Kuala Lumpur is a diverse city representing many different religions and nationalities. Recent government policy has actively promoted unity and cohesion throughout the city; and the country of Malaysia, with the implementation of a programme called 1Malaysia. In this book, the authors investigate the aims of this programme – predominantly to unify the Malaysian society – and how these objectives resonate in the daily spatial practices of the city’s residents. -/- This book argues that elements of urban infrastructure could work (...) as an essential mediator ‘beyond community’, allowing inclusive social structures to be built, despite cultural and religious tensions existing within the city. It builds on the premise of an empirical study which explores the ways in which different communities use the same spaces, supported through the implementation of a theoretical framework which looks at both Western and Islamic conceptualisations of the notion of community. Through the analysis of Kuala Lumpur, this book contributes towards the creation of more inclusive places in multi-ethnic, multi-cultural and multi-religious communities across the world. (shrink)

Zaionc, M., λ-Definability on free algebras, Annals of Pure and Applied Logic 51 279-300. A λ-language over a simple type structure is considered. There is a natural isomorphism which identifies free algebras with nonempty second-order types. If A is a free algebra determined by the signature SA = [α1,...,αn], then by a type τA we mean τ1,...,τn→0 where τi=0αi→0. It can be seen that closed terms of the type τA reflex constructions in the algebra A. Therefore any term of the (...) type n→τA defines some n-ary mapping in algebra A. The problem is to characterize λ-definable mappings in any free algebra. It is proved that the set of λ-definable operations is the minimal set that contains constant functions and projections and is closed under composition and limited recursion. This result is a generalization of the result of Schwichtenberg and Statman which characterize the λ-definable functions over the natural number type →, i.e algebra [1, 0], as well as of the result of Zaionc for λ-definable word operations over type n→, i.e algebra [1,...,1,0], and of the results about λ-definable tree operations , i.e in algebra [2, 0]. Výsledkem rozboru lexikálního pole vražda a jemu příbuzných pojmů je zjištění, že tento pojem už ve svém významu obsahuje negativní hodnocení, na rozdíl od okolních pojmů. Avšak současná etika lokalizuje hodnotovost tohoto pojmu do slova špatný a soustředí se na jeho opak, slovo dobrý, jehož čistě etický význam se snaží izolovat. Plodnější však je chápat slovo vražda analogicky k jeho užití v justičním procesu soudem, kde z něj, ve formě rozsudku, dokonce plynou performativní a právní důsledky.An analysis of the lexical (...) field murder and its neighbouring concepts shows that this concept itself contains a negative value, as opposed to the other notions. But contemporary ethics tries to localize this negativity into the predicate wrong and concentrates on its opposite, good, whose purely ethical meaning it purports to isolate. But perhaps it is more useful to view the word murder analogically to its use in the judicial process, where performative and legal consequences follow. (shrink)

Článek reaguje na monografii Homo Natura: Nietzsche, Philosophical Anthropology and Biopolitics (2020) současné akademičky Vanessy Lemmové zabývající se Nietzschovým úkolem „přesadit člověka zpět do přírody“, tzn. chápat jej jako bytost veskrze imanentní přírodě. Reakce směřuje především na jednu z hlavních tezí knihy, podle níž tato Nietzschova snaha otevírá možnost nového, postantropocentrického pohledu na člověka a jeho vztahu k přírodě – pohledu, v jehož centru zájmu již nestojí člověk, nýbrž život sám, resp. kontinuum života, jež se ztělesňuje v lidském druhu a (...) jehož je lidský druh rovnocennou součástí po boku ostatních organismů. Nietzschova myšlenka o homo natura podle Lemmové předznamenává myšlení současného posthumanismu vyznačujícího se právě snahou vytvořit takový pohled na člověka a jeho vztah k přírodě, který bybyl vhodným teoretickým rámcem pro sebepojetí člověka v epoše antropocénu. Článek tuto tezi doplňuje o Heideggerovu interpretaci Nietzschovy myšlenky nadčlověka podanou v sérii přednášek Co znamená myslet?, v níž je nadčlověk chápán jako ekologický ideál lidstva schopného zodpovědně převzít moc plynoucí z technického přetváření země. Cílem článku je ukázat, že, v souladu s interpretacemi Lemmové a Heideggera, u Nietzscheho lze nalézt způsob, jak by se lidstvo mohlo produktivně vyrovnat s realitou antropocénu, a to skrze přechod od „posledního člověka“ k „nadčlověku“, kde přechod k „nadčlověku“ je chápán jako idea nastolení nového vztahu mezi lidmi a přírodou, resp. mezi lidmi a zemí. The paper concerns the problem of the legal responsibility of autonomous machines. In our opinion it boils down to the question of whether such machines can be seen as real agents through the prism of folk-psychology. We argue that autonomous machines cannot be granted the status of legal agents. Although this is quite possible from purely technical point of view, since the law is a conventional tool of regulating social interactions and as such can accommodate various legislative constructs, including legal (...) responsibility of autonomous artificial agents, we believe that it would remain a mere ‘law in books’, never materializing as ‘law in action’. It is not impossible to imagine that the evolution of our conceptual apparatus will reach a stage, when autonomous robots become full-blooded moral and legal agents. Two modern achievements, the modern figure of the intellectual and the modern institution of the university, have been undergoing a radical crisis of identity. The decline of the philosophical project of modernity is turning out to be a painful process for modern culture: once again it has to reformulate the aims of its social institutions (the university) and the tasks of its cultural heroes (the intellectual). The traditional modern figure of the intellectual seems untenable in our increasingly postmodern cultural surrounding. (...) The modern institution of the university may face a similar fate in our increasingly globalized surrounding: either it is going to accept the rules of bureaucratic consumer-oriented corporations, or it will have to try once again to find a new regulative idea. Thus, the history of the university and the history of the intellectual in the 20<SUP>th century being parallel, the present volume consists of essays in the philosophy of culture (devoted to the intellectual) and in the philosophy of education (devoted to the modern university) and attempts to link the two modern themes together. The issue of whistleblower protection has been gaining more attention in recent years, especially after the passing of Directive (EU) 2019/1937 of the European Parliament and of the Council of October 23, 2019 on the protection of persons who report breaches of Union law. However, there is a fundamental question as to whether the regulations are sufficient to provide real protection for whistleblowers in organizations. In this regard, it seems crucial that the various actors (legislators, managers, employees) work together to (...) create an appropriate social environment. In this context, it is worth considering the use of knowledge of human decision-making processes, with particular emphasis on the possibility of modifying choice architecture and influencing decisions without imposing specific solutions. Nudging can be used in the “foreground” of legal regulation, by adjusting the social environment in such a way that legal regulation can work effectively. The paper provides an introduction to the application of nudge theory in the context of legal protection of whistleblowers. (shrink)

Microfinance institutions are alternative financial providers offering financial services to people typically excluded from the standard banking sector. While most MFIs are active in developing countries, there is also a young and developing microfinance sector in Europe; however, very little literature exists on this MFI segment. In this paper, we analyze the environmental performance of 58 European MFIs. Our results suggest that the size of the MFI, investor concern for environmental performance and, to a lesser extent, donor interest, are closely (...) related to the institution’s environmental performance. Moreover, providing loans larger than microcredits is linked to better environmental performance. This could suggest that the additional revenues generated from these loans, also called cross-subsidies, could help MFIs to strengthen their environmental bottom line. Finally, no evidence suggests that profit status explains environmental performance. (shrink)

Quine’s project of “naturalized epistemology” is usually interpreted as a rejection of classical epistemology, which becomes merely a “chapter of psychology”. It does not imply, however, a different understanding of the character of naturalization is inadequate or wrong. Susan Haack’s interpretations are briefly analyzed in the paper. Thereafter, they are harnessed as models of interpretation of the “naturalization of law”. The main aim is to point the radical reading of Quine’s project is not the only acceptable one. Consequently, there are (...) at least three models of the “naturalization of law” that are analogical to the “naturalization of epistemology”. The author details their character. (shrink)

W artykule podjęto próbę teoretycznego ujęcia obcości w kontekście filozofii życia.Poczucie obcości jawi się jako konkretne, pierwotne doświadczenie życiowe.Dopiero wtórnie wynika z niej antagonizm kulturowy czy etniczny. W artykule proponujesię rozróżnienie kategorii obcości oraz inności. Tę pierwszą uznaje się za zradykalizowanąpostać inności. Obcość konstytuuje zabsolutyzowana różnica i myślenie dualistyczne.

Badania dotyczące pojawiania się myśli oderwanych od zadania wykonywanego przez podmiot pokazują, że takich myśli jest tym mniej, im większe wymagania stawia ono systemowi poznawczemu, jeśli chodzi o zaangażowanie procesów zarządczych, złożoność, trudność bądź częstość wykonywanych operacji. Jednym z możliwych wyjaśnień tych zależności jest hipoteza biernej regulacji zasobowej: aktywność umysłowa oderwana od zadania rozwija się w takim zakresie, w jakim procesy realizujące zadanie pozostawiają wolne zasoby niezbędne do jej rozwoju. Analizy przedstawione w artykule motywowane są pytaniem o teoretyczną konkretyzację tej (...) idei. Jaka jest natura zasobowych ograniczeń, które mają uniemożliwiać równoczesne rozwijanie się aktywności umysłowej dotyczącej zadania i oderwanej od niego? Na jakim etapie rozwoju aktywności umysłowej prowadzącej do pojawienia się myśli oderwanej od zadania występuje w związku z tymi ograniczeniami zasobowa blokada? Pod tym kątem rozważane są cztery współczesne znaczące ujęcia „roboczej” części umysłu: modele pamięci roboczej Baddeleya i Cowana oraz architektury kognitywne ACT-R i CAPS. Chociaż w tych teoriach są uwzględnione ograniczenia dotyczące przetwarzania lub aktywnego przechowywania, z którymi może wiązać się bierna regulacja zasobowa, to ważne pytania dotyczące mechanizmów takiej regulacji pozostają bez odpowiedzi. Wyjaśnienie odwołujące się do idei biernej regulacji zasobowej stawia przed modelami funkcjonowania umysłu nowe wyzwania. (shrink)

I show how classical and quantum physics approach the problem of randomness and probability. Contrary to popular opinions, neither we can prove that classical mechanics is a deterministic theory, nor that quantum mechanics is a nondeterministic one. In other words it is not possible to show that randomness in classical mechanics has a purely epistemic character and that of quantum mechanics an ontic one. Nevertheless, recent developments of quantum theory and increasing experimental possibilities to check its predictions call for returning (...) to the problem of comparing possibilities given by classical and quantum physics to accommodate and prove the existence of a `genuine randomness'. Recent results concerning `amplification of randomness' show that, in certain sense, quantum physics is in fact ‘more random’ that classical and outperforms it in producing a `truly random process'. The paper discusses problems concerning anthropocentric understanding of cosmology and physics. The author considers two version of anthropic principle ("weak" and "strong"). Among other things the connection between anthropic principle and cosmological principle is here analysed. The author also deals with the problem of object-subject relation in physical science (probability and measurement in quantum mechanics). He have come to the conclusion, that anthropocentric interpretation of physical science leads to essential difficulties.

The author presents in the paper several related „logical” meanings of the category of the existence. He discusses some views held by Frege, Russell, Lesniewski, and Quine. The aim of the discussion is to show the insufficiency of those views for the philosophical discourse. The criticism goes in two main directions: immanent direction and transcendent direction. Firstly, the author indicates some internal inconsistencies of the interpretations under discussion. Secondly, he tries to compare the conceptions under consideration with some alternative attitudes, (...) especially with the approach of the so-called existential metaphysics. (shrink)

This article focuses on the production of children’s literature in New Zealand. It problematizes the current practices of releasing and distributing children’s literature, and explores these practices as technologies of control through processes of censorship and classification set by government agencies such as the Office for Film and Literature. Decisions about what is and what is not acceptable for children’s development, it is argued, are not neutral and are instead driven by a neoliberal image of the ‘happy’ uncomplicated child. The (...) article takes the example of the state-funded and distributed My Feelings series as a widely accessible text that is embedded in neoliberal ideology. As this series is distributed to all New Zealand early childhood centres and kindergartens, this article explores understandings of how politics of government influence children’s literature. The work of Václav Havel and Michel Foucault are drawn upon to demonstrate the mechanisms of ideologically driven forms of governmental power that directly impact on the constitution of certain types of childhoods. An example from a contrasting historical and political discourse in the form of communist Czechoslovakia suggests unexpected synergies between neoliberal and socialist ideological frameworks. This analysis further problematizes notions of power in the distribution of children’s literature, and illustrates the influence that political agendas have on the production of idealized political childhood subjectivities. In this note two notions of meaning are considered and accordingly two versions of synonymy are defined, weaker and stronger ones. A new semantic device is introduced: a matrix is said to be pragmatic iff its algebra is in fact an algebra of meanings in the stronger sense. The new semantics is proved to be universal enough (Theorem 1), and it turns out to be in some sense a generalization of Wójcicki's referential semantics (Theorem 3).

The author examines the arguments for applicability of the limitation clause which specifies the requirements for limitation of constitutional freedoms and rights (Article 31 para. 3 of the Constitution) to the right to protection of life (Article 38). Even if there is almost a general acceptance of such applicability, this approach does not hold up to criticism based on the rule existing in the Polish legal order that treaty commitments concerning human rights have supremacy over national statutory regulations. Due to (...) an international pattern which does not provide application of the limitation clause to the right to life protection, despite the recognition — at the level of a constitutional standard — of applicability of the clause of Article 31 para. 3 to Article 38, and to protection of life in general, this will be made impossible at any attempt to formulate a statutory standard. He also points out the defectiveness of the reasoning leading to acceptance of certain limitations of a particular value (e.g. life) on the basis of the ex definitione exemptions existing in the international standard to the assumption of applicability of the limitation clause when shaping statutory standards in the Polish legal system. The discussed issues are related to the question of interpretation of the inviolability of human rights. This term takes different meaning in the context of: 1) inviolability of all human rights understood in abstracto as normative structures of a general and abstract nature; 2) right protecting certain values with no exception; 3) rights to which an application of the limitation clause is forbidden; 4) rights not subject to derogation; 5) inviolability of understood in concreto, as that is (here and now) due to the subject of dignity; 6) inviolable essence of freedoms and rights. One should also clearly distinguish between (7) the descriptive and (8) the normative meaning of inviolability. -/- Punktem wyjścia jest analiza argumentacji na rzecz tezy o stosowalności do prawa do ochrony życia (art. 38 Konstytucji RP), klauzuli limitacyjnej określającej warunki ograniczania konstytucyjnych wolności i praw (art. 31 ust. 3). Mimo niemal powszechnej akceptacji tej tezy, nie wytrzymuje ona krytyki opartej na pierwszeństwie, które w polskim porządku prawnym mają zobowiązania traktowe dotyczące praw człowieka, wobec regulacji ustawowych. Ze względu na wzorzec międzynarodowy, który nie przewiduje stosowania klasycznej klauzuli limitacyjnej do prawa do życia, mimo uznania - na poziomie standardu konstytucyjnego - stosowalności klauzuli z art. 31 ust. 3 do art. 38 i ochrony życia w ogóle, stosowalność tej klauzuli będzie uniemożliwiona przy każdej próbie formułowania standardu ustawowego. Autor zwraca uwagę na wadliwość wnioskowania prowadzącego od uznania dopuszczalności pewnych ograniczeń ochrony jakiejś wartości (np. życia) na podstawie wyjątków ex definitione obecnych w standardzie międzynarodowym, do tezy o stosowalności klauzuli limitacyjnej przy kształtowaniu standardu ustawowego w polskim systemie prawnym. We formulate a cosmogonic indifference principle in cosmology in terms of a dynamical system theory. While the choice between generic and fine tuned initial condition for our Universe has a rather philosophical character, there is a very generic set of initial conditions which give rise to the concordance inflectional ΛCDM model which becomes in good agreement with astronomical observations.

Recognizing inherent and inalienable nature of dignity and universality of certain values, the Constitution of the Republic of Poland, introduces to the foundations of Polish legal system some elements of natural law which may be used for application of the Basic Law. Constitutional recognition of these elements only makes sense on the assumption of their cognizability. Therefore, as an important element of constitutional concept of natural law is taken the recognition of the argument of cognitivism according to which moral assessments (...) may have the nature of judgments and truth qualification (they may be true or false). In the course of application of the constitution, norms of natural-law character and natural-law justification. Since dignity and the essence of freedoms and rights based on dignity are the only inviolable values recognized by the constitution, the arguments of natural law lead to a far-going reinterpretation of constitutional norms. The norm of natural law protecting inviolable values will have precedence in the event of collision with norms protecting other values, also with constitutional norms. Even if such a norm is formulated on the basis of the provisions of the constitution, in fact natural law is given higher rank than elements based only on enacted law. Despite that, reliability of a legally established order does not seem to be radically endangered. -/- Konstytucja RP uznając przyrodzoność i niezbywalność godności oraz uniwersalność niektórych wartości, wprowadza do podstaw całego polskiego systemu prawnego elementy prawnonaturalne, które mogą być wykorzystane w stosowaniu konstytucji. Konstytucyjne uznanie takich elementów ma sens przy założeniu ich poznawalności, stąd istotnym elementem konstytucyjnej koncepcji prawa naturalnego jest uznanie tezy kognitywizmu głoszącej, że oceny moralne mogą mieć charakter sądów i kwalifikację prawdziwościową – mogą być prawdziwe lub fałszywe. W procesie stosowania konstytucji mogą być formułowane normy o charakterze prawnonaturalnym oraz uzasadnienia prawnonaturalne. Ponieważ jedynymi wartościami uznanymi w konstytucji za nienaruszalne jest godność oraz istota wolności i praw, których godność jest źródłem, argumentacja prawnonaturalna może prowadzić do daleko idącej reinterpretacji norm konstytucyjnych. Norma prawnonaturalna chroniąca warunki konieczne poszanowania godności lub istoty wolności i praw będzie miała pierwszeństwo w razie kolizji z normami chroniącymi inne wartości, także z normami konstytucyjnymi. Choć norma taka będzie formułowana na podstawie przepisów konstytucji, to jednak faktycznie prawo naturalne uzyskuje wyższą rangę od elementów opartych jedynie na stanowieniu. Mimo tego bezpieczeństwo prawne nie wydaje się być radykalnie zagrożone. O prawnonaturalnym charakterze normy i uzasadnienia decyduje oparcie w ocenach moralnych, które pretendują do bycia sądami, do bycia prawdziwymi lub fałszywymi. Z punktu widzenia stosowania konstytucji i wymogu intersubiektywnej komunikowalności i kontrolowalności dookreślania treści prawnonaturalnych, dla nadania ocenom charakteru sądów istotny jest kształt procedur i argumentacji prowadzących do tego dookreślenia. Powinny to być procedury i argumentacja typowe dla dyskursu mającego na celu sformułowanie prawdziwych sądów. Maksymalizowana powinna być dyskursywność takich procedur, a podstawą rozstrzygnięcia powinien być, jeśli to tylko możliwe, konsens. Nie mogą być uważane za rozstrzygające argumenty odwołujące się do woli indywidualnej lub zbiorowej, reakcji emocjonalnych, stopnia rozpowszechnienia danej oceny czy do tradycji kulturowej. (shrink)

Choć samo zjawisko wykluczenia społecznego nie jest nowe, to jego waga, zwłaszcza w perspektywie praw człowieka, została doceniona stosunkowo niedawno. „Wykluczenie społeczne” nie jest kategorią konstytucyjną. Celem opracowania jest ogólne usytuowanie problematyki wykluczenia w kontekście zagadnień konstytucyjnych. Zmierza się do dookreślenia, czym jest wykluczenie społeczne oraz do wskazania zasadniczych konstytucyjnych punktów odniesienia, pozwalających na podjęcie tego problemu. Właściwe wykluczeniu społecznemu jest złożoność przyczyn - sam brak środków finansowych nie musi prowadzić do wykluczenia, choć proces wykluczania może być zainicjowany jednym wydarzeniem. (...) Jednak wykluczenia nie można adekwatnie scharakteryzować jedynie poprzez jego przyczyny. Wielowymiarowość dotyczy także przejawów wykluczenia. O wykluczeniu społecznym w sensie właściwym mówi się wówczas, gdy ograniczenia dotyczą jednocześnie wielu sfer życia społecznego. Chodzi przy tym o sfery fundamentalne, istotne . Charakterystyczne dla wykluczenia jest dłuższe trwanie w czasie. Często ma wymiar przestrzenny – procesy wykluczania prowadzą do wyodrębnienia obszarów, enklaw zamieszkanych przez wykluczanych, co jeszcze bardziej utrwala stan wykluczenia. Procesy wykluczania prowadzą niekiedy do zjawiska zwanego dziedziczeniem biedy czy wykluczenia. Ochrona przed wykluczeniem, wolność od niego, została uznana za prawo człowieka; prawo niesprowadzalne do tradycyjnie formułowanych praw gospodarczych, socjalnych i kulturalnych; mimo że wykluczenie społeczne dotyczy przede wszystkim udziału w życiu gospodarczym, społecznym i kulturalnym. Wykluczenie jest powiązane z naruszeniem zasady równości, jednak nie daje się ująć jedynie w perspektywie tej zasady, przy czym w szeregu istotnych punktów różni się od dyskryminacji w korzystaniu z praw człowieka. Poszukując w Konstytucji RP, w której brak jest kategorii „wykluczenia społecznego” zasadniczych punktów odniesienia należy poszukiwać w zasadzie godności z art. 30 oraz – w stosunku do obywateli – w art. 1. Jako pomocnicze punkty odniesienia można wskazać zasady sprawiedliwości społecznej, solidarności oraz równości, a także konstytucyjny katalog wolności i praw, przede wszystkim wolności i praw ekonomicznych, socjalnych i kulturalnych.
