U ovom članku raspravljamo o hipotezi proširenog jastva Andyja Clarka i Davida Chalmersa, a osobito o prigovoru prema kojemu proširenom jastvu nedostaje stabilnost i kontinuitet koji su potrebni da bismo ga smatrali identičnim kroz vrijeme. Pokušavamo pokazati da je taj prigovor neodrživ. Raspravljamo i o gledištu prema kojemu se drugi tip jastva, to jest narativno jastvo, također može shvatiti kao prošireno, i tvrdimo da stabilnost i kontinuitet toga tipa jastva također nisu ugroženi ako ga proširimo izvan granica čovjekova tijela. Stoga, (...) barem što se tiče tih tipova jastva, kada razmišljamo o problemima osobnog identiteta, nije potrebno ograničiti se na internalizirano jastvo. (shrink)

Rigorous attention has been paid to moral distress among healthcare professionals, largely in high-income settings. More obscure is the presence and impact of moral distress in contexts of chronic poverty and structural violence. Intercultural ethics research and dialogue can help reveal how the long-term presence of morally distressing conditions might influence the moral experience and agency of healthcare providers. This article discusses mixed-methods research at one nongovernmental social support agency and clinic in Rio de Janeiro, Brazil. Chronic levels of moral (...) distress and perceptions of moral harm among clinicians in this setting were both violent, following Nancy Scheper-Hughes’ use of that term, and a source of exceptional and innovative care. Rather than glossing over the moral variables of work in such desperate extremes, ethnography in these settings reveals novel skills and strategies for managing moral distress. (shrink)

Socio-cultural shifts during the 1960s and 1970s included widespread secularization, challenges to authority and tradition, and an emphasis on individual choice. Healthcare and biomedical research advances accompanied these social changes, giving rise to numerous ethical and policy questions. The contemporary bioethics project emerged in this context with (at least) three aims: (1) to offer practical answers to these questions (often) in ways that (2) facilitate or support particular practices or goals (e.g., organ donation or human research) and that (3) appear (...) broadly applicable and legitimately enforceable. Philosophical thinking, which involves investigating and disambiguating concepts and categories, articulating conceptually clear definitions, and mapping arguments to identify premises, detect fallacies, and describe their logical implications, can undermine the practical goals of the bioethics project. This tension between the goals of bioethics and philosophical thinking might help to explain what some scholars see as a disinterest in philosophical thinking in bioethics today. (shrink)

The term ‘culture wars’ has been used to describe deep, apparently intractable, disagreements between groups for many years. In contemporary discourse, it refers to disputes regarding significant moral matters carried out in the public square and for which there appears to be no way to achieve consensus or compromise. One set of battle lines is drawn between those who hold traditional Christian commitments and those who do not. Christian bioethics is nested in a set of moral and metaphysical understandings that (...) collide with those of the dominant secular culture. The result is a gulf between a moral life and an approach to bioethics framed in the face of a transcendent God and a final judgment versus a moral life and an approach to bioethics framed as if the world were without ultimate meaning and as if death were the end of personal existence. These approaches are separated by a moral and metaphysical gulf that sustains incompatible life worlds and incompatible understandings of bioethics. Attempts to bridge the gulf with secular reason are ineffective because there is no shared conception of reason or standard of evidence. Efforts to use the state to enforce a particular set of metaphysical and moral commitments, whether secular or religious, lead to public disputes with a war-like character. (shrink)

The article discusses the narrative turn as a key for the analysis of sociological/social theories. To that end, we present some preliminary results of an inquiry around the theories of modernization put forward by the Italian-Argentine sociologist Gino Germani. We look into the narrative of transition, its paradoxes and a counter narrative found in some of his works. From this point we draw some conclusions about the limits of the "narrative turn" as a perspective for social theory analysis and display, (...) as an alternative, Foucault's perspective of re-problematization. We primarily look into the danger of homogenization that the "narrative turn" entails, in spite of the heterogeneity of elements which, as we shall argue, form the modernization theory found in Germani. In this sense, towards the end, the article seeks to contribute to a reflection on the work with theoretical texts and proposes an approach able to observe the historical and material singularities involved in his production. El artículo discute la perspectiva del giro narrativo como clave de análisis de teorías sociológicas/sociales. Para ello, presenta como "caso" algunos resultados preliminares de una indagación sobre las teorías de la modernización presentes en los textos del sociólogo ítalo-argentino Gino Germani. Se analiza el funcionamiento, en los textos germanianos, de una narrativa de la transición, sus paradojas, así como de una contranarrativa crítica de la modernidad. A partir de ello, se exponen algunos límites del abordaje propuesto por el giro narrativo al que se contrapondrá, como alternativa, la perspectiva foucaultiana de re-problematización. Fundamentalmente, se analizan los peligros de homogenización que comporta el tipo de análisis propuesto por el giro narrativo en desmedro de la heterogeneidad de elementos que, según argumentaremos, componen la teoría de la modernización presente en Germani. En este sentido, hacia el final, el artículo busca aportar a una reflexión respecto del trabajo con textos teóricos y propone un abordaje atento a las singularidades histórico-materiales asociadas a su producción. O alojamento do recluso no estabelecimento prisional deve respeitar a sua dignidade. Os dados oficiais, até dezembro de 2020, revelam sobrelotação em algumas prisões. Analisamos a problemática no foro constitucional, dos direitos de personalidade e do direito penitenciário, recorrendo a fontes legais e doutrinárias. Concluímos que a sobrelotação configura um problema que tem de ser ultrapassado e que existe um claro desfasamento entre a law in the books e a law in action.

The term etonism is from «Etona» that means flag, marks, evidence, and reason in Kikôngo. The variants in Umbûndu: etonolo or etonuilo means, allegations, reasons, indulgence (tolerance). The Nyaneka form is etŏnya: 1) reasons, 2) allegations, 3) indulgence and 5) the justice and the tolerance. Etona is Angolan artist (sculptor/painter). In his sculpture they are morphologically evidenced three treatments in the surface of the matter, namely 1) flat treatment; 2) rude treatment and finally 3) accidental treatment. Each one is a (...) code: #1. The flat treatment indicates well-knowledge; a man of superior class; race or tribe or religion of majority; thought well-organized and structured. In painting, the hot intensity indicates dominance, prosperity, energy, intense desires; #2. The rude treatment reveals an acquired knowledge without academism, self-taught; medium class men; speech out of the scientific perimeters but with certain admissibility; race, tribe or religion of lot of people, but not of majority. In his painting, the neutral intensity marks the balance and inspires recomfort nurtured from two opposed poles (hot and cold); #3. The accidental part of the sculpture indicates some knowledge’s lack (pure empiricism); inferior class; race, tribe, religion of minority. In the painting, the cold intensity is naturally contrary of #1. Etonism is the tolerant reason between #1=I, #2=YOU and #3=HE. All of them form the coherent society that we call WE: the Etonian jusphilosophy that African peoples need for stability of their democracies and finishing their War. (shrink)

The International Criminal Court (ICC) is responsible for prosecuting individuals for heinous crimes that take place during civil and/or international armed conflicts, including sexual violence. Prosecuting this crime relies primarily on survivor accounts, but witnesses often fear the psychological effects of giving such testimony, particularly because there is a high risk of retraumatization, a stigma associated with victimhood, and a fear of victim-blaming. Thus, the Court’s Victims and Witness Unit (VWU) puts forth provisions for questioning vulnerable witnesses, requiring, in part, (...) that questioners avoid embarrassing or offending witnesses. Using a discourse analytic approach, this paper examines transcripts from three recent ICC cases dealing with wartime sexual violence—_Bemba, Ongwen_, and _Katanga and Chui—_exploring the discursive strategies employed by prosecutors and defense attorneys in these trials as they navigate arguing their cases before the judges while also tailoring their questions to adhere to the VWU’s provisions. I show that adhering to the provisions often involves relying on euphemistic expressions to discuss rape—which enter the trial discourse through linguistic formulations and reformulations—even though these expressions reflect the language used to discuss consensual sex and not sexual violence. Thus, this method of adhering to the provisions can undermine the prosecution’s case while helping the defense’s. (shrink)

Este artículo presenta una descripción fonético-fonológica del criollo haitiano hablado por hablantes nativos de esta lengua residentes en la Provincia de Concepción. Para la elicitación de los datos se utilizó una lista léxica de 133 ítems y, en algunas ocasiones, un set de imágenes _ad hoc_. La muestra estuvo constituida por seis colaboradores (cuatro de sexo masculino y dos de sexo femenino). El marco de referencia teórico-metodológico es el (neo)distribucionalismo, utilizado habitualmente en la descripción de vernáculos en Chile. Algunas conclusiones (...) prominentes de este artículo son las siguientes: la abertura y nasalización tienen estatus fonémico en algunas vocales (/e, o/, versus / ɛ, ɔ /; /a, e, o/ versus /ã, ẽ, õ/), existe una alta alofonía en algunas consonantes (por ejemplo, en los fonemas /p, t, k/), hay una oposición fonológica entre consonante fricativas sordas y fricativas sonoras (/f/ versus /v/, /s/ versus /z/ y / ʃ / versus / ʒ /), y no hay realizaciones aproximantes de los fonemas oclusivos sonoros. Se estudia la percepción que tienen las personas que visitan Andalucía de patrimonio distinguido por Unesco en esta comunidad (grado de conocimiento que tienen las personas visitantes de dicho patrimonio, el medio por el cual lo han conocido, su interés en visitarlo y la valoración que otorgan a dicho patrimonio), descubriendo la imagen que tienen los y las visitantes a la comunidad autónoma andaluza de este patrimonio. The book you hold in your hands is the outcome of the "ISCS 2013: Interdisciplinary Symposium on Complex Systems" held at the historical capital of Bohemia as a continuation of our series of symposia in the science of complex systems. Prague, one of the most beautiful European cities, has its own beautiful genius loci. Here, a great number of important discoveries were made and many important scientists spent fruitful and creative years to leave unforgettable traces. The perhaps most significant period (...) was the time of Rudolf II who was a great supporter of the art and the science and attracted a great number of prominent minds to Prague. This trend would continue. Tycho Brahe, Niels Henrik Abel, Johannes Kepler, Bernard Bolzano, August Cauchy Christian Doppler, Ernst Mach, Albert Einstein and many others followed developing fundamental mathematical and physical theories or expanding them. Thus in the beginning of the 17th century, Kepler formulated here the first two of his three laws of planetary motion on the basis of Tycho Brahe’s observations. In the 19th century, nowhere differentiable continuous functions (of a fractal character) were constructed here by Bolzano along with a treatise on infinite sets, titled “Paradoxes of Infinity” (1851). Weierstrass would later publish a similar function in 1872. In 1842, Doppler as a professor of mathematics at the Technical University of Prague here first lectured about a physical effect to bear his name later. And the epoch-making physicist Albert Einstein – while being a chaired professor of theoretical physics at the German University of Prague – arrived at the decisive steps of his later finished theory of general relativity during the years 1911–1912. In Prague, also many famous philosophers and writers accomplished their works; for instance, playwright arel ape coined the word "robot" in Prague (“robot” comes from the Czech word “robota” which means “forced labor”). This article addresses the impact of the potential conflict between the roles of physicians who are both clinicians and researchers on the recruitment of persons into research trials. It has been proposedthat a physician breaches inter-role confidentiality when he or she uses information gathered in his or her clinical role to inform patients about trials for which they may be eligible and that clinician-researchers should adopt a model of preliminary consent to be approached about research prior to commencing a clinical (...) relationship. This article argues that even if we grant the legitimacy of inter-role confidentiality (which is open to question), there are circumstances in which other obligations physicians bear override the obligation of inter-role confidentiality. Moreover, it is argued that the practice of preliminary consent is morally suspect and that such consent cannot be deemed valid. The article concludes with a series of recommendations of ways in which the legitimate concern regarding the conflicting roles of clinician-researchers can be addressed in the recruitment stage of research. This paper maps and systematizes the different discourses around peace in the public sphere in Colombia during the context of the latest peace negotiations between the government and the guerrilla group FARC-EP. The analysis of the discourses of peace is boiled down to four main approaches: a. Peace is understood as a relational dynamic that allows for the deconstruction of the binary friend-enemy and the recognition of the other; b. peace is seen as a condition that enables security and the (...) deepening of economic development through neoliberal policies; c. peace is re-signified through the signifier ‘territory’, to refer to the need of local involvement to define and implement peace policies in order to take into account the needs from those living and being in the territories; and d. peace is proposed as the consecution of social and environmental justice, accompanied of an alternative development that ensures the autonomy of indigenous, black communities, and peasants to decide how they want to live, how they want to exist. The ultimate goal of this paper is to explore the power-resistance dynamics at play in the re-definition of peace during the window of opportunity that the peace dialogues represented. (shrink)

Introduction The bioethics literature reflects significant interest in and concern with the use of genetic and genomic information in various settings. Because psychiatric treatment and research raises unique ethical, legal, and social issues, we conducted a scoping review of the biomedical, bioethics, and psychology literature regarding the application of genetic and genomic tools to psychiatric disorders (as listed in the DSM-5) and two associated behaviors or symptoms to provide a more detailed overview of the state of the field. Objectives The (...) primary objective was to examine the available bioethics, biomedical, and psychology literature on applying genetic and genomic tools to psychiatric disorders (other than neurodevelopmental disorders) and two behaviors or symptoms sometimes associated with them (aggression or violence and suicidality) to identify the disorders to which these tools have been applied, the contexts in or purposes for which they have been applied, the ethical, legal, or social concerns associated with those uses, and proposed recommendations for mitigating those concerns. Methods We used Arksey and O’Malley’s scoping review framework: (1) identify the research question; (2) identify relevant studies; (3) select studies; (4) chart the data; and (5) collate, summarize, and report results (2005). We relied on Levac et al. to inform our application of the framework (2010). The PRISMA extension for scoping reviews checklist informed our reporting (2018). We searched three electronic databases MEDLINE (PubMed), Embase, and PsycInfo (EbscoHost) for peer-reviewed journal articles in English to identify relevant literature. One author screened the initial results and additional screening was done in consultation with other authors. A data extraction form using DSM-5 diagnostic categories (excluding neurodevelopmental disorders) was developed and two authors independently each reviewed approximately half of the articles. Inter-rater reliability was ensured by double-coding approximately 10% of the papers. An additional author independently coded 10% of the articles to audit the data. Results In 365 coded publications, we identified 15 DSM-5 diagnostic categories in addition to the two pre-selected behaviors or symptoms (aggression or violence and suicidality) to which genetic or genomic tools have been applied. We identified 11 settings in or purposes for which these tools were applied. Twenty-two types of ethical, legal, or social concerns associated with the application of genetic or genomic tools to these disorders or behaviors/symptoms were identified along with 13 practices or policies that could mitigate these concerns. Conclusion Genetic and genomic tools have been applied to a wide range of psychiatric disorders. These raise a range of ethical, legal, and social concerns. Additional research is warranted to better understand the concerns and effective ways to address them. Advancing the literature to identify relevant ethical, legal, or social concerns and solutions to those problems likely requires greater attention to specific applications of genetic or genomic tools to particular psychiatric disorders and associated behaviors/symptoms as well as broad stakeholder engagement. An Institute of Medicine panel charged with reviewing the system for overseeing research involving children concluded in 2004 that Institutional Review Boards, institutions engaged in research, and study sponsors should “adopt explicit written policies on acceptable and unacceptable types and amounts of payments related to [children’s] research participation.” We previously reported data on practices and policies in the U.S. regarding payments to children who participate in research and their parents. Here, we report additional results from our study and identify some (...) of the decisions that must be made in developing payment plans and on which payment policies will be expected to offer guidance. We conclude that further conceptual analysis and empirical research are necessary before IRBs, institutions, and sponsors can develop specific rules on numerous aspects of payment. Nevertheless, payment policies that promote the ethical treatment of children in research and their parents can be developed. We propose a structure for such policies. (shrink)

The bioethics literature has paid little attention to matters of informed reproductive decision-making among women of childbearing age who have chronic kidney disease (CKD), including women who are on dialysis or women who have had a kidney transplant. Women with CKD receive inconsistent and, sometimes, inadequate reproductive counseling, particularly with respect to information about pursuing pregnancy. We identify four factors that might contribute to inadequate and inconsistent reproductive counseling. We argue that women with CKD should receive comprehensive reproductive counseling, including (...) information about the possibility of pursuing pregnancy, and that more rigorous research on pregnancy in women with CKD, including women on dialysis or who have received a kidney transplant, is warranted to improve informed reproductive decision making in this population. What the Doctor Didn’t Say, by Jerry Menikoff and Edward P. Richards, is a courageous and well-written volume that examines some of the fundamental debates pertaining to the ethics of clinical research. The volume deserves a careful reading by anyone with a potential role in clinical research: clinicians who might serve as investigators or refer patients to clinical trials; research staff; Institutional Review Board members and administrators; sponsors who design clinical trials; and the book’s intended audience, namely, potential research participants (...) and their families. A cursory reading of this volume might lead one to think that Menikoff and Richards have declared war on clinical research. They have not. Instead, they offer an in-depth study of the conduct and oversight of clinical research through the lens of law and ethics. They shed light on old issues and initiate discussion of new questions, challenging readers to think critically about the relationship between medical ethics, research ethics, the law, and the conduct of clinical research.
