Este artículo se enfoca en la concepción kantiana de un derecho de guerra, en particular en la controversial figura del enemigo injusto del apartado “Derecho de gentes” de la Rechtslehre, que ha dado pie a que se considere a Kant un teórico de la guerra justa (e. g. Carl Schmitt y B. Orend). Rechazo dicha interpretación y defiendo que al filósofo alemán no se le puede colocar esta etiqueta sin desvirtuar su visión crítica de la guerra, lo que supone comprender, (...) por una parte, la función de esta en el progreso de la humanidad, y, por otra, aceptar el veto de la razón práctica que la prohíbe. Con ese propósito retomo la defensa que hace Howard Williams frente a B. Orend e intento imprimir mayor fuerza a su argumento incorporando la noción de “ley permisiva” al derecho de guerra que se emprende contra el enemigo injusto. (shrink)

En este texto se aborda la cuestión del tipo de violencia que llevó a la matanza de Tlatelolco, en 1968, y a la desaparición de los estudiantes de Ayotzinapa en la llamada “noche de Iguala”, 46 años después. El primero fue el suceso más relevante después de la Revolución mexicana; el segundo, desnudó la colusión de un Estado corrupto con el crimen organizado. Sin duda, en ambos acontecimientos hay una violencia estructural e institucional atribuible al Estado. In Portugal, as elsewhere, the rhetoric of managerialism in higher education is becoming firmly entrenched in the governmental policymakers’ discourse and has been widely disseminated across the institutional landscape. Managerialism is an important ideological support of New Public Management policies and can be classified as a narrative of strategic change. In this paper, we analyse how far the managerialism narrative has been injected into the discursive repertory of Portuguese academics in their role as the co-ordinators of the higher education institutions’ (...) teaching and academic middle levels. Based on an analysis of interview responses, it seems that most academics support traditional academic values such as autonomy and collegiality, and reject university or polytechnic governance based on corporate philosophy. El presente artículo intenta retomar el tema de la injusticia social con el fin de poder construir una caracterización útil para la filosofía política. La hipótesis principal es que el tema de la injusticia es tan importante como el de la justicia —de la cual hay ilustres teorías filosóficas— pero que no puede ser comprendido cabalmente si se le considera solamente como el polo opuesto de esta. En apoyo de esta idea se desarrollan tres dimensiones de la injusticia social: mala (...) distribución de bienes y servicios, exclusión y desempoderamiento, las que se ponen a prueba en un caso particular. De otra parte, se señala la importancia de distinguir a la injusticia de la mala suerte o el infortunio. Estas consideraciones conducen, en la parte final del texto, a tratar el tema de las víctimas y de la posibilidad del cambio. (shrink)

Resumen En este artículo se examina el Darwinismo Neural en su explicación de la evolución de la conciencia humana, contrastando su metodología con la utilizada por Richard Lewontin, Richard Levins y Steven Rose, quienes han hecho importantes aportaciones en el estudio de los sistemas vivos desde un punto de vista dialéctico. Concluimos que la explicación interaccionista de la evolución de la conciencia planteada en el DN, supera muchas de las deficiencias del determinismo biológico; sin embargo, al compartir algunos lineamientos con (...) el cartesianismo, mantiene un carácter a-histórico insuficiente para la explicación de la conciencia humana. Finalmente, proponemos la adopción de una teoría explicativa de la conciencia humana que considere las relaciones existentes en ella, no sólo como interacciones sino también como interpenetraciones ontogénicas y filogenéticas.This article examines Neural Darwinism proposed as an explanation of evolution of human consciousness. His methodology is contrasted with that used by Richard Lewontin, Richard Levins, and Steven Rose, who made important contributions to the study of living systems from a dialectical point of view. We conclude that the interactionist explanation of the evolution of conscience put forward in ND overcomes many of the deficiencies proper to biological determinism. However, as ND also shares many of the foundations of the Cartesian approach, it maintains a non-historical character, insufficient for the account of human consciousness. We suggest the adoption of an alternative theory, able to fully explain human conscience which must consider the whole of existing relations in it, and, instead of merely considering them as interactions, they have to be observed as dialectical interpenetrations. Fifty years after the death of Edmund Husserl, the main founder of the phenomenological current of thought, we present to the public a four book collection showing in an unprecedented way how Husserl's aspiration to inspire the entire universe of knowledge and scholarship has now been realized. These volumes display for the first time the astounding expansion of phenomenological philosophy throughout the world and the enormous wealth and variety of ideas, insights, and approaches it has inspired. Civility is often treated as an essential virtue in liberal democracies that promise to protect diversity as well as active disagreement in the public sphere. Yet the fear that our tolerant society faces a crisis of incivility is gaining ground. Politicians and public intellectuals call for "more civility" as the solution--but is civility really a virtue? Or is it something more sinister--a covert demand for conformity that silences dissent? Mere Civility sheds light on this tension in contemporary political theory and (...) practice by examining similar appeals to civility in early modern debates about religious toleration. In seventeenth-century England, figures as different as Roger Williams, Thomas Hobbes, and John Locke could agree that some restraint on the wars of words and "persecution of the tongue" between sectarians would be required; and yet, they recognized that the prosecution of incivility was often difficult to distinguish from persecution.--. Both the diagnosis and medical treatment of gender dysphoria —particularly in children and adolescents—have been the subject of significant controversy in recent years. In this paper, we outline the means by which GD is diagnosed in children and adolescents, the currently available treatment options, and the bioethical issues these currently raise. In particular, we argue that the families and healthcare providers of children presenting with GD currently face two main ethical dilemmas in decision making regarding treatment: the pathway dilemma and (...) the consent dilemma. Resumo: Meu objetivo aqui é indagar como devemos entender a literatura das sagas, textos em prosa islandeses da Idade Medía; O ápice da produção de sagas ocorreu entre a segunda metade do século XIII e a primeira metade do XIV. Estou interessado de modo geral na representação que essas sagas produziram a respeito do período alto-medieval dos “vikings”, onde frequentemente sucede a ação contida em seus relatos; e pontualmente, na figura dos pagãos e dos magos do período pré-cristão ali apresentada.

The idea that one can 'soak up' someone else's mood or sense the tension in a room is familiar - as in 'negative energy'. This ability to borrow or share states of mind is now pathologized, as the author shows in relation to affective transfer in psychiatric clinics.

This article argues that a particular metaphysical model permeates cultural practices surrounding pregnancy: the foetal container model. Widespread uncritical reliance on this view of pregnancy has been highly detrimental to women's liberty and reproductive autonomy. In this article, I extend existing critiques of the medical treatment of pregnant women to the context of the burgeoning commercial surrogacy industry. In doing so, I aim to show that our philosophical analysis in both spheres is constrained by the presupposition that the foetus and (...) pregnant woman are metaphysically and ethically distinct entities. By exploring the similarities and differences between the expectations placed on pregnant women in these two spheres, I show that the foetal container model is not a homogeneous understanding of pregnancy applied consistently across contexts; rather, it has been used to justify various practices and attitudes toward pregnancy and pregnant women through different moral frameworks, in the service of different overarching aims. In History After Lacan, Teresa Brennan argues that Jacques Lacan was not an ahistorical post-structuralist. She tells the story of a social psychosis, beginning with a discussion of Lacan's neglected theory of history which argued that we are in the grip of a psychotic's era which began in the seventeenth century and climaxes in the present. By extending and elaborating on Lacan's theory, Brennan develops a general theory of modernity. Contrary to postmodern assumptions, she argues, we need a general (...) historical explanation. An understanding of historical dynamics is essential if we are to make the connections between the outstanding facts of modernity--ethnocentrism, the relation between the sexes, and ecological catastrophe. A challenging feminist, interdisciplinary study, History After Lacan will be essential reading for social, cultural, and political theorists, historians, psychoanalysts, and literary theorists. El presente artículo propone un modelo de análisis para orientar el discernimiento y posicionamiento en torno al uso de la IA en educación superior. Analizaremos los cuatro posibles usos de la IA que más incidencia tendrán en esta si se considera el actual desarrollo de esta tecnología. Ellos son: la co-construcción de conocimiento, el uso de IA para tutoría o mentoreo, el auge de las plataformas adaptativas y la capacidad predictiva. Propondremos un ejercicio de análisis para cada uso apelando a (...) algunas de las dimensiones del modelo propuesto para orientar sobre su utilización. El resultado es fecundo, en tanto advierte sobre el riesgo de parcializar el análisis perdiendo de vista las implicancias y los compromisos más profundos que exige el discernimiento sobre el uso de la IA. In _Basic Concepts_, Heidegger claims that "Being is the most worn-out" and yet also that Being "remains constantly available." Santiago Zabala radicalizes the consequences of these little known but significant affirmations. Revisiting the work of Jacques Derrida, Reiner Schürmann, Jean-Luc Nancy, Hans-Georg Gadamer, Ernst Tugendhat, and Gianni Vattimo, he finds these remains of Being within which ontological thought can still operate. Being is an event, Zabala argues, a kind of generosity and gift that generates astonishment in those who experience (...) it. This sense of wonder has fueled questions of meaning for centuries-from Plato to the present day. Postmetaphysical accounts of Being, as exemplified by the thinkers of Zabala's analysis, as well as by Nietzsche, Dewey, and others he encounters, don't abandon Being. Rather, they reject rigid, determined modes of essentialist thought in favor of more fluid, malleable, and adaptable conceptions, redefining the pursuit and meaning of philosophy itself. (shrink)

In this paper I tried to find a harm based solution to the non-identity problem. I explore the view upon which future persons are harmed if we prevent them from having what it is required by the Principle of Utility.

In this paper, we argue for an instrumental form of existence, inspired by Hilbert’s method of ideal elements. As a case study, we consider the existence of contradictory objects in models of non-classical set theories. Based on this discussion, we argue for a very liberal notion of existence in mathematics.

This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

Ever since Mary Astell was introduced as the “First English Feminist” in 1986, scholars have been perplexed by her dual commitments to natural equality and social, political, and ecclesiastical hierarchy. But any supposed “paradox” in her thought is the product of a modernist conceit that treats equality and hierarchy as antonyms, assuming the former must be prior, normative, and hostile to the latter. Seeing this, two other crucial features of Astell’s thought emerge: her ethics of ascent and her psychology of (...) superiority. These, in turn, illuminate her lifelong fascination with ambition as a feminine virtue, as well as her curious embrace of Machiavelli. Astell’s politics and ethics are thus doubly worthy of recovery, both as the product of a singularly brilliant early modern mind and as a fascinating but forgotten vision of “equality before egalitarianism” that sheds light on the persistent complexities of equality and hierarchy to this day.
