It has become increasingly popular to argue that legal positivism is actually a normative theory, and that it cannot be purely descriptive and morally neutral as H.L.A. Hart has suggested. This article purports to disprove this line of thought. It argues that legal positivism is best understood as a descriptive, morally neutral, theory about the nature of law. The article distinguishes between five possible views about the relations between normative claims and legal positivism, arguing that some (...) of them are not at odds with Hart’s thesis about the nature of jurisprudence, while the others are wrong, both as expositions of legal positivism or as critiques of it. The bending styles in Avatar: The Last Airbender draw their inspiration from real‐world Chinese martial arts. Karl Friday describes satsujinken in a more (...) complicated way: “when a combatant uses force of will to overpower, immobilize, and strike down an opponent before he can react, this is called ‘setsunin‐to’”. It could be a perfect description of bloodbending as practiced by Hama: a use of already established and morally neutral techniques for the domination and overpowering of a person for egoistic aims. This paper clarifies and answers the following question: is technology morally neutral? It is argued that the debate between proponents and opponents of the Neutrality Thesis depends on different underlying assumptions about the nature of technological artifacts. My central argument centres around the claim that a mere physicalistic vocabulary does not suffice in characterizing technological artifacts as artifacts, and that the concepts of function and intention are necessary to describe technological artifacts at the right level of description. (...) Once this has been established, I demystify talk about the possible value-ladenness of technological artifacts by showing how these values can be empirically identified. I draw from examples in biology and the social sciences to show that there is a non-mysterious sense in which functions and values can be empirically identified. I conclude from this that technology can be value-laden and that its value-ladenness can both derive from the intended functions as well as the harmful non-intended functions of technological artifacts. RESUMEN Se aborda el tema de la "racionalidad" en la versión estándar del enfoque pragmadialéctico, que pretende superar la dicotomía entre los aspectos normativo y descriptivo que existe en los estudios sobre argumentación. Se señala que la pragmadialéctica, al conceptualizar su noción de racionalidad, asume explícitamente ciertos postulados popperianos y, dado que aquella también incluye elementos de Searle y Grice, se indaga si las ideas de racionalidad de estos filósofos están presentes implícitamente en el compromiso con la racionalidad. A su (...) vez, se da cuenta de algunos nexos del pensamiento aristotélico con los planteamientos de Popper, Searle y Grice con el fin de aclarar la concepción de la racionalidad que tienen los pragmadialécticos, y de estimular un regreso enriquecedor a las fuentes de la argumentación. ABSTRACT The article addresses the issue of "rationality" in the standard version of the pragma-dialectic approach, which aims at overcoming the dichotomy between the normative and descriptive aspects that are evident in studies on argumentation. It points out that when conceptualizing its notion of rationality, pragma-dialectics explicitly assumes some of Popper's postulates. Given that said conceptualization also includes elements from Searle and Grice, the paper also inquires into whether these philosophers' ideas on rationality are implicitly present in the commitment to rationality. Likewise, it discusses some connections between Aristotelian thought and the formulations of Popper, Searle, and Grice, in order to clarify the pragma-dialectic conception of rationality and foster an enriching return to the sources of argumentation. The present paper analyses the topic of scientific discovery and the problem of the existence of a logical framework involved in such endeavour. We inquire how several non-monotonic logic frameworks and other formalisms can account for such a task. In the same vein, we analyse some key aspects of the historical and theoretical debate surrounding scientific discovery, in particular, the context of discovery and context of justification context distinction. We present an argument concerning the weakening of the discovery/justification context dichotomy (...) based on the descriptive accent contained in the non-monotonic logic perspective together with its epistemological concerns. En la concepción estructuralista de teoría científica se afirma que sus tesis son neutrales respecto a compromisos epistemológicos, puesto que su análisis es estructural (Diederich, 1996). En el presente texto nos proponemos mostrar que no existe tal neutralidad epistemológica en una de las piezas clave del estructuralismo metateórico, nos referimos a la noción “aplicaciones intencionales”, y que de lo anterior se deriva un compromiso epistémico relacionado con la justificación de teorías científicas, según el cual, la ciencia es una “red” de (...) relaciones lógicas entre teorías. Para lograr lo anterior nos proponemos analizar las implicaciones semánticas y epistemológicas de esa noción y el rol que juega en la contrastación teórica. Una de las consecuencias más radicales del análisis propuesto es que la noción anterior (aplicaciones intencionales) implica que unas teorías están justificadas por otras; en otras palabras, la justificación de teorías científicas caería en un coherentismo interteórico, que precisaremos más adelante. Naturalmente, es importante advertir que esta tesis y esta implicación coherentista la aceptan los defensores del estructuralismo metateórico (Balzer, Moulines & Sneed, 1987) y (Díez & Moulines, 1997). Sin embargo, el punto realmente problemático, y lo novedoso del presente artículo, es que el coherentismo compromete la justificación de las teorías en cuanto implica un regressus ad infinitum en la reconstrucción formal. Además, este defecto del estructuralismo conlleva a otras dos réplicas adicionales, una desde el punto de vista pragmático y otra desde el punto de vista semántico. El primero consiste en que, si aceptamos la tesis del regressus la reconstrucción puede ser infructuosa para efectos pragmáticos, i.e. la corrección formal de una teoría nos obliga a corregir el conjunto de teorías ya presupuestas que intervienen en ella. De la misma manera, la dependencia semántica de una teoría respecto a sus antecesoras implica que si uno de sus conceptos fundamentales es corregido o modificado, entonces habría que hacer una revisión general de todas las teorías relacionadas en las que el concepto en cuestión es relevante. The present study aimed to analyze the stability of the memory of a stressful event (medical examination within a hospital setting) over time in young people (age range 12 to 21, Mage = 15.11 years old, SD = 3.047) with mild or moderate intellectual disability (IQ = 54.32, SD = 13.47). The results show a stability of the memory of what happened an hour and a week after the event in relation to the people involved, the apparatus used, and the (...) parts of the body explored. No interaction effects were found between the stability of memory over time and the level of intellectual disability. The level of disability (mild or moderate) only affected the description of the doctor who performed the exploration and the explored parts of the body, showing better results for people with mild disability. In addition, the results highlight the relationship between memory and IQ, especially verbal IQ. (shrink)

Se realizó una investigación en sistemas y servicios de salud de tipo descriptiva transversal, con el objetivo de elaborar un sistema de acciones de capacitación para el profesional de la enfermería comunitaria en la prevención del embarazo en la adolescencia. Se aplicaron métodos teóricos y empíricos propios de la investigación científica. El universo lo constituyeron 20 profesionales de enfermería que laboran en consultorios del Área Salud "Tula Aguilera". La muestra quedó conformada por los 12 profesionales que aceptaron participar en el (...) estudio. El criterio de exclusión fue la libre decisión de cada individuo para participar o retirarse de la investigación. Se aplicó una encuesta estandarizada, previo consentimiento informado, para determinar el nivel de conocimientos sobre salud reproductiva en la adolescencia. Los resultados constatados reflejaron que la mayoría de los encuestados tenían criterios estrechos, no fundamentados científicamente ni actualizados sobre el tema, por lo que se diseñó un sistema de acciones de capacitación basado en conocimientos científicos actualizados, pertinentes y contextualizados. Cada actividad se propuso demostrar la factibilidad e importancia de utilizar técnicas participativas y la fundamentación de las ventajas de su uso en diferentes actividades comunitarias, encaminadas a enfatizar en la organización, movilización, concientización y capacitación a los diferentes sujetos sociales involucrados en la prevención del embarazo en la adolescencia, para que estos se conviertan en transformadores de su propia realidad, en correspondencia con sus necesidades y demandas sociales. A descriptive transversal study was carried out on health systems and services aiming at designing a system of training actions for the community professional nurses in order to prevent pregnancy in adolescence. Theorical and empirical methods were applied. The universe was made up of twenty professionals who consented to participate in the study. The inclusion criterion was the free decision of each individual on either participating or not in the investigation. A standard survey was applied -with a previous informed consent , to determine the knowledge about reproductive health in adolescence. The results revealed that most of the surveyed people had narrow criteria with no updated scientific grounds on the issue, thus a system of training actions based on updated scientific pertinent contextualized information was designed Each activity aimed at demonstrating the feasibility study of using participative techniques as well as the reasons for the advantages of their use in a variety of community activities to emphasize the organization and understanding of the different social subjects involved in the prevention of pregnancy in adolescence. In the last three decades or so a prominent view among legal philosophers has been that while legal theory is evaluative because it requires making judgments of importance, it can remain morally neutral. This view, which I call the ‘orthodox view’, was first articulated by Joseph Raz and has since been supported by many other prominent legal philosophers. In this essay I examine it, and argue that it is indefensible. I begin by examining the terms ‘description’ and (...) ‘evaluation’, and show that they are ambiguous in a way that most current discussion does not realize. I then rely on this analysis to develop several arguments against the orthodox view. I argue that defenders of the orthodox view have considered only one such argument, and that even with regard to this one their response is unsuccessful. (shrink)

Scholars have given attention to the question of whether morally-neutral philosophical analysis of the concept ‘law’ is a sustainable project. Less at- tention has been given to whether the methodological approach that relies on morally-neutral description and explanation, rather than on philosophical analysis, is a defensible project. My primary goal in this paper is to argue that although descriptive/explanatory theorizing is a logically possible project, it is not a defensible one. I claim that there is (...) no reason to insulate legal theorizing from moral arguments. Indeed, it is desirable for legal theorists to employ moral considerations because it is only through moral argument that we can answer important questions we care about with respect to law.Resumen:Muchos teóricos han prestado su atención a la pregunta sobre si el análisis filosófico moralmente neutral del concepto ‘derecho’ es un proyecto sostenible. En cambio, se ha prestado menos atención a discutir si el en- foque metodológico basado en descripciones y explicaciones moralmente neutrales, en lugar del análisis filosófico, es un proyecto defendible. Mi objetivo principal en este artículo es argumentar que, si bien la labor teórica descriptiva/explicativa es un proyecto lógicamente posible, no es, sin embargo, defendible. Yo sostengo que no hay razón para aislar la labor teórico-jurídica de los argumentos morales. Por el contrario, es deseable que los teóricos del derecho empleen consideraciones morales, debido a que es sólo a través de argumentos morales como podemos responder las preguntas que nos preocupan en relación con el derecho. Although prior work on ethical decision-making has examined the direct impact of magnitude of consequences as well as the direct impact of emotions on ethical judgments, the current research examines the interaction of these two constructs. Building on previous research finding disgust to have a varying impact on ethical judgments depending on the specific behavior being evaluated, we investigate how disgust, as well as happiness and sadness, moderates the effect of magnitude of consequences on an individual’s judgments of another person’s (...) unethical behavior. Specifically, we propose and find that because disgust and happiness are both associated with more heuristic-based processing, they both lead to a stronger reliance on the magnitude of consequences when forming ethical judgments. In contrast, because sad and neutral emotional states are associated with more systematic processing, they both result in a weaker reliance on the magnitude of consequences. As such, the effect of magnitude of consequences on judgments of unethical behaviors is stronger when individuals making the judgments are experiencing disgust or happiness versus sadness or a neutral state. This research shows that ethical judgment severity is contingent on individual-level factors, particularly the current emotional state being experienced by the individual, interacting with magnitude of consequences to impact the ethical decision-making process. This paper concludes a special feature of Sustainability Science that explores a broad range of social value theoretical traditions, such as religious studies, social psychology, indigenous knowledge, economics, sociology, and philosophy. We introduce a novel transdisciplinary conceptual framework that revolves around concepts of 'lenses' and 'tensions' to help navigate value diversity. First, we consider the notion of lenses: perspectives on value and valuation along diverse dimensions that describe what values focus on, how their sociality is envisioned, and what epistemic and (...) procedural assumptions are made. We characterise fourteen of such dimensions. This provides a foundation for exploration of seven areas of tension, between: (1) the values of individuals vs collectives; (2) values as discrete and held vs embedded and constructed; (3) value as static or changeable; (4) valuation as descriptive vs normative and transformative; (5) social vs relational values; (6) different rationalities and their relation to value integration; (7) degrees of acknowledgment of the role of power in navigating value conflicts. In doing so, we embrace the 'mess' of diversity, yet also provide a framework to organise this mess and support and encourage active transdisciplinary collaboration. We identify key research areas where such collaborations can be harnessed for sustainability transformation. Here it is crucial to understand how certain social value lenses are privileged over others and build capacity in decision-making for understanding and drawing on multiple value, epistemic and procedural lenses. The paper inculcates the path of modern education by implementing cum ensuing the form and content of moral education from the stances of prescriptivist R. M Hare and existentialist Sartre. In the first part of the paper, Hare’s tune for language-centric moral concepts and its prescriptive plus universalistic application for society enhance an outlook for moral education where learners should be taught to apply morality from a prescriptive sense, not by memorizing it in a descriptive manner. Besides, Sartre’s existentialist appeal (...) delineates moral education as a free choice of a learner where any institutional hegemony becomes trivial. The second part of the paper focuses on the content of moral education. What sort of moral laws make the content of moral education justifiable? Here Russell’s approach takes a pertinent role. We should secure modern education from the social and state’s anarchism. A way out that I depict in the last section of the paper stresses on moral education that evades itself from the repression of the pedagogue or rigid principles. Modern education should quest for why and liberal neutrality not by following the rigid rules obediently. Moral education teaches children about their own rights and the rights of the other in a beneficial manner. (shrink)

The causal characters (spacelike, lightlike, timelike) of the coordinate lines, coordinate surfaces and coordinate hypersurfaces of a coordinate system in Relativity define what is called its causal class. It is known that, in any relativistic space-time, there exist one hundred and ninety nine such causal classes. But in Newtonian physics (where only spacelike and timelike characters exist) the corresponding causal classes have not been discussed until recently. Here it is shown that, in sharp contrast with the relativistic case, in Newtonian (...) space-time the different causal classes of coordinate systems are drastically reduced to four. These causal classes admit simple geometric descriptions and physical interpretations. For example, it is shown that one can generate coordinate systems of the four causal classes by means of the sole linear synchronization group, i.e. by coordinate transformations that only change the origin of time linearly. The relativistic analogs of these examples are also considered. (shrink)

This article discusses Husserl’s “epoche” and “phenomenological reduction” and early Heidegger’s “fear” and “anxiety” from a conceptual and terminological point of view. The basis for comparing “epoche” and “fear” is their main function of neutralizing the world. The author also considers the way of correlating the epoche and anxiety as philosophical concepts with three types of realizable experience that served as their source. The main points and stages of the introduction of the term “epoche” are highlighted; the main functional differences (...) between the terms “epoche” and “phenomenological reduction” in various works of Husserl are indicated. A number of Husserl’s attempts to transform the methodological principles put forward by him into a description of a special experience of detachment, accessible through moral efforts, courage and honesty, are considered. In this regard, the transformation of Cartesian doubt into the procedure of “epoche” through the artificial procedure of “attempt at doubt” is analyzed. Three types of restrictions on the universality of the epoche are distinguished. Terminological and meaningful relationships between neutralization as a mode of consciousness and the epoche are considered. Two main differences are revealed, with the help of which Husserl tries to transform principles into experience: the difference between positional and neutral consciousness and the difference between an epoche and a quasi-epoche. Husserl’s interpretation of the epoche and reduction as a special experience has two main sources: first, the experience of the imagination, or fantasy, and in this sense the source of the epoche is the quasi-epoche, and not vice versa. Secondly, the postulate of the identity of sensation from the real and illusory object. Heidegger’s distinction between fear and anxiety is critically analyzed. The author comes to the conclusion that a common source of the phenomena of anxiety, fear, horror, fright, and so on consists in the collision and mutual penetration of various human worlds. It is impossible to distance oneself from this diversity; further, it is the true source of philosophical reflection. (shrink)

The organizational climate is the work environment conceived by emotions and motivation of an organization and, an optimal way of increasing participation is with working groups in the dependencies to improve: objectives, processes, conflicts, leadership. Thus the objective was to determine the characterization of variables. The method incorporates the quantitative approach, non -experimental design, descriptive level, applied and transversal type, analysis and deductive methods. The results show, there is a high organizational climate level, due to the contribution of three dimensions (...) or aspects that are: economic conditions, management values and organizational policies. Professional medical ethics demands of health care professionals in addition to specific duties and rules of conduct that they embody a responsible and trustworthy personality. In the public discussion, different concepts are suggested to describe the desired implied attitude of physicians. In a sequel of three articles, a set of three of these concepts is presented in an interpretation that is meant to characterise the morally emotional part of this attitude: “empathy”, “compassion” and “care”. In the first article of (...) the series, “empathy” has been developed as a mainly cognitive and morally neutral capacity of understanding. In this article, the emotional and virtuous core of the desired professional attitude—compassion—is elaborated. Compassion is distinguished from sympathy, empathy and pity. Several problems of compassion as a spontaneous, warm emotion for being a professional virtue are discussed: especially questions of over-demand, of justice and of concerns because of a possible threat to the patient’s dignity and autonomy. An interpretation of compassion as processed and learned professional attitude, that founds dignity on the general idea of man as a sentient being and on solidarity, not on his independence and capacities, is developed. It is meant to rule out the possible side effects and to make compassion as a professional attitude and as professional virtue attractive, teachable and acquirable. In order to reach the adequate warmth and closeness for the particular physician-patient-relation, professional compassion has to be combined with the capacity of empathy. If appropriate, the combination of both empathy and compassion as “empathic compassion” can demand a much warmer attitude towards the patient than each of the elements alone, or the simple addition of them can provide. The concept of “care” that will be discussed in a forthcoming article of this sequel is a missing necessary part to describe the active potential of the desired moral attitude of the physician more completely. The reconstruction of the desired professional attitude in terms of “empathic compassionate care” is certainly not the only possible description, but it is a detailed proposal in order to give an impulse for the discussion about the inner tacit values and the meaning of medicine and clinical healthcare professions. Background The birth plan is a tool that allows the self-learning and thoughtful analysis of the women during the birthing process, facilitating their making of decisions and participation, in agreement with the bioethical principles of autonomy and no malfeasance. Goal: To understand the perception and satisfaction of women who presented a birth plan. Methodology: Qualitative, descriptive, observational, retrospective and cross-sectional study. The population of the study was composed of 21 women who presented a birth plan regulated in a Hospital ever (...) since the recording of the presentation of the birth plan was started until 2015. Place: Cartagena. Techniques/methods: Semistructured interview. Results-Discussion: Most women considered the plan as a useful self-learning tool on the meaning of the birthing process, as it favored the communication between the expectant mothers/health professionals. Our informants sought information related to the birthing process from informal sources; most perceived a level of respect of their wishes during the process of giving birth. The use of the birth plan did not imply the perception of loss of the degree of control during the birth, although attention to the written document could be improved. Conclusions The use of the birth plan is a very satisfactory and useful experience for their involvement in their self-care, although in some cases, the births did not proceed according to their plans. Nevertheless, the prevalence of the principle of Non-Malfeasance over Autonomy was evidenced. (shrink)

The objective of the research is focused on the study of the evolution of sexism as a cultural parameter in the Roma population whose people maintain recognition as an ethnic minority in Europe. The design selected for this study is descriptive. This study involves testing the reliability of the reduced version of the ambivalent sexism inventory (ASI; Glick and Fiske, 1996) scale among a representative group of the Roma population belonging to the city of Toledo. A representative sample of 44 (...) people aged between 16 and 40 years was selected, with an average of 27.3. The results confirm the reliability of the scale and provide little differentiation and sex-disaggregated results. The responses on the items show a high degree of sexism among the participants. The obtained results give a better understanding of the scope of gender roles and, therefore, can help us to reorient interventions in the prevention of gender inequalities or early school dropouts among Roma girls. BackgroundImplementing the routine consultation of patient advance directives in hospital emergency departments and emergency medical services has become essential, given that advance directives constitute the frame of reference for care personalisation and respect for patients’ values and preferences related to healthcare. The aim of this study was to assess the levels and relationship of knowledge and attitudes of nursing and medical professionals towards advance directives in hospital emergency departments and emergency medical services, and to determine the correlated and predictor variables (...) of favourable attitudes towards advance directives.MethodsObservational, descriptive, and cross-sectional study. The study was conducted in the emergency department of a second-level hospital and in the emergency medical service. Data collection was performed from January 2019 to February 2020. The STROBE guidelines were followed for the preparation of the study.ResultsA total of 173 healthcare professionals responded to the questionnaire. Among them, 91.3% considered that they were not sufficiently informed about advance directives, and 74% acknowledged not having incorporated them into their usual practice. Multinomial analysis indicated a statistically significant relationship between the variable emergency medical service and having more favourable attitudes towards consulting the advance directives in their practical application (OR 2.49 [95% CI 1.06–5.88]; p = 0.037) and compliance in complex scenarios (OR 3.65 [95% CI 1.58 − 8.41]; p = 0.002). Working the afternoon and night shift was a predictor variable for obtaining a higher score with respect to attitudes in complex scenarios.ConclusionThere is an association between the level of knowledge that nursing and medical professionals have about advance directives and the scores obtained on the attitude scales at the time of practical implementation and in complex scenarios. This shows that the more knowledge professionals have, the more likely they are to consult patients' advance directives and to respect their wishes and preferences for care and/or treatment. In professional medical ethics, the physician traditionally is obliged to fulfil specific duties as well as to embody a responsible and trustworthy personality. In the public discussion, different concepts are suggested to describe the desired moral attitude of physicians. In a series of three articles, three of the discussed concepts are presented in an interpretation that is meant to characterise the morally emotional part of this attitude: “empathy”, “compassion” and “care”. In the first article of the series, “empathy” has (...) been developed as a mainly cognitive and morally neutral capacity of understanding. In the second article, the emotional and virtuous core of the desired professional attitude—compassion—has been presented. Compassion as a professional attitude has been distinguished from a spontaneous feeling of compassion, and has been related to a general idea of man as vulnerable and solidary being. Thus, the dignity of the patient is safeguarded in spite of the asymmetry of compassion. In this article, the third concept of the triad—“care”—is presented. Care is conceived as an attitude as well as an activity which can be directed to different objects: if it is directed to another sentient being, it is regarded as intrinsically morally valuable; implying (1) the acceptance of being addressed, (2) a benevolent inclination to help and to foster, and (3) activity to realize this. There are different forms of benevolence that can underlie caring. With regard to the professional physician’s ethos, the attitude of empathic compassion as developed in the two previous articles is proposed to be the adequate underlying attitude of care which demands the right balance between closeness and professionalism and the right form of attention to the person of the patient. ‘Empathic compassionate care’ does not, however, describe the whole of the desired attitude of a physician, but focuses on the morally-emotive aspects. In order to get also the cognitive and practical aspects of biomedicine into the picture, ‘empathic compassionate care’ has to be combined with an attitude of responsibility that is more directed to decision-making and outcome than a caring attitude alone can be. The reconstruction of the desired professional attitude in terms of “empathic compassionate care” and “responsibility” is certainly not the only possible description, but it is a detailed proposal in order to give an impulse for the discussion about the inner tacit values and the meaning of medicine and clinical healthcare professions. RESUMEN Introducción: El proceso de cuidar es el resultado de una construcción propia de cada situación, se origina con la identificación de los problemas de salud y las necesidades reales o potenciales de las personas, familia y comunidad que demandan cuidado. Objetivo: Evaluar el impacto del Diplomado Prevención del Síndrome de Burnout, en el autocuidado del personal de enfermería de la Atención Secundaria de Salud de la provincia Camagüey. Métodos: Se realizó un estudio descriptivo observacional, en el Hospital Amalia Simoni (...) Argilagos de Camagüey, durante el Diplomado Prevención del Síndrome de Burnout dirigido al personal de enfermería de la Atención Secundaria de Salud. Para ello se aplicó una encuesta y el Test Psicológico de Maslach y Jackson al inicio y al final de la aplicación del Diplomado. Los datos aportados por estos instrumentos se complementaron con los provenientes de la aplicación de la técnica del PNI. Resultados: Predominó el sexo femenino. El total de los cursistas son licenciados en Enfermería. Con la ejecución del diplomado se constatan cambios importantes en cuanto a la autopreparación, el rendimiento, los hábitos de descanso, satisfacción personal y realización de ejercicios físicos. Discusión: La aplicación del diplomado logró transformar estilos de trabajo, afrontamientos al estrés, así como una mejor satisfacción personal y colectiva. ABSTRACT Introduction: The process of taking care is the result of a proper construction of every situation, it originates with the identification of the problems of health and the real or potential needs of the persons, family and community that demand care. Objective: To evaluate the impact of Postgraduate Course Prevention of the Syndrome of Burnout, in the self-care of the personnel of infirmary of the Secondary Attention of Health of the Camagüey province. Methods: a descriptive, observational study was carried out in the Hospital Amalia Simoni Argilagos of Camagüey, during Postgraduate Course Prevention of the Syndrome of Burnout directed to the personnel of infirmary of the Secondary Attention of Health. For that reason, a survey and the Psychological Test of Maslach and Jackson was applied at the beginning and at the end of the application of the course. The information contributed by these instruments complemented itself with the originated ones from the application of the technique of the PNI. Results: The sex that predominated was the feminine one. All of the students are licensed in Infirmary. With the execution of the course important changes are stated as for the self-preparation, the yield, the habits of rest, personal satisfaction and achievement of physical exercises. Discussion: The application of the course managed to transform styles of work, confrontations to the stress, as well as a better personal and collective satisfaction. (shrink)

Introduction Good quality of care is dependent on nurses’ strong clinical skills and moral competencies, as well. While most nurses work with high moral standards, the moral performance of some nurses in some organizations shows a deterioration in their moral sensitivity and actions. The study reported in this paper aimed to explore the experiences of nurses regarding negative changes in their moral practice. Materials and methods This was a qualitative study utilizing an inductive thematic analysis approach, which was conducted from (...) February 2017 to September 2019. Twenty-five nurses participated in semi-structured interviews. Results The main theme that emerged from our analysis was one of moral neutralization in the context of an unethical moral climate. We found five sub-themes, including: feeling discouraged; normalization; giving up; becoming a justifier; and moral indifference. Conclusions Unethical moral climates in health organizations can result in deterioration of morality in nurses which can harm both patients and health systems. Some unethical behaviors in nurses can be explained by this process. (shrink)

For decades, Anderson has been pressing critical theorists and literary scholars to acknowledge the inescapably normative dimensions of their work. Through careful attention to rhetorical styles, she has persuasively argued that epistemological positions and social theories are tethered to “characterological” judgments—to implicit endorsements of ethos. Meanwhile, critical discourse has warmed to the claims of lived experience (the “turn to ethics,” the interest in “affect”), but the “ethical” has remained a negative movement, either as the critique of social and discursive structures (...) or as clearing space for the “other”—and “affect” has been construed as the pleasure and self-care that enable resistance to the pressure of these structures. The questions that galvanize ethical criticism (What is wrong with the way things are?) and theories of affect (How can I survive?) continue to evade the deeper one that Anderson sees as basic to any theorizing: How should I live?The lesson of Anderson's The Way We Argue Now is that ethics without ethos is shallow. In Psyche and Ethos, the lesson is that psychology without morality is benumbed. Though Anderson is characteristically judicious in her reconstruction of the arguments she opposes, there are several rhetorical targets in these lectures. The first is contemporary cognitive science, which pictures moral thinking as either the “belated” rationalization of decisions really made by “automatic” psychological processes or as a mechanism for eliminating “cognitive dissonance.” Anderson shows how these pictures assume an abstracted, “punctual” model of moral experience; their “deflationary” zeal ironically depends on an untenable ideal of moral voluntarism that is then speciously “debunked.” By contrast, novels are able to explore the temporal dimension of moral consciousness, especially through their representation of what she calls “moral rumination,” a concept further developed in her recent contribution to Character: Three Inquiries in Literary Studies. Anderson shows, moreover, that narrative fictions like The Winter's Tale, Middlemarch, and The Beast in the Jungle understand “belatedness” not as evidence for the superficiality of morality but as a distinct mode of moral recognition that can unfold only across time.Anderson worries that the new “eudaimonic” literary criticism, which explores “enabling moods,” unwittingly perpetuates the moral confusion of empirical psychology and “privileg[es] psychological over moral desiderata,” even as certain “psychological states” are “presented as morally desirable.” This contradiction is another iteration of one she has been confronting throughout her career: the strange incapacity of critical discourse either to recognize or to avow the normative claims—the elaboration of an ethos as good or valuable—with which it is nonetheless saturated. Still, the contradiction has been a defining feature of modern “therapeutic culture” (a formulation she employs): the neutral, functionalist descriptions of empirical psychology ostensibly bracket morality, yet some descriptions are inevitably coded as “better” or “worse,” and they are consistently harnessed to fully moral evaluations. It is rare to hear a literary theorist of Anderson's provenance reanimate, if indirectly, the criticism that Philip Rieff, Christopher Lasch, and Jackson Lears directed toward “therapeutic culture,” which has largely been forgotten or vulgarized by right-wing pundits. In essence, however, her plea is similar to theirs: she wants us to acknowledge that the moral life is integral to the “healthy” life; and she wants critics to stop dismissing it as epiphenomenal to either psychology or politics. She sees the novel, and the humanities more broadly, as the preeminent cultural vehicles for “clarifying” the moral life. (shrink)

ABSTRACT The paper addresses the fundamental issue of the morality of terrorism. It distinguishes four types of terrorism—‘predatory,’‘retaliatory,’‘political’and ‘moralistic’—and argues that in all of them terrorism (in a ‘descriptive,’value‐neutral sense of the word) is always wrong. After a short introductory section the paper considers in some detail the conceptual problem of defining ‘terrorism’. Next it considers the possible application to terrorism, with the necessary modifications, of two main conditions of a ‘just war’; viz. the Principles of Discrimination and of (...) Proportion. It argues that these conditions support the paper's central contention. Additional support is then found in the concept and principles of human rights. In the final section the paper evaluates utilitarian arguments brought forth by Kai Nielsen in Violence and Terrorism: its uses and abuses, in support of so‐called ‘revolutionary terrorism’. Throughout the discussion is illustrated by some actual examples from the recent past. (shrink)

I offer you some theories of intellectual obligations and rights (virtue Ethics): initially, RBT (a Right to Believe Truth, if something is true it follows one has a right to believe it), and, NDSM (one has no right to believe a contradiction, i.e., No right to commit Doxastic Self-Mutilation). Evidence for both below. Anthropology, Psychology, computer software, Sociology, and the neurosciences prove things about human beliefs, and History, Economics, and comparative law can provide evidence of value about theories of rights. (...) However, insofar as we have methods within Philosophy to help us formulate precise concepts of 'belief' and 'rights', methods that also help us to prove links (or absence thereof) amongst families of concepts of rights and belief, our discipline is in and of itself capable of sound reasoning about issues as puzzling as the following. Suppose a Jane who does not believe in God yet who believes she ought to so believe: Jane is undergoing doxastic moral regret (moral regret for lack of faith). We have all known such Janes and perhaps at one time or another even been one. Paradox: given RBT and NDSM, Jane as described not only does not exist, Jane cannot exist. Thus, to enrich the ways in which Philosophy need not get all its evidence from other academic disciplines, I present a brief introduction to what I call Neutral Universal Frames (NUFs). NUFs solve hard puzzles about interactions among modal concepts of belief and rights, concepts that occur in RBT, NDSM and the description of our Janes. NUFs for theories precisely articulated via any two or more modal concepts are a powerful and immensely general set of tools enabling us to define rich theories of truth ("models on frames") to test philosophical theories for internal consistency and to prove the existence of connections (or absence thereof) amongst alternative articulations of philosophical theories. NUFs thereby add to the constructive knowledge producing way Logics intersect with Philosophy of Religion. And we will soon see why Jane, be she named 'Jane' or known simply as you: cannot exist. I argue, contra Dreier, Blackburn, and others, that there are no morally neutral metaethical positions. Every metaethical position commits you to the denial of some moral statement. So, for example, the metaethical position that there are no moral properties commits you to the denial of the moral conjunction of 1) it is right to interfere violently when someone is wrongly causing massive suffering and 2) it is wrong to interfere violently when only non-moral properties are at stake. How should we act when uncertain about the moral truth, or when trying to remain neutral between competing moral theories? This dissertation argues that some types of actions and policies are relatively likely to be approved by a very wide range of moral theories—even theories which have never yet been formulated, or which appear to cancel out one another's advice. For example, I argue that actions and policies which increase a moral agent's access to primary goods also tend to (...) increase that agent's likelihood of bringing about good consequences, even under varying and mutually incompatible hypotheses about what consequences count as "good". We therefore have a subjective, pro tanto moral reason to perform such actions and enact such policies—one whose justification does not require treating any particular theory as especially probable, but instead merely requires treating at least one at-least-partly consequentialist moral theory as an open hypothesis, and is therefore applicable even under conditions of moral uncertainty or moral neutrality. My discussion begins abstractly, but as it progresses it gradually applies its framework to increasingly concrete issues. I find that the justification of some liberal policies—in the classical sense of "liberal"—can be accomplished with significantly fewer moral assumptions than have traditionally been relied upon. ABSTRACT A growth mixture modeling (GMM) analysis of neutralization scores in 1,830 youth across six waves of data revealed evidence of a three-class model in which moral neutralization either increased (low accelerating), decreased (high decelerating), or remained the same (moderate stable) over time. Controlling for age, sex, race, group assignment, and Wave 1 delinquency, an analysis of covariance revealed a significantly greater increase in Wave 6 delinquency in the moderate stable group than in the low accelerating group. When the average (...) neutralization score was added as a control variable, the low accelerating group was highest, the moderate stable group next highest, and the high decelerating group lowest on Wave 6 delinquency. These results indicate that change in the pattern of neutralization scores (accelerating, stable, decelerating) may be as important as the level of moral neutralization at any particular point in time in determining the effect of neutralization on future delinquency. The contemporary sociology of morality is a form of descriptive ethics that shrinks away from any sort of prescriptive ethics. Building on the moral philosophies of John Dewey, and also of Alasdair MacIntyre and Paul Ricoeur, and in dialogue with recent work by Stefan Bargheer, this article proposes a more ambitious program of critical social ethics that connects concerns with character and the common good but tempers them with attention to alienation and oppression.

Scientists and engineers lack the equivalent of an ethics committee to which their colleagues in the medical profession may turn when ethical dilemmas arise. In the US workers in aerospace industry have campaigned for a Technology Bill of Rights. In the UK there has been a vigorous movement around the concept of socially useful and environmentally desirable technology. The organisation Scientists for Social Responsibility has set up a panel of scientists who can advise younger colleagues on issues of ethical responsibility.

Abstract:We aim in this paper to explore several related challenges to contemporary analytical legal theorists who accept as theoretically foundational the state-based view of legality and legal system advanced by H.L.A. Hart. We contend that this approach contains internal explanatory problems which limit the view’s capacity to account for novel prima facie legal phenomena outside the typical experience of the law-state. We supplement the analytical approach by advancing the rudiments of what we call an ‘inter-institutional theory of legality,’ a theory (...) of legality derived from a morally-neutral, descriptive-explanatory picture of legal system qua system of legal institutions. Our theory additionally enables us to account for the novel prima facie legal phenomena we identify, and to conclude that while prior analytical legal theorists’ approaches to legality and legal system were historically right to depart from the example of the municipal legal system, that example and departure point are no longer most salient, so explanation of the legality within the state is no longer sufficient as a general explanation of legality.Resumen:En este artículo los autores se proponen explorar diversos retos que enfrentan los teóricos analíticos del derecho contemporáneos, los cuales han aceptado que una perspectiva estatista del sistema jurídico y de la legalidad —introducida por H. L. A. Hart— es fundamental como punto de partida en la teoría. Los autores sostienen que este enfoque contiene problemas explicativos internos que limitan su capacidad para explicar fenómenos jurídicos prima facie novedosos que no se ajustan a la experiencia paradigmática de un derecho-estado. Los autores reformulan el enfoque analítico mediante la introducción de las bases de lo que deno minan una “teoría de la legalidad interinstitucional”, esto es, una teoría de la legalidad derivada de una noción moralmente neutral, descriptiva y explicativa del sistema jurídico como un sistema de instituciones jurídicas. Esta teoría permite, además, explicar los fenómenos jurídicos prima facie novedosos que identifican los autores; y concluir que si bien los enfoques anteriores hacia el sistema jurídico y la legalidad de los teóricos analíticos estuvieron históricamente en lo correcto al tomar como punto de partida el ejemplo de un sistema jurídico municipal, ese ejemplo y punto de partida han dejado de ser relevantes, dicho ejemplo y punto de partida no resulta suficiente, por lo que la explicación de la legalidad dentro de los confines del Estado no es suficiente para una explicación general de la legalidad. Hart identified a utilitarian tradition in jurisprudence, which he associated with Jeremy Bentham and John Austin. This tradition consisted in three doctrines: the separation of law and morals; the analysis of legal concepts; and the imperative theory of law. I argue, contrary to Hart, that Bentham did not adopt a 'positivist' conception of law whether understood in terms of the separation of legal theory and morality or in terms of the separation of law and morals. Misinterpreting Bentham's approach to the (...) analysis of language, Hart was wrong to assume that Bentham's jurisprudential project was a precursor to his own attempt to provide a morally neutral description of a legal system. It was this assumption that led to mistakes in Hart's editing of Of Laws in General. Bentham's utilitarian theory of law should be recognised as a distinct alternative to Common Law and Natural Law theories. (shrink)

As an alternative to attempts to impose models of personal moral development (e.g. Kohlberg) upon organisations we propose an evolutionary model of managing ethics in organisations. The Modes of Managing Morality Model that we suggest, is based on an analysis that explains why business organisations tend to move from less complex modes of managing ethics to more complex modes thereof. Furthermore, it also identifies the dominant ethics management strategies that characterise each of the stages. It is done in a way (...) that avoids claiming that the more advanced modes of managing ethics necessarily represent moral development by business organisations. Instead of claiming the organisations develop morally, we claim that organisations move through an evolutionary process of improving their sophistication in managing ethical performance. (shrink)

Tattoos are widely regarded as morally neutral, and the decision to have them as carrying no ethical implications. The aim of this paper is to question this assumption. I argue that decisions to have tattoos involve risks that are not merely prudential—they are normative. The argument starts with a thesis that the power we presently have over our lives is constrained by the need to respect our future selves. If we make a discretionary choice that disregards our future (...) interests and preferences, then, under certain circumstances, we can be morally to blame. I argue that certain decisions to get tattoos fit this description. Therefore, getting some tattoos makes us blameworthy. (shrink)

A target question for the scientific study of consciousness is how dimensions of consciousness, such as the ability to feel pain and pleasure or reflect on one’s own experience, vary in different states and animal species. Considering the tight link between consciousness and moral status, answers to these questions have implications for law and ethics. Here we point out that given this link, the scientific community studying consciousness may face implicit pressure to carry out certain research programs or interpret results (...) in ways that justify current norms rather than challenge them. We show that because consciousness largely determines moral status, the use of nonhuman animals in the scientific study of consciousness introduces a direct conflict between scientific relevance and ethics—the more scientifically valuable an animal model is for studying consciousness, the more difficult it becomes to ethically justify compromises to its well-being for consciousness research. Finally, in light of these considerations, we call for a discussion of the immediate ethical corollaries of the body of knowledge that has accumulated and for a more explicit consideration of the role of ideology and ethics in the scientific study of consciousness. The social intuitionist approach to moral judgments advanced by social psychologist Jonathan Haidt presupposes that it is possible to provide an explanation of the human moral sense without normative implications. By contrast, Iris Murdoch’s philosophical work on moral psychology suggests that every description of morality necessarily involves evaluative features that reveal the thinker’s own moral attitudes and implicit philosophical pictures. In the light of this, we contend that Haidt’s treatment of the story about Julie and Mark, two siblings who (...) decide to have casual, protected, and in his view harmless sex, provides a too simplistic picture of what is involved in understanding human morality. Despite his aim to explain the roots of moral judgments, he fails to provide a deeper understanding of morality in two different respects. First, he does so by suggesting that his story contains all the relevant information needed to take a moral stand on it, and by rejecting as irrelevant the wider human context in which questions about sexual and family relations arise. Second, he simplifies the responses of the people who are subject to his experiment by disregarding their various reasons for disapproving and by equating understanding human morality with explaining an impersonal psychological process. This article questions a number of widely held views of the role of values in psychotherapy. It begins with a discussion of the now largely discredited view that psychotherapy can be value free. It also broadens this challenge to question the popular idea that values form an inescapable part of the therapeutic encounter. While this view is correct in outline, it is necessary to reject the underlying conception of values as largely arbitrary preferences that the client and the therapist bring (...) to the encounter, as this fails to do justice to the inherently ethical nature of psychotherapy. It argues that we should recover the Greek notion of therapy as essentially concerned with the character of a person. In other words, the goal of therapy is virtue. (shrink)
