It is beyond doubt that the legal system established by the Nazi government in Germany between 1933-1945 represented a gross departure from the rule of law: the Nazis eradicated legal security and certainty; allowed for judicial and state arbitrariness; blocked epistemic access to what the law requires; issued unpredictable legal requirements; and so on. This introduction outlines the distorted nature of the Nazi legal system and looks at the main factors that contributed to this grave divergence.

Private governance raises important questions about democratic representation. Rule making is rarely based on electoral authorisation by those in whose name rules are made—typically a requirement for democratic legitimacy. This requires revisiting the role of representation in input legitimacy in transnational governance, which remains underdeveloped. Focussing on private labour governance, we contrast two approaches to the transnational representation of worker interests in global supply chains: non-governmental organisations providing representative claims versus trade unions providing representative structures. Studying the Bangladesh Accord for (...) Fire and Building Safety, we examine their interaction along three dimensions of democratic representation: 1) creating presence, 2) authorisation, and 3) accountability to affected constituents. We develop a framework that explains when representative claims and structures become complementary but also how the politics of input legitimacy shapewhoseinterests get represented. We conclude by deriving theoretical and normative implications for transnational representation and input legitimacy in global governance. (shrink)

Psychological science is maturing and therefore transitioning from explorative to theory-driven research. While explorative research seeks to find something “new,” theory-driven research seeks to elaborate on already known and hence predictable effects. A consequence of these differences is that the quality of explorative and theory-driven research needs to be judged by distinct criterions that optimally support their respective development. Especially, theory-driven research needs to be judged by its methodological rigor. A focus on innovativeness, which is typical for explorative research, will (...) instead incentivize bad research practices (e.g., imprecise theorizing, ignoring previous research, parallel theories). To support the advancement of psychology, we must drop the innovation requirement for theory-driven research and instead require the strongest methods, which are marked by high internal and external validity. Precise theorizing needs to substitute novelty. Theories are advanced by requiring explicit, testable assumptions, and an explicit preference for one theory over another. These explicit and potentially wrong assumptions should not be silenced within the peer-review process, but instead be scrutinized in new publications. Importantly, these changes in scientific conduct need to be supported by senior researchers, especially, in their roles as editors, reviewers, and in the hiring process. An important obstacle to further theory-driven research is to measure scientific merit using researchers’ number of publications, which favors theoretically shallow and imprecise writing. Additionally, it makes publications the central target of scientific misconduct even though they are the main source of information for the scientific community and the public. To advance the field, researchers should be judged by their contribution to the scientific community (e.g., exchange with and support of colleagues, and mentoring). Another step to advance psychology is to clearly differentiate between measurement model and theory, and not to overgeneralize based on few stimuli, incidences, or studies. We will use ideas from the theory of science to underline the changes necessary within the field of psychology to overcome this existential replication crisis. (shrink)

O artigo discute a centralidade da inovação na gramática discursiva da educação contemporânea a fim de refletir sobre as possibilidades de inovar nas Humanidades. Para tanto, realizou-se uma historicização do campo das Humanidades mapeando a rede de sentidos em que o termo Humanidades emergiu e da qual provêm. Analisou-se que a primeira referência de “humanidade” remonta aos autores da Antiguidade Latina, quando o termo grego Paidéia é traduzido por Humanitas significando “filantropia”, “cultura geral” ou “amor à humanidade”. Já na tradição (...) cristã, a expressão littera humaniores passa a ser utilizada para se referir aos textos laicos e distinguir-se dos textos de caráter sagrado. Nessa variação, destaca-se o uso do termo Humanidades pela Ordem dos Jesuítas, que o toma como campo de saber a ser ensinado. O uso do termo com esse sentido e a possibilidade de falar em ensino de Humanidades parece emergir com o modelo jesuíta e seu método escolástico. Tal modelo de ensino impactou as colônias espanholas nos séculos XVI ao XVIII e se coloca como uma das condições de possibilidade para a compreensão de ensino em Humanidades no presente. Diante do imperativo da inovação para o ensino de Humanidades na contemporaneidade, atentamos para o âmbito da formação. Formar pessoas não está desvinculado do ensino, mas o extrapola. As Humanidades constituem o campo do saber que assume, como condição básica, além da tarefa de instruir, a de formar pessoas para transformar o ser. Conclui-se, portanto, que a inovação nas Humanidades tem um papel mais fundamental que em outras áreas pois a produção do novo é mais radical e extrapola uma utilidade imediata. A inovação nas Humanidades requer o cultivo de um pensamento crítico, que ultrapassa o imediatismo, a padronização, a superficialidade, a banalização e a exclusão. Em sua finalidade, a formação em Humanidades pode encontrar meios para seu devir nas inovações tecnológicas, porém, tais inovações não são condições necessárias tampouco suficientes para inovar nas Humanidades. Immunology and its philosophy are a primary source for thinking about biological individuality. Through its discriminatory function, the immune system is believed to delineate organism and environment within one generation, thus defining the physiological individual. Based on the paradigmatic instantiations of immune systems, immune interactions and, thus, the physiological individual are believed to last only for one generation. However, in recent years, transgenerationally persisting immune responses have been reported in several phyla, but the consequences for physiological individuality have not yet (...) been explored. In this article, I will introduce an invertebrate immune system that is RNA-based and operates through a heritable silencing/licensing paradigm. I will discuss how such a perspective on immune systems can illuminate our conceptions of individuality. I will particularly introduce an account of immunological individuality that is not restricted to one generation. (shrink)

The discovery of RNA interference in 1998 has made a lasting impact on biological research. Identifying the regulatory role of small RNAs changed the modes of molecular biological inquiry as well as biologists' understanding of genetic regulation. This article examines the early years of small RNA biology's success story. I query which factors had to come together so that small RNA research came into life in the blink of an eye. I primarily look at scientific repertoires as facilitators of rapid (...) scientific change. I show that for a short period of time, between the years 1998 and 2002, different model organism communities, investigative strategies, technological innovations, and research interests could be successfully aligned to take small RNA research off the ground. I discuss how the keystone discoveries were situated in specific experimental traditions and what strategies were employed to establish these discoveries as more general phenomena. Providing thus a practice-based approach of rapid scientific change, I ask how to relate the change in propositional bits of scientific knowledge with changes in scientific practice. (shrink)

In contrast to apes’ seemingly sophisticated skill at producing pointing gestures referentially, the comprehension of other individual’s pointing gestures as a source of indexical information seems to be less pronounced.One reason for apes’ difficulty at comprehending pointing gestures might be that in former studies they were mainly confronted with human declarative pointing gestures, whereas apes have largely been shown to point imperatively and towards humans. In the present study bonobos, chimpanzees and orangutans were confronted with a conspecific’s imperative pointing gesture (...) in a competitive context, therefore mirroring former studies that have investigated apes’ skills at producing these gestures.However, apes in the present study did not use their conspecific’s pointing gestures. Apes have been shown to use indexical information when provided noncommunicatively and to interpret other individuals’ actions in terms of motives. Thus, it is discussed whether apes treat a pointing gesture as intentional act of indexical reference. (shrink)

Prosocial behaviour benefits another individual and occurs voluntarily. It may have a cognitive and a motivational component. The actor who benefits a recipient – for example by solving her/his problem must recognize the recipient’s goal and understand how to fulfil it and has to be motivated to support the recipient. In the current paper I will review recent studies on prosocial behavior in dogs and I will compare them to studies with primates. I will address the cognitive and motivational skills (...) required for the actor in order to support the recipient. I conclude that dogs and also chimpanzees display a number of prosocial behaviours, but there are remarkable differences. In contrast to humans, which have an outstanding biological predisposition to benefit others, dogs and chimpanzees only do so under certain conditions. (shrink)

This accessible book examines the philosophical foundations of Chaim Perelman's rhetorical theory. In addition to offering a brief biography, it explores Perelman's deep philosophical commitments and his concern for the ways in which the details of actual texts realize those commitments. The authors show that Perelman still reigns supreme when it comes to the elucidation of actual texts. His is a microanalysis of arguments, one that is endlessly suggestive of ways of analyzing texts at the level of the word and (...) phrase, the arrangement of parts, and the structure of arguments. When I recently read a little aesthetic manifesto by Alain Badiou, who is getting a lot of recognition in the intellectual scene in Berlin at the moment, I found myself disagreeing with nearly every single point that Badiou makes there – but it inspired me to present what I want to say today as a response to this piece, and in the form of a counter-manifesto, if you will. Not only because it is generally more fun to articulate the theses (...) one might have on « Aesthetics and Contemporary Art » in a way that sounds a little apodictic and macho, but also because it is challenging to try and do this with theses that counter precisely the smart claims to universalism, truth, abstraction that have become so fashionable again today, especially, and not surprisingly, it seems to me, among young male intellectuals. While scientific pluralism enjoys widespread popularity within the philosophy of science, a related position, epistemic relativism, does not have much traction. Defenders of scientific pluralism, however, dread the question of whether scientific pluralism entails epistemic relativism. It is often argued that if a scientific pluralist accepts epistemic relativism, she will be unable to pass judgment because she believes that “anything goes”. In this article, I will show this concern to be unnecessary. I will also argue that common strategies to differentiate (...) relativism and pluralism fail. Building upon this analysis, I will propose a new way of looking at both positions’ relations. This article aims to understand what explains the friction between scientific pluralism and epistemic relativism. I will demonstrate that conceptualizing both epistemic relativism and scientific pluralism as “stances” sheds better light on their relation and demonstrates that it is, in principle, possible to support both positions at the same time. Preferred policies and levels of analysis, however, cause friction in practice. (shrink)

Der Gegenstand des vorliegenden Beitrags ist die Entwicklungstheorie von Paul Alsberg (1883-1965) und deren Prinzip der Körperausschaltung. Erkenntnisleitend ist die Frage, wohin diese Ausschaltung führt, wenn sie realisiert wird. Ein Szenario, das – so die hier vertretene These – das vollzogene Prinzip der Körperausschaltung mit den Mitteln des ästhetischen Ausdrucks thematisiert, ist der Film Matrix (1999). In diesem Sinne wird zuerst Alsberg und dessen Werk vorgestellt. Anschließend folgt eine kurze Einführung in seine Theorie der menschlichen Entwicklung durch Körperausschaltung in ihren (...) wesentlichen Gesichtspunkten. Darauf basierend werden durch die Brille dieser anthropologischen Theorie des Menschen als Mängelwesen einzelne, die Thematik des Films Matrix konstituierende Aspekte beleuchtet. (shrink)

In this paper, we explore how the development and affordances of predictive analytics may impact how teachers and other educational actors think about and teach students and, more broadly, how society understands education. Our particular focus is on the data dashboards of learning support systems which are based on Machine Learning. While previous research has focused on how these systems produce credible knowledge, we explore here how they also produce compelling, persuasive and convincing narratives. Our main argument is that particular (...) kinds of stories are written by predictive analytics and written into their data dashboards. Based on a case study of a leading predictive analytics system, we explore how data dashboards imply causality between the ‘facts’ they are visualising. To do so, we analyse the stories they tell according to their spatial and temporal dimensions, characters and events, sequentiality as well as tellability. In the stories we identify, teachers are managers, students are at greater or lesser risk, and students’ sociality is reduced to machine-readable interactions. Overall, only data marked as individual behaviours becomes relevant to the system, rendering structural inequalities invisible. Reflecting on the implications of these systems, we suggest ways in which the uptake of these systems can interrupt such stories and reshape them in other directions. (shrink)

Applying the framework of ecological rationality, the authors studied the adaptivity of group decision making. In detail, they investigated whether groups apply decision strategies conditional on their composition in terms of task‐relevant features. The authors focused on the recognition heuristic, so the task‐relevant features were the validity of the group members' recognition and knowledge, which influenced the potential performance of group strategies. Forty‐three three‐member groups performed an inference task in which they had to infer which of two German companies had (...) the higher market capitalization. Results based on the choice data support the hypothesis that groups adaptively apply the strategy that leads to the highest theoretically achievable performance. Time constraints had no effect on strategy use but did have an effect on the proportions of different types of arguments. Possible mechanisms underlying the adaptive use of recognition in group decision making are discussed. (shrink)

Child sexual exploitation and abuse has grave implications for the mental health and wellbeing of children and young people. It has been linked to a wide range of difficulties which may extend into adulthood. School-based prevention programs that aim to raise awareness are popular, however, have historically lacked robust and consistent evaluation. The purpose of the present study was therefore to explore young people’s experiences of attending a school-based theater-in-education program, and the impact this had on their awareness and understanding (...) of CSEA. Four focus groups of between four to six participants each were conducted with young people from two co-educational State schools in the United Kingdom. The approach of Template Analysis was used to analyze the data, and revealed a number of themes related to the superordinate themes of “Information and Detail Delivered” and “Format and Timing.” The results suggest that participants gained new awareness and understanding of aspects related to CSEA, including other forms of exploitation, as well as how to avoid harm and what to do “if bad things happen.” Participants further reported that the theater performance/live element of the program was particularly impactful, feeling that this was delivered to them at the right time, but suggesting that younger people would also benefit from the important messages. In addition, areas for improvement were identified in terms of the delivery of the program, and the issue of victim blaming. Findings are discussed with a view to practical implications and directions for future research. (shrink)

In this title, new and established scholars demonstrate the application of feminism in a range of academic disciplines including history, philosophy, politics, and sociology.

This study presents the evaluation of a computer-based learning program for children with developmental dyscalculia and focuses on factors affecting individual responsiveness. The adaptive training program Calcularis 2.0 has been developed according to current neuro-cognitive theory of numerical cognition. It aims to automatize number representations, supports the formation and access to the mental number line and trains arithmetic operations as well as arithmetic fact knowledge in expanding number ranges. Sixty-seven children with developmental dyscalculia from second to fifth grade (mean age (...) 8.96 years) were randomly assigned to one of two groups (Calcularis group, waiting control group). Training duration comprised a minimum of 42 training sessions à 20 minutes within a maximum period of 13 weeks. Compared to the waiting control group, children of the Calcularis group demonstrated a higher benefit in arithmetic operations and number line estimation. These improvements were shown to be stable after a 3-months post training interval. In addition, this study examines which predictors accounted for training improvements. Results indicate that this self-directed training was especially beneficial for children with low math anxiety scores and without an additional reading and/or spelling disorder. In conclusion, Calcularis 2.0 supports children with developmental dyscalculia to improve their arithmetical abilities and their mental number line representation. However, it is relevant to further adapt the setting to the individual circumstances. (shrink)

In the postgenomic era, interactions between organism and environment are central in disciplines such as epigenetics, medical physiology, and immunology. Particularly in the more "applied" medical fields, an emphasis lies on interactions of the organism with other organisms, that is, other living things. There is, however, a growing amount of research investigating the impact of abiotic triggers on the immune system. While the distinction between biota and abiota features heavily in other contexts, its status is not explicit within immunology. Do (...) immunologists distinguish living from nonliving triggers? In this article, I will carve out whether and in which ways the biotic/abiotic distinction operates in immunology. I will look into responses to biotic and abiotic stressors in plant and invertebrate model species and ask how and why they are conceptually separated. I will trace the reasons by investigating the disciplinary situatedness of immune phenomena and the import of vertebrate immunology when conceptualizing immune responses in other model organisms. I will then investigate how the convergence of biotic and abiotic stress responses in plants and invertebrates adds to the recent philosophical programs advocating an ecological perspective on immune systems. In his insightful review, Eugene V. Koonin discusses various aspects of CRISPR-Cas systems with a strong focus on their qualities as "adaptive immune systems". The CRISPR-Cas system is most famous for its application as a gene-editing tool. Koonin provides a deeper insight into its biological function in bacteria, which is to immunize the cell against parasite DNA. I shall comment on one issue discussed in the text, in two steps. First, I shall elaborate on CRISPR-Cas systems and their supposed Lamarckian (...) character. Criteria for calling biological phenomena genuinely Lamarckian will be narrowed down and then applied to the CRISPR-Cas system, considering interference-driven spacer acquisition as an instantiation of a truly Lamarckian paradigm. Second, I shall consider whether Lamarckian and "canonical" instances of inheritance are a case of theoretical pluralism, being two non-reducible, yet interconnected paradigms. (shrink)

ABSTRACTOrganization and management researchers praise the value of care in the workplace. However, they overlook the conflict between caring for work and for coworkers, which resonates with the dilemma of care allocation highlighted by ethicists of care. Through an in-depth qualitative study of two organizations, we examine how this dilemma is confronted in everyday organizational life. We draw on the concept of boundary work to explain how employees negotiate the boundary of their caring responsibilities in ways that grants or denies (...) care to coworkers. We argue that the possibility of an ethics of care for coworkers requires boundary work that suspends the separation of personal and professional selves and constitutes the worker as a whole person. We contribute to research on care in organizations by showing how care for coworkers may be enabled or undermined by maintaining or suppressing the care allocation dilemma. (shrink)

Fundamental disagreement is at the core of many debates surrounding epistemic relativism. Proponents of epistemic relativism argue that certain disagreements are irresolvable because proponents base their views on fundamentally different epistemic principles and, thus, fundamentally different epistemic systems. Critics of epistemic relativism argue that this analysis is wrong since the particular epistemic principles in question are most of the time derived from or instances of the same, more basic, epistemic principle. With regard to the individuation of epistemic systems, there is, (...) thus, an impasse within the epistemic relativism literature. It is the aim of this article to employ the recently developed notion of ‘situated judgments’ as well as the concepts of ‘world-traveling’ and ‘epistemic friction’ to provide an epistemic agent-based, dynamic account of disagreeing and thereby also contribute to the question of how to individuate an epistemic system. In recent years, immune systems have sparked considerable interest within the philosophy of science. One issue that has received increased attention is whether other phyla besides vertebrates display an adaptive immune system. Particularly the discovery of CRISPR-Cas9-based systems has triggered a discussion about how to classify adaptive immune systems. One question that has not been addressed yet is the transgenerational aspect of the CRISPR-Cas9-based response. If immunity is acquired and inherited, how to distinguish evolutionary from immunological adaptation? To shed light (...) on this issue and obtain conceptual clarity, I will investigate the inheritance of small RNA responses to pathogens in the nematode C. elegans as a further potential instantiation of a transgenerational adaptive immune system. I will explore how to make sense of systems that lie at the crossroads between genetic, immunological, and evolutionary spheres and explore the consequences of a transgenerational perspective on immune systems for immunology and its philosophy. Jackendoff defends a mentalist approach to semantics that investigates conceptual structures in the mind/brain and their interfaces with other structures, including specifically linguistic structures responsible for syntactic and phonological competence. He contrasts this approach with one that seeks to characterize the intentional relations between expressions and objects in the world. The latter, he argues, cannot be reconciled with mentalism. He objects in particular that intentionality cannot be naturalized and that the relevant notion of object is suspect. Este artigo tem por objetiva geral descrever a linguagem musical sob a perspectiva da teoria histórico-cultural, conforme Vygotsky, seu principal representante. Neste sentido, procura-se também entender o conceito de mediação, como elemento articulador entre linguagem musical e o fenômeno pedagógico, produzido nos enredos intersubjetivos de professores e alunos. Nessa perspectiva, e com as contribuições da Base Nacional Comum Curricular (BNCC), que integra a música no ensino de Arte, identifica-se a relevância da linguagem musical na formação cidadã de estudantes da Educação (...) Básica. O presente estudo se caracteriza como uma pesquisa bibliográfica, amparada em obras originais de Vygotsky e de outros autores que escrevem a respeito da temática em questão, para embasamento aprofundado. Constatou-se que a música, enquanto linguagem, é dinâmica cujas habilidades e ações, construídas socialmente, são mediadas na interação professor-aluno. Portanto, a leitura que se faz da música, enquanto linguagem, não pode prescindir do caráter histórico-cultural, subjacente a toda e qualquer manifestação cultural. (shrink)

The paper demonstrates that dependency-based syntax is in a strong position to produce principled and economical accounts of the syntax of constructs. The difficulty that constituency-based syntax has in this regard is that very many constructs fail to qualify as constituents. The point is evident with the box diagrams and attribute value matrices (AVMs) that some construction grammars (CxGs) use to formalize constructions; these schemata often represent fragments rather than constituents. In dependency-based syntax in contrast, constructions are catenae, whereby a (...) catena is a chain of words linked together by dependencies. The catena is a novel but well-defined unit of syntax associated with dependency grammar (DG). The constructs of CxGs are more amenable to analyses in terms of the catenae of dependency-based syntax than to analyses in terms of the constituents of constituency-based syntax. (shrink)

Forrest and Gross expose the scientific failure, the religious essence, and the political ambitions of "intelligent design" creationism. They examine the movement's "Wedge Strategy," which has advanced and is succeeding through public relations rather than through scientific research. Analyzing the content and character of "intelligent design theory," they highlight its threat to public education and to the separation of church and state.

How is admiration different from adoration? We provided one answer to this question by examining the pathways through which admiration and adoration linked to self-expansion in a questionnaire and an experimental (autobiographical recall of emotion episodes) study. Both emotions were associated with increased potential efficacy to accomplish goals (i.e., self-expansion), but different action tendencies accounted for these links. While our emotion inductions did not successfully distinguish between admiration and adoration, we could statistically disentangle their effects through mediator models. In both (...) studies, self-reported admiration linked to self-expansion through the tendency to emulate admired others. Adoration related to self-expansion through the tendency to affiliate with adored others. These findings were obtained after controlling for other emotions in response to the target person (awe, love, hope, benign envy) and mutuality of the relationship. Our findings also suggest that considering specific emotions (rather than undifferentiated positive affect) helps uncover different pathways to self-expansion. (shrink)
