Wie muss ein ethischer Beratungsdienst strukturiert sein, damit er in moralischen Konfliktsituationen im klinischen Alltag angefragt wird und die Ratsuchenden ergebnisorientiert unterstützen kann? Nach welchen Kriterien lassen sich die Beratungsgespräche auswerten und bewerten? Zur Beantwortung dieser Fragen werden theoretisch fundierte Konzepte ethischer Fallbesprechung aus Nimwegen, Leuven und Basel herangezogen; dies geschieht vor dem Hintergrund der Erfahrungen mit der über zehnjährigen Entwicklung der ethischen Arbeit im Ev. Krankenhaus Bielefeld (EvKB). Als Resultat stellen wir einen strukturierten, multidisziplinären Ansatz vor, mit dem in (...) den Beratungsgesprächen die ethischen Dimensionen unterschiedlicher Vorstellungen herausgearbeitet und möglichst einvernehmlichen Lösungen zugeführt werden. Am Beispiel des EvKB lässt sich zeigen, dass der ethische Beratungsdienst auch in Zeiten knapper Ressourcen implementiert und praktiziert werden kann und eine Gesprächskultur schafft, die zu neuen Zielvariablen führt; hier spielen der Perspektivenwechsel und die Prozessgerechtigkeit eine zentrale Rolle und liefern zugleich Ansatzpunkte für unsere eigene Evaluationsstrategie. Zum aktuellen Stand der Evaluation klinischer Ethikberatung wird die internationale Literatur kritisch gewürdigt. Erste konzeptionelle Ansätze und Ergebnisse einer eigenen Evaluationsstrategie werden vorgestellt. Durch die Offenlegung hoffen wir, die Auseinandersetzung mit diesen Themen zu intensivieren. In der Neonatologie—wie auch in anderen Bereichen der Intensivmedizin—müssen Ärzte und Pflegende häufig die ethisch schwierige Entscheidung treffen, ob die Therapie eines schwer kranken Patienten intensiviert oder eingeschränkt werden soll. In der Literatur existieren verschiedene Instrumente zur Entscheidungsfindung, die, angewandt im Rahmen ethischer Konsile, die Nachvollziehbarkeit einer ausgesprochenen Empfehlung gewährleisten sollen. Zwei dieser verfügbaren Modelle („Schema zur ethischen Urteilsbildung nach dem Muster der aristotelischen Ethik“, Honnefelder 1994 und die „Nimwegener Methode für ethische Fallbesprechung“, Gordijn 1998) wurden anhand klinischer Fälle auf (...) ihre Anwendbarkeit in der Neonatologie hin untersucht. Unsere Studie zeigt, dass die Verwendung eines Entscheidungshilfeinstruments zwar grundsätzlich sinnvoll ist, deckt aber gleichzeitig den Konkretisierungsbedarf der oben genannten Modelle beim Einsatz in der Neonatologie auf. Der daraufhin entwickelte „Kölner Arbeitsbogen zur ethischen Entscheidungsfindung in der Neonatologie“ stellt ein auf die speziellen Bedürfnisse der Neonatologie ausgerichtetes Schema dar und könnte damit eine Lücke für den rasant expandierenden Bereich der Früh- und Neugeborenenmedizin schließen. Unter der Perspektive von Big Data werden ethische Grundfragen fokussiert, die sich aus der Entwicklung und Anwendung fortgeschrittener Informationstechnologien ergeben. Allen fortgeschrittenen informatischen Werkzeugen ist gemeinsam, dass sie mit großen Datenmengen umgehen müssen, diese zu analysieren, zu verarbeiten und möglichst selbständig auf die Analysate regulierend und steuernd zu reagieren haben. Im Fokus steht erstens die Anschließbarkeit eines speziellen Diskurses über fortgeschrittene Informationstechnologien innerhalb der Technikethik, zweitens die Verortbarkeit spezifischer Handlungsprobleme in Prozessen, die die gesamte Gesellschaft und den ethischen Status des (...) Individuums betreffen, und drittens die Aufweisung metaphysischer Voraussetzungen gegenwärtiger Einstellungen im Umgang mit Analysaten, die aus großen, insbesondere fließenden Datenmengen gewonnen werden. Es wird versucht die Kontinuität bestimmter ethischer Grundkonflikte im informationstechnologischen Diskurs aufzuweisen. Schlüsselthemen sind u.a. die Dialektik von Ermächtigung und Entmündigung im Umgang mit modernen Informationstechnologien sowie, damit verbunden, der Verlust von Widerständigkeitserfahrungen, der mit einem Wirklichkeitsverlust einhergeht. Die Studie versteht sich als Orientierungshilfe und als Beitrag zur philosophischen Verortung und Einschätzung einer Bereichsethik. Der Autor Prof. Dr. Klaus Wiegerling arbeitete bis zur Pensionierung am Institut für Technikfolgenabschätzung und Systemanalyse (ITAS) des KIT Karlsruhe. The achievement of unity and perfection in human action begins with a struggle for these ideals in human thought. Dr. Klaus Vondung in his collection of essays that span four decades explores examples of this in different fields of human inquiry: striving for harmonious existential unity of talents and morals, intellect and emotion; seeking to make natural sciences consonant with the humanities and thereby moving toward a more universal, "perfect" science; and establishing unity in political structures and cultivating in (...) this unity a homogenous society. Vondung has given special devotion to National Socialism as a context wherein he revisits its perverted motivation and the consequences of this despite noble ideals. Particular focus in following the thread of unity and perfection in human intellectual and practical ambitions ultimately hones in on the combination of religion and politics. Vondung in these essays unpacks the ways in which this continues to fascinate and disturb us, and in his expertise he uses National Socialism to connect this pursuit of unity and perfection to what he calls one of the signature marks of modernity--namely, secular apocalypticism. This claim stands in opposition to Eric Voegelin's remark that Gnosticism, rather, is "the nature of modernity." Vondung, who studied and wrote his dissertation under Voegelin, grapples with the contrast of these positions. Vondung is willing to challenge Voegelin, but ultimately his treatment of the latter bears the quality of tribute to this great scholar. Vondung also explores the points of contact between apocalypticism and Hermetic speculation. Despite the independence of the religious and philosophical doctrines of Hermeticism, there are parallels to be found. Apocalypticism and Hermeticism originated in antiquity and yet each represents a tradition that still holds footing today. Vondung furthermore leads the reader to see the project of salvation found in both even as each operates with a different scope. This collection of essays centers itself on a perspective of the human pursuit of unity and perfection, directly or indirectly, as objectives of intellectual endeavors, existential ideals, as social or political outcomes, and in the case of National Socialism even as perverse aberrations. Vondung's particular treatment of Voegelin's work likewise establishes what the former identifies as a stand-out question of this study: Does the search of order in history show us the unity of the history of humankind? BackgroundThe global COVID-19 pandemic confronts people with their fragility, vulnerability, and mortality. To date, scales to measure death awareness mainly focus on the anxiety-provoking aspect of mortality cues. This study aims to cross-culturally adapt and validate the Death Reflection Scale, a scale for measuring positive, growth-oriented cognitions of life reflection and prosocial behavior following confrontation with the finiteness of life.Materials and MethodsThe Death Reflection Scale was translated and adapted in a multi-step process to the German language. In this anonymous, cross-sectional, (...) online survey at a large university in Germany, students, healthcare professionals and other staff completed the DRS alongside comparison measures. Multi-group confirmatory factor analysis was used to assess configural, metric, and scalar measurement equivalence across four age and occupational groups. Convergent/divergent validity testing was done via Spearman correlations.Results1,703 participants provided data for a response rate of ∼5%. 24% of respondents were HCP, 22% students. Confirmatory factor analysis showed a higher-order structure of the DRS with a strong general factor and the originally proposed five subscales. Multi-group CFA showed partial metric equivalence across age groups and partial scalar invariance across occupational groups. Non-invariant scales were the Motivation to live, Putting life into perspective, and Legacy subscales. In the convergent validity testing, two hypotheses were fully confirmed, two partially and four were not confirmed. Experiencing a propensity for increased contemplation and life reflection during the pandemic together with spirituality showed correlations of moderate to large size to the DRS and its subscales.ConclusionFurther conceptual work for death awareness to explore the construct’s stability in different population groups needs to be undertaken. However, the DRS can be mostly used to assess positive and growth-oriented aspects of death awareness and death reflection which may be an important avenue when developing counseling and support interventions for groups experiencing a high burden during the pandemic. Over the last century, emotion research has been beset by the problem of major disagreements with respect to the definition of the phenomenon and an abundance of different theories. Arguably, these divergences have had adverse effects on theory development, on the theoretical foundations of empirical research, and on knowledge accumulation in the study of emotion. Similar problems have been encountered in other areas of behavioural science. Increasingly, there have been calls to work towards some form of theory integration. In contrast, (...) here an effort is made to show that a reasonable degree of theory convergence in the area of emotion science can be attained by adopting a design feature-based working definition of emotion and highlighting the basic agreement on the components of the dynamic emotion process. The aim is to invite constructive discussion on communalities and divergences between different theories and foster the development of more complementary theoretical frameworks to guide future empirical research. The theory of resistance here elaborated is based on considerations current since the 18th century and concern the proof of reality of the external world. However, what is ignored in the course of these proofs are the social, psychological, and in particular the logical aspects of resistance. The idea of a theory of resistance is inspired by tendencies in the philosophy of technology, as well as other current philosophical and scientific lines of thought that obscure their metaphysical underpinnings, advocating a (...) position of complete achievability of human and natural relations. The theory of resistance seeks to show that resistance is a reflexive term that concerns relations, not objects or those relations that can be expressed in qualities and quantities. Furthermore, this concept has a positioning role, important in epistemological, as well as ethical and anthropological sense. Resistance is a central, although not the sole characteristic of reality. As an ethical category, it is articulated, for example, in the idea of dignity if understood as hostility to mere typologization and subjection to calcu?lation. The theory of resistance does not advocate some existing reality, but limits the domain of validity of constructivist and narrativist theories. (shrink)

*******Résume en français plus bas****** Karl Kraus’s favourable and conceptually complex comments of the portrait drawings byOskar Kokoschka in 1910 put us on the trail of a host of different phenomena of pictorial representation. Based on close-readings of several aphorisms by Kraus and drawings by Kokoschka, I suggest that there is something like realistic distortion and that the traditional concepts of style cannot account for all essential stylistic variations that are important in pictures. I argue that we need to introduce (...) the concept of subject specific style. This must be distinguished from other concepts such as signature style. I try to show how these conceptual distinctions are connected to the difference in representational range displayed by media that are based on traces, like photography, and by media based on testimony, like drawing or writing. *********** Résumé En 1910, Oskar Kokoschka produit une série de dessins pour la revue expressionniste berlinoise Der Sturm. L’un des portraits représente le satiriste Karl Kraus, un autre l’architecte Adolf Loos. Au même moment, Kraus fait paraître une série d’aphorismes qui commentent le travail de Kokoschka. Kraus part du travail de Kokoschka pour arriver à des principes généraux sur la représentation picturale. Une analyse des réflexions de l’écrivain et des deux dessins faits par Kokoschka nous permet non seulement de mieux comprendre comment un dessin peut saisir le caractère d’un modèle au-delà du physique, mais aussi de forger des concepts pour enrichir les notions de style traditionnelles. Nous soutenons dans notre article qu’il faut introduire l’idée d’un style à l’oeuvre pour compléter les notions de style habituelles.Le style à l’oeuvre peut être spécifique au sujet traité. Nous montrons en particulier comment le dessin permet des distorsions réalistes, difficiles à obtenir dans des médias basés sur la trace comme la photographie. (shrink)

In this article, I try to show that the question of what the “first proposition” in Groundwork I is can be answered by textual evidence. At the end of paragraph 15 of GMS I, Kant recapitulates the “first proposition”. It is: “Eine Handlung aus Pflicht sondert den Einfluss der Neigung ganz ab.“ (“An action from duty puts aside entirely the influence of inclination.”). It is also shown that this “proposition” summarizes an important result of Kant’s argument in the preceding paragraphs (...) 8–13 and is presupposed by the “second proposition” and by Kant’s whole argument in the paragraphs 14 and 15, which he recapitulates in the last sentence of paragraph 15. This work represents Niklas Luhmann's definitive application of systems theory to the understanding of law. In it Luhmann reviews past attempts to create a theory of law and argues they all fail to capture how law operates in modern society. He presents an alternative, critical theory through analysing law as a system of communication.

The ability to reason independently from one's own goals or beliefs has long been recognised as a key characteristic of the development of formal operational thought. In this article we present the results of a study that examined the correlates of this ability in a group of 10-year-old children ( N = 61). Participants were presented with conditional and relational reasoning items, where the content was manipulated such that the conclusion to the arguments were either congruent, neutral, or incongruent with (...) beliefs, and either logically valid or logically invalid. Participants also received a measure of working memory capacity (the counting span task) and a measure of inhibitory control (the stop signal task). Indices of belief bias and logical reasoning on belief-based problems were predicted independently by both measures. In contrast logical reasoning on belief neutral problems was predicted by working memory alone. The findings suggest that executive functions play a key role in the development of children's ability to decontextualise their thinking. (shrink)

Attention is automatically allocated to stimuli that are opposite in valence to the current motivational focus (Rothermund, 2003; Rothermund, Voss, & Wentura, 2008). We tested whether this incongruency effect is due to affective–motivational counter-regulation or to an increased salience of stimuli that mismatch with cognitively activated information. Affective processing biases were assessed with a search task in which participants had to detect the spatial position at which a positive or negative stimulus was presented. In the motivational condition, positive or negative (...) affective–motivational states were induced by performance feedback after each trial. In the cognitive activation condition, participants memorised the word “good” or “bad” during the search task. The affective incongruency effect was replicated in the motivational condition, whereas an affective congruency effect obtained in the cognitive activation condition. These findings support an explanation of affective incongruency effects in terms of automatic counter-regulation that is motivational in nature. (shrink)
