ObjectiveAlthough childhood adversity can have lasting effects into later life, positive adaptations have also been observed, including an increased tendency toward prosocial behavior. However, little is known about the link between childhood adversity and later life prosocial behavior, with a particular scarcity of research on intrafamilial childhood adversity. Therefore, this study aimed to examine older adult's experiences of childhood adversity and identify mechanisms linked to prosocial behavior. Two adversity contexts were compared to explore individual, as well as broader cultural and (...) contextual mechanisms linking childhood adversity and later life prosocial behavior.MethodSemi-structured interviews were conducted with N = 29 Irish adult survivors of childhood adversity: n = 12 intrafamilial survivors, n = 17 institutional survivors. Interviews were analyzed using the framework analysis method, with reference to the conceptual model of altruism born of suffering.ResultsFive themes were identified on prosocial mechanisms, with three themes in both survivor groups, and two group-specific themes.ConclusionResults identified motivational processes and volitional factors linked to later life prosocial behavior. Connections to caring roles, support, and social norms in childhood, as well as the need for a sense of purpose and meaning from the adversities in adulthood, highlight potential targets for psychotherapeutic intervention to promote prosocial responding and positive adaptation for childhood adversity survivors. ABSTRACTUsing a frame analysis approach this paper examines how The Irish Times and the Irish Independent portrayed public sector workers during Ireland's economic crisis. Using a sample of coverage from 2009 and 2010 it discusses the five media frames identified in this analysis, three of which were hegemonic and two of which were counter hegemonic. In this paper, I argue that coverage of the public sector by each newspaper was imbalanced and inaccurate. This paper also finds that both newspapers (...) were strong advocates of austerity cutbacks in the public service as a solution to Ireland's financial crisis, frequently representing this idea as ‘fact’ while simultaneously delegitimising those opposing this viewpoint. This article investigates the textual strategies with which Maeve Murphy's Silent Grace addresses viewers in contemporary Northern Ireland. Borrowing Eric Santner's concept of `narrative fetishism', the analysis examines how the film's representation of the past obscures the historical realities experienced by female political prisoners in Armagh jail in the late 1970s and early 1980s. From this standpoint, its ethical relation to historical `truth' and responsibilities to its local audience are debated.

This article explores the context within which abortion law and discourse in Northern Ireland must be situated and understood, relying in part on post-modern insights into the wider and long-term implications of feminists engaging law and by examining the strategies employed in Northern Ireland around the issue of abortion. In 2001,the Family Planning Association (Northern Ireland) took legal action to force the devolved government to defend at a procedural level the unequal and uncertain form of common law (...) abortion regulation for Northern Ireland. The authors examine the strategy of this review as well as the response of the High Court, suggesting that while it may begin to challenge the legitimacy of abortion law, feminists and pro-choice advocates must prepare for challenges beyond that, the greatest being the cultural challenge. The courts, legislators and other public and political institutions(including the Northern Ireland Human Rights Commission and the Northern Ireland Women's Coalition) consistently explain the law's lack of provision for women with reference to the `pro-life' majority views of Northern Irish people. The authors question the legitimacy of this claim in a cultural climate of intimidation against the expression of alternative views. Women will continue to be marginalised and devalued in this debate if the silencing of the pro-choice community and bodies responsible for protecting human rights is not redressed. A case is therefore made for a reconceptualisation of the abortion debate from the perspective of women's agency, which, alongside litigation and other strategies, is necessary to overcome the cultural censure that currently prevents meaningful dialogue. The health of a nation tells much about the nature of a social contract between citizen and state. The way that health care is organised, and the degree to which it is equitably accessible, constitutes a manifestation of the effects of moments and events in that country's history. Research around health inequalities often focuses on demonstrating current conditions, with little attention paid to how the conditions of inequality have been achieved and sustained. This article presents a novel approach to inequalities (...) research that focuses on examining powerful historical discourses as legitimising processes that serve to sustain unequal conditions. The use of this Foucauldian historical genealogical approach in a study of the Irish health care system is explored and proposed as a novel approach to the research of health inequities. (shrink)

The coronavirus pandemic has impacted health care, economies and societies in ways that are still being measured across the world. To control the spread of the virus, governments continue to appeal to citizens to alter their behaviours and act in the interests of the collective public good so as to protect the vulnerable. Demonstrations of collective solidarity are being consistently sought to control the spread of the virus. Catchphrases, soundbites and hashtags such as ‘we’re all in this together’, ‘stronger together’ (...) and other messages of unity are employed, invoking the sense of a collective struggle. However, this approach is fundamentally challenged as collectivist attitudes run contrary to the individualism of neoliberal ideology, to which citizens have been subjected. This paper argues that attempting to employ the concept of solidarity is inherently challenged by the deep impact of neoliberalism in health policies and draws on the work of Durkheim to examine the concept in a context in which health care has become established as an individual responsibility. The paper will argue that a dominant private-responsibility model and an underfunded public system have eroded solidarity weakening its effectiveness in generating concerns for the collective. Background Several jurisdictions, including Singapore, Australia, New Zealand and most recently Ireland, have a public interest or public good criterion for granting waivers of consent in biomedical research using secondary health data or tissue. However, the concept of the public interest is not well defined in this context, which creates difficulties for institutions, institutional review boards and regulators trying to implement the criterion. Main text This paper clarifies how the public interest criterion can be defensibly deployed. We first explain (...) the ethical basis for requiring waivers to only be granted to studies meeting the public interest criterion, then explore how further criteria may be set to determine the extent to which a given study can legitimately claim to be in the public interest. We propose an approach that does not attempt to measure magnitude of benefit directly, but rather takes into account metrics that are more straightforward to apply. To ensure consistent and justifiable interpretation, research institutions and IRBs should also incorporate procedural features such as transparency and public engagement in determining which studies satisfy the public interest requirement. Conclusion The requirement of public interest for consent waivers in secondary biomedical research should be guided by well-defined criteria for systematic evaluation. Such a criteria and its application need to be periodically subject to intra-committee and intra-institution review, reflection, deliberation and amendment. (shrink)

This study examines the methods students use to cheat on class examinations and suggests ways of deterring using an international sample from Australia, China, Ireland, and the United States. We also examine the level of cheating and reasons for cheating that prior research has highlighted as a method of demonstrating that our sample is equivalent to those in prior studies. Our results confirm the results of prior research that primarily employs students from the United States. The data indicate that (...) actions such as having multiple versions of the examination and scrambling the questions on these versions would deter cheating. In addition, given the increased level of cheating and students' increased perception of the social acceptability of cheating in college, the data provided by our international sample also suggest that some relatively simple precautions by instructors could dramatically reduce the level of cheating on in-class examinations. A woman from the Republic of Ireland has successfully challenged the country's restrictive abortion legislation at the European Court of Human Rights. 1 The woman was in remission from cancer and believed that she was at increased risk of relapse due to her unintended pregnancy. She believed that continuing with the pregnancy would have put her life at risk. She travelled to England for an abortion in 2005 and subsequently experienced medical complications when she returned to Republic of (...) class='Hi'>Ireland. Abortion in the Republic of Ireland is permitted if the life of the pregnant woman is at risk, but given the uncertainty around interpreting the legislation and the fear of criminal sanctions, the provision is not always effective in practice. The woman argued that her right to an abortion had been denied because there was no law or procedure through which she could have her clinical entitlement established. The ECtHR was unanimous that her right to private and family life had been violated but did not uphold her challenge under Articles 2, 3 and 14. The woman was joined by two other women in the challenge but the other women were unsuccessful as their circumstances differed; their lives had not been at risk if they had continued with their pregnancies. 2The Court concluded ‘that neither the medical consultation nor litigation options, relied on by the Irish government, constituted effective and accessible procedures which allowed [her] … to establish her right to lawful abortion in Ireland’.3At the time of writing, the Irish government was considering how to implement the judgement.Review of arm's-length bodiesAs previously reported here, in July 2010 the UK Government announced plans to reform and abolish a large number of arm's-length bodies. 4 …. The Family Planning Association Northern Ireland (F.P.A.N.I.) has recently been successful in holding the state accountable for its duty to safeguard women’s reproductive health and welfare, and clarify the circumstances in which abortion is lawful. By demanding that the Minister for Health investigate abortion provision and produce abortion guidance, F.P.A.N.I. hope to improve the quality of abortion services and alleviate the situation of those women who are legally entitled to abortion in Northern Ireland but cannot access it there. (...) This action has challenged a public failure which impacts most negatively on those women who cannot easily escape its effects. Although the case succeeded in shaming the state for such a failure, the judicial review strategy could not challenge the legal ethos which denies women a say over their reproductive lives. This case commentary argues that pro-choice strategic litigation needs to positively and generally assert women’s reproductive rights at the same time as it seeks to accommodate the needs of the most vulnerable. The jurist A. V. Dicey’s study of the Law of the Constitution (1885) has been since its publication the dominant analysis of the British constitution and the source of orthodoxy on such subjects as parliamentary sovereignty and the rule of law. This canonical status has obscured the originality of Dicey’s ideas in the history of legal and political thought. Dicey reworked the traditional idea of sovereignty into two separate concepts – legal and political sovereignty – in order to square the (...) common law notion of the sovereignty of parliament with the democratic idea of the sovereignty of the people. He forged a new concept – ‘the rule of law’ – to explain the legal basis of liberty in common law countries in a manner that was both Benthamite and constitutionalist. Finally, he provided a democratic and anti-federalist rationale for maintaining the Union of Great Britain and Ireland. This majoritarian, centralist and utilitarian constitutionalism has been one of the most enduring products of Victorian scholarship. This article seeks to recover it in its original context and, in so doing, to show the value of reintegrating legal thought into the mainstream of modern British history and the history of political thought. The decision of the House of Lords in Gillick v West Norfolk Area Health Authority carved out a safe space for competent minors to confidentially access sexual and reproductive health care and advice in the UK. Ireland is one of the few common law jurisdictions that has not endorsed Gillick or a similar mature minor doctrine, nor has it securely legislated for the right to consent of those aged 16 and 17 years. The legal lacuna created by this deficiency (...) has left young persons in Ireland seeking sexual and reproductive healthcare, and the clinicians who provide this, in a challenging place. While this void has been partially filled with policy statements by bodies such as the Irish College of General Practitioners and the Health Service Executive, nonetheless the legal shortcomings leave both a sense of insecurity, and real world difficulties for adolescents seeking to access to sexual and reproductive healthcare. VP’s Plato (...) is in a way the only one I have known. When I hear the terms ‘aporia’, ‘whether-or-not’, and ‘ti esti’, they ring in my ears like bells. In this double review, I hope to impress upon the reader the unique importance of this interpretation of Plato, both for the history of philosophy and philosophy more broadly, and thereby to give a sense of its melody and resonance. The case of Vo v. France represents the latest phase of the European Court of Human Rights’ thinking on the scope of Article 2 of the European Convention on Human Rights (the right to life) in relation to foetal life where a foetus had been lost owing to a medical accident. The Court by a majority decided that, “even assuming” Article 2 applied to the instant case (albeit to the life of the pregnant woman rather than that of the foetus), (...) it had not been violated. While the facts in Vo were extreme and exceptional, the Court will shortly hear the case of D v. Ireland concerning access to abortion for foetal anomaly, an application made under Articles 3, 8, 10 and 14 of the European Convention. If the case of D were declared admissible, the Court would then have to consider whether a denial of access to abortion for foetal anomaly constitutes inhuman and degrading treatment contrary to Article 3, or an interference with a pregnant woman’s right to respect for private life under Article 8 (and if so, how the doctrine of the margin of appreciation applies). The Grand Chamber precedent of Vo displays ambivalence about whether Article 2 should apply to foetal life, and its resort to the “even assuming” formula spared Member States the difficulty of having to justify their various abortion regimes, by reference to this Article. It remains to be seen whether in a case like D that is directly concerned with abortion, the Court will take a more definite stance on the correct balance to be struck between the State’s interest in protecting foetal life and the Convention rights of pregnant women. From Kosovo to Québec, Ireland to East Timor, nationalism has been a recurrent topic of intense debate. It has been condemned as a source of hatred and war, yet embraced for stimulating community feeling and collective freedom. Nach einer langen Pause wird das Thema des religiösen Gefühls in Albert Révilles liberaltheologischem Projekt wieder aktuell. Ausgehend von Schleiermachers Voraussetzungen hoffte Réville dadurch die Apologetik zu modernisieren wie auch den Weg zum theologischen Inklusivismus zu bahnen. (...) Sein Sohn Jean, ebenfalls Theologe, neutestamentlicher Forscher und Sentimentalist, arbeitete mit dem Vater zusammen an der Institutionalisierung des Faches Religionsgeschichte in Frankreich. The article shows that Borisov’s direct solution to the problem of skepticism about meaning using a special type of introspection is associated with the assumption of the agent’s direct access to their own consciousness. This assumption has two complicating consequences: the analogy with Moore’s paradox and the Platonic concept of meaning. It is also shown that direct access to meaning as a way of Borisov’s direct solution of the skeptical paradox significantly uses the performativity of the speech act, narrowing the (...) scope of analysis of the original problem. The little-studied problem of distinction in the analysis of the skeptical paradox of meaningful and formalized mathematics is noted. (shrink)

Sexuality education is fundamental in higher and tertiary education institutions (HTEIs). Evidence suggests that its effective education is through translations into the first language of learners. However, in global and multilingual cultural communities such as HTEIs, the foundations for these translations are still a researchable area. Notably, in HTEIs adolescents, young adults and adults co-exist and therefore, any translations must be toned to balance across these groups. The aim of this study was to establish strategies that could enable sexuality educators (...) to effectively transfer information that is steeped in indigenous language, religious and cultural meaning without precipitating stigma and taboo issues. The study setting was the National University of Science and Technology where a cross section of indigenous cultures, languages and religions co-existed with other global cultures. A University Community-based Participatory Research (CBPR) methodology was administered by the researchers using a Delphi research approach to students and staff. Multilingual, multilayered, multireligious, and multicultural nature of the setting presented serious challenges that compromised the prevention of stigma and taboo issues when dealing with sexuality education. We recommend that the strategy to present sexuality education in indigenous languages to the generality of HTEIs population should, in the first instance, involve systematic identification of appropriate interventions that are religious, cultural, and language-specific. Recently the CJEU decision in the case of ‘Ewa Glawischnig-Piesczek v. Facebook Ireland Limited’ has raised the issue of the transcultural/trans-territorial signification of hate speech and hate crimes. Taking a cue from this decision and the related semiotic/legal implications, the paper proposes an analysis of the semio/pragmatic conditions for the production of performativity inherent in hate speech across different cultural universes of discourse. Given that web-based digital communication is global—at least, potentially—regardless of any spatial/political compartmentalization, it crosses different semio-cultural (...) circuits. This trans-spatiality implies transcultural crossings that can multiply and even transfigure the semantic implications of the original signifier and the related prognoses of ‘semantic effectiveness.’ Cultural boundaries therefore may function as a kind of ‘horizon of events’ for hate speech and, more inclusively, all linguistic acts and their legal signification/classification. The question then arises regarding whether and to what extent the performativity of hate speech is able to withstand the variation of cultural boundary conditions. Insofar as cultures are universes of experience, the issue to be investigated broadens, and ends up invoking the question of whether or not the production of performativity implicitly presupposes and tacitly epitomizes the semio-pragmatic implications/consequences (or, in Peircean terms, ‘bearings’) coextensive with cultural universes of experience. Were this the case, it would seem to call into question the very possibility of ‘making things only with words,’ or more explicitly, the alleged meaning of ‘linguistic acts.’. (shrink)

Wedin considers the relation between the ontological commitment in the Categories and the semantical theory of underlying ontological configurations for standard categorical statements. According to Wedin, Aristotle's fourfold division of beings, which divides things according to whether they are, or are not, said of, and/or present in a subject, is a meta‐ontology that is concerned with beings per se, i.e. the fundamental things that are. Wedin explains that the primacy of c‐substance involves an asymmetry in the relation between c‐substance and (...) everything else, or between the substantial and the nonsubstantial. This is because there is an ontological dependence of non‐substances, and also of secondary substances, on substances: everything is either said of, or in, primary substance. The argument of this chapter, then, is that the world of the Categories is a world of individuals: all ontological relations needed for semantics can be accommodated by appeal to individuals only. Wedin argues that Aristotle makes form the substance of c‐substances because it is the essence of the c‐substance. Much of this chapter consists of a careful examination of a passage in Metaphysics Zeta 4, which Wedin calls the ‘New Primacy Passage’, that is crucial to Wedin's overall thesis, because here Aristotle appeals to a notion of definitional primacy, as opposed to the ontological primacy of the Categories. Z.4 focuses on this claim that form must be essence: Wedin argues that essence (...) is a certain kind of form, a form of a genus ; this does not mean ‘species’, as some commentators have thought. This is because the species is a combination of form and matter, whereas the genous eidos, Wedin argues, is the formal part only of the definition that applies to the thing. Wedin offers an interpretation of Metaphysics Zeta 13, a very important and difficult chapter, where Aristotle apparently denies that substance is a universal, having, on most accounts, already claimed that form is substance, and that form is a universal. This interpretation of the argument of Z.13, Wedin argues, threatens the possibility of attaining a definition of substance, and places in doubt what has gone before in the treatise. According to Wedin, what Aristotle is concerned with in Z.13 is not the (...) denial that substance is a universal but rather with the denial that anything predicated universally of a c‐substance is the substance‐of the c‐substance, which Wedin calls ‘Weak proscription’. In Wedin's account of Z.13, then, Aristotle is continuing to pursue issues first raised in Z.10–11 that have to do with the relations between form and definition, and form and the universal. Wedin also argues that the dilemma at the conclusion of Z.13, regarding the definability of substance, is resolved in Z.16, with the notion of ‘Dual Complexity’, according to which the parts of a form exist potentially in the form, just as the parts of the c‐substance exist potentially in the c‐substance. Wedin addresses the debate over whether nonsubstantial individuals, that inhere in a subject but are not said of a subject, i.e. accidents, such as the pallor of Socrates, are nonrecurring particulars or a kind of determinate universal. Wedin examines the secondary literature on this topic and divides it into two schools of thought, determined by the contributions of J.L. Ackrill and G.E.L. Owen. According to Ackrill, individuals in non‐substance categories are particular to the substance they are in; Owen critiques Ackrill's (...) view, and proposes that these items can recur in more than one subject and hence are a sort of universal. Wedin finds Owen's thesis unsatisfactory, even after supplementing it with an improved version due to Michael Frede; instead, Wedin argues for a revised version of Ackrill's interpretation of nonsubstantial individuals as nonrecurrent particulars. According to Wedin, Aristotle is committed to individuals only—e.g. to Socrates and to the particular bit of pallor in him: this conclusion has an important bearing on the ontological status of individuals and on the primacy of substance to nonsubstantial items. Wedin considers the problem of the compatibility of the Categories account of primary substance with the theory of substantial form of the Metaphysics. Wedin collects from the secondary literature the most important arguments for incompatibilism, and offers some proposals for restoring their harmony. While admitting the evident differences in the way Aristotle treats the question of substance in each treatise, Wedin is keen to argue that these differences are not sufficient to conclude that the treatises are incompatible. Wedin singles out (...) for particular attention, and criticism, Michael Frede and Gunther Patzig's account of Metaphysics Zeta, according to which the primary substance of the Metaphysics and the basic subject of predications is the form. Wedin considers two ‘philosophical’ arguments and one ‘Aristotelian’ argument for the subjecthood of forms, and argues that the textual evidence does not support the claim that form is the subject of accidents. Chapters 10 and 11 are critical to the argument of Metaphysics Zeta: these chapters are concerned with the purification of form. Z.10 introduces the apparatus of part and whole and consists of an argument to the end that form and its parts have priority over the other internal structural components of c‐substances, i.e. matter and the compound of form and matter; while in Z.11 Aristotle argues that form and its parts cannot involve any admixture of matter. Wedin argues that the (...) causal role of form presupposes its purity: if form is to explain why a certain portion of matter constitutes a c‐substance of a given kind, then matter—whether this latter is understood as functional, or remnant matter—cannot already be contained in the form. This is the ‘purity thesis’, as Wedin calls it: matter cannot be included in the definitions of natural organisms, Wedin points out, because that would make the explanandum a part of the principle that explains it. Wedin also argues that form must be sufficiently complex to provide definitions of the natures of particular compounds, which are complex, even though form itself is a kind of universal. (shrink)

In the Metaphysics, Aristotle often says that ‘form is substance’: in this chapter, Wedin argues that ‘substance’ in this context means the ‘substance‐of’ c‐substances. Wedin begins by examining Aristotle's use, and retention, of the framework of the Categories in Metaphysics Zeta, before turning to discuss Z.3, which is crucial to understanding the relation between the Categories and Metaphysics theories of substance, because it is usually thought that here Aristotle departs from the substance of the Categories. Wedin denies that Z.3 involves (...) a rejection of the Categories subjecthood criterion for primary substance: Aristotle rejects only the claim that one thing is the substance of another simply if it is the primary underlying subject of the other. Wedin argues that in Z.3 Aristotle introduces the idea of the ‘substance‐of’ a thing, and identifies as candidates for the substance of c‐substances the internal structural components form, matter, and the compound of form and matter. Wedin discusses Aristotle's claims in Metaphysics Zeta 6 that the essence of a thing is to be sought among its per se attributes, and that each thing that is primary and spoken of per se, e.g. primary substance, is the same as its essence. Wedin argues that the Zeta 6 Thesis, i.e. that the essence of a thing is the thing's immediate essence, is a crucial requirement of the explanatory role of essence as the substance of c‐substances. According to Wedin, (...) Aristotle introduces this requirement in order to establish that a thing's essence cannot depend on another essence. Form must be the essence; if form cannot explain the nature of the thing of which it is the form, there would be the threat of a regress of explanatory forms. At the end of the chapter, Wedin considers the problem that the identity of a thing and its essence is a requirement that can be met by non‐substance items, but he denies that this leads to a dilution of the conception of substance. This essay explores the aspects of the Aristotelian psuchē that accounts for its contemporary appeal. The poverty of the notion of the mind is discussed. The superiority of the psuchē over the mind is emphasized.

The research is devoted to justification of the interdisciplinary approach in the study of consciousness. Studying consciousness as a phenomenon is a very divergent project, the mystery of its nature and appearance makes different ways of studying consciousness possible. Besides, consciousness is an umbrella term which may be interpreted differently in different contexts. Various approaches to comprehension of consciousness have been developed nowadays in Philosophy, Psychology, Biology, Medicine, Neurosciences, Sociology, Cognitive and Computer Sciences, Linguistics and a number of other research (...) fields. In the end of the 1980s one can notice an exceptional growth of interest in the problem of consciousness both in Philosophy and Science. The works by Bernard Baars, Daniel Dennett, Roger Penrose, Francis Crick and Christopher Koch, David Chalmers have appeared in these years. They outlined the main approaches to the study of consciousness and demonstrated that study of consciousness became an interdisciplinarity research. The research discusses the features of the phenomenon of consciousness and outlines the main theoretical issues, the most relevant of which are the “hard problem” of consciousness, the problem of mind and body, the problem of “the explanatory gap”, the question of the primacy of the brain in relation to consciousness, the place of consciousness in the modern scientific paradigm, changes of the ethical and worldview interpretation in connection with artificial intelligence, neurochips and neural network. Based on the complexity and multidimensionality of the research field associated with the problem of consciousness, the variety of approaches to studying this problem in Philosophy and Science, the controversial character of the questions raised, and the heated discussion among researches, the author concludes that interdisciplinary studies of consciousness have the greatest heuristic possibilities today. KeatingA historically conversant reader interested in the current state of discourse regarding Catholicism and American politics will find a good amount of familiar discord. He will discover, for example, that the life issues continue to bedevil. Can a Catholic vote in good conscience for an abortion-rights candidate over a pro-life competitor if that candidate is more supportive of other (...) policies in line with Catholic Social Teaching? This issue has, of course, been with the American Church for some time now, even if it has taken on renewed urgency given the coincidence of the overturning of Roe v. Wade with the presidency of Joseph Biden, the second Roman Catholic to hold that office and a recent convert to pro-choice stridency. The action of the Supreme Court and the battles within the various states will ensure that abortion remains at the political heart of American Catholicism for years to come. One can say something similar about other issues, such as immigration, gun control, and economic justice. None of this will be found to be particularly surprising. The same cannot be said, however, of the return of a more fundamental question, one thought to have been settled since the mid-1960s. That question is whether Roman Catholicism and American liberal democracy are incompatible to the extent that Catholics ought to seek, if possible, another constitutional arrangement, one more friendly to the Catholic cause.Our reader would be familiar with the standard narrative that, while the existence of a medieval Church in a modern polity that upholds religious freedom had been a matter of concern since the dawn of the Republic, it [End Page 991] became serious only in the first half of the twentieth century as the number of Catholics and their influence grew. Until that time, American bishops, such as Archbishop John Ireland (1815–1918), made a special point of speaking publicly on the benefits of American freedom for the Church, just as they made clear that Catholics could be as patriotic as any other citizen. If there were tensions, they came primarily from anti-Catholic bigotry and governmental overreach. Things changed, however, when the point at issue was no longer primarily a religious one of Catholic believers infecting their Protestant neighbors with erroneous doctrine, but rather the threat so many Catholics posed to the fate of American freedom itself. In a postwar America concerned with the spread of Soviet communism, Paul Blanshard found a ready audience for his scholarly anti-Catholic diatribes, American Freedom and Catholic Power (1949) and Communism, Democracy, and Catholic Power (1951).1 Without much difficultly, he pointed to various statements of Gregory XVI and Pius IX condemning the separation of Church and state, the freedom of religious conscience, and democracy as the best governmental form. To top things off, he had Leo XIII's Testem Benevolentiae, an 1899 letter to the Cardinal Archbishop James Gibbons of Baltimore, warning him and his fellow bishops not to speak of the constitutional arrangement of the United States as a political ideal. While Leo had positive things to say about the American system, his admonition followed the traditional line: while constitutional protections of religious freedom are necessary when Catholics are in the minority, the ideal situation is a state that officially confesses and supports the Catholic religion. Of more recent vintage, Blanshard could quote the response of America's best-known Catholic theologian, Monsignor John A. Ryan, to the question of whether non-Catholics would be permitted to practice their religion in this ideal state:If these are carried on within the family, or in such inconspicuous manner as to be an occasion neither of scandal nor of perversion to the faithful, they may be properly tolerated by the State,... Quite distinct from the performance of false religious worship and preaching to the members of the erring sects, is the propagation of the false doctrine among Catholics. This could become a source of injury, a positive menace, to the religious welfare of true believers. Against such an evil they have a right of protection by the Catholic State...
