It is widely acknowledged that categories play significant roles in the appreciation of artworks. This paper argues that the correct categories of artworks are institutionally established through social processes. Section 1 examines the candidates for determining correct categories and proposes that this question should shift the focus from category membership to appreciative behaviour associated with categories. Section 2 draws on Francesco Guala’s theory of institutions to show that categories of artworks are established as rules-in-equilibrium. Over the last decade, scandals within the UK Financial Service sector have impacted their legitimacy and raised questions whether a compliance culture exists or not. Several institutional changes at the regulatory and normative levels have targeted stakeholders’ concerns regarding compliance culture and led to changes in the legitimation process. This paper attempts to address a gap in the literature by asking the following question: How is the UK financial institutions’ compliance culture shaped by the institutional environment and changing (...) legitimacy claims? Towards achieving this objective, the paper draws on the institutional theory and pays attention to the various configurations of the legitimacy notion :451–478; 2017). The paper utilises a longitudinal interpretive design and undertakes a qualitative content analysis of fines issued by the UK regulator and the communicated response of violating firms as well as non-sanctioned firms. Our findings indicate that there is a cyclical ‘evolutionary compliance’ rather than the more widely recognised state of ‘compliance culture’. This culture is fuelled by interchangeable isomorphic forces where the majority of violating firms are seen to issue similar responses to the regulators sanction to maintain their reputation and legitimacy in the market. Notably, legitimacy is now defined within an interactive process between the regulator and firms rather than being static and achieved by ticking the box. (shrink)

In 1987 Jerrold Levinson wrote, in a review of George Dickie's _The Art Circle_, that in reading it he felt 'caught in a kind of aesthetic time warp'. I had the same feeling, and indeed have the same feeling when I read papers published since on Dickie's theory. A recent criticism in this journal by Oswald Hanfling is a case in point. To be fair, Hanfling explicit states that he is discussing the 1974 version of the theory rather (...) than Dickie's current views. However, this weakens the paper as a contribution to the current debate. Dickie no longer advocates the 1974 theory, as opposed to the 1984 version. Hanfling also directs most of his argument against the second disjunct of that definition, largely ignoring the first. furthermore, following recent work on the theory by others, Dickie's theory has become a more protean creature than Hanfling suppose. Criticism are rarely decisive; what works against one version of the theory is ineffective against another. In this paper I will argue that the theory as standardly conceived can be broken down into two logically independent parts. Once this is done, the objections current in the literature are not decisive. I will then attempt to evaluate what I take to be the improved version. (shrink)

One cannot ignore the institutions that surround art if one wants to deliver a theory of art acknowledging that art lives through a community of social relationships and assumes meaning as such. I make the claim that the evolution of sports from mere play, survival, and diversion toward the global phenomenon of modern sports can likewise be understood as a function of social connectivity. In "Convention and Dickie's Institutional Theory" (British Journal of Aesthetics 1980), Catherine Lord maintains the following thesis: (L) If a work of art is defined as institutional and conventional, then the definition precludes the freedom and creativity associated with art. Lord also maintains that the antecedent of this conditional is false. In this note, I argue that (i) certain confusions and assumptions prevent Lord from showing the antecedent is false, and (ii) even if the antecedent is assumed (...) to be true, there are counterexamples to the entire conditional. With regard to (ii), I will suggest that conventionality is necessary for creativity. Once affirmed that a formal and finalistic theory of action is one of the four pillars of neo‐institutionalism, the author introduces the concept of Freedom of action, which is based on two points: the empirical existence of a scope for action and an information process which determine the choice between alternative actions. He then analyzes different versions of determinism and the distinction between descriptive and practical sentences, and concludes that a theory of action based on the information process (...) has to deal with the structures of teleological thought. It is somewhat ironic that this book comes out in the centenary of Political Theology, first published in 1922. In the end, one of the main claims we shall make here is that Carl Schmitt's celebrated essay has been unduly overemphasised and that it formulated a theory of law and a conception of normality that he himself dismantled a few years after its publication. A related claim will be that interpretations that identify a connection between Political Theology and successive (...) works such as The Concept of the Political (1928) and Constitutional Theory (1928) are wrong in at least one important respect: through those works, Schmitt tried to pull himself out of the quagmire in which he was bogged down in 1922, viz., the problematic conception that we shall dub "exceptionalist decisionism." But we shall have to go further. Works that are coeval with Political Theology, such as Dictatorship (1921) and Roman Catholicism and Political Form (1923), offer much leeway for criticising exceptionalist decisionism, either because the notions of exception and decision are thinner and more tenable (as is the case with Dictatorship), or because there is no room at all for any of them (as is the case with Roman Catholicism and Political Form). In sum, as a celebration of Political Theology, this book cuts a poor figure. (shrink)

In this paper, I will look at the relationship between Weitz’s claim that art is an “open” concept and Dickie’s institutional theory of art, in its most recent form. Dickie’s theory has been extensively discussed, and often criticized, in the literature on aesthetics, yet it has rarely been observed – to my knowledge at least – that the fact that his theory actually incorporates, at least to some extent, Weitz’s claim about the “openness” of the concept (...) of art, precisely accounts for what I take to be the main flaws in the theory. In what follows I present arguments for that claim, looking briefly at the position of both authors with respect to the concept of art, then showing how they relate to each other, and what implications this has for Dickie’s institutional theory, and more generally for the traditional project of characterising art. The topic of the article is George Dickie’s institutional theory of art as one of contemporary art theories which purport to answer the “what is art?” question by defining the concept of art in terms of its necessary and sufficient conditions. Introductory part of the article brings a brief review of so-called functionalist theories, as well as of their shortcomings when compared to theories to which institutional theory belongs. Also included is a short survey of theories (...) and arguments that significantly influenced institutional theory, e.g. Danto’s “theory of meaning”. Next are presented the basics of the institutional theory. It is shown that advantages of this theory over other functionalist theories became especially visible after the appearance of art practices of the 20th century which rendered the difference between artistic and non-artistic objects extremely complex. I investigate contemporary Russia's real, but shallow success in implementing two borrowed capitalist institutions—a monetary system and the joint-stock company. Even though money and shares of stock in Russia are exchanged in voluntary transactions, they fail to play the legal roles ordinarily expected of them, resulting in weak corporate governance and nonmonetary exchange. Via a criticism of game-theoretic approaches to institutions in the New Institutional Economics, I argue that the roots of this shallow marketization lie in the distinct social (...) foundations of the transactional and legal roles of money and corporate stock. Arguments drawn from sociological institutionalism then illuminate why Russia displays this limited isomorphism to authoritative international models of market institutions. The article concludes by discussing implications for a third body of institutional theory, historical institutionalism, and the possible broader relevance of the pattern of shallow marketization in contemporary relatively backward countries. The essay shows how strategic maneuvering shifts the burden of proof within institutional relations.

ABSTRACT:We examine the practice of nepotism in the Arab World and analyze how a rational-legal model of bureaucracy was never able to take hold. We draw upon ideas from institutional theory and related notions of legitimacy to provide an explanation of nepotism’s extraordinary persistence. Then we use arguments to speculate how the appearance of institutional entrepreneurs who are advocates for a new hybrid form of nepotism might begin to colonize a social space created by larger political and (...) economic changes that are sweeping the Arab World. Those entrepreneurs must persuade other members of an extended family that the current practice of nepotism is typically destructive of a firm’s competitive performance. In addition, they will argue that nepotism as currently practiced violates teachings of Islam. This second argument is likely to be particularly effective with an audience that sees Islam as a source of universal notions of justice and fairness. (shrink)

Gegenwärtige Entwicklungen des Kunstmarkts fordern die institutionelle Theorie von Kunst heraus, da es zunehmend fraglich erscheint, dass ›die Kunstwelt‹ – das Kernstück der institutionellen Theorie – noch von einem tiefgehenden Kunstverständnis anstatt von ökonomischen Interessen geleitet wird. Da die institutionelle Theorie ›die Kunstwelt‹ an sich sehr vage definiert, könnte diese auch wirtschaftlich orientierte Sammlerinnen und Galeristen einschließen. Wenn der monetäre Wert (...) von Kunst aber die treibende Kraft für die Erschaffung von Kunst ist, stellt sich die Frage, wie dies die Kunstwelt als Institution, die darüber entscheidet, ob etwas als Kunst gelten kann, beeinflusst. Um diese Frage zu beantworten, werde ich mich mit neuesten Entwicklungen der zeitgenössischen Kunstwelt auseinandersetzen, da diese es erfordern, die institutionelle Theorie so zu modifizieren, dass sie auf gegenwärtige Phänomene anwendbar ist. Als Ausblick werde ich vorschlagen, dass David Humes allgemeiner Maßstab für das Geschmacksurteil zur Entwicklung eines Maßstabs für das kuratorische Urteil beitragen könnte. Sustainable development is often framed as a social issue to which corporations should pay attention because it offers both opportunities and challenges. Through the use of institutional theory and the resource-based view of the firm, we shed some light on why, more than 20 years after sustainable development was first introduced, we see neither the adoption of this business model as dominant nor its converse, that is the total abandonment of the model as unworkable and unprofitable. We focus (...) on multinational corporations (MNCs) because they were among the organizations first called to take action. In order to illustrate the institutional pressures MNCs face and their strategic response to these pressures, we analysed four major oil and gas multinationals subject to similar sustainable development pressures – climate change, biodiversity, renewable energy development and social investment. We argue that normative and coercive isomorphism does not occur at the global level because sustainable development is largely a stakeholder-driven rather than a broad social pressure. That is, host country interpretation of sustainable development pressures varies across an MNC’s subsidiary network. Based on the analysis of the four major MNCs’ annual reports from 2000 to 2005, we argue that mimetic isomorphism may occur, but since it implies the use of complex and intangible resources, mimetic processes are slow, rare and discretionary. Institutional economics and discourse theory stand unconnected next to each other, in spite of the fact that they both ask for the legitimacy of institutions (normative) and the functioning and effectiveness of institutions (positive). Both use as theoretical constructions rational individuals and the concept of consensus for legitimacy. Whereas discourse theory emphasizes the conditions of a legitimate consensus and could thus enable institutional economics to escape the infinite regress of judging a consensus legitimate, institutional economics (...) has a tested social science paradigm (rational choice) of explaining and predicting the functioning of institutions. The article outlines a theoretical synthesis of the two theories by finding points in common and possibilities of fruitful combinations concerning the problem of legitimacy, institutional design and effectiveness of legal norms. ABSTRACT:Reports of widespread misconduct in organizations have become sadly commonplace. Sexual abuse in the Catholic Church, accounting fraud in large corporations, and physical and sexual harassment in the military implicate not only the individuals involved, but the organizations and fields in which they happened. In this paper we describe such situations as instances of “moral collapse” and develop a multi-level theory of moral collapse that draws on institutional theory as its central orienting lens. We draw on (...) class='Hi'>institutional theory because of its explicit concern with the relationships among individual beliefs and actions, the organizations within which they occur, and the collective social structures in which norms, rules and beliefs are anchored. Our theory of moral collapse has two main elements. First, we argue that morality in organizations is embedded in nested systems of individuals, organizations and moral communities in which ideology and regulation flow “down” from moral communities through organizations to individuals, and moral ideas and influence flow “upward” from individuals through organizations to moral communities. Second, we argue that moral collapse is associated with breakdowns in these flows, and explore conditions under which such breakdowns are likely to occur. (shrink)

Social innovations are urgently needed as we confront complex social problems. As these social problems feature substantial interdependencies among multiple systems and actors, developing and implementing innovative solutions involve the re-negotiating of settled institutions or the building of new ones. In this introductory article, we introduce a stylized three-cycle model highlighting the institutional nature of social innovation efforts. The model conceptualizes social innovation processes as the product of agentic, relational, and situated dynamics in three interrelated cycles that operate at (...) the micro, meso, and macro levels of analysis. The five papers included in this special issue address one or more of these cycles. We draw on these papers and the model to stimulate and offer guidance to future conversations on social innovations from an institutional theory perspective. (shrink)

I summarize seven general trends in the institutional analysis of organizations which I view as constructive and provide evidence of progress in the development of this perspective. I emphasize corrections in early theoretical limitations as well as improvements in the use of empirical indicators and an expansion of the types of organizations included and issues addressed by institutional theorists.
