El artículo aborda la discusión acerca de la unicidad divina y la existencia de atributos, tanto en la filosofía como en la teología islámica medieval, haciendo énfasis en la obra de Averroes. Se analiza cómo en el pensamiento Islámico, al tiempo que se afirma el dogma de la unicidad divina se sostiene la existencia de atributos reales, apuntando directamente a conceptos dialecticos como unidad y multiplicidad, identidad y diferencia, o igualdad y alteridad. Así mismo, partiendo del análisis de su obra, (...) se busca mostrar la manera en la que el pensador cordobés legitimó el uso de la razón filosófica como camino optimo y recomendado para el abordaje de las verdades religiosas. Se considera que Averroes avanzó en una doctrina teológico-filosófica particular diferente del asharismo que se estaba imponiendo en la época, resistiéndose a Al Ghazali, y reivindicando el valor la perspectiva peripatética para enriquecer el debate en el Islam. In this study, bullying is examined in light of the “prosocial security hypothesis”— i.e., the hypothesis that insecure attachment, with temperamental dispositions such as sensation seeking, may foster individualistic, competitive value orientations and problem behaviors. A group of 375 Italian students (53% female; Mean age = 12.58, SD = 1.08) completed anonymous questionnaires regarding attachment security, social values, sensation seeking, and bullying behaviors. Path analysis showed that attachment to mother was negatively associated with bullying of others, both directly and through (...) the mediating role of conservative socially oriented values, while attachment to father was directly associated with victimization. Sensation seeking predicted bullying of others and victimization both directly and through the mediating role of conservative socially oriented values. Adolescents’ gender affected how attachment moderated the relationship between sensation seeking and problem behavior. (shrink)

This paper intends to offer a critical evaluation of the role played by intuitions in the mainstream methodology in traditional analytic epistemology. The criticism directed to what I call methodology of evaluation by intuitions shows that epistemologists often idealize the reliability of intuitions when assessing a theory against potential counterexamples, ignoring that the disposition to answer intuitively to a case of concept attribution is bounded to the familiar dimension in which the relevant conceptual competence emerges. Thus, the reliability of intuitions (...) does not necessarily extend to far-fetched cases. Given that the assessment by our intuitions is not sufficient to decide for or against an epistemological theory, I offer a sketch for a pragmatic and naturalized conception of theoretical decision-making in epistemology.Key-words: Intuitions, Analytic epistemology, Conceptual abilities, Naturalism, Pragmatism. Anticipatory looking on mindreading tasks can indicate our expectation of an agent's action. The challenge is that social situations are often more complex, involving instances where we need to track an agent's false belief to successfully identify the outcome to which an action is directed. If motor processes can guide how action goals are understood, it is conceivable— where that kind of goal ascription occurs in false-belief tasks— for motor representations to account for someone's belief-like state. Testing adults (N = (...) 42) in a real-time interactive helping scenario, we discovered that participants' early mediolateral motor activity (leftwards– rightwards leaning on balance board) foreshadowed the agent's belief-based action preparation. These results suggest fast belief-tracking can modulate motor representations generated in the course of one's interaction with an agent. While adults' leaning, and anticipatory looking, revealed the contribution of fast false-belief tracking, participants did not correct the agent's mistake in their final helping action. These discoveries suggest that adults may not necessarily use another's belief during overt social interaction or find reflecting on another's belief as being normatively relevant to one's own choice of action. Our interactive task design offers a promising way to investigate how motor and mindreading processes may be variously integrated. (shrink)

Emotions and personhood are important notions within the field of mental health care. How they are related is less evident. This book provides a framework for understanding the important and complex relationship between our emotional wellbeing and our sense of self, drawing on psychopathology, philosophy, and phenomenology.

Risk and crisis communication (RCC) is a current ethical issue subject to controversy, mainly due to the tension between individual liberty (a core component of fairness) and effectiveness. In this paper we propose a consistent definition of the RCC process in public health emergencies (PHERCC), which comprises six key elements: evidence, initiator, channel, publics, message, and feedback. Based on these elements and on a detailed analysis of their role in PHERCC, we present an ethical framework to help design, govern and (...) evaluate PHERCC strategies. The framework aims to facilitate RCC, incorporating effectiveness, autonomy, and fairness. It comprises five operational ethical principles: openness, transparency, inclusivity, understandability, and privacy. The resulting matrix helps understanding the interplay between the PHERCC process and the principles of the framework. The paper includes suggestions and recommendations for the implementation of the PHERCC matrix. (shrink)

Frederic Kellogg has already published several works on legal pragmatism and on Oliver Wendell Holmes in particular.1 In this volume, he focuses on the early history of Holmes' views, on his readings in law and philosophy, and his interests in science in the years of the Metaphysical Club. Drawing on sources like Francis Bacon, John Stuart Mill and Chauncey Wright, Holmes developed an inductive approach to common law reasoning; eventually, as I discuss below, this approach needed refinement when he engaged (...) with constitutional interpretation. There are two intuitions about time. The first is that there's something special about the present that objectively differentiates it from the past and the future. Call this intuition Specialness. The second is that the time at which we happen to live is just one among many other times, all of which are ‘on a par’ when it comes to their forming part of reality. Call this other intuition Egalitarianism. Tradition has it that the so-called ‘A-theories of time’ fare well (...) at addressing the first intuition, but rather badly when it comes to the second. The recent outbreak of the SARS-CoV-2 coronavirus is posing many different challenges to local communities, directly affected by the pandemic, and to the global community, trying to find how to respond to this threat in a larger scale. The history of the Eyam Plague, read in light of Ross Upshur’s Four Principles for the Justification of Public Health Intervention, and of the Siracusa Principles on the Limitation and Derogation Provisions in the International Covenant on Civil and Political Rights, could provide (...) useful guidance in navigating the complex ethical issues that arise when quarantine measures need to be put in place. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. In this paper, we consider the nature of two aspects of human emotional experience—moods and affects—in their relation to the concept of the person. We argue for the importance of the concept of the person in an approach to human emotional experience. This paper differentiates between the concepts of minimal self, extended self, and person. Furthermore, it offers a phenomenological proposal to understand the feeling dimension of moods and affects as critical for the differentiation of human emotional experience, and hence (...) an understanding of that experience. By way of conclusion, we opt for a narrative approach to the question of the normative dimension of emotional experience to clarify the intricate relationship between mood and personhood. (shrink)

How is it possible that a phenomenon like psychoanalysis, which has dominated the cultural and intellectual life of the last century in Europe, North and South America, has had apparently no resonance in Hong Kong? While psychoanalysis is raising some interest in Mainland China and in Taiwan, it remains only marginally relevant in Hong Kong. This book attempts to explain why. Addressing the subject from an East to West approach, this study proposes an experience of displacement, as it is argued (...) that the chance for psychoanalysis today is not just to be exported to the East, but asking how psychoanalysis can be re-invented after experiencing the culture in Hong Kong. What remains of psychoanalysis, after this? How to re-invent and innovate psychoanalysis today? Our objective in this paper is twofold: first, we intend to address the tenability of the enactivist middle way between realism and idealism, as it is proposed in The Embodied Mind. We do so by taking the enactivist conception of bringing forth a world literally in three conceptual levels: enaction, niche construction and social construction. Based on this proposal, we claim that enactivism is compatible with the idea of an independent reality without committing to the claim that organisms have cognitive (...) access to a world composed of properties specified prior to any cognitive activity. Our second goal is to show that our literal interpretation of bringing forth a world not only sustains the legitimacy of the middle way, but it also allows us to revive the conception of evolution as natural drift—which is perhaps the least examined aspect of the original enactivist theory and is central to the understanding of cognition in an enactive way. Natural drift focuses on how structural couplings between organism and environment trigger viable pathways of maintenance and reproduction, instead of selecting the most adapted trait to a pregiven environment. Thus, although enactivists typically do not explore the consequences of their views regarding evolutionary dynamics, we show how natural drift provides a suitable starting point. (shrink)

This paper develops two new measures of labor tax avoidance based on social contribution expenses reported in financial statements and tests them and their determinants within a sample of 224 Italian firms defined as legally registered Mafia firms due to having been confiscated at some point by judicial authorities, in relation to alleged connections with Italian organized crime. Overall, our results reveal that before confiscation LMFs engage more in LTAV than lawful firms do, whereas after confiscation there is no significant (...) difference between both types of firm. Furthermore, we find that several factors have a significant influence on the probability of engaging in such a practice. This study can enhance further research on the effectiveness of our measures and on the determinants of LTAV in other contexts and for other types of firms. Moreover, these measures can be added to the other direct and indirect methods commonly employed to measure and detect undeclared work representing a primary means of LTAV. Finally, our study allows inferring conclusions on the relation between corporate social responsibility and tax avoidance, suggesting that socially irresponsible firms, such as LMFs, are more likely to adopt this practice. The paper focuses on the role of relativistic ideas in Wittgenstein’s philosophy. In particular, it focuses on On Certainty (1969), where in (305), Wittgenstein explicitly invokes Einstein’s theory of relativity: “Here once more there is needed a step like the one taken in relativity theory.” The aim of the paper is to establish a connection between Wittgenstein and Einstein that is both theoretically and exegetically sound. In particular, the paper argues that Wittgenstein’s reaction to scepticism closely resembles Einstein’s reaction to (...) the ether. (shrink)

The coronavirus COVID-19 pandemic is an unprecedented health crisis. Many governments around the world have responded by implementing lockdown measures of various degrees of intensity. To be effective, these measures must rely on citizens’ cooperation. In the present study, we drew samples from the United States (N= 597), Italy (N= 606), and South Korea (N= 693) and examined predictors of compliance with social distancing and intentions to report the infection to both authorities and acquaintances. Data were collected between April 6th (...) and 8th 2020. We investigated the role of cultural orientations of horizontal and vertical individualism and collectivism, self-conscious emotions of shame and guilt related to the infection and trust in the government’s action. Across all countries, vertical collectivism (VC) predicted stronger shame, whereas horizontal collectivism predicted stronger trust in the government. Only in the United States, VC was associated with stronger trust. Stronger feelings of shame predicted lower compliance and intentions to report the infection to both authorities and acquaintances. In contrast, guilt was associated with stronger intentions to report the infection to the authorities. Finally, trust was associated with stronger compliance and intentions to report the infection to the authorities. Unlike Italy and South Korea, the association between trust on compliance was not statistically significant in the United States, implications of the findings, and directions for future research are discussed. This paper argues that the gesture of being silent —or “subjective silence”— can be described as a specific modulation of attention, in which consciousness gains awareness of a specific realm of experience where the body appears as a transcendental dimension of the self. Taking Dauenhauer’s typology as a point of departure, I will describe what I understand with the expressions “subjective silence” –and “the gesture of being silent”– and try to show its specific relation to “attention,” according to Husserl’s description (...) of it. Second, that the noematic field of this “subjective silence” is the realm of the pre-predicative, since it allows consciousness to maintain a certain intentional tension that does not focus on any categorial object. Finally, I will try to show that in this realm of the pre-predicative, the body appears as an immanent dimension of consciousness and, therefore, not as a mere object but as a transcendental instance of the self. La libertad ética debe descubrirse en el intersticio entre la libertad positiva y la negativa, considerándose como límite pero no limitada por éstas. En esa frontera tienen lugar los encuentros y los acuerdos entre los hombres libres, los cuales, más allá de la ley, pueden establecer relaciones justas. Por eso la ética es también un encuentro como lo es la política, entendida como vínculo entre la comunidad y la libertad moral de los individuos.

A growing group of institutional investors use divestment strategically to deter misconducts that are harmful for the climate and society. Based on Kantian ethics, we propose that divestment represents investors’ universal and absolute moral commitment to socially responsible investing (SRI). Following categorical and hypothetical imperatives and reciprocity as a norm, we hypothesize how institutional investors’ commit to SRI through a divestment strategy against ethically reprehensible behaviour of banks, especially when these investors represent banks themselves. Using a hand-collected database of the (...) revelation dates of enforcement actions on banks, we find evidence that banks are less likely to divest equity holding on banks with misconduct (fined banks) than their non-bank institutional investors peers. Banks that commit to invest responsibly by signing for the Principles for Responsible Investment (PRI) are not significantly more likely to divest on fined banks stocks than non-signatory banks. Moreover, divestment of fined banks whose own legitimacy to operate is in question is not significantly different from non-fined banks divestment. We find that European banks are more inclined to sell their holdings permanently on fined banks than their United States peers. Therefore, bank’s moral commitment to SRI via divestments is influenced more by cultural and reciprocity norms than their moral commitment to participate in the PRI. (shrink)

El objetivo del siguiente artículo es identificar los elementos que componen la función del intelectual en Michel Foucault y explicar el modo cómo ellos actúan. La tesis que se desarrollará es que dicha función se entiende a partir de los efectos políticos producidos por discursos de verdad. Se argumentará que en ella se concatenan estos tres elementos (Discurso, política y verdad) siendo atravesados por las relaciones de poder.
