Mr. Galanas, an eighty‐six‐year‐old man, intentionally shot himself in the chest and abdomen. Surprisingly, the bullet damaged only his distal pancreas and part of his colon, requiring a diverting colostomy to prevent leakage of bowel fluids into his abdomen. After being admitted, he lies intubated in the intensive care unit awaiting surgery to repair his colon. He is responsive but does not demonstrate clear decision‐making capacity. He grudgingly accepts pain medications but refuses antibiotics and antidepressants. He has a living will (...) that gives his wife durable power of attorney and also explicitly states a desire to refuse all medical interventions if he is permanently unconscious or in an end‐stage condition. Mrs. Galanas reports frequent conversations in which her husband said he would not want to be sustained on life support. She also says that he often mentioned he would not want an ostomy bag—a likely, albeit temporary, outcome of the proposed surgery. His physicians are nervous about withholding medical interventions when Mr. Galanas's injury is the result of a suicide attempt and his prognosis is good. Should the care team surgically repair his injured colon, regardless of the patient's capacity, his advance directive, and his wife's statement that he would not want surgery or other life‐sustaining treatment? The adage “an ounce of prevention is worth a pound of cure” is widely used in healthcare settings and can be applied to the work of institutional clinical ethics committees. The model of clinical ethics consultation, however, is inherently reactive: a crisis or question emerges, and ethics experts are called to help. In an effort to employ a proactive component to the model of clinical ethics consultation (as well as to standardize our educational interventions), we developed ethics pocket cards. The (...) purpose of this article is to: (1) describe the rationale for using ethics pocket cards, (2) provide examples of our cards, and (3) begin a dialogue about the potential uses of ethics pocket cards. This paper poses the question, “what are providers’ obligations to patients who lie?” This question is explored through the lens of a specific case: a 26–year–old woman who requests prophylactic bilateral mastectomy with reconstruction reports a significant and dramatic family history, but does not want to undergo genetic testing. Using a conversational–style discussion, the case is explored by a breast surgeon, genetic counselor/medical geneticist, clinical psychologist, chair of a hospital ethics committee and director of a clinical ethics consultation service.

Japanese Hermeneutics provides a forum for the most current international debates on the role played by interpretative models in the articulation of cultural discourses on Japan. It presents the thinking of esteemed Western philosophers, aestheticians, and art and literary historians, and introduces to English-reading audiences some of Japan's most distinguished scholars, whose work has received limited or no exposure in the United States. Bradley's critique of abstract, atomic individualism in social and political theory addresses persistent shortcomings of liberalism. At the same time, his account of the growth of moral order in the individual offers a counterweight to excessively organicist theories of the moral self, which dissolve it into social context and undercut the possibility of non-social, non-trivial moral norms. This thesis argues that Bradley avoids this by complementing the contextual determination of individual ends with a developmental moral psychology that provides a conception (...) of human nature and specific ends which are not socially formed, and develops more fully his conception of the community as the embodiment of moral order. ;In the introduction I describe the development of atomic individualism in social theory and nineteenth century opposition to it. In chapters two and three I examine Bradley's critique of Mill's atomism and Michael Sandel's criticisms of Rawls's social theory and compare these criticisms. The comparison indicates significant agreement between communitarian criticisms of deontological liberalism and Bradley's critique of Mill. ;In chapters four through six I give an account of Bradley's moral psychology which explains his philosophical motivation for espousing social organicism. I examine the notion of self-realization as a psychological principle and make tangible the central importance Bradley gives to realization of the self as a whole. I consider: Bradley's basic psychological "law," its bearing on the early stages of moral development, the development of 'objective interests' which become constitutive of our mature moral identity, Bradley's formula for self-realization, and the nature of some concrete ends which give it substantial content. I incorporate these into a consideration of Bradley's conception of the community or 'moral organism,' and defend this from the objection that it requires strong metaphysical claims. ;In chapter seven I develop the conception further through a comparison of Bradley's ethics to A. E. Murphy's account of the language of moral reasons in The Theory of Practical Reason. My conclusion indicates its present importance by relating it to a recent study of ethical culture in America--Habits of the Heart--and by suggesting its potentially salutary effects. (shrink)

Recently several philosophers have argued that environmental reform movements cannot halt humankind’s destruction of the biosphere because they still operate within the anthropocentric humanism that forms the root of the ecological crisis. According to “radical” environmentalists, disaster can be averted only if we adopt a nonanthropocentric understanding of reality that teaches us to live harmoniouslyon the Earth. Martin Heidegger agrees that humanism leads human beings beyond their proper limits while forcing other beings beyond their limits as weIl. The doctrine of (...) the “rights of man” justifies human exploitation of nonhuman beings. Paradoxically, however, the doctrine of rights for nonhuman beings does not escape the orbit of humanism. According to Heidegger, a nonanthropocentric conception of humanity and its relation to nature must go beyond the doctrine of rights. We can dweIl harmoniously on Earth only by submitting to our primary obligation: to be open for the Being of beings. We need a new way of understanding Being, a new ethos, that lets beings manifest themselves not merely as objects for human ends, but as intrinsically important. Heidegger calls this ethos the “fourfold” of earth and sky, gods and mortals. Humanists argue that Heidegger is wrong to abandon the principle of human rights in favor of the notion that we are obligated to “let beings be,” while some radical environmentalists accuse hirn of being a humanist because he supposedly overestimates the importance of humankind’s ability to speak. Heidegger insists, however, that language makes possible culture, without which thereis no human experience of nature. An environmentally sound ethos. can arise, according to Heidegger, only from a shift within the cultural heritage of the West. Richard Rorty agrees that we must become open for a new “conversation” with the West, even if this requires abandoning traditionally important fields such as epistemology. The need to develop a new understanding of Being is so great that thinkers from the analytic and continental traditions of philosophy are finally initiating a long-overdue dialogue. (shrink)

A considerable body of research has documented the emergence of what appears to be instrumental helping behavior in early childhood. The current study tested the hypothesis that one basic psychological mechanism motivating this behavior is a preference for completing unfinished actions. To test this, a paradigm was implemented in which 2-year-olds (n = 34, 16 female/18 male, mostly White middle-class children) could continue an adult’s action when the adult no longer wanted to complete the action. The results showed that children (...) continued the adult’s actions more often when the goal had been abandoned than when it had been reached (OR = 2.37). This supports the hypothesis that apparent helping behavior in 2-year-olds is motivated by a preference for completing unfinished actions. (shrink)

In December 2006 there was an amendment to the Medicines for Human Use Regulations 2004, the statutory instrument that translated the European directive into UK law. I will demonstrate how the European directive stifled much needed clinical research in urgent critical states whilst there is an international consensus that research in these situations be allowed. The amendments to the UK Medicines for Human Use Regulations 2004 in allowing such exception have failed to preserve the high degree of respect and protection (...) of the participants' interest as reflected in the spirit of the numerous guidelines, conventions and laws appertaining to the ethics of research in clinical emergencies. From the end of the seventeenth century to now well into the 21st, John Locke’s theory of personal identity has been foundational in the field of philosophy and psychology. Here we suggest that there are two fundamental threads intertwined in Lockean identity, the flux of perception-thought-action (i.e. continuity of consciousness) and memory. Using Maurice Merleau-Ponty, Paul Ricoeur, and Bernard Steigler as guides we will see that these threads constitute a phenomenological self (l’ésprit), a lived experience of our identity that is (...) not only perhaps the most essential component of our humanity, but also the most threatened in today’s ongoing, commercial convergence of the real and the virtual in the “Age of Disruption”. ABSTRACTIs it possible to reconcile the concept of conscious agency with the view that humans are biological creatures subject to material causality? The problem of conscious agency is complicated by the tendency to attribute autonomous powers of control to conscious processes. In this paper, we offer an embodied process model of conscious agency. We begin with the concept of embodied emergence – the idea that psychological processes are higher-order biological processes, albeit ones that exhibit emergent properties. Although consciousness, experience, and (...) representation are emergent properties of higher-order biological organisms, the capacity for hierarchical regulation is a property of all living systems. Thus, while the capacity for consciousness transforms the process of hierarchical regulation, consciousness is not an autonomous center of control. Instead, consciousness functions as a system for coordinating novel representations of the most pressing demands placed on the organism at any given time.... (shrink)

All species continuously evolve to adapt to changing environments. The genetic variation that fosters such adaptation is caused by a plethora of mechanisms, including meiotic recombination that generates novel allelic combinations in the progeny of two parental lineages. However, a considerable number of eukaryotic species, including many fungi, do not have an apparent sexual cycle and are consequently thought to be limited in their evolutionary potential. As such organisms are expected to have reduced capability to eliminate deleterious mutations, they are (...) often considered as evolutionary dead ends. However, inspired by recent reports we argue that such organisms can be as persistent as organisms with conventional sexual cycles through the use of other mechanisms, such as genomic rearrangements, to foster adaptation. In today’s society, a peculiar understanding of distributive justice has developed which holds that “social justice must be distributed by the coercive force of government.” However, this is a perversion of the ideal of distributive justice. The perspective of distributive justice which should be considered is one with its roots in the school of thought referred to as self-actualization ethics or eudaimonism, which holds that each person is unique and each should discover whom he or she is—to actualize his or (...) her true potential and to live the “good life” within the congeniality and complementarity of personal excellences of his or her fellow members of community. When a eudaimonistic perspective is considered, a definition of distributive of justice could be “the allocation of goods and utilities via the voluntary ubiquitous human interaction of self-actualizing individuals who not only recognize the human dignity of the self and other and the rights which flow from and guarantee it, but also actively will goods and utilities toward the self and other so as to manifest human dignity.” Therefore, with a eudaimonistic understanding of distributive justice, one can argue that the free market is the ubiquitous interactions of self-actualizing individuals who are giving and receiving goods and utilities for one and another’s own “happiness,” i.e. the free market is the socio-economic mechanism by which distributive justice operates. In this paper I first will overview the philosophical foundations of distributive justice. Next, I will propose a eudaimonistic definition of distributive justice. Finally, I will highlight examples of distributive justice operating in a free market economy. (shrink)
