In 1754 Véron Duverger de Forbonnais published the two books of his Élemens du Commerce which, as the Avertissement stated, collected together some of the chapters the author had written for the Encyclopédie. The second edition was published in the same year with ‘quelques légères additions’. In 1765, Carlos Lemaur, a French engineer who worked in Spain from 1750 until 1785, translated the text into Spanish. The probable reason for the translation was the importance that Forbonnais attributed to the construction (...) of roads and infrastructure that enabled improved communication between the markets and an increased distribution of money to the small cities located far from big centres. The translator worked as an engineer in a number of remarkable constructions designed to enhance logistics in Spain, and shared Forbonnais’ perspective on Enlightenment principles. My analysis will focus on the translation strategies adopted by Lemaur, and on the adaptation of the source text to the target culture, following the approach taken by Theo Hermans. I will examine the equivalence between the source text and the translation, which was the result of the functionality and dynamism of the translator's technique. (shrink)

Against the backdrop of an alarming rise in authoritarianism and the crisis of liberal democracy, few would consider extoling the virtues of politics today. Yet in this lively dialogue with journalist Aude Lancelin, leading French thinker Alain Badiou argues that it is precisely through politics that humanity can still achieve its most ambitious aims. This paper presents a number of objections to the characterization of Foucault as a "eurocentric", “occidentalist” thinker. It shows how Foucault proceeds by space-time cuts while never assuming the exemplarity of the topographies he is studying. Far from seeking to affix the seal of the universal on the analyses he proposes of specified objects, he insists on the singularities of the operations he studies, of the "dark acts" on which he works. Foucault is a "eurocentric" thinker only in a purely (...) tautological sense, as he scored his research and fieldwork in a European space, which is not a presumption as to the particular value of those topographies but represents thevconditions of possibility that, at the time of his research, are his own. He has insteadvconsistently attempted to highlight the non-exportability of the conclusions he drawsvfrom his research and has applied himself to move in the field of knowledge and in hisvown methods of problematising. He remains, moreover, the one who, amongvcontemporary philosophers, emphasized with more insistance the reason for thevhistoricity of truth, a pattern that moves him away from all the common prejudicesvabout eurocentric and occidentalist “universalism”. The movies Transcendence and Her perfectly epitomize these concepts, because in the former the conscience of the scientist Will is downloaded into a computer, from which he emerges as a new monstrous entity; in the latter a computer program, a voice, so artfully interacts with man as to give the impression of a reasonable and independent human being. Didacticism, romanticism, and classicism are the possible schemata for the knotting of art and philosophy, the third term in this knot being the education of subjects, youth in particular. What characterizes the century that has just come to a close is that, while it underwent the saturation of these three schemata, it failed to introduce a new one. Today, this predicament tends to produce a kind of unknotting of terms, a desperate dis-relation between art and philosophy, together with the pure (...) and simple collapse of what circulated between them: the theme of education. Whence the thesis of which this book is nothing but a series of variations: faced with such a situation of saturation and closure, we must attempt to propose a new schema, a fourth type of knot between philosophy and art. Among these “inaesthetic” variations, the reader will encounter a sustained debate with contemporary philosophical uses of the poem, bold articulations of the specificity and prospects of theater, cinema, and dance, along with subtle and provocative readings of Fernando Pessoa, Ste;phane Mallarme;, and Samuel Beckett. While a large body of research has provided quantitative data on children’s levels of happiness, positive emotions and life satisfaction, the literature reflects a dearth of studies that analyze these dimensions from a narrative and qualitative point of view. Folk and fairy tales may serve as ideal tools for this purpose, since they are concerned with several concepts scientifically investigated by research in the field of positive psychology, such as resilience, self-realization, personal growth and meaning in life. The aim of (...) the present study was to explore children’s well-being and positive emotions using an innovative narrative approach, which involved interviews and group discussions, as well as the analysis of fairy tales written and discussed in a group context. The sample included 95 school children who were asked to report and discuss in a group setting situations or experiences which triggered positive emotions and happiness in them. Guided by their teachers and a school psychologist, they were then asked to write their own original fairy tale drawing on the positive emotions that had previously emerged. Positive emotions were found to be triggered mainly by interpersonal relationships with peers as well as with family members. Hobbies and leisure time were also strongly associated with happiness and hedonic well-being, while personal fulfilment, self-esteem and goal achievement emerged as highly significant for children. In sum, the findings suggest that this school psycho-educative intervention based on narrative strategies provided useful information on children’s well-being and yielded positive feedback, the implications and possible further applications of which are discussed. In this book a noted physiologist and neuroscientist introduces the concept of simplexity, the set of solutions living organisms find that enable them to deal with information and situations, while taking into account past experiences and anticipating future ones. Such solutions are new ways of addressing problems so that actions may be taken more quickly, more elegantly, and more efficiently. In a sense, the history of living organisms may be summed up by their remarkable ability to find solutions that avoid (...) the world's complexity by imposing on it their own rules and functions. Evolution has resolved the problem of complexity not by simplifying but by finding solutions whose processes--though they can sometimes be complex--allow us to act in the midst of complexity and of uncertainty. Nature can inspire us by making us realize that simplification is never simple and requires instead that we choose, refuse, connect, and imagine, in order to act in the best possible manner. Self-awareness represents the capacity of becoming the object of one’s own attention. In this state one actively identifies, processes, and stores information about the self. This paper surveys the self-awareness literature by emphasizing definition issues, measurement techniques, effects and functions of self-attention, and antecedents of self-awareness. Key self-related concepts (e.g., minimal, reflective consciousness) are distinguished from the central notion of self-awareness. Reviewed measures include questionnaires, implicit tasks, and self-recognition. Main effects and functions of self-attention consist in selfevaluation, escape from the (...) self, amplification of one's subjective experience, increased self-knowledge, self-regulation, and inferences about others' mental states (Theory-of-Mind). A neurocognitive and socioecological model of self-awareness is described in which the role of face-to-face interactions, reflected appraisals, mirrors, media, inner speech, imagery, autobiographical knowledge, and neurological structures is underlined. In this groundbreaking work, French legal scholar Alain Supiot examines the relationship of society to legal discourse. He argues that the law is how justice is implmented in secular society, but it is not simply a technique to be manipulated at will: it is also an expression of the core beliefs of the West. We must recognize its universalizing, dogmatic nature and become receptive to other interpretations from non-Western cultures to help us avoid the clash of civilizations. In Homo (...) Juridicus, Supiot deconstructs the illusion of a world that has become flat and undifferentiated, regulated only by supposed "laws" of science and the economy, and peopled by contract-makers driven only by the calculation of their individual interests. Such a liberal perspective is nothing but the flipside of the notion of the withering away of law and the state, promoted this time not under the banner of the struggle between classes, but rather in the name of the free competition between sovereign individuals. Supiot's exploration of the development of the legal subject-the individual as formed through a dense web of contracts and laws-is set to become a classic work of social theory. (shrink)

Haitian Creole is a unique language, as are all creole languages. Mother tongue of almost six million people—without counting those who have immigrated—it has its own particular ways of expressing in words, of making sentences and forming a discourse. However, for more than two centuries it has been excluded from many circuits of communication. The limits imposed on it have kept it from developing a creativity, at the vocabulary level as well as that of organizing a discourse that would assure (...) a function of plural communication, both oral and written. The present challenge of this long-throttled language has posed an important number of problems in linguistics, teaching, culture and politics because of new communication systems and especially because of education. The very diversity of cultures impels the economist to respect a principle of modesty when it comes to specifying the degree of universality to which the science of economics can lay claim. In considering this issue, this paper: a) criticizes the ambition of certain forms of economic thought to arrive at truths which are universal, and b) explores the modes by which contemporary economic science participates in a renewed pursuit of a universalist doctrine. It concludes that the logic of economic (...) rationality implies a representation of the world that is incompatible with the diversity of cultures. At the same time, such diversity should not be raised to the status of absolutes. Combining difference and unity is a major challenge for current economics. (shrink)

Quite a few recent models are rapidly introducing new concepts describing different levels of consciousness. This situation is getting confusing because some theorists formulate their models without making reference to existing views, redundantly adding complexity to an already difficult problem. In this paper, I present and compare nine neurocognitive models to highlight points of convergence and divergence. Two aspects of consciousness seem especially important: perception of self in time and complexity of self-representations. To this I add frequency of self-focus, amount (...) of self-related information, and accuracy of self-knowledge. Overall, I conclude that many novel concepts (e.g., reflective, primary, core, extended, recursive, and minimal consciousness) are useful in helping us distinguish between delicate variations in consciousness and in clarifying theoretical issues that have been intensely debated in the scientific literature—e.g., consciousness in relation to mirror self-recognition and language. It is widely acknowledged that human rights law and international criminal law share core normative features. Yet, the literature has not yet reconstructed this underlying basis in a systematic way. In this contribution, I lay down the basis of such an account. I first identify a similar tension between a “moral” and a “political” approach to the normative foundations of those norms and to the legitimate role of international courts and tribunals adjudicating those norms. With a view to bring the (...) debate forward, I then turn to the practices of HRL and international criminal law to examine which of those approaches best illuminates some salient aspects of the adjudication of ICs. Finally, I argue that the political approach best explains the practice. While each preserves a distinct role, HRL and ICL both establish the basic conditions for the primary subject of international law, namely the state, to legitimately govern its own subjects constructed as free and equal moral agents. Legal scholars and theorists have recently drawn a more sustained attention to the link between international human rights law (hereafter IHRL) and international criminal law (hereafter ICL). This concerns both positive and more normative accounts of the link. Whether positive or normative, the predominant approach to constructing the link is substantive. This overlap is normatively justified in similar terms by reference to a subset of moral human rights. In this paper, I offer an alternative to the substantive approach. After identifying (...) two flaws in the substantive approach (the problem of threshold and the problem of ethical neutrality), I defend what I call a structural account by focusing on duty‐holders. I start by reconstructing two structural characteristics common to IHRL and ICL qua international legal regimes: who has the authority to address violations of IHRL and ICL, and who can be liable for those violations. I then infer that public authority (functionally construed) constitutes the common structural core of IHRL and ICL. I rely on the extraterritorial application of IHRL and on the collective dimension of ICL violations to further support the argument. I finally offer an argument explaining the normative point of those structural features. I hold that IHRL and ICL (their adjudicative and liability regimes) are both necessary (but clearly not sufficient) to render this exercise of public authority legitimate to its subjects. (shrink)

In this paper, I offer an analytical and normative framework to re-visit the question of whether state parties should derogate from the European Convention on Human Rights (ECHR) in order to combat the COVID-19 pandemic via harsh ‘lockdown’ measures. It is three-pronged. First, I show that the predominant debate on the (non-)derogation question is informed by a textual approach to adjudication, which severely limits the analytical and evaluative horizon for addressing the issue. Most importantly, it cannot address one salient fact (...) about the effects of lockdown measures, namely their highly disproportionate effects on vulnerable groups and minorities. Second, I argue that proportionality assessment should be the basis for determining whether state parties ought to derogate or not. This is because proportionality’s very purpose is in part to track the effects of state interferences on minorities and vulnerable groups by measuring the disproportionate burden imposed on them. It is also because proportionality assessment has very different requirements between limitation clauses built into the relevant Convention articles (e.g. Article 5, Articles 8–11) and the derogation clause (Article 15) under the ECHR. Surprisingly, while the emerging literature almost always mentions proportionality as an important component of the analysis, it does not investigate the extent to which each regime (derogation or limitation) better performs it, and why. Third, I draw from the philosophical literature on the ‘right to justification’ to clarify the egalitarian and justificatory function of proportionality. Unlike derogation, limitation clauses have a much higher and systematic requirement of justification, which makes the case for non-derogation clearer and stronger. (shrink)

been recently proposed (Morin, 2003; 2004). The model takes into account most known mechanisms and processes leading to self-awareness, and examines their multiple and complex interactions. Inner speech is postulated to play a key-role in this model, as it establishes important connections between many of its ele- ments. This paper first reviews past and current references to a link between self-awareness and inner speech. It then presents an analysis of the nature of the relation between these two concepts. It is (...) suggested that inner speech can inter- nally reproduce and expand social and physical (ecological) sources of self- awareness. Inner speech can also create a psychological distance between the self and mental events it experiences (thus facilitating self-observation) it can act as a problem-solving device where the self represents the problem and self-information the solution, and can label aspects of one’s inner life that would otherwise be difficult to objectively perceive. Empirical evidence supporting the role of inner speech in self-awareness is also presented. (shrink)

A single, fairly simple proposition lies at the heart of the present contribution, viz. that the development of early-modern literature on international law should be regarded as a specific form of the early usus modernus during the second half of the sixteenth century and the first half of the seventeenth century.In Section 1 that general proposition and some of its ramifications will receive some further explanation. First, the main characteristics of usus modernus will be set out, and, subsequently, their applicability (...) to early-modern literature on international law will be outlined. In addition, the question should be raised, what purpose the characterisation of that literature as part of the more general usus modernus may serve. These considerations may inevitably appear somewhat abstract. Section 2 will therefore aim to provide a particular illustration, based on two contemporary works on the law of naval warfare, viz. A.
