The Dobbs decision will directly affect patients and reproductive rights; it will also impact patients indirectly in many ways, one of which will be changes in the physician workforce through its impact on graduate medical education. Current residency accreditation standards require training in all forms of contraception in addition to training in the provision of abortion. State bans on abortions may diminish access to training as approximately half of obstetrics and gynecology residency programs are in states with significant abortion restrictions. (...) The Dobbs decision creates numerous hurdles for trainees and their programs. Trainees in restrictive states will have to travel to learn in a different program in a protective state. As training opportunities diminish, potentially leading to a decline in clinical skills, knowledge, and experience in the provision of abortion, the rate of complications and maternal mortality are likely to rise. This will likely have a disproportionately negative effect on preexisting disparities in reproductive health fueled by a longstanding history of systemic racism and inequities. This work aims to both define the looming problem in abortion training created by Dobbs and propose solutions to ensure that an adequate workforce is available in the future to serve patient needs. Clinical trial recruitment is ripe for innovation. The current model is costly, often results in poor recruitment and offers inequitable access. To improve this system, we envision a peer-to-peer blockchain platform where patients control the depth and breadth of how their medical information is shared.

In April 2021, the U.S. Food and Drug Administration announced its intention to ban menthol flavoring in cigarettes and cigars. The Agency’s decision was based in part on the disproportionate impact of menthol flavoring in Black communities.

The neo‐Gramscian framework offers one of the more innovative contributions to a discipline long embedded in the self‐same verities of behaviouralism, positivism and neo‐Realism. As with conventional wisdom, however, neo‐Gramscians reproduce either assumptions of liberal neutrality or cultural thickness in relation to the ‘peripheral zones’ of the global political economy. These tendencies produce a variant that can be likened to ‘soft Orientalism’. In the first instance, cultural difference is not much of an impediment to the establishment of (West‐centred) global hegemony. (...) In the second instance, otherness becomes the principal source of counter‐hegemonic movements or resistance. This article provides a Gramscian rereading of these antinomies in relation to the apparent consolidation of a natural attitude towards Islam in the wake of recent dramatic events. (shrink)

Western science claims to provide unique, objective information about the world. This is supported by the observation that peoples across cultures will agree upon a common description of the physical world. Further, the use of scientific instruments and mathematics is claimed to enable the objectification of science. In this work, carried out by reviewing the scientific literature, the above claims are disputed systematically by evaluating the definition of physical reality and the scientific method, showing that empiricism relies ultimately upon the (...) human senses for the evaluation of scientific theories and that measuring instruments cannot replace the human sensory system. Nativist and constructivist theories of human sensory development are reviewed, and it is shown that nativist claims of core conceptual knowledge cannot be supported by the findings in the literature, which shows that perception does not simply arise from a process of maturation. Instead, sensory function requires a long process of learning through interactions with the environment. To more rigorously define physical reality and systematically evaluate the stability of perception, and thus the basis of empiricism, the development of the method of dimension analysis is reviewed. It is shown that this methodology, relied upon for the mathematical analysis of physical quantities, is itself based upon empiricism, and that all of physical reality can be described in terms of the three fundamental dimensions of mass, length and time. Hereafter the sensory modalities that inform us about these three dimensions are systematically evaluated. The following careful analysis of neuronal plasticity in these modalities shows that all the relevant senses acquire from the environment the capacity to apprehend physical reality. It is concluded that physical reality is acquired rather than given innately, and leads to the position that science cannot provide unique results. Rather, those it can provide are sufficient for a particular environmental setting. (shrink)

Health care ethics is a sensitive domain, which if ignored, can lead to patient dissatisfaction, weakened doctor–patient interaction and episodes of violence. Little importance has been paid to medical ethics within undergraduate medical education in developing countries such as Pakistan. Three doctors in Pakistan are currently facing an official police complaint and arrest charges, following the death of a sanitary worker, who fell unconscious while cleaning a drain and was allegedly refused treatment as he was covered in sewage filth. The (...) medical license of the doctors in question should be cancelled, if found guilty following a thorough investigation into the case. The ‘right to life’ has been universally assured by all moral, cultural and legal codes and no society can ever argue against the sacredness of a human life. It is quite clear that the aforesaid doctors’ actions are not only against the core principles of the physicians’ code, but also go against the doctrine of human rights. If serious efforts on an urgent basis are not made by the regulatory and governing bodies, one can definitely expect similar incidents for at least a few more decades before any noticeable change is seen. ABSTRACT The BiRCh Project (The Corpus of Bilingual Russian Child Speech) involves collecting a longitudinal audio corpus of Russian spoken by children and their families in Russia, Ukraine, Germany, the U.S., and Canada. We are building a large-scale corpus based on a subset of this data, the “Parsed and Audio-aligned Corpus of Bilingual Russian Child and Child-directed Speech (BiRCh)” with two basic components: (1) 1-million-word transcripts which are time-aligned with the audio speech signal and fully textsearchable, and (2) a 500K-word (...) morphologically annotated and parsed portion of the transcripts, also audio-aligned. We are using this corpus to investigate various phenomena in the linguistic input and the developmental trajectory of heritage bilinguals, e.g., case, gender, passives, impersonals, politeness markers, disfluencies, and discourse markers. This article focuses on the challenges and solutions of the BiRCh development and the implications for research on the richly annotated data provided by the corpus. (shrink)

Estamos construindo um corpus de larga escala com base no conjunto dessas gravações, o ‘Parsed and Audio-aligned Corpus of Bilingual Russian Child and Child-directed Speech (BiRCh)’, com os dois componentes básicos: (1) as transcrições de (...) um milhão de palavras alinhadas com os arquivos de áudio, em que pode ser realizada a busca textual, e (2) as transcrições de 500 mil palavras anotadas morfologicamente e analisadas sintaticamente, também alinhadas com os arquivos de áudio. Estamos utilizando o corpus para investigar os diversos fenômenos no input linguístico e na trajetória do desenvolvimento de falantes de herança, tais como o uso de caso, gênero, construções passivas e impessoais, marcadores de polidez, disfluências e marcadores discursivos. ABSTRACTHate crimes in the United States have drastically increased since 2015, particularly for the American Muslim population. There was a 17% hike in hate crimes against American Muslims in 2017...

Soon after the first COVID-19 positive case was detected in Wuhan, China, the virus spread around the globe, and in no time, it was declared as a global pandemic by the WHO. Testing, which is the first step in identifying and diagnosing COVID-19, became the first need of the masses. Therefore, testing kits for COVID-19 were manufactured for efficiently detecting COVID-19. However, due to limited resources in the densely populated countries, testing capacity even after a year is still a limiting (...) factor for COVID-19 diagnosis on a larger scale and contributes to a lag in disease tracking and containment. Due to this reason, we started this study to provide a better cost-effective solution for enhancing the testing capacity so that the maximum number of people could get tested for COVID-19. For this purpose, we utilized the approach of artificial neural networks (ANN) to acquire the relevant data on COVID-19 and its testing. The data were analyzed by using Machine Learning, and probabilistic algorithms were applied to obtain a statistically proven solution for COVID-19 testing. The results obtained through ANN indicated that sample pooling is not only an effective way but also regarded as a “Gold standard” for testing samples when the prevalence of the disease is low in the population and the chances of getting a positive result are less. We further demonstrated through algorithms that pooling samples from 16 individuals is better than pooling samples of 8 individuals when there is a high likelihood of getting negative test results. These findings provide ground to the fact that if sample pooling will be employed on a larger scale, testing capacity will be considerably increased within limited available resources without compromising the test specificity. It will provide healthcare units and enterprises with solutions through scientifically proven algorithms, thus, saving a considerable amount of time and finances. This will eventually help in containing the spread of the pandemic in densely populated areas including vulnerably confined groups, such as nursing homes, hospitals, cruise ships, and military ships. The earlier volume in this series dealt with two religions of Indian origin, namely, Buddhism and Jainism. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India. Aḥmed Cevdet Pasha (d. 1312/1895) is one of the influential and prominent Ottoman scholars in history and law. Besides history and law, he also produced works on literature, sīra (the life of the Prophet) and tafsīr (the Qur’anic exegesis). In the last years of his life, Cevdet Pasha aimed to translate the Qurʾān including short comments on the verses, but this work was remained limited to the sūrah al-Baqara. Correspondingly to this translation named Terjeme-i Sharīfa, he prepared a (...) glossary to the Qurʾān called Lāḥiqa-i Sharīfa for expressions and terms that require detailed explanation. Hereby, this work could only include the sūrah al-Baqara. After Cevdet Pasha’s death, his books passed to his daughter Ms Fāṭima ʿAliyye (d. 1936). The director of the Library of Maʿārif, Nācī Qāsim (d. 1963) gave a deed stipulating that he would take the first part of the Lāḥiqa-i Sharīfa and Terjeme-i Sharīfa from her and return them as they are. Later on, he published only the Muqaddima (introduction) and Lāḥiqa-i Sharīfa in the work named Tercemeli Ḳurʾân-ı Kerîm (İstanbul: 1927). Placing the Muqaddima at the beginning of the book and Lāḥiqa-i Sharīfa at the end misled some people by making them to think that the translation belongs entirely to Cevdet Pasha. Sulayman Tevfīq reprinted these two works together within his translation named el-Beyān fī ʾāyāti’l-Qurʾān in 1928. Terjeme-i Sharīfa has not been published anywhere else. Emine Armağan recently found and published a notepad in which Cevdet Pasha wrote Terjeme-i Sharīfa, mentioned Muqaddima and Lāḥiqa-i Sharīfa. In her book Emine Armağan printed the pages belonging to Cevdet Pasha as thumbnails, but she did not publish them in Latin. In this article, Muḳaddime and Lâḥika-i Şerîfe are Latinized and compared to the Terceme-i Şerîfe. The relevant parts of the translation are given in the footnotes. This study is an attempt to determine to what extent the translation in the manuscript form corresponds to the glossary and the soundness of relating the text to the author. In addition, many errors in the Ottoman edition of the glossary were also corrected. In the Muqaddima, Cevdet Pasha draws attention to the necessity of God’s existence, the illiteracy and the trustworthiness of his Messenger, and that the revelation is the primary source of knowledge for people. He summarizes the process of the Qurʾān’s revelation, notification and compilation. He briefly touches on the issues related to ʿUlūm al-Qurʾān. Cevdet Pasha, who passed from here to the miracle of the Qurʾān, talks about the qadim (pre-existing) nature of the divine word and teḥaddī. Cevdet Pasha emphasizes that understanding the Qurʾān is possible only by knowing the Arabic language very well and whithout this knowldege the Qurʾān cannot adequately be translated into another language. On the other hand, he also believes that the first meanings can be externally translated in order to explain the first meanings of the verses to those who do not know Arabic. Cevdet Pasha’s preface is considerably concise in structure. He shortly pointed to the crucial issues in one sentence and passed to the other subjects. While writing Terjeme-i Sharīfa, Cevdet Pasha left the extensive explanations of the polysemous words and terms that cannot be translated literally to the tafsīr and Lāḥiqa. Cevdet Pasha’s Lāḥiqa-i Sharīfa is entirely original and not merely a translation of any Qurʾānic dictionary. He compiled the meanings of a word existing in different verses, and he was very meticulous in choosing the meanings the words. He summarized very detailed informations in the sources in a simple, concise and fluent style. The arrangement of the words was based on the abbreviated versions used in the Qurʾān. In addition to the lexical meaning of the word, he sometimes mentioned the words’ roots, form, singular and plural forms, ism al-fāʿil, ism al-mefʿūl, ism al-mekān, synonym/antonym, lexical aspects, the meaning and terminology it expresses in different recitations of the Qur’an (al-qırāat). He in particular highlighted if the word is one of the al-asmāʾ al-ḥusnā. He explained the changes in the meaning of a word when it is used for Allah or for humans. He shortly touched on the legal rulings. Cevdet Pasha clearly expressed in his work the most vital issues that the community should know without tiring the general reader of scientific disputes, philosophical discussions and literary analysises. Cevdet Pasha did not refer to any sources in his work and did not mention the transmission chain of the narrations. As a result of our research, we determined that he benefited from the commentaries of al-Zamakhshari (d. 538/1144), al-Rāzī (d. 606/1210), al-Qurṭūbī (d. 671/1273) and Beyḍāvī (d. 685/1286). We have seen that there are some similarities between the explanations of the words in the Lāḥiqa-i Sharīfa and the famous Qurʾānic dictionaries such as al-Mufredāt, Umdet al-ḥuffāẓ and Beṣāir. Waqf system is a judical and financial institution of social security as well as the institutions which conduct educational, cultural, religious, public works, social aid and health investments. The waqf founders lined the services idealized by them in their deeds of trustee. It is aimed that these services countinue forever. This process survived for centuries primarily stemmed from this legal infrastructure, financial resources and efficient inspecting recording order. The accountancy culture which is on the basis of auditing and proper for (...) information characteristics of the accountancy within the Ottoman financial tradition may be read from the accountancy books kept in the awqaf. There are a lot of studies on Ahmed Cevdet Paşa who has been considered as statesman, politician, jurist, historian, sociologist and educationalist. At the same time Ahmet Cevdet Paşa’s studies on logic are critically important when we deal with the last period of the Ottoman Empire. His book which is called Miyar-ı Sedad had both influenced the development of instruction of logic education in madrasahs and created a turning point in the studies on modern logic. For this reason we have (...) discussed his opinions about logic and science in this study and we have also tried to show that how his opinions on these issues affecected the instruction and the other fields. This paper is a tour of how the laws of nature can distinguish between the past and the future, or be T-violating. I argue that, in terms of the basic argumentative structure, there are basically just three approaches currently being explored. The first is an application of Curie's Principle, together with the CPT theorem. The second route makes use of a principle due to Pasha Kabir which allows for a direct detection. The third route makes use of a Non-degeneracy (...) Principle, and is related to the energy spectrum of elementary particles. I show how each provides a general template for detecting T-violation, illustrate each with an example, and discuss their prospects in extensions of particle physics beyond the standard model. In 1826, the Pasha of Egypt offered to the King Charles X an unusual present: a living giraffe. While offering remarkable animals was a common practice among monarchs, the choice of a giraffe was somewhat extraordinary since it was the first representative of its kind to set foot in France. The Royal Menagerie of the Paris Muséum national d'histoire naturelle was asked to oversee the transportation of this precious mammal and Étienne Geoffroy Saint-Hilaire, one of its professors, was sent (...) to Marseilles to fetch it on foot all the way back to the capital. The whereabouts of this exotic procession stirred passions throughout the country, generating a fashion craze "à la girafe." The so-called Pasha's giraffe, King's giraffe or French giraffe is also -- and perhaps more importantly -- Geoffroy's giraffe. The giraffe episode is representative of Geoffroy's larger scientific career. Because of its Egyptian flavor, its adventurous aspect, its political and diplomatic undertones, as well as the popular attention and educational opportunities it afforded, that mission was ideally suited for the flamboyant naturalist. So close were the animal's and the French zoologist's fates, that they passed away a couple months apart and both fell into relative oblivion. But even dead and dissected, Geoffroy's giraffe could not easily be dissociated from its companion. The afterlife of its "saintly" relics mirrors the popular and scholarly revival of Étienne Geoffroy Saint-Hilaire, portrayed by some as a forgotten "prophet.". (shrink)

England, known as “the empire without sun settling down” and being among the final winners of the World War I (1914-1918), had one of the heaviest defeats of its history against the Ottoman Empire in the Kut al-Amara, which happened on 29 April 1916 close to Baghdad. Following the defeat of Kut al-Amara, which was the most important war trauma for England during the World War I, the Turks and Germans, as winner side of the battle were evaluated by British (...) prisoners from military, political, cultural and socio-psychological aspects in their memories. Content analysis method is used in the article for qualitative evalution of the data related to the Turkish and German image reflected in the memories of British prisoners after the siege of Kut al-Amara. The alliance between Turks and Germans is regarded as contrast in terms of important elements as national and ethnic identity, language, religion and culture in the main sources of the research as My Compain by Charles Townshend, Besieged in Kut and After by Barber, A Kut Prisoner by Bishop, In Kut and Captivity with the Sixth Indian Division by Sandes, The Secrets of a Kuttite by Mousley which occationally use exaggerated language and the subjective information due to the impact of traumatic defeat.Summary: Being a heroic epic in the war history of Turkey, Kūt al-‘Amāra has been the subject of very fewer researches until recently, despite its importance in Turkey’s history. This argument is supported by the fact that the memoirs by Ottoman soldiers related to the WWI, which also encompass information about Kūt al-‘Amāra, were published half a century after the war at the earliest. Unlike the records of Turkish soldiers participating in Kūt al-‘Amāra, the memoirs and the war diaries of British soldiers were published shortly after the war, as early as possible, between the years of 1918-1921. The authors of these memoirs and war diaries informed the public on the reasons for the defeat of Kūt al-‘Amāra on the one hand, and on the other hand created the Ottoman and Turkish image which was concidered differently in the British society in terms of culture and civilization. They also strengthened this image over that of German’s, with whom they shared many common values despite the fact that they represented the opposite fronts of the war.It is worthy mentioning that the role of the Ottoman army in the victory of Kūt al-‘Amāra was highly underestimated by the memoirs of the British prisoners. According to the authors, it is not the Turkish army that has achieved real victories over the British, but Germany’s support, notably General von der Goltz, the great strategist of Europe. The effects of bad weather conditions and geographical situation are also emphasized among the reasons of the defeat of Kūt al-‘Amāra. Consequently, the success of the Turkish army in the victory of Kūt al-‘Amāra was ignored, except for the role of Halil Pasha. The image of an army that knows the trench and defence techniques well, but fails to attack is one of the prominent evaluations in the memoirs related to the Turkish military characteristics.The British prisoners of war, who evaluate the Turkish and German image through the economic and political situation, draw a very desperate picture of the situation of the Turks in the mentioned areas. According to this image, corruption and bribery prevails at every stage of the Turkish government. The Turks are unable to repay their dept to Germany, which dominates the economy of the country completely. According to these records, besides ordinary people, the army is also facing great difficulties in meeting basic requirements. To convert the Ottoman Empire into their own property and keep the Turks under their control in military, economic and political spheres, the Germans lend a high amount of money.On the basis of Turkish soldiers encountered in Kūt al-‘Amāra, the British prisoners characterizes the Turks as physically large, hard and strong-bodied people. The authors also note that the Turks are not as cold-blooded, calm and obedient as they seem at first sight, rather they become rude people when they get angry. Another feature that British prisoners evaluate as a potential of the Turks, is their childish spirit. In as much as they are happy with small things and can be offended by small things. According to the memoirs, the Germans should not be allowed to benefit from these characteristics of the Turks, but the British should take the advantage of their potential power.The moral characteristics of the Turks and the Germans are among the most emphasized subjects. Written in exceptional time such as war, sometimes the diaries include exaggerated and sentimental phrases related to the moral attitudes enemy soldiers exhibited during siege, as well as captivity. Turks are regarded as negligent and careless rather than cruel or ruthless. They owe these characteristics to their Eastern identity, which is different from the Europeans having virtues such as task responsibility and diligence. The moral characteristic of the Turks regarding the duty, responsibility and kindness is evaluated comparatively with the civilized and humanistic behaviors of the Germans towards the prisoners. Being Europeans, the Germans often come to the fore because of their more polite treatment towards the British prisoners. Although the Germans as an enemy fought against the British on the front, they were kind to them in the Ottoman territories as the only civilized people among the barbarian peoples of the East.The Turks and the Germans are compared in the field of education, as well as other areas of development. The authors emphasize that the education level of the Turks is very low; Armenian and Greek subjects of the Empire are its brain and financial resources, which is the reason why the Turks are anxious about them. The Germans have the superiority in both transportation and communication technology in the Ottoman territories. One of the reasons they had a huge investment on the Ottoman territories is the Berlin-Istanbul-Baghdad-Basra railway. The British prisoners give details on the German communication technology they encountered during both the battle and the captivity days in Anatolia. In addition to the transport and communication technology, they also record much German-made military equipment, from weapons to maps.Evaluating the Turks and the Germans as opposites, the British prisoners draw an image for the latter, with whom they share a common cultural legacy, as a fully equipped enemy in terms of technology and strategy on the front, and the civilized Europeans characterized with their virtue in non-war situations. On the contrary, the Turks are described as a strong defender and daredevil soldiers on the front line, but strategically weak on the front. In terms of duties and responsibilities, the Turkish soldiers are presented with negligent and irresponsible approach towards their prisoners. The images of the Turks and the Germans, which are compared by the British prisoners, are often based on their Eastern and Western identity. The plain covers the easternmost areas of Mersin Province, southern and central Adana Province, Western Osmaniye, and Northwestern Hatay, and it has been a major place of anthropogenic change and industrialization since the 1930s, in the aftermath of transition from the Ottoman Empire to the modern Republic. Kemal presents the severe impact of the destruction of the forests and the draining of the swamps on the nature of the local people, whose way of life was transformed by this anthropogenic uprooting during the modernization and industrialization brought about by successive political and environmental administrations in post-Ottoman Turkey:The earth was covered with woods from Misis to the Mediterranean Sea in the olden days. There is a tree called Kars. Due to the fact that the Kars tree grows there the place was called Kars for a long time.... Now there is nothing; not one single tree until the Mediterranean. Historians write that the land was a great forest even in the 19th century. This was stated in a letter of Cevdet Pasha written in 1865.... This is the reality of our century, the actual conditions of our times.(qtd. in Andaç 61–62; my translation)I suggest that Kemal's lamentation here introduces non-Western stories, placing post-Ottoman vulnerability and resilience into the Anthropocene, our current geological era in which humans as a collective are said to have become a geophysical force on a planetary scale.2 The above excerpt encourages the reader to embark on an alternative reading in which the anthropogenic changes have deep and environmentally damaging roots in the Middle Eastern region, including Turkey (see Inal and Turhan 1–9). Despite the global and universal staging of the Anthropocene within North America and Western Europe, it is crucial here to underscore how the Anthropocene renders both a global process of anthropogenic climate change and a local laying down of industrial change in other landscapes and cities beyond its Eurocentric roots and routes.Within this context, this article argues that Kemal's literary works speak well to the concerns of the Anthropocene epoch, characterized by rapid and fundamental human-driven alterations of Earth, revealing longue duree linkages between weather, war, industrialization, empire, agriculture, urbanization, and deforestation that have created extraordinary changes on local and global scales. In the above passage, where we read the loss of the woods from Misis to the Mediterranean, Kemal manifests an acute awareness that the tree already disappears amid a vanishing ecosystem. Elsewhere, Kemal recounts the destruction of the forests and swamps that grants the Çukurova region its richness and vitality. At the same time, he shows how the particular process of deforestation dramatically changes ordinary lives of both human and nonhuman communities in the area during the modernizing and westernizing processes in the aftermath of the Ottoman Empire. These criteria may occur as a classification of science and they also can be limited to a few sciences. In this article, we will examine the Tafsīr chapter from the work of Sipāhīzādah who took charge (...) as a teacher and judge in the Ottoman Empire. That part cons-titutes the first chapter of the work called Anmūdhaju’l-Funūn which he symbolically limited the investigated sciences to seven. The other investigated sciences in the work are Ḥadīth, Kalām, the methodology of Islamic Law, Fiqh, Bayân, and Medical Science. In the Tafsīr chap-ter of the work of Sipāhīzādah called Anmūdhaju’l-Funūn, seven different issues are investi-gated in total. Can Bismillah be used as a vow? According to Sipāhīzādah, al-Bayḍāwī, al-Jurjānī and Mollā Khusraw claim that there is a difference between vowing in the name of God and starting something with Bismillah and this difference should be rejected through the work of al-Mergīnānī that is called Hidâye and Ibn al-Humām’s Sharh. Thus, according to him one of the differences between Billah and Bismillah is not that they count as a vow.2. What is the order of the creation of the earth and the heavens in the light of the verse al-Baqarah 2/29? Sipāhīzādah mentions that the creation and the arrangement of the earth did not happen at the same time.3. Do the names of the numbers imply limitation (hasr)? Regarding this issue, Sipāhīzādah took the verse that says “…and made them seven heavens” as the focal point and claimed that the mentioned number in this verse indicated limitation and gave examples from verses, hadith, linguists and scholars of the methodology.4. What is the reason behind the borrowing of Israelites the jewels of the Egyptians in the light of the verse al-Baqarah 2/50? Sipāhīzādah criticized the two arguments of Fakhr al-Dīn al-Rāzī. Sipāhīzādah criticized the assessments that Ancient Egyptians pursued those properties which they lent before and Israelites kept those jewels and he rejected them.5. The entry order to the city was given to Israelites in the verses al-Baqara 2/58-59, was this order given to them before or after their deviation? He criticized the argu-ments of al-Zamakhsharī and al-Bayḍāwī which they have given to prove that this order was given to them after their deviation. He offered arguments and emphasi-zed that the entry order to the city was given before their deviation.6. Where is the prostrated door which is mentioned in the verse al-Baqara 2/58? It is controversial if it is Jerusalem or the door of the Mosque in which they were perfor-ming the prayer. al-Zamakhsharī and al-Bayḍāwī claim that it is Jerusalem. Was this order given before or after the death of the prophet Moses? Sipāhīzādah thinks that it has to be the door of Jerusalem.7. How can we assess Fakhr al-Dīn al-Rāzī’s questions and answers regarding the nar-rative differences between the verses al-Baqarah (2/58-59) and al-A‘râf (7/161-162)? Sipāhīzādah criticized the responses which are given by al-Rāzī and gives contrary responses.It is obvious that the author is Hanafi in the matters of Islamic Law. Besides this, we can say that Sipāhīzādah did not examine the issues of Tafsīr through a sense of belonging, he emp-hasized the opinions of people which he found compatible with his beliefs. Hence, He someti-mes comes to an agreement with al-Bayḍāwī who is a Shaffi in the matters of Islamic Law and from time to time he affirms al-Zamakhsharī who is a Mutazilite in the matters of faith. Sipāhīzādah examined the issues of Tafsīr through a historical depth and this both makes him a participant of the debate and allows the continuation of the present discourse through a critical reading. Thus, an attitude of critical consistency is prominent in his works. In our opi-nion, this attitude of critical consistency is an action of consolidation for the maintenance of the power of the relevant text-centered linguistic system. In this regard, we can say that Tafsīr remained its liveliness in the geography in which the author lived. So, the founders of the system which we can list as al-Zamakhsharī, Fakhr al-Dīn al-Rāzī, and al-Bayḍāwī and the ones who caused it to continue which we can list as Sayyid Sharif al-Jurjānī, Mollā Khusraw, and Ibn Kamāl Pasha have been read critically by the author. This makes the subject of work quite important. Because thanks to the work, it will be possible to catch some clues about the progress of the accumulation regarding Tafsir in the era the author lived. Even though it was negative in the issues that are investigated by the author, the fact that the Fakhr al-Dīn al-Rāzī is a prominent figure is an indicator of the maintenance of the dominance of Rāzī. It would be more appropriate to link this with his effectiveness rather than the Kalāmī power of his Tafsir. For Rāzī is not taken as the focal point by Sipāhīzādah only in issues of Kalām. Besides that, he renders Rāzī as a participant of the subject in linguistic issues too such as whether if the name of the numbers implies limitation or not and the usage of varied phrases in verses. Außer der Ausgabe mit italienischer Übersetzung (S. 122–139) bietet aber der Herausgeber auch eine ausführliche Einführungsstudie (S. 13–120), sowie ebenso ausführliche historische Kommentare (S. 143–173). Die Ausgabe ist auf Grund der Handschriften aus dem Kl. Barlaam (heute Petrop. Gr.251.I) und Kl. des Hl. Stefan entstanden. Die (...) beiden Handschriften bestehen aus dem Text der Chronik von Ioannina, einem Horismos des Sinan-pasha und dem hier herausgegebenen Text, wobei in der Handschrift Barlaam noch verschiedene Notizen am Ende beigefügt sind. It is evident that the Ottoman state made radical reforms to overcome the crises it had fallen in various fields, especially since the Tanzimat era. In this context, the preparation and codification of “Majalla-i Ahkām-i Adliyya” is undoubtedly one of the most important events of both the Ottoman legal history and the history of Islamic law. It is not a whole and complete civil law since it mainly covers debts, partly property and judicial /procedural law. “Munākahāt ve Mufārakāt” subjects corresponding (...) especially to the field of family law and the related law articles are not included in Majalla. The work that forms the basis of our paper was written precisely to fill this gap. The work in the nature of translation and commentary of Kadri Pasha’s book, al-Ahkām al-shar'iyya fi al-Ahvāl al-shahsiyya, which is a draft law, was born out of the need for a compact text on family law. It is also a response to the criticisms in his era towards the Islamic Family Law verdict. Its preparation about twenty years before the Family Law Decree is also a helpful clue in analyzing the nature of the work. In addition to translation, Hasan Riza strives to make the marriage contract, the responsibilities of the spouses, divorce, lineage and alimony subjects understandable, and to respond to the criticisms on these issues. When his effort is evaluated together with the religiously referenced commentary he made to Qānūn-i Asāsī, it can be described as the proof of the accuracy of the family law judgment, especially in the classical fiqh literature, and the defense of the conformity of these provisions to intact human nature. While this article mainly examines the nature of this work, it also aims to describe the criticism issues that the author’s era produced regarding the jurisprudence. The eight blurbs (taqrīz) at the beginning of the work are indicative in this regard. Bureaucratic and scientific relations and controversial issues on the agenda can be understood from these blurbs. In these blurbs, some references are made to the feminist movement along with the observations concerning the status of women. When approaches handled here are combined with the informtion as to the historical roots and the phases of feminist movement, it would be possible to reach the intellectual memory of that period. Determination and analysis of Darguzīnī’s identity and status is an indispensable requirement of this study. (shrink)
