Information Retrieval systems benefit from the use of long queries containing a large volume of search-relevant information. This situation is not common, as users of such systems tend to use very short and precise queries with few keywords. In this work we propose a modification of the Latent Dirichlet Allocation (LDA) technique using data from the document collection and its vocabulary for a better representation of short queries. Additionally, a study is carried out on how the modification of the proposed (...) LDA weighted vectors increase the performance using relevant documents as feedback. The work shown in this paper is tested using three biomedical corpora (TREC Genomics 2004, TREC Genomics 2005 and OHSUMED) and one legal corpus (FIRE 2017). Results prove that the application of the proposed representation technique, as well as the feedback adjustment, clearly outperforms the baseline methods (BM25 and non-modified LDA). (shrink)

This essay is an attempt to put in evidence the preacher's argumentative power, on the basis of Chaïm Perelman's considerations on Rethoric as "a speech that aims to convince or persuade". Com este artigo, procurámos expor a dinâmica que assiste à Filosofia do Conhecimento de Francisco Vieira de Almeida (1888-1962), Professor da Faculdade de Letras da Universidade de Lisboa de 1915 a 1958, por um lado, apresentada como acesso privilegiado à prática filosófica, por outro, entendida como exercício de sistematização que recusa a fixação num sistema, por fim, atravessada pela intenção de promover a osmose entre o conhecimento de «tipo-filosofia» e o de «tipo-ciência», surpreendendo a gestualidade dessa ética do filosofar (...) naquela que é tida, consensualmente, como sua obra-prima, Pontos de Referência, publicada em 1961. As fraturas da sociedade salarial e o aumento da precariedade de vida levam diferentes setores a se engajarem em ações sociais. O artigo analisa o papel das corporações no enfrentamento dos problemas sociais a partir de um debate sobre o tipo de racionalidade subjacente ao modelo de desenvolvimento globalizado (pautado na razão indolente de Boaventura de Sousa Santos) e da análise da imbricação da economia na estrutura social (através da sociologia econômica). Os resultados demonstram que, apesar de alguns avanços historicamente (...) consolidados, práticas consideradas inovadoras por parte das corporações encontram substantivos desafios para ultrapassarem o nível da compensação, o que se relaciona com a permanência dos princípios da racionalidade mercantil. O estudo conclui que a genuína inovação social necessita considerar uma perspectiva de desenvolvimento e inovação baseada nas liberdades substantivas dos seres humanos. (shrink)

The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). Este artículo analiza los desarrollos que Foucault realiza en torno a la analítica de la finitud en su libro Las palabras y las cosas con el fin de dilucidar las diferencias conceptuales con que Freud y Lacan abordan el sujeto del psicoanálisis. Se pretende reconocer la potencia de la crítica foucaulteana al cuadrilátero antropológico y revisar si las teorías de Freud y Lacan se encuentran o no dentro del mismo, buscando pensar la fecundidad de las direcciones contemporáneas del psicoanálisis. Resultados: (...) Foucault dejó en claro que es necesario prescindir del hombre para poder pensar de nuevo la realidad humana. Freud abrió las puertas de tal desaparición, aunque sus cimientos epistemológicos lo dejaron fijado a una antropología biologicista. Lacan retornó lingüísticamente a Freud para rescatar la potencia de su descubrimiento y formalizar un psicoanálisis cuyo sujeto no es el hombre. Orientaciones actuales del psicoanálisis parecen olvidar este último esfuerzo. (shrink)

In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. The E.U. is shortly before implementing the Digital Markets Act (DMA), which aims to regulate digital markets and (ideally) rein in the power of big tech gatekeepers. Several researchers claim that this proposal – and especially its goal to ensure the contestability and fairness of digital markets – is ordoliberal in nature, yet what is missing in the academic literature is a closer look at the parallels (and differences) between the E.U.’s competition policy (and the DMA) and ordoliberalism. This paper (...) tries to close the gap and help answer the question of whether the DMA is indeed standing in an ordoliberal tradition. Furthermore, it evaluates the Act’s institutional strengths and weaknesses – as seen from an ordoliberal perspective – and points out potential ways to strengthen E.U. competition policy (and the DMA) and bring it closer to the ordoliberal ideal. I first seriously contemplated writing a book on degree theory in 1976 while I was visiting the University of Illinois at Chicago Circle. There was, at that time, some interest in ann-series book about degree theory, and through the encouragement of Bob Soare, I decided to make a proposal to write such a book. Degree theory had, at that time, matured to the point where the local structure results which had been the mainstay of the earlier papers in the area (...) were finding a steadily increasing number of applications to global degree theory. Michael Yates was the first to realize that the time had come for a systematic study of the interaction between local and global degree theory, and his papers had a considerable influence on the content of this book. During the time that the book was being written and rewritten, there was an explosion in the number of global theorems about the degrees which were proved as applications of local theorems. The global results, in turn, pointed the way to new local theorems which were needed in order to make further progress. I have tried to update the book continuously, in order to be able to present some of the more recent results. It is my hope to introduce the reader to some of the fascinat ing combinatorial methods of Recursion Theory while simultaneously showing how to use these methods to prove some beautiful global theorems about the degrees. Nomy Arpaly rejects the model of rationality used by most ethicists and action theorists. Both observation and psychology indicate that people act rationally without deliberation, and act irrationally with deliberation. By questioning the notion that our own minds are comprehensible to us--and therefore questioning much of the current work of action theorists and ethicists--Arpaly attempts to develop a more realistic conception of moral agency.

Both legal and moral theorists have offered broadly “communicative” theories of criminal and moral responsibility. According to such accounts, we can understand the nature of responsibility by appealing to the idea that responsibility practices are in some fundamental sense expressive, discursive, or communicative. In this essay, I consider a variety of issues in connections with this family of views, including its relationship to free will, the theory of exemptions, and potential alternatives to the communicative model. Focusing on Michael McKenna’s Conversation (...) and Responsibility, I argue that communicative accounts, and the conversational model in particular, direct our attention to important and under-appreciated elements of our responsibility practices. However, rather than focusing on a model of conversation-as-address, as McKenna does, we do better to regard gossip as the paradigmatic conversational form that captures the main features of moral responsibility. Philosophers disagree whether composition as identity entails mereological universalism. Bricker :264–294, 2016) has recently considered an argument which concludes that composition as identity supports universalism. The key step in this argument is the thesis that any objects are identical to some object, which Bricker justifies with the principle of the universality of identity. I will spell out this principle in more detail and argue that it has an unexpected consequence. If the universality of identity holds, then composition as identity not (...) only leads us to universalism, but also leads to the view that there are no mereological atoms. (shrink)

The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

Composition as Identity is the view that an object is identical to its parts taken collectively. I elaborate and defend a theory based on this idea: composition is a kind of identity. Since this claim is best presented within a plural logic, I develop a formal system of plural logic. The principles of this system differ from the standard views on plural logic because one of my central claims is that identity is a relation which comes in a variety of (...) forms and only one of them obeys substitution unrestrictedly. I justify this departure from orthodoxy by showing some problems which result from attempts to avoid inconsistencies within plural logic by means of postulating other non-singular terms besides plural terms. Thereby, some of the main criticisms raised against Composition as Identity can be addressed. Further, I argue that the way objects are arranged is relevant with respect to the question which object they compose, i.e. to which object they are identical to. This helps to meet a second group of arguments against Composition as Identity. These arguments aim to show that identifying composite objects on the basis of the identity of their parts entails, contrary to our common sense view, that rearranging the parts of a composite object does not leave us with a different object. Moreover, it allows us to carve out the intensional aspects of Composition as Identity and to defend mereological universalism, the claim that any objects compose some object. Much of the pressure put on the latter view can be avoided by distinguishing the question whether some objects compose an object from the question what object they compose. Eventually, I conclude that Composition as Identity is a coherent and plausible position, as long as we take identity to be a more complex relation than commonly assumed. (shrink)

The way digital information technologies work and, more specifically, the possibilities for action that technological devices offer to us affect our processes of political belief formation. In particular, there seems to be a close connection between our digital affordances and the increase of the sort of polarization that threatens the proper functioning of democracy. In this paper, we analyze whether the type of polarization linked to the use of digital technologies, and which endangers the health of public deliberation, has to (...) do with the adoption of beliefs whose contents are increasingly extreme—extremism—or, on the contrary, has more to do with increasing our credence in the core beliefs of our political identity—radicalism. The article is guided by two main research questions: First, do the Equator Principles (EPs), a voluntary CSR-initiative in the project finance sector, and the recently published working paper of the Thun Group of Banks adequately address the U.N. Guiding Principles on Business and Human Rights or do they fall behind the ‘Ruggie framework’? Second, is the demand for human rights due diligence sufficient to classify the EPs as a positive and leverage-based concept of CSR (à la Wettstein and Wood) (...) or is this requirement still a feature of a negative and impact-based concept of CSR? In case it is a negative and impact-based concept of CSR, the question comes up which further steps should be taken by financial institutions to fulfill their positive and leverage-based responsibilities. The article argues that positive and leverage-based responsibilities for multinational companies exist – due to the moral nature of human rights and due to the political authority of multinational companies – and that the current (Ruggie-like) requirements for human rights due diligence are not adequate for a positive and leverage-based concept of CSR. Further measures should be taken by multinational companies – and especially (Equator) banks which possess a high leverage-influence over their clients – to not only ensure the respect for human rights, but also the on-the-ground protection and realization of human rights. Recent years have seen recurring episodes of tension between proponents of freedom of speech and advocates of the disenfranchised. Recent survey research attests to the ideological division in attitudes toward free speech, whereby conservatives report greater support for free speech than progressives do. Intrigued by the question of whether “canceling” is indeed a uniquely progressive tendency, we conducted a vignette-based experiment examining judgments of offensiveness among progressives and conservatives. Contrary to the dominant portrayal of progressives and conservatives, our study documented (...) ideological symmetry in their evaluations of offensive speech. When faced with utterances whose content matters to them, both conservatives and progressives viewed outgroup speakers as more offensive than ingroup speakers. A second contribution of this chapter is to provide a deeper understanding of the cognitive mechanism implicated in evaluating outgroup speech as more offensive than ingroup speech. Our results suggest that perception of offensiveness is mediated by ascriptions of intent: we tend to attribute negative intent to the speaker whenever we deem their utterances to be offensive, even against the explicitly stated speaker’s background attitudes. Con esto pretendemos reflexionar en qué medida los diferentes términos y expresiones configuran un imaginario sociocultural en el que la bebida es concomitante con las prácticas cotidianas de los jóvenes. La metodología empleada parte del estudio léxico-semántico de un corpus de 5.000 formas, aproximadamente, a través de la elaboración de una taxonomía, y de una planta de análisis lexicográfico, (...) a partir de figuras retóricas, principalmente la metáfora y la metonimia, que provoca, el gozo y el deleite por parte de sus usuarios. En última instancia, dos formas de entender las relaciones entre filosofía y vida. Más allá del logocentrismo, objeto de la deconstrucción, el biocentrismo es el eje de la tarea de reconstrucción de una filosofía articulada como ontología o teoría de lo real, filosofía moral o teoría de la justicia y sabiduría o (...) teoría de la salvación. AI (ethics) initiatives are essential in bringing about fairer, safer, and more trustworthy AI systems. Yet, they also come with various drawbacks, including a lack of effective governance mechanisms, window-dressing, and ‘ethics shopping.’ To address those concerns, hard laws are necessary, and more and more countries are moving in this direction. Two of the most notable recent legislations include the Biden Administration’s Executive Order (EO) on AI and the E.U.’s AI Act (AIA). While several scholarly articles have evaluated the strengths (...) and weaknesses of the AIA and proposed reform measures that could help strengthen the Act, only a couple of papers do the same for the EO or compare the two regulatory initiatives. The following sections try to close this research gap by providing an in-depth comparative analysis of the EO and AIA. They offer, in particular, a critical computer-ethical evaluation of the EO’s and AIA’s pros and cons and similarities and differences and discuss possible ways to improve both legislations. In the present contribution, we argue that all health care professionals and particularly psychotherapists should provide a plausible rationale for their treatment including an etiological model and a model of unique and common change mechanisms. The provision of a plausible rationale has two goals: (1) meet the ethical challenge of informed consent, and (2) to improve treatment outcome by fostering the meaning response. In the course of the ethical and a legal obligation of psychotherapists to obtain patients’ informed consent before (...) initiating psychotherapy, patients have the right to receive maximally comprehensive information for providing their consent, which - among other information about the treatment (such as general psychotherapeutic approach, setting, and procedures) – should include a plausible treatment rationale. A useful concept in conceptualizing and communicating a treatment rationale as part of the informed consent procedure is Moerman’s general notion of the meaning response as the physiological or psychological effects of meaning in the course and treatment of an illness. The more compelling the rational explanation of the targeted treatment effects, the stronger the meaning response is expected to be. As the mechanisms of change in psychotherapy are known to be quite abstract and considered common to all approaches to a large extent, it seems especially important to provide a convincing treatment rationale to strengthen trust in the therapist and potentially foster positive expectations of process and outcome. To that extent, strengthening a patient`s meaning response to information provided at the beginning of psychotherapy may be central to activating common therapeutic factors. (shrink)

Las herramientas teóricas destinadas a señalar las injusticias que sufren ciertos grupos socialmente oprimidos pueden acabar siendo utilizadas con propósitos completamente opuestos a los iniciales. Modificar el alcance de una herramienta teórica no es necesariamente problemático: la popularización de un concepto abre las puertas a que se utilice estratégicamente para diferentes fines. La tesis que defendemos en este artículo es que algunos personajes públicos cultivan una imagen particular de sí mismos que parece satisfacer los requisitos de la noción de injusticia (...) testimonial y utilizan esta situación como medio para obtener beneficio político de ella. Más concretamente, estos personajes públicos se benefician de esta condición para generar situaciones de desacuerdos cruzados, que están estrechamente relacionados con el aumento de la polarización. Our democracies presently face a set of unique challenges. In this article we argue that the current crisis needs to be understood as resulting from the convergence of two historical transformations: the paradigm of boundlessness; and what we term “endividualismo”, a novel mutation of individualism in the context of the financial age. The result is a novel political reality where individual rights are ever-expanding and the opportunities for collective action have shrunk to the point of impossibility. The resulting powerlessness of (...) the polity demands new answers: we need to reconfigure the relationship between citizens and political power. (shrink)

El formalismo no es la única dolencia que aqueja al Derecho o, mejor, a quienes tienen la función de interpretarlo y aplicarlo. Es cierto, por otro lado, que no todo lo que se llama a veces "formalismo" es igualmente rechazable; e incluso hay un formalismo -un significado de esa expresión- que no lo es en absoluto. El Derecho (...) es, en buena medida, un fenómeno de autoridad; en el mismo, las razones formales tienen una importancia fundamental, lo que no ocurre, por ejemplo, en la moral. Por eso, los jueces no deben dialogar, como a veces se dice, de tú a tú con la Constitución y con las leyes, sino que deben reconocer la autoridad de la una y de las otras; en el caso del juez constitucional, el sometimiento a la Constitución debe ir unido a la deferencia hacia el legislador como principio interpretativo fundamental. Si las cosas no fueran así, no habría Estado de Derecho, simplemente porque el imperio de la ley habría pasado a ser imperio o gobierno de los jueces. (shrink)
