Lack of understanding about the relationship between federal and state educational institutions brings confusion into discussions of democracy, equity and equality in schools. The 'right to education' continues to be espoused by American society as a birthright, yet it does not figure in federal documentation. This matter has repeatedly come to the attention of legislative courts, who have insisted that the question of education as a fundamental right be addressed. Numerous court cases have attempted to bring closure on this issue, (...) on the basis of such abstractions as national rights, equal access, opportunity and economic disparity among the petitions. However, legal judgments remain inconclusive, reiterating that education remains a state legislative issue. This paper explores the implications of a fundamental right to education through an examination of federal and state legal litigation, discussing the philosophical and ideological roots of discussion of rights and democratic values, and evaluating how federal and judicial participation contributes to overall misunderstanding regarding public schooling. We investigated the contributions of familiarity of setting, self-relevance and self-projection in time to episodic future thinking. The role of familiarity of setting was assessed, in Experiment 1, by comparing episodic future thoughts to autobiographical future events supposed to occur in unfamiliar settings. The role of self-relevance was assessed, in Experiment 2, by comparing episodic future thoughts to future events involving familiar others. The role of self-projection in time was assessed, in both Experiments, by comparing episodic future thoughts to autobiographical (...) events that were not temporal in nature. Results indicated that episodic future thoughts were more clearly represented than autobiographical future events occurring in unfamiliar setting and future events involving familiar others. Our results also revealed that episodic future thoughts were indistinguishable from autobiographical atemporal events with respect to both subjective and objective detail ratings. These results suggest that future and atemporal events are mentally represented in a similar way. (shrink)

In 1814, Jane Austen published Mansfield Park, which, despite being one of her lesser-known works raised important discussions about the depiction of its historical context. Having one of the characters as a landowner in Antigua, the novel prompted readings from post-colonialist perspectives, such as Edward Said’s interpretation of the “dead silence” scene, and George Boulukos’ discussion about amelioration. These approaches to the text have probably led Patricia Rozema into using the slave-dependency as central to the Bertrams’ lives in her 1999 (...) adaptation of the book. From this point of view, this article intends to compare Jane Austen’s Mansfield Park and Patricia Rozema’s film taking into account their different approaches to slavery.Keywords: Slavery. This paper discusses, within the context of analytical theory, some of the implications when rape is subsumed within the international crime of genocide and concludes that this type of enquiry is essential for creating a clearer framework to address and understand this violation. From the analysis undertaken, two critical questions become apparent: a) Does compatibility exist when rape is subsumed within the category of a group violation (genocide), if rape is constructed as a violation of an individual’s sexual autonomy? i (...) b) Is the link between rape and genocide necessarily problematic within this notion of autonomy for the individual victim of rape? The process unfolds within an analytical theoretical approach that touches upon the current concept of human rights with its focus on the individual. Although the key element is the individual, the concept of human rights also creates a space, albeit limited and at times controversial, for the group. As such, this paper identifies some of the theoretical implications that emerge once rape is subsumed within the international crime of genocide, which is defined as a violation committed against particular groups. This contribution addresses some bioethical and medico-legal issues of the opinion formulated by the Italian National Bioethics Committee (CNB) in response to the dilemma between the State’s duty to protect the life and health of the prisoner entrusted to its care and the prisoner’s right to exercise his freedom of expression. The prisoner hunger strike is a form of protest frequently encountered in prison and it is a form of communication but also a language used by the prisoner in order (...) to provoke changes in the prison condition. There are no rules in the prison regulations, nor in the laws governing the legal status of prisoners, that allow the conscious will of the capable and informed subject to be opposed and forced nutrition to be carried out. However, this can in no manner make therapeutic abandonment legitimate: the medical doctor should promote every action to support the patient. In the recent opinion formulated by the CNB it was remarked how self-determination is a central concept in human rights and refers to an individual’s ability to make autonomous and free decisions about his or her life and body. The rise of the idea of the Anthropocene is promoting multiple reflections on its meaning. As we consider entering this new geological epoch, we realize the pervasiveness of humankind’s deconstruction and reconstruction of the Earth, in both geophysical and discursive terms. As the body of the Earth is marked and reshaped, so is its idea. From a hostile territory to be subjugated and exploited through sovereign commands, the Earth is now reframed as a vulnerable domain in need of protection. The (...) mode of sovereignty, which has accompanied human and legal history and practice during modernity and its project of mastery, is no longer useful. Humanity’s control of the Earth is being reimagined and reconfigured along biopolitical coordinates of thought and action. Biopolitics shifts the focus of power, changes its modalities of interventions, and rearticulates its legitimacy on the idea of taking responsibility for the Earth, for nature. A biopolitical re-orientation of law captures the fundamental aim of caring for nature, of fostering its vital possibilities and of enhancing its productive potential. Yet, biopolitics engulfs nature in its entirety under its framework of control, where protection and subjugation, vulnerability and productivity, life and death are constantly entangled in a reciprocal and inevitable relation of indistinguishability. Sovereignty becomes thus a key modality of biopolitical intervention, when nature is recalcitrant, wild, spontaneous, unpredictable, violent, dangerous. Biopolitics, thus, remains caught in an undecidable dilemma, where in order to protect the Earth, it must subjugate it; to save it, it must condemn it. In this respect, biopolitics remains utterly modern, or as argued by Roberto Esposito, modernity has always been biopolitical, insofar as modernity has emerged as a framework for the protection of life against life’s own excesses. But how can we escape the biopolitical reframing and enframing of the Earth and its total subsumption under its matrix of control? How can we rethink the encounter between law and nature without remaining entangled in the aporetic dilemma of biopolitics? An aesthetics of wonder may offer a way. (shrink)

In the Cairo Genizah were manuscripts with Gregorian notation and Hebrew script. They also appeared documents that point to author of the scores at Giovanni-Obadiah, a twelfth century Christian monk, born in southern Italy, who converted to Judaism. Until now, the study of this personage has been realized almost exclusively from the Jewish point of view. Nevertheless, like Obadiah synthesizes the traditions Christian and Jewish in its notation when copying Hebrew melodies with Christian notation, also it does in his texts. (...) Obadiah transcribed a Latin appointment of Joel to Hebrew characters. This article pretends to oppose his conversion to Judaism with his ordination as a Christian monk through the prophecy of Joel, which implies an intense dialogue between the two traditions. (shrink)

This memoir consists of two parts, of which the first deals with the foundations of the theory of the struggle for existence, and begins with the introduction of the important concept of quantity of life, besides that of population. The fundamental equations are then established for the case where the individuals of a biological association mutually devour each other, the reasoning being based on the principle of encounters and on the fundamental hypothesis of the existence of equivalents of the individuals (...) constituting the different species which form the association.Having now obtained the equations which determine the rates of change of the numbers of individuals and of the quantities of life of the species, the memoir proceeds to find the equations relating to the stationary state, by establishing theorems which are afterwards applied for the purpose of obtaining the three general laws of the fluctuations. This investigation of the equilibrium state is then followed by the determination of the integrals of the fluctuation equations, and the deduction from these of their most important consequences.The second part of the memoir contains the enumeration and demonstration of the general laws of the struggle for existence, which flow from the discussion of the principles and the integrals obtained in the first part. In this way there is established a new sort of dynamics, demographic dynamics, which, though substantially different from the dynamics of material systems, is developed from an analogous point of view.The second part begins with the principle of the conservation of demographic energy, according to which there are two sorts of energy, one actual and one potential, which transform mutually the one into the other. This principle is the analogue of the principle of conservation of mechanical energy. Realist evaluation has gained prominence in the field of evaluation in recent years. Its theory-driven approach to explaining how and why programmes work or not makes it attractive to many novices, early career researchers, and organizations implementing various programmes globally and relevant to policymakers and programme implementers. While realist evaluation seeks to be pragmatic, adopting principles and methods that can be used to help focus an evaluation, its deep ontological and epistemological foundations make its application in real-life situations challenging. In (...) this paper, we seek to unpack the key tenets scaffolding the practical application of realist evaluation. Although Pawson and Tilley foreground realist evaluation in applied scientific realism, we argue that an amalgam of scientific and critical realist principles underpins realist evaluation. We unpack these principles and illustrate how they fit into each other to provide a cogent theoretical foundation for realist evaluation. (shrink)

Is the assessment of motor milestones valid and scaled equivalently for all infants? It is not only important to understand if the way we use gross and fine motor scores are appropriate for monitoring motor milestones but also to determine if these scores are confounded by specific infant characteristics. Therefore, the aim of the study is to investigate the latent structure underlying motor milestone assessment in infancy and measurement invariance across sex, birth weight, and gestational age. For this study, the (...) birth cohort data from the United Kingdom Millennium Cohort Study was used, which includes the assessment of eight motor milestone tasks from the Denver Developmental Screening Test in 9-month-old infants, depicting early motor development of the first children of generation Z. Confirmatory factor analyses showed a better model fit for a two-factor structure compared to a one-factor structure, and multiple indicators multiple causes modeling revealed no differential item functioning related to sex, birth weight, and gestational age. The study provides support for the use of gross and fine motor scores when assessing motor milestones in infants—both boys and girls with different birth weights and of varying gestational ages. Further investigation into widely adopted assessment tools is recommended to support the use of valid composite scores in early childhood research and practice. (shrink)

Norman tries to link the ecological and constructivist approaches to the dorsal and ventral pathways of the visual system. Such a link implies that the distinction is not only one of approach, but that different issues are studied. Norman identifies these issues as perception and action. The influence of contextual illusions is critical for Norman's arguments. We point out that fast (dorsal) actions can be fooled by contextual illusions while (ventral) perceptual judgements can be insensitive to them. _Contributions to Law, Philosophy and Ecology: Exploring Re-Embodiments_ is a preliminary contribution to the establishment of re-embodiments as a theoretical strand within legal and ecological theory and philosophy. De tout temps, les hommes d'Etat ont eu pour préoccupation majeure de réaliser l'intégration de leurs citoyens. C'est ce souci qui conduit, dès -334, Alexandre le Grand, élève d'Aristote, à l'élaboration d'une pensée unique et universelle pour assurer la cohésion de son Empire à l'échelle planétaire. La pensée devient alors, par sa fonction d'intégration, une entreprise gérée par l'Etat qui la fait évoluer selon des procédés appelés à se transmettre d'Empire à Empire. L'enquête menée par l'auteur, en suivant la formation (...) de la pensée universelle en milieux grec et romain, sa rivalité avec le judaïsme, sa rencontre avec le christianisme et sa confrontation avec l'Islam révèle les enjeux de fond qui expliquent la genèse de la pensée en Occident et les temps forts de son évolution. Na tragédia de Eurípides, Electra, ganha relevo um embate discursivo entre Electra e sua mãe Clitemnestra, no qual ocorre uma subversão do contrato parresiástico, segundo Foucault (2007). Focalizando precisamente essa subversão, propomo-nos retornar a uma história das mulheres na Grécia Antiga, a fim de compreendermos os atravessamentos que essas mulheres têm em suas relações com as verdades, rituais, preceitos e condutas que, por sua vez, são indicativos de suas construções enquanto sujeitos. Este estudo enfoca os estilos de vida de adolescentes escolares a fim de identificar tanto as práticas protetivas quanto as arriscadas entre grupos de adolescentes. O estudo transversal contou com uma amostra de 1210 adolescentes escolares de nono ano do ensino fundamental de 66 escolas públicas est.

2Public space is an old habit. The words public space are deceptive; when I hear the words, when I say the words, I’m forced to have an image of a physical place I can point to and be in. I should be thinking only of a condition; but, instead, I imagine an architectural type, and I think of a piazza, or a town square, or a city commons. Public space, I assume, without thinking about it, is a place where the (...) public gathers. The public gathers in two kinds of spaces. The first is a space that is public, a place where the public gathers because it has a right to the place; the second is a space that is made public, a place where the public gathers precisely because it doesn’t have the right—a place made public by force.3In the space that is public, the public whose space this is has agreed to be a public; these are people “in the form of the city,” they are public when they act “in the name of the city.” They “own” the city only in quotes. The establishment of certain space in the city as “public” is a reminder, a warning, that the rest of the city isn’t public. New York doesn’t belong to us, and neither does Paris, and neither does Des Moines. Setting up a public space means setting aside a public space. Public space is a place in the middle of the city but isolated from the city. Public space is the piazza, an open space separated from the closure of alleys and dead ends; public space is the piazza, a space in the light, away from the plots and conspiracies in dark smokey rooms. Dans la seconde moitié du XIXe siècle, un nombre important de femmes peintres, françaises et étrangères, sont actives professionnellement à Paris, et exposent au Salon, la manifestation annuelle d’art contemporain. À la différence de leurs confrères, elles ont à se positionner par rapport à divers préjugés, notamment celui du dilettantisme qui influence leurs choix stylistiques. D’un autre côté, leurs écrits personnels (correspondances, mémoires, journaux intimes) mettent en évidence la vraie modernité de leur vie et de leur mode de pensée.

The distinction between ‘being’ and ‘essence’ arose in the elaboration of the theory of universal hylomorphism, defended by the Franciscans, which maintained that there is a composition of matter and form in all beings other than the First cause. This paper focuses on a formula which Jean de La Rochelle (1190/ 1200-1245) borrows from Boethius (c. 480-524) to explain how the ‘being’ of the soul is distinct from the ‘essence’ of the soul. This paper aims to analyze Pierre Janet’s interpretation of Maine de Biran’s notion of the “unconscious” through a comparative study between L’automatisme psychologique (1889) and some Biranian writings devoted to the problem of pure affections. The objective is to question whether Janet’s psychological reading of this very notion had been faithful to Biran’s intentions, and to understand what kind of Biranism Janet is referring to when dealing with the problem of the unconscious.

En 1868, vingt ans après la naissance du féminisme américain, se forme en Europe un mouvement pour l'émancipation des femmes qui, faute de faire l'unité sur la demande du droit de vote, se concentre sur l'exigence de l'amélioration de l'enseignement féminin. À l'exemple américain, des femmes de plusieurs pays plaident pour la mixité scolaire ou coéducation. Dans les nombreux congrès internationaux ou nationaux, on en discute fortement dans la dernière décennie du XIXe siècle. C'est d'abord le fait des Françaises, des (...) À lafin du XVIII e siècle, lemédecin et philosophe allemand Ernst Platner, en rapportant une observation faite sur un aveugle-né, affirme qu’un homme privé de la vue depuis la naissance ne peut pas posséder la catégorie de l’espace. Cette courte observation s’affirme bientôt comme référence privilégiée du débat sur la nature acquise ou innée de la connaissance. L’une des principales contributions publiées en France est le texte de Jules Lachelier sur la genèse de la notion d’espace. Texte fort peu connu (...) de la production de l’auteur, « L’Observation de Platner » (1903) renferme des vues originales sur la question. Sur la base d’une connaissance approfondie du débat psychologique de l’époque, Lachelier donne ici une nouvelle forme aux positions spiritualistes formulées sur le problème, en finissant par reconceptualiser le dualisme entre nativisme et empirisme.
