As a result of financial difficulties confronting American agriculture, public debate is focusing on longterm options for restoring economic stability and growth to the agricultural economy. Many believe that just as homeowners in small communities throughout the nation have been served by the development of a secondary market for residential mortgages sponsored by the federal government, farmers throughout the country would similarly benefit from the development of a secondary market for farm real estate mortgages. This paper discusses issues (...) relating to the development of a secondary market for agricultural real estate loans. The concept of a secondary market for agriculture is of considerable interest to Congress, as evidenced by recent enactment of the Agricultural Credit Act of 1987 which established the Federal Agricultural Mortgage Corporation (“Farmer Mac”) to create a secondary market for farm real estate loans. The first section discusses the general nature of secondary markets and their purposes, with particular attention given to the secondary market for home mortgages because it served as a model for a secondary market for farm loans. Section two discusses basic differences between agriculture and housing, and section three provides a brief discussion of federal credit subsidies designed to help meet social and economic goals by influencing the allocation of credit to particular sectors of the economy such as housing and agriculture. As an object in which property rights can be invested, land is a peculiar hybrid structure that comprehends both spatial and non-spatial aspects. Even in its purely spatial aspect land is treated differently from culture to culture, thus for example in the degree to which property rights in land are held to relate to vague or precisely delineated parcels and to portions of space above and below the surface of the earth. When we examine the non-spatial aspects of landed property, (...) however, the dimensions of variability across cultures are multiplied tremendously. The goal is to provide a general framework for comparison of different socio-legal ontologies of land. The relevance of this project turns on the fact that without land (or real estate) it is difficult (perhaps impossible) to obtain credit; without credit it is difficult for nations to develop. Thus, if land is treated in a radically different way from one nation to another, this will surely exert an effect upon the development of nations. (shrink)

Several recent articles in the field of ethics and business have raised questions concerning the viability of professional ethical codes. Are such codes serious, effective tools for promoting and enforcing an ethical standard of behavior? Or do the codes more closely resemble clever, elaborate public-relation ploys? The purpose of this paper is to analyze the content, role and efficacy of one such ethical code, namely, The Code of Ethics of the National Association of Realtors. The paper examines the ethical principles (...) embodied, implicitly or explicitly, in this Code; it tests these principles for coherence, comprehensiveness, clarity and enforce-ability. Furthermore, it seeks to determine whether this Code articulates standards of ethical conduct that are higher than those already required by law and whether the Code successfully translates a general ethical vision down to concrete, everyday real estate practice. Due to the development of transnational communicative and economic structures, nation states are increasingly unable to be the starting point for journalistic regulation. In this chapter, therefore, I raise the question whether it is possible – and desirable – to have transnational rules for ethically good journalism. I argue that ethical evaluations should focus upon the meeting between normative ideals and factual realities. This meeting is always open because ideals can challenge reality, just as reality can challenge ideals. Ethical (...) questions are thus always raising a fundamental “maybe”. Traditionally the ideals of journalists have been articulated in close affiliation with ideas of the Fourth Estate. However, due to our globalised communicative structure, this articulation is in need of revision. I argue that the ethical requests change because the structure of Internet-based publics changes. Departing from this situation I suggest that journalistic products are ethically urgent insofar as they both bring communities together and give voice to the inarticulate or voiceless. I argue that in order to substantiate this approach it is important to articulate rules, because rules further the possibility of deliberating disagreements. The notion of deliberating disagreement is at the core of ethical discussions. I suggest that Habermas’ discourse ethics account may serve as a starting point for articulating a robust body of journalistic ethics. However, two moderations are important: On one hand, the rules and codes should be articulated against a “globalised we”, rather than against the nation state. On the other hand, it is important to realise that the rules do not robustly prescribe what to do. They should serve as a starting point for articulating and discussing disagreements. The openness of the global “maybe” does not call for global agreement but rather for the possibility of discussing disagreements. (shrink)

Traditionally, people, territory, and rights must align to justify state control. However, states have recently shifted their borders so that these three elements are decoupled. How should we understand state legitimacy then? This paper examines three contemporary responses to the phenomenon of shifting borders. First, sovereigntism seeks to stabilize the relation of people and territory, even if that requires limiting the scope of rights. Second, democratic cosmopolitanism tolerates shifts in territory, as long as the people and rights coincide. Finally, the (...) Watershed Model keeps rights within the territory, but it accepts changes in the people, as it separates democratic governance and rights from a particular national identity. The paper argues that the Watershed Model can better respond to the challenges posed by human mobility in times of planetary crises. Tradicionalmente, pueblo, territorio y derechos deben coincidir para justificar el control estatal. Sin embargo, los Estados han desplazado recientemente sus fronteras de modo que estos tres elementos se encuentran desacoplados. ¿Cómo debemos entender entonces la legitimidad del Estado? Este artículo examina tres respuestas contemporáneas al fenómeno del desplazamiento de las fronteras. En primer lugar, el soberanismo trata de estabilizar la relación entre pueblo y territorio, aunque para ello haya que limitar el alcance de los derechos. En segundo lugar, el cosmopolitismo democrático tolera los desplazamientos del territorio, siempre que pueblos y derechos coincidan. Por último, el modelo de la cuenca hidrográfica mantiene los derechos dentro del territorio, pero acepta cambios en el pueblo, ya que separa la gobernanza democrática y los derechos de una identidad nacional concreta. In a first wave—during the decades preceding and following the French Revolution, roughly the years 1780-1848—the framework for the nation-state was created. (...) It was mainly the liberal bourgeoisie which stood at the forefront. After the Congress of Vienna, where the “ante bellum” situation had been restored, it led more or less successful national revolutions in Germany, Italy, Spain, Belgium, and Poland. In a second wave, starting with the Franco-Prussian War of 1870 and ending with the First World War, the framework of the nation-state was filled in. In those years a growing number of social groups found accommodation in the liberal house, which they also managed thoroughly to rebuild. This period can be described as the phase of integrated nationalism.Together with the nation-state came the rise of modern national his-toriography. The most well-known exponents of this typically nineteenth-century genre were the monumental outlines of national pasts which started appearing from 1890 onward. Karl Lamprecht in Germany (Deutsche Geschichte, 1890–1909), Pieter Jan Blok in the Netherlands (Geschiedenis van het Nederlandsche Volk, 1892–1908), Henri Pirenne in Belgium (Histoire de Belgique, 1900–1932), and Ernest Lavisse and his collaborators in France (Histoire de France, 1901–11) all gave their respective countries’ pasts an impressive, scholarly design. The first phase of the emergence of the nation-state, however, was also ac-companied by a stream of national histories. Johannes von Müller in Switzerland (Geschichten Schweizerischer Eidgenossenschaft, 1786–1808), Simonde de [End Page 329] Sismondi in Italy (Histoire des Républiques italiennes du Moyen Age, 1807–18), Augustin Thierry in France (Lettres sur l’Histoire de France, 1820–27), and Willem Bilderdijk in the Netherlands (Geschiedenis des Vader-lands, posthumously 1833–53) all became authors of patriotic and romantically tinted surveys and studies of (fragments from) their own national history.The work of this second group of historians fits with the cultural nationalism which took root during the last decades of the eighteenth and the beginning of the nineteenth centuries and which is sometimes considered to have been the heart of romantic nationalism. 1 The supporters of this nationalism were con-vinced that culture, lifestyle, and social institutions could only be understood as the expression of the “soul,” the “spirit,” or the “character” of a people or nation. They tried to deduce this individual character through the language, popular literature, art, and “national” (as opposed to Roman) law, as is demonstrated by the Gaelic revival in Ireland. 2 History, however, also attracted their interest; the nation and the people were after all considered to be dynamic entities which developed along the lines of a multiple causal process. In England, for example, where nationalism arose as a protest against excessive foreign—French—cultural influence, a group of historians, among them Catherine Macaulay and John Pinkerton, started publishing nationalistic histories during the early years of George III’s reign, paying special attention to the origin of the English people. 3 Such cultural nationalism could, however, easily take on political overtones, especially when it was the nationalism of a people who were either stateless or dispersed throughout different states, or whose state was still young.These earliest national histories were meant as a contribution to the formation, consolidation, and confirmation of a national identity. Their writers had to lend unity, specificity, and continuity to the national past. They had to, as Novalis observed in 1798, “organize historical essentials.” 4 Their work was less a matter of reconstruction than of construction. In this paper, which brings together aging research and media research, we will contribute to the mapping of the complicated cartography of anti-aging by analyzing the press coverage of anti-aging medicine. The mass media decisively shape societal impacts of the expert scientific discourse on anti-aging. While sensitivity towards the heterogeneity of the field of anti-aging is increasing to some degree in the social-gerontological discussion, the role of the media in transmitting the various anti-aging messages to the general public has so (...) far not been systematically scrutinized. Current opinions on the press coverage of anti-aging medicine range from proponents’ complaints of a media witch-hunt against them to opponents’ reproaches about uncritical reporting of this complex topic. This paper discusses whether the media act accordingly to the ideal of the fourth estate, controlling the increased power of science in the 20th century. Our areas of investigation are two Western countries: the USA and Germany. Both countries have experienced an apparent increase in the average age of their populations, which has led to increasingly vigorous public debate since the late 20th century. The subjects of our study are three organizations that represent different approaches to anti-aging medicine: the American Academy of Anti-Aging Medicine, the German Society of Anti-Aging Medicine, and the Methuselah Foundation. The article discusses the programs, goals, and media strategies of these organizations and compares them with the anti-aging messages that actually make their way to the reader in the media “interdiscourse.” The article asks whether transatlantic learning processes within the anti-aging medicine movement as well as in the media can be identified. The paper’s methods and sources are those of contemporary history and ethnography. The three approaches to anti-aging medicine are drawn from publications of spokespersons from the three presented anti-aging medicine organizations and from participant observation of anti-aging medicine conferences in Germany and Europe during the period from 2005 to 2008. The media analysis is based on the study of about 300 articles that appeared between 1990 and 2009 in US and German dailies and weeklies such as Newsweek, The New York Times, Der Spiegel, and Die Welt. Our analysis shows that, against the backdrop of pessimistic demographic apprehensions, the leitmotiv of both nations’ medical journalism between 1990 and 2009 was overwhelmingly pro anti-aging medicine. It is criticized that medical journalism on anti-aging medicine refrains from own investigations on potential risks. Scrutinizing activities of the media in terms of a fourth estate require stimulation from science itself. Hence, we argue for sensitization of medical journalism regarding ageism. (shrink)

This article traces some aspects of the transformation of South African wildlife management during the 1930s to the 1960s from game reserves based on custodianship and the "balance of nature" into scientifically managed national parks with a philosophy of "command and control" or "management by intervention." In 1910 the four (...) British colonies had formed the Union of South Africa, and by the 1920s there was wide acceptance of national parks, a development influenced by their success in the United States. It was not, however, until after the Second World War, that management of the expanding conservation estate altered from a rather unsystematic laissez faire variety, into more scientifically informed management practices with an efficient bureaucracy in charge. This was achieved by modifications in organizational structures and institutional cultures initiated by a change of government in 1948 which, this article argues, impacted in turn on wildlife management and shaped and professionalized many aspects of that field science. "Management by intervention" was the hallmark of South African wildlife and conservation biology from the 1960s until recently, when there have been shifts towards "adaptive resource management" in a period of further change in the country's politics. This article offers an alternative reading of the Abbé Sieyès and the modern ‘nation-state’ problématique. I argue that the subject/object that is constituted in the early days of modernity is the incomplete society: an impossible-possibility ideal of congruency of population, authority and space. I suggest reading this ideal of congruency as a fantasy in that it offers a certain ‘fullness to come’, the promise of jouissance that can never be attained and is thus constantly re-envisioned and reinvoked. Drawing on (...) discourse-analytical and psychoanalytical tools I explain the logic of fantasy before analysing Sieyès’ What is the Third Estate?, as I show how he critiques and fragments the old model of the state and how his reading of the nation is fantasmatic, a continuous project towards impossible congruency. In her reminiscences, she reflected on the pivotal event as follows:[A]fter ten years of ever-increasing persecutions [...] I was obliged to leave two homelands as (...) a fugitive, Switzerland and France, by order of a man less French than I. For I was born on the banks of the Seine, where his only claim to citizenship is his tyranny. He saw the light of day on the island of Corsica, practically within Africa’s savage sway. His father did not, like mine, devote his fortune and his sleepless nights to defending France from bankruptcy and famine; the air of this beautiful country is not his native air; how can he understand the pain of being exiled from it, when he considers this fertile land only as the instrument of his victories. [End Page 231] Where is his patrie? It is any country that accepts his domination. His fellow-citizens? They are whatever slaves obey his orders.1In this passage, de Staël deliberately links nationality and citizenship. In her view, citizenship status was acquired simply by being born on French soil. Her family’s tireless labors on behalf of the nation added another irrefutable proof of Frenchness. In addition, growing up in France and breathing the country’s invigorating air had created an emotional attachment that a person raised elsewhere simply could not fathom. We thus have a triad of birth/service/sentiment that connects the deserving individual to his or her nation (in this case la grande nation).In this essay I explore de Staël’s understanding of the twin concepts of nationality and citizenship through the lens of gender. Nationality and citizenship were of perennial concern to her thought, partly because of the turbulent times she lived in, partly because of her personal experience in exile. Influenced by history and literature, she early on admired the gallant men with muskets who heroically sacrificed their lives for the glory of the nation. But it was the exceptional women with lyres who were destined to act as the nation’s unifying agents by recreating the gallants’ deeds in writing. By imagining the nation these women fulfilled the supreme task of citizenship. In what follows I will argue that de Staël conceived of the ideal citizen as a woman writer or artist who served her nation by inspiring its members with enthusiasm and virtue.2 In elaborating her view of the superior woman as citoyenne and national muse she made an important contribution to the debate on the nation and the citizen.The only daughter of Louis XVI’s finance minister Jacques Necker and the salonnière Suzanne Curchod-Necker, of Genevan and Vaudois citizenship respectively, de Staël gained fame and notoriety through her brilliant conversational talents, political intrigues, and unconventional relationships with famous men. Though she considered herself a “true Frenchwoman” (véritable française),3 she was a citizen of Geneva and a Swedish subject by marriage, at least until 1803 when she took advantage of the Code Civil [End Page 232] and officially claimed French citizenship.4 Considering this multiplicity of conflicting loyalties, it is not surprising that her major writings reveal a sustained preoccupation with these issues.Despite their undeniable significance for early nineteenth-century European intellectual history, historians have so far devoted scant attention to de Staël’s writings. In fact, in the US, Staëlien studies have largely been dominated by literary criticism and theory.5 This has had the effect of prioritizing her novels over her non-fiction, downplaying the historical context of her oeuvre and, most grievously, ignoring de Staël’s historical contribution to socio-political thought.6 As a result of the complex ways in which her personal experience informed her writing, her oeuvre is best examined as a unified, though certainly inconsistent, whole. ABSTRACTSome people might argue that there are already too many different documents, guidelines, and regulations in bioethics. Some overlap with one another, some are advisory and lack legal force, others are legally binding in countries, and still others are directed at narrow topics within bioethics, such as HIV/AIDS and human genetics. As the latest document to enter the fray, the UNESCO Declaration has the widest scope of any previous document. It embraces not only research involving human beings, but addresses broader (...) concerns in medicine and healthcare. The UNESCO draft declaration has some minor weaknesses, but on the whole, the strengths outweigh the weaknesses. One weakness is that some items in the draft are stated in a way that is too restrictive, thereby appearing to rule out legitimate activities. A strength of the Declaration is that it is relatively brief, yet at the same time contains sufficient detail to make it something more than a rehearsal of mere pieties. As the most recent of the numerous bioethics and human rights documents, the UNESCO draft draws on many of the earlier documents and also includes some of the most recent thinking about ethical norms and obligations. Perhaps its greatest strength lies not in details of the principles or their implementation, but rather in its stature as an international declaration issued by a United Nations organization. Turning an Info-Glut into a Library. Science 266 (7 October): 20-22, p. 20), Internet resources now receive numerous levels of organization, from basic directory listings (...) to elaborate "links" (cross-references to other Internet documents) that flash and glow in the dark. In many ways, the Internet functions as a direct extension of the traditional library. Following linked references across various sites is an electronic version of browsing library stacks, and the serendipitous discoveries made while "surfing the Net" recall the wonders of physically going "book-to-book." Although many of the Internet's best aspects augment library strengths by eliminating physical distance from sources, Net resources pose unique problems for researchers. It is not always clear who is responsible for the content of Web documents, when the document was produced, or how often (if ever) it is updated. Internet resource tools, then, must enable researchers to identify appropriate resources and to evaluate what they find when they get there. Web Research as Taking "Snapshots" Given the Internet's visual nature and fluid content, the process of conducting research on the Web has been likened to taking an informal picture of information on a specific date at a particular time. This metaphor also conveys the "zoom-in" aspect of searching through Web pages by going from general to specific categories. In the first section of this Scope Note, National Reference Center for Bioethics Literature (NRCBL) staff present a snapshot of bioethics resources taken during the spring months of 2000. Entries are divided into the categories of directories, electronic journals, full-text documents, news/current awareness, and teaching resources. In the two subsequent sections, this series of categories is repeated for entries on a specific topic within bioethics-genetics-and again for general search and evaluation tools. Where a Web site may contain pages applicable [End Page 175] to more than one category, multiple entries are made for that site with appropriate information for each category.Much as telecommunication advances have strengthened the relationship of patients and providers as partners, the dynamic nature of the Internet acknowledges that the researcher functions as a librarian whenever accessing the Web. It is our hope that BIOETHICSLINE and the other NRCBL databases not only will enable researchers to search the Web more efficiently, but also will help them to evaluate what they find when they get there. Bioethicsline on the Web: An International Plan in Progress Once only available through libraries, the U.S. National Library of Medicine (NLM), the funding agency for the ongoing development of the BIOETHICS LINE® database from the Kennedy Institute, has provided free Web access to that database of 63,000 citations since September 1998 through Internet Grateful Med. Plans are now underway to eliminate such specialty databases and incorporate all citations into PubMed (for journal articles) or LOCATORplus (for book-like materials and chapters in books). Both of these databases are likewise available at no cost on the Web. In the transition to PubMed and LOCATORplus some features of BIOETHICSLINE that presently are available may be lost. Researchers are encouraged to contact the National Reference Center for Bioethics Literature with search requests or for search strategy assistance with either the current or the future system ([email protected]).The inclusion of bioethics citations in PubMed and LOCATORplus will have several advantages. First, unique keywords from the Bioethics Thesaurus will be considered for inclusion in Medical Subject Headings (MeSH), the indexing vocabulary for PubMed and LOCATORplus, thereby enhancing retrieval of relevant clinical literature by offering more precise terminology covering ethical issues. Second, it will be easier to identify foreign-language materials, which are not currently included in the scope of BIOETHICSLINE. Third, the updating schedule will become more frequent.
