One recurring criticism of the best interests standard concerns its vagueness, and thus the inadequate guidance it offers to care providers. The lack of an agreed definition of ‘best interests’, together with the fact that several suggested considerations adopted in legislation or professional guidelines for doctors do not obviously apply across different groups of persons, result in decisions being made in murky waters. In response, bioethicists have attempted to specify the best interests standard, to reduce the indeterminacy surrounding medical decisions. (...) In this paper, we discuss the bioethicists’ response in relation to the state's possible role in clarifying the best interests standard. We identify and characterise two clarificatory strategies employed by bioethicists —elaborative and enumerative—and argue that the state should adopt the latter. Beyond the practical difficulties of the former strategy, a state adoption of it would inevitably be prejudicial in a pluralistic society. Given the gravity of best interests decisions, and the delicate task of respecting citizens with different understandings of best interests, only the enumerative strategy is viable. We argue that this does not commit the state to silence in providing guidance to and supporting healthcare providers, nor does it facilitate the abuse of the vulnerable. Finally, we address two methodological worries about adopting this approach at the state level. The adoption of the enumerative strategy is not defeatist in attitude, nor does it eventually collapse into (a form of) the elaborative strategy. (shrink)

Despite the importance of the co-evolution approach in various branches of research, such as strategy, organisation theory, complexity, population ecology, technology and innovation (Lewin et al., 1999; March, 1991), co-evolution has been relatively neglected in international business and ethics research (Madhok and Phene, 2001). The purpose of this article is to show how co-evolution theory provides a theoretical framework within which some issues of ethics research are addressed. Our analysis is in the context of the contrasts between business systems (North, (...) 1990), and in particular the distinction between informal systems and those systems where institutions are formalised in law. This complements the growing research on comparative corporate governance and capitalisms (Chandler and Hikino, 1990; Choi et al., 1999; Whitley, 1994). The synthesis of co-evolution and analysis of divergent institutional environments in ethics research can also complement the globalisation and MNE approaches to international business research. Affinity maturation occurs by the introduction of multiple point mutations in the variable region gene that encodes the antigen binding site. Networks and the World Wide Web seem to provide an answer to efficiently creating and disseminating knowledge resources. Knowledge, however, is ambiguous in character, and contains both explicit (information) and tacit dimensions - the latter being difficult to value as well as to transfer. Participant identity, commitment and behaviour within the network also affect the sharing of knowledge. Hence, existing laws and norms (including property rights) which have been established on the basis of discrete transactions and monetary value-oriented exchange may (...) not be adequate to deal with the whole spectrum of knowledge transfer. A model is needed to address transfer across a large heterogeneous network. We introduce the concept of sub-networks where tacit knowledge resides and argue that considering social norms underlying trust and other informal mechanisms provides a more suitable basis for understanding the exchange of tacit knowledge. Norm establishment is complicated by the fact that values differ across cultures; however, the social norms that underpin sub-networks can sustain knowledge transfer within them. The purpose of this conceptual article is to introduce the concept of sub-networks and to identify the sub-network/network relationship as an area in which it is necessary to look beyond property rights and raise the issue of norms. We believe that an analysis of the role of social norms in knowledge sub-networks and their interaction with global networks points to a key element in understanding networks and any emerging theory of network ethics in the twenty-first century. This article analyses MNCs, worker identity and the ethical vulnerability caused by over-reliance on expatriate managers and under-reliance on local managers, who are often undervalued. It is argued that MNCs not only need but also have an obligation to assess local managers’ knowledge and contributions as having not only operational and market values, but also institutional value. Local managers both give access to and form part of local social capital and the treatment they receive is an element in the CSR (...) performance of the MNCs. Recognition of the value of equal treatment creates an ethical imperative that the barriers of cultural difference be overcome. We see such an approach towards local managers as more fully taking into account the human rights of these local managers. Such a holistic approach is increasingly relevant for MNCs in the 21st century, as MNCs increasing globalize into new large emerging markets such as Brazil, Russia, India and China. (shrink)

ObjectiveTo prospectively study the cingulate cortex for the localization and role of the grasping action in humans during electrical stimulation of depth electrodes.MethodsAll the patients with intractable focal epilepsy and a depth electrode stereotactically placed in the cingulate cortex, as part of their pre-surgical epilepsy evaluation from 2015 to 2017, were included. Cortical stimulation was performed and examined for grasping actions. Post-implantation volumetric T1 MRIs were co-registered to determine the exact electrode position.ResultsFive patients exhibited contralateral grasping actions during electrical stimulation. (...) All patients had electrodes implanted in the ventral bank of the right cingulate sulcus adjacent to the vertical anterior commissure line. Stimulation of other electrodes in adjacent regions did not elicit grasping.ConclusionGrasping action elicited from a localized region in the mid-cingulate cortex directly supports the concept of the cingulate cortex being crucially involved in the grasping network. This opens an opportunity to explore this region with deep brain stimulation as a motor neuromodulation target for treatment in specific movement disorders or neurorehabilitation. (shrink)

Much is being written today about the changing nature of the American workforce. This article summarizes 10 of these changes: (a) global competition; (b) the changing skills of work; (c) the declining impact of unions; (d) the altered human composition of the workforce; (e) the effects of continuous improvement, downsizing, and reengineering; (f) the growing use of part-time employees; (g) the widening income gap; (h) lessened employer and employee loyalty and commitment; (i) early retirement programs; and (j) telecommunications and virtual (...) employees. Rather than just identifying and documenting these trends, this article discusses the ethical implications of such movements. In this article, employee relations ethics is defined as "treating employees properly, with respect and dignity." The term employee relations ethics is used both individually and collectively to analyze the negative human results from a moral rather than an economic perspective. The age-old clash between bottom-line mentality (economics) versus higher order thinking (ethics) is revisited with a focus on employees, not owners (old theory) or customers (new theory). (shrink)

We study the jump hierarchy of d.c.e. Turing degrees and show that there exists a high d.c.e. degree d which does not bound any minimal pair of d.c.e. degrees.

Zero pronominals challenge Type Logical Grammar in two ways. One, TLG displays a linear resource management regime for semantic composition, meaning that pronominals call for special treatment if they want to do resource multiplication. Two, as a grammar of lexicalism, TLG applies to phonologically realized lexical entries only, illegitimating the phonetically null items during syntactic derivation. Jägor extends the inventory of category-forming connectives of TLG by a third kind of implication that creates categories of anaphoric items and solves the first (...) problem above. This article goes a step further to tackle the second one. In order to formalize the constructions with zero pronominals, we design a ternary category A B C and include the latter into Jägor’s system. The proposed system is proof-theoretically well-behaved. It is complete, sound, and decidable. More importantly, zero pronominals of various forms can be derived in the system. (shrink)

The debate concerning truth in Classical Chinese philosophy has for the most part avoided the possibility that pluralist theories of truth were part of the classical philosophical framework. I argue that the Eastern Han philosopher Wang Chong (c. 25-100 CE) can be profitably read as endorsing a kind of pluralism about truth grounded in the concept of shi 實 , or “actuality”. In my exploration of this view, I explain how it offers a different account of the truth of (...) moral and non-moral statements, while still retaining the univocality of the concept of truth (that is, that the concept amounts to more than the expression of a disjunction of various truth properties), by connecting shi with normative and descriptive facts about how humans appraise statements. In addition to providing insight into pluralist views of truth in early China, the unique pluralist view implicit in Wang’s work can help solve problems with contemporary pluralist theories of truth.  . In the traditional Chinese conception, ‘things’ (wu 物) serve as the fundamental ‘components’ of order. Moreover, it is through things and their changes that humans can grasp moral and political norms based on the notion of resonance (ganying 感應). This implies that human society and the world of things are necessarily interconnected. In opposition to this view of order Xiong Bolong 熊伯龍 (1617–1670) in his work Wuhe ji 無何集 (Collected Passages on Being without Causes) critiqued the notion of resonance and (...) arrived at a more ‘disenchanted’ approach to ‘things’ by incorporating the idea of contingency from Wang Chong’s 王充 (27–c. 97) philosophical thought. However, Xiong’s view of order full of contingency does not entirely diverge from the traditional mainstream Chinese view, because in his world of thought, a belief in the underlying necessity of a perfect order within the holistic arrangement of myriad things including humans remained.
