Objective: To explore the relationship between the presentation of suffering and support for euthanasia in the British news media.Method: Data was retrieved by searching the British newspaper database LexisNexis from 1996 to 2000. Twenty-nine articles covering three cases of family assisted suicide were found. Presentations of suffering were analysed employing Heidegger’s distinction between technological ordering and poetic revealing.Findings: With few exceptions, the press constructed the complex terrain of FAS as an orderly or orderable performance. This was enabled by containing the (...) contradictions of FAS through a number of journalistic strategies: treating degenerative dying as an aberrant condition, smoothing over botched attempts, locating the object of ethical evaluation in persons, not contexts, abbreviating the decision making process, constructing community consensus and marginalising opposing views.Conclusion: The findings of this study support the view that news reporting of FAS is not neutral or inconsequential. In particular, those reports presenting FAS as an orderly, rational performance were biased in favor of technical solutions by way of the legalisation of euthanasia and/or the involvement of medical professionals. In contrast, while news reports sensitive to contradiction did not necessarily oppose euthanasia, they were less inclined to overtly support technical solutions, recognising the importance of a trial to address the complexity of FAS. As natural language processing tools powered by big data become increasingly ubiquitous, questions of how to design, develop, and manage these tools and their impacts on diverse populations are pressing. We propose utilizing the concept of linguistic justice—the realization of equitable access to social and political life regardless of language—to provide a framework for examining natural language processing tools that learn from and use human language data. To support linguistic justice, we argue that natural language processing tools must be examined (...) not only from the perspective of a privileged, majority language user, but also from the perspectives of minoritized language users. Considering such perspectives can help to surface areas in which the data used within natural language processing tools may be working against linguistic justice by failing to provide access to information, services, or opportunities in users’ language of choice, underperforming for certain linguistic groups, or advancing harmful stereotypes that can lead to negative life outcomes for members of marginalized groups. At the same time, this framework can help to illuminate ways that these shortcomings can be addressed and allow us to use inclusive language data and approaches to leverage natural language processing technologies that advance linguistic justice. As modern deep networks become more complex, and get closer to human‐like capabilities in certain domains, the question arises as to how the representations and decision rules they learn compare to the ones in humans. In this work, we study representations of sentences in one such artificial system for natural language processing. We first present a diagnostic test dataset to examine the degree of abstract composable structure represented. Analyzing performance on these diagnostic tests indicates a lack of systematicity in representations (...) and decision rules, and reveals a set of heuristic strategies. We then investigate the effect of training distribution on learning these heuristic strategies, and we study changes in these representations with various augmentations to the training set. Our results reveal parallels to the analogous representations in people. We find that these systems can learn abstract rules and generalize them to new contexts under certain circumstances—similar to human zero‐shot reasoning. However, we also note some shortcomings in this generalization behavior—similar to human judgment errors like belief bias. Studying these parallels suggests new ways to understand psychological phenomena in humans as well as informs best strategies for building artificial intelligence with human‐like language understanding. F. A. Hayek has had great influence upon recent political thought. Though he presents no organized account of Bentham his many references, mostly uncomplimentary, create the impression that Bentham's presentation was characteristically ‘crudely expressed’ and ‘naive’, and that Benthamite constructivism has been a major threat to individual liberty and a precursor of totalitarian social control. While Hayek has made a valuable contribution to the study of political ideas, this caricature has probably discouraged his readers from studying Bentham. It will be (...) argued, however, that Bentham and Hayek share much common ground, and that an appreciation of the ways in which Bentham's position differs from Hayek's may contribute to a useful critique of Hayek's system. Psychologists and neuroscientists extensively rely on computational models for studying and analyzing the human mind. Traditionally, such computational models have been hand-designed by expert researchers. Two prominent examples are cognitive architectures and Bayesian models of cognition. While the former requires the specification of a fixed set of computational structures and a definition of how these structures interact with each other, the latter necessitates the commitment to a particular prior and a likelihood function which – in combination with Bayes’ rule – (...) determine the model's behavior. In recent years, a new framework has established itself as a promising tool for building models of human cognition: the framework of meta-learning. In contrast to the previously mentioned model classes, meta-learned models acquire their inductive biases from experience, i.e., by repeatedly interacting with an environment. However, a coherent research program around meta-learned models of cognition is still missing to this day. The purpose of this article is to synthesize previous work in this field and establish such a research program. We accomplish this by pointing out that meta-learning can be used to construct Bayes-optimal learning algorithms, allowing us to draw strong connections to the rational analysis of cognition. We then discuss several advantages of the meta-learning framework over traditional methods and reexamine prior work in the context of these new insights. (shrink)

However, as Ericsson, Chase, and Faloon (1980) showed, this is not true for digit‐span experts and, as we show, it is certainly not true for Tetris players at any level of expertise. Although some people may simply “twitch” faster than others, the limit to Tetris expertise is not raw keypress time but the (...) techniques acquired by players that allow them to use the tools provided by the hardware and software to compensate for the game's relentlessly increasing drop speed. Unfortunately, these increases in drop speed between Tetris levels make performance plateaus very short and quickly followed by game death. Hence, a player's success at discovering, exploring, and practicing new techniques for the tasks of board preparation, board maintenance, optimal placement discovery, zoid rotation, lateral movement of zoids, and other tasks important to expertise in Tetris is limited. In this paper, we analyze data collected from 492 Tetris players to reveal the challenges they confronted while constructing expertise via the discovery of new techniques for gameplay at increasingly difficult levels of Tetris. This book delves deep into the Social Construction of Theory, comparative epistemology and intellectual history to stress the interrelationship between diverse cultures during the colonial period and bring forth convincing evidence of how the 19th century was shaped. It approaches an interesting relation between the linguistic studies of 19th century’s scientific world and subsequent widespread acceptance of the empirically weak theory of the Aryan invasion. To show entangled history in a globalized world, the book draws on the Aryan Invasion Theory (...) to highlight how different socio-religious parties commonly shape a new theory. It also explores how research is affected by the so-called social construction of theory and comparative epistemology, and deals with scholarly advancement and its relation with contemporary socio-political demands. A hypertext learner navigates with a instinctive feeling for a knowledge. The learner does not know her queries, although she has a feeling for them. A learner’s navigation appears as complete upon the emergence of an aesthetic pleasure, called rasa. The order of arrival or the associational logic and even the temporal order are not relevant to this emergence. The completeness of aesthetics is important. The learner does not look for the intention of the writer, neither does she look for (...) significance. Lexia has a suggestive power and she is suggested in the arrival of aesthetics. Hypertext learning does not depend on communication. The learner in her pleasure transgresses the bounds of space-time to be in communion with several writers/learners. Hypertext learning does not appear to be fundamentally different from the analog learning; however, in performance, as in navigation, the learner assumes a mental state that helps her in her emergence into aesthetic bliss, of an arrival to the completed lexial navigation. Contemporary democracy has given primacy to thought. Building up institutions on thought and reasoned discourse excludes out human actions derived not from thought that one thinks. Ordinary life is visited by emotion and passion. Such actions of unknown origin are captured best in the drama. Indian theory and practice of drama and the poetics offer communion between the performer and the viewer. Blissful relish of the actions and the dialogues lift up the banal actions from the ordinary to a state (...) beyond simple event. Relishing thus resides in cognition. Drama in theory and in its practice thus offers foundation to institutions that could embrace independent actions as well. In relish there is cognition and reasoning alone cannot lay claim. This paper addresses questions of women’s autonomy in India and analyses its location within the legal discourse. The women’s movement has primarily tried to analyse questions of women’s autonomy through exploring women’s position in law. Among other indicators, women’s position in society is often analysed through marriage, divorce and property acts. This paper analyses the evolution of these acts and critiques whether they have led to women’s autonomy or merely subsumed questions of autonomy resulting in further marginalization of women in (...) the polity. The paper begins with the assumption that locations matter and that laws affect different women differently, particularly in the context of India where civil law is constantly pitted against personal and customary law. To understand the situation of women in India, therefore, an understanding of the evolution of laws seems necessary, because laws are considered to be primary markers of autonomy. (shrink)

The collapse of the wavefunction is arguably the least understood process in quantum mechanics. A plethora of ideas—macro-micro divide, many worlds and even consciousness—have been put forth to resolve the issue. Contrary to the standard Copenhagen interpretation, objective collapse models modify the Schrödinger equation with nonlinear and stochastic terms in order to explain the collapse of the wavefunction. In this paper we propose a collapse model in which a particle’s wavefunction has a possibility of collapsing when it interacts with macroscopic (...) objects, without the intervention of a conscious observer. This article investigates the contribution of white liberal politics of an ex-missionary New Zealander, Sir Reginald Stephen Garfield Todd, on the development of Southern Rhodesia towards becoming an independent state. It outlines the contribution he made towards the progress of black Zimbabweans in a number of spheres. It arouses interest in contemporary Zimbabwean religious and political discourses. Todd held a hybridity of roles in transitional politics from the blunting settler racism to the sharpening of African capability on multi-racial democracy important (...) for our debate on the decolonisation of southern Africa. He was a rhetorically gifted radical paternalist who adopted reformist policies to advance both the African cause and his prophetic vocation. He suggested technocratic solutions that could reorganise and diversify political and economic options.CONTRIBUTION: This study uses critical discourse analysis on the wider literature on Todd's biography and African policies in view of his Christian vocation towards changing conditions of socio-economic, political-religious and technological-technocratic solutions to contemporary African independence. He was a man of his times living and working in an increasingly problematic context guided by the Christian principles in which he was reared. He is the 'father of faith' in the Church of Christ in Zimbabwe, and leaves us pedagogical lessons on human security, gender equality, church governance and human well-being that require review within the contemporary Christian fraternity. HIV remission clinical researchers are increasingly seeking study participants who are diagnosed and treated during acute HIV infection—the brief period between infection and the point when the body creates detectable HIV antibodies. This earliest stage of infection is often marked by flu-like illness and may be an especially tumultuous period of confusion, guilt, anger, and uncertainty. Such experiences may present added ethical challenges for HIV research recruitment, participation, and retention. The purpose of this paper is to identify potential ethical challenges (...) associated with involving acutely diagnosed people living with HIV in remission research and considerations for how to mitigate them. We identify three domains of potential ethical concern for clinicians, researchers, and ethics committee members to consider: 1) Recruitment and informed consent; (2) Transmission risks and partner protection; and (3) Ancillary and continuing care. We discuss each of these domains with the aim of inspiring further work to advance the ethical conduct of HIV remission research. For example, experiences of confusion and uncertainty regarding illness and diagnosis during acute HIV infection may complicate informed consent procedures in studies that seek to recruit directly after diagnosis. To address this, it may be appropriate to use staged re-consent procedures or comprehension assessment. Responsible conduct of research requires a broad understanding of acute HIV infection that encompasses its biomedical, psychological, social, and behavioral dimensions. We argue that the lived experience of acute HIV infection may introduce ethical concerns that researchers and reviewers should address during study design and ethical approval. (shrink)

AimRapid eye movement (REM) sleep, non-rapid eye movement (NREM) sleep, and sleep spindles are all implicated in the consolidation of procedural memories. Relative contributions of sleep stages and sleep spindles were previously shown to depend on individual differences in task processing. However, no studies to our knowledge have focused on individual differences in experience with Vipassana meditation as related to sleep. Vipassana meditation is a form of mental training that enhances proprioceptive and somatic awareness and alters attentional style. The goal (...) of this study was to examine a potential role for Vipassana meditation experience in sleep-dependent procedural memory consolidation.MethodsGroups of Vipassana meditation practitioners (N = 22) and matched meditation-naïve controls (N = 20) slept for a daytime nap in the laboratory. Before and after the nap they completed a procedural task on the Wii Fit balance platform.ResultsMeditators performed slightly better on the task before the nap, but the two groups improved similarly after sleep. The groups showed different patterns of sleep-dependent procedural memory consolidation: in meditators, task learning was positively correlated with density of slow occipital spindles, while in controls task improvement was positively associated with time in REM sleep. Two algebraic structures, the contrapositionally complemented Heyting algebra (ccHa) and the contrapositionally |$\vee $| complemented Heyting algebra (c|$\vee $|cHa), are studied. The salient feature of these algebras is that there are two negations, one intuitionistic and another minimal in nature, along with a condition connecting the two operators. Properties of these algebras are discussed, examples are given and comparisons are made with relevant algebras. Intuitionistic Logic with Minimal Negation (ILM) corresponding to ccHas and its extension |${\textrm {ILM}}$|-|${\vee }$| for c|$\vee (...) $|cHas are then investigated. Besides its relations with intuitionistic and minimal logics, ILM is observed to be related to Peirce’s logic and Vakarelov’s logic MIN. With a focus on properties of the two negations, relational semantics for ILM and |${\textrm {ILM}}$|-|${\vee }$| are obtained with respect to four classes of frames, and inter-translations between the classes preserving truth and validity are provided. ILM and |${\textrm {ILM}}$|-|${\vee }$| are shown to have the finite model property with respect to these classes of frames and proved to be decidable. Extracting features of the two negations in the algebras, a further investigation is made, following logical studies of negations that define the operators independently of the binary operator of implication. Using Dunn’s logical framework for the purpose, two logics |$K_{im}$| and |$K_{im-{\vee }}$| are discussed, where the language does not include implication. The |$K_{im}$|-algebras are reducts of ccHas and are different from relevant algebraic structures having two negations. The negations in the |$K_{im}$|-algebras and |$K_{im-{\vee }}$|-algebras are shown to occupy distinct positions in an enhanced form of Dunn’s kite of negations. Relational semantics for |$K_{im}$| and |$K_{im-{\vee }}$| is provided by a class of frames that are based on Dunn’s compatibility frames. It is observed that this class coincides with one of the four classes giving the relational semantics for ILM and |${\textrm {ILM}}$|-|${\vee }$|⁠. (shrink)

We highlight how Corporate Social Responsibility can be strategically used against the negative perception from earnings management. Using international data, we analyse the effect of CSR and EM on the cost of capital and corporate reputation. Results confirm that CSR strategy is positively valued by investors and other stakeholders. Contrary to EM, CSR has a positive effect on corporate reputation and lowers the cost of capital. In addition, we also find that the favourable effect of CSR on cost of capital (...) is consistently more intense in firms that show signs of EM indicating that the market does not identify when CSR practices are used as a strategy to mask EM. We also demonstrate how institutional factors influence the above relationship. (shrink)

Despite increasing pressure to deal with climate change, firms have been slow to respond with effective action. This article presents a multi-level framework for a better understanding of why many firms are failing to reduce their absolute greenhouse gas emissions, which contribute to climate change. The concepts of short-termism and uncertainty avoidance from research in psychology, sociology, and organization theory can explain the phenomenon of organizational inaction on climate change. Antecedents related to short-termism and uncertainty avoidance reinforce one another at (...) three levels—individual, organizational, and institutional—and result in organizational inaction on climate change. The article also discusses the implications of this multi-level framework for research on corporate sustainability. (shrink)

In this article I provide a critical perspective on governing the global corporation. While the papers in the 2009 special issue of Business Ethics Quarterly explore the political role of corporations I argue that they lack a sophisticated analysis of power acrossinstitutional and actor networks. The argument that corporate engagement with deliberative democracy can enhance the legitimacy of corporations does not take into account the effects of institutional, material and discursive forms of power that determine legitimacycriteria. As a result corporate (...) versions of citizenship mediate versions of social responsibility and morality, which are reflected in the institutional and political economic norms that are produced by this power/knowledge. In order to overcome the limits of corporate social responsibility there is a need to develop more democratic forms of global governance of corporations. A radical revisioning of democratic governance would also need to overcome the limits posed by sovereignty and would require new forms of multi-actor and multi-level translocal governance arrangements in an attempt to create forms of power that are more compatible with the principles of economic democracy. Previous research with adults suggests that a catalog of minimally counterintuitive concepts, which underlies supernatural or religious concepts, may constitute a cognitive optimum and is therefore cognitively encoded and culturally transmitted more successfully than either entirely intuitive concepts or maximally counterintuitive concepts. This study examines whether children's concept recall similarly is sensitive to the degree of conceptual counterintuitiveness (operationalized as a concept's number of ontological domain violations) for items presented in the context of a fictional narrative. Seven- to nine-year-old children (...) who listened to a story including both intuitive and counterintuitive concepts recalled the counterintuitive concepts containing one (Experiment 1) or two (Experiment 2), but not three (Experiment 3), violations of intuitive ontological expectations significantly more and in greater detail than the intuitive concepts, both immediately after hearing the story and 1 week later. We conclude that one or two violations of expectation may be a cognitive optimum for children: They are more inferentially rich and therefore more memorable, whereas three or more violations diminish memorability for target concepts. These results suggest that the cognitive bias for minimally counterintuitive ideas is present and active early in human development, near the start of formal religious instruction. This finding supports a growing literature suggesting that diverse, early-emerging, evolved psychological biases predispose humans to hold and perform religious beliefs and practices whose primary form and content is not derived from arbitrary custom or the social environment alone. A structural theorem for Kleene algebras is proved, showing that an element of a Kleene algebra can be looked upon as an ordered pair of sets, and that negation with the Kleene property is describable by the set-theoretic complement. The propositional logic \ of Kleene algebras is shown to be sound and complete with respect to a 3-valued and a rough set semantics. It is also established that Kleene negation can be considered as a modal operator, due to a perp (...) semantics of \. Moreover, another representation of Kleene algebras is obtained in the class of complex algebras of compatibility frames. Purpose Cyberbullying occurs when a minor is tormented, threatened, harassed, humiliated, embarrassed or otherwise targeted by another child. Given that cyberbullying entails defamation or spreading false information or portfolios about someone, it is regarded as a violation of the ethical code of information use. The purpose of the study was to explore the perceptions, experiences and challenges of post-high school youth with regards to cyberbullying. This is a quantitative study that used a survey approach to gather data using a self-administered (...) questionnaire, which was distributed to 60 youth from the KwaZulu-Natal computer literacy community engagement project. The findings attest that youth recognise that cyberbullying might have detrimental effects on victims, such as alcohol and drugs abuse, low self-esteem, high level of absenteeism, poor grades and depression and suicidal thoughts. There is a low percentage of victims and perpetrators of cyberbullying in rural contexts in South Africa. It is hoped that findings may will a positive impact in the rural communities and enable the youth to interact with the modern technologies and handle them in an ethical manner. The study recommends that parents need to take cognisance of the probable possible dangers of the various technologies so that they could be instrumental in educating their children about children cyberbullying. Further, the schools and the Department of Education can play a fundamental role in educating children about cyberbullying and cyber ethics. Design/methodology/approach This survey was conducted to explore youth perceptions and experiences, as well as violations, of ethics through cyberbullying as experienced by the rural community at Mbazwana in the North Coast of KwaZulu-Natal. Convenience sampling was used, because although the questionnaire was distributed to all 60 participants in the project, not all of them completed the instrument, as participation was voluntary. Only 43 were completed, which is equal to 72 per cent response rate. The validity of the data collection instrument used was enhanced by the fact that questions were derived from the main objective of the study. Some themes of the instrument were self-designed and others were adapted from a similar study by Dehue et al., who looked at cyberbullying experiences of youth. The instrument was tried out in a pilot study in grade 12 classes in two high schools at Mbazwana in a bid to find out whether the learners would understand the questionnaire. Post-high school learners were considered to be at a similar level as the grade 12 learners polled. The pilot study proved its own importance: students who filled in the questionnaire indicated that they were not familiar with some terms and the researchers had to simplify the language to make it more understandable. Findings A large portion of the youth studied indicated that they used their smartphones to access the internet, 25 per cent identified libraries as their source of access to the internet and 13 per cent reported accessing the internet from community laboratories. In total, 13 per cent of respondents reported accessing the internet from friends’ computers. Last, the smallest proportion at 4 per cent reported having internet access via their home desktop computers. The South African Mobile Report reveals that a great majority of South Africans access the internet via their own smartphones. These findings might indicate that many people nowadays do indeed have internet access in their regions. Research limitations/implications The results of this study indicate that not all households own a desktop computer, as some people rely on community laboratories and others rely on friends who own desktop or laptop computers. Practical implications The study results reveal that most students who did the computer literacy course consider themselves at an “intermediate” level. It was noted that cellphones/smartphones play a significant role in gaining access to the internet and to social networking applications in rural communities. The social media applications most visited by youth in this study were shown to be Facebook and WhatsApp. Only a relatively low percentage of the respondents in this study in a rural context in South Africa reported being either victims or perpetrators of cyberbullying. Social implications Social media give people ample opportunities to interact and socialise with other people in global context. It is hoped that insights gained from these findings may have a positive effect in the rural communities if awareness programmes are put in place to enable the youth to interact with the modern technologies and handle them in an ethical manner. Originality/value The contribution to the world of knowledge is that this study gives a clear indication of experiences and perceptions of cyberbullying in rural areas in South Africa. This will inform other scholars who want to engage in similar studies in different contexts that can be compared with the results of this study. It is notable that one cannot predict one’s own knowledge of a certain aspect of a community until one has fully engaged in research. Research on moral psychology has frequently appealed to three, apparently consistent patterns: Males are more likely to engage in transgressions involving harm than females; educated people are likely to be more thorough in their moral deliberations because they have better resources for rationally navigating and evaluating complex information; political affiliations and religious ideologies are an important source of our moral principles. Here, we provide a test of how four factors ‐ gender, education, politics and religion ‐ affect intuitive moral judgments (...) in unfamiliar situations. Using a large-scale sample of participants who voluntarily logged on to the internet-based Moral Sense Test, we analyzed responses to 145 unique moral and conventional scenarios that varied widely in content. Although each demographic or cultural factor sometimes yielded a statistically significant difference in the predicted direction, these differences were consistently associated with extremely small effect sizes. We conclude that gender, education, politics and religion are likely to be relatively insignificant for moral judgments of unfamiliar scenarios. We discuss these results in light of current debates concerning the mechanisms underlying our moral judgments and, especially, the idea that we share a universal moral sense that constrains the range of cross-cultural variation. The study investigated postgraduate students’ knowledge of plagiarism, forms of plagiarism they commit, the reasons they commit plagiarism and actions taken against postgraduate students who plagiarise at Mzuzu University in Malawi. The study adopted a mixed methods approach. The quantitative data were collected by distributing questionnaires to postgraduate students and academic staff whereas qualitative data were collected by conducting follow-up interviews with some academics, an assistant registrar and assistant librarian. The study found that despite students reporting that they had a (...) conceptual understanding of plagiarism, the majority of them reported that they had intentionally and unintentionally committed plagiarism, mainly due to pressure for good grades (86.7%), laziness and poor time management (84.9%), and lack of good academic writing skills (84.9%). The study also established that prevalent forms of plagiarism admitted (by students) and reported (by academic staff) to have been committed included lack of proper acknowledgement after paraphrasing (69.8%), summarising (64.1%) and using quotation marks (56.6%). The study further found that the common sanctions applied by academics include giving a warning and asking the student to re-write the plagiarised work. The study recommends that Mzuzu University should carry out awareness campaigns about the negative effects of plagiarism, targeting postgraduate students; and should introduce advanced academic writing skills training for postgraduate students. AbstractIn this paper I provide a decolonial critique of received knowledge about deliberative democracy. Legacies of colonialism have generally been overlooked in theories of democracy. These omissions challenge several key assumptions of deliberative democracy. I argue that deliberative democracy does not travel well outside Western sites and its key assumptions begin to unravel in the ‘developing’ regions of the world. The context for a decolonial critique of deliberative democracy is the ongoing violent conflicts over resource extraction in the former colonies (...) of Africa, Asia and Latin America. I argue that deliberative democracy cannot take into account the needs of marginalized stakeholders who are defending their lands and livelihoods. The paper contributes to the literature by (1) offering a critique of hegemonic models of democracy that cannot address issues of inequality and colonial difference and (2) offering possibilities to imagine counterhegemonic alternatives for a democratization of democracy from below. Almaatouq et al. propose an “integrative approach” to increase the generalisability and commensurability of experiments. Yet their metascientific approach has one glaring omission (and misinterpretation of) – the role of sample diversity in generalisability. In this commentary, we challenge false notions of subsumed duality between contexts, population, and diversity, and propose modifications to their design space to accommodate sample diversity.

The importance of overt levers of business political influence, notably campaign donations and lobbying, has been overemphasized. Using executive branch policymaking during the Obama administration as a case study, this article shows that those paths of influence are often not the most important. It places special emphasis on the structural power that large banks and corporations wield by virtue of their control over the flow of capital and the consequent effects on employment levels, credit availability, prices, and tax collection. At (...) times, business disinvestment, combined with demands for government policy reforms, constitutes a conscious “capital strike,” which has the potential to shape political appointments, legislation, and policy implementation. At other times, the threat of disinvestment, the hint of a drop in “business confidence,” or rhetoric about job creation is sufficient to achieve those objectives. The present analysis has important implications for our understanding of political power and social change in capitalist economies. (shrink)

In this article, we examine the shifting roles played by non-state actors in governing areas of limited statehood. In particular, we focus on the emergence of voluntary grassroots organizations in Palestine and describe how regimes of international development aid transformed these organizations into professional nongovernmental organizations (NGOs) that created new forms of colonial control. Based on in-depth interviews with 145 NGO members and key stakeholders and a historical analysis of limited statehood in Palestine, we found that social relations became disembedded (...) from the local context and re-embedded in new relations with international donor organizations resulting in a depoliticized public sphere. NGOization of the economy also resulted in new forms of exclusion and inclusion as well as contestations between a new class of urban middle-class professionals working in NGOs and the older generation of activists who were involved in grassroots organizations. Our findings have implications for business and human rights and governance in areas of limited statehood, in particular how private actors such as NGOs are able to exercise power in the economy. Modelling that exploits visual elements and information visualisation are important areas that have contributed immensely to understanding and the computerisation advancements in many domains and yet remain unexplored for the benefit of the law and legal practice. This paper investigates the challenge of modelling and expressing structures and processes in legislation and the law by using visual modelling and information visualisation (InfoVis) to assist accessibility of legal knowledge, practice and knowledge formalisation as a basis for legal AI. The paper uses (...) a subset of the well-defined Unified Modelling Language (UML) to visually express the structure and process of the legislation and the law to create visual flow diagrams called lawmaps, which form the basis of further formalisation. A lawmap development methodology is presented and evaluated by creating a set of lawmaps for the practice of conveyancing and the Landlords and Tenants Act 1954 of the United Kingdom. This paper is the first of a new breed of preliminary solutions capable of application across all aspects, from legislation to practice; and capable of accelerating development of legal AI. (shrink)
