The main objective of this research is to identify the current panorama of scientific production associated with governance in university institutions. A bibliometric analysis was developed in Scopus using R Core Team 2022-Bibliometrix and Vosviewer software. The results highlight the countries with the highest productivity in the topic of study, with the most representative authors favoring the understanding of governance. Since 2002, legislation in Spain has allowed for the creation and documentation of end-of-life decisionmaking. Over the intervening years, the actual implementation of such documents is very low. Through extensive analysis of the literature, this article explores the current status of the use of and attitudes toward advance directives in Spain and then proposes strategies for improvement in their implementation.

This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

In this paper we describe an experimental test of the validity of the Pauli Exclusion Principle (for electrons) which is based on a straightforward idea put forward a few years ago by Ramberg and Snow (Phys. Lett. B 238:438, 1990). We perform a very accurate search of X-rays from the Pauli-forbidden atomic transitions of electrons in the already filled 1S shells of copper atoms. Although the experiment has a very simple structure, it poses deep conceptual and interpretational problems. Here we (...) describe the experimental method and recent experimental results, which we interpret in the framework of quon theory. Informed consent forms have been useful in clinical practice and they constitute a part of the shared decision making in the informed consent process. They provide information to patients about clinical procedures and techniques. They also act as a remainder of the information discussed after the medical interview. Sometimes these documents are not readable to everybody. Belgian law specifies that all information that patients receive has to be proportionate verbally, but written information is also handled. The present research analyzes the (...) readability of the Flemish informed consent forms located in the webs of all General Hospitals using a simple random sample of 75 informed consent forms. By using the Douma tool, which bases its analysis in the length of words and sentences, the readability mean of the sample was 46, level “Difficult”. The 59% of them had a difficult level. The 11% were normal. It is a fact, then, that the 59% of the informed consent forms evaluated in this study are not suitable for everybody in Flanders, especially those people with low literacy. There were some researches made in other countries that agreed with these results. Written clinical information was poorly written so the informed consent forms were not working helping patients to recall information nor helping patients to become a part in the shared decision making about their health. The use of readability formulas represented a simple way to discriminate those informed consent forms that had normal readability scores from those that should be adapted. (shrink)

Esta comunicación examina cómo la pandemia de la COVID-19 ha impactado en la ya existente brecha de género en la trayectoria académica de las investigadoras y docentes de nuestras universidades. Para examinar dicho impacto, se realiza una revisión de varias investigaciones realizadas en España y en Portugal durante el periodo de confinamiento derivado de la pandemia. Los resultados recabados indican que durante el confinamiento creció la producción científica de los varones, y disminuyó la de las mujeres, entre otras diferencias relacionadas (...) con el trabajo académico en general (docencia, gestión, investigación). Una de las principales causas apunta a la brecha de cuidados existente. Esta situación requiere la necesidad de ampliar las medidas para evitar la desigualdad de género en la academia. (shrink)

The present study aims to explore whether the symptoms associated with fibromyalgia are contextually influenced by the area of residence. Furthermore, it is analyzed whether the effect of the acceptance of the disease on the emotional, cognitive and physical symptoms is moderated by the patients’ place of residence. Using a cross-sectional design, a total of 234 women with fibromyalgia were surveyed, of which 55.13% resided in rural areas and 44.87% in urban areas. Self-reported questionnaires were used to assess pain severity, (...) anxiety and depression, functional limitation, physical and mental fatigue and acceptance of the disease. The results show significant differences in acceptance, pain, and physical and mental fatigue between patients from rural and urban areas. The rural area patients presented higher levels of acceptance and pain and lesser levels of physical and mental fatigue compared to the urban area. The moderation analysis add that, only in patients from the rural area, the variables of physical symptoms were significantly and negatively associated with acceptance. This study addresses for the first time the role of the place of residence in suffering from fibromyalgia, suggesting that the rural or urban environment plays a relevant role in the severity and/or management of symptoms in fibromyalgia women. IntroductionRheumatologists are the primary healthcare professionals responsible for patients with rheumatic diseases and should acquire medical ethical competencies, such as the informed consent process. The objective clinical structured examination is a valuable tool for assessing clinical competencies. We report the performance of 90 rheumatologist trainees participating in a station designed to evaluate the ICP during the 2018 and 2019 national accreditations.MethodsThe station was validated and represented a medical encounter in which the rheumatologist informed a patient with systemic lupus erythematosus with (...) clinically active nephritis about renal biopsy. A trained patient–actor and an evaluator were instructed to assess ICP skills in obtaining formal informed consent, delivering bad news and overall communication with patients. The evaluator used a tailored checklist and form.ResultsCandidate performance varied with ICP content and was superior for potential benefit information but significantly reduced for potential complications and biopsy description. Only 17.8% of the candidates mentioned the legal perspective of ICP. Death was omitted by the majority of the candidates ; after the patient–actor challenged candidates, only 57.1% of them gave a clear and positive answer. Evaluators frequently rated candidate communications skills as superior, but ≥1 negative aspect was identified in 69% of the candidates.ConclusionsEthical competencies are mandatory for professional rheumatologists. It seems necessary to include an ethics competency framework in the curriculum throughout the rheumatology residency. (shrink)

There has been little investigation of male adolescent violence against women as acknowledged by boys themselves, and even less on such violence in different contexts with comparative studies of behavior between those who perpetrate this violence and the population at large. This study used cluster analysis to establish a male adolescent typology based on boys’ self-reporting of violence against women in three contexts. The participants were 3,132 Spanish teenage boys aged 14–18 with experience of relationships with girls. Three discrete, identifiable (...) types were obtained: the first group, of non-violent boys; the second group, more involved in sexual harassment online outside a relationship but with a low incidence of dating violence offline; the third group, with abuse in the three contexts but less involved in sexual harassment online than the second group. The logistic regression analysis showed that justification of male dominance and violence was the main risk condition for inclusion in the second and third groups, followed by low self-esteem and risky sexual behaviors online. The findings based on these results are important for preventing male adolescent dating violence against women in the three male types detected. (shrink)

Media ecology is not the theoretical stream of communication studies and it is not limited to Marshall McLuhan´s work and thinking; however, we focus on McLuhan’s approach to media ecology for this special issue on the philosophy of Marshall McLuhan. Media ecology is a complex and systemic metadiscipline whose object of study is the changes and effects that have occurred in society as a result of the evolution of technology and media throughout history.

This paper is concerned with the role of self-observation in managing complexity in meaning systems. Revising Niklas Luhmann's theory of mass media, we approach the mass media system as a social sub-system functionally specialized in the coupling of psychic systems' self-observation and social systems' self-observation.According to Autopoietic Systems Theory and von Foerster's second order cybernetics, self-observation presupposes a capability for meta-observation that demands a specific distinction between observer and actor. This distinction seems especially relevant in those social contexts where a (...) separation between the action of observation and other social actions is required. However, in those social contexts where the defining action is precisely observation, the border between observer and actor is blurred.We shall consider the significant divergence between the implicit and the explicit epistemologies of the mass media system, which appears to be characterized by the explicit assumption of a classic objectivist epistemology, on one side, and a relativist epistemology on the other, posing a hybrid epistemic status somewhere in between science and arts. Experiential imagination consists in an imaginative projection that aims at simulating the experiences one would undergo in different circumstances. It has been traditionally thought to play a role in how we build our lives, engage with other agents, and appreciate art. Although some philosophers have recently expressed doubts over the capacity of experiential imagination to offer insight into the perspective of someone other than our present-selves, experiential imagination remains a much sought-after tool. This paper substantiates pessimism about the epistemological value (...) of these uses of experiential imagination by developing an embodied approach. Our thesis is that experiential imagination is _robustly embodied_ because the _sociohistorically situated_ body makes an irreducible contribution to the imaginative project, and that, as such, it is constrained by who we are as _concrete_ agents. We argue that experiential imagination is an embodied, virtual exploration of imagined scenarios that depends on our situated history of sensorimotor and affective interactions. We conclude that experiential imagination is much more limited than commonly acknowledged, as it can hardly be divorced from who we are and where we have been. (shrink)

Advocates of interactionism in the ethical criticism of art argue that ethical value impacts aesthetic value. The debate is concerned with “the intrinsic question”: the question of whether ethical flaws/merits in artworks’ manifested attitudes affect their aesthetic value (Gaut 2007: 9). This paper argues that the assumption that artworks have intrinsic ethical value is problematic at least in regards to a significant subset of works: fictional artworks. I argue that, insofar as their ethical value emerges only from attitudes attributable to (...) actual agents, fictional artworks only have extrinsic ethical value. I show that what is at stake for interactionism is whether ethical judgements concerning artists’ attitudes in a context, rather than manifested attitudes, are ever aesthetically relevant. I conclude that, without buying into extreme actual intentionalism, a still controversial theory of interpretation that ties artworks’ meaning to actual artists, interactionism fails to show that ethical flaws/merits are aesthetic flaws/merits. Atadas, como estamos, a una representación y lenguaje masculinos, se impone la necesidad de sacarla del mundo y lógica (...) edípicos para leerla bajo una perspectiva más cercana a la figura central, aunque invisible, de Yocasta.The impact that the myth of Antigone has had on feminist theory is comparable to the one it has had on the history of Western culture and thought. But how does the figure of Antigone, an undoubtedly masculine fiction, become a feminist badge? Could it lose its reflections of masculinity and become part of a female genealogy? Tied as we are to a masculine representation and language it becomes necessary to take it out of the Oedipal world and logic, to read it in keys that bring it closer to the central yet invisible figure of Yocasta. Advocates of the ethical criticism of art claim that works' ethical defects or merits have an impact on their aesthetic value. Against ethical critics, autonomists claim that moral criteria should not be part of the considerations when evaluating works of art as art. Autonomism refers to the view that an artwork's aesthetic value is independent from its ethical value. The purpose of this paper is to examine how autonomism has been defended in the contemporary discussion in analytic aesthetics. I present (...) three versions of autonomism: Richard Posner's radical autonomism, James C. Anderson and Jeffrey T. Dean, and James Harold's moderate autonomism, and Francisca Pérez Carreño's robust autonomism. I argue that robust autonomism offers a stronger argument against the ethical critic. However, I point to some difficulties for Pérez Carreño's account and conclude by suggesting how further work in autonomism might go around them. (shrink)

En este trabajo se hace un análisis aproximativo del estudio fenomenológico hermenéutico del dolor en la facticidad del vivir propio. Su objetivo es visualizar el dolor como determinante en la apertura a la existencia del ser, del ser-ahí, en perspectiva heideggeriana. Se expone la experiencia de la vida dolorosa como experiencia fáctica del vivir en sí mismo, y el conflicto ético que plantea la alteridad: la dificultad de comprender el dolor de los otros desde su propio experimentar dolor. Este conflicto (...) ético aparece en la conciencia del médico cuando éste asume el compromiso de ir más allá de la ayuda instrumental e intenta ver el sufrimiento del enfermo desde la realidad del otro como sí mismo. La hipótesis que subyace en este análisis es que el sufrimiento del dolor abre camino a la existencia propia; sin embargo, evidencia el obstáculo de comprensión del otro. Se concluye ratificando la idea de que el dolor tiene carácter de «existenciario» (término de Martin Heidegger, que significa un modo de ser-en-el-mundo). (shrink)

A lo largo del siglo XIX mexicano, la definición de las relaciones entre la Iglesia y el Estado estuvo siempre en la mesa de la discusión pública. Desde la independencia y hasta el movimiento de Reforma, se trató de delimitar el papel que la institución eclesiástica debía ocupar en la nueva nación. Así, a mediados de siglo se reconfiguró en respuesta la secularización que se produjo en México y en gran parte del mundo occidental.

Hernán Cortés, the conquistador of Mexico, conquered Mesoamerican territories between 1519 and 1525. Over the course of those years he maintained an intense epistolary exchange with the Emperor Charles V, to whom he wrote his Cartas de relación and many other letters and memories. In return, the emperor rewarded Cortés with vassals, titles and honors. However, as time passed, when Cortés established his home in the New Spain, the epistolary exchange, which was so fruitful at the beginning, in the end (...) became a nuisance for Charles V because of the constant complaints of the conquistador. As a consequence, between 1530 and 1547, after the glorious years, the relationship between Cortés and the monarch became estranged and complicated. This paper analyzes some of the letters Cortés sent to the emperor, and reflects on the importance of his figure in 16th century Spain, as well as the relevance of a relationship, that of the emperor and the conquistador, that changed the face of the known world. Hernán Cortés, el conquistador de México, llevó a cabo sus conquistas entre 1519 y 1525. En esos años mantuvo una intensa relación epistolar con el emperador Carlos V, a quien dirigió sus Cartas de relación y muchas otras cartas y memoriales. A su vez, el emperador premió a Cortés con vasallos, títulos y honores. Sin embargo, al pasar de los años, cuando Cortés se estableció en la Nueva España, esa relación epistolar, que al principio fue muy fructífera, al final se (...) convirtió en una molestia por las continuas quejas y reclamos del conquistador. Así, entre 1530 y 1547, después de los años de gloria, la relación entre Cortés y el monarca se tornó lejana y complicada. En este trabajo se analizan algunas de las cartas que Hernán Cortés envió al emperador y se hace una reflexión sobre la importancia de su figura en la España del siglo XVI, así como la relevancia de una relación, la del emperador y el conquistador, que cambió la faz del mundo entonces conocido. Over the turn of the 21st century, the use of data from large electronic corpora has changed research on Spanish historical syntax, spurring interest in long-range evolutions and the shape of the correspondent diachronic curves. However, general reflections on diffusion and the factors that drive and influence it are still pretty much lacking. In this paper, I reflect on the research possibilities laid open by the availability of such large masses of data, focusing particularly on new knowledge on syntactic change (...) brought about by the study of low-frequency phenomena and of recessive changes, as well as on the exploration of changes conditioned by dialect contact and textual traditions. I conclude with some remarks on the general typology of diffusion in syntactic change. (shrink)
