The attempt to critique the profession of clinical ethics consultation by establishing the impossibility of ethics expertise has been a red herring. Decisions made in clinical ethics cases are almost never based purely on moral judgments. Instead, they are all-things-considered judgments that involve determining how to balance other values as well. A standard of justified decision-making in this context would enable us to identify experts who could achieve these standards more often than others, and thus provide a basis for expertise (...) in clinical ethics consultation. Questions about the relevance and value of various liberal concepts are at the heart of important debates among feminist philosophers and social theorists. Although many feminists invoke concepts such as rights, equality, autonomy, and freedom in arguments for liberation, some attempt to avoid them, noting that they can also reinforce and perpetuate oppressive social structures. In Challenging Liberalism Schwartzman explores the reasons why concepts such as rights and equality can sometimes reinforce oppression. She argues that certain forms of abstraction and (...) individualism are central to liberal methodology and that these give rise to a number of problems. Drawing on the work of feminist moral, political, and legal theorists, she constructs an approach that employs these concepts, while viewing them from within a critique of social relations of power. The concept of bodily health is problematic for mechanists like Descartes, as it seems that they need to appeal to something extrinsic to a machine, i.e., its purpose, to determine whether the machine is working well or badly, and so healthy or unhealthy. I take issue with this claim. By drawing on the history of medicine, I suggest that in the seventeenth century there was space for a non-teleological account of health. For many, the word 'pleasure' conjures associations with hedonism, indulgence, and escape from the life of the mind. However little we talk about it, though, pleasure also plays an integral role in cognitive life, in both our sensory perception of the world and our intellectual understanding. This previously important but now neglected philosophical understanding of pleasure is the focus of the essays in this volume, which challenges received views that pleasure is principally motivating of action, unanalyzable, and caused, rather than (...) responsive to reason. Like other books in the Oxford Philosophical Concepts series, it traces the development of the focal idea from ancient times through the 20th century. The essays highlight points of departure for new lines of inquiry rather than attempting to provide a full picture of how the idea of pleasure has been explored in philosophy. The volume begins by showing how Plato, Aristotle, early Islamic philosophers, and philosophers in the Medieval Latin tradition, such as Aquinas, honed in on the challenge of unifying the variety of pleasures so that they fall under one concept. In the early modern period, philosophers shifted from understanding the logic of pleasure to treating pleasure as a mental state. As the studies of Malebranche, Berkeley and Kant show, the central problem becomes understanding the relation of pleasure to other sensory experiences, and the role of pleasure in human cognition and knowledge. Short interdisciplinary reflections interspersed between essays focus on art of 16th and 17th century textbooks and the difficult music of composers like Bach, which demonstrate translation of these concerns to cultural production in the period. As the essay on Mill shows, the 19th century development of scientific psychology narrowed the definition of pleasure, and so its philosophical focus. Contemporary accounts of pleasure, however, in both philosophy and psychology, are now recognizing the limitations of this narrow focus, and are once again recognizing the complexity of pleasure and its role in human life. Human motor skills are exceptional compared to other species, no less than their cognitive skills. In this perspective paper, we suggest that “movement matters!,” implying that motor development is a crucial driving force of cognitive development, much more impactful than previously acknowledged. Thus, we argue that to fully understand and explain developmental changes, it is necessary to consider the interaction of motor and cognitive skills. We exemplify this argument by introducing the concept of “embodied planning,” which takes an embodied cognition (...) perspective on planning development throughout childhood. From this integrated, comprehensive framework, we present a novel climbing paradigm as the ideal testbed to explore the development of embodied planning in childhood and across the lifespan. Finally, we outline future research directions and discuss practical applications of the work on developmental embodied planning for robotics, sports, and education. (shrink)

The Office of Research Integrity found in 2011 that Vipul Bhrigu, a postdoctoral researcher who sabotaged a colleague’s research materials, was guilty of misconduct. However, I argue that this judgment is ill-considered and sets a problematic precedent for future cases. I first discuss the current federal definition of research misconduct and representative cases of research misconduct. Then, because this case recalls a debate from the 1990s over what the definition of “research misconduct” ought to be, I briefly recapitulate that history (...) and reconsider the Bhrigu case in light of that history and in comparison to other cases involving tampering. Finally, I consider what the aim of a definition of research misconduct ought to be, and argue that the precedent set by the reasoning in this case is problematic. (shrink)

This article presents the first author's experiences as an Australian doctoral student undertaking a PhD by publication in the arena of the social sciences. She published nine articles in refereed journals and a peer-reviewed book chapter during the course of her PhD. We situate this experience in the context of current discussion about doctoral publication practices, in order to inform both postgraduate students and academics in general. The article discusses recent thinking about PhD by publication and identifies the factors that (...) students should consider prior to adopting this approach, in terms of university requirements, supervisors' attitudes, the research subject matter, intellectual property, capacity and working style, and issues of co-authorship. It then outlines our perceptions of the advantages and disadvantages of undertaking a PhD by publication. We suggest that, in general, the advantages outweigh the disadvantages. We conclude by reflecting on how the first author's experiences relate to current discussions about fostering publications by doctoral students. (shrink)

Due to the lack of a standard definition for the concept of corporate social responsibility, various discourse communities have assigned different meanings to it. Based on the intermedia agenda setting theory, this study examines the extent to which CSR-related news releases published by the two electricity providers in Hong Kong have influenced press coverage over a 6-year period between 2006 and 2011. A total of 202 news releases and 1,045 news articles were content-analyzed based on the following mutually exclusive categories (...) of CSR-related news events: operations, education, community, products and services, recognition, environment, and donations and sponsorships. This study found that operations-related and products and services-related news releases were more likely to be reported in the press. Recognition-related news releases were the least likely to be reported. Based on the findings, this study posits that two criteria would determine whether a CSR-related news release is likely to be covered in the press: the extent to which the news events are relevant to the core operations of the corporations and the extent to which the news events make an impact on society. In this article we propose a philosophical critique of two general, but not exhaustive, approaches to gender studies in sport, namely gynocentric feminism and humanist feminism. We argue that both approaches are problematic because they fail clearly to distinguish or articulate their epistemological and ideological commitments. In particular, humanist feminists articulate the human condition using the sex/gender dichotomy, which fails to account adequately for gendered subjectivity. For them gender difference is a contingent feature of humanity developed through socialisation. As a (...) result, it seems that what humanist feminists regard as women in their natural ?state? is in itself ideological. The generic ?human? condition is by no means a neutral condition but rather an idea tarnished by gender history characterised by the masculine. Consequently, humanist feminists uncritically argue for inclusion in sport, with access to an equal share of the human goods available, without carefully problematising the ideological nature of the practice. Gynocentric feminists also subscribe to the sex/gender dichotomy, suggesting however, that gender subjectivity is the result of a biological imperative. For gynocentric feminists, sexual difference provides authority for adjudicating between a separate and different male and female epistemology. Accordingly, gynocentric feminists commit the genetic fallacy by condemning sport to a masculine activity and therefore incompatible with feminine value in light of its male ancestry. ?Soft? gynocentrism does not fully sanction a conception of sport which allows only traditionally female values to flourish, or at least the reason for celebrating such sports would focus upon the goods and values therein. In other words, the value of the practice for either men or women is to be found, following MacIntyre (1985), in the internal goods that characterise the particular practice. Such internal goods are, as MacIntyre argues, goods of the practice and do not belong to any particular gender or group. (shrink)

While communities engaged in liberatory struggles have valued group loyalty and condemned betrayal, loyalty itself may be problematic, because remaining loyal to a community may require that one refrain from deconstructing the group identity on which the community is based. This essay investigates what loyalty is and whether loyalty is a virtue, and considers why, if loyalty is indeed a virtue, it may be one that is difficult to maintain in a context of oppression.

Lisa Tessman’s Moral Failure: On the Impossible Demands of Morality raises important questions about ideal theory, oppression, and the role of action guidance in normative philosophy. After a brief overview of feminist and anti-racist philosophers’ critiques of ideal theory, I examine Tessman’s claim that nonideal oppression theorists focus too narrowly on action guidance and thereby obscure other important normative issues, such as the problem of moral failure. Although I agree with Tessman’s advocacy of a wider focus—and with her suggestion (...) that situations of inevitable moral failure are particularly important to examine in contexts of oppression—I question whether nonideal oppression theorists actually emphasize action guidance to the exclusion of other concerns. I conclude with a brief examination of the way that ideal and nonideal theory have been defined and understood in debates about normative methodology, and I suggest that a move away from Rawls’s account of the ideal/nonideal distinction would benefit feminists and other oppression theorists. Traditional disciplinary guidelines are inadequate to address some of the ethical dilemmas that emerge when conducting research on violence against women and girls. This article is organized according to the ethical principles of respect for persons, privacy and confidentiality, justice, beneficence, and nonmaleficence. In the article, I describe dilemmas involved in cross-cultural research, research on children, informed consent, voluntariness, coercion, deception, safety, mandated reporting, and dissemination. Charles Mills has critiqued of the whiteness of the discipline of Philosophy by showing how ideal theorizing dominates Anglo-American philosophy and functions there as ideology, while it is non-ideal theorizing that can better attend to the realities of racialized lives. This paper investigates how idealization within the subfield of ethics leads mainstream ethical theorizing to fail to reflect moral life under racial and other forms of domination and oppression. In this article I attempt to untangle the purported connection between moral virtue and flourishing in the context of examining what looks like an unexpected effect of oppression: If moral virtue is necessary for flourishing—as Aristotle assumes that it is when he describes eudaimonia as an “activity of the soul in accordance with virtue” — then members of structurally privileged groups can only flourish if they are morally good. However, it is hard to conceive of the privileged as morally good, (...) since their privileges result from unjust social positionings. Thus it appears that they are prevented from leading good lives. This is an odd claim to add to a theory of oppression, which one would expect to explain how the victims of oppression — rather than its beneficiaries — are denied a shot at the good life.While the privileged may enjoy especially ample opportunities to develop certain virtues, I will be thinking here about vices associated with practices of domination, including active or passive acceptance of the benefits that come from occupying positionings that depend upon systems of male dominance, white supremacy, class divisions under capitalism, norms of heterosexuality, and so on. DNA replication requires the unwinding of the parental duplex, which generates (+) supercoiling ahead of the replication fork. It has been thought that removal of these (+) supercoils was the only method of unlinking the parental strands. Recent evidence implies that supercoils can diffuse across the replication fork, resulting in interwound replicated strands called precatenanes. Topoisomerases can then act both in front of and behind the replication fork. A new study by Sogo et al.
