In 2006, United Nations Human Rights Council was tasked to establish a new human rights monitoring mechanism: Universal Periodic Review process. The objective of this process is to promote and protect the universality of all human rights issues and concerns via a dialogical peer review process. The primary aim of this investigation is to ask the following question: has this claim of promoting and protecting the universality of the human rights been met, or challenged, during state reviews in the UPR (...) process? The issue of polygamy has been selected as the focus for this investigation to be used, primarily, as a tool to undertake an in-depth analysis of the discussions held during state reviews in the review process. In addition, this paper will employ scholarly debates between universalism and cultural relativism, as well as the sophisticated and nuanced approaches that fall in between the polarised opposites, to analyse the discussions held on human rights during state reviews. Ultimately, the findings and discussion of this investigation will provide a unique and valuable insight to the work and operation of the UPR process, so far. (shrink)

This article explores what ignorance feels like from the subjective side of a knower in the Madhyamaka Buddhist tradition (...) through an analysis of epistemic affect. I borrow two affective concepts—"epistemic emotion" and "epistemic feeling"—from theorists in Anglo-American analytic epistemology to discuss affectively charged misknowing.2 In this literature, epistemic emotions are affective experiences that participate in a knower's epistemic activity in positive or negative ways, but are not necessary for that activity to proceed. In contrast, epistemic feelings are affectively qualitative experiences that are integral to a knower's activity. With a focus on texts by Nāgārjuna, I present fear as a paradoxical epistemic emotion that correlates with a similarly pathogenic and instigative function in Buddhist moral psychology. I then present determinacy as a more subtly operating epistemic feeling in reificatory ignorance. In addition to expanding epistemologically oriented discussions within Buddhist philosophy, this article also contributes to scholarly discussion of epistemic affect by introducing determinacy as a new epistemic feeling. [End Page 44]Diffuse and Complex IgnoranceThe central role of ignorance in formulating the problem of suffering and its cessation implies that in many ways all of Buddhism is interested in how we know and understand. This centrality is evident in the Avijja Sutta when the Buddha states:Bhikkhus, ignorance is the forerunner in the entry upon unwholesome states, with shamelessness and fearlessness of wrongdoing following along. For an unwise person immersed in ignorance, wrong view springs up. For one of wrong view, wrong intention springs up. For one of wrong intention, wrong speech springs up. This is especially the case in the early works of the critical project of Madhyamaka ("Middle Way") philosophy by Nāgārjuna. The bulk of these works presents arguments against any ignorant metaphysics that essentializes existents in efforts to claim epistemic access to an objective ultimate reality. This article argues that through a certain way of reading Madhyamaka philosophical texts, we find helpful information for recognizing what ignorance feels like. I develop the phenomenology of epistemic emotions and feelings that coincide with the ignorant practices centrally targeted by Madhyamaka critical analysis.The encompassing scope of ignorance motivates us to conceive of it as entangled with a range of elements, including the affective components of knowing. It should not be possible to read nineteenth-century British literature without remembering that imperialism, understood as England’s social mission, was a crucial part of the cultural representation of England to the English. The role of literature in the production of cultural representation should not be ignored. These two obvious “facts” continue to be disregarded in the reading of nineteenth-century British literature. This itself attests to the continuing success of the imperialist project, displaced and dispersed into more modern forms.If these “facts” (...) were remembered, not only in the study of British literature but in the study of the literature of the European colonizing cultures of the great age of imperialism, we would produce a narrative, in literary history, of the “worlding” of what is now called “the Third World.” To consider the Third World as distant cultures, exploited but with rich intact literary heritages waiting to be recovered, interpreted, and curricularized in English translation fosters the emergence of “the Third World” as a signifier that allows us to forget that “worlding,” even as it expands the empire of the literary discipline.1[…]In this essay, I will attempt to examine the operation of the “worlding” of what is today “the Third World” by what has become a cult text of feminism: Jane Eyre.2 I plot the novel’s reach and grasp, and locate its structural motors. Prior research suggests that the media plays an important information intermediary role in capital markets. We investigate the role of the media in influencing firms’ engagement in corporate social responsibility activities. Using a large sample of 4396 unique firms from 42 countries over the period 2003–2012, we find strong evidence that firms engage in more CSR activities if located in countries where the media has more freedom. This relation is robust to using various proxies for media freedom, an alternative source (...) of CSR data, and to applying the instrumental variables approach to address endogeneity. In additional analyses, we find that the positive relation between media freedom and CSR engagement is stronger for better governed firms and for larger firms. Since the media have the ability to impact reputational capital, we conclude that media freedom affects firms’ incentives to engage in costly CSR activities. (shrink)

The popularity of ‘food sovereignty’ to cover a range of positions, interventions, and struggles within the food system is testament, above all, to the term’s adaptability. Food sovereignty is centrally, though not exclusively, about groups of people making their own decisions about the food system—it is a way of talking about a theoretically-informed food systems practice. Since people are different, we should expect decisions about food sovereignty to be different in different contexts, albeit consonant with a core set of principles (...) (including women’s rights, a shared opposition to genetically modified crops, and a demand for agriculture to be removed from current international trade agreements). In this paper we look at the analytical points of friction in applying ideas of food sovereignty within the context of Indigenous struggles in North America. This, we argue, helps to clarify one of the central themes in food sovereignty: that it is a continuation of anti-colonial struggles, even in post-colonial contexts. Such an examination has dividends both for scholars of food sovereignty and for those of Indigenous politics: by helping to problematize notions of food sovereignty and postcoloniality, but also by posing pointed questions around gender for Indigenous struggles. Femicide is an ongoing public health and human rights crisis of global proportions. Currently, however, there is a relative vacuum of ethics theory and discussion about femicide amongst the health professions. This article draws from three illustrative case examples along the continuum of femicide to explore contemporary ethical concerns relevant to addressing gender-based violence and death through clinical medicine and public health. Lévinas is the generic name associated with such a position. A beautiful passage from Otherwise than Being lays it out, although neither interruption nor postponement (...) is mentioned. That connection is made by Derrida [Adieu 51-59].Here, then, is Lévinas, for whom Kant's critical perspectivization of the subject and the rigorous limits of pure theoretical reason seem to have been displaced by the structuralist hermeneutics of suspicion. For Lévinas, structuralism did not attend to what in Kant was the mechanism that interrupted the constrained and rigorous workings of pure reason: "The interests that Kant discovered in theoretical reason itself, he subordinated to practical reason, become mere reason. It is just these interests that are contested by structuralism, which is perhaps to be defined by the primacy of theoretical reason" [Otherwise than Being 58; trans. modified].The relationship between the postponement of the epistemological in Lévinas and the subordination of pure reason in Kant is a rich theme, beyond the scope of this essay. Let us return to what Lévinas will perceive as a general contemporary hermeneutics of suspicion, related to the primacy of theoretical reason: "The suspicions engendered by psychoanalysis, sociology and politics weigh on human identity such that we never know to whom we are speaking and what we are dealing with when we build our ideas on the basis of the human fact."1 The political calculus thematizes this suspicion into an entire code of strategy defined as varieties of game theory and rational choice. This can be verified across cultural difference, backwards through history, and in today's global academic discourse. Over against this Lévinas posits the ethical with astonishing humility: "but we do not need this knowledge in the relationship in which the other is the one next to me [le prochain]" [Otherwise 59].Kant thought that the ethical commonality of being (gemeines Wesen—repeatedly mistranslated as "the ethical state") cannot form the basis of a state. Surprisingly, there is a clear line from the face-to-face of the ethical to the state in Lévinas.2 It has long [End Page 17] been my habit to scavenge and tinker in the field of practical philosophy. I will conserve from Kant the discontinuity between the ethical and the political, from Lévinas the discontinuity between the ethical and the epistemological. I will suggest that the discontinuities between the ethical and the epistemological and political fields are tamed in the nestling of logic and rhetoric in fiction.3Enabled by such a suggestion, I can move to another bit of prose on that page in Lévinas: "for reasons not at all transcendental but purely logical, the object-man must figure at the beginning of all knowing."The figure of the "I" as object: this representation of the holy man in Lévinas does not match our colloquial and literal expectations. My general suggestion, that the protocol of fiction gives us a practical simulacrum of the graver discontinuities inhabiting (and operating?) the ethico-epistemic and the ethico-political, can, however, take such a figure on board. I will continue to want to say that fiction offers us an experience of the discontinuities that remain in place "in real life." That would be a description of fiction as an event—an indeterminate "sharing" between writer and reader, where the effort of reading is to taste the impossible status of being figured as object in the web of the other. Genotoxic stress leads to DNA damage which can be detrimental to the cell. A well‐orchestrated cellular response is mounted to manage and repair the genotoxic stress‐induced DNA damage. Our understanding of genotoxic stress response is derived mainly from studies focused on transcription, mRNA splicing, and protein turnover. Surprisingly not as much is understood about the role of mRNA translation and decay in genotoxic stress response. This is despite the fact that regulation of gene expression at the level of mRNA translation (...) and decay plays a critical role in a myriad of cellular processes. This review aims to summarize some of the known findings of the role of mRNA translation and decay by focusing on two categories of examples. We discuss examples of mRNA whose fates are regulated in the cytoplasm and RNA‐binding proteins that regulate mRNA fates in response to genotoxic stress. (shrink)

This study examines the endogenous relation between corporate social responsibility and tax avoidance by focusing on a common strategy of corporate tax avoidance, i.e., establishing entities in offshore tax havens. Using hand-collected data on a sample of U.S. firms, we find that firms’ CSR ratings increase substantially in the two years after they first open tax haven affiliates. We provide evidence by using the controlled foreign corporations look-through rule enacted by Congress in 2006 that facilitates offshore profit shifting. We find (...) that firms that are affected by the CFC legislation increase their CSR practices in response. Overall, our results are consistent with the risk management theory, which argues that firms hedge against the potential negative consequences of aggressive tax avoidance practices through an increase in positive CSR activities. This article describes a representation-based framework of distributed cognition. This framework considers distributed cognition as a cognitive system whose structures and processes are distributed between internal and external representations, across a group of individuals, and across space and time. The major issue for distributed research, under this framework, are the distribution, transformation, and propagation of information across the components of the distributed cognitive system and how they affect the performance of the system as a whole. To demonstrate the value of (...) this representation-based approach, the framework was used to describe and explain an important, challenging, and controversial issue — the concept of affordance. We contribute to the literature on intentions to report wrongdoing by examining whether Chinese internal auditors make consistent judgments when an ethical dilemma is presented in English and when the same dilemma is presented in Chinese. We invoke cultural frame switching theory, and our findings, which are based on a randomized experiment using between-subjects and within-subject mixed design, support the hypothesis that Chinese internal auditors are more likely to report wrongdoing when the ethical dilemma is presented in English than when (...) it is presented in Chinese. Our results, which demonstrate that internal auditors make inconsistent ethical judgments in English and Chinese, point to language-triggered cognitive bias resulting from cultural mindsets. We suggest practical interventions and language strategies to improve audit quality. (shrink)

Recent media articles have stirred controversy over anecdotal reports of medical students practising educational pelvic examinations on women under anaesthesia without explicit consent. The understandable public outrage that followed merits a substantive response from the medical community. As medical students, we offer a unique perspective on consent for trainee involvement informed by the transitional stage we occupy between patient and physician. We start by contextualising the role of educational pelvic examinations under anaesthesia (EUAs) within general clinical skill development in medical (...) education. Then we analyse two main barriers to achieving explicit consent for educational pelvic EUAs: ambiguity within professional guidelines on how to operationalize ‘explicit consent’ and divergent patient and physician perspectives on harm which prevent physicians from understanding what a reasonable patient would want to know before a procedure. To overcome these barriers, we advocate for more research on patient perspectives to empower the reasonable patient standard. Next, we call for minimum disclosure standards informed by this research and created in conjunction with students, physicians and patients to improve the informed consent process and relieve medical student moral injury caused by performing ‘unconsented’ educational pelvic exams.
