In this paper we will analyze critically the traditional interpretation of the principle of subsidiarity in the Chilean Constitution of 1980 and its influence on the configuration of our economic constitution. To this end, firstly we will study the traditional interpretation of the subsidiarity, trying to demonstrate its faults, and its relationship with neoliberalism. After, we will evaluate the influence of this position on the constitutional jurisprudence of recent years. Categories, as mental structures, are more than simply sums of property frequencies. A number of recent studies have supported the view that the properties of categories may be organised along functional lines and possibly dependency structures more generally. The study presented here investigates whether earlier findings reflect something unique in the English language/North American culture or whether the functional structuring of categories is a more universal phenomenon. A population of English-speaking Americans was compared to a population of Cantonese-speaking Hong Kong (...) Chinese. The findings clearly support the view that functional influences on category centrality are universal (or at least common to Cantonese-speaking Hong Kong Chinese and English-speaking Americans), albeit with specific cross-cultural/cross-linguistic group differences in the particular properties that are considered central to categories. Jeffery et al. extensively and thoroughly describe how different species navigate through a three-dimensional environment. Undeniably, the world offers numerous three-dimensional opportunities. However, we argue that for most navigation tasks a two-dimensional representation is nevertheless sufficient, as physical conditions and limitations such as gravity, thermoclines, or layers of earth encountered in a specific situation provide the very elevation data the navigating individual needs.

Aspects of the current practice of prenatal diagnostics in Russia are surveyed. In the light of this, various ethical concerns are highlighted: (1) the requirement of parental informed consent to testing is not always sufficiently respected either in state regulation or in the practice of physicians; (2) not all Russian physicians are aware of international guidelines or standards of good practice in areas such as non-directive counselling, patient confidentiality with respect to genetic information and the patient’s right to maintain control (...) over his or her information; (3) abortion is viewed increasingly as an aspect of preventive medicine. ABSTRACT When melancholy is mentioned in connection with pietism, it is usually associated with self-ordained contrition and castigation which, according to the opponents of this religious movement, is prone to drive the believers into pathological dejection or even suicide. The example of the radical pietist Frankfurt physician Johann Christian Senckenberg, however, demonstrates the need for a more differentiated approach. As Senckenberg attained his medical knowledge primarily through physical and mental self-observation, he experienced the sadness of his own soul as (...) absence of divine grace and increased irritability resulting from his own wilfulness and lack of faith in God. Similarly, he interpreted his hypochondriac affliction as a divine punishment for his lustfulness and culinary debauchery. Concluding that both ailments could be remedied by dietetic moderation, steadfastness against temptations and withdrawal from the company of sinners, temporary seclusion and abstinence to him did not at all serve the crucifixion of the flesh, but rather functioned as part of a dietary cure, from which the sufferer could emerge cheerfully and strengthened. In this way, he could not only identify melancholy as a pathological yet treatable condition, but also solve the seeming contradiction between pious humility and independent self-preservation. This manuscript shows Kierkegaard's idea of paganism. We use the complete author´s work published during his life, including the one written under a pseudonym. In our analysis we discover that Kierkegaard used the term paganism in three different ways: The paganism of the one who lives in the world without God, the Christian paganism, and the paganism of Socrates. By showing the richness of Kierkegaard's approach to paganism we determine that this idea is not defined by its adherence to (...) one particular religion or moment in history. Rather, it refers to the way of living one's existence and relationship with God. Therefore, the idea of paganism is not necessarily something negative for a 19th century Lutheran Christian. To the point that Kierkegaard says that what Denmark really needs, and this could be extended to Europe today, is a new Socrates. (shrink)

“Sacra à Deo in corde discenda, natura ex natura.” Johann Christian Senckenberg's Observationes as a Medico-Theological Writing Method. In his early diaries, the pietist physician Johann Christian Senckenberg has taken down large amounts of observation data which mostly concentrated on his own body and soul. Earlier research has mistaken his diligent self-observation for hypochondria and unworldliness, especially since the author had never endeavoured to analyze and publish his work. The article shows that both his writing practice and his (...) reluctance to process and share its results are due to his deeply religious and firmly anti-rationalist conviction. The main purpose of his journal keeping was the attainment of religious self-knowledge and professional self-perfection. Scientific publications he considered to be hypothetical and dogmatic, be it in theology or medicine; moreover, their authors were often enough driven by their self-love and desire for fame. In his eyes, the only godly way of knowledge acquisition was the humble, diligent and minute study of divine creation according to the Hippocratic method. The most immediate and reliable way of achieving true wisdom, however, was the observation of God's work within one's own body and mind, which were subject to the effects of God's grace and punishment as well as to atmospheric, environmental and dietetic circumstances. Nicolaus Cusanus (1401-1464) konzipiert menschliche Erkenntnis als kreative, asymptotische Assimilation: Auf kreative Weise verähnlichen sich Menschen in Erkenntnisprozessen Denkunabhängigem, ohne diesen Verähnlichungsprozess je zum Abschluss bringen zu können. Obwohl menschliche Erkenntnis als kreativ charakterisiert wird, verliert sie nicht die Welthaftung. Obwohl sie asymptotisch verläuft, führt sie nicht zu Pessimismus und einem Ablassen von Erkenntnisbemühungen überhaupt. Cusanus macht die beiden Kernaspekte seines Modells menschlicher Erkenntnis trotz einiger systematischer Unschärfen im Rahmen eines massvollen Erkenntnisoptimismus kompatibel. Die vorliegende Monographie befasst sich mit diesem (...) Modell in zwei Hinsichten. Zunächst wird seine systematische Gestalt über das cusanische Oeuvre hinweg untersucht. Die zu diesem Zweck herangezogenen Werke sind De docta ignorantia, De coniecturis, Idiota de mente, De beryllo und das Compendium. Im Anschluss werden dann zentrale epistemologische Anfragen eingehender betrachtet und historisch kontextualisiert: Cusanus' Intellektverständnis, seine Stellung zu species-Theorien von Erkenntnis, seine Wahrheitsauffassung und sein Modell menschlichen Weltbezugs. Philosophy, as Aquinas, and many others, described it-- as a demonstrative progression from self-evident premises to evident (or even necessary [Scotus]) conclusions,-- is rarely attempted nowadays, even by "scholastic" philosophers. Demonstrative success,-- that is, entirely to eliminate competitors to one's conclusions, -- is not the expectation now, nor has it been the achievement of philosophers historically. Thus, some restrictions upon starting points may be relaxed as unnecessary, e.g. that they be self-evident.

Augustine’s important work De uera religione has been frequently read for its Neoplatonic resonances. However, there is much in the work that cannot be reduced to this reading. Themes such as the importance of the common and public dimension of uera religio, the significance of history, and the function of ‘true religion’ toward the training and renewal of the whole human, are topoi that reveal the dynamic structure of the work. A consideration of these themes in uera rel. brings into (...) full relief Augustine’s answer to why God acted in time and through history for the whole human race and helps to explain Augustine’s complex articulation of Christianity in the work. In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. Metaphysical anti-realism is a large and heterogeneous group of views that do not share a common thesis but only share a certain family resemblance. Views as different as mathematical nominalism—the view that numbers do not exist—, ontological relativism—the view that what exists depends on a perspective—, and modal conventionalism—-the view that modal facts are conventional—all are versions of metaphysical anti-realism. As the latter two examples suggest, relativist ideas play a starring role in many versions of metaphysical anti-realism. But what does (...) it mean for the existence of something to “depend on” a perspective, or for a modal fact to “depend on” a convention? We can distinguish between various dependence relations, giving rise to an array of drastically different forms of metaphysical anti-realism. This article offers a guided tour. I develop a systematic distinction between various forms of metaphysical anti-realism with a focus on the role of relativist ideas in this landscape. (shrink)

Its editors and contributors ask, “Where is psychoanalysis in contemporary thought?” At a time when the empirically based psychologies have long repudiated (...) the “talking cure” to the extent that the unconscious is not visible or easily measured, and when, on the other hand, psychoanalysis has been associated in the humanities with a radical political and social agenda, disappointed hopes for change have led many to throw the baby of psychoanalysis out with the bathwater of a utopian vision of transformation. The question now remains: “Whither psychoanalysis?” To answer this question (which is also a demand), the editors first acknowledge that the critique and curtailing of psychoanalytic thought in the cultural studies programs across the country in the last decade or so has been influenced by the works of Michel Foucault, his disciples, and the New Historicism. At the same time, they believe that the political, psychological, and moral dangers of embracing a knowing and cynical postmodernism that fosters hollow consumerism premised on modes of subjectivity that “neither ‘express’ interiority nor bear any relation to a lived past” are a real and present danger in contemporary life. “That the triumph of such a view has coincided with intellectuals’ renewed suspicion of psychoanalysis should, we believe, give us pause” (8). The essays that constitute the present volume thus insist on the persistence of the desire of the analyst: for knowledge of self and other, and by those who long for interpretive insight into interior lives and social places. The volume thus poses for its readers twin questions: “Why do we continue to desire psychoanalysis, and what should its role be in the cultural criticism of the new millennium?”This collection grew out of a conference organized around this question and thus reflects the varied but not necessarily interconnected papers offered in that setting. In an effort to provide some interconnections, the collection is divided into four sections grouped around the topics of psychoanalysis and the future of cultural criticism, collectivity, the author, and sexuality. The grouping does not, in my estimation, provide unity or coherence to the volume as a whole; nevertheless, each article emerges on its own terms as a strong contribution to the general field of psychoanalytic cultural criticism and critical theory. Henry Sussman’s “Psychoanalysis, Religion, and Cultural Criticism at the Millennium” provides an anchoring perspective to the volume, addressing with particular urgency the mutually transformative desire of and for analysis modeled on the transference/countertransference clinical encounter. This analogy [End Page 153] suggestively sets the stage for a like transformative intervention by the analyst in a cultural critique, while acknowledging that cultural studies provides the best interpretation and assessment of the ways that psychoanalysis operates historically and clinically in contemporary society. Sussman—and indeed many of the contributors—underscores the editors’ organizing declaration that since psychoanalysis derived from lived human experience it stands to reason that “analysis is both the product of and answer to suffering” (15).Thus it comes as something of a surprise that one of its editors, Greg Forter, in “F. Scott Fitzgerald, Psychobiography, and the Fin-de-Siecle Crisis in Masculinity,” locks the subject of psychoanalysis into a stranglehold with his presuppositions about the limits of history and the origins of psychoanalysis in the modern moment: “Because the theory and techniques of psychoanalysis were developed by analyzing modern men and women, psychoanalysis may be a theory of modern subjectivity rather than of subjectivity as such, and its mode of inquiry may be best suited to analyzing the phenomena of modernity” (148). Since Peter Brown, the standard reading holds that Augustine did not move beyond the Neoplatonism of his early dialogues until he studied the writings of the apostle Paul (...) in the mid-390s CE, after which his distinctive theology begins to emerge. In this book, Brian Dobell's basic claim is that, whatever the validity of the "volitional conversion" of book 8, Augustine is not truly converted to orthodox Christianity until he discards the Photinian (adoptionist) Christology he admits to in Confessions [hereafter conf.] 7.19.25, and discards the Platonic ascent as a means to contemplative union with God, both of which take place with the reading of Paul. But the book is equally motivated by a concern to defend the historicity of conf.; Dobell claims it is perfectly reliable, once we understand the latter half of book 7 not as a few months in 386, but as a compressed narrative spanning Augustine's entire development until his true conversion to Christianity around 395. [End Page 137]Dobell develops this argument by isolating Augustine's twofold way of salvation in the writings of the late 380s. First is the "way of authority," in which Augustine's putative Photinian Christology portrays Christ as a kind of "poor man's Plato, sent to provide a path to salvation for the uneducated masses" (96). The human Jesus is "assumed" by God and is as "a man of outstanding wisdom" (73) but is not the incarnate Son. Dobell analyzes the homo assumptus/susceptus language of the early writings, arguing that Augustine does not truly hold an orthodox Christology until 396, concordant with the development of his theology of operative grace. The second, much longer section of the book concerns the "way of reason," the intellectualist path of salvation expressed in Augustine's early obsession with the liberal disciplines. Dobell dissects the Platonic ascents of conf. 7, adducing verbal and conceptual parallels from texts ca. 387–390 (De immortalitate animae, De ordine, De libero arbitrio, De vera religione) showing how Augustine's métaphysique des degrés d'être, a concept Dobell borrows from Olivier Du Roy, provides both a means of articulating these ascents and an answer to the problem of evil. But by De doctrina christiana, Augustine has decisively rejected the Platonic ascent and the liberal disciplines, and it simply remains for his Christology to come in line for the "intellectual conversion" to be complete.Dobell's book is a significant addition to the current debate. His knowledge of the first decade or so of Augustine's literary output is impressive, and his familiarity with the secondary literature is considerable, though not encyclopedic—he misses the work of J. Patout Burns, which complicates the Pauline thesis through consideration of the anti-Donatist literature. Dobell offers magisterial and invaluable discussions of famously fraught topics such as Augustine's indecisiveness about the preexistence of the soul, or the volitional solution to the problem of evil. There are some problems with Dobell's argument, though. While his main thesis that conf. 7.9.13ff. is a kind of précis of almost a decade of intellectual development deserves serious consideration, and is an elegant solution to debates about the historicity of Augustine's narrative in conf., the supporting arguments Dobell employs are less persuasive. A major portion of his book revolves around the contention that Augustine's early, heretical Photinian Christology extends much longer than modern scholarship has realized, that Augustine rectifies this Christology in conjunction with a Pauline soteriology of grace, and that all of this has to happen before Augustine's conversion is complete. If we suspend the question of normativity inherent in deciding Augustine's "orthodoxy" (particularly prior to Chalcedon), Dobell still does not succeed in showing that the early "pedagogical" homo assumptus Christology is, in fact, adoptionist; indeed, his evidence is often rather weak (for a tacit admission, see 73). We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

Health care often involves ethically difficult situations that may disquiet the conscience. The purpose of this study was to develop a questionnaire for identifying various perceptions of conscience within a framework based on the literature and on explorative interviews about perceptions of conscience (Perceptions of Conscience Questionnaire). The questionnaire was tested on a sample of 444 registered nurses, enrolled nurses, nurses’ assistants and physicians. The data were analysed using principal component analysis to explore possible dimensions of perceptions of conscience. The (...) results showed six dimensions, found also in theory and empirical health care studies. Conscience was perceived as authority, a warning signal, demanding sensitivity, an asset, a burden and depending on culture. We conclude that the Perceptions of Conscience Questionnaire is valid for assessing some perceptions of conscience relevant to health care providers. (shrink)

Incest is a crime in most societies. In the United States, incest is punishable in almost every state with sentences going as far as 20 and 30 years in prison, and even a life sentence. Yet the reasons traditionally proffered in justification of criminalization of incest—respecting religion and universal tradition; avoiding genetic abnormalities; protecting the family unit; preventing sexual abuse and sexual imposition; and precluding immorality—at a close examination, reveal their under- and over-inclusiveness, inconsistency or outright inadequacy. It appears that (...) the true reason behind the long history of the incest laws is the feeling of repulsion and disgust this tabooed practice tends to evoke in the majority of population. However, in the absence of wrongdoing, neither a historic taboo nor the sense of repulsion and disgust legitimizes criminalization of an act. (shrink)

Plants synthesize with photons, so we commonly say. This article on photosynthesis introduces a notion of concepts that are to be thought of as capital and yet natural. They constitute a metaphysics of meteora alloys and copiousness through “actively lacking” a “proper” notion of conception.

Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

The defense of necessity, also known as the “choice of evils,” reflects popular moral intuitions and common sense: sometimes, breaking the rules is the right—indeed, the only—thing to do in order to avoid a greater evil. Citing a classic example, mountain climbers may break into a cabin to wait out a deadly snow storm and appropriate the owner’s provisions because their property violations are a lesser evil compared to the loss of life. At the same time, this defense contradicts the (...) fundamental principles of criminal responsibility in that it authorizes violation of rights of innocent bystanders. By allowing the mountain climbers to override the property rights of the cabin owner, the defense effectively forbids the cabin owner to use force in response—a different rule would perpetuate violence. This outcome is at odds with the basic criminal law doctrines. There is no general duty to rescue in Anglo-American law. Yet, by forbidding the cabin owner to use force, the defense of necessity essentially imposes on him the duty to forego his interests in favor of those of the mountain climbers. The paper explores the origins and boundaries of the defense of necessity. It argues that the existing public and private theories of necessity are unsatisfactory and concludes that a viable theory of necessity should be able to explain why it is sometimes permissible to override individual rights of citizens without their consent or fault. In this article, I try to go beyond the traditional objections to strict liability public welfare offenses and confront other possible justifications for punishing non-culpable conduct. Specifically, I consider the following arguments:Penalties for public welfare offenses are punishment by name only, thus traditional justifications for punishment are not needed;Even if those penalties are punishment, punishing those who produce or threaten significant harm to others is not necessarily unjust; andEven if such punishment is not entirely just, it is consistent with other (...) widely accepted criminal law doctrines. A claim made by Buddhist or Buddhism-affine scholars such as Michael LaTorra and James Hughes is that transhumanism, neuroscience, and the teachings of Buddhism are compatible because they aim to alleviate suffering and pain and attain a stable state of happiness. This claim can be challenged. At first glance, the approach seems valid, because since the 1980s there have been dialogues and scientific collaborations with representatives of Tibetan Buddhism and scientists on the topics of neuroscience, consciousness, ethics and technology, and (...) in this context new interpretations of Buddhist thought have emerged such as ‘Buddhist modernism’ (E. Thompson). In this discussion note, however, two main arguments are advanced as to why the claim and terminology of Buddhist transhumanism are difficult to reconcile with Buddhist terminology, values, and methods: (1) the difference between the use of such methods as meditation and contemplation and the application of so-called human enhancement technologies (2) and differences concerning self-understanding in Western science and Buddhism. A large network of alchemical agents spread from the tiny, land-locked duchy of Saxe- Gotha-Altenburg outward across Europe. At its centre, Duke Friedrich I meticulously documented his interactions with many alchemical personalities during the 1670s and 1680s. The story of one such personality illustrates the changing meanings of distant alchemical knowledge both to the inner circle of courtly alchemists and to a larger alchemical republic. Born near Gotha, Johann Otto von Hellwig built his pan-European career on a youthful stay on (...) Java. To some, this indicated his access to exotic naturalia which might be imported to a centre of collection, such as Gotha. For others, Hellwig could access a wisdom hidden abroad since ancient Egypt, which should be disseminated among widely dispersed adepts. According to the doctrine of Super-Humeanism, the world’s mosaic consists only of permanent matter points and changing spatial relations, while all the other entities and features figuring in scientific theories are nomological parameters, whose role is merely to build the best law system. In this paper, I develop an argument against Super-Humeanism by pointing out that it is vulnerable to and does not have the resources to solve the well-known problem of immanent comparisons. Firstly, I show that it cannot endorse (...) a fundamentalist solution à la Lewis, since its two pillars—a minimalist ontology and a best system account of lawhood—would generate, together, a tedious problem of internal coherence. Secondly, I consider anti-fundamentalist strategies, proposed within Humeanism, and find them inapplicable to the Super-Humean doctrine. The concern is that, since it is impossible to choose the best law system within Super-Humeanism, this doctrine may be charged with incoherence. (shrink)

In this paper, I discuss whether the results of loop quantum gravity (LQG) constitute a fatal blow to Humeanism. There is at least a prima facie reason for believing so: while Humeanism regards spatiotemporal relations as fundamental, LQG describes the fundamental layer of our reality in terms of spin networks, which are not in spacetime. However, the question should be tackled more carefully. After explaining the importance of the debate on the tenability of Humeanism in light of LQG, and having (...) presented the Humean doctrine, I review two cases which present serious threats to Humeanism, one concerning the fundamentality of vectorial quantities and the other concerning quantum entanglement. In particular, I recall the strategies that are usually employed in these two cases in order to save Humeanism: in the first case, the strategy consists in amending the characterization of the Humean mosaic; in the second case, it consists in adopting a realist or nomological interpretation of the wave function. These solutions will turn out to be helpful in my discussion of LQG where, after describing LQG, I show that Humeans might save their doctrine either by endorsing a realist interpretation of spin networks, or by giving them a nomological status and, at the same time, by revisiting the characterization of the Humean mosaic.
