Este trabajo propone analizar los avances en la jurisprudencia del Tribunal Constitucional de Brasil sobre el control de constitucionalidad de la norma que establece la prohibición de donación de sangre de hombres que hayan tenido relaciones sexuales con otros hombres. La necesidad de ampliación de donadores de sangre por causa de la pandemia de COVID-19 desencadenó un proceso de presión social por parte de instituciones democráticas y de organizaciones no gubernamentales, que culminó con la votación de la ADI 5543 y (...) con la aplicación interna de los principios de igualdad y no discriminación y de normas internacionales de derechos humanos. Ser migrante en situación administrativa irregular implica no ser considerada/o ciudadana/o, no tener derecho a tener derechos. Si además estás ocupado en alguna forma de economía informal mediante una actividad no reconocida tampoco puedes acceder a la ciudadanía a través del trabajo. Esta es la realidad las trabajadoras sexuales migrantes en España quienes sufren múltiples discriminaciones derivadas de la intersección entre las políticas de intervención abolicionistas y la política migratoria europea. Desde la epistemología feminista y la perspectiva de los derechos (...) humanos, se recogen en este trabajo una aproximación al estatuto jurídico de estas mujeres desde sus experiencias y sus reclamaciones. Este artículo examina la percepción estudiantil sobre discriminación y racismo en la educación superior. La pregunta que orienta el estudio es: ¿Qué percepciones tienen los estudiantes sobre la discriminación y el racismo en el contexto universitario? El racismo es considerado una ideologíaque naturaliza la desigualdad y que toma como base las particularidades biológicas para establecer situaciones de diferenciación social. Así, la discriminación se refiere a circunstancias de exclusión,segregación, restricción debido a estereotipos que limitan los derechos de las (...) personas. El estudio fue de carácter cuantitativo, descriptivo y transversal. Participaron 263 estudiantes provenientes decuatro facultades de la Universidad Nacional de Chimborazo. Los datos de la investigación fueron recogidos mediante el Cuestionario de Percepción sobre racismo y discriminación en la EducaciónSuperior. Se evidencia que el 29,9 % de estudiantes manifiesta haber experimentado racismo y discriminación; el 89,7 % afirma que nunca lo han ejercido y el 57,7 % aduce que ha observado diversas manifestaciones en las interacciones. Los principales focos de la discriminación son: etnia, género, identidad sexual, situación socioeconómica y/o discapacidad. Las manifestaciones de la exclusión son explícitas e implícitas y las formas más evidentes de ejercerlos son a través deviolencia psicológica, verbal y física. Finalmente, existe una negación y naturalización del fenómenoque se encuentra enraizado en la dinámica institucional. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. El objetivo de esta colaboración es, en primer lugar, dar noticia de algunas coordenadas básicas de la discusión contemporánea acerca del lenguaje y la diferencia de los sexos, prestando especial atención a la acusación de esencialismo con la que se descalifican los contendientes entre sí. En segundo lugar, quiero llamar la atención acerca de la insuficiencia de las razones esgrimidas por el discurso feminista de la diferencia y por el discurso de la complementariedad cultural, que en última instancia vienen a (...) favorecer —en total oposición, sin duda, a los deseos de sus valedores— una perpetuación de la discriminación de las mujeres1. En tercer lugar, esbozo unas pautas para la eliminación de algunos elementos sexistas que todavía subsisten en la lengua española. -/- El trabajo se articula en cuatro secciones: 1) El debate contemporáneo sobre el esencialismo; 2) El discurso biológico sobre la diferencia sexual; 3) La construcción cultural de la diferencia sexual; y finalmente, 4) La búsqueda de un nuevo lenguaje. El propósito unificador que otorga sentido al conjunto radica en el empeño por ganar en comprensión de lo que es el ser humano mediante la reflexión filosófica sobre la diferenciación sexual que se detecta, se expresa o se crea, a través o en el lenguaje. La perspectiva que adopto —desde una óptica preferentemente hispánica, pero prestando especial atención a la cultura angloamericana— es decididamente filosófica, y aspira a integrar armónicamente aportaciones multidisciplinares, datos y planteamientos teóricos procedentes de las ciencias biomédicas y de las humanidades. Esta actitud supone una concepción de la filosofía que, lejos de un eclecticismo acrítico, busca encontrar las razones de la verdad en la confrontación de opiniones opuestas, sabedora con la mejor tradición que todos los pareceres formulados seriamente, en cierto sentido, dicen algo verdadero. Una segunda consecuencia de la adopción de esta perspectiva filosófica es que he evitado convertir el trabajo en una investigación lexicográfica de la lengua española, limitando ésta exclusivamente al final de la última sección. La infección por el virus del papiloma humano (VPH) constituye la causa necesaria, aunque no suficiente, de la enfermedad de transmisión sexual más frecuente en el mundo, responsable del 4,5 % de todos los cánceres en ambos sexos. La vacunación frente al VPH, con niveles de eficacia y seguridad similares en ambos sexos, está dirigida básicamente a mujeres, para reducir la incidencia de infección y sus consecuencias, como el cáncer de cérvix. La transmisibilidad del virus en ambos sexos y la (...) inmunidad colectiva que proporciona la vacunación universal hace que su extensión al sexo masculino constituya una cuestión no solo de salud pública, sino también un dilema bioético relacionado con la protección de la salud y la equitativa distribución de los recursos. Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos demostrar que (...) la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. Mostraremos que el valor de la versión estrecha es principalmente teórico y que para utilizar el concepto de injusticia epistémica se debe adoptar una comprensión más liberal del mismo. (shrink)

Este trabajo resume los diversos pretextos que Rousseau argumenta como razones para defender la subordinación de las mujeres. Me ha parecido apropiado dividir el trabajo en dos apartados. El primero de ellos pretende decidir si la producción rousseauniana anterior a 1755 ¿fecha de publicación del Discurso sobre la Desigualdad¿ puede ser o no objeto de la crítica feminista. El segundo, en cambio, pretende reconstruir históricamente las convicciones políticas, pedagógicas y religiosas de las que Rousseau se sirve para marginar a la (...) mujer. (shrink)

Este artículo utiliza las intuiciones de Carole Pateman, en su libro El contrato sexual, para criticar la manera en que las instituciones cuya racionalidad y legitimidad emergen del contractualismo moderno no consideran en igualdad de condiciones a las personas con discapacidad. Esto, a consecuencia de que el contrato social presupone ideas unívocas de racionalidad y cooperación que se definen a partir de los parámetros de las personas sin discapacidad. Así, el paradigma del capacitismo, que identifica a la ciudadanía con la (...) posesión de capacidades regulares, genera un contrato funcional que invisibiliza y naturaliza la discriminación fundada en la discapacidad. La teorización sobre el género, desarrollada por el discurso ideológico feminista, ha permitido visibilizar la violencia contra la mujer por el hecho de ser mujer en todas sus formas —acoso sexual y acoso sexista; violencia doméstica, delitos sexuales …— y ha determinado la aparición de un tratamiento legal específ ico dirigido a la prevención y lucha contra la violencia de género, que se concreta en instrumentos internacionales y regulaciones internas que se analizan en el estudio. Nos detendremos en el reciente (...) Convenio del Consejo de Europa sobre prevención y lucha contra la violencia contra las mujeres y la violencia doméstica, pues aporta una serie de conceptos de interés —violencia contra las mujeres, doméstica y de género—. Toda esta normativa permite construir un auténtico derecho fundamental a vivir sin violencia de género, analizándose en último lugar su dimensión subjetiva y su dimensión objetiva. (shrink)

En este artículo se exponen las conclusiones de un estudio cuyo objetivo principal fue describir y analizar las situaciones de discriminación, violencia y desigualdad contra enfermeros/as gays y lesbianas con pretexto de su orientación sexual y/o expresión de género en organizaciones de salud públicas y privadas de Ciudad Autónoma de Buenos Aires (en adelante, CABA). Aquí se analizan las estrategias y los modos en que gays y lesbianas gestionan la información personal relativa a su orientación sexual en sus intercambios (...) socio-laborales para evitar el estigma.Este escrito se centra en dos categorías principales que ordenaron la investigación: (a) las posibilidades de expresar la propia orientación sexual en los respectivos espacios de trabajo y su vinculación con el estigma real o anticipado en las interacciones con compañeros/as, superiores y pacientes; y (b) el heterosexismo internalizado como una categoría vinculada tanto con el estigma anticipado y experimentado como con los distintos grados de apertura sobre la propia orientación sexual en el trabajo.Para alcanzar el objetivo propuesto, se adoptó un enfoque cualitativo y se analizaron 20 entrevistas a enfermeros y enfermeras gays, lesbianas y heterosexuales, sumado a la indagación de diversas fuentes secundarias, desde los lineamientos de la teoría fundamentada en datos. Como conclusión, se destaca la asociación entre el grado de asunción de la propia identidad sexual, el uso de estrategias de gestión de la información personal y el heterosexismo internalizado, que repercuten en la reproducción de la opresión y el estigma entre gays y lesbianas en comparación con la población heterosexual. Por lo tanto, este trabajo pretende hacer un aporte significativo a las discusiones y los estudios sobre diversidad sexual en los espacios de trabajo de Argentina y la región. (shrink)

Ordinary discourse is filled with discussions about ‘sexual orientation’. This discourse might suggest a common understanding of what sexual orientation is. But even a cursory search turns up vastly differing, conflicting, and sometimes ethically troubling characterizations of sexual orientation. The conceptual jumble surrounding sexual orientation suggests that the topic is overripe for philosophical exploration. This paper lays the groundwork for such an exploration. Over the past decade, sexual rumor spreading, slut-shaming, and homophobic labeling have become central examples of bullying among young women. This article examines the role these practices— what adults increasingly call “bullying” and what girls often call “drama”— play in girls’ gendering processes. Through interviews with 54 class and racially diverse late adolescent girls, I explore the content and functions of “sexual drama.” All participants had experiences with this kind of conflict, and nearly a third had been the subject of (...) other girls’ rumors about their own sexual actions and/or orientations. Their accounts indicate that sexual drama offers girls a socially acceptable site for making claims to, and sense of, gendered sexuality in adolescence. While they reproduce inequality through these practices, sexual drama is also a resource for girls—one that is made useful through the institutional constraints of their high schools, which reinforce traditional gender norms and limit sexuality information. Despite the vast amount of scholarship on Hobbes’s philosophy, his writings on sexuality have gone largely unexplored. This paper offers an interpretation of Hobbes’s writing on that topic. I argue that if we pay attention to his remarks on sexuality, we can retrieve a coherent account of sexual morality, one that takes a strong stance against doctrines of natural sexual morality, replacing them with a commitment to positivism about sexual norms. Does the black struggle for civil rights make common cause with the movement to foster queer community, protest anti-queer violence or discrimination, and demand respect for the rights and sensibilities of queer people? Confronting this emotionally charged question, Ladelle McWhorter reveals how a carefully structured campaign against abnormality in the late 19th and early 20th centuries encouraged white Americans to purge society of so-called biological contaminants, people who were poor, disabled, black, or queer. Building on a legacy of savage hate (...) crimes—such as the killings of Matthew Shepard and James Byrd—McWhorter shows that racism, sexual oppression, and discrimination against the disabled, the feeble, and the poor are all aspects of the same societal distemper, and that when the civil rights of one group are challenged, so are the rights of all. Technological measures meant to change sexual orientation are, we have argued elsewhere, deeply alarming, even and indeed especially if they are safe and effective. Here we point out that this in part because they produce a distinctive kind of ‘clinical collective action problem’, a sort of dilemma for individual clinicians and researchers: a treatment which evidently relieves the suffering of particular patients, but in the process contributes to a practice that substantially worsens the conditions that produce this suffering in the (...) first place. We argue that the role obligations of clinicians to relieve the suffering of their patients put them in a poor position to solve this problem, though they can take measures to avoid complicity in the harms that would result from widespread use of individually safe and effective reorientation biotechnology. But in the end the medical community as a whole still seems obligated to provide these measures, if they become technologically feasible. Medical researchers are in a better position to prevent the harms that would result if reorientation techniques were safe, effective and widely available. We argue that the harms attendant on the development of safe and effective re-orientation techniques give researchers reason to avoid ‘applied‘ research aimed at developing these techniques, and to be careful in the conduct of basic orientation research which might be applied in this way. In this paper I make a preliminary analysis of Western (or global North) discourses on sexual violence, focusing on the important concepts of “consent” and “victim.” The concept of “consent” is widely used to determine whether sexual violence has occurred, and it is the focal point of debates over the legitimacy of statutory offenses and over the way we characterize sex work done under conditions involving economic desperation. The concept of “victim” is shunned by many feminists and nonfeminists alike for (...) its apparent eclipse of agency. Putting these concepts into a global framework sheds light on their limitations. Bringing in the debate over the concept “honor crime” reveals contrasting assumptions about the nature of sexual violence. The comparative analysis used in this paper shows how we can avoid universalizing from specific frameworks, but also how we can learn from the discourses elsewhere toward developing an account of commonalities across contexts. Ultimately I argue that in applications to sexual violence, “consent” has intrinsic limitations, “victim” has context-based dangers, and “honor crime” makes both correct as well as incorrect assumptions. “Hooking up,” a popular type of sexual behavior among college students, has become a pathway to dating relationships. Based on open-ended narratives written by 273 undergraduates, we analyze how students interpreted a vignette describing a heterosexual hookup followed by a sexless first date. In contrast to the sexual script which holds that women want relationships more than sex and men care about sex more than relationships, students generally accorded women sexual agency and desire in the hookup and validated men’s post-hookup (...) relationship interest. However, in explaining the sexless date, students typically reasoned the woman was being chaste and withholding sex to redeem her reputation whereas they often characterized the man’s abstinence in terms of a pity date. The findings underscore the tenacity of gendered sexual scripts around heterosexual dates and hookups but also reveal fissures and contradictions that suggest some changes to the sexual double standard. Non-recent (historic) childhood sexual abuse is an important issue to research, though often regarded as taboo and frequently met with caution, avoidance or even opposition from research ethics committees. Sensitive research, such as that which asks victim-survivors to recount experiences of abuse or harm, has the propensity to be emotionally challenging for both the participant and the researcher. However, most research suggests that any distress experienced is usually momentary and not of any clinical significance. Moreover, this type of research offers (...) a platform for voices which have often been silenced, and many participants report the cathartic effect of recounting their experiences in a safe, non-judgemental space. With regard to the course of such research, lines of inquiry which ask adult participants to discuss their experiences of childhood sexual abuse may result in a first-time disclosure of that abuse by the victim-survivor to the researcher. Guidance about how researchers should respond to first-time disclosure is lacking. In this article, we discuss our response to one research ethics committee which had suggested that for a qualitative study for which we were seeking ethical approval (investigating experiences of pregnancy and childbirth having previously survived childhood sexual abuse), any disclosure of non-recent (historic) childhood sexual abuse which had not been previously reported would result in the researcher being obliged to report it to relevant authorities. We assess this to be inconsistent with both law and professional guidance in the United Kingdom; and provide information and recommendations for researchers and research ethics committees to consider. The pelvic exam is used to assess the health of female reproductive organs and so involves digital penetration by a physician. However, it is common practice for medical students to acquire experience in administering pelvic exams by performing them on unconscious patients without prior authorization. In this article, we argue that such unauthorized pelvic exams (UPEs) are sexual assault. Our argument is simple: in any other circumstance, unauthorized digital penetration amounts to sexual assault. Since there are no morally significant differences (...) between UPEs and other instances of digital penetration, UPEs are sexual assault. So, insofar as one is against sexual assault, one should be against UPEs. (shrink)

This chapter will argue that due to a lack of genuine consent, some of Russell’s practices in his romantic/sexual relationships are morally objectionable according to his own normative theory (utilitarianism) and these practices are intellectually objectionable according to his post-1913 meta-ethics (expressivism) and his understanding of rationality. On utilitarian grounds, Russell’s actions would maximize pleasure and minimize pain for all the parties affected by the relationship if the authenticity of his partners’ consent were maintained either by a more or less (...) equal social and political standing of the partners or, failing that, by the powerful partner’s exercise of the virtue of restraint; neither of these conditions was satisfied in Russell’s relationships with Vivien Eliot or Helen Dudley. On expressivist grounds, the expressions of desires upon which Russell’s romantic/sexual practices were based, such as the disregard for the humanity of women, conflict with his calls for world peace based on a concern for the well-being of humanity. In this paper we challenge the idea that valid consent is the golden standard by which a sexual encounter is deemed ethical. We begin by reviewing the recent public focus on consent as an ethical standard, and then argue for a standard that goes beyond legalistic and contractual foci. This is the standard of mutuality which extends beyond the assurance that all parties engaging in a sexual encounter are informed, autonomous, and otherwise capable of making a valid choice: one must (...) also encounter the other with care and loving attention. We develop this claim using Iris Murdoch’s concept of an attitude of “loving attention,” which differentiates our view from the duty of due diligence to ensure that each person is a willing participant in sex, that the rights of others have not been violated, as emphasized by Dougherty. We also address three objections to using mutuality as a measure of ethical sex, namely that it is patronizing, that it is a maximalist position that puts too great a burden on individuals and inhibits their freedom, and that it is an ideal rather than a requirement. We then look at three examples that test the construct of mutuality: the typical college hook-up, sex work, and anonymous sex through glory holes and similar set-ups. (shrink)

In this paper I first argue that we do not need to intend all the features of X in order to consent to X. I will present cases in which agents intend to consent to gambles, and intend to consent to have sex with people under certain descriptions, de re, rather than de dicto. Next, I argue that deception – even deception about features of a sexual act that qualify as “deal-breakers” for a participant – might not always have the (...) power to undermine sexual consent. In both sections I craft my arguments by appealing to a proposal about the scope of rights. I suggest that we may have intentions regarding our sexual experiences that do not map onto the rights that we actually hold pertaining to those sexual experiences. (shrink)

In some cultures, people tend to believe that it is very important to be sexually exclusive in romantic relationships and idealise monogamous romantic relationships; but there is a tension in this ideal. Sex is generally considered to have value, and usually when we love someone we want to increase the amount of value in their lives, not restrict it without good reason. There is thus a call, not yet adequately responded to by philosophers, for greater clarity in the reasons §why (...) it might be reasonable for a couple to adopt a policy of sexual exclusivity. This article argues that we cannot justify the demand for sexual exclusivity by a need to protect the relationship from the risk of one partner ‘trading-up’, or by appealing to jealousy. However, sexual exclusivity can be intelligible if it supports the romantic relationship and helps to distinguish it from other relationships. Nonetheless, sexual exclusivity ought not to be the hegemonic social norm that it currently is in some societies because this diminishes the potential value it might have and gives the idea of faithfulness the wrong focus. Perhaps the foremost issue in the emerging area of inquiry known as lesbian and gay studies is the social constructionist controversy. Social constructionism is the view that the categories of sexual orientation are cultural constructs rather than naturally universal categories. ____Forms of Desire__ brings together important essays by social constructionists and their critics, representing several disciplines and approaches to this debate about the history and science of sexuality.

This article intervenes in a critical debate about the use of consent to distinguish sex from rape. Drawing from critical contract theories, it argues that sexual consent is a cruel optimism that often operates to facilitate, rather than alleviate, sexual violence. Sexual consent as a cruel optimism promises to simplify rape allegations in the popular cultural imagination, confounds the distinction between victims and agents of sexual violence, and establishes certainty for potential victimizers who rely on it to convince themselves and (...) others that their partners implicitly or explicitly agreed to sex. In each of these cases, the power of consent rests in its tendency to obscure sexual violence in a set of questions around victimhood and agency, rather than to clarify whether or when it has occurred. Following in the critical contract tradition, this article argues that the optimistic attachment to the clarifying power of consent helps to explain the persistent commitment to better sexual consent as a ‘solution’ to the problems of rape and sexual violence, and that this ‘solution’ is insufficient to the task. I first distinguish promises with positive sexual content (e.g., promises to perform sexual acts) and promises with negative sexual content (e.g., promises to refrain from sexual acts—as one does when making monogamy promises). I argue that sexual content—even positive sexual content—does not cause a promise to misfire. However, the content of some successful promises is such that a promisee ought not to accept the promise, and, if she does accept, she ought then to release her promisor from the promise. Resumen: El espacio dramático de Michel Tremblay, “tesoro nacional” de Quebec, está poblado por personajes que se enfrentan casi siempre a la alienación y al deseo de encontrar, o incluso de crear, su propia identidad. Los héroes tremblayanos, cualquiera que sea su orientación sexual y posición en la sociedad, realizan un paso desde la inactividad hasta la acción para desgajarse del orden preestablecido. A veces incapaces de cambiar su situación, a veces felices al poder, por fin, contestar a la pregunta (...) “¿quién soy yo?”, los personajes del teatro de Tremblay siguen siendo representativos de la sociedad quebequense que, durante el período de la llamada Revolución tranquila, se vio sometida a unos profundos cambios identitarios. A lo largo de la evolución social del Quebec de los años sesenta y setenta del pasado siglo, se fueron estableciendo paralelismos entre la toma de conciencia identitaria de la sociedad y la de los personajes dramáticos de Trembley. Así, estos últimos se convertirían en alegorías de la estructura social en por lo menos dos dimensiones, moral y cultural, en el caso de Belles-Sœurs y À toi, pour toujours, ta Marie-Lou, donde se incuban las frustraciones propias de unas heroínas abrumadas por la cultura patriarcal (impotente en todos los ámbitos y ante todo el sexual), representada a su vez por la pieza Hosanna, a la que se la puede considerar como el símbolo de la expresión social de la homosexualidad y de la identidad sexual en general. En consecuencia, la finalidad de este artículo sería la reflexión misma acerca de unas (r)evoluciones teatrales que reflejarían las llevadas a cabo por la Revolución tranquila dentro de toda la sociedad. Abstract: Michel Tremblay's dramatic space, Quebec’s “national treasure”, is populated by characters who are almost always confronted with alienation and the desire to rediscover, and even to create, their own identity. The heroes of Tremblay, whatever their sexual orientation and social positions are, have the story of a passage from inaction till the act of tearing themselves away from the pre-established order. Sometimes incapable of changing their situation, sometimes happy to finally be able to answer the question “Who am I?”, the characters in the Tremblayan theatre are at all times representatives of the Quebec society, which, during the Quiet Revolution, suffered profound changes in identity. Throughout the social evolution in Quebec in the 1960s and 1970s, the awareness of the identity of the society and that of the dramatic characters are two matters that coexist in parallel manner. Thus, the latter become allegories of the social structure on at least two levels: moral and cultural, in the case of the Belles-Sœurs and À toi, pour toujours, ta Marie-Lou representing several frustrations: of the heroines, overwhelmed by the powerless patriarchal culture; sexual, represented for example by Hosanna being the symbol of the social expression of homosexuality and sexual identity in general; and finally, actional, as in the case of Sainte Carmen de la Main, which constitutes a message to Québécois to take their destiny in their hands. The main objective of the article is to bring some reflections on theatrical (r)evolutions which reflected the changes of the Quiet Revolution within the entire society. (shrink)

The way in which consent to sexual interactions is understood in the US is undergoing a transformation. Many universities, sometimes at the behest of lawmakers, are moving to adopt ‘affirmative consent’ policies, which define consent in terms of affirmative behavior that goes beyond mere silence or lack of resistance. Although these policies are a move in the right direction, I argue that their content has not been properly understood. In particular, the circumstances in which nonverbal behavior may communicate consent are (...) more limited than might be apparent. And even though these circumstances can be abstractly identified, it is difficult to give people adequate guidance about when some of them obtain. Moreover, I argue that no matter how the allowance for nonverbal behavior is construed, affirmative consent policies unnecessarily prohibit interactions that people may have reason to engage in. I propose an alternative policy that remedies these problems with the affirmative consent policies that are currently being implemented. And I note that the justification for this alternative policy does not turn on any special features of the university setting. Instead, the account I give suggests grounds for reforming the law as well. (shrink)

In my paper, I document a “travel” journey of concept formation and its concrete expression in law, which also constituted a literal travel journey across continents. Through poetic-hermeneutical approaches to language, guided by previously existing concepts stemming from experiences of the Holocaust, communism, and African-American feminist analyses of rape as an attack on a racial/ethnic group, a previously invisible domain of the human condition was charted. Throughout history, sexual atrocities have been committed within the context of wars, but their weaponisation (...) as acts of genocide remained unarticulated. This changed in the 1990s with Serbia-Yugoslavia’s genocidal wars against its neighbours (Editorial comment: The author uses the term Serbia-Yugoslavia to refer to the entity that succeeded the breakup of the Socialist Federal Republic of Yugoslavia after Croatia and Slovenia declared independence on June 25th, 1991. The SFRY up to that point consisted of the six republics Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Serbia (including the so-called autonomous regions of Kosovo and Vojvodina), and Slovenia. Further declarations of independence by Macedonia and Bosnia and Herzegovina on April 27, 1992, left only Serbia and Montenegro who the same day declared themselves to be the Federal Republic of Yugoslavia (FRY). In 2003, the Federal Republic of Yugoslavia was reconstituted as the State Union of Serbia and Montenegro, which existed until Montenegro and Serbia declared their independence (on June 3rd and June 5th, 2006, respectively)). I sketch the genesis of the concept of sexual atrocities as genocide in connection with my personal journey and how it guided legal prosecution of this “new” crime. My own travel-experience began with my association with Asja Armanda, and her discovery of coordinated mass rapes, when she came to the aid of survivors fleeing the Serbian attacks on Croatia, crimes she attempted to bring to international attention to prevent their expansion into Bosnia-Herzegovina and Kosovo. Testimonials reached me in the U.S. as well. I went to Croatia to join Armanda, where we named the crime “sexual atrocities as genocide.” On the basis of this new concept, we filed a lawsuit in New York against Bosnian Serb leader Radovan Karadžić, pioneering this crime’s recognition under international law. I conclude with philosophical questions that Putin’s similar genocidal attack on Ukraine raises today. (shrink)

While sexual violence should not be the prerequisite for legal abortion, expanding definitions of abuse to include reproductive coercion can open avenues of access to abortion following the Dobbs decision. Understanding the increased danger and compounding challenges of intimate partner violence can inform legislative initiatives, healthcare responses, and movements for reproductive justice.

The article focuses on the narratives of women secretaries regarding their work experiences in private business in Latvia, and aims at understanding the barriers that prevent the formation of women’s political subjectivity in Latvia, by looking at why sexual harassment does not become a political issue for working women in Latvia. Using Hayden White’s theory of trope analysis, the article analyses the dominant tropes and the political results of their use in secretaries’ articulations and narratives about their experiences of sexual (...) harassment. Additionally, the article provides a critical trope analysis of Western feminist theories of sexual harassment, thus pointing out their usefulness for women’s politics in Latvia. Finally, the article outlines the discursive strategies that women in Latvia could use in order to claim their own distinct and transformative political subjectivity in the newly independent, capitalist and highly nationalist post-Soviet Latvia. This article explores gender inequities and sexual double standards in teens’ digital image exchange, drawing on a UK qualitative research project on youth ‘sexting’. We develop a critique of ‘postfeminist’ media cultures, suggesting teen ‘sexting’ presents specific age and gender related contradictions: teen girls are called upon to produce particular forms of ‘sexy’ self display, yet face legal repercussions, moral condemnation and ‘slut shaming’ when they do so. We examine the production/circulation of gendered value and sexual morality via teens’ discussions (...) of activities on Facebook and Blackberry. For instance, some boys accumulated ‘ratings’ by possessing and exchanging images of girls’ breasts, which operated as a form of currency and value. Girls, in contrast, largely discussed the taking, sharing or posting of such images as risky, potentially inciting blame and shame around sexual reputation (e.g. being called ‘slut’, ‘slag’ or ‘sket’). The daily negotiations of these new digitally mediated, heterosexualised, classed and raced norms of performing teen feminine and masculine desirability are considered. (shrink)
