Kenneth R. Westphal presents an original interpretation of Hume's and Kant's moral philosophies, the differences between which are prominent in current philosophical accounts. Westphal argues that focussing on these differences, however, occludes a decisive, shared achievement: a distinctive constructivist account of the basic principles of justice which justifies their strict objectivity without invoking moral realism nor moral anti- or irrealism. Westphal explores how Hume developed a kind of constructivism for basic property rights and for government, and how (...) Kant greatly refined Hume's construction of justice within his 'metaphysical principles of justice', whilst preserving the core model of Hume's innovative account. Westphal contends that Hume's and Kant's constructivism avoids the conventionalist and relativist tendencies latent if not explicit in contemporary forms of moral constructivism. (shrink)

The scope of this study is both ambitious and modest. One of its ambitions is to reintegrate Hegel's theory of knowledge into main stream epist~ology. Hegel's views were formed in consideration of Classical Skepticism and Modern epistemology, and he frequently presupposes great familiarity with other views and the difficulties they face. Setting Hegel's discussion in the context of both traditional and contemporary epistemology is therefore necessary for correctly interpreting his issues, arguments, and views. Accordingly, this is an issues-oriented study. I (...) analyze Hegel's problematic and method by placing them in the context of Sextus Empiricus, Descartes, Kant, Carnap, and William Alston. I discuss Carnap, rather than a Modern empiricist such as Locke or Hume, for several reasons. One is that Hegel himself refutes a fundamental presupposition of Modern empiricism, the doctrine of "knowledge by acquaintance," in the first chapter of the Phenomenology, a chapter that cannot be reconstructed within the bounds of this study. The First World War was supposed to end all wars, though soon followed WWII. Since 1945 wars continued to abound; now we confront a real prospect of a third world war. Many armed struggles and wars arise in attempts to end repressive government; still more are fomented by repressive governments, few of which acknowledge their repressive character. It is historically and culturally naive to suppose that peace is normal, and war an aberration; war, preparations for war and threats of war (...) belong to ‘normal’ human life. Our tolerance, acceptance or fostering of such repeated injustices and atrocities indicate pervasive failures to understand fundamentals of justice, and what we owe morally to ourselves and to all others, together with our responsibilities to preserve the biosphere, not merely our own store(s) of reserves. As matters both of justice and prudence we must re-orient ourselves, individually and collectively, to promote justice, peace and ecological responsibilities by identifying and instituting just forms of social cooperation, domestically and internationally. All of these are our problems, whether we recognize them or continue our pervasive negligence. We urgently require cogent understanding of the social dimensions of human judgment, rational assessment, right action, and public reason. This requires understanding (inter alia) how Kant’s explication of rational judgment and justification is fundamentally social, how these features of rational judgment and justification are constitutive of Kant’s account of individual autonomy, and how they are central to Kant’s account of proper public use of reason. Reasoning publically remains precarious, not because – as often alleged – the ‘Enlightenment project’ has failed. It has not failed, it has been thwarted, and in our public responsibilities we have too often failed it. (shrink)

This book assesses and defends Kant's Critical epistemology, and the rich yet neglected resources it provides for understanding and resolving fundamental issues regarding human experience, perceptual judgment, empirical knowledge and cognitive sciences. Kenneth Westphal first examines Kant's methods and strategies for examining human sensory-perceptual experience, and then examines Kant's central, proper, and subtle attention to judgment, and so to the humanly possible valid use of concepts and principles to judge particulars we confront. This provides a comprehensive account of Kant's (...) anti-Cartesianism, the integrity of his three principles of causal judgment, and Kant's account of disciminatory perceptual-motor behaviour, including both sensory reafference and perceptual affordances. Westphal then defends the significance of Kant's subtle and illuminating account of causal judgment for three main philosophical domains: history and philosophy of science, theory of action and human freedom, and philosophy of mind. Kant's Critical Epistemology will appeal to researchers and advanced students interested in Kant and the relations of his thought to contemporary philosophical debates and to the sciences of the mind. In this book, Westphal offers an original interpretation of Hegel's moral philosophy. Building on his previous study of the role of natural law in Hume's and Kant's accounts of justice, Westphal argues that Hegel developed and justified a robust form of civic republicanism. Westphal identifies, for the first time, the proper genre to which Hegel's Philosophical Outlines of Justice belongs and to which it so prodigiously contributes, which he calls Natural Law Constructivism, an approach developed by Hume, (...) Rousseau, Kant, and Hegel. He brings to bear Hegel's adoption and augmentation of Kant's Critique of rational judgment and justification in all non-formal domains to his moral philosophy in his Outlines. Westphal argues that Hegel's justification for the standards of political legitimacy successfully integrates Rousseau's Independence Requirement into the role of public reason within a constitutional republic. In these regards, Hegel's moral and political principles are progressive not only in principle, but also in practice. This book is the first detailed study of Kant's method of 'transcendental reflection' and its use in the Critique of Pure Reason to identify our basic human cognitive capacities, and to justify Kant's transcendental proofs of the necessary a priori conditions for the possibility of self-conscious human experience. Kant famously declares that “although all our cognition commences with experience, … it does not on that account all arise from experience”. This marks Kant’s disagreement with empiricism, and his contention that human knowledge and experience require both sensation and the use of certain a priori concepts, the Categories. However, this is only the surface of Kant’s much deeper, though neglected view about the nature of reason and judgment. Kant holds that even our a priori concepts are acquired, not from (...) sensation, but “originally,” because our mind has a fundamental capacity to judge that, upon sensory stimulation, generates the Categories through its basic logical functions of judgment. This “epigenesis” of reason and our fundamental capacity to judge that drives it is the topic of Longuenesse’s fascinating book, and the source of her title. (shrink)

This article examines how Quine and Sellars develop informatively contrasting responses to a fundamental tension in Carnap’s semantics ca. 1950. Quine’s philosophy could well be styled ‘Essays in Radical Empiricism’; his assay of radical empiricism is invaluable for what it reveals about the inherent limits of empiricism. Careful examination shows that Quine’s criticism of Carnap’s semantics in ‘Two Dogmas of Empiricism’ fails, that at its core Quine’s semantics is for two key reasons incoherent and that his hallmark Thesis of Extensionalism (...) is untenable. The tension in Carnap’s semantics together with Quine’s exposure of the severe limits of radical empiricism illuminate central features of Sellars’s philosophy: the fully general form of the myth of givenness, together with Sellars’s alternative Kantian characterisation of understanding; the full significance of Carnap’s distinction between conceptual analysis and conceptual explication, and its important methodological implications; the specifically pragmatic character of Sellars’s realism; and Sellars’s methodological reasons for holding that philosophy must be systematic and that systematic philosophy must be deeply historically and textually informed. This paper thus re-examines this recent episode of philosophical history for its philosophical benefits and systematic insights. (shrink)

I argue that Hegel is aware of a crucial problem in Kant’s transcendental account of the conditions of human knowledge. Unless the matter of sensation is sufficiently ordered (and sufficiently varied) we could not make any cognitive judgments. In that case we could not distinguish ourselves from objects we know, and so could not be self-conscious. This is a necessary, formal and transcendental condition of possible human experience. However, it is also (as Kant acknowledged) a material – not a conceptual (...) or an intutive – condition. Consequently, Kant’s idealism cannot account for it. This provides one key to Hegel’s internal critique of Kant’s idealism. (shrink)

The term ‘realism’ and its contrasting terms have various related senses, although often they occlude as much as they illuminate, especially if ontological and epistemological issues and their tenable combinations are insufficiently clarified. For example, in 1807 the infamous ‘idealist’ Hegel argued cogently that any tenable philosophical theory of knowledge must take the natural and social sciences into very close consideration, which he himself did. Here I argue that Hegel ably and insightfully defends Newton’s causal realism about gravitational force, in (...) part by exposing a fatal equivocation in the traditional concept of substance, by criticizing some still-standard empiricist misconceptions of force, by emphasizing the role of explanatory integration in Newtonian mechanics, and by using his powerful semantics of singular, specifically cognitive reference to justify fallibilism regarding empirical justification, together with the semantic core of Newton’s Rule Four of (experimental) Philosophy—in a way that highlights a key fallacy in many arguments against realism, both in epistemology and within philosophy of science. Henry Harris noted that ‘the Baconian applied science of this world is the solid foundation upon which Hegel’s ladder of spiritual experience rests’. Understanding the philosophical character of Hegel’s Philosophy of Nature requires recognizing some basic legitimate philosophical issues embedded in the development of physics from Galileo to Newton (§2). These issues illuminate the character of Hegel’s analysis of philosophical issues regarding nature (§3) and the central aims and purposes of Hegel’s philosophy of nature (§4). Hegel recognized some key weaknesses (...) in Newton’s own mathematical treatment of planetary orbits which were only rectified when Johann Bernoulli recast Newtonian gravitational theory on the basis of mathematical analysis (calculus). So reconstructed, Newtonian physics provides sufficient grounds to ascribe gravitational force to matter (Enz. §§262, 269). Hegel incorporated this important point into his illuminating accounts of causal laws of nature and natural-scientific explanation. These points reveal how Hegel’s Science of Logic and Philosophy of Nature are interdependent works, integrated in part by Hegel’s critical, moderately holistic theory of semantic meaning and reference. Highlighting these features of Hegel’s Philosophy of Nature illuminates Hegel’s emergentist account of structural and functional organization of various kinds of natural phenomena. (shrink)

Despite extensive examination of Kant’s Transcendental Idealist account of freedom of action, an important question has been neglected about why and how Kant can use two distinct models of human action when considering any particular human act. The present paper examines and answers this question, revealing neglected yet important points about Kant’s account of action and its understanding and assessment.

Kant’s account of cognitive judgment is sophisticated, sound and philosophically far more illuminating than is often appreciated. Key features of Kant’s account of cognitive judgment are widely dispersed amongst various sections of the Critique of Pure Reason, whilst common philosophical proclivities have confounded these interpretive difficulties. This paper characterises Kant’s account of causal-perceptual judgment concisely to highlight one central philosophical achievement: Kant’s finding that, to understand and investigate empirical knowledge we must distinguish between predication as a grammatical form of sentences, (...) statements or judgments, and predication as a cognitive act of ascribing some characteristic to some localised particular. With Kant’s finding in view, I then elucidate how we have occluded his achievement. My results are not merely interpretive, but philosophical, because they show that Kant’s account of perceptual judgment accords with – and indeed justifies – a central and sound point regarding language, thought and reference advocated by apparently unlikely philosophical comrades. These finding highlight some methodological cautions which require re-emphasis today. (shrink)

I first highlight a main theme of the collection I edited and issued last year, Realism, Science and Pragmatism, by contrasting classical pragmatism and neo-pragmatism in terms of the distinction between semantic externalism and semantic internalism, and exhibiting how both of these semantic views are concisely stated by Carnap, though neither he nor his followers recognised this contrast, nor its profound methodological and substantive implications – although they were highlighted at the time by Wick, published by Wilfrid Sellars and Herbert (...) Feigl in the second year of their journal, Philosophical Studies. I exhibit the continuing influence of semantic internalism – which dominates Quine’s, Rorty’s, van Fraassen’s, Brandom’s and Huw Price’s neo-pragmatist views – and argue against it with pragmatic realist considerations drawn from Kant, Carnap and Sellars. This paper argues that Hegel’s Philosophical Outlines of Justice develops an incisive natural law theory by providing a comprehensive moral theory of a modern republic. Hegel’s Outlines adopt and augment a neglected species of moral constructivism which is altogether neutral about moral realism, moral motivation, and whether reasons for action are linked ‘internally’ or ‘externally’ to motives. Hegel shows that, even if basic moral norms and institutions are our artefacts, they are strictly objectively valid because for our very finite form (...) of semi-rational embodied agency they are necessary and because sufficient justifying grounds for these norms and institutions can be addressed to all persons. Hegel’s moral constructivism identifies and justifies the core content of a natural law theory, without invoking metaphysical issues of moral realism, anti-realism, irrealism or ‘truth makers’, etc. I begin with Socrates’ question to Euthyphro to distinguish between moral realism and moral irrealism. I then summarise basic points of constructivist method and how Hume’s theory of justice inaugurates this distinctive species of natural law constructivism. How this approach addresses issues of political legitimacy is highlighted by Rousseau’s juridical innovation. How this approach is better articulated and justified by Kant’s specifically Critical method is briefly considered in connection with his justification of rights to possession, so that we can then recognise Hegel’s natural law constructivism in his Outlines. Hegel’s account of rights to possession corresponds closely to Kant’s, and his account of juridical relations as human interrelations accords with natural law constructivism. This finding is corroborated by some central features of Hegel’s account of Sittlichkeit, including how Hegel adopts, undergirds and augments Rousseau’s and Kant’s Independence Requirement for political legitimacy. The apparent implications of the latest findings of the life sciences for our freedom and autonomy are both exciting and controversial: They undermine a common view of human freedom: a fundamentally Cartesian view. A superior account of our freedom was developed by Kant and Hegel. Key features of Hegel's account show that we can expect from the life sciences further insights into the biological basis of our freedom and autonomy, but not their repudiation. I begin with basic features of Cartesian (...) self-transparency (II) and then review three findings of contemporary life sciences (III). I then detail key features of Hegel's anti-Cartesianism (IV), in order to formulate the basic question about our freedom posed by the claim that biology explains away human freedom (V). I criticize this biological determinism by drawing upon Hegel's account of human freedom as autonomy (VI), and comment briefly on biologism in moral theory (VII). (shrink)

This article summarizes the systematic importance of Hegel’s philosophy for pragmatism, and in particular for the contemporary revival of pragmatic realism. Key points lie in Hegel’s internal critique of Kant’s transcendental idealism, on the basis of which Hegel demonstrates that we can be self-conscious only if we are conscious of nature. This insight enables Hegel to develop genuinely transcendental proofs without invoking transcendental idealism. Hegel uses this result to defend realism about the molar objects of empirical knowledge against Pyrrhonian, Cartesian, (...) and Humean scepticism. In this connection Hegel criticizes and rejects both coherentist and foundationalist theories of cognitive justification and argues for a pragmatic fallibilist theory of justification regarding empirical knowledge. Hegel argues (like Dewey) that individuals and social groups are mutually interdependent for their existence and characteristics; neither is more basic than the other. (shrink)

This paper answers the question, what is Kant’s ‘Critical Philosophy’? The answer is not provided by a bibliography of Kant’s main works, nor by his transcendental idealism. The answer consists in Kant’s critique of our human capacity to judge and of those rational principles by which we can properly judge matters accurately and cogently. To show this, three key features of Kant’s critique of rational judgment are examined: Five constitutive characteristics of our human capacity to judge (§2), two basic theses (...) of Kant’s Critical Philosophy (§3) and a table of basic systematic questions and their Critical answers (§4). This conspectus is philosophically significant because it clearly identifies Kant’s Critical method and its key considerations, which continue to be widely neglected when considering philosophical method (§5). This paper examines Hegel’s ontological revolution in ‘Force and Understanding’. I argue that understanding Hegel’s critical engagement with natural science is important for understanding Hegel’s 1807 Phenomenology of Spirit as well as his mature philosophy as a whole. Already in this chapter Hegel argues that philosophical theory of knowledge must take the natural sciences into close consideration. Hegel disambiguates the standard concept of substance in order to show that relational properties can be essential to particular individuals. He further argues that (...) Newtonian gravitational theory suffices to show that gravitational force is essential to matter. These are important tenets of Hegel’s moderately holistic ontology, according to which individuals and their relations are mutually interdependent for their existence and characteristics. These tenets enable Hegel to expose a number of misconceptions about causal forces central to empiricist causal scepticism, to illuminate the causal realism involved in and justified by Newtonian gravitational theory (once it is recast by Bernoulli on the basis of mathematical analysis), the explanatory power provided by theoretical integration of special theories within more general theories and also the crucial semantic role played by special theories for the general theory which subsumes them. This essay re-examines some key fundamentals of the Enlightenment regarding individual rights, responsibilities and republicanism which deserve and require re-emphasis today, insofar as they underscore the character and fundamental importance of mature judgment, and how developing and fostering mature judgment is a fundamental aim of education. These fundamentals have been clouded or eroded by various recent developments, including mis-guided educational policy and not a little scholarly bickering. Clarity about these fundamentals is more important today than ever. Sapere aude!
