During more than a century scholars have argued that the translatio vetus of De sensu can be dated to the first decade of the 13th century or to the 12th century. My investigation of the manuscripts which contain the translatio vetus of De sensu and my survey of the earliest references to De sensu in the Latin West reveals that there is no evidence that this translation was made during the 12th century. The absence of De sensu in 12th century (...) manuscripts and the absence of references to De sensu in treatises of the late 12th and early 13th century could indicate that the translatio vetus was only made at the beginning of the 13th century. If one assumes that the translation of De sensu was made much later than the translations of De anima and De memoria by James of Venice, this could help explain why in the earliest tradition, it is not De sensu but De memoria that follows on De anima. However, we cannot exclude the possibility that the translatio vetus of De sensu already existed during the 12th century, but was not used because scholars were more interested in the other newly translated Aristotelian works or because the translation of De sensu was too difficult to understand. The fact that the 13th- century manuscripts transmit a text that is strongly corrupted and contaminated could indicate that the tradition started much earlier, during the 12th century. De generatione stelllarum, which can possibly be dated before 1225, contains several citations from the translatio vetus of De sensu. It could be the earliest evidence of the use of the translation of De sensu. The anonymous De potentiis anime et obiectis, written by a theologian between 1228 and 1232, is the earliest work that can be dated with certainty and contains a quotation from De sensu. From the 1240s onwards, De sensu was widely commented on and used in treatises on the soul and in encyclopaedic works. Adam of Buckfield’s commentary on De sensu seems to have been very influential and deserves further study. (shrink)

This joint response to the roundtable takes the form of a written dialogue, based on longer conversations via video link and instant messaging. The written dialogue seems an especially apt format for this response, so interconnected is it with the traditions of utopian thinking from Plato onward, and one which moreover has much to do with utopian heuristics.

Granted, our object of inquiry may look beyond the present toward what Ruth Levitas terms the Imaginary Reconstruction of Society, but we are still workers in what Darren Webb calls the “corporate-imperial” university.1 Webb argues that within the university we can at best (...) protect “bolt holes, breathing spaces, and places of refuge” that can function as “fleeting, transitory, small-scale experiences of utopian possibility.” As academics, our greater value to utopian politics therefore involves using our “knowledge and resources... in the service of a collaborative process of memory- and story-making, pulling together disparate inchoate dreams and yearnings in order to generate a utopian vision that can help inform, guide, and mobilize long-term collective action for systemic change.”2 Such work uses resources and the products of labor within the academy in the service of ends beyond and at times against it. In other words, utopianism within the academy is necessarily complicit in the academy’s constitutive material relations, but it can also be oppositional in intellectual and—more importantly—activist senses to the academy’s ideological form. In other words, whether or not a given [End Page 517] project in the field of utopian studies is politically utopian does not depend on its material basis (i.e., how it is funded) so much as its content, in the senses of both the work that it does and the ways in which it captures and mobilizes available resources. Hence it is possible to imagine both regressive and emancipatory research projects in our field that capture or co-opt additional resources, including both internal and external funding. It is, however, a mark of emancipatory projects that they will use these resources to the ends Webb describes.Implicit in Webb’s argument is an acceptance that politically useful utopian work should be socially engaged beyond the confines of the university campus. However, engaging in utopian politics from within inegalitarian university structures (via what is institutionally termed “outreach” and “engagement” work) should be pursued with caution. Even researchers and educators acting in good faith can easily end up exploiting or causing damage to social movements, support groups and activists. Good allyship and effective support cannot be reduced to institutional mechanisms like ethics committee compliance or equality, diversity and inclusivity (EDI) initiatives, even when these go beyond “lip service” to become meaningful acts.3 For projects involving external collaborators with a connection to the sort of “long-term, collective action” Webb describes, research design must walk a tightrope between being supportive of utopian politics beyond the university and responding to instrumental pressures within it.Here I suggest as an academic field utopian studies is at least a little special as it mediates dialectically between theory and practice at one level while developing a conceptual framework of the dialectic between theory and practice at another. Within what Richter et al term “the paradox of universities as colonizing and liberatory spaces for community engagement and activism” the utopian method is well placed to ask questions about how we engage with the given conditions of the academy, including competitive research funding grants.4 I begin below with a discussion of the relationship of theory and academic work to the social with reference to utopian theory and then apply this to questions about our wider complicity within a discursive regime I term “academic excellence.” I argue this regime is central to the “prestige economy” upon which some of the structural inequalities of our sector are based. I conclude by suggesting that working within the constraints of the given while remaining orientated toward utopian politics in an ethical manner requires close attention to how we navigate the relationship between utopian theory and political practice. Criminologists have long acknowledged the link between a number of cognitive deficits, including low intelligence and impulsivity, and crime. A new wave of research has demonstrated that pharmacological intervention can restore or improve cognitive function, particularly executive function, and restore neural plasticity. Such restoration and improvement can allow for easier acquisition of new skills and as a result, presents significant possibilities for the criminal justice system. For example, studies have shown that supplements of Omega-3, a fatty acid commonly found in (...) food such as tuna, can decrease frequency of violent incidents in an incarcerated population. Research has also begun to explore the use of selective serotonin reuptake inhibitors to reduce impulsivity in some violent offenders. However, there are significant legal and ethical implications when moving from dietary supplements to prescription pharmaceuticals and medical devices for cognitive intervention. This paper will explore the legal and ethical issues surrounding the use of pharmacological intervention on prisoners as an effort to reduce crime and recidivism. (shrink)

I call the Particular Problem of Hell the problem of explaining why God allows a certain set of created persons to populate hell, as opposed to allowing some other set of created persons to do so. This paper proposes a solution to PPH on behalf of proponents of Divine Universal Causality — the view, roughly, that God causes everything distinct from himself to exist at any time it exists. Despite initial appearances, I argue, proponents of DUC can adopt a version (...) of the popular approach to the Problem of Hell sometimes called the Choice Model. My proposal is based upon Eleonore Stump's Thomistically-inspired notion that our wills can enter a state of "quiescence" with respect to a given option. While proponents of DUC will, I argue, most likely find Stump's own quiescence-based solution to PPH unacceptable, there is a way of modifying her approach that renders it compatible with God's causing everything distinct from himself, including the free choices of his creatures. This paper offers a novel interpretation of the nature and role of logical argumentation in Aristotle’s natural philosophy. In contrast to the standard domain interpretation, which makes logikôs argumentation the contrary of phusikôs, relying on principles drawn from outside the domain of natural science, I propose that the essential or defining feature of logikôs argumentation is the use of principles that are general relative to the question under investigation. Deep thoughts leave a mucal snail trail of what was tabular-seeming about our bodily situation, our environs, our friends, our experiments and our nourishment. Especially in this current age of 露 露 and 娜娜 (Lulu and Nana), our first officially public transgenic kindred, the question becomes, ‘who are these free-living divergences and what does it mean to be the uber-ding beyond geoengineering’s capabilities?’. A more ethical economic system is now possible, one that rectifies the crisis spots of our current downturn while balancing the injustices of extreme poverty and wealth. Adam Arvidsson and Nicolai Peitersen, a scholar and an entrepreneur, outline the shape such an economy might take, identifying its origins in innovations already existent in our production, valuation, and distribution systems. Much like nineteenth-century entrepreneurs, philosophers, bankers, artisans, and social organizers who planned a course for modern capitalism that was more economically (...) efficient and ethically desirable, we now have a chance to construct new instruments, institutions, and infrastructure to reverse the trajectory of a quickly deteriorating economic environment. Considering a multitude of emerging phenomena, Arvidsson and Peitersen show wealth creation can be the result of a new kind of social production, and the motivation of continuous capital accumulation can exist in tandem with a new desire to maximize our social impact. Arvidsson and Peitersen argue that financial markets could become a central arena in which diverse ethical concerns are integrated into tangible economic valuations. They suggest that such a common standard has already emerged and that this process is linked to the spread of social media, making it possible to capture the sentiment of value to most people. If D commits a wrong against V, D typically incurs a corrective duty to V. But how should we respond if V has false beliefs about whether she is harmed by D’s wrong? There are two types of cases we must consider: those in which V is not harmed but she mistakenly believes that she is those in which V is harmed but she mistakenly believes that she is not. I canvass three views: The Objective View, The Subjective View and (...) The Mixed View. The Objective View holds that V’s claim depends on the correct account of harm, rather than her false beliefs, and so D has a duty to offer damages to V in but not in in order to compensate her. The Subjective View holds that, for broadly anti-perfectionist reasons, V’s claim depends on her sincere beliefs, even if they are mistaken, and so D has a duty to compensate V in but not in. The Mixed View holds that we should defer to her beliefs in but not in, so D has a duty to compensate her in both cases. In this article, I argue that we should accept The Mixed View. (shrink)

In a recent paper, Selim Berker develops an abductive argument against practical reasons for belief that exploits an alleged difference between epistemic and practical reasons. According to Berker, epistemic reasons for belief balance to suspension. If I have equally strong epistemic reasons to believe and disbelieve some proposition, I lack sufficient reason either to believe or disbelieve it. Rather, I have decisive reason to suspend judgment. In contrast, practical reasons balance to permission. If I have equally strong practical reasons to (...) φ or ψ, I have sufficient reason to do either. Given this difference, Berker argues that defenders of practical reasons for belief cannot offer a plausible explanation of how practical and epistemic reasons interact in order to yield all-things-considered normative verdicts. In this essay, I defend a non-interactionist “pure” form of pragmatism against Berker’s objection. I outline a pure pragmatist theory, recapitulate why Berker thinks it also falls prey to his objection, and explain why the objection fails to undermine pure pragmatism. Finally, I consider an additional reason Berker’s argument might seem persuasive and show that it depends on conflating Berker’s objection and a separate challenge to pure pragmatism. Once these distinct challenges are disambiguated, it is easier to see why Berker’s objection is not a significant concern for pure pragmatists. (shrink)

A central task of comparative constitutional law scholarship is categorization and classification of constitutions. Recent scholarship, no doubt informed by the populist tide, has sought to develop the concept of a mixed constitution. Broadly speaking, a mixed constitution is a constitution that integrates liberal and illiberal elements, elements that are usually separate and not found under the same constitution. The study of “mixed constitutions” encompasses both descriptive and normative aspects. First, an attempt to ascertain what, exactly, makes a constitution “mixed.” (...) Second, an attempt to analyze either the desirability of such a system or an attempt to figure out how to harness mixed constitutions in the service of particular normative goals, for example the protection of human rights. This article has two goals. First, an inquiry into the descriptive aspect of mixed constitutions. My aim is to show that given the seeming consensus of what constitutes a mixed constitution, the category itself might encompass many more constitutions than is often acknowledged, to the point that many constitutions are likely to be mixed to a certain extent. My second goal is to demonstrate that given this definitional consensus, what makes a constitution mixed is not necessarily because the constitution itself is mixed, but because sub-constitutional norms shape our constitutional understanding. Put differently, the meaning of a constitution is not determined exclusively through an analysis of the constitution, but also by shifts in sub-constitutional understandings. If this is correct, then it turns out that the universe of mixed constitutions is much larger than thought, which casts doubt on the utility of the category of mixed constitutions. (shrink)

From the perspective of a recent graduate, this article offers a critique of non-STEM higher education in England as unfit for purpose. Whilst universities blindly focus on employability, transferable skills and narrow bands of subject knowledge, the economic world around them has collapsed into absurdity. The graduate today is now faced with economic, social and cultural precarity which is unreflected in the rigid structures and narrow focus of their degree. This article seeks a radical return to the ancient principles of (...) a liberal arts education. Far from this being regressive, I argue that this education can and should be reclaimed and reinvigorated by the flexibility, difficulty and complexity of modern philosophy. Organizations that believe they should "give something back" to the society have embraced the concept of corporate social responsibility (CSR). Although the theoretical underpinnings of CSR have been frequently debated, empirical studies often involve only limited aspects, implying that theory may not be congruent with actual practices and may impede understanding and further development of CSR. The authors investigate actual CSR practices related to five different stakeholder groups, develop an instrument to measure those CSR practices, and apply it to a (...) survey of 401 U.S. organizations. Four different clusters of organizations emerge, depending on the CSR practice focus. The distinctive features of each cluster relate to organizational demographics, perceived influence of stakeholders, managers' perceptions of the influence of CSR on performance, and organizational performance. This article aims to contextualize a short Qurʾānic passage – Q 30:2‒5 – with reference to Jewish and Christian materials that have not hitherto been deployed for this purpose. The article builds on the findings of recent scholarship, which reads this passage eschatologically rather than historically, and argues that there are, in fact, two texts that require contextualization: 1) The Qurʾānic verses themselves (which refer only to the fate of “the Romans”); and 2) The early exegetical traditions on these verses (...) (which often add “the Persians” to the eschatological drama). Furthermore, it is argued that the Biblical book of Daniel, and its interpretation in late antiquity, contributed both to the verses themselves and to their exegesis. (shrink)

This article integrates the history of military theory – and the practical history of military campaigns and battles – within the broader history of knowledge. Challenging ideas that the new natural philosophy of the seventeenth and eighteenth centuries (the so-called Scientific Revolution) fostered attempts to make warfare mathematically calculated, it builds on work showing that seventeenth- and eighteenth-century natural philosophy was itself much more subjective than previously thought. It uses the figure of King Frederick II of Prussia (reigned 1740–1786) to (...) link theoretical with practical military knowledge, placing the military treatises read and written by the king alongside the practical example of the Prussian army’s campaign against the Russians in summer 1758 at the height of the Seven Years War (1756–1763), which culminated in the battle of Zorndorf. This article shows that both the theory and practice of war – like other branches of knowledge in the long eighteenth century – were fundamentally shaped by the contemporary search for intellectual order. The inability to achieve this in practice led to a reliance on subjective judgment and individual, local knowledge. Whereas historians have noted attempts in the eighteenth century to calculate probabilities mathematically, this article shows that war continued to be conceived as the domain of fortune, subject to incalculable chance. Answering Steven Shapin’s call to define concretely “the subjective element in knowledge-making,” the examples of Frederick and his subordinate, Lieutenant General Count Christoph zu Dohna, reveal sharply different contemporary ideas about how to respond to uncertainty in war. Whereas Dohna sought to be ready for chance events and react to them, Frederick actively embraced uncertainty and risk-taking, making chance both a rhetorical argument and a positive choice guiding strategy and tactics. Behemoth is traditionally read as supporting Hobbes's science from the treatises, but it also goes beyond the strict limitations of Hobbes's science. Understanding how Hobbes expands his approach requires that we examine how A's confidence in institutional reform is met by B's cynicism. Hobbes shifts from an analysis of general inclinations to an analysis of the particular strategies that skilful sovereigns use to acquire and maintain peace. The result is a theory of the state that relies less on> institutional arrangement, (...) and more on effective statesmanship, than we typically see when considering Hobbes's treatises alone. Andy Egan has recently presented a prominent objection to causal decision theory. However, in this paper, I argue that this objection fails if CDT’s proponent accepts the plausible view that decision-theoretic options are intentions. This result both provides a defence of CDT against a prominent objection and highlights the importance of resolving the nature of decision-theoretic options.

A hypothesis on the evolutionary origin of the genetic pathway of sex determination in the nematode Caenorhabditis elegans is presented here. It is suggested that the pathway arose in steps, driven by frequency‐dependent selection for the minority sex at each step, and involving the sequential acquisition of dominant negative, neomorphic genetic switches, each one reversing the action of the previous one. A central implication is that the genetic pathway evolved in reverse order from the final step in the hierarchy up (...) to the first. The possible applicability of the model to the other well‐characterized sex determination pathway, that of Drosophila melanogaster, and to sex determination in mammals, is discussed, along with some potential implications for pathway evolution in general. Finally, the specific molecular and population genetic questions that the model raises are described and some tests are proposed. (shrink)

This article discusses the desirability and feasibility of modeling precedents with multiple interpretations within factor-based models of precedential constraint. The main idea is that allowing multiple reasonable interpretations of cases and modeling precedential constraint as a function of what all reasonable interpretations compel may be advantageous. The article explains the potential benefits of extending the models in this way with a focus on incorporating a theory of vertical precedent in U.S. federal appellate courts. It also considers the costs of extending (...) the models in this way, such as the significant increase in the functional size of the case base and the need to provide some kind of ordering on interpretations to select a “best” interpretation. Finally, the article suggests partially incorporating multiple interpretations of dimensions as a realistic starting point for incorporating interpretations generally, and shows how doing so can help address difficulties with dimensions. This article offers an explanation for the proposed moral asymmetry between non‐responsible threats and innocent bystanders. Some argue that a non‐responsible threat – a person who threatens another through no fault or choice – is required to bear a greater burden to avert the threat than a bystander. I argue that previous attempts to explain this asymmetry are either incorrect or incomplete, since they either implausibly suggest that agents who do not benefit from their bodily resources, or whose bodily resources (...) primarily benefit third parties, are liable to greater costs than a bystander, or fail to accommodate such cases. Instead, the asymmetry (when it exists) is explained either by virtue of the fact that the non‐responsible threat has a beneficiary status with respect to the threatening object, or possesses distribution‐limiting entitlements over the threatening object.
