The aim of the paper is that of discussing some recent antipositivist theses, with specific reference to the arguments that focus on the alleged incapability of legal positivism to understand and explain the complex normative structure of constitutional states. One of the central tenets of legal positivism (in its guise of ``methodological'' or ``conceptual'' positivism) is the theory of the separation between law and morality. On the assumption that in contemporary legal systems, constitutional law represents a point of intersection between (...) law and basic moral values, antipositivists contrast legal positivism with two main arguments. First, on a more general level, the positivist theory of the separation between law and morality is questioned; then, and consequently, the ``neutrality thesis'' in the juristic study of law is rejected. The author discusses both these antipositivist arguments, and offers a brief defence of methodological positivism. (shrink)

The article analyzes the social representations of ICTs’ appropriation for community empowerment by social movements. The study includes two recent Latin American student social movements: the Mexican #YoSoy132 and the Chilean student movement. Discourse analysis was used to examine interviews with participants in these social movements as well as other texts associated with their episodes of collective action. The discourse analysis was focused on four main dimensions of the social representations of ICTs’ appropriation: (1) the interrelationships between the technological and (...) the socio-political and cultural dimensions; (2) the tension between a visibility-centered and an articulating-focused use of ICTs; (3) the tension between the individual and the collective dimensions; and (4) the articulation between ICTs-based collective action and offline one. The findings indicate that the online/offline and the visibility/articulation tensions are relevant dimensions, in an articulated way, of the social representation of ICTs’ appropriation for collective empowerment. The results also indicate that the sociopolitical goals of the social movements are a central mediation for the process of configuration of the social representation, as it is proved by the importance of the individual/collective tension for the process. ABSTRACT We consider in this work the problem of iterated belief revision. We propose a family of belief revision operators called revision with memory operators and we give a logical (both syntactical and semantical) characterization of these operators. They obey what we call the principle of strong primacy of update: when one revises his beliefs by a new evidence, then all possible worlds that satisfy this new evidence become more reliable than those that do not. En este artículo se traza una distinción clara y precisa entre geometría pura y geometría aplicada dentro del marco de las reflexiones sobre los fundamentos de la geometría promovidas por la aparición de geometrías no-euclidianas y en el contexto de las discusiones mantenidas por los empiristas lógicos sobre la estructura general de las teorías empíricas. De manera más particular, se defiende, tal y como proponen los empiristas lógicos, que una geometría pura es un sistema formal que no nos dice nada (...) sobre la realidad física, mientras que una geometría aplicada es una teoría empírica, una teoría física (una teoría del espacio) que resulta de dotar de significado a una geometría matemática. Para sostener esta tesis se recurre, en parte, a ciertas ideas expresadas por Einstein sobre la teoría general de la relatividad. Por último, si bien parece que esta imagen de la estructura de una geometría física es relativamente adecuada, se insiste en la tesis de que el error principal de los empiristas lógicos estaría entonces en pretender hacer de ella el carácter predominante de la estructura de las teorías científicas en general. Para ello, retomar la obra de un pensador parcialmente olvidado en las últimas décadas, no solo (...) nos permitirá atisbar posibilidades de pensar futuros diversos, sino que nos obligará a tomar en consideración una caja de herramientas, sugerente, que terminó defendiendo con matices, contradicciones e incorporaciones hasta el final de su vida en 1988. In this paper, I propose a general taxonomy of different forms of eliminativism. In order to do so, I begin by exploring eliminativism from a broad perspective, providing a comparative picture of eliminativist projects in different domains. This exploration shows that eliminativism is a label used for a family of related types of eliminativist arguments and claims. The proposed taxonomy is an attempt to systematise those arguments and claims.

Este artículo defiende la relevancia de la filosofía en el estudio contemporáneo de conceptos. Con el desarrollo de la ciencia cognitiva, la teorización naturalista e interdisciplinaria acerca de los conceptos ha cobrado impulso. En este contexto, se ha argumentado recientemente que las teorías filosóficas de conceptos no son acerca del tipo de cosas que interesan a los psicólogos, descartando así la pertinencia científica de la contribución filosófica mencionada. Presentamos y discutimos dos casos que sugieren lo contrario, como un intento de (...) reivindicar el papel crucial que tiene la filosofía en el desarrollo de teorías empíricas de conceptos. La interpretación es un proceso cognitivo peculiar: distinto, por una parte, de la explicación cientificopositiva; por otra, de la comprensión empática y también del entender en sus distintas formas. EI proceso interpretative tiene lugar por el sujeto, que en ese momento hace de intérprete, a partir de un objeto en un contexto determinado, pero sobre la imagen del objeto, que es en realidad el referencial; la dación de significados connotativos constituye el interpretado, el cual es devuelto al contexto como referido. (...) En la neointerpretación o en la reinterpretación, ese objeto referido es entonces neoreferencial. EI proceso interpretativo es estocástico y, por eso, con la finalidad de reducir la entropía del sistema, podría ser interminable. Ernesto Sosa tiene el mérito de haber sido pionero en lo que podría describirse, quizás sin demasiada exageración, como un cambio de paradigma en la epistemología contemporánea: el que supuso el tránsito desde una epistemología centrada en el problema de la estructura de la justificación hasta una nueva concepción del conocimiento enfocada en la naturaleza del agente epistémico. Un aspecto de este cambio que conviene no tratar con negligencia es el cambio de las analogías fundamentales, que pasaron de ser arquitectónicas (...) a ser deportivas o prácticas, entre las que destaca la analogía del arquero. Nuestro objetivo en este capítulo es describir someramente dicho cambio para apuntar dos sentidos en los que creemos que la propuesta de Sosa podría «deslimitarse», es decir, desprenderse de límites que él mismo ha impuesto a su planteamiento. Un primer límite está relacionado con la dimensión temporal de la gnoseología (que, a diferencia de la ética de la creencia, habría de adoptar, según Sosa, un planteamiento esencialmente instantáneo o sincrónico). Un segundo límite es relativo a la identidad del agente epistémico, en la medida en que el planteamiento de Sosa parece asumir un enfoque individualista de difícil aplicación en casos de agentes colectivos. Sostendremos que ambos límites aparecen si mantenemos la analogía del arquero con el agente de conocimiento, al ser la suya una actividad instantánea y radicalmente individual. Si en su lugar adoptamos otras analogías para la acción epistémica, como las que aquí proponemos, salta a la vista que la sincronía y la individualidad son limitaciones contingentes para una epistemología de virtudes télica. This paper defends the relevance of philosophy in the contemporary study of concepts. With the advent of cognitive science, naturalistic and interdisciplinary theorizing about concepts has gained momentum. In this context, it has been recently argued that philosophers’ theories of concepts are not aimed at answering the issues that psychologists are interested in, thus dismissing the mentioned philosophical contribution as scientifically otiose. We present and discuss two cases in point suggesting otherwise, as an attempt to vindicate the crucial role of (...) philosophy in the development of empirical theories of concepts. (shrink)

In this paper I draw a clear and precise distinction between pure or mathematical geometry and applied or physical geometry. I make this distinction inside two contexts : one, the reflections about foundations of geometry due to the source of non-Euclidean geometry and, other one, the discussions by the logical positivists on general structure of empirical theories. In particular, such and like propose the logical positivists, I defend that pure geometry is a formal system that doesn’t tell us anything about (...) physical reality, whereas applied geometry is a theory about physical space that comes of to interpret a mathematical geometry. I support this thesis in some Einstein ’s ideas about the general theory of relativity. Finally, even though this picture of structure of physical geometry is relatively appropriate, I insist on the thesis of that main mistake of logical empiricist philosophy would be in making of this picture the dominant character of structure of scientific theories in general. Food advertising targeted at children is associated with the development of unhealthy eating habits and childhood obesity. In Spain, where one in every three children suffers from overweight, a voluntary regulation mechanism has been adopted to control such advertising, despite evidence of its ineffectiveness. This study's stated objective was to evaluate the grounds for implementing a policy that would ban the advertising of energy-dense, nutrient-poor food and beverages targeted at children in Spain, incorporating an ethical perspective in the analysis. Using (...) a bibliographic search of various databases, we reviewed the evidence for answering the seven questions posed by Walton et al.'s ethical evaluation framework, drawn up on the basis of the Nuffield Council on Bioethics Stewardship model. The results show that the proposed intervention is cost-effective, minimally intrusive, promotes healthy environments, acts on a vulnerable population, helps children lead healthy lifestyles, reduces social health inequalities, increases parents' individual freedom of choice and enjoys the support of scientists, health professionals and consumers alike. Accordingly, we feel that the time has come for food advertising directed to children in Spain to be statutorily regulated, by banning the promotion of EDNP products. (shrink)

Drawing upon a distinction between epistemically and metaphysically motivated notions of a concept, I consider the insurmountable problems of theories that appeal to our epistemic capacities to address the problem of the nature of concepts satisfactorily. Prominent theories of concepts hold that primitive concepts must have internal structure if they are to account for the explanatory functions that cognitive scientists have attributed to such constructs as prototypes, exemplars, and theories. Vindicating the role of non-experimental philosophy in the critical examination of (...) empirical theories, I argue that the explanatory effectiveness of those constructs is orthogonal to an argument concerning the structure of primitive concepts. Conceptual atomism provides an alternative approach to individuating primitive concepts the precise formulation of which has yet to be worked out. Despite its unpopularity, the atomist alternative is still in a better position to face the question of what concepts are than its competitors. (shrink)

I will argue that the rule of recognition, as it has been conceived by Hart, is either a redundant, and hence mostly useless, concept, or a concept with limited explanatory potential —in either case, at best a concept whose scope is, in contemporary legal systems, much narrower than Hart envis- aged. I will also argue that the rule of recognition, in one of its possible (and plausible) reformulations, can nevertheless play a significant, non-redundant role, but only if employed in a (...) rather different way than the one proposed by Hart, as well as by much of post-Hartian positivist literatureResumen:En este artículo se argumenta que la regla de reconocimiento, tal como fuera concebida por Hart, es o bien un concepto redundante —y en consecuencia inútil— o un concepto limitado en su poder explicativo. En cualquier caso, se trata de un concepto cuyo alcance es, frente a los sistemas jurídicos contemporáneos, mucho más estrecho de lo que Hart pudo imaginar. De igual modo se argumenta que la regla de reconocimiento, en alguna de sus posibles (y plausibles) reformulaciones, puede tener a pesar de todo un papel significativo y no redundante, pero solamente si se emplea en un sentido radicalmente distinto al que propuso Hart o que se propone en buena parte de la literatura positivista posthartiana. Developmental research typically relies on face-to-face testing at laboratories, childcare centers, museums or playgroups. Current social distancing measures have led to a halt in research. Although face-to-face interaction is considered essential for research involving young children, current technology provides viable alternatives. This paper introduces an accessible, replicable and easy to follow method to conduct online developmental research with young children employing a word-learning task as an exemplar, including a detailed workflow and step-by-step guide to using easily accessible programs and platforms. (...) Four-year-old children's performance on a word-learning task delivered online vs. face-to-face is provided as a method validation. Children's performance on the word-learning task was predominantly consistent across delivery modes, with only slight variation in performance between modes. The implications of these similar results across face-to-face and online methods are discussed alongside avenues for further research. Importantly, this paper presents an emerging methodological approach for the online administration of developmental science both within and beyond the COVID-19 pandemic, adding a new tool to current and future developmental scientist's toolkits. The essay discusses the import of the separability thesis both for legal positivism and for contemporary legal practice. First, the place of the separability thesis in legal positivism will be explored, distinguishing between “standard positivism” and “post‐Hartian positivism.” Then I will consider various kinds of relations between law and morality that are worthy of jurisprudential interest, and explore, from a positivist point of view, what kind of relations between law and morality must be rejected, what kind of such relations should (...) be taken into account, and what kind of such relations are indeed of no import at all. The upshot of this analysis consists in highlighting the distinction between two different dimensions of legal validity (formal validity and material validity respectively), and in pointing out that the positivist separability thesis can apply to formal validity only. On the other hand, when the ascertainment of material validity is at stake, some form of moral reasoning may well be involved (here and now, it isnecessarilyinvolved). The essay concludes with some brief remarks on the persisting importance of the positivist jurisprudential project. (shrink)

El TEDH se ha servido de los criterios de interpretación evolutivo y sistemático en la interpretación del CEDH, que le han permitido desarrollar una jurisprudencia sobre el derecho a la eutanasia en la que reconoce un amplio margen de apreciación a los Estados, por lo que es compatible con el CEDH tanto prohibir como permitir la eutanasia, siempre que el Estado garantice el derecho a la vida de las personas vulnerables. El Tribunal Constitucional español ha declarado la constitucionalidad de la (...) Ley Orgánica de regulación de la Eutanasia 3/2021, mediante una argumentación jurídica basada en la doctrina del TEDH. (shrink)

Edouard Machery has argued that the notion of concept should be eliminated from scientific theorising about cognition on the grounds that what psychologists call concepts do not form a natural kind and that keeping this notion would encumber scientific progress. His view is that the class of concepts really divides into three distinct yet co-referential kinds of bodies of knowledge typically used in distinct cognitive processes. The main purpose of this paper is to challenge Machery’s eliminativist conclusion on the grounds (...) that his alternative to concepts fails to be combined with any prominent account of content determination. As a case of philosophical scrutiny of a psychological proposal, the paper also intends to show how philosophical and psychological interests in concepts can be brought together. (shrink)

Is it correct to accept an anthopological dimension in Baruch Spinoza’s doctrine? Regardless of the answer we may suggest for this point, how could be this connected to the prevailing Humanism of the immediately previous period in which our author lived? Our proposal points to a positive stance in relation to the presence of an anthropological perspective in Spinoza’s thought; perspective that may be seen as a reaction to that kind of Renaissance humanism that sees the human being in Nature (...) a privileged kind. Therefore, in this paper we are going to analyse the way the concept of man evolves from this to the Spinozian formulation as a foundation in which it can be possible to accept the study of a certain Anthropology in his work. Reivindicando el aporte de la filosofía no experimental en la evaluación de teorías empíricas, planteo que un argumento a favor de la estructura de los conceptos primitivos es independiente del poder explicativo de dichos constructos. El atomismo conceptual proporciona un enfoque alternativo para individualizar conceptos primitivos cuya formulación precisa aún no se ha elaborado. Pese a su impopularidad, la alternativa atomista está en una mejor posición que sus rivales para enfrentar la pregunta acerca de qué tipo de cosas son los conceptos. (shrink)

The theory of the four stages happens to be a conjectural history with which the evolutionary interpretation of the process of civilization began, especially dynamic in the Scottish Enlightenment. The incidence in England and France of the work of the Jesuit J. de Acosta up to the English and Scottish Enlightenment is addressed, paying special attention first to the English translation by E. Grimstone, based on the French version by R. Regnault. Likewise, the use of Acosta is examined in detail (...) in a French political encyclopedia widespread in Europe, translated into several languages, also by Grimstone into English. Finally, the original components of the theory of the four stages in Acosta and D'Avity are examined, in its three Spanish, French and English versions as precursors of anthropological theory. Durante los años 1853 y 1854 surgió una ola de huelgas en varios distritos industriales de Inglaterra, especialmente en los sectores textiles de Lancashire y Manchester. Este ciclo de luchas, que pugnaba principalmente por un aumento de los salarios, fue visto por Ernest Jones y el movimiento Cartista como una oportunidad para organizar una asociación obrera a escala nacional. Karl Marx, que compartía la visión de los cartistas, analizó el movimiento desde el New York Tribune, brindando apoyo a la iniciativa (...) a la que dio lugar: el Parlamento Obrero. A continuación, se ofrece la traducción de cuatro textos periodísticos que Marx publicó en apoyo a la institución obrera –la mayoría inéditos en español–, seguidos de «Las luchas por la organización obrera en la época victoriana (1853-1854)», un estudio crítico sobre el ciclo de huelgas y las expectativas de organización obrera durante aquellos años, donde se defiende que este fallido intento de organización constituye un precedente de la sección británica de la Asociación Internacional de Trabajadores. In this article we wonder about the effects of May 68 upon the history of philosophy. To address this issue, we reconstruct the philosophical framework and the academic field of the previous years of the revolt, pointing at how inside the existing philosophical styles important changes were being prepared – maninly in the relations between philosophy and sciences–. Departing from Pierre Macherey’s trajectory, we describe the features of the philosophical space of May 68 and its changes –amplification of publics, hybridization (...) of philosophy with other knowledges, collective intellectual enterprises, militant affiliation of discourses–, showing how new models of philosophy are stabilized already in the Post 68 years. At this point, we approach the philosophical practice of Michel Foucault and Louis Althusser, exploring their innovations when it comes to understand philosophy. Finally, we trace a dialogue between the philosophy conceptions’ of Althusser and Macherey; in its tensions the possibilities of a new philosophical canon and a new practice of philosophy are expressed. Una idea ampliamente extendida es que el programa estructuralista es completamente neutral en cuestiones epistémicas. Por el contrario, el objetivo del artículo es mostrar que el estructuralismo es epistémicamente neutral en el debate realismo vs. antirrealismo, pero que supone un compromiso epistémico en la fundamentación de las teorías. Desde hace algunas décadas, la pregunta por la vida buena ha ganado relevancia en el discurso filosófico universitario. Un fenómeno llamativo en este contexto es la publicación de obras que, concebidas en el seno mismo de la academia, evitan ceñirse al formato de escritura científica convencional y en cambio integran estrategias literarias en su discurrir argumentativo. Ejemplos paradigmáticos de este fenómeno son los títulos El arte de vivir (The Art of Living) de Alexander Nehamas (1998); La vida plena (Das vollkommene (...) Leben) de Michael Hampe (2009) y La dignidad humana: Una manera de vivir (Eine Art zu Leben: Über die Vielfalt menschlicher Würde) de Peter Bieri (2013), obras que hasta ahora han pasado prácticamente inadvertidas en el ámbito hispanoparlante. El artículo pretende subsanar este vacío en la recepción mediante un seguimiento de la articulación entre las concepciones éticas expuestas en cada uno de los tres casos y el particular modo de exposición elegido, así como mediante un seguimiento de la ascendencia socrática a la que apelan declarada o tácitamente. Además, defenderá la tesis de que el recurso a elementos literarios es una manera de enfrentar, con un énfasis en la voz autoral, la neutralidad moderna de la filosofía ante la pregunta por cómo vivir. In this paper, the radical view that transparent equipment is the result of an ecological assembly between tool users and physical aspects of the world is critically assessed. According to this perspective, tool users are normally viewed as plastically organized hybrid agents. In this view, such agents are able to interact with tools (artefacts or technologies) in ways that are opportunistic and fully locked to the local task environment. This intimate and flexible interaction would provide grounds for the thesis that (...) cognitive agents and tools constitute literal extended cognitive systems. By contrast, a revised understanding of tool use transparency will be attempted. In this perspective, the interplay between on-line and off-line thinking is understood in terms of a socially reified cognitive delegation that subsumes the advantages normally associated to the so-called ‘open-ended ecological controllers.’ Thus, the notion of transparent technologies can be explored on the basis of a derived or mediated cognitive delegation. This view will be complemented by the notion of communities of practice (CoP). Special sorts of CoP will be proposed as suitable and flexible cognitive environments for the development of tool transparency. (shrink)

Is it correct to accept an anthopological dimension in Baruch Spinoza’s doctrine? Regardless of the answer we may suggest for this point, how could be this connected to the prevailing Humanism of the immediately previous period in which our author lived? Our proposal points to a positive stance in relation to the presence of an anthropological perspective in Spinoza’s thought; perspective that may be seen as a reaction to that kind of Renaissance humanism that sees the human being in Nature (...) a privileged kind. Therefore, in this paper we are going to analyse the way the concept of man evolves from this to the Spinozian formulation as a foundation in which it can be possible to accept the study of a certain Anthropology in his work. En este artículo presento una reflexión filosófica alrededor de las implicaciones ontológicas sobre la realidad física del espacio-tiempo y, como complemento a lo primero, sobre la relación entre teoría y experiencia en las teorías de la relatividad especial y general de Einstein. Así, el objetivo es doble: primero, ilustrar el debate entre realistas y convencionalistas respecto a la realidad del espacio-tiempo, el cual, en lo fundamental, puede retrotraerse hasta el debate Newton/Leibniz sobre la realidad del espacio y el tiempo absolutos; (...) segundo, a partir de lo anterior y dentro de ese contexto, reflexionar sobre la relación que guardan las teorías físicas con la realidad. En este artículo se traza una distinción clara y precisa entre geometría pura y geometría aplicada dentro del marco de las reflexiones sobre los fundamentos de la geometría promovidas por la aparición de geometrías no-euclidianas y en el contexto de las discusiones mantenidas por los empiristas lógicos sobre la estructura general de las teorías empíricas. De manera más particular, se defiende, tal y como proponen los empiristas lógicos, que una geometría pura es un sistema formal que no nos dice nada (...) sobre la realidad física, mientras que una geometría aplicada es una teoría empírica, una teoría física (una teoría del espacio) que resulta de dotar de significado a una geometría matemática. Para sostener esta tesis se recurre, en parte, a ciertas ideas expresadas por Einstein sobre la teoría general de la relatividad. Por último, si bien parece que esta imagen de la estructura de una geometría física es relativamente adecuada, se insiste en la tesis de que el error principal de los empiristas lógicos estaría entonces en pretender hacer de ella el carácter predominante de la estructura de las teorías científicas en general. All the acts of behaviour are judgements of reality . The first stage in th:is judgesment is denotative . The second is connotative . Denotative judgement contains 6 components: diacriticity, organization, identification, naming, specialization, timing. All of them have to be provided with values of truth. Value of truth of denotative judgements derives from their value of truth in context. Context is a consensus space. Thus, subject denotes object starting from theory of context he holds. As far as psychology is (...) corcerned, starting from a theory of perception -instead of a theory of denotation- has been a decisive setback. (shrink)

In qualitative decision theory, a very natural way for defining preference relations over policies (acts) -functions from a set S of states to a set X of consequences- is by using the so called Dominance Plausible Rule. In this context we need a relation > over X and a relation ? over P(S) (the subsets of S). Then we define ≥ as follows: f ≥ g, ? [f > g] ? [g > f], where [f > g] denotes the set (...) {s ? S : f(s) > g(s)g}. In many cases > is a modular relation and ? is a total preorder. A quite rational and desirable property for the relation over policies is transitivity. In general, the relation ≥ defined by the Dominance Plausible Rule is not transitive in spite of the transitivity of ?. In this work we characterize the properties of the relation ? forcing the relation ≥ over policies to be transitive. All this under the hypothesis of modularity of the relation >. (shrink)

Ernesto Sosa tiene el mérito de haber sido pionero en lo que podría describirse, quizás sin demasiada exageración, como un cambio de paradigma en la epistemología contemporánea: el que supuso el tránsito desde una epistemología centrada en el problema de la estructura de la justificación hasta una nueva concepción del conocimiento enfocada en la naturaleza del agente epistémico. Un aspecto de este cambio que conviene no tratar con negligencia es el cambio de las analogías fundamentales, que pasaron de ser arquitectónicas (...) a ser deportivas o prácticas, entre las que destaca la analogía del arquero. Nuestro objetivo en este capítulo es describir someramente dicho cambio para apuntar dos sentidos en los que creemos que la propuesta de Sosa podría «deslimitarse», es decir, desprenderse de límites que él mismo ha impuesto a su planteamiento. Un primer límite está relacionado con la dimensión temporal de la gnoseología (que, a diferencia de la ética de la creencia, habría de adoptar, según Sosa, un planteamiento esencialmente instantáneo o sincrónico). Un segundo límite es relativo a la identidad del agente epistémico, en la medida en que el planteamiento de Sosa parece asumir un enfoque individualista de difícil aplicación en casos de agentes colectivos. Sostendremos que ambos límites aparecen si mantenemos la analogía del arquero con el agente de conocimiento, al ser la suya una actividad instantánea y radicalmente individual. Si en su lugar adoptamos otras analogías para la acción epistémica, como las que aquí proponemos, salta a la vista que la sincronía y la individualidad son limitaciones contingentes para una epistemología de virtudes télica. En nuestra opinión, el abandono de esos dos límites podría abrir nuevos y prometedores horizontes para la epistemología social. (shrink)
