Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında burada tartışma konusu yapılan hadisler haberî sıfatları konu alan ve müşkil nitelikte olan rivayetlerden oluşmaktadır. Bu rivayetleri genelde Bişr el-Merîsî ve taraftarlarının tecsîm ve teşbîh içerdiği iddiasıyla münker kabul ettikleri görülmektedir. Ehl-i re’y özellikleri taşımakla birlikte ilahî sıfatlar konusunda Mu’tezilî bir anlayışa sahip olduklarından tenzih anlayışları gereği sıfatları reddetmektedirler. Yaratılmışlara ait niteliklerin yaratıcıya nisbet edilmesini tenzîh anlayışlarına aykırı gördüklerinden bu tür müşkil rivayetleri ya kendi anlayışları doğrultusunda te’vîl ya da reddettikleri gözlenmektedir. Sert bir (...) ehl-i hadîs âlimi olan Osman ed-Dârimî ise, ayet ve hadislerde bildirilen ilahî sıfatlara iman edilmesi gerektiğini kabul etmektedir. Bu anlayışı sebebiyle bu rivayetlerde bildirilen haberî sıfatlara da te’vîl etmeksizin lafzî anlamıyla yaklaşmakta; kendi görüşü doğrultusunda Bişr el-Merîsî ve taraftarlarının yaptığı te’vîlleri reddetmekte, bu te’vîllerin ta’tîle yol açacağını ileri sürmektedir. Bu rivayetlerin lafzî (literal) anlamları doğrultusunda anlaşılması gerektiğini savunmaktadır. Bu hadisler üzerinde yapılan tartışmalar, temel hadis eserlerinin yazıldığı dönemde Ehl-i re’y ve Ehl-i hadîs ekollerine mensup âlimlerin hadislere yaklaşımlarını göstermesi bakımından önem arzetmektedir. Burada vermiş olduğumuz hadisler üzerindeki tartışmalar bu iki ekolün uluhiyet anlayışını, haberî sıfatlara yaklaşımlarını ortaya koyduğu gibi bunların genel anlamda hadis perspektifi hakkında bizlere bilgi vermektedir.ÖzetBu araştırma, temel hadis kitaplarının yazıldığı dönemde, yani III./IX asırda, haberî sıfatlar ihtiva eden bazı hadisler üzerinde yapılan tartışmaları ele almaktadır. Tartışma Osman ed-Dârimî (ö. 280/894) ile Bişr el-Merîsî’nin (ö. 218/833) taraftarları arasında geçmektedir. Hadisler üzerinde Ehl-i hadîs ile Ehl-i re’y mensubu âlimler arasında gerçekleşen bu tartışmalar bir yönüyle hadislerin anlaşılması ve yorumlanmasını ilgilendirmektedir. Tartışmanın, burada ele alınan hadislerin nasıl anlaşılması gerektiği; lafızların kelime anlamı mı (literal) yoksa bu lafızların ötesindeki muhtemel mecazî anlamları dikkate alınarak mı anlaşılması gerektiği noktasında odaklandığı söylenebilir. İnceleme konusu yapılan hadisleri tartışan tarafları kısaca tanıtmak yerinde olacaktır. Sözünü ettiğimiz rivayetlerle ilgili tartışmalar Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında geçmektedir. Ehl-i hadîs’in önemli simalarından biri olan Osman ed-Dârimî, hadislerle ilgili bu tartışmaları içeren ayrı bir eser yazmıştır. Bu eser, Allah’ın sıfatları ve bazı hadis meseleleri konusunda Bişr el-Merîsî ve onun iki talebesinin görüşlerine reddiye olarak yazılmıştır. Bişr el-Merîsî, Ebû Yusuf’tan (ö. 182/798) fıkıh tahsil etmiş, önemli bir kelâmcı olarak tanınmıştır. O, kelâmla ilgili konularda aralarında İmâm Şâfiî’nin (ö. 204/820) de bulunduğu pek çok âlimle ilmî tartışmalar yapmış bir ehl-i re’y âlimdir. Halife Me’mûn’un (ö. 218/833) danışma meclisinde bulunmuş, Kur’ân’ın yaratılmışlığı (Halku’l-Kur’ân) görüşünün benimsenmesinde önemli payı olmuştur. Osman ed-Dârimî ise, Yahyâ b. Ma’în (ö. 233/848), Ali b. Medînî (ö. 234/848-49), İshâk b. Râhûye (ö. 238/853) ve Ahmed b. Hanbel (ö. 241/855) gibi döneminin otoritelerinden hadis öğrenmiş bir ehl-i hadîs âlimidir. Hadis tahsili için önemli bütün şehirleri dolaşarak hadis öğrenmiş ve rivayette bulunmuştur.Haberi sıfatları ispat ve bunlarla ilgili rivayetlerin teviline karşı çıkan anlayış ile, bu rivayetlerin tenzih anlayışına uygun biçimde tevilini savunan kesimler ilk dönemden itibaren eserler telif etmişlerdir. Osman ed-Dârimî’ye göre, ehl-i hadîs’in eleştiri edebiyatının ortaya çıkmasında, Mu’tezile’nin ilahî sıfatları reddetmesi etkili olmuş ve pek çok müellif bu yönde eserler yazmışlardır. Ebû Hüreyre’den nakledilen bir rivayetle ilgili olarak muârız, bu rivayetin Allah için bildiğimiz göz ve kulak organlarından oluştuğu izlenimi verildiğini söyler. Osman ed-Dârimî, bu hadisin göz ve kulak organlarını değil görme ve işitmeyi ispat ettiğini söyler. Hiçbir konuda Allah’ın benzerinin bulunmadığını belirtir. Dolayısıyla Allah’ın organlardan oluştuğu iddiasını ehl-i hadîs’e nisbet etmek iftiradır. Ebû Dâvûd, bu hadis ile Allah için görme ve işitme sıfatlarının ispat edildiğini ve Cehmiyye’nin ilahî sıfatları inkar görüşüne reddiye olduğunu belirtir. Ebû Hüreyre’in Hz. Peygamber’e nispet ederek naklettiği: "İman Yemenlidir, hikmet Yemenlidir! Ben Rabbi’nizin nefesini Yemen tarafından hissediyorum!" rivayetini de muârız münker kabul etmiştir. Çünkü Bişr el-Merîsî ve ashâbına göre nefes ancak karın boşluğu olanlardan çıkar, Allah ise bundan münezzehtir. Osman ed-Dârimî’ye göre, muârız yanlış anlamıştır. Burada kastedilen, Yemen tarafından esen ve insanı rahatlatan rüzgardır. Bu rivayet bağlamında bakıldığında, Bişr el-Merîsî taraftarlarının rivayeti literal değerlendirdiğini, Osman ed-Dârimî’nin ise rivayeti yorumladığını görmekteyiz. İbnü’s-Selcî, "Siz, Allah’a ondan çıkandan (Kur’ân’dan) daha faziletli bir şeyle yaklaşamazsınız!" rivayeti hakkında, Müşebbihe’nin bunu, karın boşluğu olan, kendisinden kelâm çıkan şeklinde anladıklarını belirtir. Allah boşluğu olmayan anlamında "samed" olduğundan bu anlayış geçersizdir. Bu hadisle, Kur’ân’ın Allah’tan değil O’nun katından çıkması kastedilmiştir. Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin asıl maksadı Allah’ın kelâm sıfatını inkâr etmektir. Kur’ân’ın O’ndan çıktığında bir şüphe yoktur, bunu sadece kelâm sıfatını kabul etmeyenler inkâr etmektedir. İbn Abbâs’a atfedilen; "Rükn (Hacerülesved) yeryüzünde Allah’ın sağ elidir, halk ile onunla musafaha eder" rivayetinde geçen "yemînullah" (Allah’ın sağ eli) sözünün anlamı, İbnü’s-Selcî’ye göre bildiğimiz sağ el değil, Allah’ın nimeti ve ikrâmıdır. Hacerülesved ile elin kastedilmediğini kabul eden Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin maksadı, geçersiz te’villerle Allah hakkında ayet ve hadislerde belirtilen iki eli inkar etmektir. İbn Abbâs’ın Hz. Peygamber’den naklettiği başka bir rivayeti İbnü’s-Selcî’nin eserine alıp nakletmesini eleştiren Osman ed-Dârimî, bu tür zayıf rivayetlerin yayılmaması gerektiğini söyler. Buna ilave olarak İbnü’s-Selcî’nin yaptığı yorumun da çirkin olduğunu belirtir ve eleştirir. Çünkü sözü edilen rivayette Allah, yeşil bir takım elbise giymiş kıvırcık saçlı bir genç olarak tasvir edilmektedir. Böyle bir rivayet Hz. Peygamber’den gelen sahih rivayetlerle çeliştiği için de güvenilmez bir rivayettir. Rivayetle ilgili bu değerlendirmeyi yapan Osman ed-Dârimî, rivayet hakkında muârızın yaptığı yorumları da reddeder. Muârıza göre, "Rabbimin yanına girdim" sözü, "Adn cennetinde Rabbimin huzuruna girdim" demektir. Osman ed-Dârimî’ye göre bu gibi müşkil (problemli) hadisler re’y ile tefsir edilmemeli, rivayet edilip bırakılmalıdır. Hz. Peygamber’e dayandırılan ve Allah’ın kendisine geldiğinden bahisle cevabını bilemediği bazı sorulan sorduğundan, sonra Rabbinin elini sırtına koymasıyla parmaklarının serinliğini hissettiğinden ve her şeyi öğrendiğinden bahseden rivayetle ilgili olarak muarız şu değerlendirmede bulunur: Allah Resûlü’ne gelen Rabbi değil güzel suretli bir melekti, o melek Allah tarafından yönledrilmekteydi ve elini koyan da o melekti. Osman ed-Dârimî, muârızın bu yorumunu reddeder. Bu yorum aynı zamanda diğer sahih hadislere de aykırıdır. Osman ed-Dârimî, sözkonusu rivayet hakkında muârızın yorumunu reddettikten sonra zikrettiği sahih rivayetlere dayanarak buna güvenilemiyeceğini ifade etmiştir. İlahî sıfatlar hakkında konuşmak en zor konular arasında görüldüğünden, selef âlimleri bu konuda susmayı tercih etmişlerdir. Ancak sonraki nesiller bu konuda farklı yollar tutmuşlardır. İlahi sıfatları anlama konusundaki temel yaklaşımları tefvîz, teşbîh ve te’vîl şeklinde üç ana başlıkta toplamak mümkündür. Tefvîz, selef alimlerinin benimsediği yol olup, Allah’ın zâtı ve sıfatlarının mahiyetine ilişkin bilgiyi ilâhî ilme havale etmek demektir. Teşbîh, Allah’ı yaratılmışlara veya yaratılmışları Allah’a benzetmek anlamına gelir. Te’vil, Allah’ın yaratılmışlara benzediği izlenimini veren ayet ve hadisleri dil bilimi ve aklî bilgilerle yorumlamaktır. Sıfatları inkar edenlere Muattıla denilmiş, sıfatları ispat edenler Sıfâtiyye diye anılmıştır. Ehl-i re’y’e göre Allah’a atfedilen ve sözlük anlamı bakımından teşbîh ve tecsîm izlenimi veren sıfatları uygun biçimde te’vil etmek gerekir. İlâhî sıfatlarda Mu’tezile tenzihi öne çıkarmış, Eş’ariyye ve Mâtürîdiyye ise tenzihe uygun te’vili benimsemiştir. Müşebbihe, Vehhâbî-Selefî anlayış da ilahî sıfatlardaki lafızları zahiri anlamlarıyla almışlardır. Hadis ilminde en önemli temel eserlerin telif edildiği II./VIII. ve III./IX. asırda yaşamış olan âlimler arasında cereyan eden inceleme konusu yaptığımız tartışma, ilk döneme ait olması bakımından önemlidir. Bunun yanında tartışma, âyet ve hadislerden oluşan naslara yaklaşımda, iki temel yaklaşımı göstermesi bakımından da önemli bilgiler ihtiva etmektedir. Bu iki temel yaklaşımdan biri ehl-i re’y ekolünü, diğeri ise Ehl-i hadîs anlayışını temsil etmektedir. Osman ed-Dârimî genel olarak rivayetin lafzına bağlı kalmayı savunmakta, Bişr el-Merîsî ve ashâbı ise münker olduğu gerekçesiyle rivayeti eleştirmekte ya da te’vil etmektedir. Nadir de olsa Osman ed-Dârimî’nin rivayeti ret ya da te’vil ettiği, Bişr el-Merîsî ve ashâbının ise rivayeti savunduğu yerler de görülebilmektedir. Müteşâbih (problemli) rivayetler hakkında Bişr el-Merîsî’nin yaptığı te’viller sonraki âlimler üzerinde etkili olmuştur. Onun te’villeri, Cübbâî (ö. 303/916), Kādî Abdülcebbâr (ö. 415/1025), Ebü’l-Hüseyin el-Basrî (ö. 436/1044) gibi Mu’tezilî âlimlerin yanı sıra, İbn Fûrek, Gazâlî (ö.505/1111), İbn Akîl (ö. 513/1119), Fahreddîn er-Râzî (ö. 606/1210) gibi sünnî âlimler tarafından da iktibâs edilmiştir. Rivayete dayalı olan hadis ilminde hakikatin ortaya konulabilmesi, "rivayet" ve "re’y" seçeneklerinden birini tercih etmekle değil; bunların her ikisini de yerinde ve dengeli olarak kullanılmasına bağlı olduğunu hatırda tutmak gerekir. Hadiths that have been discussed in this paper consist of narrations regarding divine attributes and having some problematic meanings between supporters of Bişr al-Marīsī and ʿUthmān al-Dārimī. These narrations were mostly accepted denounced (munkar) by Bişr al-Marīsī and his sopporters due to having an anthropormophist and corporealist content about God. They rejected divine attributes according to their understanding of God based on incomparability (tanzīh) which provided by Mutazilite approach towards divine attributes even though they conveyed some features of Ahl al-Ra’y. (...) They found contradicted of attributing human features to God based on their tanzīh understanding, therefore, they interpreted such this kind of narra-tions in terms of their approach or rejected at all. At the other hand, a hard Hadith scholar Uth-man al-Darimi believed that one should accept divine attributes as they are in the Qur’an and Sunna. According to his belief, he considered the explicit meanings of the narrations without interpretation of divine attributes, and based on his perpective he denied Bişr al-Marīsī and his supporters’ interpretations claiming they would cause divesting God of all attributes (ta‘tīl). He argues that these narrations should be taken into considerations based on their explicit mea-nings. The discussions on these hadiths are important due to showing different approaches of scholars from the schools of Ahl al-Ra’y and the ones from Ahl al-Hadith towards the hadith du-ring the period when the main Hadith works were collected. Discussions on the narrations stu-died in this paper reveal two schools’ understandings of divine issues, their approaches to divi-ne attributes, as well inform us their perspectives of hadith in general.Summary: The present paper examines the debates between ʿUthmān al-Dārimī (d. 280/894) and the supporters of Bishr al-Marīsī (d. 218/833) on the divine attributes mentioned in some hadiths in the period when the main hadith books were composed (i.e., III/IXth century). These debates that took place between the scholars of Ahl al-Hadith and Ahl al-Ra’y concern the un-derstanding and interpretation of the hadiths in a certain way.It could be stated that the debates focus on how the hadiths should be understood, or whether it is the explicit meaning of the words or the possible methaphorical meanings beyond them that should be considered.It is worth briefly introducing the parties who discussed the hadiths studied here. The aforementioned discussions about some hadith narrations are between the supporters of Bishr al-Marīsī and ʿUthmān al-Dārimī, one of the important figures of the Ahl al-Hadith who wrote a separate work on these hadiths. This work was written as a rejection of the views of Bishr al-Marīsī and his two students on the attributes of God and some issues regarding hadith.Bishr al-Marīsī was regarded as an important scholar of Kalam who received fiqh education from Abū Yūsuf (d. 182/798). He is a scholar of Ahl al-Ra’y who made scientific dis-cussions with many scholars including Imam al-Shafiʿī (d. 204/820). He was on the council of the Caliph Al-Mamūn (d. 218/833) and had a significant role in the adoption of the idea of the createdness of the Qurʾān (khalq al-Qurʾān).Uthmān al-Dārimī,on the other hand, was a scholar of Ahl al-Hadith who learned ha-dith from the authorities of his era such as Yaḥyā b. Maʿīn (d. 233/847), ʿAlī b. al-Madīnī (d. 234/848), Isḥāq b. Rāhawayh (d. 237/851), and Aḥmad b. Ḥanbal (d. 241/855). Having visited all the important cities for the training of hadith, he learned the hadiths and conveyed them.With the understanding of proving the divine attributes and the opposition of the misin-terpretation of the narratives related to them, the groups advocating the appropriation of these lines in accordance with the understanding of incomparability (tanzīh) have complied the works since the first period. According to ʿUthmān al-Dārimī, the rejection of the divine attributes by Mu'tazila was influential in the emergence of the criticism literature of the Ahl al-Hadith and many authors wrote works in this direction.Regarding a narration by Abū Hurayra, an opponent reports that this narration gives the impression that God has the eyes and ears as we know. ʿUthmān al-Dārimī reports that this hadith proves sight and hearing not the eyes and ear organs. He indicates that God has no like by no means. Therefore, it is slanderous to refer the claim that Allah is made of organs to the Ahl al-Hadith. Abū Dāwūd states that with this hadith the attributes of sight and hearing for God are proved and Jahmiyya’s denial of the divine attributes are rejected.The opponent also considered Abū Hurayra's narration referring to the Prophet: "Faith is from Yemen, wisdom is from Yemen! I feel the breath of your Lord from Yemen!" as denounced (munkar). Because, according to Bishr al-Marīsī and his companions, breath can only come from those with an abdominal cavity, and Allah is free from it. According to ʿUthmān al-Dārimī, the opponent misunderstood. What is meant here is the wind that blows from Yemen and comforts people. In the context of this narration, we see that supporters of Bishr al-Marīsī evaluate the narrative literally, while ʿUthmān al-Dārimī interpret the narrative.Regarding the narration, "You can not approach Allah with something more virtuous than what comes out of it (the Qur'ān)" Ibn al-Saljī reports that Mushabbiha understands this as one with an abdominal cavity and from whom speech comes out. This understanding is in-valid since God is "samad" in the sense that He has no void. With this hadith, it is meant that the Qur'ān comes out of Allah’s presence rather than Allah. According to ʿUthmān al-Dārimī, the real aim of Ibn al-Saljī is to deny God's attribute of speech. There is no doubt that the Qur'ān comes from Him, and those who do not accept it merely deny His attribute of speech.Attributed to Ibn Abbas; The meaning of "yamīn Allah" (the right hand of Allah) in narration "Black Stone (al-ḥajar al-aswad) is the right hand of Allah on earth, handshakes with the people" is not the right hand that we know according to Ibn al-Saljī, it is blessing and grace of Allah. According to ʿUthmān al-Dārimī, who acknowledges that Black Stone is not meant to be a hand, the purpose of Ibn al-Saljī is to deny the two hands mentioned in the verses and ha-diths about Allah with invalid interpretations.ʿUthmān al-Dārimī, who criticized that Ibn al-Saljī quoted from another narration which Ibn Abbās heard from the Prophet, says that such poor narrations should not be spread. In addition, he points out that Ibn al-Saljī's interpretation is ugly and he criticizes it. Because Allah who is mentioned in the narrative is depicted as a young man with curly hair in a green suit. Such a narration is also an untrustworthy narration as it contradicts the authentic narrations of the Prophet. ʿUthmān al-Dārimī, who made this assessment of the narration, rejects the com-ments that the opponent made about the narration. According to the opponent, the phrase "I have come to Allah" means "to come into the presence of Allah in the Garden of Eden." Accor-ding to ʿUthmān al-Dārimī’s understanding, such complicated hadiths should not be only narra-ted.About the narration that are based on the Prophet and he does not know the answer to what he has come to know of himself, then he feels the coolness of his fingers as he puts his hand on his back and learns everything, the opponent evaluates the following: He was not Allah who came to the Prophet, but a well-behaved angel who was being directed by Allah and he was the angel who put his hand. ʿUthmān al-Dārimī rejects this interpretation of that oppo-nent. This comment is also contrary to other authentic hadiths. After he refused to the com-ment of the opponent about relevant narration, ʿUthmān al-Dārimī stated that he could not trust this comment on the basis of the authentic narrations he mentioned.Salaf scholars have preferred to be silent in this regard, as it is seen among the most difficult subjects to talk about divine attributes. However, subsequent generations have held dif-ferent paths in this regard. The basic approaches to understanding the divine attributes can be summarized in three main titles: tafwīd, tashbīh, and ta’wīl. Tafwīd is the path adopted by the early salaf scholars and means to leaving the knowledge about Allah’s entity and attributes to His knowledge. Tashbīh means to compare Allah to the created or the created to Allah. Ta'wīl is to interpret the Qur'ānic verses and hadiths that give the impression that Allah is like the crea-tures with semantics and rational deduction. The ones who deny the adjectives are called as Muʿattila and those who prove their attributes are called as Sifatiyya. According to Ahl al-Ra’y, it is necessary to appropriately make interpretation (ta'wīl) of the attributes giving the impression of anthropomorphism in terms of the dictionary. In the divine attributes, Muʿtazila advoca-ted the incomparability (tanzīh), whereas Ashʿariyya and Māturīdiyya adopted interpretation in accordance with incomparability. Mushabbiha and the Wahhābī-Salafī understanding has also taken the expressions regarding divine attributes with their explicit meanings.The debate between the scholars who lived in the ages II/VIII and III/IX, when the most important works are composed in the science of hadith, is important in that it is the first turn. In addition to this, the debate also contains important information on the approach to the Qur'ānic verses and hadiths, in that it shows two basic approaches, one of which represents the school of Ahl al-Ra’y, and the other represents the school of Ahl al-Hadith.ʿUthmān al-Dārimī generally advocates adhering to the explicit meaning of the narra-tion, while Bishr al-Marīsī and his companions criticize the narration labeling it as denied (mun-kar) or making an interpretation. On rare occasions, the places where ʿUthmān al-Dārimī re-jects the narration and makes interpretation, or where Bishr al-Marīsī and his companions de-fend the narrative can be seen.Interpretations made by Bishr al-Marīsī on the problematic narratives have influenced on the next scholars. Alongside Muʿtazilite scholars such as al-Jubbāʾī (d. 303/916), Qāḍī ʿAbd al-Jabbār (d. 415/1024) and Abū l-Ḥusayn al-Baṣrī (d. 436/1044), his interpretations have been quoted by Sunni scholars such as al-Ghazālī (d. 505/1111), Ibn ʿAqīl (d. 513/1119) and Fakhr al-Dīn al-Rāzī (d. 606/1210).The fact that the truth can be put forward in the science of hadith, which is based on the narration, does not favor one of the "narration" and "ra’y", it should be kept in mind that both of these depend on the proper and balanced use of both. To reveal the truth, the narration is in need of the opinion and the opinion (ra’y) is in need of the narration. Narration and opinion sho-uld be seen as complementary elements, not each other's opponents. (shrink)

Bu makale Fahreddin el-Râzî’nin metafizik yakîn anlayışını te’vîl teorisi açısından incelerken, onun metafizik yakîne ulaşma hususundaki optimistik tutumunu da ortaya çıkarmaktadır. Kuşkucuların lideri (şeyhü’l-müşekkikîn) olarak da bilinen Râzî’nin, kendisinden önceki felsefe ve kelam geleneklerini etraflıca kritik ederken yeni ve özgün bir anlayış ortaya koyup koymadığı tartışılmış, eleştirel düşüncesi kendisinden sonraki düşünürlerce tenkit edilmiş ve bu vesile ile Râzî hakkında çeşitli okuma biçimleri ortaya çıkmıştır. Bu okuma biçimleri arasında Râzî’yi, aklın kelamî bilgide yakîne ulaşamayacağı şeklinde bir metafizik bilinmezci olarak değerlendirenler de (...) olmuştur. Bu çalışma, Râzî’nin metafizik yakîn anlayışını te’vîl teorisi ile birlikte serimlemeye çalışmaktadır. Makalenin ilk ana bölümü metafizik yakîn ve te’vîl ilişkisi ekseninde -başka bir deyişle kelâmî bilgide akıl-nakil tartışmaları açısından- Râzî öncesi düşünceye dair -ipuçları niteliğinde- tarihsel bağlam vermektedir. İkinci ana kısım ise Râzî’nin metafizik bilgide akıl anlayışındaki ilkelerini istivâ’ kavramının te’vîli üzerinden belirginleştirmektedir. Bu makale, Râzî’nin te’vîl anlayışını bütünüyle ortaya koymayı amaçlamamaktadır. Ancak, te’vîl teorisinin temel bileşenlerinden birisi olan akliyyâtın nasıl metafizik yakîniyyâta dönüştüğünü analiz etmektedir. Muʻtezile, akliyyât üzerinden dönüştürdüğü metafizik yakîniyyâti, dini anlama ve yorumlamada kıstas haline getirmiştir. Öte yandan metafizik yakîniyyât anlayışlarındaki iddiaları, farklı din yorumlarına karşı müsamahasız bir tavra dönüşmüş, siyasi erkle birlikte baskıcı hale gelmiş ve Muʻtezile dışı kelam düşüncelerini akılcılık -daha radikal bir ifade ile rasyonelizm- karşısında eleştirel-tepkisel olmaya sevk etmiştir. Doğal bir sonuç olarak diğer doktrinlerin rasyonel gelişimi Muʻtezilî etki yüzünden yavaşlamıştır. Makalenin birinci kısmı, Râzî öncesi Eşʻarî düşünceyi, metafizik yakîniyyât ve nass yorumu açısından değerlendirirken, yorum ve akliyyât ilişkisine dair anlayışlarındaki dakikleşmeyi Muʻtezile’nin tarihsel varlığına ters orantılı olarak ele almaktadır. Ancak Râzî’ye kadar kararsız bir şekilde gerçekleşen dakikleşme süreci, Râzî ile birlikte nihayi formuna ulaşmaktadır. Râzî’nin te’vîl teorisinin temel prensiplerinden ilki, aklın nakle esas (el-ʿakl aṣlu’l-nakl) teşkil etmesidir. Akıl, naklin yalnız ispatı ve anlaşılması bakımından değil, aynı zamanda yorumlanması (te’vîl) açısından da temel belirleyici bir unsura dönüşmektedir. Bu makale, Râzî’nin ilmi hayatının sonlarına doğru, metafizik yakîniyyâta ulaşma noktasında pesimizme düşerek, metafizik bilinmezciliğe doğru yöneldiği şeklindeki anlama biçimlerine karşı, en son eserleri arasında olan ve tamamlanmamış Tefsîr’i üzerinden cevaplar aramaktadır. Râzî, değişik zamanlarda ele aldığı eserlerinde, “naklin zanniliği” hususundaki ısrarlı duruşunu vurgulamaktadır. Bu makale Râzî’nin naklin zanniliği noktasındaki ısrarlı duruşunun, “aklın asıllığı” ilkesindeki kararlılığı ile zorunlu bir paralellik gösterdiğininin altını çizerken, metafizik yakîniyyât açısından da hala optimistik olduğunu savunmaktadır. The purpose of this research is to provide an overview of state governance for corporate social responsibility (CSR) in the countries of the Gulf Cooperation Council (GCC). A systemic literature review method is employed to collect 88 relevant publications, and a qualitative coding method is used to identify 98 governance instruments from those publications. These are grouped into 13 themes and then examined within three conceptual models. The findings reveal that most of the instruments are geared towards ethical expectations, internal (...) and external social responsibility, raising awareness, and socio‐economic development. The findings are then explored within four theories. The results suggest that CSR governance in the GCC is at a moderate to high level of bureaucratization; reflects Islamic identity, national development targets, and business accountability; is between the stages of habitualization and objectification; and relies mostly on normative pressures. Recommendations for policymakers and company managers are then presented based on these findings. (shrink)

Fractional calculus is nowadays an efficient tool in modelling many interesting nonlinear phenomena. This study investigates, in a novel way, the Ulam–Hyers and Ulam–Hyers–Rassias stability of differential equations with general conformable derivative. In our analysis, we employ some version of Banach fixed-point theory. In this way, we generalize several earlier interesting results. Two examples are given at the end to illustrate our results.

İrap Arap dili ve İslami ilimlere dair tedvin faaliyetlerinin başlangıcından bu yana önemini devam ettiren bir olgudur. Bu sebeple farklı alanları konu alan İslami ilimlerin çoğunda esas alınan unsurlardan birisi olmuştur. Bu alanlardan biri olan ve öncelikli hedefi Kur’ân’ın anlaşılmasına katkı sağlamak olan tefsirin de önemli bir parçasıdır. Zira dile ait özelliklerin tam manasıyla gözetilmesiyle ancak doğru bir tefsir faaliyetinden söz etmek mümkün olabilmektedir. Arap dilinin tefsirle ilgili en bariz özelliklerinden biri ise iraptır. Bundan dolayı her bir müfessirin tefsir yönteminde (...) irap önemli bir yer işgal etmektedir. Tefsirinde iraba önemli bir yer ayıran müfessirlerden Beyzâvî, İslam âleminde ve özellikle Osmanlı âlimleri nazarında kabul görmüş bir müfessirdir. Nitekim tefsiri; şerh, haşiye, ihtisar vb. yönlerden başka çalışmalara konu olmuştur. Ayrıca bazı tefsir çalışmaları da bu tefsir esas alınarak oluşturulmuştur. Bu çalışmada Beyzâvî ve Osmanlı dönemi âlimlerinden olan Lütfullah el-Erzurûmî’nin tefsiri, irabı ele alışları noktasında karşılaştırılmıştır. Lütfullah el-Erzurûmî’nin iraba dair görüşlerinin çoğuna Beyzâvî’nin kaynaklık ettiği, Beyzâvî ile aynı düşündüğü noktalarda onun görüşlerini özetleme, açıklama veya yorumlama yoluna gittiği görülmüştür. Bazı durumlarda ise kendisinin dile ve özellikle iraba vukufiyetini gösteren bir tarzda Beyzâvî’nin görüşlerine katılmamıştır. Bu durumda Zemahşerî, Râzî, Ebû Hayyân başta olmak üzere daha başka müfessirlerin görüşleriyle kendi görüşünü desteklemiştir. Bazı örnekler üzerinden iki müfessirin iraba dair görüşlerinin karşılaştırmalı incelemesini yapan bu çalışmada bu iki müfessirin eserlerinden başka tefsirlerinde irabın önemli bir yer işgal ettiği zikri geçen müelliflerin eserleri de konuyla ilgisi bağlamında incelenmiştir. Özet: Açıklamak ve beyan etmek anlamlarına gelen i‘râb, Arap dilinde kelimelerin sonlarındaki alametleri düzenleyerek, kelimelerin birbirleriyle irtibatlarını kuran ve bu sayede anlam değerlerini belirleyen kurallar sistemidir. Dolayısıyla i‘râb, cümlede anlam belirsizliklerini ortadan kaldırarak anlam inceliklerinin ortaya çıkmasını sağlayan ve bu sayede sözdeki derin anlamların anlaşılma yolunu kolaylaştıran bir role sahiptir. Bu yüzden i‘râb, Arap dilcilerinin yanı sıra hadis, fıkıh, kelam gibi dile ilişkin özelliklerin gözetildiği alanlarda eser veren müelliflerin de çalışmalarını dayandırdıkları temel noktalardan birisi olmuştur. Kur’ân-ı Kerîm’in tefsirinde de i‘râb başta gelen unsurlardan biri olmuştur. Nitekim i‘râb kaidelerinin konulmasındaki temel dinamik, Kur’ân’ı Kerîm’i lahn adı verilen hatalı okumalardan korumak olmuştur. Tefsirciler de Kur’ân’ı Kerîm’i anlamada i‘râbdan çokça faydalanmışlardır. Tefsîr-i Beyzâvî diye de bilinen Envâru’t-tenzîl ve esrâru’t-te’vîl adlı eserinde Kur’ân’ı anlamada i‘râb özelliklerine sıkça başvuran âlimlerden birisi meşhur tefsirci Abdullah b. Muhammed el-Beyzâvî’dir (ö. 685/1286). Bu eser ilim çevreleri tarafından kabul görmüş bir tefsirdir. Beyzâvî gibi tefsirinde i‘râbı çokça kullanan bir diğer alim Muhammed b. Lutfullah el-Erzurûmî (ö. 1202/1788) olup Göğsügür Lütfullah Efendi olarak da bilinmektedir. Osmanlı dönemi âlimlerinden olan ve birçok ilim dalında eser veren Lutfullah el-Erzurûmî’nin tefsirinin adı Râmûzu’t-tahrîr ve’t-tefsîr olup bu tefsirin dil ve i‘râb özelliklerine geniş yer ayırması sebebiyle lugavî tefsir olarak da nitelendirilmesi mümkündür. Müellif bu tefsirinde Beyzâvî’nin i‘râba dair görüşlerinden istifade etmenin yanında çoğu zaman onun görüşlerini açıklama yoluna gitmiştir. Bununla birlikte i‘râba dair mevzularda Zemahşerî, Râzî, Ebû Hayyân ve daha başka âlimlerin görüşlerinden de yararlanmıştır. Bu çalışmada Beyzâvî’nin Envâru’t-tenzîl ve esrâru’t-te’vîl’i ile Lütfullah el-Erzurûmî’nin Râmûzu’t-tahrîr ve’t-tefsîr’i, i‘râbı ele alışları açısından karşılaştırmalı olarak incelenmiştir. Çalışmada bu iki tefsirin seçilmesindeki belirleyici etken eserlerin i‘râbı ele alış yöntemlerinin benzerlik arz etmesidir. Bazı örnekler üzerinden konuyu karşılaştırmalı olarak inceleyen bu çalışmanın amacı iki müfessirin Kur’ân ayetlerini anlamada i‘râba yaklaşımlarını tespit etmek suretiyle bu iki müfessir arasındaki i‘râb değerlendirmeleri bağlamındaki ilişkinin niteliğini belirlemektir. Çalışmanın diğer bir amacı Beyzâvî’den sonra yaşamış olan Lütfullah el-Erzurûmî’nin onunla aynı düşündüğü veya farklı görüşe sahip olduğu noktalardaki değerlendirmelerini incelemektir. Bu noktada, her iki eserde yer alan i‘râb örnekleri üzerinden incelenen konu, eserlerinde i‘râba geniş yer veren Zemahşerî, Râzî, Ebû Hayyân ve daha başka tefsircinin görüşleriyle de mukayeseli olarak değerlendirilmiştir. Bu çalışmada i‘râba dair görüşleri değerlendirilen her iki alim kuşkusuz çeşitli yönleriyle birçok çalışmaya konu olmuştur. Yıllar geçtikçe şöhreti daha da artan ve eserleri daha çok ilgi gören Beyzâvî hakkındaki çalışmalar daha fazladır. Konumuzla alakalı olarak tefsirindeki yöntemi ve ayetleri anlamlandırmada i‘râbı kullanış tarzını inceleyen çalışmalar bulunmaktadır. Ancak bu çalışma, önceki çalışmalardan farklı olarak Beyzâvî’nin tefsirindeki yöntemi ve tefsirde dile ait özellikleri ve i‘râbı nasıl kullandığını açıklamaktan ziyade Beyzâvî ile ondan sonra yaşamış olan Lütfullah el-Erzurûmî’nin tefsirlerinde irabı ele alış tarzlarını mukayeseyi konu edinmektedir. Diğer taraftan Lütfullah el-Erzurûmî, Beyzâvî kadar çalışılmamış olsa da bazı eserlerinin çeşitli çalışmalara konu olduğu görülmektedir. Eserlerini dil yönünden inceleyen çalışmalar da bulunmaktadır. Ancak bu çalışma Beyzâvî’nin tefsirde i‘râbı ele alışını da değerlendirmekle birlikte iki müellifin bu konudaki görüşlerinin kıyaslamasını yaparak tefsirinde Beyzâvî’nin i‘râba dair görüşlerine başvuran Lütfullah el-Erzurûmî’nin onunla ittifak ettiği ve farklı düşündüğü tarafları ve bu farklılıkların kaynaklarını ortaya koymaya çalışmaktadır. Ayrıca Lütfullah el-Erzurûmî’nin Beyzâvî’yle ortak görüşe sahip olduğu noktalarda onun görüşlerini ele alış tarzının alıntılama, açıklama veya atıf yapma gibi şekillerden hangisiyle gerçekleştiğini tespit ederek buradan bir değerlendirme yapmayı amaçlamaktadır. Öte yandan farklı düşündüğü noktalarda ise bu görüşün önceki âlimlerin görüşlerinin değerlendirilmesi neticesinde birinin diğerine tercih edilmesi şeklinde mi yoksa bizzat müellifin kendi görüşü mü olduğu belirlenmeye çalışmaktadır. Çalışmaya konu olan iki eserdeki i‘râba dair mevzuların ele alınış biçimiyle ilgili olarak şu sonuçlara ulaşılmıştır: Lütfullah el-Erzurûmî çoğunlukla Beyzâvî’nin görüşüne tabi olmuştur. Beyzâvî’nin çoğu görüşünü özetleme yoluna gitse de bazı durumlarda açıklama yapma ihtiyacı hissetmiştir. Çalışmada bazı örnekleri sunulan bu konuya dair daha çok örnek her iki müellifin eserinden verilebilir. İhtilaf ettiği konularda ise diğer tefsirlerde daha isabetli gördüğü görüşleri sunmuştur. Beyzâvî’ye katılmadığı noktalarda ise başta Zemahşerî’nin Keşşâf’ı olmak üzere Râzî’nin Mefâtîhu’l-gayb’ı, Ebû Hayyân’ın el-Bahru’l-muhît’i ve daha başka tefsirlerdeki i‘râba dair görüşlerden yararlanmıştır. Bazı görüşlerinde ise gerek Beyzâvî gerek diğer müfessirlerin görüşlerine katılmayarak kendi görüşünü belirtmiştir. İraba dair bu değerlendirmeler, önceden dile getirilmemiş müellife ait bir görüş olabildiği gibi anlamı belirlemede açık etkisi olan herhangi bir görüşün üstün tutulması tarzında da tezahür edebilmiştir. Lütfullah el-Erzurûmî, Beyzâvî’nin görüşlerine katıldığı durumlarda bunu çeşitli deliller sunarak gerekçelendirmiştir. Bu husus, kadim müfessirleri takip eden sonraki müfessirlerin tefsirdeki rolünün sadece özetleme veya şerh etme şeklinde gerçekleşmediğini, bilakis kendilerine has yöntem, değerlendirme ve kıstaslarının bulunduğunu göstermektedir. Öte yandan çalışmaya konu olan iki eserin karşılaştırılmasıyla ortaya çıkan bu sonuçlar, kadim âlimlerin gerek dil alanında gerek diğer alanlarda sonrakilere bıraktığı bilgi birikimi ve teliflerin bolluğuna rağmen kapsamlı inceleme ve araştırmalar neticesinde onların elde edemedikleri bir takım neticelere sonrakilerin ulaşabileceğini de ortaya koymaktadır. BackgroundOrgan donation has become one of the most effective ways to save lives and improve the quality of life for patients with end-stage organ failure. No previous studies have investigated the preferences for the different consenting options for organ donation in Egypt. This study aims to assess Egyptians’ preferences regarding consenting options for posthumous organ donation, and measure their awareness and acceptance of the Egyptian law articles regulating organ donation.MethodsA cross sectional study was conducted among 2743 participants over two years. Each participant was required to rank eleven consenting options from 1 to 11, and to report his awareness and acceptance of the seven articles of the Egyptian law of organ donation.Results47% of the participants expressed willingness to donate their organs after death. This percentage increased to 78% when consenting options were explained to participants. “Informed consent by donor only” was the most preferred type of consent for one third of respondents. Awareness of the law articles regulating organ donation was relatively low ranging from 56% to 23%.ConclusionCurrently, around half of the Egyptian population agree to posthumous organ donation. This percentage could be increased significantly by raising the awareness about how the process of donation could be regulated and how the patient’s right of decision could be protected. (shrink)

Although Indonesia is far from where Islam emerged, it is a country with the world’s largest Muslim population. The historical data on Islam’s entry into Indonesia is still very limited, therefore it is not easy to find clear information about it. This met with the historical reconstruction difficulty to the Islamic sciences’ development, especially ḥadīth, when Islam first came to Indonesia. Ḥadīth is not as popular as other sciences such as tafsīr, fiqh, taṣawwuf, and kalām. The ḥadīth’s arrival and the (...) history of prevelance in Indonesia were not as clear as the others sciences. To solve this problem, the Indonesian historians traced the dates when Islamic sciences began to emerge and spread in Indonesia. These also provided clues about ḥadīth science’s emergence and development in Indonesia. Based on tracing early ḥadīth studies in Indonesia, we can speak about two important figures’ names who are widely mentioned and cannot be separated from ḥadīth science history in Indonesia; Mahfudz Tremas (d. 1338/1920) and Hasyim Asy’ari (d. 1366/1947). These two figures colored Islamic teaching in Indonesia because of their mastery Islamic knowledge covering various Islamic sciences. Both of them also had an important role in Indonesian society in the colonialism era. This made it easier for them to spread ḥadīth widely among Indonesian Muslim people. In this research article, data, reports, and information of ḥadīth science emergence in Indonesia, Mahfudz Tremas and Hasyim Asy’ari’s biographies, studies, and contributions were compiled with descriptive analysis method and historical approach. Furthermore, data collection and evaluation methods were used in this research article. This research cites references written in Indonesian, Turkish, Arabic, and other foreign languages. The journal articles and scientific books we used are among the sources used in this study. The early Indonesian scholars are generally experts not only in one of the Islamic sciences but also in others. Moreover, Islamic sciences that they desired, deepened in, and focused on were mixed. The early Indonesian scholars not only wrote several on Islamic science fields, but they also interconnected the early Islamic sciences’ works in Indonesia. Therefore, it can be considered a difficult task to distinguish ḥadīth from others. The subject, we examine here is within the ḥadīth science’s historical framework mixed with other Islamic sciences in Indonesia. This research article focused only on ḥadīth entry history in Indonesia, Mahfudz Tremas, Hasyim Asy’ari, and their role in ḥadīth development. The questions we answered in this article are when ḥadīth science began to emerge, what was and how the role of Mahfudz Tremas and Hasyim Asy’ari were in Indonesia at this subject as the greatest contributors to its early emergence and dissemination, and high authority scholars among Indonesian Muslim society. Our aim in this research is to study, understand, and explain the early ḥadīth science’s history in Indonesia. Mahfudz Tremas and Hasyim Asy’ari, who are Indonesian ḥadīth scholars teaching ḥadīth for Indonesian people, attaching great importance to ḥadīth, making a great contribution, and having the most influence, are discussed. Understanding and explaining ḥadīth studies in Indonesia would be easier by getting to know these two scholars. Apart from these two scholars, it should not be assumed that there was no ḥadīth scholar in Indonesia in the early period. Here, we aim to understand the most influential scholars’ service and contribution in the ḥadīth field. It is important to introduce Indonesian hadith scholars, their works, and contributions to scholars and scientists in Turkey and the world, and then to contribute to the academic and scientific relations among the countries. This research article, as one of the first Turkish sources on ḥadīth’s growth and development in Indonesia, would be useful for ḥadīth academicians in Turkey. Since the research title on the ḥadīth science emergence history in Indonesia, and Mahfudz Tremas and Hasyim Asy’ari’s contribution to its development, as we know, has never been done before. This research article will help to built a network between the Indonesian and Turkish peoples, scholars, and academicians. It also contributes to increasing the scientific benefits of the two sides of academic circles. Through this research, contemporary ḥadīth studies in Indonesia can be traced from the time it emerged and the early development process. Moreover, It is a great contribution to specify the early ḥadīth science history in Indonesia, as the world’s largest Muslim country. (shrink)

Este trabajo investiga las capacidades epistémicas de las instituciones democráticas a través de una evaluación de tres modelos epistémicos de democracia: el Teorema del Jurado de Condorcet, el Teorema ‘Diversidad supera Habilidad’ y el modelo experimentalista de Dewey. El modelo de Dewey es superior a los demás en su capacidad de modelar las funciones epistémicas de tres características constitutivas de la democracia: la diversidad epistémica de los participantes, la interacción de la votación con el debate y los mecanismos de retroalimentación (...) como las elecciones periódicas y las protestas. Considera que la democracia es una institución para reunir información ampliamente distribuida sobre problemas y políticas de interés público mediante la participación de conocedores epistémicamente diversos. Las normas democráticas de libre discurso, disenso, retroalimentación y rendición de cuentas funcionan para garantizar el aprendizaje colectivo y con base experimental a partir de las diversas experiencias de los diferentes conocedores. Ilustro estos puntos con un estudio de caso de grupos forestales comunitarios en el Asia meridional, cuyas capacidades epistémicas se han visto perjudicadas por la supresión de la participación de las mujeres. This work focuses on the participatory cultural model that, at the specific moment in history, managed to adjust in order to avoid the vices inherent in any assembly model. Moreover, this book pleads for the need to distribute knowledge and cultural wealth to be able to develop a democratic political system. (...) This work aims to re-evaluate the importance of the human imagination in the semiotic of C. S. Peirce. Based on a selection of texts from the Collected Papers (from 1878 to 1903), it attempts to describe the formal relationship between imagination and the controversial notion of semiotic ground. This account of the imagination as a prerequisite for the creation of new beliefs and habits also draws from the Aristotelian notion of "ascending mimesis" and the Peircean normative science of esthetics.

Este ensayo analiza algunas semejanzas y diferencias entre la obra de Emmanuel Lévinas y la obra de Walter Benjamin . Se discute la crítica de ambos autores a la noción de totalidad, su cuestionamiento del historicismo y la exclusión de la alteridad que asocian con él, así como la propuesta de ambos autores de una noción de tiempo que rompa con la continuidad. Se discute de qué manera estas reflexiones se relacionan con la noción de responsabilidad hacia el otro.

La relación entre maternidad y trabajo ha sido materia de políticas públicas desde comienzos del siglo XX, pero en las últimas décadas ha adquirido nuevas connotaciones por el aumento de la participación laboral femenina. Ello no ha conducido a una eliminación de las discriminaciones que enfrentan las trabajadoras por su condición (real o potencial) de madres, ni a una organización del mercado de trabajo que permita articular demandas laborales y familiares, ni una redistribución del trabajo reproductivo. Para analizar cómo actores (...) involucrados en la formulación de políticas relacionadas con esta temática concebían la relación entre trabajo y maternidad y las tensiones que derivaban de ella, se entrevistó a un grupo de actores sociales provenientes de tres ámbitos. Dos ideas caracterizan sus concepciones: las normas de protección a la maternidad en el trabajo afectan negativamente la empleabilidad femenina y la relación maternidad trabajo es difícil porque la organización del mercado de trabajo dificulta la articulación de responsabilidades laborales y familiares. Respecto de las tensiones, se constataron en diferentes dimensiones: económica, demográfica, ejercicio de derechos y sociocultural. (shrink)

In Gorgias Plato distinguishes empeiria and technê appealing to the notion of reason: Technê offers reasons while empeiria is an alogon pragma. But he links this criterion to the dichotomy of pleasure and good such that the field of technê is limited to good and the field of empeiria to pleasure. I focus on this connection showing its underlying assumptions. I propose to consider that the central dichotomy is that of pleasure and good and that the criterion based on reason (...) can be derived from it. For this I show that good and pleasure do not act solely as objects of technê and empeiria but rather are ways of reasoning and arguing. This leads to the redefinition of the concept of alogon pragma. it must be understood as an activity that is irrational to the extent that it creates pseudoreasons. The concept of Kosmos will be relevant in this context. (shrink)

We propose a distinction between precategorial, acategorial and categorial states within a scientifically oriented understanding of mental processes. This distinction can be specified by approaches developed in cognitive neuroscience and the analytical philosophy of mind. On the basis of a representational theory of mental processes, acategoriality refers to a form of knowledge that presumes fully developed categorial mental representations, yet refers to nonconceptual experiences in mental states beyond categorial states. It relies on a simultaneous experience of potential individual representations and (...) their actual “representational ground”, an undifferentiated precategorial state. This simultaneity is possible if the mental state does not reside in a representation but in between representations. Acategoriality can be formally modeled as an unstable state of a dynamical mental system that is subject to particular stability criteria. (shrink)

Testimony is a special challenge in epistemology. Human life as we know it would be impossible without it; we commonly accept it without question; and only the highly skeptical doubt that from it we gain much knowledge about matters on which we lack independent evidence. In my theory of testimony, it figures as an essential source of knowledge in our lives, but not as a basic source of it; and the way in which testimony yields justification for believing its content (...) is very different from the way in which it yields knowledge. Isabelle Keßels, David Lambert, and Christian Quast have produced a long and detailed study of my treatment of the topic, and here I can note only some important aspects of it and seek to discuss them in ways that may advance understanding of some major aspects of the topic. RESUMEN: El presente trabajo examina Anarquía, Estado y utopía de Robert Nozick a la luz de los mitos y ficciones sobre los cuales se construye. En este sentido, se sostendrá que es posible identificar dos mitos principales: el estado de naturaleza lockeano, cuyo principio se deja resumir en la máxima volenti non fit iniuria; y la meta-utopía libertaria, que se deja explicar como una aplicación de la teoría evolutiva de Hayek y de la epistemología de Popper a la construcción de (...) una utopía. Se sostendrá además que existe una continuidad entre ambos mitos y que dicha continuidad viene dada por una intuición moral que Nozick formula al principio de la obra y que sirve también de inspiración al mito libertario: que la vida solo puede tener sentido cuando se deja a cada persona vivir la suya del modo en que estime conveniente. Dicha intuición, se concluirá, se traduce en el campo de la política y del derecho en el principio de que cada persona es dueña de sí misma y que, por consiguiente, esta forma particular de propiedad constituye el secreto hilo conductor de toda la obra. ABSTRACT: This paper examines Robert Nozick's Anarchy, State, and Utopia in the light of the myths and fictions upon which it is built. I hold that it is possible to identify two main myths: the Lockean state of nature, whose principle can be summarized by the maxim volenti non fit injuria, and the libertarian meta-utopia, that can be explained as an application of Hayek evolutive theory and of Popper's epistemology in order to construct an utopia. I also claim that there is a continuity between both myths, and that this continuity is granted by a moral intuition that Nozick presents at the beginning of this work, and that also inspires the libertarian myth: that life can only have sense when each person is allowed to live her own in the way she deems convenient. I will conclude that this intuition finds an expression, in the field of politics and law, in the principle that each person owns herself and, hence, that this peculiar form of ownership is the secret thread of the whole book. Understanding the developments in the early period when Ṣūfism became widespread in the Islamic society, both necessitates studies on other disciplines from Ṣūfism, and also requires the consideration of Ṣūfism from the perspective of other religious sciences. In this regard, one of the important names is the famous Ḥanbalī scholar Abū Yaʿlā al-Farrā. Abū Yaʿlā al-Farrā who was interested in ḥadīth, Islamic law and tafsīr as well as Ṣūfism and theological issues, has an important place especially with his works in (...) the Ḥanbalī tradition. Abū Yaʿlā, who grew up in a period when the Sunnī theology schools were formed, spread and exercised its influence, he maintained the Ḥanbalī viewpoint and criticized both some schools of kalām and the Ṣūfis by using the kalām method. Therefore, analyzing his views is important for understanding the formative conditions of the first period of religious science tradition, as well as giving clues about the relationship between Ṣūfism and Ḥanbalī tradition. In this article, his views of zuhd, tawakkul and Ṣūfism in general is examined in the context of his works Kitāb al-Muʿtamad fī uṣūl al-dīn and Kitāb al-tawakkul, and his importance in understanding the relationship between Ṣūfism and Ḥanbalī tradition is emphasized. La cosiddetta “morte cerebrale totale”, o più correttamente “morte encefalica” (whole brain death), è un criterio fisiologico riferito alla cessazione irreversibile e permanente di tutte le funzioni dell’encefalo (emisferi e tronco encefalico), ed è correlato alla cessazione del funzionamento integrato dell’organismo. L’applicazione del criterio neurologico, e degli esami che lo accompagnano, è finalizzato ad una diagnosi clinica e strumentale per individuare una condizione causata da lesioni neurologiche diffuse e responsabili di coma, assenza di coscienza, di respirazione spontanea, di risposte agli (...) stimoli esterni, e di attività elettrica cerebrale in pazienti collegati alle macchine per la rianimazione. La diagnosi consente la dichiarazione legale di morte. L’assunto scientifico alla base dell’impiego del criterio neurologico è la teoria dell’integratore centrale, secondo la quale l’encefalo è responsabile del funzionamento integrato e coordinato dell’organismo. Questo contributo ricostruisce a grandi linee il dibattito bioetico italiano sui criteri per l’accertamento della morte, prestando attenzione anche ai recenti sviluppi della discussione sui mass media. I criteri neurologici per accertare il decesso, da impiegare in alternativa a quelli cardiorespiratori se il paziente ha subìto lesioni cerebrali e si trova collegato alle apparecchiature per la ventilazione artificiale, sono entrati nell’uso comune della pratica medica occidentale da circa quarant’anni ed il consenso di cui essi godono nella comunità scientifica sembra, a prima vista, essere ancora oggi molto solido. Si diceva a prima vista, perché se si esamina con attenzione la letteratura dal 1992 ad oggi, si possono scoprire (...) i crescenti numeri del dissenso: ripensamenti e critiche provengono soprattutto da esperti di area medico-biologica, che associano le loro voci a quelle di filosofi, teologi, studiosi di etica. I motivi del dissenso sono molteplici, e l’ampia letteratura che li documenta riguarda la teoria scientifica posta a fondamento dei criteri neurologici, ed evidenzia le contraddizioni, teoriche ed applicative, derivanti dall’uso di quei criteri.
