Restorative justice should have greater weight as a criterion in criminal justice sentencing practice. It permits a realistic recognition of the kinds of harm and damage caused by offences, and encourages individualized non-custodial sentencing options as ways of addressing these harms. Non-custodial sentences have proven more effective than incarceration in securing social reconciliation and preventing recidivism, and they avoid the serious social and personal costs of imprisonment. This paper argues in support of restorative justice as a guiding idea in sentencing. (...) Although the behavioral effects of damage to the frontal lobes date back to at least the late 19th century even midway through the 20th century very little was known about human frontal lobe function and there was a general consensus that the frontal lobe did not play a key role in cognition. This all changed when Brenda Milner published a chapter in a 1964 volume entitled: The Frontal Granular Cortex and Behavior. Milner’s chapter, “Some effects of frontal lobectomy in (...) man,” was the first systematic study of the effect of frontal lobe excisions on cognition in human patients. Milner had access to a unique population of frontal excision patients at the Montreal Neurological Institute that were being treated by Wilder Penfield and his associates for a wide range of neurological disorders, including intractable epilepsy. Milner and her colleagues engaged in a more than 50-year study that has had a formidable impact on our understanding of frontal lobe function. Paralleling studies of frontal lobe function in non-humans they influence on understanding the evolution and function of the prefrontal cortex of mammals. Thus, although Brenda Milner is best known for her studies of human memory, she has had an equally important contribution to our understanding of the frontal lobes. (shrink)

There is growing recognition that good ethics can have a positive economic impact on the performance of firms. Many statistics support the premise that ethics, values, integrity and responsibility are required in the modern workplace. For consumer groups and society at large, research has shown that good ethics is good business. This study defines and traces the emergence and evolution within the business literature of the concepts of values, business ethics and corporate social responsibility to illustrate the increased emphasis that (...) has been placed on these issues over time. Two organizations that have successfully dealt with these issues were analyzed to identify the links among values, ethics, and corporate social responsibility as they are incorporated into the culture and management of a firm. In spite of the interference manifested in the double-slit experiment, quantum theory predicts that a measure of interference defined by Sorkin and involving various outcome probabilities from an experiment with three slits, is identically zero. We adapt Sorkin’s measure into a general operational probabilistic framework for physical theories, and then study its relationship to the structure of quantum theory. BackgroundSocial media has globalised compassion enabling requests for donations to spread beyond geographical boundaries. The use of social media for medical crowdfunding links people with unmet healthcare needs to charitable donors. There is no doubt that fundraising campaigns using such platforms facilitates access to financial resources to the benefit of patients and their caregivers.Main textThis paper reports on a critical review of the published literature and information from other online resources discussing medical crowdfunding and the related ethical questions. The review (...) highlighted the benefits of crowdfunding as well as the under-exploration of the risk of having patients’ desires and human rights undermined during online fundraising campaigns. Majority of these campaigns get initiated on behalf of the patients, especially the very sick and dependant. The ethical questions raised relate to the voluntariness of informed consent and the possibility of patients being used as a means to an end. Vulnerability of patients may expose them to coercion, undue influence, manipulation, and violation of their human rights. The success of these campaigns is influenced by the digital skills, pre-existing social networks and, the emotional potency. Healthcare is a public good, and online market forces should not determine access to essential health services. The benefits of crowdfunding cannot be subverted, but it can perpetuate unintended injustices, especially those arising from socio-economic factors.ConclusionsPolicymakers ought to monitor the utilisation of crowdfunding sites to identify policy failures and unmet essential health care needs responsible for driving individuals to use these platforms. The upholding of human rights and the fundamental respect of the individual’s wishes is a moral imperative. The need for an ethics framework to guide different stakeholders during medical crowdfunding needs further examination. (shrink)

Despite a growing body of research by management scholars to understand and explain failures in ethical decision making (EDM), misconduct prevails. Scholars have identified character, founded in virtue ethics, as an important perspective that can help to address the gap in organizational misconduct. While character has been offered as a valid perspective in EDM, current theorizing on how it applies to EDM has not been well developed. We thus integrate character, founded in virtue ethics, into Rest’s (1986) EDM model to (...) reveal how shifting attention to the nature of the moral agent provides critical insights into decision making more broadly and EDM specifically. Virtue ethics provides a perspective on EDM that acknowledges and anticipates uncertainties, considers its contextual constraints, and contemplates the development of the moral agent. We thus answer the call by many scholars to integrate character in EDM in order to advance the understanding of the field and suggest propositions for how to move forward. We conclude with implications of a character-infused approach to EDM for future research. (shrink)

This essay evaluates Charles Taylor's defence of a politics of recognition in light of his broader account of modern identity and the self. I argue that his call for a politics of recognition betrays what is most ethically promising in his own account of modern subjectivity – namely, its emphasis on and affirmation of inner multiplicity. The first part of the paper identifies the ways in which his account of the self affirms inner multiplicity. The second part of the paper (...) outlines how a politics of recognition circumscribes this inner plurality by rendering core aspects of personal identity rigid and by promoting attitudes that inhibit attentiveness to multiplicity within the self. By outlining the ways in which it circumscribes inner multiplicity, I show that Taylor's preferred form of politics undermines two of his own central goals: that of securing the conditions in which authentic identity can be realized and that of promoting mutually receptive relations among diverse selves. A form of liberalism that strives for neutrality with respect to cultural symbols and practices more effectively facilitates the realization of these goals. (shrink)

This article explores an aspect of women’s transnational labor migration that has been understudied in many labor-sending countries: how men experience shifts in the household labor division triggered by women’s migration. In so doing, we shed light on the diverse ways notions of masculinity and gender identities are being reworked and renegotiated in the transnational family. Drawing on qualitative data collected from in-depth interviews with carers of left-behind children in Northern Vietnam, we show how men are confronted with the need (...) to take on child care duties, which have traditionally been ascribed to women, while at the same time being under considerable pressure to live up to locally accepted masculinity ideals. We provide interesting insights into the changing family structures and dynamics in Vietnamese society where patriarchal norms continue to exert significant influence on different facets of life. It highlights the growing importance of corporate governance issues, an area which now has unprecedented coverage by the media in the commercial sector and is increasingly important in business schools.

This paper proposes a dynamic theory of embodiment that aims to get beyond the absent moving body in embodied social theory. The first somatic revolution, inspired by Merleau Ponty, provided theories based on the feeling and experience of the body. The theory of dynamic embodiment focuses instead on the doing itself as embodied social action, in which the embodied person is fore-grounded as a complex resource for meaning making. This represents a theoretical enrichment of the earlier turn to the body (...) in social theory, which tended to separate the semiotic, as necessarily representational and/or linguistic, from the somatic as a wide range of corporeal processes and practices assumed to be separated from mind, language and/or conscious thought. We argue that overcoming this persistent Cartesianism requires a New Realist approach to the proper location of human agency as a causal power, one that promotes a bio-psycho-social concept of personhood. Part one of the paper presents a general framework for this perspective, while part two applies this paradigm ethnographically to illustrate how bringing semiosis and somatics together requires a robust conception of multi-sensory modalities. This is always so for pure bipartite states in quantum mechanics, a fact (...) first observed by Schrödinger in 1935. Here, we show that, for weakly self-dual state spaces (those isomorphic, but perhaps not canonically isomorphic, to their dual spaces), the assumption that every state of a system A is steered by some bipartite state of a composite AA consisting of two copies of A, amounts to the homogeneity of the state cone. If the state space is actually self-dual, and not just weakly so, this implies (via the Koecher-Vinberg Theorem) that it is the self-adjoint part of a formally real Jordan algebra, and hence, quite close to being quantum mechanical. Medical care of critically ill and injured infants and children globally should be based on best research evidence to ensure safe, efficacious treatment. In South Africa and other low and middle-income countries, research is needed to optimise care and ensure rational, equitable allocation of scare paediatric critical care resources.

Using a result of H. Hanche-Olsen, we show that (subject to fairly natural constraints on what constitutes a system, and on what constitutes a composite system), orthodox finite-dimensional complex quantum mechanics with superselection rules is the only non-signaling probabilistic theory in which (i) individual systems are Jordan algebras (equivalently, their cones of unnormalized states are homogeneous and self-dual), (ii) composites are locally tomographic (meaning that states are determined by the joint probabilities they assign to measurement outcomes on the component systems) (...) and (iii) at least one system has the structure of a qubit. Using this result, we also characterize finite dimensional quantum theory among probabilistic theories having the structure of a dagger-monoidal category. (shrink)

This unpublished 1990 preprint argues that a crucial distinction in discussions of the many-worlds interpretation of quantum mechanics (MWI) is that between versions of the interpretation positing a physical multiplicity of worlds, and those in which the multiplicity is merely psychological, and due to the splitting of consciousness upon interaction with amplified quantum superpositions. It is argued that Everett's original version of the MWI belongs to the latter class, and that most of the criticisms leveled against the MWI, in particular (...) that it is illogical or incoherent, are not valid against such "psychological-multiplicity" versions. Attempts to derive the quantum-mechanical probabilities from the many-worlds interpretation are reviewed, and Everett's initial derivation is extended in an attempt to show that these are the unique possible probabilities. But there remains a challenge for proponents of the MWI: to show that their interpretation requires probabilities, rather than merely nonprobabilistic indeterminacy. A 2002 preface, revised in 2004, briefly discusses the extent to which I still agree with the claims in the paper. While its derivation of probabilities used, and failed to justify, noncontextuality, I still agree with the paper's general interpretation of the MWI, though not with the MWI itself. (shrink)

The American states have demonstrated varying levels of support for animal rights legislation. The activities of interest groups, including pressures from competing groups, help to explain the presence or absence of ten pro-animal regulations and laws. This article analyzes and ranks each of the fifty states with regard to ten key areas of animal protection and welfare legislation. The analysis reveals that states with a more agricultural economic base are less likely to provide protection to animals. The dominant discourse in chronic disease management centres on the ideal of person-centred healthcare, with an empowered patient taking an active role in decision-making with their healthcare provider. Despite these encouraging developments toward healthcare democracy, many person-centred conceptions of healthcare and programming continue to focus on the healthcare institution’s perspective and priorities. In these debates, the patient’s voice has largely been absent. This article takes the example of patient empowerment to show how the concept has been influenced by a variety (...) of competing and shifting influences that have led to conceptualisations and programming designed for the patient, but developed without the patient. The framework of epistemic injustice is proposed to unravel the complexity of these omissions. The concept can be defined as a wrong done to someone specifically in their capacity as a knower. It occurs when a person is ignored or not believed due to a prejudice of some kind. It has been applied to healthcare in order to better understand barriers for patient participation and will be used to better understand the problems with current empowerment definitions and implementation strategies. The article will end by proposing some methodologies to facilitate patient-developed concepts of empowerment. (shrink)

Positivist medical historians, guided by the savoir of modern western biomedicine, have long depicted medieval medicine as an aberration along the continuum of scientific and medical progress. Historical epistemology, founded in the ideas of Cavailles, Foucault, Davidson, and Hacking, however, allows the historian to disrupt this false continuum and to unchain medieval medicine from modern medicine. Postmodernist approaches, such as those sourced in Lyotard, Barthes, and Derrida, allow the historian to further deconstruct medieval and modern medical discourse, revealing a multitude (...) of narrative lenses spinning around biomedical and biocultural strands. In liberating these two medical systems and setting them within the distinct historical and epistemological contexts that both shaped and were shaped by them, the historian can revision the theories, practices, and culture of medieval medicine without having to anachronistically justify them according to modern medical discourse. Quantum information science is a source of task-related axioms whose consequences can be explored in general settings encompassing quantum mechanics, classical theory, and more. Quantum states are compendia of probabilities for the outcomes of possible operations we may perform on a system: ''operational states.'' I discuss general frameworks for ''operational theories'' (sets of possible operational states of a system), in which convexity plays key role. The main technical content of the paper is in a theorem that any such theory naturally (...) gives rise to a ''weak effect algebra'' when outcomes having the same probability in all states are identified and in the introduction of a notion of ''operation algebra'' that also takes account of sequential and conditional operations. Such frameworks are appropriate for investigating what things look like from an ''inside view,'' i.e., for describing perspectival information that one subsystem of the world can have about another. Understanding how such views can combine, and whether an overall ''geometric'' picture (''outside view'') coordinating them all can be had, even if this picture is very different in structure from the perspectives within it, is the key to whether we may be able to achieve a unified, ''objective'' physical view in which quantum mechanics is the appropriate description for certain perspectives, or whether quantum mechanics is truly telling us we must go beyond this ''geometric'' conception of physics. Este artículo se inscribe en el debate acerca de los procesos de recepción en relación a los consumos mediáticos. Específicamente, se analizan las interpretaciones y construcciones de sentidos que los públicos hacen de las noticias de inseguridad. Para ello se propone los siguientes objetivos: en primer lugar, debatir los fundamentos de los conceptos de audiencias y públicos en las investigaciones en comunicación; en segundo lugar, indagar en distintas dimensiones sobre el proceso de recepción y circulación de las representaciones mediáticas del (...) delito como las llamadas “olas de inseguridad”, la credibilidad de las noticias y la incidencia de la reiteración de la misma información en los consumidores mediáticos. A partir de un estudio cualitativo, basado en entrevistas en profundidad con sujetos que habitan en dos barrios porteños con alta percepción del delito y el uso de disparadores audiovisuales, el trabajo cuestiona el lugar de los medios de comunicación como principales actores en la generación de temores sociales. En cambio, se propone vislumbrar distintos entramados de sentido, e incluso ir más allá de los medios, para observar el papel fundamental que tiene la experiencia y la comunicación interpersonal en los procesos de consolidación de determinadas creencias y comportamientos sobre la inseguridad. This empirical study reports the implementation and assessment of service learning in management education. Principles of Management students worked in teams to support Campus Kitchens, a national program affiliated with colleges and universities, in recovering surplus food and delivering it to community members. Student perceptions regarding civic engagement and social responsibility, application of skills, and professional development were assessed. Two complete cycles of implementation and assessment are chronicled. The sample size for Cycle 1 was 123 students and for Cycle 2 (...) the sample size was 91 students.
