Étudier les actes de requête dans les discours prononcés aux Nations Unies s’avère d’une utilité certaine dans le travail de caractérisation de ce sous-genre diplomatique. La formulation indirecte des actes de langage et les procédés linguistiques qui éloignent les sources potentielles de confrontation révèle des discours contraints par l’exercice de la « politesse », au service de l’impératif institutionnel de valorisation du consensus. Ces discours qui s’éloignent du fonctionnement du langage ordinaire transfèrent la prise en charge de l’énonciation (...) aux États-membres qui sont ici de véritables locuteurs et qui partant parlent en leur propre nom. L’on observe alors l’impact d’un contexte socio-discursif sur le fonctionnement de langue. Les requêtes formulées dans ces discours reflètent les problématiques qui préoccupent les États membres, puisque dans bien des cas, une requête peut être l’aveu d’un manque. Les verbes illocutoires donnent un bon aperçu des « façons de parler » et témoignent d’ores-et-déjà d’une routinisation des pratiques langagières. (shrink)

Pour souligner le 30e anniversaire de la Convention internationale des droits de l’enfant (CIDE), le Groupe de recherche interdisciplinaire en droits de l’enfant (GRIDE) de l’Université de Moncton a organisé son premier colloque international du 26 au 28 novembre 2019, en collaboration avec le Bureau du défenseur des enfants et des jeunes du Nouveau-Brunswick. Ce colloque a permis de dresser un état des lieux éclairant, d’une part pour savoir si les objectifs énoncés dans la CIDE sont atteints avec l’application de (...) la Convention en droit interne et, d’autre part, pour évaluer les défis et les enjeux actuels de la mise en œuvre des droits de l’enfant dans une approche interdisciplinaire et interprofessionnelle. Les Actes du colloque regroupent dans le présent ouvrage cinq textes qui tentent de répondre à ces questions. This article studies the lobbying strategies of national business associations against the background of increasing Europeanization. It addresses the question whether national associations have withered away during the process of European integration. On the basis of neo-functionalist integration theory and the multi-level governance perspective, a number of hypotheses are generated about the fate of national associations in the European integration process. An extensive empirica[ study of the EU financial services sector analyzes these hypotheses. The data show that European financial integration (...) has not caused the withering away of national business associations as predicted by neofunctionalist theory. The data not only confirm the MLG hypothesis that national associations develop direct lobbying strategies at different levels of the EU multi-level system in order to gain access to the European decision-making process. In addition, the results also confirm the hypothesis that national associations undertake indirect lobbying strategies with the aim of gaining institutional access. Finally, the degree to which national associations gain access to the European institutions is explained in terms of a theory of supply and demand for access goods. (shrink)

In spite of its importance in European Union decision making, research on the functioning of the Council is scarce. Based on empirical findings this article gives some new insights in the way Council decision making is institutionalized. The first part focusses on the characteristics of Council working groups and the different positions of actors in the decision making network. Our findings confirm the definition of the Council as a highly bureaucratized institution. Interesting is that the diversity of tasks of the (...) different actors strengthens the impact of national administrations in Council decision making. The second part explores the reasons for this impact. This article adds to the functional approach, which over-emphasizes the adaptive character of the Council, the perception of the Council as an intergovernmental component in a supranational system. It is sometimes assumed that federal States are a novelty introduced at the end of the 18th century in America. The word «federal» is indeed a recent invention but since antiquity politica! structures have existed in Europe having characteristics which may be qualified as federal or confederal.Originally the only power given to the «supra-national institutions» was common defence, but later other powers were added such as external relations, money, federal taxation, direct applicability of federal decisions, common nationality. A bicameral parliament (...) was not introduced until the United Provinces of the Netherlands, but a federal chamber and executif were in existence since the early greek federations. The European Union affects the internal organisation of national political parties. We found 'traces of Europe' in the party statutes of all Belgian parties that are represented in the European Parliament since 1999. Europe is, to a greater or lesser extent, present in party goals, rules on party membership and party organs. Parties have elaborated rules for the organisation of European elections, for the selection of European executives, for the formulation of party programmes, and for internal and external co-ordination of (...) policy formulation. At first sight these rules seem to confirm the hypothesis that Europe is in the first place a concern of party leadership, and that it reinforces centralisation of decision-making. Yet the full confirmation of this hypothesis requires further comparative research on the Europeanisation of political parties. (shrink)

While Christian Democratic parties in several Western European countries are often said to be in crisis, the European People's Party holds the largest parliamentary group in the European Parliament since 1999. This paradox relies on the specificity of the different 'national' electoral logics on the one hand and the realisation of a long-term 'European' majority strategy on the other hand. The alliance with Conservatives and Conservative parties has to overcome an absolute electoral decline in 'old' EU countries and a relative (...) decline through the accession of 'new' member states without Christian Democratic parties. The EPP majority strategy is realised through various ways : the key position of the transnational party and party group, the role of political leadership, the way of decision making, the co-operation with side-organisations, the problem-solving of ideological conflicts, etc. Our analysis proves how the majority strategy of the European Christian Democrats realises its ultimate 'survival strategy' despite several nationalparty crises. Without doubt, the year 2001 will remain identified with the terrorist attacks of september 11. To some extent, this goes for the European Union as well. The events of september 11 left an important mark on the European integration process, of which the development of the European arrest warrant is an important illustration. Nevertheless, as for the European Union, the year 2001 was more than a year of anti-terrorism measures. In the second semester of2001, the Belgian government assumed the presidency (...) ofthe European Union. 2001 was also the year in which, only weeks after street violence disruputed the European Council ofGöteborg, a protester was killed in the margin ofthe G7-G8 Summit in Genova. In 2001, the gap between the European Union and the United States got larger for a number of policy fields, including National Missile Defence and the Kyoto Protocol. Yet, in the autumn of2001, both power blocks reconciliated at the WTO Ministerial Conference in Doha, Qatar. In Doha, a new global round of trade negotiations was launched. As in previous years, in 2001, the enlargement process was high on the European agenda. As for the latter, for the first time, ten candidate countries were mentioned by name, making their accession in 2004 a more realistic scenario. The eastern enlargement will radically change the face of the European Union. The Belgian presidency anticipated this impeding metamorphosis and stimulated the adoption of the Laeken Declaration in december 2001. The Declaration laid the foundation for the Convention on the Future of Europe which started on February 28, 2002. The Declaration of Laeken was one of the European highlights of 2001. The low point was the Irish referendum of June 7, 2001, in which a majority of the Irish population rejected the Treaty of Nice. Both events reflect the situation the European Union is faced with today, as they demonstrate the growing tension between the desires of «widening» and «deepening» the European construction. Be- cause the research involves (...) the use of human embryos, it triggers serious debate on ethical issues. Opponents consider the embryo to be an early form of human life that should be respected and not destroyed. However, the majority of scientists support embryonic stem cell research, believing that it offers good prospects for the treatment of diseases that have remained incurable until now and so will benefit humankind. The Ethics Committee of the Department of Ethical, Legal, and Social Implications of the Chinese National Human Genome Center at Shanghai seriously discussed the ethical debate initiated by embryonic stem cell research. We concluded that we should support the scientists of our country in actively carrying out human embryonic stem cell research for the noble cause of "medicine being a beneficent art." For the healthy and orderly development of human embryonic stem cell research in our country, we put forward the following recommended Ethical Guidelines for Human Embryonic Stem Cell Research as a reference for leaders, administrative departments, and related scientists. Preface Article 1. Human embryonic stem cells are the primitive cells that play the main role in the growth and development of a human body. These [End Page 47] primitive cells have the potential for infinite proliferation, self-renewal, and multi-directional differentiation. If scientists can discover the mechanism of differentiation of human embryonic stem cells, it will be possible to induce differentiation of human embryonic stem cells to form various types of human cells for clinical cell therapy. If human embryonic stem cell research can be integrated with modern biomedical engineering techniques, it also will be possible to make repair and replacement of human tissues and organs a reality. Article 2. There are two ways to classify human embryonic stem cells. One way is to classify them according to their potential for differentiation. There could be three kinds of stem cells: totipotent stem cells, pluripotent stem cells, and unipotent stem cells.A totipotent stem cell has the potential to develop into a whole individual. It can differentiate into the more than 200 cell types in the whole body, construct any tissue or organ of the body, and finally develop into a whole individual. The fertilized egg and the cleavage cells at the very early stage of embryonic development are totipotent stem cells.A pluripotent stem cell has the potential to differentiate into many cell types derived from the three embryonic layers. However, it has lost the capacity to develop into a complete organism.A unipotent stem cell is derived from the further differentiation of the pluripotent stem cell. It can differentiate only into one cell type such as a hematopoietic stem cell, neural stem cell, and others.The other way is to classify human stem cells according to their source. There could be two kinds of human stem cells: embryonic stem cells and tissue stem cells (also called adult stem cells). The former involves experimentation with embryos, which has serious ethical implications. Ethical issues associated with the latter are mainly expressed in the various opinions regarding the allocation of health resources. Article 3. Human embryonic stem cells are the group of cells called the blastocyst inner cell mass during the early stage of embryonic development. They are the main source of totipotent stem cells, and hence the focal and hot point in stem cell research. ABSTRACTSome people might argue that there are already too many different documents, guidelines, and regulations in bioethics. Some overlap with one another, some are advisory and lack legal force, others are legally binding in countries, and still others are directed at narrow topics within bioethics, such as HIV/AIDS and human genetics. As the latest document to enter the fray, the UNESCO Declaration has the widest scope of any previous document. It embraces not only research involving human beings, but addresses broader (...) concerns in medicine and healthcare. The UNESCO draft declaration has some minor weaknesses, but on the whole, the strengths outweigh the weaknesses. One weakness is that some items in the draft are stated in a way that is too restrictive, thereby appearing to rule out legitimate activities. A strength of the Declaration is that it is relatively brief, yet at the same time contains sufficient detail to make it something more than a rehearsal of mere pieties. As the most recent of the numerous bioethics and human rights documents, the UNESCO draft draws on many of the earlier documents and also includes some of the most recent thinking about ethical norms and obligations. Perhaps its greatest strength lies not in details of the principles or their implementation, but rather in its stature as an international declaration issued by a United Nations organization. Turning an Info-Glut into a Library. Science 266 (7 October): 20-22, p. 20), Internet resources now receive numerous levels of organization, from basic directory listings (...) to elaborate "links" (cross-references to other Internet documents) that flash and glow in the dark. In many ways, the Internet functions as a direct extension of the traditional library. Following linked references across various sites is an electronic version of browsing library stacks, and the serendipitous discoveries made while "surfing the Net" recall the wonders of physically going "book-to-book." Although many of the Internet's best aspects augment library strengths by eliminating physical distance from sources, Net resources pose unique problems for researchers. It is not always clear who is responsible for the content of Web documents, when the document was produced, or how often (if ever) it is updated. Internet resource tools, then, must enable researchers to identify appropriate resources and to evaluate what they find when they get there. Web Research as Taking "Snapshots" Given the Internet's visual nature and fluid content, the process of conducting research on the Web has been likened to taking an informal picture of information on a specific date at a particular time. This metaphor also conveys the "zoom-in" aspect of searching through Web pages by going from general to specific categories. In the first section of this Scope Note, National Reference Center for Bioethics Literature (NRCBL) staff present a snapshot of bioethics resources taken during the spring months of 2000. Entries are divided into the categories of directories, electronic journals, full-text documents, news/current awareness, and teaching resources. In the two subsequent sections, this series of categories is repeated for entries on a specific topic within bioethics-genetics-and again for general search and evaluation tools. Where a Web site may contain pages applicable [End Page 175] to more than one category, multiple entries are made for that site with appropriate information for each category.Much as telecommunication advances have strengthened the relationship of patients and providers as partners, the dynamic nature of the Internet acknowledges that the researcher functions as a librarian whenever accessing the Web. It is our hope that BIOETHICSLINE and the other NRCBL databases not only will enable researchers to search the Web more efficiently, but also will help them to evaluate what they find when they get there. Bioethicsline on the Web: An International Plan in Progress Once only available through libraries, the U.S. National Library of Medicine (NLM), the funding agency for the ongoing development of the BIOETHICS LINE® database from the Kennedy Institute, has provided free Web access to that database of 63,000 citations since September 1998 through Internet Grateful Med. Plans are now underway to eliminate such specialty databases and incorporate all citations into PubMed (for journal articles) or LOCATORplus (for book-like materials and chapters in books). Both of these databases are likewise available at no cost on the Web. In the transition to PubMed and LOCATORplus some features of BIOETHICSLINE that presently are available may be lost. Researchers are encouraged to contact the National Reference Center for Bioethics Literature with search requests or for search strategy assistance with either the current or the future system ([email protected]).The inclusion of bioethics citations in PubMed and LOCATORplus will have several advantages. First, unique keywords from the Bioethics Thesaurus will be considered for inclusion in Medical Subject Headings (MeSH), the indexing vocabulary for PubMed and LOCATORplus, thereby enhancing retrieval of relevant clinical literature by offering more precise terminology covering ethical issues. Second, it will be easier to identify foreign-language materials, which are not currently included in the scope of BIOETHICSLINE. Third, the updating schedule will become more frequent.
