This article provides a critical appraisal of the case for healthcare being rationed away from older patients to those who are younger. After sketching a metaphysics of elderliness and reviewing clinical and economic cases for healthcare rationing, the article looks in depth at the most challenging case for age rationing known as the ‘fair innings’ case. This article rejects that case and makes an alternative case that fairness actually dictates against age rationing in favour of allocation on the basis of (...) need. It concludes with a call for a renewed ‘covenant between generations’, founded on the virtue of pietas. (shrink)

Although underappreciated in his own day, Catholic convert John Henry Newman was remarkably prophetic about the challenges that lay ahead for the Catholic faith. In his 1873 sermon titled, ‘The Infidelity of the Future’, Newman warned of a time when the Church would face not only the cold indifference of agnosticism but also the targeted hostility of those opposed to both God and religion. Yet Newman was not without hope or wisdom for the future Church. This essay examines Newman's insistence (...) upon the need to cultivate an ‘ecclesiastical spirit’ and an ‘intelligent faith’. It specifically explores how Catholic institutions of higher education can respond to Newman's call and assist in bringing about a renewal in the evangelical mission of the Church, providing a much-needed alternative to the wisdom of the world. Cooperation in evil or wrongdoing is one of the most perplexing areas in bioethics, both for those working in the field and those seeking their advice. What does philosophy have to say about the argument that blasphemous art ought not to be publicly displayed? We examine four concepts of blasphemy: blasphemy as offence, attack on religion, attack on the sacred, attack on the blasphemer himself. We argue all four are needed to grasp this complex concept. We also argue for blasphemy as primarily a moral, not a religious concept. We then criticise four arguments for the public display of blasphemous art: it may be beautiful, provocative, devoutly (...) intended, and is autonomous of religious concerns. Finally, we discuss the notions of blasphemy and blasphemous art as public offences. We conclude that the display of blasphemous art is a public, and not merely a private moral offence, and that there are respectable philosophical arguments for this conclusion. (shrink)

Fisher, Anthony The campaign to redefine marriage has recently gained such momentum- with now three and soon four Bills before the Commonwealth Parliament-that many think it is inevitable; this can leave those with misgivings feeling that they are already losers in a done deal. Some think it's the inexorable progress of liberty and equality-which leaves the doubters 'on the wrong side of history'. In this context supporters of classical marriage are presumed to have no real arguments to offer. (...) So in this paper I want to offer some reasons-not decrees from on high or from the past, not expressions of hatred or prejudice-but reasons I hope anyone can understand. I also hope you find these reasons persuasive and helpful in proclaiming and witnessing to true marriage among your families, friends and colleagues. But even if you disagree with me on this matter, I at least hope to help you understand why Australian law has always held, and many people still hold, that marriage is for people of opposite sex. Others, having feigned illness and been transferred to hospital, broke their chains and came to their assistance. But the third wave, of farm workers with farm implements, arrived too late to be of any help. Dr Edwards' stimulating and provocative book advances the thesis that the appropriate axiomatic basis for inductive inference is not that of probability, with its addition axiom, but rather likelihood - the concept introduced by Fisher as a measure of relative support amongst different hypotheses. Starting from the simplest considerations and assuming no more than a modest acquaintance with probability theory, the author sets out to reconstruct nothing less than a consistent theory of statistical inference in science.

Anthony Kenny concludes The God of the Philosophers by saying that ‘If the argument of the previous chapters has been correct then there is no such being as the God of traditional natural theology … There cannot, if our argument has been sound, be a timeless, immutable, omniscient, omnipotent all-good being’ . In the 1960s, before the promulgation of Humanae Vitae, the Catholic philosophers Elizabeth Anscombe and Herbert McCabe OP debated whether there are convincing natural law arguments for the claim that contraception violates an exceptionless moral norm. This article revisits those arguments and critiques McCabe’s approach to natural law, concerned primarily with ‘social sin’ and not simply violations of ‘right reason,’ as one particularly ill-suited to addressing questions in sexual ethics and unable both to distinguish properly between certain forms of sexual (...) wrongdoing and more obviously social sins such as theft, and also to distinguish between ‘natural’ and ‘unnatural’ sexual acts. Anscombe’s views, I argue, are closer to those of Thomas Aquinas and provide reasons for making the distinctions McCabe does not. An argument concerning the nature of the institution of marriage and the effects of non-marital acts on that institution is proposed as a way of strengthening Anscombe’s argument that contraception violates an exceptionless moral norm. Freedom and the Rule of Law takes a critical look at the historical beginnings of law in the United States, and how that history has influenced current trends regarding law and freedom. Anthony Peacock has compiled articles that examine the relationship between freedom and the rule of law in America. The rule of law is fundamental to all liberal constitutional regimes whose political orders recognize the equal natural rights of all.

Tudor historians of Henry VIII's reign strove both to define the great political theological controversies of the day and to shape the future understanding of past events. This essay considers how Roman Catholic accounts of the life and martyrdom of Sir Thomas More, including those by Nicholas Harpsfield and Thomas Stapleton, shaped subsequent Protestant works of fiction, written during the 1590s. The essay explores, in particular, the collaborative play, Sir Thomas More, by Anthony Munday and revised by Shakespeare and (...) others; and Sir John Harington's references to More and Bishop John Fisher in the preface to his translation of Orlando Furioso and his extensive anecdotal remarks about More's scatological witticisms in his satirical tract, The Metamorphosis of Ajax. Such fictional works presage both the hesitant trend towards ecumenism and the imagined reunion of Christendom of the subsequent Jacobean reign, and the later emergence of the transnational secular public sphere, which transpired during the late seventeenth and eighteenth centuries. Emancipatie is goed, identiteitspolitiek is fout, zo luidt de strekking van het recente boek van politiek filosoof Gijs van Oenen, getiteld Culturele veldslagen: Filosofie van de culture wars. Kritiek op identiteitspolitiek - vooral die in de woke vorm – is vandaag de dag niks bijzonders. Ook de analyse van Van Oenen dat er net zo goed een identiteitspolitiek van rechts als van links bestaat is niet nieuw, evenmin als zijn ‘oplossing’ namelijk liberalisme en de rechtsstaat – beide treffen we bijvoorbeeld (...) aan bij Anthony Appiah’s The Lies That Bind: Rethinking Identity (2019). Nieuw is wel dat Van Oenen - die zich als links intellectueel afficheert – hierbij etiketten gebruikt die momenteel gangbaar zijn in de hoek van alt right. De termen ‘cultuurmarxisme’ en ‘culture wars’ - zie de titel van zijn boek - worden door hem als neutraal gepresenteerd, maar het is de vraag wat hij daarmee binnen haalt. (shrink)

I respond to the commentaries on 'Grace de Laguna's Analytic and Speculative Philosophy' offered by Peter Olen [2023], Trevor Pearce, Anthony Fisher, Marguerite La Caze and Frederique Janssen-Lauret. In doing so, I bring out some of the value of de Laguna’s perspectivism and of her treatment of modality. I also further clarify how she departs from pragmatism and from analytic philosophy, and how she relates to continental philosophy.

It is clear, irenic, and shows extensive research: nearly 1,000 footnotes in its 275 pages of text offering many avenues for further exploration including numerous references to “alternative” accounts. It is far more than an analysis of cooperation, for it exposes the reader to a universe of concepts, many of which are seldom introduced in studies on the topic. It is also bracing, an elixir likely to incite (and likely intended to incite) the reader to a deeper commitment to careful moral thought and conscientious moral action. Few readers will close this book with a feeling of time unprofitably spent.The introduction makes clear the book’s two central claims: (i) that an adequate analysis of the topic of cooperation with evil has yet to be provided and (ii) that a virtue-based approach stemming from St. Thomas Aquinas contains the elements for its provision. In support of these claims the book is organized into five chapters, the first three foundational and the last two matters of application.Chapter 1, “The Teaching of St. Thomas Aquinas: Received and Jettisoned,” begins with a presentation of St. Thomas’s treatment of five topics—borrowing money from known usurers, scandal, restitution for [End Page 709] crimes committed by agents working together, exacting oaths from known perjurers, production of objects used for sinful purposes. Following this section is a third containing an account of the departure from the Thomistic mode of analysis represented by Thomas Sanchez (d. 1610) and St. Alphonsus Liguori (d. 1787). Anthony Everett gives a philosophical defence of the common-sense view that there are no such things as fictional people, places, and things. He argues that our talk and thought about such fictional objects takes place within the scope of a pretense, and that we gain little but lose much by accepting fictional realism.

This book is a discussion of some of Kierkegaard's central ideas, showing their relevance to contemporary debates in epistemology, ethics, and the philosophy of religion. Anthony Rudd's aim is not simply to expound Kierkegaard's ideas but to draw on them creatively in order to illuminate questions about the foundations of morality and the nature of personal identity, as discussed by analytical philosophers such as MacIntyre, Parfit, Williams, and Foot. Rudd seeks a way forward from the sterile conflict between the (...) view that morality and religion are based on objective reasoning and the view that they are merely expressions of subjective emotions. He argues that morality and religion must be understood in terms of the individual's search for a sense of meaning in his or her own life, but emphasizes that this does not imply that values are arbitrary or merely subjective.
