The starting point for this paper is the ongoing debate about the relation between research and policy in education. Recent developments in England and Scotland are reviewed in the context of political and academic arguments about the nature and function of research activity. The defensiveness of the research community in the face of professional and political attacks is examined critically. A case study of the Higher Still programme is used to illustrate the complexity of the relationships between evidence, ideology, values (...) and professional practice. It is argued that the research community needs to become more politically sophisticated and to advance a clearer vision of its social function in advanced democratic societies if its potential contribution to educational development is to be realised. The dangers of a retreat to a narrow empirical role are highlighted. (shrink)

Under the umbrella of the burgeoning neurotransdisciplines, scholars are using the principles and research methodologies of their primary and secondary fields to examine developments in neuroimaging, neuromodulation and psychopharmacology. The path for advanced scholarship at the intersection of law and neuroscience may clear if work across the disciplines is collected and reviewed and outstanding and debated issues are identified and clarified. For a long time, the transcendental dialectic was not at the center of Kant scholarship but was often treated simply as Kant’s reckoning with contemporary metaphysics. Accordingly, the main interest was in the transcendental analytic, especially the transcendental deduction. It is all the more gratifying that in recent times a rethinking seems to be taking place on this issue. In the following, I shall attempt to show why the transcendental dialectic is something more than an addendum to the core (...) business of the Critique of Pure Reason. Rather, it forms the culmination of the work, demanding our full attention. Indeed, it provides the key to the entire critical philosophy by exhibiting reason itself as the ultimate founding principle in the form of its Idea. (shrink)

Drawing inspiration from this scholarship, the article highlights the significance of the Indian subordinates in the lock hospital system in the nineteenth century Madras Presidency. This study focuses on a class of Indian subordinates called the “gomastah”, who were (...) employed to detect clandestine prostitution in Madras to control the spread of venereal disease. It also underlines the role of other native and non-native subordinates such as Dhais, Chowdranies and Matrons, the ways in which they became indispensable for the smoother operation of the Contagious Diseases Act and the lock hospitals on a day-to-day basis. By emphasising how Indian subordinates were able to bring in caste biases within colonial governmentality, adding another layer to the colonial prejudices and xenophobia against the native population, it underlines the fact that there was not a one-way appropriation or facilitation of the coloniser’s knowledge or biases by the colonised intermediaries. Rather, it argues for an interaction between them, and highlights the complexities of caste hierarchies and prejudice within the everyday colonial governmentality. The dual career allows elite athletes to attain their maximum competitive and academic performance, but the COVID-19 pandemic hindered their development and changed their perception of the importance given to the sporting and educational environment. For this reason, the aim of the present study was to determine the differences in the motivations and perceived barriers, the importance given to academic qualifications, and the perception of the dual career from a multifactorial perspective, of elite athletes according to sex, type of sport (...) practiced, job performance, time of sports career, type of athlete, and type of scholarship received. A total of 100 student-athletes participated in the research study by completing the “Perceptions of dual career student-athletes” questionnaire. The results showed that athletes from individual modalities and those who did not receive any scholarships described more barriers. In addition, women studied more because they enjoyed it ; athletes from individual modalities studied to work later ; athletes who do not work perceived a greater influence between study and sports performance ; at the beginning and at the best stage of their sports career, a greater influence of academics on performance was perceived ; and athletes who considered themselves professionals, and athletes who did not receive any scholarships, reported that the conciliation between sports and academic life was difficult. The results obtained point to the importance of dual career scholarships for student-athletes, as well as the need for the programs implemented for these athletes to consider sex, sport modality or type of scholarship granted. Often, a more or less universal quality is attributed to certain legal concepts. For refugee scholars working between 1933 and 1945, the universal quality of these concepts was challenged on two fronts: first, the breaking down of the Weimar Constitution and the German Rechtsstaat under Nazi rule demonstrated the fragility of a constitutional and legal order. Moreover, the breakdown of the German Rechtsstaat was felt on a deeper conceptual level. ‘Immutable’ legal concepts turned out to be easily mutated to conform (...) to Nazi ideology. The second major challenge to the universality of concepts thus pertains to the universal characteristics of the ‘concept of a concept’ itself. In brief, what German refugee legal scholars attempted to create in the course of the 1930s and 1940s was a ‘universal’ Rechtsstaat centred around concepts and legal scholarship that would avoid the breakdown by placing it into a feasible and balanced system of legal enforcement on an international level. Thus, in their new academic context, rather than dismissing the Rechtsstaatliche function of legal concepts and the role of legal scholars, refugee scholarship ventured to enhance it. This contribution argues that the development of Hersch Lauterpacht’s concept of human rights constitutes such an enhancement. (shrink)

This book is about the use of legal scholarship by judges. It discusses the possibility that legal scholarship may function as a genuine source of law in modern municipal legal systems. The book advances a number of claims, some conceptual, some empirical, some normative. The major conceptual claims are found in Chapters 2 and 3, where a general account of the notion of a source of law is provided. Roughly, sources of law are documents or practices (e.g. statutes, (...) judicial decisions, official customs) from which norms can be derived that function as sources of content-independent reasons for judges to decide legal cases one way or another. The relevant notion of content-independence is derived (with qualifications) from H.L.A. Hart's jurisprudence. Indeed, the book's analysis of the concept of a source of law relies at various points on Hartian insights about law and legal reasoning. Chapter 4 argues that legal scholarship - or, more precisely, a particular type of legal scholarship that might be described as standard or doctrinal - can be, and indeed is, used as a source of law in modern legal systems. The conclusion that legal scholarship is used as a source of law (and thus as a source of content-independent reasons for action) may come as a surprise to those who associate judicial recourse to legal scholarship with judicial activism. This association is discussed and criticized in Chapters 5 and 6. It is argued that, in spite of a relatively common opinion to the contrary, legal scholarship can be used to mitigate discretion. In fact, it is precisely because it can be used in this way that judges sometimes refer to scholarship deceptively and suggest that it limits discretion in situations in which it really does not. In this late modern era within which the basic values of life have been reordered (driven by globalisation, the corporate agenda and mass communication technologies), the individual has effectively been reduced to a mere abstraction. It might be argued that the rational, moral and humanistic concept of freedom has, to a great extent, been compromised by a consequent crisis within the intelligentsia. These groups, in particular the gatekeepers of a classical liberal approach to legal scholarship, are caught between the (...) twin evils of increased unreflective populism and pragmatism evident within many law schools and modern legal institutions. Although a contested term, defenders of the ‘socio-legal’ tradition, who place the humanities at the heart of legal research and education, are obliged to restate with increased determination the utility of the liberal arts and literature to the law profession and wider legal community. In a normative environment, law and narrative are inextricably linked and narrative poetry is not only invaluable to explaining the origins and location of the legal tradition, but also elicits a mode of understanding which transcends the boundaries of narrowlydefined legal hermeneutics—which often only addresses issues of an operational nature. French novelist Flaubert claimed “chaque notaire porte en soi les débris d’un poète” (Flaubert in Madame bovary (trans: Wall, G.), Penguin Classics, London, 1960: 269), paraphrased by American civil rights lawyer, Clarence Darrow, as “inside every lawyer is the wreck of a poet” (Lukas in Big trouble: a murder in a small western town sets off a struggle for the soul of America, Simon & Schuster, New York, 1997: 323). MarshallGiambattista Vico is one of those chameleon figures in the history of ideas who is so intellectually rich that he can be constantly reinvented. It is indicative of the rich ambiguity of his thought that two of the most prominent intellectual historians working today should have come to opposite conclusions about his relationship to the master-category of eighteenth-century intellectual history: for Mark (...) Lilla, Vico was a Counter-Enlightenment thinker; for Jonathan Israel, he was a figure in the Radical Enlightenment.1 Vico’s fungibility gives reason for pause. Someone who can be folded into all manner of intellectual projects may be suspect. But Vico is more colonizing than colonized and, thus, the diversity of his receptions is evidence of creativity, and not merely malleability. The only way to deal with Vico is to dive into the multiplicity of plausible interpretations and find in them the makings of a new line of inquiry. Vico’s moment of flourishing in the Anglophone world came initially in the 1960s and 1970s, but if the diversity and quality of receptions in the last five years is anything to go by then we can say that Vico remains—especially in Italian, French, and German— an intellectual historical provocateur.This review essay surveys such literature and makes a single recurring observation: the various specifications of Vico’s place in intellectual history come into alignment as dimensions of what one might term Vico’s reinvention of rhetoric. As a professor of rhetoric in a culture that possessed—for [End Page 141] the most part—very weak oratorical institutions, Vico found himself in a particularly paradoxical situation. Recent research on Vico suggests that this paradox worked itself out in Vico’s thought in a number of highly interesting ways. First, Vico constitutes an opportunity for intellectual historians of the scientific revolution by offering a simultaneously rhetorical and pragmatic gloss of the early modern logic of experiment. Second, for intellectual historians of religion, Vico constitutes a study in how early moderns could examine the rhetorical functioning of theological vocabularies without necessarily committing themselves to the independent existence of the referents of those vocabularies. Third, for intellectual historians of Enlightenment, Vico confirms that encyclopedism was not a merely French practice in the eighteenth century and that the kind of omnicompetence implicit in encyclopedic multidisciplinarity had roots in rhetorical criticism. Fourth, intellectual historians of Counter-Enlightenment cannot easily fold Vico into their narratives, in part because his legal works (which have been read as a call for cultural retrenchment in response to early modern skepticism) are in fact an account of how Greek rhetoric found its analogue in Roman jurisprudence. Fifth, for historians of the idea of language, Vico demonstrates that there were powerful alternatives in early modernity to the dominant contractualist account of the origin of language (offered by Hobbes, Locke, and others) that were rhetorical and yet did not emphasize the priority of speech over writing.When it appeared in 1961, Nicola Badaloni’s Introduzione a G.B. Vico was the most sophisticated attempt to locate Vico in the Neapolitan philosophical tradition. In many ways, it remains the best attempt at contextualizing a thinker who is notoriously difficult to situate among his contemporaries. In the paper “An archeology of corruption in medicine”, Miles Little, Wendy Lipworth, and Ian Kerridge present an account of corruption and describe its prevalent forms in medicine. In presenting an individual-focused account of corruption found within “social entities”, Little et al. argue that these entities are corruptible by nature and that certain individuals are prone to take advantage of the corruptibility of social entities to pursue their own ends. The authors state that this is not preventable, so the way (...) to remedy corruption is via management and, where necessary, punishment. This commentary will briefly lay out the key features and functions of corruption as presented by Little et al., before providing a critical discussion that will focus on whether corruptibility is a necessary feature of social entities. I will propose that it is not a necessary feature, though it may frequently arise where individualistic values are unchecked. Corruption can be prevented within social entities by enhancing structures that direct toward virtue and which promote and reward cooperation instead of competition. (shrink)

The aim of this paper is to examine, comparatively, women’s place within the political systems of Plato, Aristotle and Hegel from a brief sketch of their conceptions about human nature and feminine nature. It will be intended to indicate to what extent there is a relation, sometimes of tension, sometimes of complementarity, in the way descriptive and prescriptive elements function to circumscribe the space of women from the household private sphere, from Aristotelian and Hegelian perspectives, and how the subordination of (...) descriptive elements to prescriptive elements allow woman to ascend in the public sphere under the Platonic perspective. After tracing this sketch, it will be suggested how this tension, in the political philosophy of Hegel, will result, in a way, in an explicit denial of women's political rights and, in another way, in the possibility of envisioning civil and political equality between men and women from an internal and inherent device of the Hegelian system, the notion of “second nature” as ethical reposition of the natural. In modern physics, various fundamental problems have become topics of debate. There was the 20th century climb to a Standard Model, still accurate at the highest energy levels obtainable so far. But, since the 1970's, a different approach to physics advocates for theories such as string theory, known for their mathematical elegance, even though they either cannot be verified in data or contradict presently known experimental results. In philosophy of physics, there is a gradually emerging consensus that philosophy of physics (...) and physics somehow contribute to a common enterprise. But, there is little sign of progress toward consensus about the nature of that unity. All the while, it is generally recognized that physics is interdisciplinary. There are, of course, differences in focus. But, implicitly at least, there are no "sharp dividing lines" between physics and philosophy of physics; pure and applied physics; physical chemistry; biophysics; medical physics; history and philosophy of physics; physics and society; physics education; and so on. What, then, is progress in physics? The question here is not about ideal structures, but asks about what is going on in physics. Beginnings in discerning the presence of eight main tasks help reveal the (pre-) emergence of a normative omni-disciplinary basis for collaboration that, once adverted to, promises to be constitutive of a new and increasingly effective control of meaning. Originally discovered by Bernard Lonergan in 1965, progress in the new collaboration will not seek to eliminate specialized expertise. It will, though, divide tasks within an eightfold functional division of labor. This book invites attention to data for each of the eight main tasks evident and self-evident in existing scholarship in the community. (shrink)

While a growing body of scholarship identifies urban agriculture’s broad suite of benefits and drivers, it remains unclear how motivations to engage in urban agriculture (UA) interrelate or how they differ across cities and types of organizations. In this paper, we draw on survey responses collected from more than 250 UA organizations and businesses from 84 cities across the United States and Canada. Synthesizing the results of our quantitative analysis of responses (including principal components analysis), qualitative analysis of textual (...) data excerpted from open-ended responses, and a review of existing literature, we describe six motivational frames that appear to guide organizations and businesses in their UA practice: Entrepreneurial, Sustainable Development, Educational, Eco-Centric, DIY Secessionist, and Radical. Identifying how practitioners stack functions and frame their work is a first step in helping to differentiate the diverse and often contradictory efforts transforming urban food environments. We demonstrate that a wide range of objectives drive UA and that political orientations and discourses differ by geography, organizational type and size, and funding regime. These six paradigms provide a basic framework for understanding UA that can guide more in-depth studies of the gap between intentions and outcomes, while helping link historically and geographically specific insights to wider social and political economic processes. This article argues that the power of religion to shape experience presupposes the mobilization of religious identity through social opposition. This thesis is developed through a critique of George Lindbeck's The Nature of Doctrine. The article first examines Lindbeck's thesis that religion shapes experience in light of Talal Asad's critique of Geertz's concept of religion. It argues that in order to understand how ‘religion’ shapes experience we must look outside the immanent sphere of cultural‐religious meaning that Lindbeck, following Geertz, identifies (...) with ‘religion’. Religious authority ultimately derives from the recognition of a social group. Next, looking at the nature of doctrine in light of Kathryn Tanner's thesis that Christian identity is essentially relational, it argues that church doctrines function to mobilize group identity through social opposition. In this respect they resemble the mobilizing slogans of political discourse more than, as Lindbeck's theory proposes, the grammatical rules governing Wittgensteinian language games. (shrink)

Ideology and politics were among the dynamics that shaped the scholarly reception of Friedrich Hölderlin and his work from the 1920s to 1940s. By taking the examples of research reports by Adolf von Grolman, Johannes Hoffmeister, and Heinz Otto Burger as well as of the controversy between Wilhelm Böhm and Ludwig Strauß, we outline the reciprocal function of Hölderlin and the DVjs. In doing so, we specifically focus on Paul Kluckhohn’s role in Hölderlin research, not only as an editor but (...) also as a public speaker and academic promoter in politically turbulent times. The ritual handling of serpents remains an unnoticed cultural form for the explanatory aims and theoretical insights desired by cognitive scientists of religion. In the current article, we introduce the Hood and Williams archives at The University of Tennessee at Chattanooga that contains data culled from Hood’s 40-plus year career of studying serpent handlers. The archives contain hundreds of hours of interviews and recordings of speaking in tongues, handling fire, drinking poison, and taking up serpents by different congregants and congregations. (...) The archive remains a rich but untapped source of data for building, testing, and refining cognitive theories of ritual in general, and serpent handling in specific. We connect Hood’s work to current cognitive theories and engage critically with research on the social functions of ritual. In Mainland China, due to dominant status and decisive function of Marxism philosophy, philosophy has developed as the state ideology since the foundation of People’s Republic of China in 1949. However, since the 1990s the humanities and social sciences have been experiencing an obvious academic turn in Mainland China. The event first set in with a debate on academic norms and with the debate the academic norms have gradually become the mainstreamin Mainland China. In accordance with the division of disciplines (...) in Mainland China, philosophy as the first-level discipline is subdivided into eight second-level disciplines: Marxist philosophy, Chinese philosophy, foreign philosophy, logic, ethics, aesthetics, religion, and philosophy of science and technology. Roughly speaking, aesthetics, ethics and Marxist philosophy have a remarkable turn, while others just have a weak one. The turn signifies the achievement of the academic autonomy of philosophy in China; and the turn also means that philosophy scholars have realized their transition to professional status. (shrink)

Cognitive neuroenhancement involves the use of medical interventions to improve normal cognitive functioning such as memory, focus, concentration, or willpower. In this paper I give a Kantian argument defending the use of CNE in science, scholarly research, and creative fields. Kant’s universal law formulation of the categorical imperative shows why enhancement is morally wrong in the familiar contexts of sports or competitive games. This argument, however, does not apply to the use of CNE in higher education, scholarly or scientific research, (...) or creative endeavors such as visual art, fiction or poetry, or musical composition. This is because performance in these areas is embedded within practices that differ in morally significant ways from competitive practices. This important difference provides good reason to think that there is nothing morally wrong with the use of CNE in these areas. My approach is not simply to assume a full-fledged Kantian ethical theory and apply it straight away to the enhancement issue but to establish a reflective equilibrium between our moral intuitions, moral principles that support those intuitions, and the nature of the practices involved. Difficoltà nell’avanzamento e nel completamento diventano sempre più il centro dell’attenzione per tutti i tipi di dottorato. È stato riconosciuto che una serie di fattori al di là di quelli prettamente demografici potrebbe influire sulla possibilità di completare gli studi. C’è ancora molto da imparare sul motivo per cui l’avanzamento e il completamento del dottorato sono così impegnativi. In (...) questo articolo vorremmo mettere in evidenza un settore che sembra trascurato dalla ricerca: l’esperienza emotivamente complessa del percorso di dottorato.Offriamo un contributo al dibattito su ciò che è necessario per facilitare il successo e intrinsecamente un soddisfacente avanzamento all’interno di un programma di dottorato professionale. Noi sosteniamo che una maggiore attenzione debba essere prestata al cammino esperienziale di studenti di dottorato dal momento che essi hanno il difficile compito di integrare la loro vita personale, professionale e accademica. Il nostro interesse per le risorse emotive di cui gli studenti possono avvalersi durante il loro percorso di dottorato è iniziato con la progettazione e lo sviluppo del nostro primo dottorato professionale in materia di sanità e cura. Attraverso la nostra iniziale esperienza con due gruppi di studenti, abbiamo riflettuto sullo sviluppo del dottorato professionale, in generale, e trasversalmente a diverse altre discipline, per comprendere meglio come facilitare una buona esperienza di dottorato e una conclusione nei tempi.L’importanza di partecipare all’esperienza emotiva all’interno del complesso percorso di dottorato professionale ci ha portato al concetto di ‘nourished scholarship’ . Si definisce la nozione di ‘nourished scholarship’ come un percorso di apprendimento che lega i valori personali, significativi e attuali, allo sviluppo e al contributo professionale. Tale nutrimento emotivo è caratterizzato da una soddisfacente esperienza di scambio tra il sé, l’apprendimento e la comunità di pratica/studio. La nostra opinione è che tale nutrimento emotivo sia una risorsa fondamentale da cui gli studenti attingono al momento di negoziare le sfide complesse del percorso professionale di dottorato. Al fine di illustrare il significato di ‘nourished scholarship’ descriviamo alcune delle sue dimensioni emotive chiave. Queste dimensioni possono essere agevolate in vari modi, ma qui ne segnaliamo uno in particolare: il sostegno reciproco e la supervisione di gruppo facilitata. Al fine di illustrare le dimensioni della ‘nourished scholarship’ quindi noi riflettiamo su un caso specifico, quello di una coorte di studenti di dottorato professionale. Sono state estratte alcune loro esperienze per illustrare sette dimensioni che sono importanti per contribuire all’esperienza di ‘nourished scholarship’ come una risorsa di sostegno:- Sperimentare i benefici di appartenenza- Aiutarsi vicendevolmente a contenere l’ansia- Vivere la crescente fiducia- Accettare comunanza e unicità- Miglioramento personale, identità professionale e accademica attraverso la chiarificazione dei valori- Sperimentare i benefici di relazionarsi ad una più ampia comunità scientifica- Accettare i ritmi dei tempi in cui ricevere dei tempi attivi.Inoltre, in questo articolo si riflette su come la particolare struttura del programma di dottorato è stata in grado di sostenere lo sviluppo di queste risorse. Ci sono state tre caratteristiche chiave che crediamo siano state fondamentali nel modo in cui il programma è stato progettato e realizzato:a) ‘Cohortness’ in cui gli studenti si impegnano con il programma come un gruppo in viaggio.b) Supervisione di coorte: anche se tutti studiavano diversi argomenti, si è formato un gruppo insieme a due facilitatori accademici per discutere il processo, l’esperienza del percorso e il loro apprendimento.c) Una strategia di valutazione flessibile che permette agli studenti di progredire in modo personale e non lineare.Il valore potenziale di questo articolo per i programmi educativi è che fornisce un quadro per focalizzare l’attenzione sull’importanza del percorso emotivo e sui modi per sostenere la motivazione degli studenti e la resilienza. Noi crediamo che questo quadro abbia un potenziale trasferibile ad altre situazioni in cui tali risorse emotive possono essere importanti.During the past 20 years there has been a global expansion in doctoral education and in particular professional doctorates. Difficulties with progression and completion have increasingly become the focus of attention within both academic and professional contexts. It has been acknowledged that a range of factors, beyond demographics, could be influential in whether students are able to sustain their studies to completion. In this paper we stress the importance of conceptualising professional doctoral studies as a personal, professional and academic journey that is sustained by emotional factors that may need more explicit attention. As such, our contribution is the delineation of a phenomenon that we call ‘nourished scholarship’. We wish to illustrate how such ‘nourished scholarship’ functions as a resource for sustaining motivation and integration through the doctoral journey. We offer seven dimensions that a doctoral programme needs to embody in order to facilitate ‘nourished scholarship’: belonging, containing anxiety, growing confidence, commonality and uniqueness, values clarification, scholarly community, and negotiating the rhythms of receptive and active times. We illustrate these dimensions in the context of a professional doctorate programme that emphasises ‘cohort supervision’ as the primary resource for facilitating such nourished scholarship. We believe that this notion has transferable potential to other provisions where such emotional resources may be important. (shrink)

Given the significance of Nicholas of Cusa’s ecclesiastical career, it is no surprise that a good deal of academic attention on Nicholas has focused on his role in the history of the church. Nevertheless, it would also be fair to say that a good deal of the attention that is focused on the life and thought of Nicholas of Cusa is the legacy of prior generations of scholars who saw in his theoretical work an opportunity to define the most salient (...) features of transformations in the habits of thinking leading from the Middle Ages into the epoch of modernity. Thus, although contemporary scholars have not been able to achieve any clear consensus on the question of whether Nicholas belongs to the Middle Ages or to modernity, the field of Cusanus studies has become much more attentive to the possibility that the uniqueness and significance of Nicholas’s vision is a function of his ability to synthesize and redeploy a variety of strands in the Catholic intellectual tradition—strands that are as apt to involve practical matters of canon law and church reform as they are to hinge on a unique and richly developed mystical theology. Given the flourishing of the attention devoted to Nicholas in the late 20th and early 21st centuries, the choices about which texts to include in this article were difficult ones. The rationale for this article’s predominant focus on scholarship of the late 20th and early 21st centuries is that, insofar as the recent studies listed here enter into the debates that have been shaped by their predecessors, the sources mentioned here will point readers to the prior work in the field not acknowledged here. The new evidence scholarship addresses three distinct approaches: legal probabilism, Bayesian decision theory and relative plausibility theory. Each has major insights to offer, but none seems satisfactory as it stands. This paper proposes that relative plausibility theory be modified in two substantial ways. The first is by defining its key concept of plausibility, hitherto treated as primitive, by generalising the standard axioms of probability. The second is by complementing the descriptive component of the theory with a normative decision theory (...) adapted to legal process. Because this version of decision theory is based on plausibilities rather than probabilities, it generates plausibilistic expectations as outputs. Because these outputs are comparable, they function as relative plausibilities. Hence the resulting framework is an extension of relative plausibility theory, but it retains deep ties to legal probabilism, through the proposed definition of plausibility, and to Bayesian decision theory, through the normative use of decision theory. This book reorients the question of the matrix as a place where everything comes from (_chora_, womb, incubator) by recasting it in terms of acts of "matrixial/maternal hospitality" producing space and matter of and for the other. Irina Aristarkhova theorizes such hospitality with the potential to go beyond tolerance in understanding self/other relations. Building on and critically evaluating a wide range of historical and contemporary (...) class='Hi'>scholarship, she applies this theoretical framework to the science, technology, and art of ectogenesis (artificial womb, neonatal incubators, and other types of generation outside of the maternal body) and proves the question "Can the machine nurse?" is critical when approaching and understanding the functional capacities and failures of incubating technologies, such as artificial placenta. Aristarkhova concludes with the science and art of male pregnancy, positioning the condition as a question of the hospitable man and newly defined fatherhood and its challenge to the conception of masculinity as unable to welcome the other. It also examines the treatise especially in the context of anti-heretical polemics. The Continuous Parameter Estimation Model is applied to develop individual genomic-level heritabilities for the latent hierarchical structure and developmental dynamics of Life History (LH) strategy LH strategies relate to the allocations of bioenergetic resources into different domains of fitness. LH has moderate to high population-level heritability in humans, both at the level of the high-order Super-K Factor and the lower-order factors, the K-Factor, Covitality Factor, and General Factor of Personality (GFP). Several important questions remain unexplored. We developed measures of genome-level (...) heritabilities employing an American sample of 316 monozygotic (MZ) and 274 dizygotic (DZ) twin dyads and a Swedish sample of 863 MZ and 475 DZ twin dyads. This novel heritability index measures individual genetic transmissibility, therefore opening new avenues for analyzing complex interactions among heritable traits inaccessible to standard structural equations methods. For these samples: (1) moderate to high heritability of factor loadings of Super-K on its lower-order factors is demonstrated, evidencing biological preparedness, genetic accommodation, and the gene-culture coevolution of biased epigenetic rules of development; (2) moderate to high heritability of the magnitudes of the effect of the higher-order factors upon their loadings on their constituent factors, evidencing genetic constraints upon phenotypic plasticity; and (3) that heritability of the LH factors, of factor loadings, and of the magnitudes of the correlations among factors are weaker among those with slower LH speeds, demonstrating that inter-individual variation in transmissibility is a function of individual socioecological selection pressures. Descartes's concept of the mind, as distinct from the body with which it forms a union, set the agenda for much of Western philosophy's subsequent reflection on human nature and thought. This is the first book to give an analysis of Descartes's pivotal concept that deals with all the functions of the mind, cognitive as well as volitional, theoretical as well as practical and moral. Focusing on Descartes's view of the mind as intimately united to and intermingled with the (...) body, and exploring its implications for his philosophy of mind and moral psychology, Lilli Alanen argues that the epistemological and methodological consequences of this view have been largely misconstrued in the modern debate. Informed by both the French tradition of Descartes scholarship and recent Anglo-American research, Alanen's book combines historical-contextual analysis with a philosophical problem-oriented approach. It seeks to relate Descartes's views on mind and intentionality both to contemporary debates and to the problems Descartes confronted in their historical context. By drawing out the historical antecedents and the intellectual evolution of Descartes's thinking about the mind, the book shows how his emphasis on the embodiment of the mind has implications far more complex and interesting than the usual dualist account suggests. A rational evaluation of the role of REM in memory processing requires systematic testing of hypotheses that are optimally derived from a complete synthesis of existing knowledge. Our view is that the large number of studies supporting a relationship between REM-related brain activity and memory is not easily explained away. [Vertes & Eastman].

From my ongoing "Metalogical Plato" project. The aim of the diagram is to make reasonably intuitive how the Socratic elenchos (the logic of refutation applied to candidate formulations of virtues or ruling knowledges) looks and works as a whole structure. This is my starting point in the project, in part because of its great familiarity and arguable claim to being the inauguration of western philosophy; getting this point less wrong would have broad and deep consequences, including for philosophy’s self-understanding. -/- (...) (i.) is the first pass at elenchos in which the Socratic interlocutor does not reflect on knowledge being the crux of the problem. (ii.) is the second, rarer, reflective pass in which they are, making the investigation explicitly about knowledge. Its centrality in the Charmides makes that neglected dialogue of superlative importance. This structure is also the gateway through which the discussion/dialectic crosses into the Agathology (discussion of the form of the good) at Republic 505. -/- The problem of elenchos, then, grasped as a whole structure, is that it seems that knowledge can neither satisfactorily be included in nor excluded from its own scope. The development of the ti esti (“what is ---?”) question leads to the introduction of knowledge into its own scope (i. implicitly, as goodness contrasted with blind rule-following ii. explicitly qua knowledge) while the development of the dual peri tinos (“----about what?) question leads to K’s elimination from its own scope. The introductions are motivated to avoid contradiction, but produce regress; the eliminations are motivated to avoid regress, but produce contradiction. In scholarship, and in the history of philosophy, the ti esti question is universally recognized, to the point of being identified with philosophy’s origin and essence; the peri tinos question is neglected textually and never recognized as the equal dual to the ti esti. This, I claim, has blocked the development of a nontrivial logical appreciation of what Plato's Socrates is up to. (One rather disastrous effect of this neglect is taking Aristotle as the beginning of the development of logic, rather than, correctly, for the beginning of logic’s fatal separation from mathematics and dialectic.) -/- Further, because of this monopticism of the ti esti, the function of consistency in the elenchos has not been understood, even with respect to the ti esti. The ti esti is actually in search of completeness, given a norm of consistency; the peri tinos is in search of consistency, given a norm of completeness. Only appreciating the two questions as dual allows space in the structure to clarify these different orientations relative to consistency. (And, dually, to completeness, whose function in the elenchos is generally entirely missed by scholars and relegated to discussions of eros; it's not out of place there, of course, but its significance is secured here.) Recognizing the duality of the ti esti and peri tinos questions is thus the royal road, in the Socratic-Platonic context, to catching sight of what we post-Cantorians can recognize as the metalogical duality of consistency and completeness. (The salutary disruptive effects of this Plato-Cantor proximity have, of course, been traced in complementary ways by Badiou.) -/- Note that the diagram is supposed to provide a relatively accessible orientation, not to stand on its own, and certainly not to be the last word on any subject. An important qualification (telegraphed in the previous paragraph) is that what elenchos shows is not finally circular or paradoxical, though the problem first presents as such (stubbornly, obdurately, as "difficult" Plato's Socrates always says with characteristic understatement). What is depicted here is meant, at a first pass, to be the shape of that first presentation, the form of the problem of elenchos, rather than of its solution. It's not an accident that this problem strongly resembles "Russell's paradox" (not Russell's not a paradox.) Problem is to solution as RP is to the diagonal theorems. (shrink)

For several decades, intercultural philosophers have produced an extensive body of scholarly work aimed at mutual intercultural understanding. They have focused on the ideal of intercultural dialogue that is supported by dialogue principles and virtuous attitudes. However, this ideal is challenged by decolonial scholarship as neglecting power inequalities. Decolonial scholars have emphasized the differences between cultures and worldviews, shifting the focus to colonial history and radical alterity. In return, intercultural philosophers have worried about the very possibility of dialogue and (...) mutual understanding in frameworks that use coloniality as their singular pole of analysis. In this paper, we explore the complex relations between decolonial and intercultural philosophies. While we diagnose tensions between both intellectual discourses, we argue that these tensions turn out to be productive: for intercultural philosophers, decolonial challenges provide an opportunity to critically rethink ideals of equitable dialogue in the light of colonial inequity and its deep entrenchment in global philosophical encounters. For decolonial scholars, intercultural philosophies provide an opportunity to sharpen positive proposals of equitable encounters beyond the critique of current forms of colonial domination. Rather than developing a compromise, we propose to embrace the productive tensions between them through a broad methodological toolbox. Decolonial and intercultural motifs serve different functions in the articulation of a critical global philosophy and can sharpen each other without integrating into a middle ground that is “a little bit intercultural” and “a little bit decolonial”. Hardback, $37.00.Paul Sagar's invigorating book is a reconsideration of Adam Smith in the sense that it challenges much that is received wisdom in current scholarship. First and foremost, it (...) rejects the idea that Smith was preeminently a moral philosopher concerned with the threat to civic virtue posed by commercial society, and yet intent on giving commercial society a moral vindication nevertheless. Sagar—rightly, in my view—wants us to recognize Smith as having been a political thinker. Too much work on Smith still assumes that there is not much to say [End Page 323] about his political thought because he regarded all but the most minimal government as an obstacle to the proper functioning of markets. Smith is supposed to be a "classical liberal" bent on preserving as much natural liberty as possible in the face of government's relentless overextension of its powers of regulation. In Adam Smith's Politics: An Essay in Historiographic Revision (Cambridge: Cambridge University Press, 1978), Donald Winch rejected that approach to Smith in favor of a portrait of the author of The Theory of Moral Sentiments and The Wealth of Nations as an eighteenth-century thinker with an eighteenth-century thinker's concerns. Sagar's project is quite different. This is a book on Smith's political thought that does not once deploy the term 'Whig.' Sagar's Smith does not wholly float free of his historical situation—the questions he addresses are those posed by the end of feudalism and the advent of modernity—but situating him in the particular circumstances of Britain in the age of revolutions is not Sagar's concern. As Sagar sees it, the fundamental issues addressed by Smith's political thought concern the distinctive form taken by commercial society in the modern era. Smith, according to Sagar, held that all advanced societies are commercial societies. Commercial society as such needed no vindication. The question, rather, was what kind of commercial society a modern state wanted to be. That was a political question insofar as it was a question about the kind of freedom that mattered and about the kind of institutions needed to make that freedom a reality.Defined in maximally general terms, freedom for Smith was the absence of domination, where domination is understood as a lack of security in respect of one's physical safety and possessions. The condition of the poor and powerless had always been one of subjection to the will of the rich and powerful. What changed that, according to Smith, was implementation of the rule of law. This is in itself not a new reading of Smith, but what distinguishes Sagar's version of it is the care with which he examines both the place of the rule of law in Smith's historical account of the emergence of liberty in modern Europe and the precise nature of the connection between the rule of law and freedom. First, on Sagar's view, there needed to be a comprehensive picture of domination and slavery, which had been the normal condition of almost everyone for almost all of human history. Then there needed to be an explanation of how it was that, at one particular historical moment, domination was slowly but surely challenged by the emergence of law and law courts considered as independent of political power. In England, this was the story of the common law and of judges who held office for life, rather than at the pleasure of traditional possessors of power. It was the story of security in property, of the backing of property by law, and it was a largely urban story, of burghers who managed to enlist monarchs on their side in the battle against the barons. It was, in other words, in large part a medieval story, and one consequence is that there was more to say about the rise of liberty in the modern age than that it was caused inadvertently by... Constitutional scholarship has put much emphasis on Montesquieu's principle of separation of powers as developed in the chapter of 'The Spirit of the Laws' devoted to the English constitution (XI, 6). It has also been quite common to mix up this model of separation of powers with elements taken from other sections of Montesquieu's masterpiece. The starting point of this paper is that there is an alternative, second model of separation powers based on the French monarchy of intermediate powers, (...) which is also an instantiation of limited government. From this premise, the paper's aim is to carve out a second version of the principle of separation of powers by focusing on the different role and nature of judicial power in the English and French models. It turns out that the French version of the separation of powers is not based on a strict separation, since it bestows on the higher judicial intermediate bodies both judicial and legislative functions. This also leads to a kind of constitutionalism that is 'in between' ancient and modern, as it is exemplified by Montesquieu's take on the functioning of parliaments. As is typical of his political thought, he sees this intermediate power as representative of traditional and conservative social forces but, at the same time, in virtue of its social status, as an institution which strengthens, by opposing it, the monarch's legislative rationality, and legally contains political action. There is a growing body of scholarship that is addressing the ethics, in particular, the bioethics of space travel and colonisation. Naturally, a variety of perspectives concerning the ethical issues and moral permissibility of different technological strategies for confronting the rigours of space travel and colonisation have emerged in the debate. Approaches ranging from genetically enhancing human astronauts to modifying the environments of planets to make them hospitable have been proposed as methods. This paper takes a look at a (...) critique of human bioenhancement proposed by Mirko Garasic who argues that the bioenhancement of human astronauts is not only functional but necessary and thus morally permissible. However, he further claims that the bioethical arguments proposed for the context of space do not apply to the context of Earth. This paper forwards three arguments for how Garasic’s views are philosophically dubious: (1) when he examines our responsibility towards future generations he refers to a moral principle (which we will call the principle of mere survival) which, besides being vague, is not morally acceptable; (2) the idea that human bioenhancement is not natural is not only debatable but morally irrelevant; and (3) it is not true that the situations that may arise in space travel cannot occur on Earth. We conclude that not only is the (bio)enhancement of humans on Earth permissible but perhaps even necessary in certain circumstances. (shrink)

While principally focusing on the early modern approaches to the lower functions of the soul, readers will discover the roots of these approaches back to the Ancient times, as the volume highlights the role of three strands that help shape the study of life in the Medieval and early modern natural philosophies. From late antiquity to the early modern period, the vegetative (...) soul and its cognate concepts have played a substantial role in specifying life, living functions, and living bodies, sometimes blurring the line between living and non-living nature, and, at other moments, resulting in a strong restriction of life to a mechanical system of operations and powers.
