The motivating question of this paper is: ‘How are our beliefs in the theorems of mathematics justified?’ This is distinguished from the question ‘How are our mathematical beliefs reliably true?’ We examine an influential answer, outlined by Russell, championed by Gödel, and developed by those searching for new axioms to settle undecidables, that our mathematical beliefs are justified by ‘intuitions’, as our scientific beliefs are justified by observations. On this view, axioms are analogous to laws of nature. They are postulated (...) to best systematize the data to be explained. We argue that there is a decisive difference between the cases. There is agreement on the data to be systematized in the scientific case that has no analog in the mathematical one. There is virtual consensus over observations, but conspicuous dispute over intuitions. In this respect, mathematics more closely resembles stereotypical philosophy. We conclude by distinguishing two ideas that have long been associated -- realism (the idea that there is an independent reality) and objectivity (the idea that in a disagreement, only one of us can be right). We argue that, while realism is true of mathematics and philosophy, these domains fail to be objective. One upshot of the discussion is that even questions of fundamental physics may fail to be objective in roughly the sense that the question, ‘Is the Parallel Postulate is true?’, understood as one of pure mathematics, fails to be. Another is a kind of pragmatism. Factual questions in mathematics, modality, logic, and evaluative areas go proxy for non-factual practical ones. -/- . (shrink)

Avner Baz presents a critique of the working practices of analytic philosophy in recent decades. He challenges the assumptions on which the philosophical 'method of cases' rests, and he presents a pragmatist conception of language on which the method of cases as used both 'armchair' and 'experimental' philosophers is fundamentally misguided.

This book describes a program of research in computable structure theory. The goal is to find definability conditions corresponding to bounds on complexity which persist under isomorphism. The results apply to familiar kinds of structures (groups, fields, vector spaces, linear orderings Boolean algebras, Abelian p-groups, models of arithmetic). There are many interesting results already, but there are also many natural questions still to be answered. The book is self-contained in that it includes necessary background material from recursion theory (ordinal notations, (...) the hyperarithmetical hierarchy) and model theory (infinitary formulas, consistency properties). A comprehensive compilation of legal rulings about children, one of particular historical utility and yet largely overlooked, is Muḥammad al-Asrūshanī’s Jāmiʿ aḥkām al-ṣighār. It offers a rather holistic view of the legal status of Muslim children and, more importantly, insight into common concepts of childhood and attitudes to children in premodern Muslim societies. Moreover, although drawing on the written heritage of middle-class urban scholars, the normative yet multilayered text of Jāmiʿ provides many precise details on children’s lives and their social (...) environment. This article introduces al-Asrūshanī’s unique work—its structure, contents, and sources—and offers, as a case study, an analysis of the chapter the author dedicates to enslaved children. While al-Asrūshanī intended some, or even the majority, of instances discussed in this chapter to address theoretical legal debates, others, particularly those drawn from fatwas, mirror the real experiences of enslaved minors, concubines, and enslavers. Together they provide a picture of a moderate form of domestic slavery in the Islamic world, particularly in Central Asia of the Mongol period. (shrink)

What does it mean to be disadvantaged? Is it possible to compare different disadvantages? What should governments do to move their societies in the direction of equality, where equality is to be understood both in distributional and social terms? Linking rigorous analytical philosophical theory with broad empirical studies, including interviews conducted for the purpose of this book, Wolff and de-Shalit show how taking theory and practice together is essential if the theory is to be rich enough to be applied to (...) the real world, and policy systematic enough to have purpose and justification. The book is in three parts. Part 1 presents a pluralist analysis of disadvantage, modifying the capability theory of Sen and Nussbaum to produce the 'genuine opportunity for secure functioning' view. This emphasises risk and insecurity as a central component of disadvantage. Part 2 shows how to identify the least advantaged in society even on a pluralist view. The authors suggest that disadvantage 'clusters' in the sense that some people are disadvantaged in several different respects. Thus identifying the least advantaged is not as problematic as it appears to be. Conversely, a society which has 'declustered disadvantaged' - in the sense that no group lacks secure functioning on a range of functionings - has made considerable progress in the direction of equality. Part 3 explores how to decluster disadvantage, by paying special attention to 'corrosive disadvantages' - those disadvantages which cause further disadvantages - and 'fertile functionings' - those which are likely to secure other functionings. In sum this books presents a refreshing new analysis of disadvantage, and puts forward proposals to help governments improve the lives of the least advantaged in their societies, thereby moving in the direction of equality. XVI Psychologists have, however, shown that what we are primarily aware of is not a succession of sense-data but figures-ground phenomena: Wittgenstein's ambiguous duck-rabbit is merely one such example. They have also drawn our attention to the existence of tertiary qualities in perception, such as 'symmetry' and 'elegance' which are just as directly given as are the perceived colours red, green or yellow. It is interesting to note that Merleau-Ponty has made considerable use of Gestalt ideas in his Phenomenology of (...) Perception. One of the commonest reasons given by linguistic philosophers for not making direct use of the results of psychological research (although philosophers are usually willing to accept the first-hand results of physical science) is that philosophical accounts of perception and thinking are concerned with analysing the language in which these reports are made; that is to say, they are second-order enquiries. Often this approach is still more restricted and ordinary linguistic usage is taken as the yardstick against which questions relating to thought and perception are to be measured. The task of the philosopher is then con fined to the analysis of ordinary language. If he is more adventurous, as some writers on philosophical psychology are, he might go on to show how far the language used by psychological researchers falls short of the paradigms of common sense. My plan in this article is to begin by raising the question of the point of judgements of beauty, and then to examine Kant's account of beauty in the third Critique from the perspective opened up by that question. Having raised the question of the point, I will argue, first, that there is an implied answer to it in Kant's text, and, second, that the answer is ultimately unsatisfying in that it falsely assumes that there is a ‘need’, or ‘task’, (...) or ‘purpose’, that we all necessarily share, to conceptualize all that encounters us in our experience, and fit it into one unified and comprehensive system. It is only against this assumption of our transcendental cognitive interest that Kant can so much as seem to have a real story to tell about where the value that we claim for things in calling them ‘beautiful’ derives from. This, in effect, means that to the extent that Kant offers us any answer at all to the question of the point of judgements of beauty, that answer testifies to his general neglect of the question of the point of judgements. And my purpose is to draw attention to that neglect, and to begin to assess its significance for Kant's transcendental project in general and for his conception of beauty in particular. (shrink)

‘Rabbi’ is the title of Jewish scholars and teachers. Yet, in the sixteenth century, the word was sometimes employed in Christian discourse, when Christian scholars referred to their Christian peers as rabbis. How could non-Jews be called rabbis? This article explores the meaning of the term ‘rabbi’ in sixteenth-century intra-Christian polemics and discourse. It shows how the image of the ‘rabbi’, a figure of (negative) intellectual authority, penetrated the speech of Christian intellectuals and polemicists. It suggests that this ‘rabbinic’ figure (...) was not necessarily Jewish. Although ‘rabbi’ is a Jewish term – the incarnation of Jewish intellectual life – the term also denotes Jesus as well as his opponents, the Pharisees. Thus, polemical ‘rabbinising’ of Christian scholars potentially involved very different images of scholarly authority. (shrink)

The purpose of this paper is to use Kant's Critique of Judgement in order to raise and motivate the question of the point of judgements of beauty, to illustrate the philosophical tendency to neglect or even repress it, and to begin to look for an answer to that question. On the way, I will consider Kant's implied answer to the question and will argue that it is unsatisfactory in that it relies on a false picture of the everyday subject's relation (...) to his or her world. First published in 1977. Ethics is the most practical branch of philosophy: its immediate concern is with people's actions. Yet most philosophers do little to relate ethics intelligibly to the human situation. In this inquiry into the nature of ethics, William Ash draws on the relevant works of Marx, Engels, Lenin and Stalin to present the theory and practice of Marxist ethics. He offers an explanation of the moral aspect of Marx's dictum: 'The philosophers have only interpreted the world, in (...) various ways; the point, however, is to change it.' The book includes, perhaps for the first time in so considered a form, an assessment of Mao Tsetung's contribution to Marxist moral philosophy, together with the ethical implications of such developments in social practice as the Proletarian Cultural Revolution. The author deals with the question of value by analysing the concept of 'good'; with the question of claims on people and things by analysing the concept of 'right'; with the question of the limits and scope of freedom of choice and action by analysing the concept of 'ought'.' Clearly written in order to 'de-mystify' the subject, the book challenges readers to test the author's enlightened, Marxist approach in terms of the ethical ordering of their own society. (shrink)

The perception of what he calls 'aspects' preoccupied Wittgenstein and gave him considerable trouble in his final years. The Wittgensteinian aspect defies any number of traditional philosophical dichotomies: the aspect is neither subjective nor objective; it presents perceivable unity and sense that are not conceptual; it is 'subject to the will', but at the same time is normally taken to be genuinely revelatory of the object perceived under it. This Element begins with a grammatical and phenomenological characterization of Wittgensteinian 'aspects'. (...) It then challenges two widespread ideas: that aspects are to be identified with concepts; and that aspect perception has a continuous version that is characteristic of human perception. It concludes by proposing that aspect perception brings to light the distinction between the world as perceived and the world as objectively construed, and the role we play in the constitution of the former. In this paper I develop a critique of Kantian ethics, and more precisely a critique of a particular conception of moral reasoning. The fundamental assumption that underlies the conception that I am targeting is that to justify (morally or otherwise) an action is (perhaps with an ‘all things being equal’ clause) to settle its value, in such a way that all rational participants would have to acknowledge that value. As an alternative to the Kantian conception, I propose a conception in (...) which the basic unit of moral reasoning is not an action but rather what I call an ‘ethical position’—where an ethical position is where, at any given moment and with respect to the matter at hand, you stand, and where moral reasoning consists in the articulation of ethical positions. The argument of this chapter proceeds in the form of constructive criticism of Charles Travis’s recent work on perception. Travis has presented a powerful argument against the idea that perception, as such, provides us with true-or-false representations of the world. The representationalist view, Travis argues, fails to respect the fundamental Fregean distinction between "the conceptual" and "the nonconceptual." According to Travis, what perception presents us with is nonconceptual; hence, perception is indeterminate as far as representational content goes. Travis argues that (...) determinate representational content, on the other hand, is only created when things are judged to be some particular way or another. In this chapter, Avner Baz finds himself in substantial agreement with Travis, but argues that something important also goes missing in the latter’s account, namely what Baz calls "the phenomenal world"; that is, the world as perceived and responded toprior to becoming the object of true or false judgments. In particular, Baz shows how Travis consistently represses the phenomenal world in his account of perception whenever he attempts to explain the perception of what Wittgenstein calls "aspects"; for any respectable account of the perception of such aspects, Baz argues, ought to bring the phenomenal world into view. Dr Bawa-Garba, a senior paediatric trainee who had been involved in the care of a child who died shortly after admission to hospital, was convicted of gross negligence manslaughter and subsequently erased from the medical register. We argue that criminalisation of doctors in this way is fraught with ethical tensions at levels of individual blameworthiness, systemic failures, professionalism, patient safety and at the interface of the regulator and doctor. The current response to alleged manslaughter during clinical care is not fit (...) for purpose because of its narrow focus on criminalisation and punishment of individual doctors. The justice system fails to take into account systemic issues in a sufficiently proper and informed way particularly in respect of human factors involved in decision-making. It is easier to convict individual doctors for gross negligence manslaughter than it is to effect legal accountability upon organisations. If educational reflections are used to apportion blame, then this could impact detrimentally on honesty and the duty of candour, with negative implications for patient safety. Regulatory processes should not be deployed without consideration of context. There is an urgent need for a fresh and open evaluation of professional and societal expectations from the regulator that should include positive action as well as those that are proportionately punitive. Justice and patient safety would be served better by more sophisticated contextualisation through an approach that balances accountability in healthcare with failures that can occur within complex systems, and by working to a radical shift towards a just culture. Studies of multiple paternity in mammals and other animal species generally report proportion of multiple paternity among litters, mean litter sizes, and mean number of sires per litter. It is shown how these variables can be used to produce an estimate of the probability of reproductive success for a male that has mated with a female. This estimate of male success is more informative about the mating system that alternative measures, like the proportion of litters with multiple paternity or the (...) mean number of sires per litter. The probability of success for a mated male can be measured both theoretically and empirically, and gives an estimate of the intensity of sperm competition and of a male's “confidence of paternity” upon mating. The probability of success for mated males for ten “exemplar” species of mammals is estimated and they are compared for insights into the functioning of their mating systems. (shrink)

Adam Smith rejected Mandeville's invisible-hand doctrine of 'private vices, publick benefits'. In The Theory of Moral Sentiments his model of the 'impartial spectator' is driven not by sympathy for other people, but by their approbation. The innate capacity for sympathy makes approbation credible. Approbation needs to be authenticated, and in Smith's model authentication relies on innate virtue, which is not realistic. An alternative model of 'regard' makes use of signalling and is more pragmatic. Modern versions of the invisible hand in (...) rational choice theory and neo- liberalism are shown to be radical departures from the ethical legacy of Enlightenment and utilitarian economics, and are not consistent with Adam Smith's own position. ABSTRACT Facing heretofore unknown waves of new immigrants, the Israeli Government and the mayor of Jerusalem issued a comprehensive development programme, including rapid and massive construction. Cities with historical and aesthetic uniqueness, particularly Jerusalem, are likely to lose their special features and beauty. A question is raised: how can an argument in favour of conservation of the special beauties of such cities be advanced in light of the urgent need to supply shelter and jobs for their inhabitants? The paper has (...) two aims: to analyse the reasons for environmental ethics'failure to discuss urban preservation so far, and to put forward a rationale for urban preservation. The latter derives from the political wisdom of King Solomon and from the notion of anthropocentric intrinsic value. (shrink)
