Conceptual confusions permeate all forms of intellectual pursuit. Many have contended that multilingual legislation, i.e., one law enacted in different languages, is unviable when carried out by means of translation. But not many have realized that the same would also be true of drafting if their contention could be justified. My involvement in the translation of Hong Kong laws into Chinese in the run-up to 1997 exposed me to a whole world of myths and misconceptions about legal translation arising from (...) our failure to command a clear view of the workings of language. Over the years I have endeavoured to come to grips with the problems inherent in legal translation, showing that the arguments against the possibility of exact translation, against the possibility of achieving equivalence between different language texts of the law, and against the possibility of bridging the conceptual gap between legal terminologies in different languages, are all ill-grounded and misguided. There are indeed enormous difficulties in drafting and translating multilingual law, but they are essentially of a technical nature, by no means theoretically irresolvable. The viability of multilingual legislation is simply grounded in our innate communicative intention to use signs and symbols to convey meaning. As language users, we are capable of making language work for us for any particular purpose. Just as we can translate the rules of chess from one language to another whereby players speaking different languages can play the same game called “chess”, we don’t see why we can’t do the same with multilingual legislation. This article is a study of the editions of song lyrics by the Southern Song dynasty poet, musician, and calligrapher Jiang Kui in the context of the process of “canonization.” It focuses on the editorial or canonization process as it unfolded in the Qing dynasty, led by the two proponents of Jiang Kui, Zhu Yizun, founder of the Zhexi school of ci, and his follower Li E. Drawing on a wide range of primary sources and building on secondary scholarship from (...) the Qing to the present day, the article exposes the intricate trajectory of Jiang Kui’s canonization. Through close examination of a number of unpublished manuscripts of Jiang’s ci, it moreover uncovers the literati circles engaged in their production. The analysis of Zhu Yizun’s valorization of the veiled and indirect Southern Song style over the expressive-heroic Northern Song style further supports the argument for a political and “psychological” motivation of the ci revival after the Qing conquest. Artiklis arendatakse alternatiivset kontseptsiooni niihästi traditsioonilisele füüsikakesksele teadusliku teooria käsitlusele kui ka seisukohale, et füüsikateooriat ei saa teadusfilosoofias mõista teadusliku teooria mudelina, sest erinevates teadustes on teooriad oma loomult erinevad. Ollakse seisukohal, et teaduslik teooria on ikkagi teadusfilosoofia kategooriana teadusliku distsipliini eripärast sõltumatu. Käsitletakse põhiliselt kahte punkti: (1) miks on teadusfilosoofias põhjust kritiseerida traditsioonilist, füüsika põhjal saadud ettekujutust teaduslikust teooriast? (2) miks ei ole põhjendatud seisukoht, et nt keemias on teaduslik teooria (nt klassikaline keemilise struktuuri teooria) oma loomult füüsikateooriast (nt (...) klassikalisest mehhaanikast) erinev? Traditsioonilise füüsikakeskse lähenemisviisi puhul ei ole piisavalt uuritud, miks õieti füüsikateooria on saanud teadusliku teooria etaloniks. Teoreetilise füüsika keskne teadusekontseptsioon on olnud ühekülgselt orienteeritudmatemaatikale ja loogikale. Kui aga lähtuda teooriast kui mudelite populatsioonist, nagu Ronald Giere on seda teinud ka klassikalise mehhaanika - füüsikakeskse teooriakäsituse traditsioonilise näite - korral, siis osutub see teooriakäsitus tõepoolest invariantseks teatavale tunnetustüübile, mida on alust nimetada teaduslikuks ja mis on selgesti omane ka nt keemiale. In this paper an alternative conception is proposed both to (1) the traditional physics-based conception of scientific theory, and (2) the view that a physical theory cannot be regarded as the model for scientific theory in philosophy of science in general because scientific theories are discipline-dependent. It is argued that scientific theory as a category of philosophy of science is independent of a particular scientific discipline. The main focus of the paper is on two questions: (1) Why is the traditional physics-based conception of scientific theory subject to criticism in philosophy of science? (2) Why is it unjustified to consider a scientific theory in chemistry (e.g., the classical chemical structure theory, which is probably the most characteristic theory of chemistry) to be different in character from a physical theory (e.g., classical mechanics, which is a prototypical example of a theory in the philosophy of science)? In case of the traditional physics-based approach not enough research has been done as to why theories of physics have become the etalon of scientific theory. The accepted view of science, centered on theoretical physics, has been one-sidedly oriented towards mathematics and logic. But when proceeding from a conception of a scientific theory as a population of models, as Ronald Giere has done for the case of classical mechanics - the traditional example of a physical theory -, this conception of a theory really does prove the invariance of a certain type of cognition that can justifiably be called scientific and that is clearly characteristic of, e.g., chemistry as well. Artikkel käsitleb kriitiliselt üht viimaste kümnendite vastandust poliitilises filosoofias — ‘poliitilise liberalismi’ (Rawls) ja ‘radikaalse demokraatia’ (Laclau ja Mouffe) vahel. Artikkel püüab käivitada potentsiaalset dialoogi nende kahe näiliselt lahkneva lähenemise vahel. Kokkuvõttes näitab artikkel, et vastandus on möödarääkimine vähemalt ühes fundamentaalses mõttes: mõlemad lähenemised jagavad ühiskonnastmõtlemisel sama aluseetost. Artiklis nimetatakse seda ‘sattumuslikkuse eetoseks’ ning väidetakse, et see on kõige fundamentaalsem alusveendumus nii Laclau ja Mouffe’i ‘radikaalse demokraatia’ kui ka Rawlsi ‘õigluse kui ausameelsuse’ idee jaoks. Artikkel osutab ka ühele kesksele kitsaskohale (...) Laclau ja Mouffe’i lähenemises: nende suutmatusele kontseptualiseerida institutsioonilisi korraldusi tulenevalt nende ülemäärasest rõhuasetust demokraatia dekonstruktiivsele potentsiaalile. Selles suhtes osutatakse ka Rawlsi käsitluse ilmselgetele eelistele, kuna see pakub juhiseid organiseerimaks demokraatlikke institutsioone. The paper concentrates on a controversy in recent decades’ political thought between ‘political liberalism’ of Rawls and ‘radical democracy’ (represented in this paper by Laclau and Mouffe). The article tries to initiate a potential dialogue between these seemingly divisive approaches. In conclusion the paper maintains that the whole controversy is misguided in one fundamental respect: both approaches share the same underlying ethos in envisioning society—‘the ethos of contingency’. It is argued that it is the most fundamental tenet informing both Laclau and Mouffe’s theory of hegemony with its complementary idea of ‘radical democracy’, and justice as fairness conceived in terms of reciprocity with its accompanying idea of public justification and reflective equilibrium. _e article points to a central impasse in Laclau and Mouffe’s approach: its incapability to conceptualize institutional arrangements due to their overemphasis on the deconstructive potential of democracy. In this respect the obvious merits of Rawls’ conception are highlighted in view of his proposals for organizing democratic institutions. (shrink)

The book Maupassant (1976), which is devoted to an analysis of Maupassant’s short story “Two friends”, is one of A. J. Greimas’ most important works. In it he tried out the semiotic tools he had developed up to that point, tested models for narrative analysis, and anticipated future perspectives in the development of semiotic theory. We discuss how the book puts forward the principle of immanent analysis, and how the “closed” text – the object of semiotic analysis – is constructed. (...) Th e article reveals that while Greimas declares, in the book’s Foreword, that he is distancing from context – the literary sociocultural universe – within the analysis itself he is forced to recognize certain contextual elements. Greimas recognizes the importance of acknowledging contextual facts such as the French concept of patrie and does not attempt to hide certain subjective interpretive elements. Yet at the same time Greimas attempts to suppress context’s invasion of his interpretation. He recognizes the semantic isotopies generated by context to the extent to which they suit the coherence of his analysis, considering them auxiliary in terms of the syntactic and discursive structures of the text. Nevertheless, a contextual isotopy – based on intertextual ties to a Biblical parable – becomes the main one. We come to the conclusion that the principle of immanence in Maupassant is not a negation, but a problematization that demonstrates how relevant contextual material can be integrated into a semiotic analysis.Книга ≪Мопассан≫ (1976), посвященная анализу новеллы ≪Два друга≫ французского писателя XIX века, – один из главных трудов Альгирдаса Юлиуса Греймаса, в котором используются ранее созданные им инструменты семиотического анализа, проверяются и дальше создаются модели нарративного анализа, намечаются будущие перспективы развития семиотической теории. Автор статьи обсуждает, каким образом в книге постулируется принцип имманентного анализа и конструируется ≪закрытый≫ текст – объект семиотического анализа. В статье показывается, что несмотря на то, что в предисловии к работе Греймас декларировал отстранение от контекста – социолектического универсума литературы, в самом анализе Греймас вынужден принимать во внимание определенные элементы контекста, а некоторые из них интегрировать в интерпретацию новеллы. С одной стороны, Греймас признает необходимость считаться с данными контекста, такими как французское понятие родины, и не скрывает некоторых субъективных элементов интерпретации (опираясь на биографические данные, автор статьи обсуждает возможный генезис некоторых из этих элементов). С другой стороны, в то же самое время автор ≪Мопассана≫ старается совладать с ворвавшимся в интерпретацию контекстом. Генерируемые контекстом семантические изотопии он признает настолько, насколько они вписываются в когерентный анализ, и считает их вспомогательными по отношению к синтаксическим и дискурсивным текстовым структурам. Однако в кульминации анализа такая контекстуальная изотопия возвращается интертекстуальной связью с библейской параболой (притчей) и становится главной. Автор статьи делает вывод, что принцип имманентности в ≪Мопассане≫ не отрицается, но становится проблемным, показывая, как релевантные данные контекста могут быть интегрированы в семиотическую интерпретацию. Raamat “Maupassant”, mis on puhendatud 19. sajandi prantsuse kirjaniku novelli “Kaks sopra” analuusile, on uks Algirdas Julius Greimase tahtsamaid toid. Selles katsetas ta semiootilisi tooriistu, mille oli selleks ajaks valja tootanud, pani proovile narratiivianaluusi mudeleid ning jatkas nende loomist ja ennetas tulevikuperspektiive semiootikateooria arengus. Artikli autor vaatleb, kuidas selles teoses esitatakse immanentse analuusi printsiipi ja kuidas konstrueeritakse “suletud” teksti – semiootilise analuusi objekti. Artiklist ilmneb, et kui Greimas kuulutas raamatu eessonas, et ta distantseerub kontekstist – kirjanduslikust sotsiaalmajanduslikust universumist, on ta analuusis eneses sunnitud tunnistama teatavaid kontekstuaalseid elemente ning isegi loimima moningaid neist tolgendusse, mille ta loole annab. Uhest kuljest tunnistab “Maupassant’i” autor selliste kontekstuaalsete faktidega, nagu seda on naiteks Prantsuse moiste ‘patrie’, arvestamise tahtsust ega urita peita teatavaid subjektiivseid interpreteerivaid elemente (artikli autor kasutab nende voimaliku geneesi vaatlemisel biograafi list materjali). Ent samal ajal uritab Greimas alla suruda konteksti pealetungi oma tolgendusele. Konteksti loodud semantilisi isotoope tunnustab ta maaral, mil need sobivad tema analuusi sidususega, pidades neid teksti suntaktilisi ja diskursiivseid struktuure silmas pidades korvalisteks. Siiski saab peamiseks uks kontekstuaalne isotoopia, mis pohineb intertekstuaalsetel sidemetel Piibli vordumiga. Artikli autor jouab jareldusele, et immanentsuse printsiip “Maupassant’is” ei ole eitus, vaid problematiseering, mis toestab, kuidas on voimalik olulist kontekstuaalset materjali semiootilisse analuusi loimida. The author concentrates on the period of approximately 1960–1990, when he himself was engaged in the field, i.e. the time before 1960 is not included. The aim of this paper is not to provide an overview of the individual philosophers in Estonia (...) at the time and their works, but to give a more general description of the philosophy of the Soviet era. The Soviet and the East European philosophy of the time have received rather little critical treatment in literature in English. However, a few general overviews trying to prove that this Soviet and East European philosophical legacy is worth studying have still been published. This paper is focused on the question what kind of philosophical researches it was possible to engage oneself in under the abnormal conditions at the time and whether some starting points and problem issues in theseresearches might be viable also today. Estonian experience confirms the general conclusion of these authors who, analyzing the legacy of Marxism, have found that although Marxism is nowadays—not to mention how it existed in the Soviet totalitarian regime—mainly not considered a serious philosophy but rather an ideological basis of a failed political doctrine, it has nevertheless quite something to offer when treated in a more depoliticized manner, in the general context of philosophical quests. Teoreetiline ja teadusfilosoofia Nõukogude ajal: mõned märkused Eesti näitel 1960-1990 Vaatluse all on Eesti näitel ja lähtudes Tartu ülikoolist see osa Nõukogudeaegsest filosoofiast, mis vastab umbes teoreetilisele filosoofiale ja teadusfilosoofiale. Autor peatub ajavahemikul umbes 1960–1990, mil ta ka ise tegev oli, st 1960-ndate aastate eelset aega ei käsitleta. Artikli eesmärgiks ei ole ülevaate andmine Eestis sel ajal tegutsenud filosoofidest ja nende töödest, vaid Nõukogudeaegse filosoofia üldisem iseloomustamine. Nõukogude ja selleagset Ida-Euroopa filosoofiat on ingliskeelses kirjanduses üsna vähe kriitiliselt uuritud. Üksikuid ülevaateteoseid, milles on püütud näidata, etsee Nõukogude ja Ida-Euroopa filosoofiline pärand väärib uurimist, on siiski ilmunud. Grice’i algne vahetegemine “‘tähendamise’ naturaalse tähenduse” ja “‘tähendamise’mittenaturaalse tähenduse” vahel osutab loomulikule pingele ‘naturaalse’ ja ‘semantilise’vahel — kui ‘semantilise’ puhul on oluline, et see saab olla väär või ekslik,siis ‘naturaalse’ puhul väärus ja ekslikkus välistatakse. Artikli taotluseks on näidata, et juhul kui naturaalset tõlgendada kui ‘vastavalt füüsikaseadustele’, siis on seevastasseis vältimatu, samas kui tõlgenduse ‘nagu bioloogias’ korral oleneb ebakõlasuurus konkreetsest semantikateooriast, mida ollakse valmis omaks võtma. Viimases punktismööndakse, et kuigi loosung ‘ma suudan eksida’ on immuunne naturalistlikurünnaku vastu kujul ‘sa eksid, (...) kui seda väidad’, saab sellele siiski ette heitaekslikku arusaama ekslikkusest, iseäranis juhul, kui see tugineb ettekujutusele privaatsestkogemusest, nagu antud artiklis. The paper argues that if `natural' is understood as 'according to physics' this opposition is principal, whereas if it is understood as 'like in biology' the degree of discord depends on particular theory of 'semantics' one is ready to adopt. In the last section of the paper it is admitted that, although the slogan 'I am able to be wrong' should be immune to a naturalist refutation of the form 'you are wrong saying this', it may be still criticized for introducing a wrong kind of wrongness, e.g. the one that relies on subject's private episodes (the preferred option in this paper). As a reply to a standard critique against any role of private episodes in language, a preliminary hypothesis is put forward that (relying loosely on Harry Collins' distinction) it is only the interactive linguistic expertise that does not depend on private episodes, whereas the contributive linguistic expertise does. The subject of the article is the role of M.A. Balakirev in the development of Russian musical culture. The purpose of the article is to analyze the multifaceted activities of M.A. Balakirev, whom history itself has put forward to accomplish great things for the benefit of musical culture and musical education in Russia. In accordance with the theme and purpose, the following methods were used: retrospective analysis of the musical life of Russia in the second half of the XIX – (...) early XX centuries; analysis of memoir sources of M.A. Balakirev's contemporaries; generalization of modern scientific research on the topic stated in the article. The methodology of the research consists of : memoirs of students and associates of M.A. Balakirev – Ts.A. Kui, N.A. Rimsky-Korsakov, V.V. Stasov; memoirs of Russian researchers – P.D. Bobrykin, Yu.V. Vasiliev, E.M. Gordeeva, Yu.V. Keldysh, I.F. Kunin. The novelty of the research lies in the identification of aesthetic contradictions between the established approach not only in the creative association of composers, but also in the musical art of that era. The materials of the article can be included in the course of lectures and seminars on the history of Russian music, advanced training courses for music teachers, teachers of secondary specialized and higher educational institutions. The conclusions of the study are : the purpose and creative activity of the composers of the "Mighty Bunch" under the leadership of M.A. Balakirev is characterized as a reflection of the Russian democratic culture of the era of revolutionary populism; the activity of the creative community "Mighty Bunch" is presented as embodying the ideological platform of the new Russian direction in music of the XIX century; the main methods of "composer" training and education applied by M.A. Balakirev. One of the most recent writers on the early history of Rome has shown that the framework of the traditional story is perhaps to be trusted, even though there are many details, inconsistent and self-contradictory, which are obviously to be rejected. In view of this fact, it might be worth while to reconsider the Coriolanus story, the prevailing opinion concerning which is that vouchsafed by Mommsen many years ago: ‘die Erzählung ist ein spät, in die Annalen eingefügtes, darum in alien (...) Stücken denselben ungleichartiges und widersprechendes Einschiebsel.’ The reasons for arriving at such an opinion are sufficiently obvious to warrant their receiving but the barest recital. First, it is incredible that the Volsci would either choose a renegade Roman to be their general, or, even if they did, allow him at the last minute to rob them of the fruits of victory. Secondly, inconsistencies in the version of the story which we possess induce us to suspect its historicity; for example, Dionysius of Syracuse is made to send corn to the starving Romans'—yet Dionysius lived some hundred years later; a youthful Coriolanus is represented as having considerable influence in the senate—yet in those early days the senate was essentially a gathering of venerable men; the Roman populace learns immediately the gist of Coriolanus' remarks in the senate—yet senate meetings were held in secret; Volsci are allowed to attend the ‘ludi’ and to meet at the Spring of Ferentina—yet in the fifth century none but Latini could do this; the Roman Marcius is given an honorific cognomen, Coriolanus, because of his behaviour at the capture of Corioli—yet such cognomina were not granted until the third century or even later and even then only to the general and not to the subordinate; the plebs is represented as wielding great power in the assembly1—yet we know that in the fifth century it did nothing of the kind.
