According to the Differences of Sex Development Regulations of the International Association of Athletics Federations, Caster Semenya and other athletes with heightened testosterone levels are considered non-eligible for middle distance running races in the women’s class. Based on an analysis of fair equality of opportunity in sport, I take a critical look at the Semenya case and at IAAF’s DSD Regulations. I distinguish between what I call stable and dynamic inequalities between athletes. Stable inequalities are those that (...) athletes cannot impact or control in any significant way such as inequalities in biological sex, body size and chronological age. Dynamic inequalities, such as inequalities in strength, speed and endurance, or in technical and tactical skills, can be impacted and to a certain extent controlled by athletes. If stable inequalities exert significant and systematic impact on performance, they provide a rationale for classification. If high testosterone level is an inborn, strong and systemic driver of performance development, inequalities in such levels can provide a rationale for classification. As is emphasised by the Court of Arbitration for Sport, this leads to a dilemma of rights: the right of Semenya to compete in sport according to her legal sex and gender identity, and the right of other athletes within the average female testosterone range to compete under fair conditions. I conclude with providing conditional support of the CAS decision in the Semenya case and of IAAF’s DSD Regulations. (shrink)

Caster Semenya, a South African 18-year-old, won the 800-metre track running title at the Berlin World Athletics Championships in 2009. Only 3 h later, her gender was being harshly contested. The investigation of the International Association of Athletics Federations (IAAF) was neither discreet nor respectful of her privacy. Caster's case has implications for the ethics of sports and debates about gender and enhancement, and for the philosophical debate about the nature of categories and the classification of people. (...) The IAAF has not disclosed the results of their tests on Caster, and the South African Ministry of Sport has decreed that in any case she can continue running with women in her own country. But could a scientific or medical test offer uncontroversial answers regarding Caster's gender? The concept of ‘gender’ is partly a social construction. Sport is predicated on the idea of victors emerging from a level playing field. All ethically informed evaluate practices are like this; they require an equality of respect, consideration, and opportunity, while trying to achieve substantively unequal outcomes. For instance: limited resources mean that physicians must treat some patients and not others, while still treating them with equal respect; examiners must pass some students and not others, while still giving their work equal consideration; employers may only be able to hire (...) one applicant, while still being required to treat all applicants fairly, and so on. The 800 m is meant to be one of these practices: a level and equidistance running track from which one victor is intended to emerge. The case of Caster Semenya raises challenging questions about what makes level-playing-fields level, questions that extend beyond any given playing field. In the Feature Article for this issue Loland provides us with new and engaging reasons to support of the Court of Arbitration for Sport decision in the Casta Semenya case. The impact of the CAS decision requires Casta Semenya to supress her naturally occurring testosterone if she is to compete in an international athletics events. In his paper, Loland1 offers conditional support for 2019 World Athletics ‘differences of sex development’ regulations,2 upheld that year by the Court of Arbitration for Sport 3 in the case of Caster Semenya. He states this is conditional due to the ‘systemic and psycho-somatic’ impact of hormonal treatment. Loland also calls for ‘further analysis of the nature of athlete classification’ and identifies some welcome options for reducing the significance of sex classifications in sport. While Loland identifies ‘essentialist and (...) reductionist definitions of gender’ as problematic, he finds this inescapable, affirming the case as a ‘dilemma of rights’ where excluding Semenya is ‘protecting the integrity of women’s sport’.1 The idea that Semenya’s participation presents a dilemma necessarily presumes that she is not a woman. Loland’s conclusions support a convenience-based approach to classification of sex where choices about the status of people with intersex variations are made by others according to their interests at that time, inter alia, a woman in situation A if no-one complains, a woman in situation B when subjected to medical intervention, a man in situation C and non-binary in D. Caster Semenya is done with track and field. At 29, her hopes for a continued career as a professional middle-distance runner are dashed. After her case against International Association for Athletics Federation 1 was dismissed by the Court for Arbitration of Sport on 1 May 2019, she has switched to football later in the year.1 Semenya’s case may have come to its legal conclusion, however it has generated an aporia regarding the binary classification in athletics, which has (...) yet to be solved.2 It is time the implications of the fair equality of opportunity principle as a normative basis for the construction of categories in sport are taken seriously to move forward the debate on unfair advantages in sport. This article discusses the imbrication of racialising and sexualising scientific practices of gender testing and verification in elite athletics competition, and their intersection with social politics, using as a theoretical frame the feminist, anti-racist work of Hortense Spillers (2003), Judith Butler (1990, 1993a, 1993b, 2004) and Anne Fausto-Sterling (2000), among others. It traces the practice of sex-gender testing of ‘women’ at sanctioned International Association of Athletics Federations (IAAF) and International Olympic Committee (IOC) track and field competitions in order to contextualise (...) I appreciate all of the commentaries as they raise a series of critical and constructive points. Due to limited space, I can only address some of the issues in brief ways. Knox and Anderson indicate that classification according to testosterone levels should be applied only at the elite level and with a more inclusive approach in amateur and recreational sport. Indeed, I agree, and this is also the case in the International Association of Athletics Federation's Differences of Sexual Development regulations (...) that hold only for international events. A second comment questions whether my use of the adjective ‘systemic’ adds meaning beyond what is already included in ‘stable inequality’. I find ‘systemic’ useful as it emphasises inequalities with effects more or less on the whole organism, but I am definitely open for improving the terminology. A third comment relates to whether inequalities must be inborn to justify classification. This is a valid point, and I need to be more precise. Inequalities need not be inborn. For instance, as Knox and Anderson note, stable testosterone levels can be outcomes of hormone therapy as in the case of elite transwomen athletes. This paper aims to bring a novel approach to the discussion of unfair advantages in sport by looking for a local criterion of fairness instead of a universal criterion. A local criterion of fairness would not solve the general dispute over what counts as an unfair advantage, but it would be beneficial in evaluating specific cases and could guide further discussion about them. We seek a local criterion of fairness by comparing the specific property advantages of Caster Semenya (...) and Eero Mäntyranta. South African Semenya is a middle‐distance runner whose right to compete in the female category has been challenged owing to her assumed difference of sex development and related high level of testosterone. Finnish Mäntyranta was a cross‐country skier with an exceptionally high haematocrit level. We examine whether there is a relevant difference between their advantages that would justify treating the athletes differently. We propose that the criterion ‘not attainable by other athletes in the same category’ could stand as a local criterion of fairness under certain conditions. However, its proper application requires further discussion on how to justify categories in sport. (shrink)

This article aims to systematically deconstruct four distinct narratives derived from the case of Caster Semenya v. IAAF (Court of Arbitration for Sport).

As medical professionals, we outline the science underlying disorders or differences of sexual development (DSD), discuss the nuances of sex and gender and how terminology can differ based on medical vs. non-medical context, briefly review the evidence of the ergogenic effects of hyperandrogenism, and discuss the medical complications with the hormonal contraceptive use currently dictated by World Athletics to allow DSD athletes to compete in the female category.

It is important to note that marriage is one of the main parts of the life cycle amongst the Basotho and not only joins a man and a woman together, but is also considered to unite the members of the respective families of the married couple into one family. This union of two families comes into effect when the process of (...) negotiation of the mahadi is initiated. The negotiation for mahadi is, in other words, the first stage of bonding two families together. This article investigates the practice of vat en sit to offer solutions to church councils of the mainly Black Reformed Churches in South Africa and also to the couples and families involved in such a relationship. Vat en sit is fast becoming a common phenomenon in South Africa. It should be noted that some of the couples in the vat-en-sit relationships may enter into it with no formal agreement. However, there are partners who may enter into this kind of relationship (...) through a universal partnership agreement whereby the couple plan to live together without marrying one another or a domestic life-partnership agreement whereby the couple opt to regulate their rights and duties in a vat-en-sit relationship. It does not, however, affect only the black members of the Reformed Churches in South Africa but also the family structures of society. The article thus endeavours to determine the reasons why many couples go this route and also how church councils could be assisted in dealing with the issue of vat en sit. This article examines the Basotho’s views on sexuality within a theological context as wellas the conflict between Christianity and cultural beliefs. Most Basotho have strong opinions on the subject of sexuality and those views undoubtedly emanate from the Basotho culture,which makes it necessary to evaluate them. The issue of sexuality is always a topic of discussion amongst people and did not go unnoticed by church fathers, like Augustine. Questioning in an organizational context is a challenging event in multiple senses. Questioning may be used to criticize the leaders of an organization. For the criticisms to be heard as legitimate, however, the questioner must operate within contextual constraints. The main purpose of this article is to examine how questioning functions to construct a university's crisis. Discourse within two faculty senate meetings is analyzed. Three faculty questioning strategies are described: appealing to another organizational entity, requesting either/or information; and metacommunicative commentary. (...) Administration and senate leadership responded to questions using the strategies of appealing to a process and metacommunicative commentary. Faculty questioning functioned to challenge a current course of action while operating from within the organizational guidelines of discourse. Alternatively, leadership responses deferred any substantive change in the course of action. The strategies are related to issues of power, social action, and models of educational governance. Comparing the relative sensitivity of direct and indirect measures of learning is proposed as the best way to provide evidence for unconscious learning when both conceptual and operative definitions of awareness are lacking. This approach was first proposed by Reingold & Merikle (1988) in the context of subliminal perception. In this paper, we apply it to a choice reaction time task in which the material is generated based on a probabilistic finite-state grammar (Cleeremans, 1993). We show (1) that participants progressively (...) learn about the statistical structure of the stimulus material over training with the choice reaction time task, and (2) that they can use some of this knowledge to predict the location of the next stimulus in a subsequent “generation” task. However, detailed partial correlational analyses of the correspondence between performance during the reaction time task and the statistical structure of the training material showed that large effects remained even when controlling for explicit knowledge as assessed by the generation task. Hence we conclude (1) that at least some of the knowledge expressed through reaction time performance can not be characterized as conscious, and (2) that even when associations are found at a global level of analysis, dissociations can still be obtained when more detailed analyses are conducted. Finally, we also show that participants are limited in the depth of the contingencies they can learn about, and that these limitations are shared by the Simple Recurrent Network model of Cleeremans & McClelland (1991). El mismo desarrolla la tesis de que la mímēsis es una facultad humana atravesada por la condición paradójica a partir de la cual es factible su instrumentalización alienante de las conciencias, pero también su uso creativo para producir diferencias de lo semejante y semejanzas de lo diferente. la condición paradójica impide el reduccionismo de la mímēsis (...) a una única perspectiva. Inicialmente, seguindo os estudos de Foucault, analisam-se as implicações da governamentalidade sobre a democracia, principalmente a partir da emergência da opinião pública como técnica da razão de Estado. Posteriormente, relacionam-se os estudos de Foucault com as teses de Agamben a respeito da burocracia e a hierarquia, a fim de compreendermos como estas pesquisas desembocam (...) no conceito de democracias espetaculares defendido por Agamben. ABSTRACT This essay presents a critical analysis of the current democracies that have emptied themselves of the deliberative power of the demos to become, more and more, spectacular democracies. Initially, following Foucault's studies, we analyze the implications of governmentality on democracy, especially from the emergence of public opinion as a technique of reason of state. Later, Foucault's studies are related to Agamben's theses on bureaucracy and hierarchy, in order to understand how these researches lead to the concept of spectacular democracies defended by Agamben. En la presente investigación proponemos profundizar en el concepto de ecocidio y sus implicaciones ético-políticas, relacionándolo con los conceptos de soberanía y estado de excepción de Giorgio Agamben. El concepto de excepción, en la tradición jurídica y filosófica, está referido al ámbito de la vida de las personas y no al daño producido a la vida en la naturaleza. Sin embargo, partiendo del presupuesto de que hay una interdependencia de la vida humana con la vida de la naturaleza, se analizan (...) los desdoblamientos ético-políticos a los que esa interdependencia nos conduce, teniendo como eje el concepto de ecocidio. Para este análisis proponemos recorrer los vínculos entre ecocidio y estado de excepción como dos prácticas asimiladas que, para destruir la vida, la reducen a una insignificancia ética a través de un vacío jurídico. En este este estudio presentamos una investigación sobre la genealogía de la razón de Estado y del golpe de Estado, según Michel Foucault. La genealogía de la razón gubernamental se desarrolló paralelamente a la comprensión científica del mundo, en los siglos XVI e XVII, como una realidad gobernada por leyes propias de la naturaleza. La genealogía de la razón de Estado incorporó los elementos “científicos” de la razón gubernamental como técnicas utilitarias para gobernar convenientemente un Estado, más allá del voluntarismo (...) del arbitrio del poder soberano. Foucault muestra en sus análisis genealógicos que el golpe de Estado fue concebido, ya en el siglo XVII, como una técnica gubernamental conveniente con la razón de Estado, cuyas tres principales características son: la necesidad, la violencia y la teatralidad. Na modernidade, ciência e ética raramente conviveram em harmonia. Sua relação conflitante sempre demarca sobre os tipos de verdade de ambos discursos. A construção de qualquer consenso entre os discursos científico e ético se mantém sobre uma base instável de mútua desconfiança. Essa instabilidade implica, comumente, um confronto permanente entre as verdades e os critérios de ambos discursos. O conflito entre ciência e ética se dá, essencialmente, no campo da teoria da linguagem, ou seja, na análise do discurso. As pretensões (...) de verdade e os efeitos de poder das verdades científicas e éticas, são correlativos ao reconhecimento da verdade de suas proposições e da validade do seu discurso. Para contribuir com alguns esclarecimentos neste debate entre ciência e ética, deveremos, pois, nos introduzir em alguns pontos da teoria da linguagem, ou seja, na historicidade e na hermenêutica. This paper aims to present a critique of naturalistic theories of violence. The context of this critique concerns the naturalization of violence, which induces the assimilation power as a form of violence. Therefore, we resumed the theses of Hannah Arendt and Michel Foucault on power and violence. The goal is not to list the differences between these authors on the subject, which are explicit in the development of the test, but show their concordance regarding the critique of power as something (...) synonymous with violence. A partir da segunda metade do século XX, as políticas econômicas disseminaram um conjunto de dispositivos sutis, no sentido de seu exercício, ao mesmo tempo em que mais plurais, em relação à sua extensão. Um dos principais deslocamentos epistemológicos produzidos pelo discurso neoliberal diz respeito à inserção da subjetividade humana como elemento central da racionalidade econômica. A inclusão da subjetividade na lógica dos cálculos econômicos possibilitou construir a figura do homo oeconomicus como referente antropológico do novo discurso neoliberal. Um dos (...) principais autores nessa jornada é Ludwig von Mises. A teoria misiana é profundamente filosófica: dela é possível coletar toda a estrutura da teoria neoliberal e de seu contraste bifocal entre a ação econômica do mercado e a teoria política do Estado, e nela o homo oeconomicus ocupa um lugar central. A genealogia de Michel Foucault sobre o escopo da governamentalidade neoliberal trouxe um olhar crítico diferente sobre os princípios constitutivos deste discurso. A par da teoria de Mises, a leitura de Foucault nos é precisa, na medida em que nos permite contrastar a razão de governo, constituída ao longo dos modelos de pensamento, com aquela ótica empresarial do homo oeconomicus como um suposto sujeito soberano. O intuito deste ensaio é provocar um cruzamento crítico entre o pensamento de Mises e de Foucault, concentrado principalmente no estudo das contradições que surgem no seio do discurso neoliberal da figura do homo oeconomicus como sujeito soberano, com as práticas de governamentalização desse mesmo homo oeconomicus. O ensaio é constituído de três momentos: primeiramente, nosso objetivo é compreender a teoria do mercado de von Mises, com o intuito de alinhavar alguns conceitos importantes, em especial o conceito de soberania do homo oeconomicus; em seguida, temos como pretensão analisar a teoria de Foucault sobre a governamentalidade neoliberal, acenando em direção ao modo pelo qual a teoria de Mises projeta-se como uma razão econômica de governo; em um terceiro ponto, desenvolvemos algumas implicações derivadas dos cruzamentos das teses sobre a soberania do homo oeconomicus, de Mises, com as análises sobre a governamentalidade desse homo oeconomicus desenvolvidas pelos estudos de Foucault. A ética é uma prática que coimplica subjetividade e da alteridade. Nas atuais sociedades de controle se procura fabricar subjetividades destemperadas numa ética do descuido de si. As éticas do cuidado de si visavam ajudar a constituir sujeitos livres pela prática ética da virtude. Os novos dispositivos de controle atualizaram o poder da ética como prática em que o sujeito pode dirimir seu estilo de vida entre a sujeição ou a liberdade. As éticas do cuidado de si desconsideraram a importância (...) da alteridade para pensar a prática ética. Embora existam divergências importantes entre ambas perspectivas éticas, elas coincidem em afirmar a ética como uma prática que incide na constituição dos sujeitos, uma prática de liberdade de si (Foucault) e uma prática de libertação do outro como justiça (Levinas). This article seeks to contribute to the process of reconciliation in South Africa. This is achieved by firstly exploring the meaning of ubuntu as a common culture or religion under a large percentage of South Africa’s people over the borders of language and other cultural values. In the second part of the article two concepts that play a major role in Christianity are explored, namely koinonia and diakonia. Again a large percentage of South Africans believe that the Bible is the (...) Word of God in which the right way of living is described. A comparison is made between the core values of ubuntu and the way of living that emerges from the use of the two concepts of koinonia and diakonia in the New Testament. A way that can contribute to reconciliation is suggested from this comparison. (shrink)

Jackson and Jackson (1995) argue that most current tests used to assess awareness of sequential material are flawed because of their emphasis on accuracy. They propose to distinguish two forms of sequence knowledge: Serial knowledge, that is, knowledge about the specific sequence that stimuli follow, which involves information about the statistical relationship between many sequence elements, and statistical knowledge, or knowledge about the probability of different transitions between adjacent sequence elements. Further, they suggest a new method to analyze generation performance, (...) which involves considering the correlation between subjects' responses and the distribution of transition probabilities, regardless of the accuracy of generation performance. In this comment, we first suggest that the distinction between serial and statistical knowledge is unwarranted except in one case which is not addressed by Jackson and Jackson. We propose instead that all sequence knowledge is essentially statistical in nature. Second, we suggest that using probabilistic instead of deterministic sequences is a better way to approach the assessment of explicit knowledge, and illustrate this contention with empirical and simulated examples based on previous and current research (Cleeremans, 1993; Cleeremans and McClelland, 1991; Jimenez, Mendez and Cleeremans. A tendência de algumas visões naturalistas de deduzir o sentido da ação humana da sua natureza biológica conduz a naturalizar a violência como fenômeno político inexorável. A violência naturalizada leva a sociedade para a dinâmica da inexorável violência, cuja única solução é a legitimação de uma violência total. Propomos, neste ensaio, a desconstrução crítica dos determinismos naturalistas por meio da análise da ação humana e da especificidade de sua potência que se manifesta como potência criadora (Cornelius Castoriadis) e potência do (...) não (Giorgio Agamben). A potência da ação humana transcende os determinismos da sua natureza biológica, embora por eles esteja condicionada. The tendency some naturalist visions have to deduce the meaning of human action from their biological nature, leads to a naturalization of violence as an inexorable political phenomenon. Naturalized violence leads the society towards the dynamics of inexorable violence, whose only solution is legitimazing total violence. In this article we propose the critical deconstruction of naturalistic determinism by means of the analysis of human action and the specificity of its power, which is manifested as creative power (Cornelius Castoriadis) and power of no (Giorgio Agamben). The power of human action transcends the biological determinisms of its biologic nature, although the power of human action is conditioned by them. (shrink)

This essay defends that mimesis is an inherently agonistic and paradoxical human practice. The divergent views on mimesis by Plato and Aristotle, as well as by Adorno and Benjamin, are the philosophical manifestation of an agonistic tension of human mimesis that is not resolved in the exclusive truth of one of the positions, but remains as a permanent possibility to create alternative paths in history.

Este ensaio apresenta uma arqueologia da sacralidade a partir dos estudos de Walter Benjamin e Giorgio Agamben, estabelecendo uma comparação com o sentido da sacralidade nas polis antigas. A sacralidade aparece como figura simbólica marcada pelo paradoxo – ao mesmo tempo que protege a vida pelo direito sagrado, o direito a captura e a ameaça com a exceção. Assim, refletimos acerca do tensionamento e da polifonia entre a vontade de potência em sua configuração fisiopsicológica, e a grande política a partir da transvaloração dos valores. Indicamos essa tensão e polifonia tendo em vista o outro tipo de potência ao qual Agamben se inscreve, a aristotélica, para pensarmos sobre (...) as aberturas políticas que se descortinam a partir da crítica nietzschiana à política e à democracia liberal. Convém atentar ao argumento de Piazzesi de que a vontade de potência sintetiza os âmbitos mecanicista e valorativo que, em relação agonística, explicam a vontade de potência. O projeto Homo sacer começa e termina com uma crítica à biopolítica que Agamben compreende como sendo aquela nietzschiana. Esse é um tensionamento entre a concretização da transvaloração dos valores como possibilidade de superar o niilismo e criar o lastro para a grande política, pois insere no campo da fisiologia uma questão política, do paradigma da autonomia.Nietzsche e Agamben, com suas concepções divergentes de potência, apontam as possibilidades da política e os limites da democracia liberal. BackgroundIn childhood cancer care, healthcare professionals must deal with several difficult moral situations in clinical practice. Previous studies show that morally difficult challenges are related to decisions on treatment limitations, infringing on the child's integrity and growing autonomy, and interprofessional conflicts. Research also shows that healthcare professionals have expressed a need for clinical ethics support to help them deal with morally difficult situations. Moral case deliberations (MCDs) are one example of ethics support. The aim of this study was to describe (...) the MCD-related outcomes that healthcare professionals in childhood cancer care considered important, before MCDs were implemented, in order to facilitate the implementation of MCDs in childhood cancer care in Sweden.MethodsThis study is based on qualitative data. Healthcare professionals, mostly representing registered nurses, nursing assistants and physicians, working at childhood cancer care centres in Sweden, were invited to respond to the translated and content validated European MCD Outcomes Instrument, before participating in regular MCDs. Answers to the main open-ended question, included in the questionnaire, was analysed according to systematic text condensation.ResultsData was collected from 161 responses from the healthcare professionals. The responses included healthcare professionals’ perceptions of which MCD-related outcomes they found important for handling moral challenges. Three different themes of important outcomes from the analysis of the data are presented as follows:Interprofessional well-being in team interactionson a team level;Professional comfort when dealing with moral challengeson a personal level; andImproved quality of care for the child and the familyon a care level.ConclusionsHealthcare professionals in childhood cancer care considered it important that ethics support could enhance the well-being of interprofessional teams, support healthcare professionals on an individual level and improve quality of care. The results of this study can be used in current and future training for MCD-facilitators. When knowing the context specific important MCD-outcomes, the sessions could be adapted. Managers in childhood cancer care would benefit from knowing about the specific important outcomes for their target group because they could then create relevant working conditions for clinical ethics support.
