The prospect of European elections has begun to alter the conditions under which national poli tical parties exercise their functions. It has brought parties to negociate common platforms and to strengthen transnational organizations. How these organizations wilt be structured, what functions they wilt assume, will be determined largely by the issue of a conflict-solving process between existing national structures, by the ability of national parties to accomplish new functions in a European system, and by the demands of that system.This study (...) presents a tentative framework of analysis for the examination of European groupings of political parties. It may help to interpret current negotiations and future actions of these organizations with reference to the criteria, structures and functions that are classically those of political parties. R. Malthus's Essay on Population (1798), which he later claimed first suggested to him the idea that "on the whole the best fitted live." This idea Darwin would popularize through the notion of the "struggle for existence," a phrase which he famously claimed to use as a "metaphor" but which meant simply "the doctrine of Malthus applied with manifold force to the whole animal and vegetable kingdoms." 2 That application resulted in the publication [End Page 223] of the Origin of Species in 1859, an occasion hailed as "the greatest event of Queen Victoria's reign," 3 even "by far the most important... in the history of the modern West." 4 It is well known, too, that Darwin's appreciation of Malthus was not unique even among naturalists. The year before the Origin of Species appeared another young man, Alfred Russel Wallace, aged 25, encountered the very same book. "There suddenly," he later recalled, flashed upon him "the idea of the survival of the fittest." 5 We know Wallace today, thus, as the codiscoverer of theory of natural selection, who presented a paper jointly with Darwin at the Linnean Society on that momentous evening of 1 July 1858 to mark their brilliant achievement. 6This curious coincidence has often been noted, but its ramifications require further assessment. Natural Property Rights presents a novel theory of property based on individual, pre-political rights. The book argues that a just system of property protects people's rights to use resources and also orders those rights consistent with natural law and the public welfare. Drawing on influential property theorists such as Grotius, Locke, Blackstone, and early American statesmen and judges, as well as recent work in in normative and analytical philosophy, the book shows how natural rights guide political and legal reasoning about (...) property law. The debate over the influence of American culture upon Europe and the rest of the world is hardly new. Discussions about the cultural effects of video recorders, satellite broadcasting, cable television and their likely content are only the latest episode in a long-running drama in which the young and aggressive culture of America bludgeons the elderly culture of old Europe (or correspondingly overruns and wipes out the quaint but ill-armed ethnic cultures of the less-developed world, dragging the natives from coconuts (...) to Coca-Cola in a generation of identity crisis). But though there has been much written about some aspects of this issue, and most non-Americans who have come into contact with American culture have some awareness of its dimensions, there is also much which remains unclear, and ill- or misunderstood. In this essay two aspects of this large and complex problem will be examined. Firstly, the problem of how the “Americanisation of world culture” has been understood until now will be outlined, by looking at its background in the mass culture critique of the 19th and 20th centuries, with some current notions of what American culture is, and some accounts of how it has been internationalized. My aim in this first section is in particular to try to isolate “American culture” from commercial and industrial culture more generally, for a conflation of these phenomena is widespread and very misleading. Secondly, a normative argument will be outlined from the premises that a “superculture” is indeed developing and that, though it is less threatening than many suspect, it requires a vital measure of resistance if many valuable elements of human experience are not to be relegated to anthropology museums. The central value which will be defended here, however, is not “Europeanism” or “Americanism”, but rather the central liberal virtue of diversity, of which cultural expression is an extremely important form. My attempt to develop a politics of cultural protectionism, then, represents a wish to surpass simplistic rejections of American culture and to come to terms with the confrontation of culture with industrial society itself. This involves going beyond the traditional discussion of culture in one country, however, and trying to extend the mass culture debate to the international arena, where the present debate on this problem is far more complex but often less sophisticated. Noam Chomsky and Frances Egan argue that David Marr’s computational theory of vision is not intentional, claiming that the formal scientific theory does not include description of visual content. They also argue that the theory is internalist in the sense of not describing things physically external to the perceiver. They argue that these claims hold for computational theories of vision in general. Beyond theories of vision, they argue that representational content does not figure as a topic within formal computational theories (...) in cognitive science. I demonstrate that Chomsky’s and Egan’s claims about Marr’s theory are false. Marr’s computational theory contains a mathematical theory of visual content, based on empirical psychophysical evidence. It also contains mathematical descriptions of distal physical surfaces and objects, and of their optic projection to the perceiver. Much computational research on vision contains these types of intentional and externalist components within the formal, mathematical, theories. Chomsky’s and Egan’s claims demonstrate inadequate study and understanding of Marr’s work and other research in this area. Computational theories of vision, by containing empirically based mathematical theories of visual content, to this extent present naturalizations of semantics. (shrink)

ABSTRACTIn scholarship on intellectual property, nonconsequentialist justifications for IP rights seem to suffer from one of two flaws. To some, such justifications seem indeterminate; they seem not to offer concrete guidance about how rights should be structured in practice. To others, such justifications seem dogmatic; they seem to mandate certain conclusions without letting decision makers consider the relevant context or consequences of different proposals to regulate IP. Both impressions neglect an important dimension of reasoning about rights—practical reason. In perfectionist theories (...) of law, ‘practical reason’ describes the principles by which general justifications for rights are implemented in specific decisions in politics and ethics. This article introduces practical reason to IP scholarship, and it shows how practical reason facilitates reasoning about the design of different legal IP rights. After the many meetings held in 2016 to commemorate the five hundredth anniversary of the publication of Thomas More's Utopia, it seems fitting that we should consider the relevance of its central themes to the idea of what Europe has come to represent in the past sixty years or so. This article will proceed by recalling More's leading ideas and then indicating how later thinkers, especially after 1800, moved some of these in a specifically European direction. After touching on some (...) key moments in the European utopian narrative, this article will briefly consider some discordant dystopian episodes in this story. Then it will turn to the present and to our prospects for the longer-term future, or, at any rate, the rest of the twenty-first century. (shrink)

There are some serious misapprehensions about my arguments in Moylan's treatment, as well as a failure to engage with some of the central themes of the book. Substantial differences also clearly exist between my approach and Moylan's approach to the subject of dystopia and indeed to scholarly engagement in general. This chapter summarizes current predictions as to the likely prospect of environmental catastrophe in the coming century, and then asks a series of questions about prospective Marxist responses to the problem. A brief overview of Marx's view of nature reveals an ambiguity about prospective future consumption by the working classes in a communist society. This is followed by scrutiny of Soviet approaches to consumerism in particular in which a similar tension is evident between opposition to crass consumerism and luxury and (...) the need to satisfy widespread and increasing demands for commodities. Here a degree of inevitability in the development of consumer culture is evident. Finally the specific problems resulting from the need to place an abrupt brake on patterns of industrialization is addressed. The little book we now familiarly refer to as Utopia was published five hundred years ago in Leuven, the capital of what is today the Flemish province of Brabant in Belgium. As a work of fantasy it has had an astonishingly successful history. As both the no-place and the good-place, then eventually perhaps also the place-one-should-not-go, the dream that becomes a nightmare when we try to realize it, utopia has become inscribed in our vocabulary and our ideas. Many discussions of J. S. Mill's concept of liberty focus too narrowly on On Liberty and fail to acknowledge that his treatment of related issues elsewhere may modify its leading doctrines. Mill and Paternalism demonstrates how a contextual reading suggests that in Principles of Political Economy, and also his writings on Ireland, India and on domestic issues like land reform, Mill proposed a substantially more interventionist account of the state than On Liberty seems to imply. This helps to explain Mill's (...) sympathies for socialism after 1848, as well as his Malthusianism and feminism, which, in conjunction with Harriet Taylor's views, are central to his later discussions of the family and marriage. Feminism, indeed, is shown to provide the answer to the problem which most agitated Mill, overpopulation. Thus Gregory Claeys sheds new lights on many of Mill's overarching preoccupations, including the theory of liberty at the heart of On Liberty. (shrink)

This article examines approaches to early socialism from an intellectual history viewpoint, focussing on British Owenite socialism. It assesses the author's own research in the field over the past thirty-five years in an effort to measure the strengths and weaknesses of the approaches he initially adopted to the field. It attempts to balance insights associated with the so-called “Cambridge School” with those gained in particular from the standpoints of the history of religion and the history of emotions, and a theory (...) of group identity which can in part be associated with the history of utopianism. In this chapter a new problem about rule-following is outlined, one that is distinct both from Kripke’s and Wright’s versions of the problem. This new problem cannot be correctly responsed to, as Kripke’s can, by invoking Wright’s Intentional Account of rule-following. The upshot might be called, following Kant, an antinomy of pure reason: we both must — and cannot — make sense of someone’s following a rule. Paul Thom's book presents Kilwardby's science of logic as a body of demonstrative knowledge about inferences and their validity, about the semantics of non-modal and modal propositions, and about the logic of genus and species. This science is thoroughly intensional. It grounds the logic of inference on "that in virtue of which" the inference holds. It bases the truth conditions of propositions on relations between conceptual entities. It explains the logic of genus and species through the notion of essence. (...) Thom interprets this science as a formal logic of intensions with its own proof theory and semantics. This comprehensive reconstruction of Kilwardby's logic shows the medieval master to be one of the most interesting logicians of the thirteenth century. (shrink)

This article considers how John Stuart Mill's relationship with philosophical necessitarianism, or the idea that character is formed by external circumstances, came to pervade his later thought, and was central to his eventual presentation of the famous theory of liberty outlined in _ On Liberty _, for which he remains best known today. My main argument here extends Bernard Semmel's suggestion that "The conflict between philosophical liberty and necessity, between free will and determinism, was critical to the argument of _ (...) On _ _ Liberty _, in keeping with the central role it played in Mill's thought", by providing a more extended discussion of the Owenite background in particular. Contrary to the disingenuous disclaimer Mill offers initially in _ On Liberty _, the doctrine of free will is actually central to his case for individuality, and to his defence of social liberty. This was in turn the outcome of a process of deliberation about these issues which had been ongoing since 1826. My concern he... (shrink)

The Renaissance was a period of great intellectual change and innovation as philosophers rediscovered the philosophy of classical antiquity and passed it on to the modern age. Renaissance philosophy is distinct both from the medieval scholasticism, based on revelation and authority, and from philosophers of the seventeenth and eighteenth centuries who transformed it into new philosophical systems. Despite the importance of the Renaissance to the development of philosophy over time, it has remained largely understudied by historians of philosophy and professional (...) philosophers. This anthology aims to correct this by providing scholars and students of philosophy with representative translations of the most important philosophers of the Renaissance. Its purpose is to help readers appreciate philosophy in the Renaissance and its importance in the history of philosophy. The anthology includes translations from philosophers from the thirteenth to the seventeenth centuries, and it ranges from works on moral and political philosophy, to metaphysics, epistemology, and natural philosophy, thereby providing historians and students of philosophy with a sense for the nature, breadth, and complexity of philosophy in the Renaissance. Paul Helm investigates what religious faith is and what makes it reasonable.

According to the standards of public law, municipal polls have only a local scope : the election of a common council. Do politicians make deductions concerning the formal political power-constellation on national level either from the approach of municipal elections or from their results? Can these elections lead to changes in or of the government and eventually to anticipated legislative elections?After the first world-war, the electorate was called eight times to vote for new common councillors. Half of these elections had (...) no influence on the national power-constellation :they hardly stirred the national political life. In 1958 any possible influence of the municipal elections was even a priori ruled out. A remarkable point is that all municipal elections which took place undergovernments of national union, were only of local importance.Since the first world-war not a single municipal election has led to changes within the government : there was never a redistribution of ministerial portfolios amongst the coalitionpartners, nor did any electioncause the dismissal of an individual minister.It is traditional in Belgian politics that the national opposition, when the results of municipal elections are in its favour and prejudicial to the party in office, tries to call in question the legitimacy of the government in the opinion of the public by the way of motions or interpellations in parliament, claiming dismissal of the government or anticipated legislative elections. At these occasions it appeared unimportant whether the parliamental majority were confortable or not. But never did the governments give in to these attempts.The elections of 1857, 1884 and 1932 constitute an element of power - although of subsidiary importance - in the discharge of the then governments. The governmental crisis of 1884 however can only be explained if the constitutional position of Leopold II is taken into account. With all other factors alike, such a crisis wouldn't arise any more in the context of to-day. The municipal elections of 1932 have moreover led to anticipated legislative elections whose date was an element of power in the election-process. At that time, these elections played the part of an indicator of the electorial condition, comparable to that of the by elections in Great-Britain. And an unreliable indicator too, in view of the difference between national and local electionstatures. (shrink)

We sometimes strive to achieve difficult goals when our evidence suggests that success is unlikely – not just because it will require strength of will, but because we are targets of prejudice and discrimination or because success will require unusual ability. Optimism about one’s prospects can be useful for persevering in these cases. That said, excessive optimism can be dangerous; when our evidence is unfavourable, we should be at most agnostic about whether we will succeed. This paper explores the nature (...) and rational significance of agnostic practical commitments. Most importantly, the rationality of striving against the odds can depend on investing in a plan for failure: a plan B. I aim to make headway on an account of what backup plans are, how they are related to primary plans, and whether the standard norms of plan rationality apply to our agnostic commitments. (shrink)

The relationship between abstract formal procedures and the activities of actual physical systems has proved to be surprisingly subtle and controversial, and there are a number of competing accounts of when a physical system can be properly said to implement a mathematical formalism and hence perform a computation. I defend an account wherein computational descriptions of physical systems are high-level normative interpretations motivated by our pragmatic concerns. Furthermore, the criteria of utility and success vary according to our diverse purposes and (...) pragmatic goals. Hence there is no independent or uniform fact to the matter, and I advance the ‘anti-realist’ conclusion that computational descriptions of physical systems are not founded upon deep ontological distinctions, but rather upon interest-relative human conventions. Hence physical computation is a ‘conventional’ rather than a ‘natural’ kind. (shrink)
