higher on Paulhus’ measure of social desirability response bias calls into question prior research that does not control for social desirability response bias indicating women are more ethically sensitive than men. This research is an extension of Walker Information’s (Business Ethics: Ethical Decision Making and Cases, pp. 235–255, 1999) study on employees’ job attitudes that was conducted exclusively in the United States. Walker Information found that the reputation of the organization, fairness at work, care, and concern for employees, trust in employees, and resources available at work were important factors in an employee’s decision to remain with his or her company. Our sample includes 713 students from seven countries: Canada, Colombia, Ecuador, (...) Hong Kong, Ireland, South Africa, and the United States. When analyzing the entire sample, our data indicate that both social desirability response bias and gender were significant; however, this was not the case when the data are analyzed by country. On an individual country basis, our data suggest that the generally accepted premise that women are more ethically conscious than men was only true for the samples from the United States and Canada. The data also indicate that, while social desirability response bias was significant for the four factors suggesting ethical components for the sample from the United States, this finding was not universal. In this paper, we propose a framework capable of dealing with anaphora and ellipsis which is both general and algorithmic. This generality is ensured by the compination of two general ideas. First, we use a dynamic semantics which reperent effects using a monad structure. Second we treat scopes flexibly, extending them as needed. We additionally implement this framework as an algorithm which translates abstract syntax to logical formulas. We argue that this framework can provide a unified account of a large (...) number of anaphoric phenomena. Specifically, we show its effectiveness in dealing with pronominal and VP-anaphora, strict and lazy pronouns, lazy identity, bound variable anaphora, e-type pronouns, and cataphora. This means that in particular we can handle complex cases like Bach–Peters sentences, which require an account dealing simultaneously with several phenomena. We use Haskell as a meta-language to present the theory, which also consitutes an implementation of all the phenomena discussed in the paper. To demonstrate coverage, we propose a test suite that can be used to evaluate computational approaches to anaphora. (shrink)

Por que amamos? O que está por trás desse sentimento que, segundo dizem, move montanhas? É se debruçando sobre a filosofia, a ancestralidade, mitos africanos, indígenas, orientais, ocidentais e até sobre a biologia que Renato Noguera nos leva a refletir sobre os diferentes significados do amor. Amar é querer aprender, ensinam-nos os gregos. A esse aprendizado, soma-se outro fundamental, desta vez proveniente de culturas afro-indígenas: amar não é uma emoção individual, mas coletiva, e pode envolver duas, três, quatro pessoas, (...) ou mesmo uma comunidade inteira – o que é explicado também pela biologia. A alquimia de Noguera está em mostrar como os ensinamentos de filósofos e pensadores das mais diversas eras e sociedades não se contradizem, mas complementam-se. Por que amamos? Não há apenas uma resposta – assim como não há apenas uma forma de amor. (shrink)
