As an ethicist trained in narrative, I wondered what I could offer Dr. Darcy at this point, two weeks after the events he described. And what might I have offered those involved if they had called an ethics consult at the time? One of this physician's implicit questions was, “How might this have unfolded in a better way?”When difficult choices must be made, how can a narrative approach help? A narrativist focuses less on principles, rules, and law than would a (...) philosopher or a lawyer. This is not to say that we ignore the law or are unaware of bioethical principles. But where do we go from there? Narrative offers a mode of engagement that asks different kinds of questions than those that law or philosophy might ask about moral agency, context, and values. This volume brings together Nussbaum's published papers on the relationship between literature and philosophy, especially moral philosophy. The papers, many of them previously inaccessible to non-specialist readers, explore such fundamental issues as the relationship between style and content in the exploration of ethical issues; the nature of ethical attention and ethical knowledge and their relationship to written forms and styles; and the role of the emotions in deliberation and self-knowledge. Nussbaum investigates and defends a conception of ethical understanding which involves (...) emotional as well as intellectual activity, and which gives a certain type of priority to the perception of particular people and situations rather than to abstract rules. She argues that this ethical conception cannot be completely and appropriately stated without turning to forms of writing usually considered literary rather than philosophical. It is consequently necessary to broaden our conception of moral philosophy in order to include these forms. Featuring two new essays and revised versions of several previously published essays, this collection attempts to articulate the relationship, within such a broader ethical inquiry, between literary and more abstractly theoretical elements. Amartya Sen has made a major contribution to the theory of social justice, and of gender justice, by arguing that capabilities are the relevant space of comparison when justice-related issues are considered. This article supports Sen's idea, arguing that capabilities supply guidance superior to that of utility and resources (the view's familiar opponents), but also to that of the social contract tradition, and at least some accounts of human rights. But I argue that capabilities can help us to construct a (...) normative conception of social justice, with critical potential for gender issues, only if we specify a definite set of capabilities as the most important ones to protect. Sen's "perspective of freedom" is too vague. Some freedoms limit others; some freedoms are important, some trivial, some good, and some positively bad. Before the approach can offer a valuable normative gender perspective, we must make commitments about substance. (shrink)

Philoctetes was a good man and a good soldier. When he was on his way to Troy to fight alongside the Greeks, he had a terrible misfortune. By sheer accident he trespassed in a sacred precinct on the island of Lemnos. As punishment he was bitten on the foot by the serpent who guarded the shrine. His foot began to ooze with foul-smelling pus, and the pain made him cry out curses that spoiled the other soldiers' religious observances. They therefore (...) left him alone on the island, a lame man with no resources but his bow and arrows, no friends but the animals who were also his food. Ten years later, according to Sophocles' version of the story, they come to bring him back: for they have learned that they cannot win the war without him. The leaders of the expedition think of Philoctetes as a tool of their purposes; they plan to trick him into returning, with no empathy for his plight. The Chorus of soldiers, however, has a different response. Even before they see the man, they imagine vividly what it is like to be him– and they enter a protest against the callousness of the commanders: For my part, I pity him– thinking of how, with no living soul to care for him, seeing no friendly face, wretched, always alone, he suffers with a fierce affliction, and has no resources to meet his daily needs. It explains that this approach provides better theoretical guidance on the issue of animal entitlements over contractarian and utilitarian approaches because it is capable of recognising a wide range of types of animal dignity and of corresponding needs for flourishing. Capacious and ambiguous, this notion of dignity may invite agreement precisely because different people project different meanings onto it. This paper deals with how telematic technologies such as the cellular phones, Internet, telerobotics and other varieties of telematic communication and control are placing into discussion the nature of knowledge and its scope. These technologies offer us knowledge by description and representation instead of physical contact, a fact that is often seen with suspicion since they are perceived as technologies of delusion in a culture characterized by its conspicuous materialism. What are the possible roles for our mediated activities in relation (...) with the comprehension of our environment and the construction of subjectivity? Telematic mediation necessarily deals with the immaterial aspects of technologies such as the changing concepts of reality and nature, future possibilities of an ethereal afterlife achieved through spiritual or technological means and the concept of distance that can render mediated communication delusory and unsatisfying while acting as an agent of delocalization. This view is supported by our traditional Platonic view that perceives representation of things as a palpable degradation while neglecting the constructive aspects of those fictional endeavours. In the summer of 2017, much of the world was riveted by the case of Charlie Gard, a baby in London whose parents wanted an experimental treatment and whose doctors thought that further treatment would be futile. The case worked its way through the British courts and, eventually, was even heard by the European Court of Human Rights. Pope Francis and President Trump weighed in. If nothing else, the case revealed how controversial the issues around medical futility and shared decision-making (...) still are. Many ethical issues resolve over time. If you travel through airports, you can’t help but notice it. Jodi Picoult’s novels are everywhere. From Charlotte to Kansas City to Los Angeles, airport bookstores are consistently stocked with three or four or more of her most recent heavy volumes of fiction. Read one and you might mutter that it seems designed for a relatively mindless flight from one coast to the other. Read several and you might agree with National Public Radio’s disparaging view that the books are “lurid (...) tales of family strife . . . garnished heavily with medical jargon, legalese, and a punitive finger pointed at a mother.” It’s not hard to find negative comments about Picoult’s novels. Nietzsche claimed to be a political thinker in Ecce Homo and elsewhere. He constantly compared his thought with other political theorists, chiefly Rousseau, Kant and Mill, and he claimed to offer an alternative to the bankruptcy of Enlightenment liberalism. It is worthwhile re-examining Nietzsche's claim to offer serious criticisms of liberal political philosophy. I shall proceed by setting out seven criteria for serious political thought: understanding of material need; procedural justification; liberty and its worth; racial, ethnic and religious difference; gender (...) and family; justice between nations; and moral psychology. I shall argue polemically that on the first six issues Nietzsche has nothing to offer, but that on the seventh, moral psychology, he makes a profound contribution. Serious political theory, however, needs to forget about Nietzsche and turn to those thinkers he found so boring - the liberal Enlightenment thinkers. (shrink)
