Vādanyāya is one of the representative works of Dharmakīrti. It is concerned with debate logic and deals with win-or-lose reasoning rules in the broad sense of logic. In this paper, we will concentrate our discussion on Dharmakīrti’s theory of nigrahasthāna (fault) in his debate logic, a key issue in Vādanyāya. First, we point out that the justification of three logical reasons as proof conditions of debate constitutes the rational point of departure for Dharmakīrti’s debate logic. Second, we analyze the (...) differences between Dharmakīrti’s and the Naiyāyika’s notion of debate and point out that Dharmakīrti’s ‘debate’ involves two parties (the disputant and the opponent) attempting to rationally refute the other’s opinion to persuade the other to change their wrong ideas. Last, based on the discussion of Dharmakīrti’s concept of debate logic, we identify seven types of nigrahasthāna in Vādanyāya with regard to the two parties of a debate (the disputant and the opponent). This paper discusses the role of Law and Legal Thinking in Critical Theory with specific reference to the arguments that Michael Hardt and Antonio Negri offer in their book Commonwealth. The core idea is that Critical Theory is no less radical, but much more concrete, when it is performing not only an external, but also an internal critique of the Law. It shows that the role of the law in critical theory emerges as a problem when the (...) latter claims that ‘there is no outside’ and that ‘the legal base of the system structures our lives.’ It then discusses optimistic and pessimistic strategies to overcome the problem, and argue for a demanding strategy which consist in articulating the external and the internal critique of the law. To make this point, the paper goes back to the epistemic context in which critical attitudes are deployed (the ‘Conflict of the Faculties’), describes the four theoretical moves constitutive of the historical moment in which, at the end of the 18th Century, modern law as we know it was conceived of and founded; and sketches the key moments of the history of the internal critique of the law. It then illustrates the demanding strategy with examples taken from the field of Intellectual Property, and concludes that the Law is malleable and open enough to allow the thinking and practicing of radical alternatives from within the legal system and also that alternatives spoken in the language of the law are no less radical, but certainly, more concrete than others. The problem of other minds has widely been considered as a special problem within the debate about scepticism. If one cannot be sure that there is a world existing independently of one's mind, how can we be sure that there are minds - minds which we cannot even experience the way we experience material objects? This book shows, through a detailed examination of David Hume's A Treatise of Human Nature, that these concerns are unfounded. By focusing on Hume's discussion of (...) sympathy - the ability to connect with the mental contents of other persons - Anik Waldow demonstrates that belief in other minds can be justified by the same means as belief in material objects. The book thus not only provides the first large-scale treatment of the function of the belief in other minds within the Treatise, thereby adding a new dimension to Hume's realism, but also serves as an invaluable guide to the complexity of the problem of other minds and its various responses in contemporary debate. In this work Ockham proposes a theory of simple predication, which he uses in explicating the truth conditions of progressively more complicated kinds of propositions. His discussion includes what he takes to be the correct semantic treatment of quantified propositions, past tense and future tense propositions, and modal propositions, all of which are receiving much attention from contemporary philosophers. He also illustrates the use of exponential analysis to deal with propositions that prove troublesome in both semantic theory and (...) other disciplines, such as metaphysics, physics, and theology. This type of analysis plays an essential role in his substantive philosophical and theological works, and in many cases then can hardly be understood without a prior acquaintance with this section of the Summa. An introduction by Alfred J. Freddoso clarifies and summarizes Ockham's theory, discusses certain philosophical problems which it engenders, and proposes new interpretations for parts of it. The Rights of Others examines the boundaries of political community by focusing on political membership - the principles and practices for incorporating aliens and strangers, immigrants and newcomers, refugees and asylum seekers into existing polities. Boundaries define some as members, others as aliens. Critical social philosophy of education strives to provide a radical critique of existing models of education in the so-called Western models of democracy, creating progressive alternative models. In this context, the proposed integrative metatheory, which is based on classical and modern sources, concepts, aims for a comprehensive understanding and reconstruction of the phenomenon of education. One of the main tasks in the sphere of education’s democratization today, therefore, is to bring to education the results of restructuring and democratization (...) of the society, to reflect changes in conditions of life and thinking, experience and transformation of subjectivity in the context of the technological revolution and globalization. Methodology. The critical social theory, which developed in the framework of contemporary neo-Marxism, indicates the need for a thorough analysis of society, however, unlike other theoretical concepts and research programs in order to analyze not a fixation and a statement of the existing social givens. On the contrary, critical analysis of society involves the identification of existing antagonistic, alienating factors that distort public communication.The subject of social analysis is the whole sphere of human and non-human nature, which interacts a person depend on it, the whole system of relations between society and nature, society and man, which is covered by the historical practice of conscious – "praxis". The representative of "pure science" isn't the learning, research subject. He is a public a person, which is the totality of all social definitions included in society and its constituent individuals. For such a "total subject" Object of interest is not something external; on the contrary, the latter appears as a product of his own activity. The scientific novelty examines trends in educational institutions and models of globalizing society in the context of our particular relationship of education and society, man and the state, and processes. The research and systematic analysis of neoliberal reforms at the level of society in general and education in particular are conducted. It examines substantive, structural and functional characteristics of the concept of «critical social philosophy of education» in the context of institutional tendencies of social life, as well as forms and possibilities of its methodological application. It consider a model of «critical social philosophy of education», as embodied in the programs of social development and learning, which are primarily designed to teach people how to lead an independent and original research themselves, society and knowledge systems. However, it is proved that the models and programs should not be cut off from any individual and the collective system of moral and social values, theoretical and applied training, nor from further use of the acquired values, norms and skills in everyday life, science, or in production, sphere of all social institutions. Conclusions. Critical philosophical, educational, pedagogical-psychological surprisingly theory, its models and concepts seek to redefine public and private and the public mind. Based on these grounds, in the future, it allows philosophy of education to develop a more inclusive philosophical vision of education, to apply directly to the problems of democratization and changes in social relations in the direction of equality and social justice in the field of education. The point of view of socio-philosophical and philosophical-еducational, pedagogical-psychological, normative understanding and social critics also requires the use of active efforts in the reconstruuction of education and society, the social vision of what education and human life can be and what their specific limitations in existing societies. How can one distinguish the concept of second modernity from the concept of postmodernity? Postmodernists are interested in deconstruction without reconstruction, second modernity is about deconstruction and reconstruction. Social sciences need to construct new concepts to understand the world dynamics at the beginning of the 21st century. Modernity has not vanished, we are not post it. Radical social change has always been part of modernity. What is new is that modernity has begun to modernize its own foundations. This is what (...) it means to say modernity has become reflexive. It has become directed at itself. This causes huge new problems both in reality and in theory. There has been a pluralization of the boundaries within and between societies, between society and nature, between Us and Other, between life and death. This pluralization also changes the inherent nature of boundaries. They become not so much boundaries as a variety of attempts to draw of boundaries. Border conflicts become transformed into conflicts over the drawing of boundaries. Where postmodernism simply celebrates this multiplication of boundaries, the theory of second modernity starts with the problem this new reality poses for individual and collective decisions, and with the problem that the continued existence of such decisions poses for theory. Institutions that are capable of such conscious boundary drawing are enabled in a way that those of the first modernity were not. But this process also generates qualitatively new kinds of trouble and crises. To investigate those troubles is to unveil the emergence of the second modernity. (shrink)

A lump theorist claims that ordinary objects are spread out across possible worlds, much like many of us think that tables are spread out across space. We are not wholly located in any one particular world, the lump theorist claims, just as we are not wholly spatially located where one’s hand is. We are modally spread out, a trans-world mereological sum of world-bound parts. We are lump sums of modal parts. And so are all other ordinary objects. In this paper, (...) I explore lump theory and investigate five arguments against it. These arguments may be the primary reasons why lump theory has not been widely accepted––or extensively explored––until now. This author’s reply addresses critiques by Daniel Engster, Kelly Gawel, and Andrea Westlund about my 2020 book, Freedom to Care: Liberalism, Dependency Care, and Culture. I begin with a statement of my commitment to liberalism. In section two, I defend the value of a distinction between conceptions of persons in the real world and in contract theory to track inequalities in care when indexed to legitimate needs. I argue, as well, that my variety of contract theory supplies the (...) normative content needed to reject the subordination of women of color. Acknowledging the enduring danger of expressive subordination, I emphasize my theory’s compatibility with the full social inclusion of people with disabilities. Section three then defends liberal dependency care’s compatibility with radical critique and transformative change by emphasizing the abstract nature of its core theoretical module. Finally, in section four, I reaffirm conceptual distinctions between autonomy skills, care skills, and a sense of justice by explicating their theoretical roles. In that section, I also embrace Westlund’s insight that theorists of justice need to have skills enabling responsiveness to other perspectives. To this new requirement for actual theorists of justice, I further add that we must attain capacities to engage critically with our society’s norms. Thus, the final section of this article supplements the justificatory module of liberal dependency care, building from the necessary conditions specified as two-level contract theory toward an account of necessary and sufficient conditions for this liberalism’s justificatory module. This paper supplements an earlier one (Wassermann 1978b). Its views aim to reinforce those of Lewontin and other prominent evolutionists, but differ significantly from the opinions of some philosophers of science, notably Popper (1957) and Olding (1978). A basic distinction is made between 'laws' and 'theories of mechanisms'. The 'Theory of Evolution' is not characterized by laws, but is viewed here as a hypertheory which explains classifiable evolutionary phenomena in terms of subordinate classifiable theories of 'evolution-specific mechanisms' (ESMs), each (...) of which could apply to a host of species. Adaptations could result from ESMs that are rooted in molecular complementarities. The theory of mind (ToM) framework has been criticised by emerging alternative accounts. Each alternative begins with the accusation that ToM's validity as a research paradigm rests on the assumption of the ‘unobservability’ of other minds. We argue that the critics' discussion of the unobservability assumption (UA) targets a straw man. We discuss metaphysical, phenomenological, epistemological, and psychological readings of UA and demonstrate that it is not the case that ToM assumes the metaphysical, phenomenological, or epistemological claims. However, ToM (...) supports the psychological UA as a claim about cognitive processes responsible for mindreading. The latter can be interpreted as a claim that (a) neither the other's ‘mindedness’ in general nor the other's particular mental states are observable (i.e. apprehended perceptually); (b) particular mental states are unobservable, whereas some aspects indicative of ‘mindedness’ are observable; (c) some mental states are unobservable but some are also observable. Whereas the critics tend to attribute (a) to ToM, most ToM accounts actually take positions (b) or (c). We conclude that the allegations against ToM for positing UA are seriously misdirected. We further bring out an important stipulation of any account of observability of mental states: mental states are not observable in the same way as the sensory properties of physical objects. Benhabib argues that the tension between universal human rights and democratic self-determination cannot be resolved. Distinguishing between the principle of rights, on the one hand, and context-specific `schedules of rights', on the other hand, helps, however, to specify the scope of both norms. I show that applying this idea to questions of citizenship requires further elaboration in three respects: (1) Benhabib's argument for porous rather than open borders, which does not fully address the challenge of global distributive justice; (2) norms (...) for access to citizenship, which need to cover also transnational affiliations between sending states and their external populations; and (3) necessary constraints on democratic self-determination. I suggest replacing the principle of self-determination with a principle of self-government that does not include a unilateral right to determine the territorial or membership boundaries of the polity. Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three (...) features that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies. These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. Because of their eudaimonistic structure, ancient theories have been criticized as egoistic, but this is a mistake, overlooking the place in them of philia or ‘friendship’, covering particular relationships, and of justice; both require other‐concern, the question for ancient ethics being how far this should extend.

This article shows that the relationship between Simone de Beauvoir's novel, Le Sang des autres (The Blood of Others), first published in 1945, and her essay, Pour une morale de l'ambiguïté (The Ethics of Ambiguity), first published in 1947, illustrates her point in "Littérature et métaphysique" that an abstract philosophical theory is grounded in immediate metaphysical experience. An original ethical position emerges from Hélène Bertrand's lived experience in the novel, which anticipates feminist issues addressed in The Second Sex (...) more directly than does Beauvoir's essay. One of the leading theories of social learning today is Wenger's theory of Communities of Practice'. CoP-theory reiterates basic tenets of social learning theory yet it us set apart from other theories of social learning and education not only by centering on identity-formation but by positing four key dualities as inherent structural features of the educational process. While concurring with Wenger's 'dilemmatic' understanding of education and his open-ended, practice-based conception of identity-formation, we argue that Wenger's theory (...) overlooks central elements that are needed in order to fully articulate the ends of the educational process, as he conceives them. We claim that further supplementation is needed to support the kind of educational processes that Wenger advocates. Referring to the work of Jack Mezirow and Charles Taylor, this supplementation concerns both critical reflection and 'ethical imagination'. Rather than threatening the coherency of the theory, we claim that these supplementations are internally derived from the ends of CoP-theory and are necessary for its very possibility. To remain in line with Wenger's dilemmatic structure of education, these supplementations are presented in the form of a duality: the tension between artistic and ethical imagination. (shrink)

Section three then defends liberal dependency care’s compatibility with radical critique and transformative change by emphasizing the abstract nature of its core theoretical module. Finally, in section four, I reaffirm conceptual distinctions between autonomy skills, care skills, and a sense of justice by explicating their theoretical roles. In that section, I also embrace Westlund’s insight that theorists of justice need to have skills enabling responsiveness to other perspectives. To this new requirement for actual theorists of justice, I further add that we must attain capacities to engage critically with our society’s norms. Thus, the final section of this article supplements the justificatory module of liberal dependency care, building from the necessary conditions specified as two-level contract theory toward an account of necessary and sufficient conditions for this liberalism’s justificatory module. The Mahayana tradition in Buddhist philosophy is defined by its ethical orientation--the adoption of bodhicitta, the aspiration to attain awakening for the benefit of all sentient beings. And indeed, this tradition is known for its literature on ethics, which reflect the Madhyamaka tradition of philosophy, and emphasizes both the imperative to cultivate an attitude of universal care (karuna) grounded in the realization of emptiness, impermanence, independence, and the absence of any self in persons or other phenomena.This position is morally very (...) attractive, but raises an important problem: if all phenomena, including persons and actions, are only conventionally real, can moral injunctions or principles be binding, or does the conventional status of the reality we inhabit condemn us to an ethical relativism or nihilism? In Moonpaths, the Cowherds address an analogous problem in the domain of epistemology and argues that the Madhyamaka tradition has the resources to develop a robust account of truth and knowledge within the context of conventional reality. The essays explore a variety of ways in which to understand important Buddhist texts on ethics and Mahayana moral theory so as to make sense of the genuine force of morality. (shrink)

This study examines the use of a modified form of the theory of planned behavior in understanding the decisions of undergraduate students in engineering and humanities to engage in cheating. We surveyed 527 randomly selected students from three academic institutions. Results supported the use of the model in predicting ethical decision-making regarding cheating. In particular, the model demonstrated how certain variables (gender, discipline, high school cheating, education level, international student status, participation in Greek organizations or other clubs) and moral (...) constructs related to intention to cheat, attitudes toward cheating, perceptions of norms with respect to cheating, and ultimately cheating behaviors. Further the relative importance of the theory of planned behavior constructs was consistent regardless of context, whereas the contributions of variables included in the study that were outside the theory varied by context. Of particular note were findings suggesting that the extent of cheating in high school was a strong predictor of cheating in college and that engineering students reported cheating more frequently than students in the humanities, even when controlling for the number of opportunities to do so. Distinguishes two senses of 'judgment' on the one hand as meaning a state of 'conviction' or 'belief', and on the other hand as meaning an act of 'affirmation' or 'assertion'. Certainly conviction and assertion stand in close relation to each other, but they delineate two heterogeneous logical spheres, and thereby divide the total field of the theory of judgment into two neighbouring but separate sub-fields. Once this is done it is shown to have implications for our understanding especially of (...) the phenomenon of negation, and of the distinction between negation as affirmation of a negative state of affairs, and negation as act of contradicting the judgment someone else has made. 1. The theory of classes presented in this paper is a simplification of that presented by J. von Neumann in his paper Die Axiomatisierung der Mengenlehre. However, this paper is written so that it can be read independently of von Neumann's. The principal modifications of his system are the following.(1) The idea of ordered pair is defined in terms of the other primitive concepts of the system. We wish first to give a rough picture of the system which we are trying to construct. Suppose that we have the idea “class,” but no material from which to construct classes. Nevertheless, we can construct the class 0 having no elements. And then the class 1 having 0 as its only element. To extend this method to infinite classes, we must give rules telling what elements are to be included. Since the nature of the rules which we can use is not altogether clear, we try to formalize the whole system; that is, to set up a system of axioms which seems to characterize this system of classes. In this paper I try to elucidate the differences between theoretical and practical endeavors in philosophy, and then to show that in a sense philosophy has to be theoretical, but— if it claims to be viable—it must be practical as well. First I consider the meaning of the terms theoretical, practical, abstract, and concrete. Then, with the help of Whitehead’s ideas on this topic, I briefly reflect on the method, aims and role of philosophy. I hold that a properly established (...) philosophical approach should have its roots in concrete experience and should include concrete applications. Thus, abstract ideas can be (and indeed often are) transformed into our daily life practices, being applied to solve real problems—personal, social, environmental, etc. The ideas are conveyed from the sphere of philosophy to that of ordinary life. In the next stage I demonstrate this principle using a concrete example, Whitehead’s philosophical system and how it can be fruitfully applied to the sphere of deep ecology. There are many other examples that could be mentioned, but giving a proper demonstration of this application principle requires more space and so I concentrate only on one of these examples. This study offers a systematic reconstruction of the theoretical foundations and framework of critical social theory. It is Habermas' "magnum opus", and it is regarded as one of the most important works of modern social thought. In this second and final volume of the work, Habermas examines the relations between action concepts and systems theory and elaborates a framework for analyzing the developmental tendencies of modern societies. He discusses in detail the work of Marx, Durkheim, G.H. Mead and (...) Talcott Parsons, among others. By distinguishing between social systems and what he calls the "life-world", Habermas is able to analyze the ways in which the development of social systems impinges upon the symbolic and subjective dimensions of social life, resulting in the kind of crises, conflicts and protest movements which are characteristic of advanced capitalist societies in the late-20th century. This paper reimagines the traditional problem of other minds. On a Cartesian view, the problem involves humans’ inability to perceive other persons’ minds. Similarly, Gilbert Ryle claims that we cannot directly access another’s mind. The paper’s rethinking of the problem of other minds moves beyond these questions of perceptibility and accessibility. It asks whether there are certain groups of people whose minds are systematically misinterpreted, or even denied mentality. It argues that there are. This claim builds off recent work in (...) philosophy and social psychology on epistemic injustice and the role of social categories in mental state attribution. The paper proposes the Problem of the Other’s Mind: the phenomenon of a (relatively) socially privileged person’s inability or lack of desire to understand the mind of a (relatively) socially underprivileged person. Non-cognitivists are known to face a problem in extending their account of straightforward predicative moral judgments to logically complex moral judgments. This paper presents a related problem concerning how non-cognitivists might extend their accounts of moral judgments to other kinds of moral attitudes, such as moral hopes and moral intuitions. Non-cognitivists must solve three separate challenges: they must explain the natures of these other attitudes, they must explain why they count as moral attitudes, and they must explain why the moral (...) attitudes are systematically correlated with ordinary propositional attitudes. After presenting the problem, this paper examines several contemporary theories with some initial promise for solving it, and argues that they are insufficient. (shrink)

The Institute of Social Research, from which the Frankfurt School developed, was founded in the early years of the Weimar Republic. It survived the Nazi era in exile, to become an important centre of social theory in the postwar era. Early members of the school, such as Adorno, Horkheimer and Marcuse, developed a form of Marxist theory known as Critical Theory, which became influential in the study of class, politics, culture and ideology. The work of more recent (...) members, and in particular Habermas, has received wide attention throughout Europe and North America. Tom Bottomore's study takes a new and controversial look at the contributions of the Frankfurt School to modern sociology, examining several issues not previously discussed elsewhere. He discusses the neglect of history and political economy by the critical theorists, and considers the relationship of the later Frankfurt School to the radical movements of the 1960s and the present time. His critical analysis makes the school's writers accessible, through an assessment of their work and an exploration of the relationship of Critical Theory to other forms of sociological thought, especially positivism and structuralism. Hybrid accounts of folk psychology maintain that we sometimes theorize and sometimes simulate in order to understand others. An important question is why this is the case. In this paper, I present a view according to which simulation, but not theory, plays a central role in empathy. In contrast to others taking a similar approach to simulation, I do not focus on empathy’s cognitive aspect, but stress its affective-motivational one. Simulating others’ emotions usually engages our motivations (...) altruistically. By vicariously feeling what others are feeling, we directly come to be motivated by their projects and concerns. Simulation contrasts with more theoretical approaches to psychological attribution that help us understand and explan others, but that do not move us altruistically. This helps us see why we would posit two different folk psychological approaches instead of merely one. (shrink)
