This article describes an ontological model of norms. The basic assumption is that a substantial part of a legal system is grounded on the concept of agency. Since a legal system aims at regulating a society, then its goal can be achieved only by affecting the behaviour of the members of the society. We assume that a society is made up of agents (which can be individuals, institutions, software programs, etc.), that agents have beliefs, goals and preferences, and that they (...) commit to intentions in order to choose a line of behaviour. The role of norms, within a legal system, is to specify how and when the chosen behaviour agrees with the basic principles of the legal system. In this article, we show how a model based on plans can be the basis for the ontological representation of norms, which are expressed as constraints on the possible plans an agent may choose to guide its behaviour. Moreover, the paper describes how the proposed model can be linked to the upper level of a philosophically well-founded ontology (DOLCE); in this way, the model is set in a wider perspective, which opens the way to further developments. Il volume offre una sintetica analisi dell’attualismo di Giovanni Gentile al fine di rilevare i dettagli fondamentali della sua posizione teoretica e di individuare gli elementi su cui si è strutturata la sua ricezione in Italia. La filosofia postattualista italiana è stata radicalmente influenzata dal filosofo siciliano e il suo sviluppo ha assunto le forme di un lungo dialogo con l’attualismo. The target articles in this special section shed new light on the old question whether and how emotions influence action. However, what is missing is a straightforward motivational analysis—considering what we have learned from the science of explaining the “why” and “how” of behavior. I posit that emotions can influence the motivation process and thus action by fulfilling at least three functions: First, being grounded in needs, experienced emotions can function as strong need-like motivational states. Second, anticipated emotions can function (...) as incentives and justify action. Third, emotions can inform about progress in goal pursuit permitting behavior calibration. In summary, there is little doubt that emotions influence action. They can do so because they are hypo-phenomena of motivation. (shrink)

In public political deliberation, people will err and lie in accordance with definite patterns. Such discourse failure results from behavior that is both instrumentally and epistemically rational. The deliberative practices of a liberal democracy cannot be improved so as to overcome the tendency for rational citizens to believe and say things at odds with reliable propositions of social science. The theory has several corollaries. One is that much contemporary political philosophy can be seen as an unsuccessful attempt to vindicate, on (...) symbolic and moral grounds, the forms that discourse failure take on in public political deliberation. Another is that deliberative practices cannot be rescued even on non-epistemic grounds, such as social peace, impartiality, participation, and equality. To alleviate discourse failure, this book proposes to reduce the scope of majoritarian politics and enlarge markets. (shrink)

Several authors in psychology and philosophy have recently raised the following question: when is it permissible to intentionally change the meaning and use of our words and concepts? I argue that an arguably prior question has received much less attention: Even if there were good moral or epistemic reasons for conceptual or semantic changes, this does not yet justify pushing or lobbying for such changes if they are socially and conceptually disruptive. In this paper I generalize the new approach to nonmonotonicreasoning that was presented in [6]. This generalization results in the inconsistency-adaptive logic PRL . I give proof theory, semantics, mention interesting properties,and comment on the reconstruction and amelioration of other nonmonotoniclogics and mechanisms.

This article analyses the Fair Trade sector as a “mixed-form market,” i.e., a market in which different types of players (in this case, nonprofit, co-operative and for-profit organizations) coexist and compete. The purposes of this article are (1) to understand the factors that have led Fair Trade to become a mixed-form market and (2) to propose some trails to understand the market dynamics that result from the interactions between the different types of players. We start by defining briefly Fair Trade, (...) its different dimensions (including the “fair” quality of the products) and its organizational landscape, focusing on the distinction between the pioneer “Alternative Trading Organizations” and the second-mover companies. Then, we recall the theoretical emergence factors for each type of organization (nonprofit, co-operative and for-profit) and apply these emergence factors to the context of Fair Trade. This analysis allows us to capture the specificities of each type of operator with regard to Fair Trade and, thus, to have a better understanding of the dynamics in the sector. Such dynamics includes competition, but also conflict and partnership. Our analysis includes elements on ethical imitation, consumers’ behaviors, effects on welfare and the role of the government. Given the metaphysical and explanatory stalemate between Embedded and Extended cognition, different authors proposed moral arguments to overcome such a deadlock in favor of EXT. Farina and Lavazza attribute to EXT and EMB a substantive moral content, arguing in favor of the former by virtue of its progressiveness and inclusiveness. In this treatment, I criticize four of their moral arguments. In Sect. 2, I focus on the argument from legitimate interventions and on the argument from extended agency. Section 3 concerns (...) the argument from better protection and the argument from better treatment. Sections 4 and 5 are dedicated to counterarguments against each respectively. By distinguishing between EXT and the extended view, I argue that it is sufficient to use this second version for directly addressing and evaluating moral problems on normative grounds, independently of the causal or constitutive cognitive influence of the external resource on the agents’ minds. Moreover, I argue that the arguments and assumptions used by EXT theorists do not foster values of progressiveness and inclusiveness. To conclude, in Sect. 6, I show that the analysis of each argument converges on the conclusion that EXT does not have substantive moral content and implications per se, since they always depend on further assumptions. O texto visa apresentar a querela entre Sigmund Freud e Gilles Deleuze acerca da noção de “repetição” – noção fundamental tanto para a metapsicologia do primeiro, quanto para a filosofia do segundo. Através da crítica de Deleuze ao caráter eminentemente negativo e “derivativo” da repetição em Freud (ideia que, no caso de Freud, aparece sobretudo em dois textos fundamentais: “Recordar, repetir e elaborar”, de 1914, e “Além do princípio do prazer”, de 1920), será refeito o itinerário das “sínteses do tempo”, (...) presentes na obra _Diferença e repetição_, apontando para uma noção positiva de repetição – sem, contudo, incorrer às figuras do Mesmo e ao primado da representação. Uma “repetição complexa”, que se faz acompanhar de uma “diferença pura”, cuja temporalidade mais adequada é aquela própria à lógica da multiplicidade, isto é, um tempo “não-reconciliado”, parafraseando a expressão de Peter Pál Pelbart. El presente escrito analiza algunos lineamientos de la teoría hegeliana del reconocimiento y sus diferentes contextos a la luz de la cuestión del derecho natural y el estado de naturaleza. Específicamente, nos referiremos a los siguientes escritos: el Sistema de la Eticidad, la Filosofía del Espíritu, la Fenomenología del Espíritu y la Filosofía del Derecho.

El relato “Los teólogos”, de Borges, puede ser leído a partir de un eje de contrarios que se confunden, de verdades que falseadas vuelven a ser consideradas tales, puestas al servicio del mantenimiento de un orden en el que los personajes varían de acusadores a víctimas. Esa perspectiva permite reflexionar acerca del modo en que se lleva a cabo una argumentación en juicio, las formas de resolver un litigio, el rol de los jueces y su lugar dentro del sistema en (...) el que operan, el concepto de la verdad dentro del sistema penal y la cuestión de cómo se neutraliza la violencia social o se resuelven los conflictos en una comunidad. En el relato, los personajes se dedican construir argumentaciones en defensa de la fe dentro de un modelo ideado para el mantenimiento del orden que la iglesia pretendía consolidar tras la caída del imperio romano. A partir de ese modelo de disputa, el texto revisa brevemente cómo se ha construido hasta hoy el sistema de persecución y juzgamiento de delitos y cuál es el rol que ocupan las personas designadas para juzgar y aplicar un castigo. Intentaré, a partir de las descripciones del relato, presentar ciertas formas de fundamentación y de manipulación de las herramientas argumentales y la trascendencia de la noción de verdad en una administración de justicia cuya finalidad central es la de resolver conflictos en el marco de un determinado modelo de convivencia. En el libro II de la Ética Nicomaquea (EN), Aristóteles menciona 6 casos para los cuales la fórmula según la cual la virtud es el término medio no aplica, esto es, 3 acciones y 3 pasiones donde no es posible pensar ocasión o modo correctos de realizarlas, acciones y pasiones que siempre estarán mal independientemente del contexto y del agente, lo que hoy día llamaríamos «absolutos morales». Dentro de la bibliografía secundaria tal afirmación no ha suscitado gran polémica, pero poco (...) o nada se ha reparado en el hecho de que (1) la cualidad por la cual esas 6 son siempre reprobables la comparten muchas otras acciones y pasiones y que, por tanto, (2) habría que aceptar que en Aristóteles hay un listado relativamente extenso de «absolutos morales». Epistemologists understand radical skepticism as arising from two principles: Closure and Underdetermination. Both possess intuitive prima facie support for their endorsement. Understanding how they engender skepticism is crucial for any reasonable anti-skeptical attempt. The contemporary discussion has focused on elucidating the relationship between them to ascertain whether they establish distinct skeptical questions and which of the two constitutes the ultimately fundamental threat. Major contributions to this debate are due to Brueckner, Cohen, and Pritchard. This contribution aims at defending Brueckner’s contention (...) that underdetermination expresses the fundamental skeptical threat and that the closure-based argument can ultimately be reduced to it, at least concerning skeptical contexts. This will be achieved by undermining Cohen’s objections to Brueckner on both counts. Cohen’s argument endorses a picture of evidential underdetermination, which, while apt for non-skeptical contexts, cannot be applied to radical skepticism. A comparison with a case of scientific underdetermination is developed to argue for this idea. Our argument is then applied to the principle equivalence issue and to objections against it. It is then shown how this analysis possesses a distinctive effect on our understanding of the skeptical threat and the assessment of successful anti-skeptical strategies. (shrink)

Inter- and transdisciplinary (ITD) approaches represent promising ways to address complex global challenges, such as climate change. Importantly, arts–sciences collaborations as a form of inter and transdisciplinarity have been widely recognized as potential catalysts for scientific development and social change towards sustainability. However, little attention has been paid to the process of reasoning among the participants in such collaborations. How do participants in arts–science collaboration reason together to overcome disciplinary boundaries and to co-create interventions? This article investigates how inter- and (...) transdisciplinary reasoning (or ITD reasoning) unfolded in a collaboration involving experts from the natural sciences, humanities, and the arts. We studied how collaborators reasoned through different understandings and experiences of climate change as well as through multiple ways of fostering motivation to take action via two co-designed artworks, HOMONEXUS (a participatory textile and acoustic installation) and GLACIER NEX US (a performance staging a dialogue between a melting glacier and a glaciologist). Our conclusions are threefold: (i) ITD reasoning can increase participants’ capacity to navigate often-unpredictable situations by cross-fertilizing ideas and overcoming blind-spots; (ii) humanities in arts–science collaborations can foster a more nuanced understanding of the differences and similarities of different knowledge systems as well as a deeper ecological understanding of sustainability problems; and (iii) the aesthetic experiences stimulated by arts–science interventions may help to raise awareness about the climate emergency and sustainable actions by providing pleasant and positive or dazzling and negative aesthetic experiences. O contexto da educação básica brasileira caracteriza-se, de modo geral, na atuação de docentes com descompassos formativos, que ministram aulas de diversas disciplinas, no caso dos anos iniciais do ensino fundamental, ou que lecionam disciplinas diversas de sua área de formação, no caso das séries finais e ensino médio. Nessa linha, diversos estudos apontam para a evidência de lacunas e imprecisões conceituais no planejamento de intervenções didáticas, devido ao precário desenvolvimento profissional. Desse modo, o presente artigo traz uma revisão teórica (...) sistemática sobre o tema relacionado aos conhecimentos profissionais do magistério e busca contribuir com tal debate, trazendo como resultado a proposta de uma visão do processo de construção de saberes docentes com base em modelos do conhecimento pedagógico de conteúdo articulados com os processos de criação vigotskianos. Tal proposta possibilitou possíveis implicações das articulações apresentadas em associação com as pesquisas relacionadas à formação docente, bem como com propostas formativas, que levem em consideração o contexto cultural do professor, especificamente seus esquemas repertoriais, aqui representados pelo espectro criativo. Desse modo, pretende-se que os contextos formativos utilizem e incrementem o repertório professoral, repertório este fundamental para o desenvolvimento de novos Conhecimentos Pedagógicos de Conteúdo em um caráter transformativo, possibilitando práticas que permitam o desenvolvimento profissional docente. This paper focuses on physiological integration in multicellular systems, a notion often associated with biological individuality, but which has not received enough attention and needs a thorough theoretical treatment. Broadly speaking, physiological integration consists in how different components come together into a cohesive unit in which they are dependent on one another for their existence and activity. This paper argues that physiological integration can be understood by considering how the components of a biological multicellular system are controlled and coordinated in (...) such a way that their activities can contribute to the maintenance of the system. The main implication of this perspective is that different ways of controlling their parts may give rise to multicellular organizations with different degrees of integration. After defining control, this paper analyses how control is realized in two examples of multicellular systems located at different ends of the spectrum of multicellularity: biofilms and animals. It focuses on differences in control ranges, and it argues that a high degree of integration implies control exerted at both medium and long ranges, and that insofar as biofilms lack long-range control (relative to their size) they can be considered as less integrated than other multicellular systems. It then discusses the implication of this account for the debate on physiological individuality and the idea that degrees of physiological integration imply degrees of individuality. (shrink)

J’essaie d’expliquer, d’abord, pourquoi Collingwood recourt, dans An Autobiography et An Essay on Metaphysics, à une terminologie un peu curieuse et même parfois trompeuse, qui a donné prise à l’interprétation selon laquelle le der-nier Collingwood répudiait l’existence de problèmes éternels en philosophie. Deuxiè-mement, mon intention est de rendre manifeste (...) que pour Collingwood — qui se considérait luimême, au milieu des années trente, comme un «idéaliste objectif» — les questions philosophiques sont à la fois historiques et éternelles. It is generally agreed that R.G.Collingwood's An Essay on Philosophical Method and An Essay on Metaphysics are closely related but are also significantly different. If they do in fact differ in any significant way, one wonders whether there are good reasons to prefer one account over the other at the points where they differ. In this article, I would like to try to answer this query by referring to two passages, where the text in both essays is nearly identical but (...) which nevertheless reveal the differences between the two essays. In these passages Collingwood gives a presentation of Plato's and Kant's philosophical method and compares their methodologies to his own. Precisely the small differences between the two fragments not only show the continuity between both essays, but also make clear how Collingwood's concept of metaphysics after 1936, under the pressure of logical positivism, loses its distinctive sharpness and hence becomes liable to the charge of relativism and historicism. If my analysis has any plausibility, I hope to make it clear that Collingwood's position in EPM is preferable to that of EM or, to put it more mildly, that 'any account of EM must do justice to EPM if we are to allow the rest of Collingwood's philosophy to live and flourish'. In this article I intend to focus on the interpretation of the so-called postmodern phenomenon of anthropological fragmentation/doubling. My starting-point is a comparison between the anthropological position of the American philosopher Richard Rorty on the one hand and that of the French-American anthropologist René Girard on the other. Both Rorty and Girard prefer literature to academic philosophy as a gateway to the understanding of anthropological issues. Moreover, both their anthropological analyses take full account of the work of Sigmund Freud. In (...) spite of these resemblances, their respective interpretations of the current image of man are complete opposites. I shall work out this opposition in three different steps. In the first section of this article, I shall go into Rorty's interpretation of the Freudian image of man. In the second section I shall present the Girardian image of man, which, to a certain extent, he has worked out in answer to the Freudian one. Eventually, in the third section, I shall confront both forms of current anthropology, situate Girard's early writings within the context of his entire oeuvre and put forward a few critical remarks with regard to his anthroplogical presuppositions. We analyse the development of Fair Trade in Italy by examining its principles, structure, performance, dilemmas and potential solutions and identifying its main distinctive features. These lead us to develop a specifically Italian model. Fair Trade in Italy is younger than its more established North European counterparts and more focussed on broad social justice issues in addition to its concern to include marginalized producers. This normative difference has given rise to a social-economy-dominated value chain, although it has generated much lower (...) per capita consumption of Fair Trade products. At the same time, we also observe a relatively higher specialization in handicraft products and educational activities as well as a strong capacity to attract voluntary labour and create social capital. We identify clear trade-offs between social goals and the economic performance of the Italian model: reduced economies of scale, a closer focus on non-economic-value-creating social activities and greater consideration of values such as consumption sobriety and environmental concerns which may conflict with economic performance. We propose solutions which may resolve these dilemmas without abandoning the initial ambition not only to achieve the promotion of market access for marginalized producers in the South, but also to pursue a broader concept of well-being in the North and the South.
