Traduire consiste à faire passer la teneur d’un message exprimé dans une langue, dans une autre, avec la plus grande fidélité. Pour que la traduction soit fidèle au texte de départ il est donc nécessaire de comprendre ledit texte. Lorsque ce dernier est de nature juridique, traduire sous-tend de comparer deux systèmes de droit (tradition civiliste et Common Law pour les textes qui nous intéressent) qui généralement ne coïncident que de manière partielle. On se propose d’analyser la traduction de concepts (...) qui posent problème sur le plan du signifiant et/ou sur celui du signifié, soit parce que la graphie des mots qui les désignent est identique ou très proche en anglais et en français—ce sont des faux amis, parmi lesquels on distinguera les vrais des faux -, soit parce que l’équivalence des mots généralement posés en miroir présente des subtilités qui interdisent parfois de traduire l’un par l’autre : parmi ces «vrais amis» , moins amicaux qu’il n’y paraît, on distinguera, là encore, les vrais, des faux. On tâchera de montrer que parfois, «bien» traduire ce peut être d’opter pour une traduction descriptive; d’autres fois, c’est choisir un équivalent fonctionnel, dès lors qu’on a identifié que l’on ne se trouve pas dans l’espace non partagé par les deux concepts juridiques; d’autres fois encore, mais de manière marginale, c’est décider de ne pas traduire. Cocreating meaning in collaboration is challenging. Success is often determined by people's abilities to coordinate their language to converge upon shared mental representations. Here we explore one set of low‐level linguistic behaviors, linguistic alignment, that both emerges from, and facilitates, outcomes of high‐level convergence. Linguistic alignment captures the ways people reuse, that is, “align to,” the lexical, syntactic, and semantic forms of others' utterances. Our focus is on the temporal change of multi‐level linguistic alignment, as well as how alignment is (...) related to communicative outcomes within a unique collaborative problem‐solving paradigm. The primary task, situated within a virtual educational video game, requires creative thinking between three people where the paths for possible solutions are highly variable. We find that over time interactions are marked by decreasing lexical and syntactic alignment, with a trade‐off of increasing semantic alignment. However, greater semantic alignment does not translate into better team performance. Overall, these findings provide greater clarity on the role of linguistic coordination within complex and dynamic collaborative problem‐solving tasks. (shrink)

This research uses Christian Hardcore punk to show how evangelical Christian men respond to changes in gender relations that threaten hegemonic masculinity through a music subculture. Drawing on interviews and participant observations of live music shows, I find that Christian Hardcore ministry involves a hybrid mix of aggressive and loving performances of manhood. Christian Hardcore punk men fortify the idea that men and women are essentially opposites through discourse and the segregation of music spaces, even as they deviate from dominant (...) ideas of what makes a man in their strategy of openly expressing the “loving” of secular men. The mechanism for this is the interactions in concert spaces. These findings offer a conceptual move away from studying “godly” masculinity as intrinsically distinct from secular masculinity and illustrate how religious masculinities can be both hegemonic and “soft.”. This case describes the background of the whistleblower complaint, filed by Daniel Schlicksup, questioning the propriety of Caterpillar Inc.’s “Swiss tax strategy”. The Swiss tax strategy was recommended by its independent auditor, PricewaterhouseCoopers, and designed to transfer to a Swiss entity the profits earned on its sales of “purchased finished replacement parts” to foreign marketers. This strategy enabled Caterpillar to shift $8 billion in replacement parts sales to Switzerland and to avoid or defer paying U.S. taxes on that income. Daniel (...) Schlicksup, a member of Caterpillar’s tax staff, filed an Internal Revenue Service whistleblower complaint against Caterpillar and provided the IRS extensive documentation that served as the foundation for the IRS’s claim Caterpillar owed $2 billion in back taxes and penalties, potentially entitling Schlicksup to a huge whistleblower award ranging from $300 to $600 million. Careful review of this case facilitates student discussion, and enhances student understanding, of the wisdom and morality of Schlicksup’s whistleblowing activities. (shrink)

Though written corporate codes of ethics have been touted as a panacea for the embarrassments and uncertainties of the past two decades, the absence of clear evaluation procedures severely compromises their usefulness. An ethnographic study comparing development processes and compliance outcomes in large health care facilities and energy companies shows that neither of the two industries has encountered much success with a codes of ethics program. Companies that distribute copies of their code of ethics seldom ensure the process is completed (...) or that employees understand the purpose of the document, and staff responsible for the code give it a low priority relative to their overall responsibilities. Contrary to expectations, health care facilities are no more likely to develop or implement codes of ethics effectively than are energy companies. More extensive research is needed in order to generate the data necessary for the development of realistic standards for the evaluation of codes of ethics. (shrink)

What critical characteristics do firms have that determine the scale and scope of corporate social responsibility activities they undertake? This paper examines two disparate predictors of corporate social performance. First, using the lens of the resource-based view, we examine the role of alliance network centrality on corporate social performance. We find that centrality enhances corporate social performance. Second, we investigate how board composition affects corporate social performance. Specifically, drawing on stakeholder theory, we find that the percentage of female directors predicts (...) greater corporate social performance. In addition, we look at the influence of outside directors on this relationship. Our findings show that the presence of more outside directors positively moderates the relationship between female directors and corporate social performance. (shrink)
