This article analyses the conflicting professional ethical demands imposed on judges to, on the one hand, faithfully apply the existing law of the land and, on the other hand, do justice in the face of urgent global challenges such as ensuring an equal access to life-saving medicines. After establishing the precise nature of the professional ethical duties of judges (as opposed to those of lawyers) and noting the tensions they face when the duty of applying the law prevents them from (...) complying with the duty of delivering material justice in the domain of access to medicines, the article then analyses the way this issue plays out in Latin America, a región where judicially-mandated access to medicines has been common. The article concludes by arguing that the Latin American experience suggests that judges around the world should take seriously the need to find a balance between their duty of deference towards public health authorities in this domain (when this is mandated by legislation), and the duty to do justice to individuals who cannot afford live-saving medicines. L’article étudie les implications de l’éponymie dans les domaines religieux et politique en examinant l’identité et le contexte des officiels éponymes. Le point central est le titre de stéphanéphore, qui n’est pas seulement l’un des quarante titres éponymes connus, mais qui mérite une attention particulière dans le cadre de l’éponymie. On remarque que, dans bon nombre de cités, cette charge imposait ses caractéristiques à ceux qui l’assumaient quels que soient leur titre ou leur fonction de départ. Ces caractéristiques étaient de (...) nature religieuse et elles étaient essentielles pour la « chorégraphie » religieuse et, dès lors, pour l’identité religieuse d’une polis particulière. Étant donné que le profil des officiels éponymes (au moins à la période hellénistique) n’était pas dessiné par le titre qui s’attachait originellement à eux, une distinction entre officiels éponymes « séculiers » ou « religieux » n’a aucun sens. Au contraire, dans beaucoup de cités d’Asie Mineure, le titre de stéphanéphore – accepter et porter la couronne d’une divinité particulière – reflète la réelle importance de la charge qui était comparable à, modelée sur, et souvent combinée à la prêtrise. An intelligent model of the incremental capacity curve of an automotive lithium-ferrophosphate battery is presented. The relative heights of the two major peaks of the IC curve can be acquired from high-current discharges, thus enabling the state of health estimation of the battery while the vehicle is being operated and in certain cases, aging mechanisms can be suggested. Our model has been validated using a large dataset representing different degradation scenarios, obtained from a recently available open-source database.

Durante su desarrollo el niño se enfrenta a eventos que plantean demandas difíciles de satisfacer como la enfermedad y la hospitalización. La Organización Mundial de Salud define la salud como un estado de completo bienestar físico, mental y social, pero no existe consenso en la literatura sobre el término bienestar. El objetivo del artículo es realizar una revisión bibliográfica acerca del concepto bienestar en niños, asociado al proceso salud - enfermedad y a la hospitalización. Los niños experimentan bienestar cuando predominan (...) sus emociones positivas, estas favorecen la salud, las negativas, pueden provocar estados patológicos y son frecuentes en la hospitalización. Esa realidad amerita ser transformada. El bienestar en niños hospitalizados constituye un reto para las ciencias médicas para penetrar las bases del nivel secundario de atención. Throughout their development, children face events that pose hard-to-satisfy demands for them such as illness and hospitalization. The World Health Organization defines health as a state of complete physical, mental, or social well-being; however, there is no consensus in literature about the term "well-being". The objective of the article is to do a bibliographic review on the concept of children well-being associated to the health-illness process and to hospitalization. Children experience the state of well-being when positive emotions, which favor health, prevail. Negative feelings, on the other hand, can cause pathological states and they are common in hospitalization. That reality merits transformation. Hospitalized children's well-being presents a challenge for medical sciences in order to get inside the basis of secondary health care attention. (shrink)

The Buddhist philosopher Dignaga (around 500 CE) centers his philosophy of language on the theorem of verbal meaning as "exclusion of other referents" (anyapoha). This is the topic of the fifth chapter in his summarizing last work, the Pramanasamuccayavrtti. Since a word tells its hearer something about the object to which it refers in the same way that a logical reason tells its observer something about the object of which it is a property, Dignaga's apoha thesis is a crucial complement (...) to his theory of inference. The original Sanskrit text of this work is no longer extant. Except for a few Sanskrit fragments and two highly problematic Tibetan translations it is only the since recently available unique Sanskrit manuscript of the mid-8th century CE commentary, the Pramanasamuccayatika, by Jinendrabuddhi that allows for a faithful English translation. Jinendrabuddhi's text has been used throughout and, in parts, critically edited for the first time. On the basis of these sources it was possible to provide the translation with a restoration as far as possible of the original Sanskrit text of Dignaga's work. In his introduction, Pind surveys his methodology, discusses the sources, the context and historical position, and the character of this chapter, and he also deals with Jinendrabuddhi's commentary, his sources and its restoration. Moreover, he presents the essential features of the apoha thesis in detail. The translation of this rather difficult text is richly annotated and provides all philological information in support of the text's restoration as well as extensive explanations and discussions of the content. It is in the notes that Pind provides the background of Indian grammatical analysis and theory (Bhartrhari and others) and documents the context of the rival philosophical traditions such as those of the Nyaya and Mimasa. Pind is also particularly aware of the influences on Jinendrabuddhi's interpretation that derive from Dharmakirti's interpretation of Dignaga's tenets and consistently analyses the differences occurring. Several appendices conclude this study by presenting a number of notes separated because of their size. After Richard Hayes' study and translation of the first part of this chapter (1988), this is the first comprehensive presentation of Dignaga's philosophy of language. (shrink)

This article puts forward some ideas on the subject, organized around the following lines: 1) some specific changes in our concept of “life” occurred along the history, 2) the dilemmas presented by current science concerning (...) the borders of human life, especially those relative to the processes of embryonic development, 3) the significance of the ethical principle of respect for the dignity of human life, and 4) the treatment that is given to this principle in the Spanish Constitution, as well as in the most relevant international declarations in this area. “Actúa de manera tal que los efectos de tu acción sean compatibles con la permanencia de la vida humana genuina en la Tierra”. ¿Cómo podemos entender esta máxima de Jonas? ¿Es demasiado antropocéntrica como para ser interesante para la ética ambiental? ¿Está demasiado limitada a la supervivencia como para tener un significado moral en una ética verdaderamente humana? En primer lugar, podríamos argumentar que no es tan anti-kantiana como para desafiar el “presentismo” actual imperante y nos obliga a tener en (...) cuenta no solo las generaciones futuras, sino también el contexto en el que anticipamos que estas futuras generaciones vivirán. Por lo tanto, deberíamos distinguir dos interpretaciones diferentes de la máxima de Jonas. En una primera etapa, la del desarrollo sostenible, se entendió que considera no solo las necesidades sino también los derechos de las generaciones futuras. En una segunda etapa, la de un Antropoceno y una transición ecológica, significa que dar sentido a la humanidad implica conectar a los seres humanos con la Tierra y otros seres vivos en lugar de oponerse a ellos. Los filósofos tienen una especial responsabilidad en la búsqueda de un horizonte de sentido que articule adecuadamente el conocimiento científico y las obligaciones morales de las personas. Para llevar a cabo esta labor es fundamental el análisis de las características constitutivas de la vida en general y de la vida humana en particular. Este artículo propone una reflexión en este sentido, que tiene en cuenta las siguientes perspectivas: 1) algunos cambios conceptuales sobre la "vida" ocurridos a lo largo de la (...) historia, 2) los dilemas que la ciencia actual presenta respecto de las fronteras de la vida humana, especialmente con relación a los... procesos del desarrollo embrionario, 3) la significación del principio ético de respeto a la dignidad de la vida humana, y 4) el tratamiento que se da a este principio en la Constitución española y en las declaraciones internacionales más relevantes para este contexto. El problema ¿se arguye¿ que se quiere solucionar con la eutanasia se soluciona mejor y respetando la moral médica mediante los cuidados paliativos. Sin embargo, entre los bioéticos y los agentes de salud es cada vez más frecuente la opinión de que los cuidados paliativos no son una alternativa a la eutanasia y puede ser incluso una solución menos digna que (...) ésta. A diplomatic edition of a commentary by Bcom-ldan-ral-gri (1227-1305), a Tibetan Buddhist scholar of the Kadampa (Bka-gdams-pa) tradition, on the "Pramāṇasamuccaya" written by the Indian Buddhist logician, Dignāga (c. 480-540 CE); includes extensive introductory material on the life and work of Dignāga, and reception of this treatise in Tibet.

The focus of this study is an examination of what it means to be a legal person and the role that the law plays in bestowing the legal status of being a person. This study highlights the underpinning rationalities and human interest that establish a hierarchy between person, defined as “human”, at a superior level to everything else, defined as “nonhuman”. In this respect, there is a core notion concerning human exceptionalism based on the rational sovereignty that justifies and consolidates (...) the mastery of nature. To understand the fundamental premises of legal personhood, it begins from the first usage of person in history and philosophy, since the concept of legal personhood has been established through historical and philosophical developments. Analysing the meaning of person through different conceptualisations can allow a deeper insight into the legal interpretation of personhood. As a result of such investigation, two main dualistic structures of legal personhood reveal: the person-property dualism and the human being-person dualism. Thus, legal personhood simultaneously includes personalisation and depersonalisation, and always operates in a hierarchical array. Although the division between persons and things in the concept of personhood is rigid, being a “person” or a “thing” is open to interpretation in different circumstances through legal practices of exclusion and inclusion. Recently, there have been an increasing number of court rulings and a tendency of legislation to recognise the legal personhood of natural entities as a legal way of conserving the environment. This leads to an interpretation that legal recognition is a matter of institutional interest and attempts. Nevertheless, legal practitioners mostly prefer to confer certain rights or the status of a legal person on nature without the consideration of legal personhood’s background as seen in the case discussed in this study - the Tierra Digna case in Colombia. While this study endeavours to demonstrate the anthropocentric standard view of legal personhood, its principal purpose is to indicate the malleable nature of legal personhood as a product of legal fiction. In this context, this study aims to conclude that law’s imaginary nature should be used for producing a new legal reasoning and for offering a real paradigm shift that is congruent with the plasticity of and the fluidity of nature. La pandemia del COVID-19 ha cambiado las formas de morir, gestionar y ritualizar las muertes. Este trabajo problematiza el dilema ético de dignificar la muerte, dando espacio a la singularidad en los ritos fúnebres, desde la perspectiva kantiana; versus su tecnificación que, desde el utilitarismo, homogeniza estos rituales para proteger las vidas. La pregunta es si, efectivamente, la protección sanitaria de la vida mediante la protocolización de los rituales fúnebres puede ser puesta en valor, en un momento tan determinante como (...) la muerte. Como conclusión, se considera la importancia de que estas medidas integren la diversidad cultural del país en la forma de afrontar las muertes. En este trabajo se expone, analiza y reflexiona sobre el dilema ético de la muerte digna, a partir de su simbolización expresada en los ritos fúnebres, desde un punto de vista kantiano; versus su afrontamiento pragmático que, desde el utilitarismo, produce una tecnificación de la muerte, que homogeniza y limita su expresión ritual para proteger las vidas de los sobrevivientes. La pregunta que se desprende de este problema ético-político es si, efectivamente, la protección sanitaria de la vida impuesta por la protocolización que restringe y homogeniza la realización de rituales fúnebres es algo que pueda ser puesto en valor, en un momento tan determinante como la muerte de un ser querido. A partir del análisis realizado y considerando la necesidad de tomar las medidas necesarias para evitar los contagios, se concluye la importancia de que estas medidas consideren fórmulas compensatorias que permitan a los deudos y a la sociedad, procesar las pérdidas humanas producto de la pandemia. Las directrices anticipadas aún no se encuentran legisladas en todos los estados de la República mexicana. En algunos de los estados en los que sí se encuentran legisladas, se prohíbe expresamente su validez durante el periodo de gestación. Lo anterior representa dilemas bioéticos y jurídicos importantes, los cuales revisamos para esclarecer las diversas interrogantes que surgen en materia de la protección tanto del bebé como de la madre gestante. Concluimos que existe una necesidad de desarrollar una ley federal que homologue (...) las directrices anticipadas, garantizando una muerte digna a todos los mexicanos, y que establezca que en caso de encontrarse en periodo de gestación, se busque asesoría por un comité de bioética que apoye a determinar en cada caso particular, las condiciones que favorezcan el desarrollo y supervivencia del bebé, siempre que sea posible, sin recurrir a tratamientos y/o medidas extraordinarias que pongan el riesgo la muerte digna y libre de sufrimiento de la madre. A Crítica de Hume ao Argumento do Desígnio José Oscar de Almeida Marques Dep. de Filosofia – UNICAMP -/- RESUMO: É comum considerar que o chamado “argumento do desígnio” (o argumento a posteriori para provar a existência de Deus a partir da ordem e funcionalidade do mundo) teria sido refutado ou seriamente abalado por Hume. Mas a natureza e o alcance dessa alegada refutação são problemáticos, pois Hume muitas vezes expressou suas críticas através de seus personagens e evitou assumi-las diretamente (...) enquanto autor. Em vez de supor que Hume procedeu dessa forma apenas para disfarçar suas verdadeiras convicções e evitar um conflito com as autoridades eclesiásticas, proponho que sua posição nesse assunto não é tão categórica como às vezes se supõe, e que os famosos argumentos de Filo nos Diálogos mostram apenas que é possível que a ordem e funcionalidade do mundo tenham surgido sem a intervenção de um desígnio consciente, mas não podem por si sós dar a essa hipótese o mínimo grau de plausibilidade necessário para torná-la digna de uma séria consideração. De fato, antes da revolução explicativa operada por Darwin um século depois, ninguém estava realmente em condições de vislumbrar uma alternativa plausível à atuação de algum tipo de inteligência na geração da ordem e funcionalidade do mundo. ------------ Some Remarks on Hume’s Critique of the Argument from Design José Oscar of Almeida Marques Dep. of Philosophy - UNICAMP -/- ABSTRACT: The so-called “argument from design” (the a posteriori argument to prove the existence of God from the order and functionality of the world) is commonly considered to have been refuted or seriously impaired by Hume. But the nature and scope of this alleged refutation is problematic because Hume often expressed his critics through other characters’ mouth and avoided to assume them directly as author. Contrarily to the supposition that Hume proceeded in this way only to disguise his true convictions and to avoid a confrontation with the ecclesiastical authorities, I propose that his stance on the matter is not, in fact, as clear-cut as it is sometimes supposed, and that Philo’s famous arguments in the Dialogues show only that it is possible for the order and functionality of the world to have arisen without the intervention of an intelligent design, but cannot by themselves lend to this hypothesis the least degree of plausibility needed to make it worthy of serious consideration. In fact, before the explanatory revolution inaugurated by Darwin a century later, nobody was in position to envisage a plausible alternative to the operation of some sort or other of intelligence in the generation of the order and functionality of the world. Con el proyecto rawlsiano de una teorí­a de la justicia resumida en dos principios básicos y la prioridad de las libertades, la filosofí­a moral volví­a a surgir como una materia digna de reflexión rigurosa y capaz de contribuir al debate público. Rawls presentaba una defensa racional de principios normativos de justicia susceptibles de reconocimiento público como base moral para las democracias contemporáneas. A treinta años de Teorí­a de la justicia, pueden destacarse del legado rawlsiano los siguientes temas y perspectivas: (...) la cuestión de la justicia como un problema moral-filosófico, la reconsideración de ideas y autores clásicos para la reflexión filosófica contemporánea, la filosofí­a como defensa razonable de un orden constitucional democrático y justo, el carácter prioritario que tiene la justicia en la cooperación social, la idea de la prioridad de las libertades, la relación de las libertades con la economí­a de mercado, el tema de la estabilidad de una sociedad con base en una concepción pública de la justicia y la defensa del liberalismo desde una perspectiva moral y en las condiciones actuales de vida. In a sense what Nozick stated on pointing out that after the publication of A Theory of Justice political philosophers should work according to Rawls "™ theory and if not explain why not, continues to be true. Para ser virtuosas, éstas deben ser loables, es decir, dignas de ser elogiadas por la comunidad a la que pertenece el agente. Pero para ser loables deben ser, a la vez, voluntarias y responsables. ¿Son las condiciones de la responsabilidad las mismas que las de la voluntariedad? Creo que, para Aristóteles, la voluntariedad es sólo la primera condición de la responsabilidad. La segunda, (...) tan necesaria como la primera, es la elección. Para mostrarlo, analizo las condiciones de una y otra, señalando lo que las condiciones de la elección añaden a las de la voluntariedad. Resumen: El objetivo principal de este artículo es mostrar las importantes consecuencias antropológicas que tiene el análisis kantiano de lo sublime. A partir de la idea de lo sublime de Kant, primero, se desprende una alta estimación de la humanidad y, segundo, se deduce un concepto de ser humano como finitud infinita. Dado que lo sublime es además respeto por la naturaleza, también se infiere una concepción de la naturaleza opuesta a la que representa la modernidad científica, una naturaleza humanizada (...) digna de admiración y respeto.: The main goal of this paper is to show the important anthropological consequences of the Kantian analysis of the sublime. From Kant’s idea of the sublime, first, a high estimation of humanity is inferred and, second, a concept of human being as infinite finitude is deduced. Since the sublime is also respect for nature, it also infers a conception of nature opposite to that represented by scientific modernity, a humanized nature worthy of admiration and respect. Buddhist philosophers have investigated the techniques and methodologies of debate and argumentation which are important aspects of Buddhist intellectual life. This was particularly the case in India, where Buddhism and Buddhist philosophy originated. But these investigations have also engaged philosophers in China, Japan, Korea and Tibet, and many other parts of the world that have been influenced by Buddhism and Buddhist philosophy. Several elements of the Buddhist tradition of philosophy are thought to be part of this investigation. -/- There are (...) interesting reasoning patterns discernible in the writings of Buddhist philosophers. For instance, the Mādhyamika philosopher Nāgārjuna presents arguments for the emptiness of all things in terms of catuṣkoṭi (four ‘corners’: roughly speaking, truth, false, both, neither). There are also the Indian vāda (debate) literature and Tibetan bsdus grwa (collected topics) that list techniques of debates. -/- The main interest here is the tradition of Buddhist philosophy, sometimes referred to as Pramāṇavāda, whose central figures are Dignāga (approx. 480–540 CE) and Dharmakīrti (6th– 7th CE). This philosophy is understood to be the Buddhist school of logic-epistemology. ‘Pramāṇavāda’ is not a doxographical term traditionally used to refer to a recognised school of Buddhist philosophy. It is a conventional term that is sometimes used in modern literature. Nevertheless, in what follows, we think of it as a tradition within Buddhist philosophy and ‘Buddhist logic’ refers to what is developed in this tradition. -/- Buddhist logicians have systematically analysed the kind of reasoning involved in acquiring knowledge. They hold that there are valid ways to reason that are productive of knowledge. In what follows, some of the main elements of their analyses will be described. Note, however, that, while exegetical studies of Buddhist texts are important, we must step back from them and consider what is involved in taking a Buddhist approach to logic in light of modern formal logic. This analysis will be done against the backdrop of the contemporary literature on logic and related subjects in contemporary philosophy to make sense of the logical studies by Buddhist logicians. Se refieren casos específicos de violencia sexual en Colombia y se expone la importancia de la creación de comunidades de confianza que propicien espaclos para la narración y escucha de los testimonlos de víctimas, la tramitación de conflictos (...) y nuevas vías de afrontamiento, a partir de los recursos que brinda la reinvención de hábitos corporizados en el arte. ABSTRACT The article analyzes the relation among memories inscribed in the body, trauma, and the subjective and collective embodied resources available to women victims of violence in order to reconstruct and resignify themselves as persons worthy of credibility and as agents of change. It discusses specific cases of sexual violence in Colombia and the importance of creating communities of trust that foster spaces for narrating and listening to the testimonies of victims, as well as for handling conflicts and exploring new ways of coping, on the basis of the resources provided by the reinvention of habits embodied in art.
