Many people find comparisons of the value of persons distasteful, even immoral. But what can be said in support of the claim that persons have incomparable worth? This chapter considers an argument purporting to show that the value of persons is incomparable because it is so great—because it is infinite. The argument rests on two claims: that the value of our capacity for valuing must equal or exceed the value of things valued and that our capacity for valuing is unbounded (...) in a very strong sense. After laying out this argument, I consider its implications for how we should regard each other. In particular, I suggest that it complicates efforts to understand morality as a system of principles. Instead, I propose that an aesthetic attitude, not unlike our experience of the sublime, is an apt response to humanity’s infinite value. -/- . (shrink)

Traditionally, questions about the role of the arts in moral thought have focused on the arts’ role in the acquisition of new moral knowledge, the refinement of moral concepts, and the capacity to apply our moral view to particular situations. Here I suggest that there is an importantly different and largely overlooked role for the arts in moral thought: an ability to reconfigure the structure of our moral thought and effect what we might call a revolution in that framework. On the Nature of Photographic Realism’ Kendall Walton argues that lack of mental-state involvement in the formation of photographic images is a quality that sets them apart from handmade images such as paintings or sketches. This paper defends and substantially develops this idea. It argues that viewers' knowledge of this objective character of the photographic process provides them with special warrant for the acceptance of first-order perceptual beliefs formed as a result of viewing photographic images. As well, it distinguishes between (...) two different ways in which mental states can be involved in the formation of photographic images, and uses this distinction to ward off the objection that decisions about film type, composition, moment of exposure, etc. undermine the objectivity of the photographic process. In his classic paper ‘Transparent Pictures: On the Nature of Photographic Realism’, Kendall Walton highlights the special sense of contact with their subjects that photographs typically engender and argues that we must postulate photographic transparency in order to explain their capacity to do so. He also downplays the epistemic advantages historically associated with the medium and instead finds the source of our medium-specific appreciation of photographs largely in their transparency. I argue that Walton errs in both these respects. I offer (...) a simpler, deflationary means of explaining the contact phenomenon, one that does not mandate that we see through photographs, and I show how an epistemic advantage associated with the medium can be brought together with this deflationary understanding to yield a two-factor analysis of our experiences in looking at photographs. It used the tools of the philosophical tradition to address questions that the philosophers—especially those in the University of Chicago’s (...) analytically oriented environment—seemed not to want to ask; at least, not when I was an undergraduate there some years ago. My engagement with philosophy has always been about personal questions, and in the past I tended to eschew the political realm as being at best external to the more essential business of philosophy. But the questions I have been asking lately are rather different from the ones that concerned me back when I was still in Chicago. Largely due to the birth of my son two years ago, questions that before were only secondhand—questions about education, democracy, and debt—are now very personal and very, very important to me. I am perhaps a latecomer to the position that, as the saying goes, “The personal is the political.” But being a convert, like the earliest Christian Apologists, may afford me an opportunity and motivation to argue the position all the more earnestly.The way I have sought to incorporate these different questions and perspectives in my theologizing has primarily been through engagement with the Confucian philosophical tradition. The Confucian tradition is, in large measure, a series of reflections on the individual’s utter embeddedness in familial, sociopolitical, environmental, and sacred structures and forces. The tradition has its own resources for expressing and navigating this embeddedness, but what has become interesting to me is that the requisite resources are being developed independently, and perhaps more forcefully, within the realm of postmodern and postcolonial theory. Indeed, these newer articulations may [End Page 55] well be vital for present-day Confucian thinkers to consider in reformulating and re-presenting their own commitments and traditions in the current era.The questions posed to and for the current paper are, first, how does the religiously committed philosopher (or theologian, in a loose sense of the term) consciously incorporate political and economic considerations into her theological research and discursive product; and second, to what extent and in what ways is it necessary for her also to include and address her own personal life/history into the same. Naturally, these are questions which religious thinkers will ask and answer anew for themselves, and repeatedly. My own engagement with Judith Butler in the current paper will merely provide, I hope, one possible model for such an account of how the personal and the political may function in theological discourse. Generally, the model given here suggests that such considerations are not external add-ons to the more essential “hard-core” theologizing of the doctrines of God and Christology. It is not a matter of (first) theory and (then) application. Rather, theological discourse is one place where ethical subjectivity is attained, if provisionally, through conscientious and critical engagement with both one’s religious tradition and the sociopolitical-economic structures in which those traditions are practiced, and where one’s own place within those structures is both questioned and created.In her recent work Giving an Account of Oneself, Judith Butler continues her project of deconstructing the metaphysics of the substantive self, begun in her deservedly noted early work, Gender Trouble. In particular, she argues that the subject comes into being through processes and in contexts that, while not completely determinative of one’s subjectivity, do limit one’s ability to give a complete account of oneself, one’s actions and motivations. She asks the important question of whether this opacity of the conditions of one’s coming into being limits the possibility of taking responsibility, or being held responsible, for one’s actions. Ethical theory is an explanatory endeavor, but until recently relatively little attention has been paid to the question of what makes for an adequate ethical explanation. This chapter argues that like explanation generally, ethical explanation is relativized to a contrast space: it is not a two-place relation between an explanandum and an ethical theory, but a three-place relation involving a background framework that, among others things, specifies a contrast space. The chapter then draws two morals from this thesis. Kendall Walton famously argues that photographic images—in contrast with handmade images—are transparent; we see through them to the persons or objects that were in front of the camera at the moment of exposure. Walton also argues, separately, that our philosophical investigations in the representational arts generally should adopt the methodology of theory construction. This article brings together these two strands of Walton's thought by rendering his argument for photographic transparency in the form of a theory consisting of a perceptual natural (...) kind and an underlying naturally dependent process, the former postulated in order to account for various photographic explananda. The surprising result is that Walton's theory, thus construed, yields at least one prediction that is in conflict with what we observe and that, because of this, he is forced to embellish his theory in ways that render it psychologically implausible and that raise the worry of ad hoc patching up. Although there is a large and growing literature on children’s developing concepts of illness transmission, little is known about how children develop contagion knowledge before formal schooling begins, and how these informal learning experiences can impact children’s health behaviors. Here we asked two important questions: First, do children’s informal learning experiences, such as their experiences reading storybooks, regularly contain causal information about illness transmission; and second, what is the impact of this type of experience on children’s developing knowledge and behavior? (...) In Study 1, we examined whether children’s commercial books about illness regularly contain contagion-relevant causal information. In Study 2, we ran a pilot study examining whether providing children with causal information about illness transmission in a storybook can influence their knowledge and subsequent behavior when presented with a contaminated object. The results from Study 1 suggest that very few (15%) children’s books about illness feature biological causal mechanisms for illness transmission. However, results from Studies 2 suggest that storybooks containing contagion-relevant explanations about illness transmission may encourage learning and avoidance of contaminated objects. Altogether, these results provide preliminary data suggesting that future research should focus on engaging children in learning about contagion and encouraging adaptive health behaviors. (shrink)

In his autobiography, Skinner states that Walden Two was an anarchist society because no person was in control and the community was planned in such a way that institutions were not needed. Based on that statement, this article aims to evaluate an anarchist interpretation of Walden Two. The text is divided into 3 parts. The first part presents a definition of anarchism, covering its criticism of domination and a defense of self-managed society (anarchy). In the second part, some (...) convergence points of Walden Two and anarchism are indicated in 3 social spheres (economic, political, and cultural). The last part analyzes the divergences between the community described in Walden Two and an anarchist society, with an emphasis on the issue of Walden Two’s political inequality. It is concluded that the divergences between Walden Two and anarchism are decisive and prevent the community described in Skinner’s book from being classified as an anarchist one, and, therefore, they counter Skinner’s own statement. Despite being eminently forgettable from the literary point of view, B. F. Skinner’s novel, Walden Two , provides us with an excellent opportunity, not so much to show what is wrong with mainstream accounts of free will, as Robert Kane thinks, but rather to explore another key and importantly neglected condition for genuine agency; namely, that properly lived human lives are those that are and must continue to be vulnerable to unforseable reversals, as Aldous Huxley speculates in his Brave (...) New World . In short, I argue, perhaps scandalously, that one of the central conditions for genuine agency is that our lives are and must continue to be, to a large extent, out of our personal control. The promise of too much personal control, not too little (as Kane thinks), is what is wrong with Skinner’s social utopia. (shrink)

Having read it, one may wonderjust what is so familiar or American about Thoreau's sensibility. And righdy so. Waiden is long on (...) observation and short on plot, as tedious in its detail as it is devoid of action. It is a wondrously slow, contemplative work and would be demanding enough for this reason alone, to say nothing of the enormous vocabulary, the abundant allusions to classical mythology, and die Latin and Greek scattered tiiroughout—all of which hint that despite his democratic rhetoric, Thoreau addresses himself to a rather small audience. Like the lusty chanticleer, "standing on his roost, ifonly to wake his neighbors up," Waiden speaks to the best part of the soul, to that in us which is divinely awake or mindful.1 Such speeches necessarily transcend not only America's borders, but common-sense understanding as well, "the sense ofmen asleep, which they express by snoring" (p. 325). As Thoreau puts it: "I desire to speak somewhere widiout bounds; like a man in a waking moment, to men in dieir waking moments" (p. 324). This desire "to speak somewhere without bounds" is philosophical. Waiden witnesses to die philosophical experience of the world. Originating in wonder and die desire to understand, Waiden moves dirough die senses, experience, the arts, and science. But its specifically philosophical character lies in Thoreau's evident desire to situate all tilings, including himself, in dieir ultimate context. Recognizing the integrity of this desire means appreciating that the full realization of one's nature requires discovering one's place in die cosmos. The first part considers Thoreau as a surveyor of the whole of things, a traditionally philosophical endeavor. The second part examines Thoreau's desire for truth and shows how it must be distinguished from the tenets of transcendental philosophy generally and Emerson's transcendentalism in particular. Contrary to a common opinion, a true estimation of Walden's philosophical depth hinges on seeing why Thoreau is not a transcendentalist. Some may worry that attention to these universal, theoretical features ofThoreau's workjeopardizes doingjustice to his famously idiosyncratic individualism. But Thoreau does not ask one to choose either allegiance to oneself or to universal laws: such a dichotomy is false and must be sublated. Thus the final part of this essay explicates how Thoreau envisions the web of particular and universal, the alignment of individual and cosmos. I conclude by framing my disagreement with Stanley Cavell's reading of Waiden. As the only well-known philosopher to have devoted a book-lengtii study to Waiden, his influence has been great, and on central points his reading sanctions the common emphasis on subjectivity.2 Two last prefatory remarks. First, Waiden is not a work in philosophy, at least not a treatise, for Thoreau does not explain his insights thematically. Nevertheless, the work has a distinct philosophical character, one I shall try to sketch with die degree of precision appropriate to it. This raises my second point. Precision does not sit easily with comprehensiveness or with the need to praise. All three are relevant to philosophical understanding, yet Thoreau evidently felt that synoptic contemplation and all its fruits, including "any memorable praise of God," were in die shorter supply (p. 78). As Thoreau tells it, he wished to "cut a broad swath and shave close, to drive life into a corner, and reduce it to its lowest terms," "to front only the essential facts," "and if [life] proved to be mean, why then to get the whole and genuine meanness of it, and publish its meanness to die world; or if it were sublime, to know it by experience, and be able to give a true account of it in my next excursion" (pp. 90—91). The original Fitchburg Line, at 54 miles long, was, until 2010, the longest run in the present -day MBTA Commuter Rail system. And it is (...) one of the oldest railways in New England. By 1900, fortunes swelled and the Fitchburg’s Hoosac Tunnel Line took passengers and goods westward toward Chicago. The Lake Champlain Route connected Boston to points north like Burlington, Vermont. Its tracks pass remarkably close to Walden Pond (Figure 2), and the Fitchburg Line—both its reality and the specter of it—is practically a character in his writing: “I usually go to the village along its causeway, and am, as it were, related to society by this link,” Thoreau writes in “Sounds,” a chapter of Walden that contains what must be one of the most picturesque odes (or laments) to rail travel and commerce in all of American literature: The engine’s whistle, Thoreau complains, pierces the still silence of his idyllic retreat like a screaming hawk circling a farmer’s field, its billows of steam an ominous harbinger of “this travelling demi-god, this cloud-compeller.”1 Thoreau’s frequent, customary walks into Concord along the railroad tracks took him through a heavily excavated stretch of the line known as the Deep Cut, to which he returned again and again each year in early spring, even after leaving the cabin, to observe and to record his observations. The leaf-shaped sand flows and trickling surface erosion caused by melting frost in the banks of the Deep Cut are elaborately described in Thoreau’s chapter in Walden entitled “Spring,” what Laurence Buell calls the “high point of Thoreau’s epic.”2 And yet, in spite of the universal acclaim of this passage as a literary tour de force, it has not received the full attention it deserves. What warrants fresh consideration first and foremost is “Spring”’s deep-rootedness in classical sources. Many classical influences, allusions, and a good deal of etymological word play have gone so far unnoticed. The chapter is also important because it describes, by intimation, what contemporary scientists now call emergence. Emergent phenomena are properties or behaviors that arise in systems as a result of complex, dynamic interactions amongst constituent parts, including changes to a system brought about by human interventions3—not only, e.g., climate change and wildfires, but also traffic patterns and terrorist networks; kidney function in the body; the rings of Saturn. As he tries to capture the essence of the 114 classics and complexity in WALDEN’s “spring” Deep Cut and interpret its significance, Thoreau adumbrates this concept, but also grapples ingeniously with broader issues of perennial concern—the relationship of Nature to Culture, for example, of Wilderness to Civilization, of Science to the Humanities—making “Spring” not only a probing work of eco-criticism and environmental philosophy, but of scientific reflection and poetic experiment as well. In short, Thoreau’s “Spring” is that rare work of classical reception that transmits both literary and scientific insight. Perhaps at this point, in lieu of accolades, it is best to let Thoreau start speaking for himself. What I offer in the following pages is a commentary on the Deep Cut passage from “Spring.” Classical references and aspects of systems theory will be explained and contextualized as they emerge, as it were, from Thoreau’s text. This paper argues against Pierre Hadot's view that Thoreau in Walden displays Epicurean and Stoic traits in roughly equal proportion. Of the two schools, he is much closer to the latter. However, the similarities between Thoreau and the Stoic are practical or generic. In terms of ethical practices, Thoreau exhibits many of the qualities found in the Stoic school. However, the theoretical discourse used to justify those practices is different in each case. If one is to say that Thoreau (...) is a Stoic, it is not a very profound sense. Thoreau shares with both the Stoics and the Epicureans an interest in what Hadot calls "spiritual exercises" or philosophy as a way of life. (shrink)

My aesthetic judgements seem to make claims on you. While some popular accounts of aesthetic normativity say that the force of these claims is third-personal, I argue that it is actually second-personal. This point may sound like a bland technicality, but it points to a novel idea about what aesthetic judgements ultimately are and what they do. It suggests, in particular, that aesthetic judgements are motions in the collective legislation of the nature of aesthetic activity. This conception is recommended by (...) its ability to explain some important but otherwise recondite features of aesthetic practice and, more importantly, by allowing us to ground the normativity of aesthetic judgement in the familiar normativity of practice. It also offers a more systematic way of understanding the rivalry between the ideals of aesthetic universality and diversity. (shrink)

This chapter develops and defends an account of reason: to reason is to scrutinize one’s attitudes by consulting the perspectives of other persons. The principal attraction of this account is its ability to vindicate the unique of authority of reason. The chapter argues that this conception entails that reasoning is a robustly social endeavor—that it is, in the first instance, something we do with other people. It is further argued that such social endeavors presuppose mutual respect on the part of (...) those participating in them. Schiller says that “it is only through beauty that man makes his way to freedom.” Here I attempt to defend a claim in the same spirit as Schiller’s but by different means. My thesis is that a person’s autonomous agency depends on their adopting an aesthetic identity. To act, we need to don contingent features of agency, things that structure our practical thought and explain what we do in very general terms but are neither universal nor necessary features of agency (...) as such. Without these things, the question of what to do for any individual would be underdetermined. The problem is that adopting such a contingent form of agency amounts to a restriction on what we can do, and so it is a prima facie threat to our autonomy. I will argue that one way, and indeed the only way, of meeting this challenge lies in aesthetic experience. Granting our capacity for aesthetic pleasure the authority to determine the particularities of our agency is compatible with autonomy because doing so means identifying with one’s capacity for pleasure in free and creative activity. Doing this allows us to be both particular sorts of agents and creatures regulated by the universalizing demands of reason. (shrink)

Recent years have seen a rekindling of interest in the method of reflective equilibrium. Most of this attention has been suspicious, however. Critics have alleged that the method is nothing more than a high-minded brand of navel-gazing, that it suffers from all the classic problems of inward-looking coherence theories, and that it overestimates the usefulness of self-scrutiny. In this paper I argue that these criticisms miss their mark because they labor under crucial misconceptions about the method of reflective equilibrium. The critics’ objections fall short, I argue, because they do not recognize reflective equilibrium’s embrace of these theses. Confronting these objections and understanding why they fail brings us to a better understanding what, exactly, the method of reflective equilibrium is. The answer I come to in the final section of the paper is that the method of reflective equilibrium is not, exactly, anything. It is a mistake to try to give a positive characterization of the view, to identify it with a concern with a particular species of data, particular procedures and methods, or even a particular conception of normative success. Instead, it should be understood as the denial of essentialism about just these matters—as a form of anti-essentialism about our epistemic inputs, methods, and goals. (shrink)

Some philosophers posit a connection between normativity and agency. This connection allows us to infer propositions about what we ought to do or what reason we have to do from the conditions of action. This chapter considers arguments for this connection. In particular, the chapter argues that not only do the conditions of generic agency have important normative implications for us, but so too do the conditions of narrower, more contingent, and more local kinds of agency. Finally, objections to this (...) thesis are summarized and rejected, in part because they presuppose our having far more control over what our deliberations require in the way of agency than we actually do. -/- . This chapter develops a theory of categorical normativity, of those principles that have authority over us regardless of our ends and interests. It argues that there is an intimate connection between these norms and the conditions of agency. In this respect, it offers a version of constitutivism. But the version of constitutivism defended is unique in a few respects. First, it is naturalistic: agency is an emergent property, like the properties of biology and economics. Second, it is social: agency is (...) something constructed by the complex interaction of agents. And third, it supports the normativity of a particular contractualist procedure: adhering to Kant’s Formula of the Realm of Ends is a condition on agency, and so a categorical requirement. (shrink)

I argue that a crucial point has been overlooked in the debate over the “numbers problem.” The initial arrangement of parties in the problem can be thought of as chancy, and whatever considerations of fairness recommend the reliance on something like a coin toss in approaching this problem equally recommend treating the initial distribution as a kind of lottery. This fact, I suggest, undermines one of the principal arguments against saving the greater number.

This article proposes a role for aesthetic judgment in our practical thought. The role is related to those moments when practical reason seems to give out, when it fails to yield a judgment about what to do in the face of a choice we cannot avoid. I argue that these impasses require agents to create, but that not any creativity will do. For we cannot regard a response to one of these problems as arbitrary or capricious if we want to (...) act on it. We must instead regard that response as justified by the problem itself. I suggest that this combination of creativity and normativity is characteristic of aesthetic judgment and this makes it a promising candidate for making these very difficult choices. (shrink)

Constitutivists believe that we can derive universally and unconditionally authoritative norms from the conditions of agency. Thus if c is a condition of agency, then you ought to live in conformity with c no matter what your particular ends, projects, or station. Much has been said about the validity of the inference, but that’s not my topic here. I want to assume it is valid and talk about what I take to be the highest ambition of constitutivism: the prospect of (...) grounding moral requirements in the conditions of agency. If this can be done, then we can show that everyone is bound by the demands of morality, and we can do so without the customary entanglements—queer normative entities, an implausibly powerful moral sense, or divine lawgivers. Not long before the change of Government in Britain in 1997, the then Heritage Secretary, Virginia Bottomley, made a speech in which she praised British contemporary art, describing it as the most exciting and innovatory in the world. Unexciting as it seemed, her observation was profoundly innovatory, indeed in its small way historic. To my knowledge no British Cabinet Minister, still less a Conservative, has ever given an official seal of approval to what is conventionally regarded as avant-garde art. The (...) Labour Government has echoed its predecessor's praise at a higher volume, as if determined to out-do it. The sanctification by the state of works of contemporary art has now become part of the discourse of officialdom. (shrink)

Arthur Danto's quarter century as art critic for The Nation was crucial, as photography had, by the 1980s and '90s, become very much in vogue in the New York artworld that was his beat. Readers familiar with the corpus of Danto's writing might infer from the discussion that his interest in photography is peripheral to his larger investigation into the ontology of artworks. Consideration of the distinction between stills and natural drawings, or of Kantian ethical concerns, appears foreign to his (...) well‐known consideration of Warhol's 1964 Brillo Box. Danto's consideration of photography reveals that art does essentially involve craft, but it is a craft involving sensitivity to, and dexterity in relation to, aspects of a realm of human interaction, rather than necessarily to materials. Further research may be directed toward refining this new craft and, especially, toward the development of pedagogical techniques suitable to it. (shrink)
