Although the view that punishment is to be justified on utilitarian grounds has obvious appeal, an examination of utilitarianism reveals that, consistently and accurately interpreted, it dictates unjust punishments which are unacceptable to the common moral consciousness. In this rule?utilitarianism is no more satisfactory than is act?utilitarianism. Although the production of the greatest good, or the greatest happiness, of the greatest number is obviously a relevant consideration when determining which punishments may properly be inflicted, the question as to which punishment (...) is just is a distinct and more basic question and one which must be answered before we can determine which punishments are morally permissible. That a retributivist theory, which is a particular application of a general principle of justice, can account more satisfactorily for our notion of justice in punishment is a positive reason in its support. The works of Paul Grice collected in this volume present his metaphysical defense of value, and represent a modern attempt to provide a metaphysical foundation for value. Value judgments are viewed as objective; value is part of the world we live in, but nonetheless is constructed by us. We inherit, or seem to inherit, the Aristotelian world in which objects and creatures are characterized in terms of what they are supposed to do. We are thereby enabled to evaluate by reference (...) to function and finality. The most striking part of Grice's position, however, is his contention that the legitimacy of such evaluations rests ultimately on an argument for absolute value. (shrink)

Theological anthropology in Islam, philosophy of Islamic education and aspects of success.

The following analysis has been undertaken mainly for the purpose of presenting a sample of a method which, as the writer holds, would, if widely and consistently applied, tend considerably to reduce the number and the significance of epistemological problems. The presuppositions characteristic of this method might be summarized in these five statements: 1)You cannot make discoveries by changing the meaning of terms.2)There is wisdom in common sense since it represents the accumulated experience of the race.3)It cannot be impossible to (...) work out common sense into a consistent terminology.4)It is when we lack the patience to do this that epistemological problems seem to arise.5)But when such a terminology is worked out, it will prove rather disappointing since it will just express, in a somewhat clarified form, what all the world has always been aware of. In his biography of Isaac Newton, which forms the most recent production in this flourishing genre, Niccolò Guicciardini states as his first point of departure that Newton's work arose not from ‘attempts to answer questions that came to him spontaneously, but [from addressing] those posed by his contemporaries’. Right he is to communicate to the larger audience for which he is writing this principal fruit of by now almost a century of professional history-of-science writing – a deep-seated awareness that every (...) scientific view or finding, even if looking timeless in retrospect, has emerged from some given historical context that shows us where the scientist in question started, and that helps explain how, and in what direction, they managed to venture beyond the original context. Indeed, the same truth applies to every genuine – that is, in some way innovative and also worthwhile – contribution to scholarship. And so it is, therefore, with the three books here under review, which I intend to examine with the following leading question in mind: what in each of them is new and what, in what turns out to be new indeed, has been worth learning? Context: Francisco Varela and Humberto Maturana worked closely together for several short episodes and wrote joint publications during the 1970s and 1980s. After that their respective paths in life diverged. Problem: What is the common ground and what are the differences between these two authors with respect to their lives and aims? Method: The author reconstructs their common history in the form of personal reflections and conversations with Varela. Results: The personal reflections reveal the intellectual path Maturana took to develop (...) his way of thinking, in particular his fascination with explanatory processes and the phenomenon of life. The conversations with Varela portray him as a man of great “cognitive autonomy,” whose career started with the intention to study “psychism in the universe.” For Varela it seemed possible, through meditation, to reach transcendental reality as something that exists externally to the living of human beings and that can be known as such. Maturana, by contrast, claims that there is no way to refer to such a universal truth. Rather, human beings generate all the worlds they live in. Implications: While the two men collaborated in both teaching and writing, they eventually created two different constructivist approaches driven by a different set of questions. British accounts of medical ethics concentrate on confidentiality to the exclusion of wider questions of privacy. This paper argues for consideration of privacy within medical ethics, and illustrates through the television series `Hospital', what may go awry when this wider concept is forgotten.

Historian James H. Jones published the first edition of Bad Blood, the definitive history of the Tuskegee Syphilis Experiment, in 1981. Its clear-eyed examination of that research and its implications remains a bioethics classic, and the 30-year anniversary of its publication served as the impetus for the reexamination of research ethics that this symposium presents. Recent revelations about the United States Public Health Service study that infected mental patients and prisoners in Guatemala with syphilis in the late 1940s in order (...) to determine the efficacy of treatment represent only one of the many attestations to the persistence of ongoing, critical, and underaddressed issues in research ethics that Bad Blood first explored. Those issues include, but are not limited to: the complex and contested matters of the value of a given research question, the validity of the clinical trial designed to address it, and the priorities of science.
