The consilia which will be examined here were written in the vicinity of the papal Rota at Avignon by Oldradus da Ponte. Educated at Bologna, he appears to have arrived at the Lateran in the entourage of Peter Colonna just before the Colonna fled from the wrath of Boniface VIII, and after a short spell as assessor for the Capitano del Popolo at Bologna and then as a teacher at Padua, to have migrated to Avignon where he was still active (...) in 1337. Initially, Oldradus' consilium 69 will be examined on the assumption that even a document which has long been described as �famous�, �important�, �celebrated� and �interesting�, will reward reconsideration. It will be argued that Oldradus did in fact sound a discordant note which failed to harmonizewith what has been presented as a contemporary consensus, namely that Justinian's legislation ought to be treated with a �veneration similar to that accorded to Holy Scripture�. This will be followed by a broader analysis of the deployment and nature of biblical and other extra-legal authorities in his consilia. Understanding Peirce requires dealing with Peirce's religious concerns, which are increasingly recognized as being as philosophically relevant as his scientific concerns. In recent times, even Peirce's regular religious practice in his Milford years has been documented (L 244), including, at least occasionally, week-day Eucharist services, which were "the hallmark of Tractarian or Anglo-Catholic parishes". -/- I have argued elsewhere that for Peirce, scientific activity is a genuine religious enterprise, perhaps even the religious activity par excellence, and that to divorce religion (...) from science is antithetical to both the scientific spirit and the genuine Peirce. In this vein, I have also held that Peirce's framework for the relations between science and religion, reason and faith, seems congenial to the Roman Catholic tradition. Perhaps the strongest conflict between Peirce's view on science and Roman Catholic faith may be epitomized in the dogma of papal infallibility, declared by the Vatican Council I and Pius IX on July of 1870, only eleven weeks before Peirce's first visit to Rome. Since the first moment, papal infallibility has been a permanent object of mockery and derision in the cultivated circles of Anglo-American intellectuals. As the late Rorty wrote, Pius's decision "was making Catholicism look ridiculous". -/- In this broad framework, the aim of my paper is to provide some context for Peirce's letter about papal infallibility, as the doctrine was presented by his former colleague George M. Searle in his 1895 book "Plain Facts for Fair Minds", which Peirce came across almost by chance. According to Peirce, there is a deep contrast between the genuine scientific attitude and the putative metaphysical notion of 'absolute truth' that was behind Searle's defense of infallibility. "I would with all my heart join the ancient church of Rome if I could. But your book," —Peirce writes to Searle (L 397) — "is an awful warning against doing so." -/- In order to explain Peirce's position, the paper is arranged into four sections: 1) a brief presentation of George M. Searle and his book Plain Facts for Fair Minds; 2) a description of Peirce's letter to Searle; 3) Peirce's fallibilism and infallibility; and 4) an attempt to guess how Searle might have responded to Peirce. I will try to collect some of Peirce's texts and to quote them extensively, since it is possible to learn a lot from the exploration of this debate. (shrink)

George M. Searle (1839-1918) and Charles S. Peirce worked together in the Coast Survey and the Harvard Observatory during the decade of 1860: both scientists were assistants of Joseph Winlock, the director of the Observatory. When in 1868 George, a convert to Catholicism, left to enter the Paulist Fathers, he was replaced by his brother Arthur Searle. George was ordained as a priest in 1871, was a lecturer of Mathematics and Astronomy at the Catholic University of America, and became the (...) fourth superior general of his congregation from 1904 to 1909. Among the books he wrote for non-Catholic audiences was Plain Facts for Fair Minds (1895). On the 8th of August of 1895, Peirce found that book in a bookstore and the following day wrote a letter to George Searle developing his strong reservations about the question of the infallibility of the Pope. This letter (L 397) is almost unknown amongst Peirce's scholars. -/- After describing these historical circumstances as a framework, the aim of my paper is to describe Peirce's arguments against papal infallibility presented by George Searle in his book, and the contrast between the genuine scientific attitude and the putative metaphysical notion of absolute truth that is —according to Peirce— behind Searle's defense of infallibility. In this sense, Peirce's fallibilism will be explained with some detail, giving an account also of his practical infallibilism: "The assertion that every assertion but this is fallible, is the only one that is absolutely infallible. But though nothing else is absolutely infallible, many propositions are practically infallible; such as the dicta of conscience" (Minute Logic, CP 2.75, c. 1902). -/- Finally, having in mind the present interest in Peirce's religious ideas it will be suggested that some of Peirce's ideas on infallibility are nearer to contemporary understanding of that issue than Searle's defense. This defense of my essay on Vitoria and Suárez argues that my use of the term “religious war” is based on religious authority at least as much as religious cause, and that Davis’s decision to discuss only Vitoria limits his ability to come to terms with my thesis. To Davis’s argument that for Vitoria war was justified against the Indians only as a necessity of simple justice and to protect the innocent, I argue that his disjunction between simple justice and (...) religious cause is a false one that fails to come to term with the church’s primary reason for approaching Indians, with the Thomistic understanding of the relation between nature and grace and between reason and revelation, and with the distinction between what justice requires in relation to the church and Christians and what it requires for others. I explain finally that my claim is not that the Catholic political rulers readily responded to papal calls for war except when it was in their interest, but that papal war was central to the normative just‐war tradition of the church in canon law and among major theologians like Vitoria and Suárez. In this essay I would like to outline the Christian perspective on solving economic issues based on documents of the Catholic Church. The term ‘economic personalism’ appeared in literature several years ago and has been used as a proposal of a new economic model which is supposed to be a synthesis of achievements of economic sciences and Christian moral theology. Pope John Paul II is believed to be one of its precursors or even founding-fathers. We shall sum up these significant (...) elements of papal personalism under the following heads: (1) A man is a person, namely an independent existence in material and personal, spiritual and material sense, rational and free. All these characteristics of a human being constitute a basis for his dignity and greatness; (2) A man is a free being. This means that he has to make choices between various values. Human freedom is closely related to the truth. The final objective of human freedom is love; (3) We can protect ourselves against alienation by acting and being together with others. We will avoid the danger of alienation when we make ourselves a gift for the other person and especially for God. Economic personalism develops John Paul II’s personalistic view in a creative way. Its program can be summarized by the following theses: (1) a man is the centre of economy; (2) a human being is the most important economic good; (3) work is part of the man’s calling; (4) reproducibility of goods is subordinated to the man’s integral development; (5) the right to participate constitutes inalienable human right; (6) the principle of subsidiary is an „intellectual” frame for social and economic order; (7) the market should not be absolutized; (8) solidarity with the poor and social justice constitute a basis of each economy. While Walls to Bridges is a broad and comprehensive work, the actualization of a Global Ethic is concrete-not abstract. Professor Küng's vision into the future, built on the expanding Global Ethic is an inspiring read and a call to action for all. What is similar among the world's religious ideologies? What's next in the evolution of the global ethic? Professor and theologian Hans Küng has devoted much of his life to answering these questions. Küng achieved global notoriety in the 60's (...) when he became the first major Roman Catholic theologian of the 20th century to question the notion of papal infallibility. For this, he was stripped of his license to teach as a Roman Catholic theologian but continued teaching as a tenured professor of Ecumenical Theology at the University of Tübingen, Germany. In the 1990s, Küng initiated a project subsequently referred to as the Movement for a "Global Ethic." After massive world-wide research into past and present ethical principles, he spelled out clearly the foundational ethical principles that the world's religions and ideologies, past and present, de facto held/hold in common, that is: The minimal code of behavior that everyone in fact accepts (e.g., "Do not lie, steal, kill innocent persons....") This English translation of The Global Ethic Handbook is a culmination of the "Movement" Küng began in the 90s. He describes his vision for a Global Ethic and takes the reader through the essential aspects of a Global Ethic, including its social, political, legal, economics, communications, esthetics, and philosophical applications. It even describes his translation of the Global Ethic/Weltethos into musical compositions-indeed, a full-blown opera! (shrink)

The basis of the Periodic Table is discussed. Electronic configuration recurs in only 21 out of the 32 groups. A better basis is derived by considering the highest classical valency (v) exhibited by an element and a new measure, the highest valency in carbonyl compounds (v*). This leads to a table based on the number of outer electrons possessed by an atom (N) and the number of electrons required for it to achieve an inert (noble) gas configuration (N*). Periodicity of (...) these is nearly complete. The new basis helps to settle the question of the best form of table and related issues. (shrink)

This work reviews and critically evaluates contemporary American Catholic moral theological reflections, both non-magisterial and magisterial, from 1975 to the present. It also considers relevant reflections from papal and papally related literature, and from the older tradition. It examines the following: criteria used in distinguishing between "ordinary" and "extraordinary" means, e.g., benefit and burden; miscellaneous elements employed in regard to these means, e.g., treatment and care; definitions given for these means. Based on the results of the foregoing, it proposes original (...) working definitions of these two main types of means. ;This work confirms the need, already recognized by some moral theologians, for a broad foundational criterion on which to base contemporary definitions of and distinctions between "ordinary" and "extraordinary" means. It finds the criteria offered thus far to be suggestive but flawed. Accordingly, its own working definitions are grounded in a foundational criterion of "integral human fulfillment in Jesus," a concept taken from the fundamental moral theological system developed by Germain Grisez. A simple way of introducing the theory of relativity to chemistry students is presented. This is based on experimental observations of the variation in the mass of an electron with speed. Analysis of these generates the equations chemists use, and provides a basis for critical discussion of the theory.

Does action always arise out of desire? G. F. Schueler examines this hotly debated topic in philosophy of action and moral philosophy, arguing that once two senses of "desire" are distinguished - roughly, genuine desires and pro attitudes - apparently plausible explanations of action in terms of the agent's desires can be seen to be mistaken. Desire probes a fundamental issue in philosophy of mind, the nature of desires and how, if at all, they motivate and justify our actions. At (...) least since Hume argued that reason "is and of right ought to be the slave of the passions," many philosophers have held that desires play an essential role both in practical reason and in the explanation of intentional action. G. F. Schueler looks at contemporary accounts of both roles in various belief-desire models of reasons and explanation and argues that the usual belief-desire accounts need to be replaced. Schueler contends that the plausibility of the standard belief-desire accounts rests largely on a failure to distinguish "desires proper," like a craving for sushi, from so-called "pro attitudes," which may take the form of beliefs and other cognitive states as well as desires proper. Schueler's "deliberative model" of practical reasoning suggests a different view of the place of desire in practical reason and the explanation of action. He holds that we can arrive at an intention to act by weighing the relevant considerations and that these may not include desires proper at all. (shrink)

Given the sordid history of injustices linking genetics to race and ethnicity, considerations of justice are central to ensuring the responsible development of precision medicine programmes around the world. While considerations of justice may be in tension with other areas of concern, such as scientific value or privacy, there are also tensions between different aspects of justice. This paper focuses on three particular aspects of justice relevant to this precision medicine: social justice, distributive justice and human rights. We describe the (...) implications of each for the use of race and ethnicity in precision medicine, and also how they intersect and potentially conflict with each another. By attending to these intersections, we aim to enrich and add nuance to debates over how best to proceed with precision medicine initiatives. (shrink)

The paper explores the possible contribution of Familiaris consortio to a contemporary theology of marriage. It argues that the exhortation and its author, Pope John Paul II, may be credited for two major innovations in the magisterial teaching: first, in taking its starting point from the human person and her capacity to love, the document has definitely overcome the earlier view, clearly articulated e.g. in Pius XI’s encyclical Casti connubii, which looked at marriage primarily in terms of a natural institution (...) and only in a second instance at its interpersonal value; second, it has attributed to marriage and the family a position in the mystery of salvation and consequently in the mission of the Church, which is unprecedented in previous teaching. However, by equating 'God’s plan for marriage' with the 'nuptial mystery of salvation' and by imposing onto human marital love the model of Christ’s total self-giving, the papal exhortation ultimately forfeits what it seemed to have gained in terms of a renewed theology of marriage: it ultimately fails to recognize that God’s salvific plan does not float above history but takes shape in the concrete lives of couples and families and that their lived experiences should therefore be given a place in theology and in the mission of the Church. This volume is a critical edition of the eight-year correspondence between Gottfried Wilhelm Leibniz and Burcher de Volder, professor of philosophy and mathematics at Leiden University. Containing the surviving correspondence between Leibniz and De Volder, the volume also presents a generous selection from the letters between Leibniz and his friend Johann Bernoulli, through whose intercession the correspondence began. Bernoulli acted as intermediary throughout, and the often candid discussions between Leibniz and Bernoulli provide illuminating background to the correspondence proper. John Buridan was a fourteenth-century philosopher who enjoyed an enormous reputation for about two hundred years, was then totally neglected, and is now being 'rediscovered' through his relevance to contemporary work in philosophical logic. The final chapter of Buridan's Sophismata deals with problems about self-reference, and in particular with the semantic paradoxes. He offers his own distinctive solution to the well-known 'Liar Paradox' and introduces a number of other paradoxes that will be unfamiliar to most logicians. Buridan also moves on (...) from these problems to more general questions about the nature of propositions, the criteria of their truth and falsity and the concepts of validity and knowledge. This edition of that chapter is intended to make Buridan's ideas and arguments accessible to a wider range of readers. Mark Henninger, Harvard University Press, 2013The ongoing and apparently interminable debate over the moral and legal status of abortion has come over the years to resemble the Western front in World War I, with two contending armies facing each other with limited maneuvering (...) room, familiar and overused weapons, periodic artillery barrages, increasing casualties, not much new to report, and a deadly ‘no man’s land’ between them in which virtually nothing survives. Against the gloomy monotony of the abortion wars, in which reductivist accounts of the opponents’ views and repetitious restatements of familiar and cherished views predominate, this book by Fabrizio Amerini, a professor of philosophy at the University of Parma, appears as a refreshing surprise. It is surprising for a number of reasons, which I shall present later. But its refreshing character comes primarily from its moderate tone and the care with which its arguments are presented. Amerini is clearly familiar with the Catholic tradition on abortion and euthanasia; he is respectful of this tradition, which he does not directly challenge, but his sense of scholarly integrity prevents him from simply presenting Aquinas as a defender and synthesizer of all the positions championed in that tradition or by its papal custodians. He has an impressive command of the relevant texts in Aquinas and the Fathers of the Church, which he joins with a scrupulous style of [End Page E-103] philosophical argument which has an affinity with the clarifying labors of G. E. Moore in the early days of analytic moral philosophy. The result is not easy reading, but the reader can be confident that the desire to score rhetorical points and political victories will not distort the philosophical and historical analysis. The book is intended primarily for those who can benefit from careful scholarship, but it should be instructive for all who regard the questions of abortion and euthanasia as genuinely difficult and as deserving our best intellectual efforts.The most important surprise is Amerini’s focus on the issue of delayed versus immediate hominization in the development from embryo to complete human being. Since Pius IX in 1867, the Vatican has insisted that from the moment of conception the embryo becomes a human person whose life is sacred and deserves full protection. This view is ordinarily discussed as ‘immediate hominization’. In Amerini’s view, the embryo lacks the development and differentiation of organs which would enable it to have a sustainable potentiality to perform the acts which are proper to a human person, particularly reasoning and choosing. In the Vatican’s view, the soul is immediately infused by God, though it obviously requires many years of development before it is able to function as a complete and distinct human person. Amerini regards this position as untenable within Aquinas’s metaphysical system and finds in Aquinas’s own texts evidence that he teaches a discontinuous process in fetal life. The paper explores the possible contribution of Familiaris consortio to a contemporary theology of marriage. It argues that the exhortation and its author, Pope John Paul II, may be credited for two major innovations in the magisterial teaching: first, in taking its starting point from the human person and her capacity to love, the document has definitely overcome the earlier view, clearly articulated e.g. in Pius XI’s encyclical Casti connubii, which looked at marriage primarily in terms of a natural institution (...) and only in a second instance at its interpersonal value; second, it has attributed to marriage and the family a position in the mystery of salvation and consequently in the mission of the Church, which is unprecedented in previous teaching. However, by equating 'God’s plan for marriage' with the 'nuptial mystery of salvation' and by imposing onto human marital love the model of Christ’s total self-giving, the papal exhortation ultimately forfeits what it seemed to have gained in terms of a renewed theology of marriage: it ultimately fails to recognize that God’s salvific plan does not float above history but takes shape in the concrete lives of couples and families and that their lived experiences should therefore be given a place in theology and in the mission of the Church. Felicitas Munzel challenges this reading of Kant's thought, claiming not only that Kant has a very rich notion of moral character, but also that it is a conception of systematic importance for his thought, linking the formal moral with the critical, aesthetic, anthropological, and biological aspects of his philosophy. The Encyclical also, however, associates this perspective wjth that of the commandments when it cites the response of Jesus, who, after having invited the rich man to turn his gaze toward the One who alone is good, directs the young man to observe the Decalogue. Then-contemporary (...) (e.g., John Henry Newman and the Tübingen school) and subsequent (e.g., Yves Congar and Henri de Lubac) theologians' theories that were more thoroughly worked out presupposed this immutability.The argument here is simple: Dei Filius's teaching on the immutability of dogma not only did serve as the necessary foundation for any sound (i.e., Catholic) theory of doctrinal development, but continues to do so. While the teaching of Dei Filius itself is limited and incomplete, it is essential. The first, and perhaps most important, factor is the implication that Anton Günther's (1783–1863) understanding of faith and reason had on dogma and its immutability. The second factor is simply the fact that, in the midst of these pervasive philosophical and theological disputes over faith and reason, Pius IX not only managed to define the Immaculate Conception as dogma, but did so by papal definition: the 1854 definition was the freshest example of what would later be defined in 1870.1 A brief examination of the thought of Günther will help us better understand why the paragraph on development (i.e., the immutability and progress of dogma) pertains to the faith–reason relationship and, hence, appears in the fourth chapter. 2Günther's major concern is a noble one: namely, to respond to the Kantian critique of supernatural religion. To do so, he sees it as necessary not only to defend rationally but also to explain rationally—according to the philosophical systems of Schelling and Hegel—Christian dogma. Günther is no brash and pure rationalist. He believes in the history of supernatural revelation. In their recent article, Koplin, Gyngell and Savulescu (2019) assess the viability of the precautionary principle as a decision-making tool to determine whether and under what circumstances germline gene editing should proceed. While their survey of different forms of the precautionary principle is illuminating, the most novel contribution is a new account of the precautionary principle, what they dub the Sufficientarian Precautionary Principle (SPP). SPP is meant to avoid several problems with existing accounts, while comporting with at least some of (...) the intuitive force behind the general idea of the precautionary principle. However, as it is only one subsection of a larger paper, SPP is not fully worked out. In this brief response, I will flesh out some problems with SPP as a decision-making tool – particularly that there is a lack of adequate normative justification for adopting it. While this does not constitute a decisive refutation of the approach, SPP needs considerable refinement and clarification before it can be considered viable for use in decision-making. (shrink)

Philosophers and logicians have long debated how best to understand conditional or hypothetical sentences. William G. Lycan has a distinctive approach to this debate, attending not just to the semantics of such sentences, but equally to their syntax. He shows how insights from linguistic theory help to illuminate problems about the meaning and function of conditionals. For instance, philosophers and logicians have had problems analysing the locutions 'only if', 'unless', and 'even if'. “THE ONLY THING NECESSARY IS NOT THEORETICAL LEARNING, but the Bildung of human beings, both in regard to their talents and their character.” Kant’s epigrammatic observation in his 1778 letter to Christian Wolke, director of the Philanthropin, adumbrates not only his mature sense of “enlightenment” but also the pedagogical role of his critical philosophy and his own life’s work. Over a decade earlier, his reading of Rousseau’s Emile: or, On Education had “set him straight” about what constitutes the true dignity (...) of humanity, namely, that it did not consist in the advance of knowledge by scholarly inquiry as he had believed. The primary thing was, instead, the “restoration of the rights of humanity,” an objective articulated in Kant’s mature moral thought as that pedagogical method which facilitates the self-consciousness and efficacy of the moral law in the individual. In another 1778 letter, this time to his former student, Marcus Herz, Kant states that the “main purpose of his academic life,” which he “at all times keeps before him,” is to “cultivate good characters.” In both his lectures on anthropology and on pedagogy, Kant repeatedly emphasizes the need for education and, by extension, for attending to the education of the educator. Human beings are nothing save what education makes of them, but they can only be educated by other human beings who must themselves first be educated. As early as his 1775/ 76 anthropology lectures, Kant observes that “if teachers and priests were educated, if the concepts of pure morality would prevail among them, then... the whole could afterwards be educated.” The resulting task is clear: it is incumbent on every generation to work on the plan of a more purposive education,” a task Kant describes as the “greatest and most difficult problem that can be assigned to humankind.”.
