The human relation to things in the world is at stake in the so-called post-humanist era where the distinction between human and non-human is blurred, as indicated in a term like ‘the nano-self’. How should we understand the nature of our relation to things in this era? Or how can we describe an educationally meaningful relation we as human agents can make in relation to things, artificial and natural, in the face of this technologically hybrid and ever-dehumanizing tendency of society? Well-known for his actor-network theory, Bruno Latour, an influential materialist and philosopher of technology, says that ‘objects’ have agency as much as humans; so we need to be able to translate the language of things into the language of men or vice versa as a way of co-shaping the world we live in. What does this mean and how can we do so? In carefully examining his theory, the essay attempts to explore and reformulate his account of the mediating role of human agency to see if it can provide us with an educationally plausible post-humanist concept of human agency, which can lead us into an ecologically ethical and politically responsible approach to education in general, and science education in particular. Performance Generating Systems (PGS) are rule- and task-based approaches to improvisation on stage in theatre, dance, and music. These systems require performers to draw on predefined source materials (texts, scores, memories) while working on complex tasks within limiting rules. An interdisciplinary research team at a large Western Canadian university hypothesized that learning to sustain this praxis over the duration of a performance places high demands on executive functions; demands that may improve the performers’ executive abilities. These performers need to continuously (...) shift attention while remaining responsive to embodied and environmental stimuli in the present, they are required to inhibit automated responses and impulses using the rules of the system, and they strive towards addressing multitasking challenges with fluidity and flexibility. This study set out to test the mentioned hypothesis deductively and identify mediating processes inductively, using mixed empirical methods. In a small sample experiment with a control group (28 participants; 15 in intervention group, 13 in control group), standardized quantitative tests of executive functions (D-KEFS) were administered before and after an eight-week intervention. Participant-reported qualitative observations from the praxis were also collected throughout the intervention for grounded analysis. Within the limitations of small sample data, we found both statistically significant and trending effects on inhibition, problem-solving initiation, fluidity, and cognitive flexibility. Examining the mediating process, we found that participants experienced significant challenges sustaining the practice halfway through the intervention. The participant-reported solutions to these challenges, which emerged as the strongest behavioural patterns when coding the qualitative data to saturation, were strategies of problem-solving and of re-directing attention. These strategies support and advance our understanding of the effects measured in the standardized tests. In terms of application, our results identify characteristics of PGS that could potentially maintain and strengthen executive functions over and above less demanding performing arts interventions. The results also deliver new insight into how PGS works, which may contribute to the development and teaching of this artistic practice. (shrink)

In a recent, currently unpublished, research project that sought to examine the meaning and enactment of ethical nursing practice across a variety of clinical settings, the significance of moral identity was highlighted. This article describes the findings and illuminates how the moral identities of the nurse participants arose and evolved as they navigated their way through the contextual and systemic forces that shaped the moral situations of their practice. Even though the relevance of business actors in peace processes is increasingly acknowledged, analysis of their particular roles and contributions remain sparse in peace mediation literature. This is despite the fact that such knowledge would be highly relevant for supporting mediation processes such as those ongoing in Colombia or the Philippines. This article looks at the involvement of business actors in mediation processes by tracing analysis along the entry points for involvement, the different roles that business actors (...) can play and the limitations they face. The empirical data shows that business actors mainly play a role during the pre‐ and mediation phase and therein often as a support‐giver to the mediation process. Furthermore, most of the involvement does not take place at track‐1 level but rather at track‐2 mediation processes, where mainly local business play an important role. In contrary to what is postulated by some of the literature, the relevance of utilitaristic motives is not problematic; rather a monetary motivation can also foster the credibility in a political process where a lot is at stake. Despite accumulated evidence from previous studies that green creativity is highly emphasized in various industries, limited research has been conducted in the context of public sectors. Drawing on the dynamic componential model of creativity and innovation in organizations, this paper aims to propose and sequentially test the relationship between green training and employees’ green creativity through green values and green intrinsic motivation. Based on the data collected in Chinese public sectors at two different time points, the results indicate that green (...) training is positively related to green creativity. Moreover, this relationship is sequentially mediated by green values and green intrinsic motivation. The results in our study advance the emergent literature on green human resource management in the public sector for the practical applications of training and creativity in terms of green management. Burnout was recently declared by WHO as an “occupational phenomenon” in the International Classification of Diseases 11th revision, recognizing burnout as a serious health issue. Earlier studies have shown that feelings of guilt appear to be involved in the burnout process. However, the exact nature of the relationships among burnout, guilt and psychosomatic disorders remains unclear. The purpose of this study was to investigate the mediator role of feelings of guilt in the relationship between burnout and psychosomatic disorders, and perform (...) a cross-cultural validation of the multi-dimensional model by Gil-Monte in two samples of teachers. The study sample was composed of 1,266 teachers, 1,062 from Spain, and 204 from Portugal. Burnout was measured by the Spanish Burnout Inventory. Hypotheses were tested together in a path model. The results obtained provide empirical evidence for the mediator role of guilt in the relationship between the Burnout syndrome and psychosomatic disorders in the sample of teachers from Spain and Portugal, and they contribute to the empirical validation of the model by Gil-Monte. The results indicate that guilt should be incorporated as a symptom of burnout in order to identify individuals affected by burnout and profiles or types of burnout to differentiate it from other pathologies like depression. Mediator is a coregulatory complex that plays essential roles in multiple processes of transcription regulation. One of the human Mediator subunits, MED26, has a role in recruitment of the super elongation complex (SEC) to polyadenylated genes and little elongation complex (LEC) to non‐polyadenylated genes, including small nuclear RNAs (snRNAs) and replication‐dependent histone (RDH) genes. MED26‐containing Mediator plays a role in 3′ Pol II pausing at the proximal region of transcript end sites in RDH genes through recruitment of Cajal bodies (...) (CBs) to histone locus bodies (HLBs). This finding suggests that Mediator is involved in the association of CBs with HLBs to facilitate 3′ Pol II pausing and subsequent 3′‐end processing by supplying 3′‐end processing factors from CBs. Thus, we argue the possibility that Mediator is involved in the organization of nuclear bodies to orchestrate multiple processes of gene transcription. (shrink)

The underlying mechanisms of the effectiveness of mindfulness-based interventions for emotional well-being remain poorly understood. Here, we examined the potential mediating effects of cognitive reactivity and self-compassion on symptoms of depression, anxiety and stress using data from an earlier randomised controlled school trial. A moderated time-lagged mediation model based on multilevel modelling was used to analyse the data. The findings showed that post-treatment changes in cognitive reactivity and self-coldness, an aspect of self-compassion, mediated subsequent changes in symptoms of depression, (...) anxiety and stress. These results suggest that cognitive reactivity and self-coldness may be considered as transdiagnostic mechanisms of change of a mindfulness-based intervention programme for youth. (shrink)

As a part of job resources, work time control is essential for innovation. We examine how work time control impacts knowledge employees’ innovation in the workplace. A two-stage study was conducted to verify the mediating and moderating processes. In Study 1, adopting the job demands–resources model as a theoretical framework, we conducted a laboratory test to find the relation between work time control, job engagement, job burnout, and innovation, and verified the path between work time control and innovation. In Study 2, drawing on the job demands–resources model verified by Study 1 and self-regulation theory, it is proposed that during the psychological process in the workplace, job engagement plays a mediating role, and the vocational delay of gratification plays a moderating role between work time control and innovation. A total of 254 knowledge employees from diverse organizations participated in the survey study. After taking demographic variables, job demands, and neuroticism as control variables, the results showed that job engagement would mediate the relationship between work time control and innovation. A higher level of delay of gratification buffered the effect of a higher level of work time control on innovation. All these findings verified and expanded knowledge on work time control and innovation literature, showing that work time control is important for innovation. Based on Chinese cultural background, managers should offer employees the opportunity to conduct self-control training and encourage them with great freedom to foster employee innovation. (shrink)

The study of ethical leadership has emerged as an important topic for understanding the effects of leadership in organizations. In a study with 845 working adults across multiple organizations, the relationships between ethical leadership with positive employee outcomes were examined. Results suggest that ethical leadership is related to both psychological well-being and job satisfaction in employees, but the processes are different. Employee voice mediated the relationship between ethical leadership and psychological well-being. Feelings of psychological ownership mediated the relationship between (...) ethical leadership and job satisfaction. A discussion of theoretical and practical implications concludes the article. Second language listening is a common challenge for language learners. It remains largely unknown how bilinguals process L2 listening. The literature has suggested an interactive model of L2 listening processing. However, few studies have examined the model from an experimental approach. The current study tried to provide empirical evidence for the interactive model of L2 listening processing in bilinguals by exploring the relationships among English spoken word segmentation, cognitive inhibition, cognitive flexibility, and L2 listening proficiency. The results showed positive associations (...) among SWS, cognitive inhibition, cognitive flexibility, and L2 listening proficiency. Mediation analysis suggested that SWS might have a positive influence on L2 listening proficiency both directly and indirectly through cognitive inhibition and cognitive flexibility, respectively. In the contemporary world, frugal innovation is the most discussed area to enhance corporate sustainable performance in manufacturing firms. The knowledge management process is also a key determinant of FI. Existing literature is limited to knowledge management and its impact on CSP. This study aims to determine the effect of the KMP on sustainable corporate performance with the association of FI. The survey method was used to collect data from 356 small and medium enterprises in China. Structure equation modeling was (...) applied to obtain the results of collected data. Results show that all three dimensions of KM have a significant impact on CSP. Furthermore, FI also has a significant and positive impact on CSP. Results further show that FI partially mediates the relationship of the knowledge dissemination, knowledge application and sustainable corporate performance but no mediation role FI was found between knowledge acquisition and CSP. The findings of this study will provide useful insights for experts and manufacturers. It will help to understand the role of KM in their organizational behavior by being an economical manufacturing process. This study underscored the importance of the KMP to policymakers. In countries such as China that have global orders, KM is an essential determinant of FI. KM is a tool used to achieve CSP goals inside and outside of an enterprise, thus the development firms need to focus on KM. (shrink)

Many studies showed that comprehenders monitor changes in protagonists’ emotions and actions. This article reports two experiments that explored how focusing comprehenders’ attention on a particular property of the protagonist dimension affects the accessibility of information about target objects mentioned in the sentence. Furthermore, the present research examined whether participants’ attitudes toward the issues described in the sentence can modulate comprehension processes. To this end, we asked participants to read sentences about environmental issues that focused comprehenders’ attention on different (...) mental and physical attributes of the same entities and then self-report their own thoughts on the topic of environment by responding to the items assessing their environmental awareness. Importantly, we manipulated the task requirements across two experiments by administering a self-report task, which required the participants to rate the seriousness and the frequency of the problem mentioned in a sentence; and administering a sentence-picture verification paradigm, which required the participants to merely indicate if the object depicted in the picture was mentioned in the preceding sentence. The results of these experiments suggest that the focus of a sentence on the environmental problem enhances the accessibility of information about environmental issues ; that the comprehender’s level of environmental awareness influences one’s attention during sentence processing; and that comprehender characteristics significantly modulate comprehension processes only when the measures tap into explicit processes. The advanced digital technologies of ubiquitous computing and generative design, as well as the invention of smart materials in late 90’s have all provoked the fluid characteristics of spatiality, and strengthen the transformative capacities of the architectural space through the emergence of computer-augmented territories. Additionally, while they are becoming as the body extensions, the advent of novel apparatuses and gadgets further enhanced the inte- gration of the corporal and incorporal bodies with the spatio-temporal multiplicities, where the hyperdimensionality of the space has been triggered to its outmost range, in relation to the “soft and smart technologically augmented immanent millieu”, in Spuybroek terms. Thus, like Spuybroek points out as the “haptonomist” presence of the body merges itself with these diverse bodily extensions on one hand; and on the other hand, as the rising influence of nomadic view of the world further stimulates the unboundedness and endless fluidity of space, so that the spatiality becomes a landscape of successive transformations, a topology of emergence or a plane of becoming, which is merely defined by lines of forces, and occures as an alive territory rather than a limited space of predefined boarders. Therefore, this evolvable territory which is affectable and being affected by the lines of forces –inner and outer forces–, emerges as an animated existence, an interactive organism. So, by interacting with the Deleuzian Philosophy and their notions like lines of forces, folding, becoming, smooth space, territory, spatium, this article aims to reveal the relevance of these notions in architectural discourse, as well as the emergence of the smooth space in the contemporary architectural practice, by magnifiying one of the very initial examples of its kind; in terms of unfolding the Fresh Water Pavilion of NOX Architecture by Lars Spuybroek into question to reveal the essences of thecontemporary transformable-evolvable architectural spatiality. In his article In Between Us, Yoni van den Eede expands existing theories of mediation into the realm of the social and the political, focusing on the notions of opacity and transparency. His approach is rich and promising, but two pitfalls should be avoided. First, his concept of ‘in-between’ runs the risk to conceptualize mediation as a process ‘between’ pre-given entities. On the basis of current work in postphenomenology and actor-network theory, though, mediation should rather be seen as the origin (...) of entities, not as an intermediary between them. Second, Van den Eede’s separate discussion of transparency and opacity in ‘use’ and in ‘context’ runs the risk to make invisible the complementarity of the two dimensions. While transparency of use embodies an experiential form of the distinction between transparency and opacity, transparency of context embodies a more cognitive dimension of the distinction. Only by linking the two it becomes possible to take responsibility for the impact that technological mediations can have. Users and designers need a ‘double vision’ to simultaneously see the transparency of both use and context. (shrink)

The present article attempts to investigate the 'philosophical foundations' of psychology and thereby of the social sciences in general with regard to a central problem, viz. the question of the 'inner'. It does this with special critical reference to an authoritative psychological theory, viz. the so-called 'mediation theory', and tries to show the necessity of interdisciplinary clarification. In the first part mediation theory was introduced as a variant of psychological behaviorism which attempts to substitute for the untenable total neglect of (...) 'inner' events a way of talking about them which is secured methodologically and retains a behavioral foundation. Of the three crucial questions raised by the project the second, viz. question, which concerns the theoretical status of the assumed inner mediators could be answered to the effect that they must be "hypothetical constructs" having the nature of real, phenomenally verifiable events, if, indeed, they are to figure as links in S-R-chains. Conceiving of them as "intervening variables", such a conception would exclude this function. The discussion of 'internalization' of behavior sequences as assumed by mediation theory has led to the conclusion that the relevant phenomena cannot, in this case, justify the necessity of a non-dispositional explanation which goes beyond 'external' performances ). Likewise the subject matter of question remained undecided; that is, the possibilities of phenomenally verifying the assumed 'inner' mediation processes which are only asserted to exist by the theory but are unspecified in content. Therefore, the observable performances in the case of sequential behaviour do not support the mediation theoretic solution of the problem of the 'inner'. (shrink)

We develop a framework for understanding how lack of clarity in business press coverage of corporate social responsibility functions as a mediated and emergent form of strategic ambiguity. Many stakeholders expect CSR to exhibit clarity, consistency, and discursive closure. But stakeholders also expect CSR to conform to varying degrees of both formal and substantive rationality. These diverse expectations conflict with each other and change over time. A content analysis of press coverage in Denmark suggests that the business media reflect and (...) amplify the ambiguity generated by these shifting demands. We propose that this very public lack of discursive closure provides strategic advantages to CSR stakeholders by rendering the concept of CSR adaptable, resilient, and meaningful to diverse interests. From this perspective, strategic ambiguity emerges from a relational and mediated process, not from the direct intentions of individual stakeholders. Our framework suggests that CSR is best understood not as a clear or consistent agenda, but rather as a forum for sensemaking, diversity of opinion, and debate over the conflicting social norms and expectations attached to corporate activity. The purpose of this paper is to examine two hypothetical models: one in which job satisfaction acts as a mediator of the effects of overqualification on turnover intention and performance, and another in which job satisfaction acts as a mediator of the effects of overqualification on performance. Data were collected from 318 call center employees in Portugal. The relationships were tested using a multiple regression hierarchy with PROCESS. As hypothesized, job satisfaction mediates the relationship between overqualification and turnover intentions. It (...) appears that overqualification alone does not influence intention to quit, but rather does so via satisfaction. Job satisfaction also mediates the relationship between overqualification and job performance. However, perceptions of non-growth appear to be associated with a decline in contextual performance. The effects of overqualification on turnover intentions and job performance of call center employees have not been previously studied. Therefore, this study aims to fill this gap. Our study joins the small number of studies that analyze the mechanisms explaining the relationship between this mismatch between job demands and employees' perceived education, skills, experience, and work outcomes. Purpose: This study aimed to explore the relationship between mathematic achievement and programming self-efficacy, and adopt a mediation model to verify the mediating role of creativity on the relationship between mathematic achievement and programming self-efficacy.Methods: A total of 950 upper-secondary school students were surveyed using their math test scores, the Kirton Adaption-Innovation and the Programmed Self-Efficacy Scale. SPSS-26 was used for descriptive statistical analysis and correlation analysis of related variables. The PROCESS plugin was used to test the mediating (...) effect of creativity.Results: Mathematic achievement has a positive effect on programming self-efficacy, mathematic achievement is positively related to creativity, and creativity also has a positive influence on programming self-efficacy. Creativity has a mediating effect on the relationship between mathematic achievement and programming self-efficacy.Conclusion: The results revealed that mathematic achievement affected programming self-efficacy directly and also indirectly through creativity. This provided certain ideas for the development of programming education for teenagers. Since students’ mathematics learning and creativity are related to programming learning, it is necessary to pay attention to the integration of the disciplines of programming education and mathematics. Further, the cultivation of innovative thinking is also critical to facilitate programming learning. (shrink)

Western buying companies impose Supplier Codes of Conduct (SCC) on their suppliers in developing countries; however, many suppliers cannot fully comply with SCC and some of them even cheat in SCC. In this research, we link contract characteristics - price pressure, production complexity, contract duration - to the likelihood of supplier's commitment to SCC through a mediating process: how the buying companies govern their suppliers. Our structural equation model analysis shows that the hierarchy/relational norms governance is a perfect mediator (...) of contract characteristics' effects on the likelihood of supplier's commitment; the market governance, an insignificant one. The significance of mediatization in countryside settings is an under-researched topic in media studies. In this paper, based on qualitative fieldwork carried out in two rural areas in Sweden, we study how mediatization integrates the prospects of cosmopolitan social change. The current phase of the mediatization process, which imposes a more dynamic register of networked communication, nourishes a new type of cosmopolitan identity in the countryside. As shown in the study, this development is constituted by complex configurations of different forms (...) of mobility and connectivity. We argue that these spatial processes are socially structured, meaning that certain social groups are better equipped, through the appropriation of network capital, for turning cosmopolitan dispositions into a transformative resource, a ‘cosmopolitan politics of place’. Such alterations of the social structure may successively destabilize the relationship between ‘the urban’ and ‘the rural’. (shrink)

Automatic imitation or “imitative compatibility” is thought to be mediated by the mirror neuron system and to be a laboratory model of the motor mimicry that occurs spontaneously in naturalistic social interaction. Imitative compatibility and spatial compatibility effects are known to depend on different stimulus dimensions—body movement topography and relative spatial position. However, it is not yet clear whether these two types of stimulus–response compatibility effect are mediated by the same or different cognitive processes. We present an interactive activation (...) model of imitative and spatial compatibility, based on a dual-route architecture, which substantiates the view they are mediated by processes of the same kind. The model, which is in many ways a standard application of the interactive activation approach, simulates all key results of a recent study by Catmur and Heyes (2011). Specifically, it captures the difference in the relative size of imitative and spatial compatibility effects; the lack of interaction when the imperative and irrelevant stimuli are presented simultaneously; the relative speed of responses in a quintile analysis when the imperative and irrelevant stimuli are presented simultaneously; and the different time courses of the compatibility effects when the imperative and irrelevant stimuli are presented asynchronously. Recent developments in the field of education have led to a renewed interest in the mediating role of critical thinking abilities in the relationship between language learning strategies and the intermediate English as a Foreign Language learners’ writing performance. Oxford Placement Test was run to homogenize the participants, and 100 intermediate learners out of 235 were selected. Then, two valid questionnaires of Ricketts’ Critical Thinking Disposition and Oxford’s Strategy Inventory for Language Learning were administered. Having administered the questionnaires, the (...) researchers asked the participants to sit for a writing test. The data collected from the questionnaires and as well as the scores of their writing performances were analyzed through SPSS. The results showed a significant relationship between learning strategies and learners’ writing performances, the sub-sets of learning strategies and learners’ writing performances, and CTA and learners’ learning strategies. However, CTA did not play a mediating role in the relationship between intermediate EFL learners’ learning strategies and writing performance. Based on the results of the study, one might also conclude that strategies seemed to play a more important role in the performance of learners especially their writing performances. Therefore, this study had useful contributions for students, teachers, and curriculum designers. Findings of this research could assist teachers to be aware of learners’ strategies in learning writing and help their students to be responsive to using learning strategies in their learning process and create a satisfactory learning context for using learning strategies. Therefore, learners were able to become independent and feel responsibility for their own learning. Secondly, curriculum developers could take advantage of the findings to include learning strategies training into the curriculum. As a result, students were able to use strategies in their learning process more easily and finally, the results might pave the way for improving the research findings. (shrink)

Since the coming of Positive Psychology in the field of second language acquisition, the significance of emotion, especially positive emotion, has been well recognized by researchers. Educational research has indicated that both emotion and engagement play fundamental roles in learning process and psychological wellbeing, but research on their relationship is scant in SLA. The present study contributed to the development of Positive Psychology in SLA by investigating the relationships between achievement emotions, behavioral engagement, and self-reported English achievements. 633 students from (...) four senior high schools in China participated in the study. Data collected through questionnaires revealed: Participants reported a medium to high level of foreign language enjoyment, foreign language classroom anxiety, and behavioral engagement; females had a higher level of FLE and behavioral engagement than males; the participants reported more anxiety and less enjoyment than western samples; significant correlations were found between FLE, FLCA, behavioral engagement, and self-reported achievement; significant mediating effects of behavioral engagement were found between both achievement emotions and self-reported achievement, and the mediating effect of engagement was stronger between FLCA and self-reported achievement. The findings extended the nomological network of achievement emotions, developed our insights into the complex relationships between emotions, learner engagement and language achievement, and revealed the mediating effects of behavioral engagement. Finally, directions for future study and implications for foreign language educators were provided. (shrink)

Nonsense‐mediated RNA decay (NMD) represents an established quality control checkpoint for gene expression that protects cells from consequences of gene mutations and errors during RNA biogenesis that lead to premature termination during translation. Characterization of NMD‐sensitive transcriptomes has revealed, however, that NMD targets not only aberrant transcripts but also a broad array of mRNA isoforms expressed from many endogenous genes. NMD is thus emerging as a master regulator that drives both fine and coarse adjustments in steady‐state RNA levels in the (...) cell. Importantly, while NMD activity is subject to autoregulation as a means to maintain homeostasis, modulation of the pathway by external cues provides a means to reprogram gene expression and drive important biological processes. Finally, the unanticipated observation that transcripts predicted to lack protein‐coding capacity are also sensitive to this translation‐dependent surveillance mechanism implicates NMD in regulating RNA function in new and diverse ways. Traditional ideas of mediator neutrality and impartiality have come under increasing attack in recent decades. There is, however, a lack of consensus on what should replace them. Mediation Ethics offers a response to this question, developing a new theory of mediation that emphasises its nature as a relational process.

Good communication is critical to the practice of medicine. This is particularly true when outcomes are unpredictable and/or patients lack the capacity to participate in medical decision making. Disputes may develop that cannot be addressed using basic communication skills. Conflict of this nature can burden patients, families, and medical staff and may result in increased suffering for all parties. Many physicians lack the necessary communication tools to handle difficult conversations. Training in bioethics mediation provides physicians with skills that can promote (...) healing by empowering participants to engage in effective discourse and break down barriers to find common ground. Mediation training for physicians can expand their capacity to connect with patients and enhance their ability to identify potential conflict early on, in order to collaborate more effectively. Competency in the processes of negotiation and conflict resolution should therefore be seen as essential elements of medical training. (shrink)

In man-machine communication, there is a relationship between what may be described as tacit (human) and explicit (machine) knowledge. The tacit lies in practice and the explicit in the formulation of the processes and content of this practice. However, when a human communicates with another human face to face, we may describe them as communicating aspects of the tacit and explicit dimension of their knowledge, i.e. the expression and its background of meaning for the particular situation. When this is (...) unsuccessful in being communicated, some mediator (not necessarily a third person) is needed to provide the bridge for the particular discrepant aspects of the tacit and explicit dimensions to meet. This is achieved by making the tacit nature of the discrepancy in the communication explicit to both participants such that they both understand the background to their discrepancy. Mediation in a legal sense is a means of alternative dispute resolution (ADR). Having evolved in the USA in the last half of 20th century the procedure is growing in popularity and proliferation all over the world. Many countries enacted particular legislation, and others included relevant articles into Civil and/or Criminal Procedure Codes. Howbeit, lawyers are to be aware of mediation and roles they may play within the process. Law school curriculum drafters face the challenge of including a new up-to-date (...) course in mediation into busy and very full academic programmes. Analysis of existing instructing practice showed that in Anglo-American law schools mediation teaching is a part of clinical legal education. As for European countries, there is a broad range of scenarios and no established experience. Recognition of communicative skills as key skills for mediators prompts the use of a CLIL approach in structuring such a course. Listening, reframing, summarising, questioning are skills to be mastered by law-students both in a foreign language and their mother tongue. Language teachers are in charge of this part of the course while law teachers can work out text contents built on the branches of law mediators deal with more often (family law, employment law, contracts, etc.). Moreover, some texts may cover mediation law in a home country and abroad. Another important factor to take into account is a career path chosen by a law-student – if s/he is going to become a mediator or a lawyer securing clients in mediation. Role plays and scenarios are an integral part of the course. Moreover, the course developed can serve as an introduction to internship in a law clinic. (shrink)
