The paper's thesis is that dialogue is not an adequate model for all types of argument. The position of Walton is taken as the contrary view. The paper provides a set of descriptions of dialogues in which arguments feature in the order of the increasing complexity of the argument presentation at each turn of the dialogue, and argues that when arguments of great complexity are traded, the exchanges between arguers are turns of a dialogue only in an extended or metaphorical (...) sense. It argues that many of the properties of engaged back-and-forth exchanges of paradigmatic argument dialogues are not found in ‘solo’ arguments, and that at least some of the norms appropriate to the former type of argument, such as some of the pragma-dialectical rules of van Eemeren and Grootendorst's model, do not apply to the latter. Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers a sustained (...) and vigorous critique of utilitarian assumptions, arguments and ideals. He finds inadequate the theory of action implied by utilitarianism, and he argues that utilitarianism fails to engage at a serious level with the real problems of moral and political philosophy, and fails to make sense of notions such as integrity, or even human happiness itself. This book should be of interest to welfare economists, political scientists and decision-theorists. (shrink)

The question, “What norms are appropriate for the evaluation of the probative merits of visual arguments?” underlies the investigation of this paper. The notions of argument and of multimodal visual argument employed in the study are explained. Then four multimodal visual arguments are analyzed and their probative merits assessed. It turns out to be possible to judge these qualities using the same criteria that apply to verbally expressed arguments. Since the sample is small and not claimed to be representative, this (...) finding can at best be regarded as suggestive for the probative assessment of multimodal visual arguments in general. Premissary relevance is a property of arguments understood as speech act complexes. It is explicable in terms of the idea of a premise's lending support to a conclusion. Premissary relevance is a function of premises belonging to a set which authoritatively warrants an inference to a conclusion. An authoritative inference warrant will have associated with it a conditional proposition which is true— that is to say, which can be justified. The study of the Aristotelian doctrine of topoi or argument schemes (...) may contribute to the task of identifying authoritative warrants. (shrink)

Informal logic began in the 1970s as a critique of then-current theoretical assumptions in the teaching of argument analysis and evaluation in philosophy departments in the U.S. and Canada. The last 35 years have seen significant developments in informal logic and critical thinking theory. The paper is a pilot study of the influence of these advances in theory on what is taught in courses on argument analysis and critical thinking in U.S. and Canadian philosophy departments. Its finding, provisional and much-qualified, (...) is that the theoretical developments and refinements have had limited impact on instruction in leading philosophy departments. (shrink)

State of nature theories have a long history and play a lively role in contemporary work. Theories of this kind share certain nontrivial commitments. Among these are commitments to inclusion of a Lockean proviso among the principles of justice and to an assumption of invariance of political principles across changes of circumstances. In this article I want to look at those two commitments and bring to light what I believe are some important difficulties they engender. For nonpattern state of nature (...) theories, the justness of a society is marked by the conformance of the society to procedural principles. Distributions of resources and the like have no particular import for questions of justice. Whatever may later result, so long as it came about in accordance with the rules determined by the principles of justice, is itself just. The Lockean proviso is one of the principles of justice governing property and other rights of nonpattern theories of justice. The proviso hangs as a "shadow" over the results of the operation of the other (usual) principles of justice. It is intended to remedy a complaint which arises when the positions of those no longer at liberty to use some resource are worsened (1) by no longer being able to use freely what they previously were free to use and (2) in such a way that they fall below a "baseline." Following Locke, a traditional formulation of the proviso is to allow acquisition just so long as there is "enough and as good" left over for others. Section I concerns the relation of the Lockean proviso to pattern and nonpattern principles of justice, demonstrating that a Lockean proviso turns a nonpattern into a pattern theory of justice. Section II is about the relation of the Lockean proviso to the ideas revealed by an examination of a state of nature, suggesting reasons to reject ideal theories of justice. (shrink)

According to a received doctrine, espoused, by Karl Popper and Harry Collins, and taken for granted by many others, poorly replicated evidence should be epistemically defective and incapable of persuading scientists to accept the views it is used to argue for. But John Hughlings Jackson used poorly replicated clinical and post-mortem evidence to mount rationally compelling and influential arguments for a highly progressive theory of the organization of the brain and its functions. This paper sets out a number of Jackson's (...) arguments from his evidence and argues that they constitute a counter example against the received doctrine. (shrink)

Are there any logical norms for argument evaluation besides soundness and inductive strength? The paper will look at several concepts or models introduced over the years, including those of Wisdom, Toulmin, Wellman, Rescher, defeasible reasoning proponents and Walton to consider whether there is common ground among them that supplies an alternative to deductive validity and inductive strength.

The meaning of valid proxy consent for children has recently been the subject of an important debate between Richard McCormick and Paul Ramsey on the ethics of experimenting with children. Ramsey is willing to agree with McCormick that parental consent for a child to undergo some medical procedure is valid only if parents consider what the child would consent to if he could. But beyond this, Ramsey has a fundamentally different conception of the child from McCormick, and therefore gives a (...) very different interpretation to this standard for valid proxy consent. In Ramsey's view, McCormick's basic mistake is to think of the child as a small adult, thereby overlooking the child's peculiar vulnerabilities and needs. In particular, McCormick fails to attend to the child's needs for "preservation in life and healthful growth". In this paper, the author pursues Ramsey's suggestion that a correct analysis of valid proxy consent for children would replace the "language of consent" with the "language of need". He does this by sketching a theory of parenthood that rests on two central notions: that of primary goods, as found in the writing of John Rawls, and that of autonomy. (shrink)

This paper is a commentary on the articles by William Rehg and Robert Asen in this issue of Informal Logic. It compares the subject matter of the two papers, offers an interpretation of and commentary on each paper separately, then discusses their overlapping problematic: the importance of public sphere argumentation.

This essay considers the nature of duties incumbent on legislators in virtue of the office itself. I argue that there is no duty for a legislator to enact a criminal law based on morality; there is no duty to incorporate substantive moral conditions into the criminal law; and there is therefore no duty derivable from the nature of the legislative office itself to make conditions of culpability depend on those of moral responsibility. Finally, I argue that the relation between morality (...) and the criminal law is therefore much less direct than assumed in most theories of the criminal law. (shrink)

The paper argues that argument and argumentation deserve philosophical attention but do not receive it, and proposes some explanations. It then asks whether there is a field of philosophy, “philosophy of argument,” that might attract philosophers’ attention. A case is made that such a field exists. However, challenges to that case seriously undermine it. Thus those who want philosophers to pay more attention to argument must find other ways to make their case.

When the Soviet Union fell in 1990, three of its 15 components, the Baltic States, joined the European Union, and a fourth, Moldova, may well join in the future. The other 11 quickly became presidential republics, following the lead given by Boris Yeltsin, the president of the largest among them, Russia. By 1994, all 11 were headed by a president elected by universal suffrage. These ex-Soviet countries contribute significantly to the number of presidential republics in the world. Presidential republics form (...) a clear majority, being predominant in Latin America and Africa, alongside the ex-Soviet Union. They are rare in Europe, the main cases being France, Romania, and, though seemingly temporarily, some Balkan states; in Asia, outside the ex-Soviet Union, they are a small minority. (shrink)

Perforation or gap formation in a vegetation is a major process in landscape transformation. The occurrence of gaps profoundly alters the microclimatical conditions in a vegetation. A method is proposed to quantify perforation by using the three main 2-D characteristics of the gaps: area, number and boundary length. New measures are developed by normalizing the observed values to the reference status of minimum and maximum perforation. As minimum perforation status, the presence of one single gap with area equal to the (...) map resolution is assumed. The new measures are combined using a 3-D Euclidean distance to visualize the process and to detect changes. The method is exemplified using a field case of gaps in a tropical terra firme rainforest at Tiputini, Ecuador. (shrink)

Norman Kretzmann's recent analysis of the natural lawslogan ``lex iniusta non est lex'' (an unjust law is nota law) demonstrates the coherence of the slogan andmakes a case for its practical value, but I shallargue that it also ends up showing that the sloganfails to mark any interesting conceptual or practicaldivision between natural law and legal positivistviews about the nature of law. I argue that this is ahappy result. The non-est-lex slogan has been used toexaggerate the extent of disagreement about (...) the natureof law and has diverted critics of natural law theoryfrom recognizing that the main disagreement betweennatural lawyers and legal positivists centres ontheories of practical reason and how they affect ourunderstanding of the relationship between law andmorality. This extends the debate about the nature oflaw somewhat beyond the traditional boundaries ofphilosophy of law, but these boundaries are due inpart to the diversion created by debate over thenon-est-lex slogan. Recognizing that the non-est-lexslogan fails on its own to mark any interestingpractical or conceptual division between natural lawtheories and legal positivism should therefore focusand encourage debate on matters of genuine substancebetween these outlooks. The disagreement, however, mayturn out to be primarily metaphysical and explanatoryand not normative in nature. (shrink)
